सा० फा० ति० 557 (अ) खान नियम , 1955 में और संशोधन करने के लिए कतिपय नियमों का एक प्रारूप , खान अधिनियम , 1952 (1952 का 35) की धारा 59 की उपधारा ( 1 ) की अपेक्षानुसार, भारत सरकार के श्रम मंत्रालय की अधिसूचना सं ० सा० का ० नि० 1585 तारीख 31 अक्तूबर, 1977 के अधीन भारत के राजपत्र , भाग 2, खण्ड 3 , उपखण्ड ( 1) , तारीख 19 नवम्बर , 1977 के पृष्ठ 3239- 3248 पर प्रकाशित किया गया था , जिसमें राजपक्ष में, उक्त अधिसूचना के प्रकाशन की तारीख से चार मास की समाप्ति तक उन सभी व्यक्तियों से श्राक्षेप या सुझाव मांगे गए थे , जिनके उससे प्रभावित होने की संभावना थी;
और उक्त राजपत्त 19 नवम्बर , 1977 को जनता को उपलब्ध करा विया गया था;
और केन्द्रीय सरकार ने उक्त प्रारुप की बाबत जनता से प्राप्त झाक्षेपों और सुझावों पर विचार कर लिया है ;
अतः अब, केन्द्रीय सरकार, उक्त अधिनियम की धारा 59 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , उक्त प्रारूप को अधिनियम के अधीन गठित खनन बोडौँ को निविष्ट करने के पश्चात् और ऐसे बोडों को

उक्त अधिनियम की धारा 59 की उपधारा ( 4) की अपेक्षानुसार उक्त संशोधन करने की समीचीनता के बारे में तथा उनकी उपयुक्ता के बारे में रिपोर्ट देने का युक्तियुक्त अवसर वेने के पश्चात् खान नियम 1955 में और संशोधन करने के लिए निम्नलिखित नियम बनाती है अर्थात्:-
1. ( 1) इन नियमों का नाम खान ( संशोधन ) नियम, 1978 है
( 2) ये उस तारीख को प्रवृत्त होंगे जो केन्द्रीय सरकार राजपत्र में अधिसूचना द्वारा नियत करे और खानों के विभिन्न वर्गों या बानों में नियोजित व्यक्तियों के लिए विभिन्न तारीखें नियत की जा सकती है । "अध्याय 4क:
खानों में नियोजित या नियोजित किए जाने वाले व्यक्तियों की स्वास्थ्य परीक्षा ।
29-क. इस अध्याय का लागू होना-इस अध्याय की कोई भी बात उन व्यक्तियों को लागू नहीं होगी जो छह मास से अनधिक की निरंतर अवधि के लिए बिल्कुल अस्थायी या नैमित्तिक आधार पर नियोजित हैं ।
29-ख . प्रारंभिक और कालिक स्वास्थ्य परीक्षाएंः ऐसी तारीख या तारीखों के पश्चात्वात् जो केन्द्रीय सरकार राजपत्र में इस निमित्त अधि- सूचना द्वारा नियत करे , प्रत्येक खान का स्वामी , श्रभिकर्ता या प्रबंधक निम्नलिखित के लिए व्यवस्था करेगा :--
(क) ( 1) इस प्रकार अधिसूचित तारीख से पांच वर्ष की अवधि के भीतर , खान में नियोजित प्रत्येक व्यक्ति की आरंभिक स्वास्थ्य परीक्षा के लिए और उक्त स्वास्थ्य परीक्षा की

पांच वर्ष की अवधि के दौरान इस प्रकार व्यवस्था की जाएगी कि खान में नियोजित व्यक्तियों के पांचवें भाग की प्रत्येक वर्ष परीक्षा हो जाए :
परन्तु ऐसी खान के मामले में , जहां ऐसी ( मुख्य निरीक्षक द्वारा यथा श्रवधारित समतुल्य स्तर की ) स्वास्थ्य परीक्षा की जानेकी पद्धति पहले ही उपयुक्त तारीख से पूर्व विद्यमान है, यहां ऐसे व्यक्ति की बाबत जिसकी ऐसी पञ्चति के अधीन उस तारीख को, तो उपर्युक्त तारीख से पूर्व पांच वर्ष से पूर्व सो न हो, स्वास्थ्य परीक्षा हो गई है , यह समझा जाएगा कि इसा उप- खण्ड के अधीन उसकी स्वास्थ्य परीक्षा हो गई है और उक्त पद्धति के अधीन उसकी स्वास्थ्यपरीक्षा की अंतिम तारीख को, इन नियमों के अधीन उसकी भ्रारंभिक स्वास्थ्य परीक्षा की तारीख समझा जाएगा ।
( 2) किसी खान में नियोजन वाहने वाले प्रत्येक व्यक्ति की भारंभिक स्वास्थ्य परीक्षा के लिए , जब तक कि ऐसे व्यक्ति की पहले ही, पूर्ववर्ती पांच वर्षों के भीतर , किसः अन्य खान में नियोजन के दौरान इन नियमों के अधीन स्वास्थ्य परीक्षा न हो गई हो ;
(ख) खान में नियोजित प्रत्येक के अन्तरालों पर तत्पश्चात् व्यक्ति की पांच वर्ष से अनधिक कालिक स्वास्थ्य परीक्षा के लिए ।
297. परीक्षा प्राधिकारी पूर्वोक्त स्वास्थ्य परीक्षा , खान के लिए नियुक्त चिकित्सा अधिकारी या खान के स्वामी के नियोजन में के चिकित्सा अधिकारी द्वारा , यदि कोई हो , या कोयला खान कल्याण निधि संगठन या किसी भन्य खान कल्याण संगठन में नियोजित किसी चिकित्सा अधिकारी द्वारा , जिसके न हो सकने पर राज्य या केन्द्रीय सरकार के किसी ऐसे चिकित्सा अधिकारी द्वारा , जो सहायक सिविल सर्जन की पंक्ति से निम्नतर न हो , कीजाएगी ।
29थ. स्वास्थ्य परीक्षा की सूचना घ-( 1 ) नियम 29-ख के अधीन प्रत्येक स्वास्थ्यपरीक्षा की बाबत, संबंधित खान का प्रबंधक , परीक्षित किए जाने वाले व्यक्ति को कम से कम बीस दिन की लिखित रूप में पूर्ण सूचना प्ररूप " ड" में देगा, परन्तु किसी खान में नियोजन चाहने बाले व्यक्ति की श्रारंभिक परीक्षा के मामले में, सूचना की अधि लधुतर हो सकेगी ।
( 2) जारी की गई ऐसी प्रत्येक सूचना की एक प्रति , प्रबंधक द्वारा परीक्षाः प्राधिकारी को भेजी जाएगी और किसी व्यक्ति की 'कालिक स्वास्थ्य परीक्षा के मामले में , संबंधित व्यक्ति के बारे में प्ररूप " ण" में जारी किए गए पूर्यतन स्वास्थ्य प्रमाणपत्तों की प्रतियां भी प्रबंधक द्वारा परीक्षा प्राधिकारी को भेजी जाएगी ।
( 3 ) उस व्यक्ति को , जो किसी युक्तियुक्त हेतु के कारण स्वास्थ्य परीक्षा के लिए अपने को उपनियम ( 1 ) के अधीन उसे जारी की गई सूचना के अनुसार प्रस्तुत नहीं करता है, प्रबंधक द्वारा प्ररूप "व " में न्यूनतम दस दिन की अवधि की दूसरी सूचना दी जाएगी और ऐसी प्रत्येक सूचना की एक प्रति प्रबंधक द्वारा परीक्षा प्राधिकारी को भेजी जाएगी ।
(4) परोक्षा प्राधिकारी प्रबंधक को सूचित करेगा कि क्या संबंधित व्यक्ति ने स्वास्थ्य परीक्षा के लिए अपने को प्रस्तुत किया है या नहीं ।
298. स्वास्थ्य परःक्षा करना यह व्यनित जो युक्तियुक्त हेतुक के बिना नियम 29 - घ के उपनियम ( 3 ) के अधीन उसे जारी की गई सूचना के अनुसार स्वास्थ्य परीक्षा के लिए अपने को प्रस्तुत नहीं करता है,

