RESOLUTION
New Delhi , the 30th August 1977
No. 16-8 / 77 - IF II -Finance Minister , in his reply to a question in the Rajya Sabha on 19-7-1977 on the credit facilities sanctioned to Kohinoor Milis Company Limited , Bombay, had given an assurance that an independent enquiry will be ordered to find out whether the various credit facilities granted to the company by Central Bank of India were in accordance with the normal banking practices and procedures In pursuance of this assurance, Government hereby appoint Shri D. N. Ghosh , Director , Office of the Comptroller and Auditor General New Delhi , as the one - man Enquiry Committee to go into the matter
2. The Committee will look into and fix responsibility in respect of the follow- ing:-
( i ) Whether advances / facilities allowed by Central Bank of India to the company since the beginning of 1972 were made in due course of banking operations and after taking due sanctions and observing normal safeguards and precautions;
( il) Whether there were any lapses , irregularities or impropriety in the conduct of the account by Central Bank of India;

( 111) Whether any undue influence was exercised or undue favour shown in the grant of advances / facilities to the company by Central Bank of India;
( IV) Whether the advances /facilities made were duly authorised by the Reserve Bank of India in terms of the procedures in force and if not, the circumstances under which such authorisation was not given ;
( v ) How far the appraisal , follow up and control mechanism in Central Bank of India was effective and if it was not , the reasons therefor
If it comes to the notice of the Committee that , during the relevant period , any other commercial bank had granted advances /facilities to the company , it will be open to the Committee to look into it , keeping in view items ( 1 ) to ( v ) above
3. Shri Ghosh will give his report to the Government on or about the 15th November , 1977 .

स० 16-3 / 77-प्राई एफ- II. वित्त मन्त्री ने , कोहिनूर मिल्स कम्पनी लिमिटेड , बम्बई को मजूर की गई ऋण सुविधाओ के बारे में 19-7-1977 को राज्य सभा मे एक प्रश्न के उत्तर में आश्वासन दिया था कि यह पता लगाने के लिए स्वतत्त्र रूप से जांच कराने के आदेश दिए आयेगे कि क्या सेट्रल बैंक आफ इंडिया द्वारा इस कम्पनी को विभिन्न ऋण सुविधाए सामान्य बैंकिंग व्यवहार और प्रक्रिया के अनुसार दी गई थी । इस आश्वासन के अनुसरण मे , सरकार , नियंत्रक और महालेखापरीक्षक का कार्यालय , नई दिल्ली के निदेशक श्री डी० एन ० घोष को इस मामले की जांच करने के लिए एक -सदस्यीय जांच -समिति के रूप में नियुक्त करती है ।
2 ममिति निम्नलिखित के बारे मे जाच करेगी तथा जिम्मेदारी निर्धारित करेगी .--
(1) क्या 1972 के आरम्भ से सेट्रल बैंक आफ इडिया द्वारा इस कम्पनी को स्वीकृत किए गए ऋण, बैंकिग परिचालन मे यथाविधि तथा उचित मंजूरी लेने और सामान्य सुरक्षणो तथा सावधानियो के बाद दिए गए थे ;
( 2 ) क्या सेंट्रल बैंक श्राफ इंडिया द्वारा खाते के संचालन में कोई भूले , अनिय- मितताएं अथवा अनुचित व्यवहार किए गए थे ;
( 3 ) क्या सेंट्रल बैंक आफ इंडिया द्वारा कम्पनी को ऋण/ सुविधाएं मंजूर करने मे कोई अनुचित प्रभाव डाला गया था अथवा अनुचित पक्षपात दिखाया गया था :

( 4) क्या ऋण/ सुविधाए चालू प्रक्रिया के अनुसार भारतीय रिजर्व बैंक द्वारा यथाविधि प्राधिकृत की गयी थी और यदि नहीं तो वे कौन सी परिस्थितिमां थी जिनमे ऐसा प्राधिकरण नही किया गया था,
( 5) सेंट्रल बैंक आफ इडिया का मूल्याकन , अनुवर्ती कार्य और नियंत्रण का तंत्र किस सीमा तक प्रभावी था और यदि वह प्रभावी नही था तो उसके कारण ।
यदि समिति के ध्यान में यह आता है कि सम्बन्धित अवधि के दौरान किसी अन्य बाणिज्यिक बैंक द्वारा इस कम्पनी को ऋण सुविधाए मंजूर की गई थी तो उक्त विषय (1) से ( 4 ) तक को ध्यान में रखते हुए उसकी जाच करने के लिए यह समिति स्वतंत्र होगी ।
3 श्री घोष अपनी रिपोर्ट 15 नवम्बर , 1977 को अथवा उसके आस पास सरकार को प्रस्तुत कर देंगे ।
आदेश
आदेश दिया जाता है कि सामान्य सूचना के लिए इस संकल्प को भारत के राजपत्र में प्रकाशित किया जाए ।
