New Delhi , the 1st July 1977
G.S R. 431 ( E ) --In exercise of the powers conferred by sub - section ( 1 ) of section 3 of the All India Services Act , 1951 ( 61 of 1951 ) the Central Government after consultation with the State Governments , concerned , hereby makes the following rules further to amend the All India Services ( Leave ) Rules 1955 , namely .--
1 ( 1 ) These rules may be called the All India Services ( Leave ) Third Amend- ment Rules , 1977
( 2 ) They shall come into force on the date of their publication in the Gazette of India
2 In rule 11 of All India Services ( Leave ) Rules , 1955 , ( Hereinafter referred to as the said rules ) , below sub -rule ( 1 ) , the following proviso shall b inserted
"Provided that earned leave granted as leave preparatory to retirement shall be subject to a maximum of 180 days" .
3 For tu'e 13 of the said rules , the following rules shall be substituted , namely
" 13 Commuted Leave . ( 1 ) Commuted Leave not exceeding half the amount of half dav leave due may be granted on medical certificate to a member of the Service subiect to the condition that twice the amount of such leave shall be debitable to the half pay leave due

(2) Commuted leave for a period not exceeding ninety days may be grant- ed to a member of the Service during his entire service when such leave is availed of for course of study which is certified to be in public interest by the Government
( 3 ) No Commuted leave mamay be granted under this rule unless the Gov- ernment has reason to believe that the matter of the Service will return to duty on its expiry "
4 For sub - rule ( 1 ) of Rule 18 of the said rules the following shall he substi- tuted namely -
" ( 1 ) Maternity leave may be granted to a women member of the Service on full pay up to a period of 90 days from the date of its com- mencement . "
5. For sub - rule ( 1 ) of rule 20A of the said rules , the following shall be sub- stituted , namely
" 20A Cash equivalent of leave salary in case of deaths in service .- ( 1 ) Where a member of the Service dies while in service , the cash equi- valent of the leave salary that the deceased officer would have received had he availed himself of earned leave at his credit on the date immediately folloing the date of death subject to a maxi- mum of 180 days , shall be paid to his famıly "
6 In sub - rule ( 2 ) of rule 21 , of the said rules the words , ' Under any Govern- ment or private employer ' shall be omitted
7 In rule 22 of the said rules , for the opening portion beginning with the words , "All orders recalling a member " and ending with the words , " he shall be entitled " , the following shall he substituted , namely ;
"A member of the Service who is recalled to duty before the expiry of the leave granted to him shall be entitled

सा० का ० नि 431 ( प्र) केन्द्रीय सरकार, अखिल भारतीय सेवा अधिनियम , 1951
( 1951 का 61 ) की धारा 3 की उपधारा ( 1 ) द्वारा प्रदत्त शक्तियो का प्रयोग करते हुए , सम्ब राज्य सरकारो से परामर्श करने के पश्चात्, अखिल भारतीय सेवा ( छुट्टी) नियम , 1955 में और सशोधन करने के लिए निम्नलिखित नियम बनाती है, अर्थात्: -
1. ( 1 ) इन नियमों का नाम अखिल भारतीय सेवा ( छुट्टी ) तृतीय सशोधन नियम, 1977 है ।
( 2 ) ये राजस्व में प्रकाशन को तारीख को प्रवृत्त होगे ।
2. अखिल भारतीय सेवा ( छुट्टी ) नियम, 1955 के नियम 11 में ( जिसे इसमे इसके पश्चात् उक्त नियम कहा गया है) , उपनियम ( 1 ) के नीचे नि नलिखित परन्तुक अन्त.स्थापित किया जाएगा
" परन्तु निवृत्ति पूर्व छुट्टी के रुप में मजूर की गई उपार्जित छुट्टी अधिकतम 180 दिन होगी । " भारत का असाधारण राजपत्र

3. उक्त नियमो के नियम 13 के व्थान पर निम्नलिखित नियम रखा जाएगा, अर्थात्
" 13. परिर्वार्तत छुट्टी ( 1 ) बाकी अर्ध वेतन छट्टी अर्वाध की आधे में अनधिक परितित छुट्टो, मेवा के सदस्य को चिकित्सीय प्रमाणपत्र के आधार पर इस शर्त के अधीन रहते हुए मंजूर की जा सकेगी कि ऐमी छुट्टी को दुगनी अवधि बाकी अर्धवेतन छुट्टी के नाम डाली जाएगी ।
( 2 ) नब्बे दिन से श्रनधिक की अवधि के लिए परिवर्तित छुट्टी सेवा के सदस्य को उसकी सम्पूर्ण सेवा के दौरान तब मंजूर की जा सकेगी जब ऐसी छुट्टी किसी ऐसे पाठ्यक्रम के अध्ययन के लिए ली गई है जिसके बारे में सरकार यह प्रमा- णित करें कि वह लोकहित में है ।
( 3 ) इन नियमों के अधीन कोई परिवर्तित छुट्टी तब तक मंजर नही की जाएगी जब तक कि सरकार के पाम यह विश्वास करने का कराण न हो कि सेवा का सदस्य उसकी समाप्ति पर कार्य पर वापस श्रा जाएगा । "
4. उक्त नियमों के नियम 18 के उपनियम ( 1 ) के स्थान पर निम्नलिखित रखा जाएगा , अर्थात्
" ( 1 ) सेवा की महिला सदस्य को प्रसूति छट्टी उसके प्रारम्भ की तारीख मे 90 दिन की अवधि के लिए पूरे वेतन पर मंजूर की जा सकेगी । "
5. उक्त नियमो के नियम 20क के उपनियम ( 1 ) के स्थान पर निम्नलिखित रखा जाएगा , अर्थात् --
" 20- क . सेवा मे रहते मृत्यु की वशा मे छट्ट्टी वेतन का नगदी समतुल्य. ( 1) जब सेवा के किसी मदम्य की सेवा में रहते हुए मृत्यु हो जाए तब छुट्टी वेतन का नगदी समनुन्य , जो मृतक अधिकारी तब प्राप्त करता जब वह मत्यु की तारीख से ठीक पूर्व की तारीख को अपने खाते में जमा उपार्जित छुट्टी 180 दिन के अधिकतम के अधीन रहते हुए , स्वय ले लता उसके कुटुम्ब को दिया जाएगा । "
6 उक्त नियमो के नियम 21 के उपनियम ( 2 ) मे " किसी सरकारी या प्राइवेट नियोजक के अधीन " शब्दों का लोप किया जाएगा ।
7 उक्त नियमों के नियम 22 में " सेवा के सदस्य को" शब्दो मे आरम्भ होने वाले और " वह निम्नलिखित का हकदार होगा " शब्दो से समाप्त होने वाले आरम्भिक भाग के स्थान पर निम्नलिखित रखा जाएगा , अर्थात्- "सेवा का सदम्य , जिसको उसे मजूर की गई छुट्टी की समाप्ति से पूर्व कर्त्तव्य पर वापस बुलाया गया है , निम्नलिखित का हकधार होगा । "