परन्तु ऐसे व्यक्ति से , जो स्वास्थ्य परीक्षा के लिए स्वयं को प्रस्तुत करने में असफल रहने के कारण स्वयं को पदच्युत किए जाने की वायी बनाता है यह हेतुक दशित करने की अपेक्षा की जाएगी कि वह उक्त सूचना में विनिर्दिष्ट समय के भीतर सूचना का पालन क्यों नहीं कर सका । यदि उसका स्पष्टीकरण प्रबन्धतंत्र द्वारा समाधानप्रद पाया जाता है तो उसे स्वास्थ्य परीक्षा में प्रस्तुत होने के लिए एक और अवसर विया जाएगा । यदि उसका स्पष्टीकरण प्रबन्धतंत्र द्वारा समाधानप्रद नहीं पाया जाता है तो उसकी सेवा प्रबंधतंत्र द्वारा समाप्त कर दी जाएगी:
परन्तु यह और किसी विवाद की दशा में उक्त व्यक्ति को खान के स्वामी, अभिकर्ता या प्रबंधक द्वारा संसूचित आदेश के 60 दिन के भीतर मुख्य निरीक्षक को उसके विनिश्चय के लिए निविष्ट किया जाएगा । आरंभिक स्वास्थ्य परीक्षा प्ररूप त-1 में अधिकथित मानक के अनुसार की जाएगी ।
( 2 ) परीक्षा के पश्चात् यथा शाक्य शीघ्र प्ररूप ' ण ' में स्वास्थ्य प्रमाणपत्र की एक प्रति परीक्षा प्राधिकारी द्वारा संबंधित व्यक्ति को रजिस्ट्री डाक से भेजी जाएगी या रसीद लेकर परिदत्त की जाएगी और एक अन्य प्रति संबंधित खान के प्रबंधक को रजिस्ट्री डाक से भेजी जाएगी या रसीद लेकर परिवत्त की जाएगी ।
लेगा । ( 3 ) परीक्षा प्राधिकारी स्वास्थ्य प्रमाणपत्र की तीसरी प्रति रक्ष
(4) किसी व्यक्ति की कालिक स्वास्थ्य परीक्षा के मामले में परीक्षा प्राधिकारी नियम 29 -घ के उप नियम ( 1 ) के अनुसरण में संबंधित व्यक्ति के पूर्वतन स्वास्थ्य प्रमाणपत्र की प्रति भी संबंधित खान के प्रबंधक को भेजेगा ।
29-छ . स्वास्थ्य प्रमाण-पत्रों का रखा जाना तथा अन्तरण-( 1) किसी खान में नियोजित या नियोजित किए जाने वाले व्यक्तियों के सभीस्वास्थ्य प्रमाण - पत्र तब तक जब तक कि ये व्यक्ति खान में नियोजित हैं और तत्पश्चात् पांच वर्ष की अवधि तक खान के प्रबंधक के कब्जे में रखे जाएंगे :
परन्तु उस खान का प्रबंधक जहां ऐसा व्यक्ति नियोजित है या नियोजित था किसी अन्य ऐसी खान के प्रबंधक द्वारा जहां वह व्यक्ति नियोजित किया जाना है ऐसी प्रार्थना की जाने पर उसको ऐसे व्यक्ति के संबंध में सभी स्वास्थ्य प्रमाण-पत्र भेजेगा ।
( 2 ) यवि वह परीक्षा अधिकारी जो किसी खान में नियोजित किए आने वाले व्यक्तियों की स्वास्थ्यपरीक्षा करता है स्वास्थ्यपरीक्षा के संबंध में अपने कर्तव्यों से अवमुक्त हो जाता है तो वह चिकित्सा व्यवसायी अपने कब्जे में के स्वास्थ्यपरीक्षा सम्बन्धी सभी अभिलेख संबंधित खान के प्रबंधक को अन्तरित कर देगा ।
29-ज. अभ्यर्थियों की पहचान:--( 1 ) ( नियम 29 -ख के खण्ड (क) के अधीन स्वास्थ्य परीक्षा के लिए प्रत्येक अभ्यर्थी परीक्षा के समय अपने तीन बिना मढ़े ( पासपोर्ट भाकार के ) फोटो परीक्षा प्राधिकारी को देगा । परीक्षा प्राधिकारी अपना यह समाधान कर लेने के पश्चात् कि प्रत्येक फोटो अभ्यर्थी की प्रतिकृति है उनमें से प्रत्येक पर अभ्यर्थी का नाम और उसके पिता का नाम या पति का नाम पृष्ठांकित करेगा ।
(2) परीक्षा प्राधिकारी अपने सामने स्वास्थ्य परीक्षा के लिए उपस्थित होने वाले प्रत्येक अभ्यर्थी के बायें हाथ की अंगूठा मिशामी या हस्ताक्षर भी प्ररूप ' ण ' में स्वास्थ्य प्रमाण-पत्र की प्रतियों पर अभिलिखित करेगा ।
29 स. स्त्रियों की स्वास्थ्य परीक्षा किसी भी स्त्री की उसकी सहमति के बिना किसी पुरुष चिकित्सा व्यवसायी द्वारा स्वास्थ्य परीक्षा किसी अन्य स्त्री की उपस्थिति में के सिवाय नहीं की जाएगी ।

