S.O. 291 ( E ) -In exercise of the powers conferred by clause ( 3 ) of article 77 of the Constitution , the Vice - President acting as President hereby makes the follow- ing rules further to amend the Government of India ( Allocation of Business ) Rules , 1961 , namely
1. ( 1 ) These rules may be called the Government of India (Allocation of Busi- ness) ( One hundred and twentieth Amendment ) Rules , 1977 .
( 2 ) They shall come into force at once .
2 In the Government of India ( Allocation of Business ) Rules , 1961 , ( herein- after referred to as the said rules ) in the First Schedule,-
(1 ) for entry 8 , the following entry shall be substituted , namely .-- " 8 Ministry of Health and Family Welfare ( Swasthya aur Parivar Kalyan Mantralaya ) .

नई दिल्ली , 7 अप्रैल , 1977
फा० ग्रा० 291 ( श्र ) - राष्ट्रपति के रूप में कार्यरत उप - राष्ट्रपति , संविधान के अनुच्छेद 77 के खण्ड ( 3 ) द्वारा प्रदत्त शक्तियो का प्रयोग करते हुए , भारत सरकार ( कार्य-आवंटन ) नियम, 1961 में और सशोधन करने के लिए निम्नलिखित नियम बनाते है, अर्थात्,
1. ( 1) इन नियमो का नाम भारत सरकार ( कार्य-आवंटन ) ( एक सौ बीसवा मशोधन ) नियम, 1977 है
( 2 ) ये तुरन्त प्रवृत्त होगे ।
2 भारत सरकार ( कार्य -आवंटन ) नियम , 1961 , ( जिसे इसमे इसके पश्चात उक्त नियम कहा गया है ) मे , प्रथम अनुसूची में -
( i ) प्रविष्टि 8 के स्थान पर , निम्नलिखित प्रविष्टि रखी जाएगी , अर्थात्:-
" 8. स्वास्थ्य और परिवार कल्याण मन्त्रालय :
( i) स्वास्थ्य विभाग ।
( ii ) परिवार कल्याण विभाग ।
( ii) प्रविष्टि 9 के स्थान पर, निम्नलिखिन प्रविष्टि रखी जाएगी , अर्थात् - " 9 गृह मन्त्रालय
(मत्नालय मे राजभाषा विभाग और कार्मिक और प्रशासनिक सुधार विभाग सहित ) । ";
( iii ) प्रविष्टि 29 के स्थान पर , निम्नलिखित प्रविष्टि रखी जाएगी , अर्थात् " 29 मत्रिमंडल सचिवालय " ;
3. उक्त नियमो की द्वितीय अनुसूची मे,-
( i ) " राजस्व और बैकिग विभाग " शीर्षक के अन्तर्गत , प्रविष्टि 14 के पश्चात्, निम्न लिखित प्रविष्टि अन स्थापि । को जाएगी , अर्थात्
" 14क प्रवर्तन , अर्थात् विदेशी मद्रा विनियम अधिनियम , 1947 के अधीन भगता के कारण उद्भुत होने वाले मामलो का अन्वेषण , न्याय-निर्णयन और अभियोजन , राजम्व आसूचना महानिदेशालय तथा प्रवर्तन निदेशालय । " ;
( ii) शीर्षक "स्वास्थ्य और परिवार नियोजन मवालय " के स्थान पर , निम्नलिखित शीर्षक रखा जाएगा ग्रर्थात् -
"स्वास्थ्य और परिवार कल्याण मन्त्रालय" , भाग II खं . 3 ( 11 )

( iii ) शीर्षक "स्वास्थ्य और परिवार कल्याण मन्त्रालय " के अन्तर्गत उप- शीर्षक "ब्र. परिवार । जन विभाग " के स्थान पर, निम्नलिखित उप- शीर्षक रखा जाएगा , अर्थात् ; -
"ख. परिवार कल्याण विभाग' ,
( iv ) " गृह मन्त्रालय " शीर्षक के अन्तर्गत , उपशीर्षक ' राजभाषा विभाग " तथा उसके अतर्गत प्रविष्टियो क पश्चात् , निम्नलिखित उपशीर्षक और प्रविष्टियां अन्तः स्थापित की जाएगी , अर्थात् --

