New Delhi , the 4th November 1977
5.O. 751 ( E ) . In exercise of the powers conferred by section 114 , read with sub - section ( 6 ) of section 27 , of the Gold ( Control ) Act , 1968 ( 45 of 1968 ) , the Central Government hereby makes the following rules further to amend the Gold Control ( Licensing of Dealers ) Rules , 1969 , namely: -
1 ( 1 ) These rules may be called the Gold Control ( Licensing of Dealers ) Amendment Rules , 1977
(2) They shall come into force on the date of their publication in the Official Gazette.
2 In rule 2 of the Gold Control ( Licensing of Dealers ) Rules , 1969 , in clause ( 1) .-
(1) in the proviso-
(1) In clause ( c) -
(a) in item ( 1 ) , for the words " one lakh rupees " , the words " ten thousand rupees " shall be substituted;

(b) in item ( 11 ) , for the words " one thousand grammes " , the words "one hundred grammes " shall be substituted ,
( 11 ) after clause ( d ) , the following clauses shall be inserted , namely :-
" (e) a person who was a partner for a period of not less than five years in any firm licensed under these rules to deal in gold , if such application is made within a period of sixty days of his leaving the said firm , for the issue of a licence to be a dealer in the same city or town or district , as the case may be , in which the said firm was licensed ,
( f) a person who was employed in the shop of a licensed dealer ( here- mafter referred to as the said dealer ) and who is found by the Admınıstıator , after making such inquiry as he may consider necessary , to posses experience in dealing in, or making , manu- facturing , preparing or repairing of , ornaments for a period of not less than five years , if such application is made within a period of sixty days of his leaving such employment , for the issue of a licence to be a dealer in the same city or town or district , as the case may be , in which the saud dealer was licensed " , app
(2) in Explanation II , for the worlds " five thousand grammes " , the words "two thousand grammes ' shall be substituted .

का० प्रा. 751 ( थ) -केन्द्रीय सरकार, स्वर्ण ( नियत्रण) अधिनियम, 1968 ( 1968 का 45 ) की धारा 27 की उपधारा ( 6 ) के साथ पठित धारा 114 द्वारा प्रदत्त शक्तियो का प्रयोग करते हुए, स्वर्ण नियन्त्रण ( व्यवहारियो का अनुज्ञापन ) नियम, 1969 में और संशोधन करने के लिए निम्नलिखित नियम बनाती है, अर्थात्:--
1. ( 1 ) इन नियमों का नाम स्वर्ण नियंत्रण (व्यवहारियों का अनुज्ञापन ) संशोधन नियम, 1977 है ।
( 2) ये राजपत्न में प्रकाशन की तारीख को प्रवृत होगे ।
(च) मे, 2 स्वर्ण नियंत्रण ( व्यवहारियो का अनुज्ञापन ) नियम, 1969 के नियम 2 के खण्ड
(1 ) परन्तुक में--
(i ) खण्ड ( ग ) में
(क) मद (i ) मे "एक लाख रुपए" शब्दो के स्थान पर "दस हजार रुपए " शब्द रखे जायेगे; ।
(ख) मद ( ii ) से " एक हजार ग्राम " शब्दो के स्थान पर " एक सौ ग्राम" शब्द रखें जायेगे ; 1 भाग 11-खं . 3 (ii )

( ii ) खण्ड ( घ ) के पश्चात् निम्नलिखित मन्त. स्थापित किया जाएगा, भर्थात्:--
"( ङ) इन नियमो के अधीन स्वर्ण का कारबार करने के लिए धनुज्ञप्त किसी फर्म मे कम से कम पाच वर्ष भागीदार रह चुका व्यक्ति , यदि उक्त फर्म छोडने के साठ दिन के भीतर , उसी महर , नगर या जिले में, जिसमे उक्त फर्म अनुज्ञप्त थी , व्यवहारी होने के लिए अनुज्ञप्ति जारी किए जाने के लिए आवेदन करता है ,
( च) व्यक्ति, जो अनुज्ञप्त व्यवहारी ( जिसे इसमे इसके पश्चात् उक्त व्यवहारी कहा गया है ) की दूकान मे नियोजित था और जिसके बारे में प्रणासफ को , ऐसी जांच करने के पश्चात् जैसी वह प्रावश्यक समझता है , यह ज्ञात हो जाता है कि उसे भाभूषण बनाने , विनिर्मित करने , तैयार करने या उनकी मरम्मत करने का कम से कम पांच वर्ष का अनुभव है, यदि ऐसा नियोजन छोडने के साठ दिन के भीतर , उसी शहर , नगर या जिले में , जिसमे उक्त व्यवहारी अनुज्ञप्त था , व्यवहारी होने के लिए अनुज्ञप्ति जारी किए जाने के लिए आवेदन करता ह । "
( 2) स्पष्टीकरण 2 मे " पाच हजार ग्राम" शब्दों के स्थान पर " दो हजार ग्राम" शब्द रखे जाएंगे ।