29 का. पुनः परीक्षा के लिए अपील: -( 1 ) जहां नियम 29 -ख
के खण्ड ( क ) के अधीन श्रारम्भिक स्वास्थ्य परीक्षा या नियम 29 ख के खण्ड ( ख ) के अधीन कालिक स्वास्थ्य परीक्षा के परिणामस्वरूप किसी व्यक्ति को खानों में या खोनों के किसी विशिष्ट प्रवर्ग में या खान में किम्हीं विनिर्दिष्ट प्रक्रियाओं में नियोजन के लिए अनुपयुक्त घोषित कर विया गया है तो वह नियम 29 च के उपनियम ( 2 ) में निविष्ट अधीन स्वास्थ्यप्रमाण-पत्र की प्रति की अपने को प्राप्ति के तीस दिन के भीतर खान के प्रबंधक को उपर्युक्त घोषणा के विरुद्ध अपील वाखिल कर सकेगा और नियम 29 ट के अधीन गठित किसी अपील चिकित्सा बोर्ड द्वारा पुनः स्वास्थ्य परीक्षा की जाने के लिए प्रार्थना कर सकेगा ।
(2) ( क) प्रबंधक अपील की प्राप्ति के तीस दिन के भीतर अपील विकित्सा बोर्ड द्वारा अपीलार्थी को पुनः स्वास्थ्य परीक्षा की जाने की व्यवस्था करेगा और अपीलार्थी को प्ररूप ' घ' में अपील चिकित्सा बोर्ड द्वारा स्वास्थ्य पुन. परीक्षा की 15 दिन की पूर्व सूचना वेगा ।
(ख ) किसी व्यक्ति को जो किसी युक्तियुक्त हेतुक के बिना खण्ड ( क ) के अधीन अपने को दी गई सूचनाओं के उपबंधों के अनुसार स्वास्थ्य पुनः परीक्षा के लिए अपने को प्रस्तुत नहीं करता प्ररूप ' व' में उसी रीति से भ्रश्य सूचना वी जाएगी ।
(ग ) ऐसा व्यक्ति जो युक्तियुक्त हेतुक के बिना खण्ड (ख ) के अधीन उसे वी गई सूचना के अनुसार स्वास्थ्य पुनः परीक्षा के लिए अपने को प्रस्तुत नहीं करता है उसकी स्वास्थ्य पुनः परीक्षा के लिए अधिसूचित अंतिम तारीख से तीस दिन की समाप्ति के पश्चात् यथास्थिति खान में या खानों के किसी विशिष्ट प्रवर्ग में या खान में किन्हीं विनिविष्ट संक्रि- याओं में नियोजन में नहीं रहेगा ।
( 3 ) अपील चिकित्सा-बोर्ड द्वारा प्रत्येक स्वास्थ्य पुनः परीक्षा की बाबत अपीलार्थी ऐसी फीसें देगा और स्वास्थ्य परीक्षा ऐसी रीति से होगी जो कि अपील चिकित्सा बोर्ड द्वारा अवधारित की जाएं । यदि अपील चिकित्सा बोर्ड उसे खानों में नियोजन के लिए उपयुक्त पाता है तो उस अपीलार्थी को फीसों की पूर्णरूपेण प्रतिपूर्ति उस खान के जिस में बह ; नियोजित है स्वामी द्वारा की जाएगी ।
29. ट अपील चिकित्सा बोर्ड का गठन अपील पर स्वास्थ्य पुनः परीक्षा के प्रयोजन के लिए अपील चिकिस्सा बोर्ड निम्नलिखित से मिलकर बनेगा अर्थात्:-
(क) खान सुरक्षा महानिदेशालय के नियोजन में का एक सम्यक्तः अहित चिकित्सा अधिकारी जो बोर्ड के संयोजन के रूप में भी कार्य करेगा ।
(ख) एलोपैथिक चिकित्सा पद्धति में सम्यक्तः अहित एक चिकित्सा अधिकारी जो खान में नियोजित व्यक्तियों के लिए केन्द्रीय सरकार द्वारा स्थापित कल्याण संगठनों से परामर्श करके मुख्य निरीक्षक द्वारा नानिदिष्ट किया जाएगा ।
(ग) एलोपैथिक चिकित्सा पद्धति में सम्यक्तः अहित एक चिकित्सा अधिकारी जो उस राज्य या केन्द्रीय सरकार या किसी सरकारी उपक्रम में नियोजित है और सहायक सिविल सर्जन की पंक्ति से निम्नतर नही है:
परन्तु यवि साण्ड ( ख) या खण्ड ( ग ) के अधीन वाला चिकित्सा मधिकारी उपलभ्य नहीं है तो केवल दो व्यक्तियों से अपील चिकित्सा बोर्ड गठित किया जाएगा ।
298. अपील चिकित्सा बोर्ड द्वारा स्वास्थ्य पुनः परीक्षा का मानक और रिपोर्ट अपील चिकित्सा बोर्ड अपीलार्थी को उस मानक के अनुसार जो पहले ही नियोजन के कर्मकारों की आरम्भिक स्वास्थ्य परीक्षा तथा कालिक स्वास्थ्य परीक्षा के लिए प्ररूप में अधिकथित है तथा उन व्यक्यिों की जो नियोजिन किए जाना हैं प्रारम्भिक स्वास्थ्य परीक्षा के लिए प्ररूप त-1 में अधिकथित मानक के अनुसार स्वास्थ्य परीक्षा करेगा तथा सम्बन्धित खाम के प्रबंधक की और अपीलार्थी को प्ररूप अ में स्वास्थ्य प्रमाणपक्ष जारी करेगा ।