4 रेल सेवाओ से भिन्न सेवाओ के संबध मे पदो के वर्गीकरण और राजपवित हैमियत प्रदान करने के सबध में साधारण नीति विषयक मामले ।
5. रेल मंत्रालय , परमाणु ऊर्जा विभाग, इलेक्ट्रानिक्स विभाग और अतरिक्ष विभाग के मिवाए , भारत सरकार के सचिवालय और उसके मलग्न कार्यालयो के लिए अनु- मचिवीय कर्मचारियो की भर्ती ।
6. रेल मन्त्रालय, परमाणु ऊर्जा विभाग , इलेक्ट्रानिक्स विभाग और अतरिक्ष विभाग के मिवाए, भारत सरकार के अधीन मिविल पदों पर अभारतीयो की नियुक्ति ।
7 विभिन्न देशो से आने वाले भारतीय मूल के व्यक्तियो के नियोजन सबधी सहायता देने की बाबत साधारण नीति ।
8 मिविल पदों और सेवाओ में नियुक्ति की बाबत युद्धमेवा-अभ्यथियो को रियायतें ।
9. जो क्षेत्र इम ममय पाकिस्तान में है उन क्षेत्रो से आने वाले विस्थापित सरकारी सेवको और छटनी किए गए अस्थायी कर्मचारियो के पुन स्थापन के संबध मे। साधारण नीति ।
10 लोक सेवाओं में प्रथम नियुक्ति या पुनर्नियुक्ति के विषय मे राजनीतिक पीडितो को रियायते ।
11 अधिवधिना-प्राप्त अधिकारियों के सेवा - विस्तारण और पुनियोजन के संबध मे साधारण नीति ।
12. भारतीय नागरिको से भिन्न व्यक्तियो की बाबत , सघ के अधीन सिविल सेवाओ और पदो पर नियुक्ति के लिए , पात्रता के प्रमाणपत्न देना ।

13. ( क ) विदेश मन्त्रालय के भारतीय तकनीकी और आर्थिक सहयोग कार्यक्रम के अधीन और विपक्षी आधार पर विदेशस्थ भारतीय विशेषज्ञों की एशिया, अफ्रीका और लेटिन अमेरिका के विकारशील देशों में प्रतिनियुक्ति ,
(ख ) संयुक्त राष्ट्र संघ श्रीर उसके महत्रद्ध अभिकरणों के साथ तथा आई०एल ०ओ ० , एफ ० ए ० ओ ० , इत्यादि जैसे उसके अन्य अन्तर्राष्ट्रीय अभिकरणो के साथ नियोजन के लिए अधिकारियों की प्रतिनियुक्ति ।
14 सरकारी सेवा मे नियुक्ति के लिए अर्थ्याययों के चरित्र तथा पूर्ववृत्त - उपयुक्तता सबंधी सत्यापन विषयक साधारण नीति ।
15. उच्चतर पदो के लिए रोजगार कार्यालयो मे ऐसे कार्मिको के रजिस्ट्रीकरण के लिए , जो सेवा मे हो, आर्पत्ति न होने सबधी प्रमाणपत्रो को जारी करने के संबध में नीति विषयक मामले ।
16 मत्त्रियों के वैयक्तिक कर्मचारिवृन्द संत्रधी मामले ।
17. निम्नलिखित के फलस्वरूप केन्द्रीय सरकार के कार्यालयो में अधिशेष हो गए कर्म- चारियों क। पुन अर्धािनयोजन-
( i) प्रणासनिक सुधार;
( ii ) कर्मचारिवृन्द निरीक्षण एक द्वारा किए गए अध्ययन ,
( iii ) दीर्घकालिक किन्तु अस्थायी सगठनों का परिसमापन ।
18 मत्तालयों के नियत्रणाधीन विभिन्न काडरो के समुचित प्रबन्ध के फंबंध में मत्रालयों को सलाह ।
II. प्रशिक्षण
19. ( क ) अखिल भारतीय श्रार केन्द्रीय सेवाओं के लिए प्रशिक्षण नीतिय। तैयार करना और उनका समन्वय ।
( ख ) राष्ट्रीय प्रशासन अकादमी और सचिवालय प्रशिक्षण स्कूल ।
( ग ) भारतीय प्रशासनिक सेवा, केन्द्रीय सचिवालय सेवा , भारतीय आर्थिक सेवा और भारतीय माख्यिकीय सेवा के लिए प्रशिक्षण कार्यक्रम ।
( घ ) प्रशिक्षण संबंधी सामग्री का और प्रशिक्षण तकनीको , सुविधाओ और कार्यक्रर्मों की जानकारी का तैयार किया जाना और उसका प्रकाशन ।
( ड ) राज्यो के भीतर की तथा विदेशो की प्रशिक्षण संस्थाओ के साथ सम्पर्क ।
(च) मध्यम और वरिष्ठ प्रबन्धकगण के स्तरो के लिए पुनश्चर्या तथा विशेष पाठ्यक्रम ।
III सतर्कता और अनुशासत
20 ( क ) भ्रष्टाचार f. राण अधिनियम , 1947 , केन्द्रीय अन्वेषण ब्यूरो ( दिल्ली विशेष पुलिस स्थापन जिसके अन्तर्गत विधिक प्रभाग , तकनीको प्रभाग , नीति प्रभाग और प्रशासन प्रभाग आते है ) , खाद्य सबधी अपराधों की शाखा और श्रार्थिक अपराध शाखा ।

