IMPORT TRADE CONTROL

SUBJECT - Import of edible oils and oil seeds under free licensing scheme .
No. 27 - ITC ( PN ) / 77 -Attention is invited to the provisions contained in Appen- dix 2 of the Import Trade Control Policy ( Volume 1 ) for April , 1977 - March , 1978 , as well as to those contained in Public Notice No. 6 - ITC ( PN ) / 77 dated the 17th January , 1977 , as amended by Public Notice No. 7 - ITC ( PN ) / 77 dated the 24th January , 1977, regarding import of edible oils (both refined and un - refined ) and oil seeds .
2. On a review of the position , it has been decided as follows-
( 1 ) All licences for edible olls / oil seeds under free licensing will be issued with a validity period of twelve months . However , the licences will be subject to the condition that the licensee must take firm commitments for import of oils / osi seeds withir a period of three months from the date of issue of the licence , failing which the licence will be auto- matically deemed to have been invalidated for importation The firm commitments will be opening of irrevocable letter of credit , or any other irrevocable commitment to import the goods,

( 11 ) No extension in the period for making firm commitments or in the val dity of the licence 'will be allowed
( 11 ) All licences which have already been issued and against which no firm commitments by way of opening the irrevocable letter of credit , or any other urevocable commitment to import the goods have been made within three months from the date of issue of such licences , will be automatically deemed to have been invalidated for importation ( 1v) All licences which have already been issued will be deemed to have been issued subject to the condition that irrevocable commitment to import the goods should be made within three months from the date of issue of the licences , failing which the licences will be deemed to have been automatically invalidated for importation
( v ) No fresh Licences will be issued to a party who has already obtained a licence , unless it has actually imported the goods against the previous licence A fresh licence will be granted only to the extent to which the previous licence held by that party has been utilised by way of actual imports as shown in the customs copy of the licence

विषय -स्वतन्त्र लाइसेंस योजना के अन्तर्गत खाद्य तेलों और निलहनो का श्रायात ।
संख्या 27 - ब्राई टी सी ( पी एन ) / 77.-अप्रैल , 1977-- मार्च 1978 की आयात व्यापार नियंत्रण नीति ( वा ० J ) के परिशिष्ट 2 मे और सार्वजिनक सूचना सख्या 7 - श्राईटीसी (पीएन ) 77, दिनांक 24 जनवरी , 1977 द्वारा यथा सशोधित सार्वजनिक सूचना स ० 6- आईटीसी (पीएन ) / 77 दिनांक 17 जनवरी , 1977 में निहित खाद्य तेलो ( परिष्कृत और अपरिष्कृत दोनों ) और तिलहनो के श्रायात से सम्बन्धित शर्तों की ओर ध्यान दिलाया जाता है ।
2. स्थिति की पुनरीक्षा करने पर निम्नलिखित अनुसार निश्चय किया गया है--
( i ) स्वतत्न लाइमेस योजना के अन्तर्गत खाद्य तेलों/ तिलहनों के लिए सभी लाइसेम 12 महीनो की वैधता अवधि के लिए जारी किए जाएगे । लेकिन लाइसेंस इम शर्त के अधीन होंगे कि लाइसेंसधारी को लाइसेस जारी होने की तिथि से 3 महीनो की अवधि के भीतर तेलो, तिलहनो के आयात के लिए पक्के सौदे अवश्य करने होगे, ऐसा करने में असमर्थ रहने पर लाइसेस आयात के लिए म्वत अवैध कर दिया समझा जाएगा । पक्के सौदे अर्थारवर्तनीय साख पत्त्र के या माल आयात करने के लिए किमी अ य अपरिवर्तनीय सौदे का प्रारम्भ करेगे ।
( ii ) पक्के सौदे करने के लिए अवधि में वृद्धि करने के लिए या लाइसेस की वैधता में वृद्धि करने के लिए किमी भी परिस्थिति में अनुर्मात नही दी जाएगी ।
( iii ) जो लाइमेस पहले ही जागे कर दिए गए है और जिनके मट्टे अपरिवर्तनीय माखपत्र खोलकर या माल के आयात के लिए कोई अन्य अपरिवर्तनीय सौदा करके उन लाइमेमो के जारी होने की तिथि से सीन महीनों के भीतर कोई भी पषका सौदा नही किया गया है तो ऐसे सभी लाइसेस आयात के लिए स्वत अवैध कर दिए गए समझे जाएगे ।

(iv) पहले ही जारी कर दिए गए लाइसेस इस शर्त के अधीन जारी किए गए समझे जाएगे कि लाइसेस जारी होने की तिथि से तीन महीनों के भीतर माल आयात करने के लिए अपरिवर्तनीय वचनबद्धता कर ली जाएगी , ऐसा करने में असमर्थ रहने पर लाइसेस श्रायात के लिए स्वत' अवैध कर दिए गए समझे जाएंगे
( V) जिस पार्टी ने लाइसेंस पहले ही प्राप्त कर लिया है उसे तब तक नए लाइसेंस जारी नही किए जाएगे जब तक कि पहले लाइसेस के मद्दे माल का वास्तव में आयात न कर लिया गया हो । नया लाइसेंस केवल उसी सीमा तक प्रदान किया जाएगा जिस सीमा तक पार्टी ने पहला लाइसेस, उसकी मीमाशुल्क निकासी प्रति में यथा प्रदर्शित वास्तविक आयात करके उपयोग कर लिया है ।