29 ड. अनुपयुक्त व्यक्तियों को नियोजित न किया जाना ( जहां नियम 29-खा के खण्ड ( क ) के अधीन आरम्भिक स्वास्थ्य परीक्षा या खण्ड (ख) के अधीन कालिक स्वास्थ्य परीक्षा के परिणामस्वरूप किसी व्यक्ति को खानों में या खान को किसी त्रिशिष्ट प्रवर्ग में या खामो में किन्हें विनिविष्ट संक्रिवाओं में नियोजन के लिए अनुपयुक्त घोषित कर दिया गया हो तो उसे खानों में या खानों केउस प्रवर्ग में या उन विनिविष्ट संक्रियाओ में उसकी स्वास्थ्य परीक्षा की तारीख से तोरा दिन समाप्त होने के पण्यात् तब तक नियोजित नही किया या नियोजित नहीं रखा जाएगा जब तक कि उसने उस घोषणा के विरुद्ध नित्रम 29 म्र के उप -नियम ( 1 ) अधीन के अपील वाखिल न कर वी हो ।
( 2) जहां संबधित व्यक्ति ने नियम 29-ञ के उप- नियम ( 1 ) के अधोन अपील दाखिल कर दी है किन्तु अपील चिकरमा बोर्ड ने स्वास्थ्य पुनःपरीक्षा के पश्चात् उसे खानों में या खानो के किसी विशिष्ट प्रवर्ग में या खानों में किन्ही विनिविष्ट संक्रियाओं में नियोजन के लिए अनु- पयुक्त घोषित करदिया है तो उसे खान में या खानों के उस प्रवर्ग में या विनिर्दिष्ट संक्रियाओं में अपील चिकित्सा बोर्ड द्वारा उसकी स्वास्थ्य पुनः परीक्षा की तारीख से तीस विन की समाप्ति के पश्चात् नियोजित नही किया जाएगा या नियोजित नहीं रखा जाएगा:
परन्तु यदि नियम 29 ख खण्ड ( क ) के अधीन आरम्भिक स्वास्थ्य परीक्षा या नियम 29 -ख के खण्ड ( ख ) के अधीन कालिक परीक्षा करने वाले चिकित्सा अधिकारी अथवा पहले ही नियोजन में व्यक्तियो को स्वास्थ्य पुनः परीक्षा करने वाले अपील चिकित्सा बोर्ड की यह राय हो कि परीक्षित व्यक्ति की निःशक्तता ऐसी प्रकृति की और इतनी मात्त्र में है कि उससे उसके कर्तव्यों के प्रसामान्य निर्वहन पर गम्भीर प्रभाव नहीं पड़ेगा या उसमें हस्तक्षेप नहीं होगा तो वह छह मास से अनधिक की अवधि के लिए खान में उसके नियोजन में बने रहने की सिफारिश कर पड़ेगा जिसके दौरान ऐसा व्यक्ति अपनी निशक्तता को दूर या नियतित करा सकेगा तथा अपने को एक और स्वास्थ्यपरीक्षा के लिए प्रस्तुत कर सकेगा और स्वास्थ्य घोषित करा सकेगा ।
29 क . उद्योग जन्य रोग के लिए प्रतिकर- यदि इन नियमों के अधीन या विनियमो के अधीन किसी स्वाम्थ्य परीक्षा के परिणामस्वरूप यह पता चलता है कि किसी व्र्ष्या को कर्मकार प्रतिकर अधिनियम 1923 की अनुसूची 3 के भाग ग में विनिविष्ट कोई रोग लग गया है तो उस अधि- नियमकी धारा 3 के उपबन्ध उस व्यक्ति के सम्बन्ध में लागू हो आएंगे ।
29ग . स्वास्थ्य परीक्षा का खर्चा नियम 29 के उपनियम ( 3 ) के उपबन्धों के अधीन रहते हुए इन नियमों के अधीन की गई प्रत्येक स्वास्थ्य परीक्षा का पूरा खर्च संबंधित खान के स्वामी द्वारा बहन किया जाएगा ।
29त. वार्षिक विवरणियां--(1 ) प्रत्येक वर्ष में फरवरी के 20 वें दित को या उपके पूर्व प्रत्येक खान का प्रबंधक पूर्ववती कनेण्डर वर्ष की बाबत प्ररूप ' न' में मुख्य निरीक्षक को वार्षिक विवरण प्रस्तुत करेगा ।
( 2) यदि कोई खान साठ दिन से अधिक की अवधि के लिए छोड़ दी जाती है या उसका चलाना वन्द कर दिया जाता है या किसी खान के स्वामित्व में परिवर्तन हो जाता है तो उप- नियम ( 1 ) के अधीन अपेक्षित विवरणियां यथास्थिति छोड़े जाने या स्वामित्व के परिवर्तन के 30 दिन के भीतर या बन्द किए जाने के नब्बे दिन के भीतर प्रस्तुत की जाएंगी ?

