AMENDMENTS TO THE LIFE INSURANCE CORPORATION OF INDIA ( STAFF ) REGULATIONS , 1960
No. 65 ( 28 ) -Ins.II/ 1 / 76.-In exercise of the powers conferred by clauses ( b) and ( bb ) of sub - section ( 2 ) of sec . 49 of the Life Insurance Corporation Act, 1956 ( 31 of 1956) the Life Insurance Corporation of India, with the previous approval of the Central Government , hereby makes the following Regulations approva Insurance of India (Staff) Regulations, amend 1960 , namely:-
1. (1 ) These Regulations may be called the Life Insurance Corporation of India ( Staff ) Amendment Regulations , 1977.
( 2 ) They shall come into force on the date of publication in the Gazette.
2. In the Lafe Insurance Corporation of India ( Staff ) Regulations , 1960-
(1 ) In Regulation 19,--
(a) In sub - regulation ( 1 ) , for the words and figures "the appointing autho- rity may direct such employee to retire on completion of 55 years of age or at any time thereafter if his efficiency is found to have

been impaired" , the words and figures "the competent authority may, if it is of the opinion that it is in the interest of the Corporation to do so, direct such employee to retire on completion of 55 years of age or at any time thereafter , on giving him three months notice or salary in heu thereof" , shall be substituted
(b) In Sub- regulation ( 2 ) ~
(1 ) In the opening paragraph, for the words and figures "but the appoint- ing authority may at its discretion extend his service for one year at a time upto 60 years of age . The appointing authority may . however, direct an employee to retire on completion of 55 years of age or at any time thereafter , if his efficiency is found to have been Impaired" the words and figures "but the competent autho- rity may, if it is of the opinion that it is in the interest ofof the Corporation to do so , direct such employee to retire on comple- tion of 50 years of age or at any time thereafter, on giving him three months notice or salary in lieu thereof" , shall be substituted .
(ii ) Explanation 1 and Explanation 2 shall be renumbered respectively as Explanation 2 and Explanation 3 and before Explanation 2 as so renumbered , the following Explanation shall be inserted name- ly-
"Explanation 1 --Where an employee is directed by the competent authority to retire as aforesaid, it shall not be deemed to be a penalty under Regulation 39 or any other provision "
(2) In Schedule IV, before the existing entry against Regulation 19 the fol- lowing entry shall be inserted , namely--
19. To direct an employee to retire on completion of 55 years of age or 50 years of age, as the case may be
MD In respect of employees belonging to Classes II , III & IV and employees in Class I in the cadres of AAO /ABM and AO /BM and equivalent cadres

भारतीय जीवन बीमा निगम कर्मचारी वर्ग विनियम 1960 में संशोधन
सं> 65 ( 28 ) -आई एन एल- III / 1 / 76.--भारतीय जीवन बीमा निगम , जीवन बीमा अधिनियम, 1956 ( 1956 का 31 ) की धारा 49 की उप-धारा ( 2 ) के (ख) और ( खख ) खंडों द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए तथा केन्द्रीय सरकार के पूर्वानुमोदन से भारतीय जीवन बीमा निगम ( कर्मचारी-वर्ग ) विनियम , 1960 को और संशोधित करने के लिए इसके द्वारा निम्मलिखित विनियम बनाता है, जैसे
1. ( 1 ) ये विनियम भारतीय जीवन त्रीमा निगम ( कर्मचारी -वर्ग ) मशोधन विनियम , 1977 कहे जा सकते है ।
( 2 ) ये राजपक्ष में प्रकाशित होने की तारीख से लागू हो जाएगे ।

2. भारतीय जीवन बीमा निगम ( कर्मचारी -वर्ग ) विनियम, 1960 में--
( 1) विनियम 19 में
(क) उप-विनियम ( 1 ) में, " ऐसे कर्मचारी को दक्षता मे कमी पाने पर नियुक्तिप्राधिकारी उसे 55 वर्ष की आयु पूरी हो जाने या उसके बाद किसी भी समय सेवा निवृत्त होने का निदेश दे सकता है " के स्थान पर " यदि सक्षम प्राधिकारी का यह मत हो कि ऐसा करना निगम के हित मे है तो वह ऐसे कर्मचारी को 55 वर्ष आयु पूरी हो जाने या उसके बाद किसी भी समय तीन मास का नोटिस या उसके बदले का वेतन देकर सेवानिवृत्त होने का निवेश दे सकता है " शब्द और अंक ग्खे जाएंगे ।
(ख) उप- विनियम ( 2 ) में-
( i ) प्रारम्भिक पैरा में , " किन्तु नियुक्ति प्राधिकारी अपने विवेक से उसकी सेवा एक बार में एक वर्ष बढ़ा कर 60 वर्ष की आयु तक बढ़ा सकता है । फिर भी यदि ऐसे कर्मचारी की दक्षता में कमी पाई गई हो तो नियुक्ति प्राधिकारी उसे 55 वर्ष की आयु पूरी हो जाने या उसके बाद किसी भी समय सेवानिवृत्त होने का निदेश दे सकता है" के स्थान पर " किन्तु यदि सक्षम प्राधिकारी का यह मत हो कि ऐसा करना निगम के हित में है तो वह ऐसे कर्मचारी को 50 वर्ष की आयु पूरी हो जाने या उसके बाद किसी भी समय तीन मास का नोटिस या उसके बदले का वेतन देकर सेवा निवृत्त होने का निदेश दे सकता है" शब्द और श्रक रखे जाएगे ।
( ii ) स्पष्टीकरण 1 और 2 का पुनरांकन क्रमशः स्पष्टीकरण 2 और 3 हो जाएगा और इस प्रकार पुनगकित स्पष्टीकरण 2 के पहले निम्नलिखित स्पष्टीकरण रखा जाएगा , जैसे
"स्पष्टीकरण 1- जब सक्षम प्राधिकारी द्वारा कर्मचारी को , जैसे पहले कहा गया है, सेवानिवृत्त होने का निवेश दिया जाए तो इसे विनियम 39 श्रथवा अन्य किसी प्रावधान के अंतर्गत कोई दण्ड ( पैनल्टी ) नही माना जाएगा । "
( 2 ) अनुसूची 4 में , विनियम 19 के सामने वर्तमान प्रविष्टि के पहले निम्नलिखित प्रविष्टि रखी जाएगी, जैसे-
क्लास II , III व IV के कर्मचारियो व ए ०।
एम ० डी०
ए ० श्रो ० / ए ० बी० एम ० और ए ० श्रा ० / बी ० एम ० के सवर्गों या समकक्ष संवर्गो में क्लास I के कर्मचारियो के संबध में ।
19 कर्मचारी को 55 वर्ष की आयु या 50 वर्ष की प्रायु , जैसा भी मामला हो, पूरी हो जाने पर सेवानिवृत होने के लिए निदेश देना ।