( ख ) दिल्ली विशेष पुलिस स्थापन द्वारा अन्वेषित किसी अपराध के लिए किसी व्यक्ति के अभियोजन के निमित्त उस दशा में मजरी देना जब कि यह अपेक्षित हो कि ऐसी मजूरी केन्द्रीय सरकार द्वारा दी जाए ।
टिप्पण-किसी ऐसे श्रपराध के लिए , जिसका अन्वेषण दिल्ली विशेष पुलिस स्थापन द्वारा न किया गया हो , किसी व्यक्ति के अभियोजन के निमित्त मंजूरी प्रशासन विभाग द्वारा उस दशा में दी जाएगी जब कि यह अपेक्षित हो कि ऐसी मजूरी केन्द्रीय सरकार द्वारा दी जाए ।
( ग ) केन्द्रीय सतर्कता आयोग ;
( घ ) लोक सेवको के मध्य सतर्कता और अनुशासन- संबंधी सभी नीति विषयक मामले ;
( ४ ) ससद् सदस्यों और प्रशासन के बीच संबंध ।
IV . सेवा की शर्ते
21 रेल मन्त्रालय , परमाणु ऊर्जा विभाग , इलैक्ट्रानिक्स विभाग और अन्तरिक्ष विभाग के नियंत्रण के अधीन सेवाओ के सिवाय, अखिल भारतीय और संघ लोक सेवाओं संबधी साधारण प्रश्न ( उनसे भिन्न जिनका बित्त से संबंध है ) , जिनमें आचरण नियम भी आते हैं ।
22. केन्द्रीय सरकार के कर्मचारियो ( रेल मंत्रालय , परमाणु ऊर्जा विभाग , इलैक्ट्रानिक्स विभाग और अन्तरिक्ष विभाग के नियंत्रण के अधीन कर्मचारियों को छोड़कर ) की ये सेवा शर्तें, जो उनसे भिन्न हैं , जिनका वित्त से संबंध है और जिनका विस्तार वहां तक है जहां तक उनसे सेवा साधारण हितों के प्रश्न उत्पन्न होते हैं ।
23. रेल कर्मचारियो से भिन्न सिविल कर्मचारियों के लिए छुट्टी यात्रा सुविधाए ।