**खान में पहले से नियोजित व्यक्ति की दशा में ही ***किसी खान में पहले से ही नियोजित व्यक्ति की भावश्यक । प्रारम्भिक स्वास्थ्य परीक्षा की बाबत और प्रत्येक कालिक स्वास्थ्य परीक्षा की बाबत कम से कम बीस दिन की पूर्विक सूचना दी जानी होती है । किसी खान में नियोजन चाहने वाले व्यक्ति की श्रारम्भिक स्वास्थ्य परीक्षा की बाबत सूचना की अवधि लघुनर हो सकेगी । "
टिप्पणः--सूचना की एक प्रति संबंधित परीक्षा प्राधिकारी को भेजी जायेगी । कालिक स्वास्थ्य परीक्षा की दशा में प्ररूप ' ण ' में स्थास्थ्य प्रमाणपक्ष की प्रति भेजी जायेगी ।

उसे इसके द्वारा पुनः अधिसूचित किया जाता है कि वह खान नियम, 155 के नियम 29 ख के अधीन आरम्भिक, कालिक *स्वास्थ्य परीक्षा के लिये श्रो (परीक्षा प्राधिकारी का नाम बीजिये) के समक्ष- (स्थान का सही विवरण दीजिये ) पर (तारीख वीजिये) को ** उपस्थित हो । ( समय दीजिये ) बजे **किसी खान में पहले से ही नियोजित व्यक्ति की प्रारम्भिक स्वास्थ्य परोक्षण की बाबत श्रीर प्रत्येक कालिक स्वास्थ्य परीक्षा की बाबत द्वितीय सूचना कम से कम दस दिन पहले दी जानी है ।

(क) *खानों में किसी नियोजन के लिये स्वास्थ्य की दृष्टि से उपयुक्त है ,
(ख) * से पीड़ित हैं और निम्नलिखित के लिये स्वास्थ्य
की दृष्टि से अनुपयूक्त है,
( 1) खान में कोई नियोजन; या
(2 ) * भूमि के नीचे कोई नियोजन; या
(3) *काई नियोजन या काम
(ग) * -से पीड़ित हैं और उन्हें यह
नितशक्तता दूर/नियंत्रित करानी चाहिये तथा--- मास की अवधि के भीतर उनकी पुनः परीक्षा की आनी चाहिये । वह भोर से के परीक्षण के परिणाम विशेषज्ञ की राय के साथ पुनः परीक्षा के लिये उपस्थित होगा/ होगी । उसे इस अवधि के दौरान अपने कर्तव्य करते रहने के लिये अनुशात किया जा सकता है/ अनुज्ञात नही किया जा सकता है ।

नियोजित व्यक्तियों के लिए स्वास्थ्य का स्वास्थ्य मानक
1. व्यक्ति अच्छे मानसिक और शारिरीक स्वास्थ्यबाला और किसी ऐसे शारीरिक दोष से मुक्त होना चाहिए जिससे खान में उसके वक्ष नियोजन में विघ्न पड़ने की संभावना हो ।
2. कंकाल तंत्रिका तंत्र भंग ठीक बनावट वाले और विकसित होने चाहिए और सभी अंगों का कृत्य प्रसामान्य सीमाभो के भोतर होना चाहिए कोई भी विरूपता अभिलिखित की जानी चाहिए । ऐसी कोई विरूपता या अंशधात नहीं होना चाहिए जिससे खान में उसके वक्ष नियोजन में विघ्न पड़ सकता हो ।
3. त्वचा: विस्तीर्ण और चिरकारी त्वचा रोग या वृणीत्पत्ति का कोई प्रमाण नही होना चाहिए । संक्रामक प्रकार के त्वचा रोग की दशा में, अभ्यर्थी को, उसकी चिकित्सा की जाने के पश्चात् , स्वस्थ किया जा सकता है सभी व्यावहारिक त्वचा रोगों को अंकित किया जाना चाहिए ।
4. ( क) झांख की वृष्टि- निम्नलिखित स्तर से कम नहीं होना

(ख) भूमि के नीचे नियोजित व्यक्तियों के लिए तथा विवृत खानो में प्रातः कालीन पारियों से भिन्न पारियो में नियोजित व्यक्तियो के लिए रतौधी नही होनी चाहिए ।
(ग) ऐसी केवल एक भांख वाले व्यक्ति को, जो प्रसामान्य रूप से कार्य करती है , भूमि के नीचे नियोजित नहीं किया जाना चाहिए । धरातल पर नियोजन के लिए , ऐसे व्यक्ति की दूसरी मांख की दृष्टि ( ऐनक के साथ और उसके बिना ) 6/18 होमी चाहिए ।
5. भवण शक्ति अच्छी होनी चाहिए । श्रवण शक्ति को प्रभावित करने वाली वर्धमान रोग या व्यावसायिक बधिरता को श्रभिलिखित किया जाना चाहिए ।
6. उच्चारण का बिना गम्भीर अड़चन के होना भावश्यक है । जब तक कि साथ व्यापक या यांशिक अगधात भी न हो, अयोग्य घोषित करने के लिए कोई यह कोई कारण नहीं होना चाहिए ।
7. ( क) श्वसनतंत्र स्वस्थ भौर किसी चिरकाली श्वसमी या स्वरतंत्र रोग से मुक्त होना चाहिए । किन्तु अयोग्य ठहराने के लिए केवल यही कोई कारण नहीं होमा चाहिए
(ख) ऐक्सरे परीक्षा की जानी चाहिए भौर यदि सक्रिय यक्ष्मा के प्रमाण मौजूद हो तो उसे काम करने के लिए तभी अनुज्ञात किया जा सकता है, यदि उसका चूक बारम्बार परीक्षा की जाने पर ऋणात्मक पाया 1096

