SUBJECT - Issue of licences for unport of raw materials and components to pro- posed units Submission of bond supported by bank guarantee
No. 56 - ITC ( PN ) /77.-Attention is invited to para 86 ( 9 ) of the Import Trade Control Hand Book of Rules and Procedure , 1977-78 wherein it has been provided that proposed units are required to give a bond supported by a bank guarantee for an amount equal to 25 per cent of the cif value of the import licence / release order , undertaking to produce evidence to the licensing authorities for utilisation of the imported material within a specified time proper
2 It is clarified that the bond and bank guarantee referred to above shall be furnished by the units concerned for 25 per cent of the value of raw materials and components actually imported against a licence and not with reference to the cif value of the import licence Import licences issued to the proposed units will accordingly be issued subject to the condition that the licensee shall

furnish a bond supported by a bank guarantee upto 25 per cent of the value of raw materials and components imported against licences , with the licensing authority at the port of clearance The aforesaid bond and bank guarantee will be required to be given on each occasion and importation takes place against a licence , subsequently
3 The existing sentence in para 86 ( 9 ) of the Import Trade Control Hand Book of Rules and Procedure , 1977-78 , may be deemed to have been substituted by the following.-
" In the case of proposed units referred to in sub para ( 4 ) above , the unit will be required to give a bond ( Appendix 40 ) supported by a bank guarantee for an amount equally to 25 per cent of the value of raw materials and components actually imported against a licence, undertaking to produce evidence to the licensing authority for pro- per utilisation of the imported material within a specified time Such a hond and bank guarantee will be required to be furnished by the licensee on each occasion an importation takes place against the licence ."

विषय. प्रस्तावित एककों के कच्चे माल एवं संत्रटकों के लिए आयात लाइसेस जार करना बैंक गारन्टी के साथ बाण्ड देना ।
सं० 56-श्राई टी सी ( पी एम) 77.--1977-78 वर्ष की आयात व्यापार नियंत्रण नियम एव क्रियाविधि पुस्तक के पैरा 86 ( 9 ) की ओर ध्यान दिलाया जाता है , जिसमे इस बात की व्यवस्था है कि प्रस्तावित एकको को आयात लाइसेस रिहाई आदेश के लागत-बीमा- भाडा मूल्य के 25 % की धनराशि की बैंक गारन्टी के साथ एक बाण्ड देना और लाइसेस प्राधिकारी को निविष्ट समय में आयातित माल के उचित उपयोग का साक्ष्य देने का बचन देना अपेक्षित है ।
2 यह स्पष्ट किया जाता है कि उपर्युक्त उल्लिखित बाण्ड और बैंक गारन्टी सम्बद्ध एकक द्वारा एक लाइसेस के मद्दे वास्तव मे आयातित कच्चे माल एव सषटको के मूल्य के 25% तक दिया जाना चाहिए न कि आयात लाइसेंस के लागत-बीमा - भाडा मूल्य के लिए । प्रस्तावित एककों को जारी किए जाने वाले आयात लाइसेस इस शर्त के अधीन जारी किए जाएगे कि लाइसेंसधारी लाइसेंस के मद्दे आयातित कच्चे माल एव मघटको के मूल्य 25 % तक बैंक गारन्टी के साथ बाण्ड लाइसेस प्राधिकारी को निकासी के पत्तन पर देगा । पूर्वोक्त बाण्ड और बैंक गारन्टी प्रत्येक अवसर पर तब देना अपेक्षित होगा जब एक बाइसेंस के मद्दे आयात कर लिया गया हो ।

3 1977-78 की आयात व्यापार नियवण नियम एवं क्रियाविधि पुस्तक मे पैरा 86 ( 9 ) वर्तमान वाक्य को निम्नलिखित द्वारा प्रतिस्थापित किया गया समझा जाए -
" ऊपर के उप - पैरा ( 4 ) मे उल्लिखित प्रस्तावित एकको के मामले में, एककों को बाण्ड के साथ लाइसेंस के मद्दे वास्तव में आयातित कच्चे माल और सधटको के पूल्य के 25 % के बराबर की धनराशि की बैक गारन्टी और लाइसेम प्राधिकारी की निर्दिष्ट समय में आयातित माल के उचित उपयोग के साक्ष्य देना अपेक्षित होगा । एक लाइसेस के मद्दे जब भी माल आयात किया जाए , प्रत्येक अवसर पर लाइसेस धारी को ऐसे बाण्ड और बैक गारन्टी देना अपेक्षित होगी । "