जाता है तथा वह ऐसा प्रमाणपत्र प्रस्तुत कर लेता है कि यह किसी अहित चिकित्सा व्यवसायी/चिकित्सालय से चिकित्सा प्राप्त कर रहा है ।
8. प्ररिसंचरण तंत्र : किसी ऐसे हृदक या संवहन तंत्र रोग का कोई प्रमाण सही होना चाहिए जिससे खान में उसके दक्ष नियोजन में विघ्न पड़ सकता हो ।
9. यदि अभ्यर्थी को हनिया हो तो उसे उसकी सफल शल्यक्रिया करा लेने के पश्चात् स्वस्थ घोषित किया जाना चाहिए ।
10 यदि हाड्रोसील हो तो वह इतना बड़ा नहीं होना चाहिए कि उससे अभ्यर्थी की प्रसामान्य गतिविधियो में विघ्न पड़ता हो । ऐसे मामलों में उसे सफल शल्यक्रिया के पश्चात् स्वस्थ घोषित किया जा सकता है ।
11. स्वास्थ्यपरीक्षा के अन्तर्गत मूत्र परीक्षा तथा अन्य संतों की परीक्षा भी रोग के प्रभाग के लिए की जानी बाहिए । मूत्र में केवल एल्युमिन और शर्करा की उपस्थिति को जिसके साथ कोई ऐसा स्थूल कायिक रोग म हो जो चिम्ह और संक्षण उत्पन्न कर रहा हो , निःशक्तता नहीं समझा जाना चाहिए ।

जाम में नियोजित किए जाने वाले व्यक्त्रियों के लिए स्वास्थ्य
1. व्यक्ति अच्छे मानक। भीर सारीरिक स्वास्थ्य वाला और किसी ऐसे शारीरिक दोष से मुक्त होता चाहिए जिससे खान में उसके बक्ष नियोजन में विध्न पड़ने की संभावना हो । अभ्यर्थी की भायु के लिए मानक में सम्यक मोक दी जानी चाहिए ।
2. जलमतंत्रः-अंग ठीक बनावट घाले और विकसित होने चाहिए और सभी अंगों का फल्ष प्रसामान्य सीमाधो के भीतर होना चाहिए । कोई भी विरूपता अभिलिखित की जानी चाहिए ऐसा कोई विरूपता या अवाम नही होना चाहिए जिससे खान में उसके दक्ष नियोजन में विघ्न पड़ सकता है । पाई गई कोई भी विरूपता अभिलिखित की जानी चाहिए ।
3.त्वचाः विस्तीर्न और चिरकति त्वचा रोग या बनोत्पति का कोई प्रमाण नहीं होना चाहिए ।
4. ( क ) ऐनक के साथ या उसके जिम, भवि की दूर वृष्टि निम्न- लिखित स्तर से कम नहीं होनी चाहिए ।

(ख ) रतीधी की भूमि के नीचे के कर्मकारों में विशेष दशाणों में ही परीक्षण किया जाना चाहिए , जहां परीक्षा प्राधिकारी ऐसा भावश्यक समझे ।
(ग ) ऐसी केवल आंख वाले व्यक्ति को जो सामान्य रूप से काम करती है , भूमि के भीचे नियोजित नही किया जाना चाहिए । धसत्स पर नियोजन के लिए , ऐसे व्यक्ति की दूसरी भांख की वृष्टि, ऐनक के साथ यां उसकें बिना 6/12 होनी चाहिए । किसी व्यक्ति को ऐनक बाला समझा जाएगा, जब एक आख वृष्टिहीन हो गई हो या जब एक आंख दृष्टि की प्रकार्यात्मक क्षति हो गई ही ।
(घ) रतौंवी की केवल विमेत्र विशाधों में ही' परीक्षण किया जाएगा जहां कण में अच्छे वर्ग- विवेक की प्रावश्यकता हो । केवल निम्न श्रेणी
[PART II-SEC. 3 (1 ) ],
(*) जहां द्विमेली वृष्टि आवश्यक हो, कोई भेंगापन मही होना चाहिए ।
(च) आखो का कोई ऐसा कायिक रोग नहीं होना चाहिए जिससे पांच वर्ष की अवधि में दूर दृष्टि पर प्रभाव पड़ने की संभावना हो ।
5. श्रवण प्रशक्ति अच्छी होनी चाहिए । श्रवण शक्ति पर प्रभाव डालने वाले किसी वर्तमान रोग को अभिलिखित किया जाना चाहिए । अभ्यर्थी तीन मीटर की दूरी से बार्तालाप की ध्वनि सुन सकता हो ।
8. उच्चरण का बिता गंभीर अड़चन के होना आवश्यक है ।
7. (क) प्रवतर्त मंत्र और किसी चिरकालिन स्वरतन्त्र श्वसनी या फुसफुस रोग से मुक्त होना षहिए । सक्ष्म यदि सक्रिय न हो तो निरहूँण नही होना चाहिए ।
(ख ) ऐक्सरे परीक्षा की जानी चाहिए और सक्रिय फुसफुस रोग के प्रमाण नहीं होने चाहिए ।
8. परिसंचरण तंत्र:-किसी ऐसे हृदय यासवहन तंत्र रोग का कोई प्रमाण नहीं होने चाहिए जिससे कान में उसके दक्ष नियोजन में विश्न पड़ सकताहो ।
9. उदर अंगों के रोग का कोई ऐसा प्रभाव नहीं होना चाहिए जिससे जान मे उसके कत्र्तव्य के वक्ष निर्वहन पर प्रभाव पड़ने की संभावना हो ।
10 यदि अभ्यर्थी को हर्निया हो तो उसकी हर्निया सफल शल्यक्रिया की जाने के पश्चात् उसे स्वस्थ घोषित किया जा सकेगा ।
11. यदि होईड्रोसीन हो तो वह इतना बड़ा नहीं होना चाहिए कि उससे व्यक्ति की प्रमामान्य गतिविधियों में बाधा पड़ें । यदि वह काफी बड़ा है तो उसकी सफल शल्यक्रिया हो जाने के पश्चात् उसे स्वास्थ्य भोषित किया जा सकेगा ।
12. तंत्रिका तंल स्वस्थ होना चाहिए । मिगों या किसी अन्य प्रकार के कार्मिक या हिस्टीरिया के दौरों के वृत्त वाले व्यक्तियों को जान में नियोजन के लिए स्वस्थ घोषित नहीं किया जाना चाहिए ।
13. स्वास्थ्य परीक्षा में मूल परीक्षा सम्मिलित की जानी चाहिए । मूत्र में केवल एल्बुमिन और शंकर्रा की उपस्थिति को जिसके साथ कोई स्थूल कार्मिक रोग न हो जो चिन्ह और लक्षण उत्पन्न कर रहा हो, निःशक्तता नही समझा जाना चाहिए ।
14. वक्ष का विकिरन स्त्रीग्राम भी प्राप्त किया जाना चाहिए । यवि मावश्यक हो तो चिकित्सा अधिकारी अभ्यर्थी को निवेश कर सकेगा कि वह विशेष परीक्षणों के परिणाम अथवा तथा कि विशेषज्ञ की राय माम्यता प्राप्त संस्था/चिकित्सालय से अभिप्राप्त करें ।

NOTIFICATION
New Delhi , the 18th November , 1978
G.S.R. 557 (E) .-Whereas certain draft rules further to amend the Mines Rules, 1955 were published as required by sub- section ( i ) of section 59 of the Mines Act , 1952 ( 35 of 1952) , at pages 3249 to 3256 of the Gazette of India Part II -section 3 , sub -section ( i ) dated the 19th November, 1977 under the notification of the Government of India in the Ministry of Labour No.G.SR. 1585 dated the 31st October , 1977 , inviting objections от suggestions from all persons likely to be affected thereby , till the expiry of four months from the date of publication of the notification in the Official Gazette;
And whereas the said Gazette was made available to the public on the 19th November , 1977;
And whereas the objections and suggestions received from the public on the said draft have been considered by the Central Government :
Now, therefore, in exercise of the powers conferred by section 59 of the said Act, the Central Government . after referred the said draft to the Mining Boards constituted under the Act and after giving such Board reasonable opportunity of reporting as to the expediency of making the said amend- ments and as to the suitability thereof , as required by sub- 1099

section (4 ) of section 59 of the sald Act, hereby makes the following rules further to amend the Mines Rules , 1955. namely :-
1. ( 1 ) These rules may be called the Mines (Amendment ) Rules, 1978 .
(3 ) A person, who for any reasonable cause , fails to submit himself for a medical examination in accordance with the notice issued to him under sub - rule ( 1 ) , shall be given a second notice of a minimum period of ten days in Form N, by the manager and a copy of every such notice shall be sent by the manager to the examining authority .
(4 ) The examining authority shall inform the manager whether the person concerned has submitted himself for medical examination or not .
(2) They shall come into force on such date as the Cent- ral Government may, by notification in the Official Gazette , appoint and different dates may be appointed for different class of mines or persons employed in the mines .
2. After Chapter IV of the Mines Rules , 1955 , (herein- after referred to as the said rules ) , the following Chapter shall be inserted, namely :-
29E. Failure to undergo medical examination.- A person who, without reasonable cause, fails to submit himself for medical examination in accordance with a notice issued to him under sub- rule ( 3 ) of rule 29D , shall be liable to be discharged from service :
"CHAPTER IVA
Medical Examination of persons Employed or to be employed in mines .
29A. Applicability of this Chapter. Nothing in this Chap- ter shall apply to persons who are employed purely on tem- porary or casual basis for a continuous period not exceeding six months .
Provided that a person who renders himself so liable to be discharged for failure to submit himself for medical examina tion shall be required to show cause why he could not comply with the notice within the time specified therein . If his ex- planation is found satisfactory by the management, he shall be given another chance to appear for medical examination . In case his explanation is not found satisfactory by the management , his service shall be terminated by the manage- ment :
29B. Initial and periodical medical examinations . After such date or dates as the Central Government may by noti- fication in the Official Gazette appoint in this behalf , the owner agent or manager of every mine shall make arrange- ments-
Provided further that in case of any dispute, the same shall be referred to the Chief Inspector for his decision within 60 days of the order communicated by the owner, agent or manager of the mine to the said person.
29F. Standard and report of medical examination .( 1) The examining authority holding initial medical exami- nation under sub- clause ( 1 ) of clouse (a), or periodical medical examination under clause (b) of rule 29B shah examine a person according to the standard laid down in Form P and the initial medical examination under sub- clause ( ii) of clause (a) of rule 29B of all persons seeking employment in a mine shall be according to the standard laid down in Form P.I.
(2) As soon as maybe , after examination , a copy of the medical certificate in Form O, shall be isued by the examin- ing authority to the person concerned by registered post or delivered under receipt and another copy sent to the manager of the mine concerned by registered post , or delivered under receipt,
(a) ( 1 ) for the initial medical examination of every person employed in the mine, within a period of five years of the date so notified and the said exami- nation shall be so arranged over a period of five years that one- fifth of the persons employed at the mine underge the examination every year : Provided that in the case of a mine where a system of carrying out of such medical examination (of a comparable standard as determined by the Chief Inspector) is already in existence before the date aforesaid, a person who has undergone a medi- cal examination under such a system on a date not carlier than five years before the date aforesaid, shall be deemed to have undergone an initial medi- cal examination under this sub - clause and the last date of his medical examination under the said sys- tem shall be taken to be the date of his initial medical examination under these rules;
(3) The examining authority shall retain the third copy of the medical certificate .
( ii ) for the initial medical examination of every person seeking employment in a mine , unless such person has already undergone within the preceeding five years , a medical examination under these rules while in employment at another mine ; and
(4) In the case of periodical medical examination of a per- son, the examining authority shall also send the copy of the previous medical certificates of the person concerned received in pursuance of sub-rule ( 1 ) of rule 29D, to the manager of the mine concerned .
(b) for the periodical medical examination thereafter of every person employed in the mine at intervals of not more them five years .
29G. Retention and transfer of medical certificates . ( 1 ) All medical certificates of persons employed or to be employed in a mine shall be retained in the possession of the manager of the mine so long as the person is employed in the mine and for a period of five years thereafter:
Provided that the manager of a mine where such person is or was employed shall , if so requested by the manager of any other mine where the person is to be employed, send to him all medical certificates with respect to such person .
29C . Examining authorities : The medical examination aforesaid shall be carried out by a Medical Officer appointed for the mine or a Medical Officer in the employment of the owner of the mine , if any , or by any medical officer employ- ed in the Coal Mines Welfare Fund Organisation or any other mines welfere organisation, failing which by any State or Central Government medical officer not below the rank of an Assistant Civil Surgeon.
(2) If the examining authority who conducts medical exami- nation of persons employed or to be employed in any mine , is relieved of his duties regarding medical examination, the medical practitioner shall transfer all records on medical exa- mination in his possession to the manager of the mine con- cerned.
29D. Notice of medical examination ( 1 ) In respeet of every medical examination under rule 29B , the manager of the mine concerned shall give at least twenty days , prlor notice in writing to the person to be examined, in Form M, provided that in ease of the initial medical examination of a person seeking employment at a mine , the period of notice may be shorter.
29H. Identity of candidates .( 1 ) Every candidate for medi- cal examination under clause (a ) of rule 29B shall, at the time of examination hand- over three unnunted photographs (passport size) of himself to the examining authority . The examining authority , after satisfying itself thrat each photo- graph is a likeness of the candidate, shall endorse each of them with the name and father's name or husband's name of the candidate .
(2) A copy of every such notice issued shall be sent by the manager to the examining authority and in the case of periodical medical examination of a person , the copies of the previous medical certificate issued in Form O, pertaining to the person concerned shall also be sent to the examining authority by the manager . 843 GI/78-2

MEDICAL STANDARD OF FITNESS FOR PERSONS EMPLOYED .
1. The person should be in good mental and bodily health and free from any physical defect likely to interfere with his efficient employment in a mine .
2. Skeletal nervous system The limbs should be well formed and developed and the function of all the limbs should be within normal limits . Any deformity should be recorded . There shouldbe no deformity or paralysis which may interfere with his efficient employments in a mine .
3. Skin: There should be no evidence of extensive and chronic skin disease or ulceration . In case of infective type of skin disease, the candidate could be made fit after he has under- gone a treatment . All occupational skin diseases should be noted.
4. Eye vision should be not less than the following standard.

(b) There should be no night blindness for persons employ- ed below ground and for persons employed in open cast workings in shifts other than in morning shifts .
(c) A person having only one eye which functions normally should not be employed below ground . For employ- ment on surface, the vision of such a person in the other eye should be 6/18 with or without glasses .
5. Hearing shouldbe good . Any progressive disease affec- ting hearing/ or occupational deafness should be recorded .
6. Speech must be without serious impediments . Unless this is also accompanied by generalised or partial paralysis this should not be a reason for declaring unfit .
7(a) Respiratory system shouldbe sound and free from any chronic bronchial or laryngeal disease . This however alone should not be a reason to make unfit ,
(b) An X-ray examination shouldbe made and if there are evidences of active pulmonary tuberculosis he may be per- mitted to work if his sputum is nagative on repeated examina- tion and on production of a certificate that he is taking treat- ment from a qualified medical practitioner /Hospital .
8. Circulatory system: There should be no evidence of any heart or vascular disease which may interfere with his efficient employment in a mine .
9. In case the candidate has hernia he may be declared fit after he has been successfully operated for the same .

10. Hydrocele if present should not be large enough to impede the normal activities of the candidate. In such cases he may be declared fit after being successfully operated.
9. There should not be any evidence of disease of abdomi- nal organs which is likely to affect his efficient discharge of duty in a mine .
10. In case the candidate has hernia he may be declared fit after he has been successfully operated for the same .
11. The medical examination should include examination of urine and of other system for evidence of disease . Mere presence of albumen and sugar in the urine without any gross organic disease producing signs and symptoms should not be considered as a disability .
11. Hydrocele if present should not be large enough to impede the normal activities of the person. If it is large enough he may be declared fit after being successfully opera- ted.

12. The nervous system should be sound . Persons with his- tory of epilepsy or any other type of organic or hysterical fits should not be declared fit for employment in a mine .

13. The medical examination should include examination of urine. Mere presence of albumen and sugar in the urine without any gross organic disease producing signs and symp- toms should not be a disability .
1. The person suould be in good mental and bodily health and free from any physicaf defect likely to interfere with his efficient employment in a mine . Due allowance in the standard should be made for the age of a candidate .
14. Skiagram of the chest should also be obtained . If it is necessary the medical officer may direct the candidate to obtain the result of special tests or/and the opinion of a specialist from recognised institution/hospital .

2. Locomotor system . The limbs should be welf formed and developed and the function of all the limbs should be within normal limits . Any deformity should be recorded . There should be no deformity or paralysis which may inter- fere with his efficient employment in a mine . Any deformity noted should be recorded .
