सा०का ०नि० 258 ( अ) राष्ट्रर्पान, संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदन शक्तियों का प्रयोग करते हुए , केन्द्रीय सचिवालय सेवा नियम, 1962 में और संशोधन करने के लिए निम्नलिखित नियम बनाते है अर्थात्ः--

1. ( 1 ) इन नियमों का नाम केन्द्रीय सचिवालय सेवा ( संशोधन ) नियम, 1979 है ।

( 2 ) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. केन्द्रीय सचिवालय सेवा नियम, 1962 में, नियम 12 के उप- नियम ( 2 ) के नीचे निम्नलिखित उपनियम अंतःस्थापित किया जाয়গা, अर्थात्:-

" 2 (क) ऊपर उपनियम ( 2 ) में किसी बात के होते हुए भी, श्रेणी 1की ऐसी रिक्तिया, जिन्हें अनुसूचित जाति और अनुसूचित जनजाति के मदस्यों द्वारा भरने का विनिश्चय किया गया है और जिनके लिए पान अधिकारी उपलब्ध नहीं है , आयोग द्वारा समय-समय पर धायोजित सीमित विभागीय परीक्षा द्वारा योग्यता क्रम के आधार पर भरी जाएगी । सीमित विभागीय प्रतियोगिता परीक्षा के नियम, गृह मंत्रालय के कार्मिक और प्रशासनिक सुधार विभाग द्वारा बनाए गए विनियमों द्वारा अवधारित किए जाएंगे । "

NOTIFICATIONS New Delhi , the 23rd March, 1979

by G.S.R. 258 (E ) . In exercise of the powers conferred proviso to article 309 of the Constitution , President hereby makes the following rules further to amend the Central Sec- retariat Service Rules , 1962 , namely :-

1. Short title and commencement .-( 1 ) These rules may be called the Central Secretariat Service ( Amendment ) Rules , 1979.

(2) They shall come into force on the date of their pub. lication in the Official Gazette .

2. In the Central Secretariat Service Rules , 1962, the following sub - rule shall be inserted below sub - rule ( 2 ) of rule 12 , namely : -

"2( a) Notwithstanding anything contained in sub -rule ( 2) above , vacancies in Grade I decided to be filled by members of the Scheduled Castes and the Scheduled Tribes and for which cligible officers are not avail. able, shallbe filled on the results of a limited depart- mental competitive examination held by the Commission from time to time, in the order of their merit . The regulations for the limited departmental competitive examination shall be determined by the Department of Personnel and Administrative Reforms in the Ministry of Home Affairs . "

सा० का० नि० 259 (अ ) गृह मंत्रालय कार्मिक श्रीर प्रशासनिक मुधार विभाग, केन्द्रीय मचिवालय सेवा नियम , 1962 के नियम 12 के उपनियम 2 ( क ) और नियम 23 के अनुसरण में , निम्नलिखित विनियम बनाना है , अर्थात्ः-

1. मंक्षिप्त नाम: -( 1 ) इन विनियमों का नाम केन्द्रीय सचिवालय

सेवा श्रेणी 1 ( अनुसूचित आत्रियों/अनुसूचित जनजातियों के लिए आरक्षित रिक्तियों को भरने के लिए सीमित विभागीय प्रतियोगिता परीक्षा ) यिनि- यम, 1979 है ।

( 2 ) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. परिभाषाएं:--( 1 ) इन विनियमों में, जब तक कि संवर्भ से अन्यथा अपेक्षित न हो,

(क ) " निर्णायक तारीख " से उस वर्ष के, जिसमें परीक्षा हुई है , पूर्व वर्ष के दिसम्बर का 31 वां दिन अभिप्रेत है ,

(ख) "परीक्षा" ने श्रायोग द्वारा ली गई ऐसी सीमित विभागीय प्रतियोगिता परीक्षा अभिप्रेत है और आरक्षित रिक्तियों की बाबत श्रेणी 1 जयन सूची में अन्य नामों के समावेश के लिए अनुसूचित जाति अनुसूचित जनजाति के अभ्यथियों के लिए

सीमित है ।

( 2 ) इन विनियमों में प्रयुक्त सभी अन्य शब्द और अभिव्यक्तियों के जिन्हें इसमें परिभाषिन नहीं किया गया है, परन्तु केन्द्रीय मचिवालय सेवा नियम , 1962 में परिभाषित है, क्रमशः वे ही अर्थ होंगे जो उन नियमो में है ।

3. परीक्षा लेना ( 1) आयोग समय-समय पर गृह मन्त्रालय के कार्मिक और प्रशासनिक सुधार विभाग द्वारा अधिसूचित रीति में परीक्षा लेगा ।

(2 ) भ्रायोग वे तारीखे, जिनको और वे स्थान , जहां पर, परीक्षा ली जाएगी , नियत करेगा ।

4. पात्रता की शर्तेः केन्द्रीय सचिवालय सेवा की अनुभाग अधिकारी श्रेणी का कोई स्थायी अधिकारी या केन्द्रीय सचिवालय श्राशुलिपिक सेवा का श्रेणी 'क ' श्रधिकारी या कोई अधिकारी जिसका नाम अनुभाग अधि- कारी श्रेणी की चयन सूची में या केन्द्रीय सचिवालय आशुलिपिक सेवा की चयन सूची में शामिल कर लिया गया है और जो किसी अनुसूचित जाति या अनुसूचित जनजाति का है जो निर्णायक तारीख को निम्नलिखित शर्तों को पूरा करता है , परीक्षा में बैठने के लिए पात्र होगा, अर्थात्ः--

( 1) सेवा की अवधिः उसने यथास्थिति , केन्द्रीय सचिवालय सेवा को अनुभाग अधिकारी श्रेणी में या केन्द्रीय सचिवालय आशुलिपिक सेवा के श्रेणी ' क' में, या दोनों में , कम से कम 4 वर्ष अनुमोदित और निरन्तर सेवा कर ली है ।

टिप्पणः-( i) केन्द्रीय सचिवालय आशुलिपिक सेवा के श्रेणी 'क' अधिकारियों की दशा में , अनुमोविन सेवा में, उम सेवा को श्रेणी ' ख' में की गई अनुमोदित सेवा के आधे भाग को भी सम्मिलित किया जाएगा ।

( ii) सैनिक कर्तव्य पर अनुपस्थिति को किसी श्रवधि को, उपर्युक्त किसी पद पर सेवा को विहित अवधि गिना जा सकेगा ।

2. केन्द्रीय सचिवालय सेवा के अनुभाग अधिकारी और केन्द्रीय सचि बालय श्राशुलिपिक सेवा के श्रेणी ' क' श्रधिकारी , जो काडर बाह्य पदों पर प्रतिनियुक्ति पर हैं , यदि अन्यथा पान हैं तो, परीक्षा में प्रविष्टि किए जाने के लिए पात्र होंगे ।

( 3) केन्द्रीय सचिवालय सेवा का वह अनुभाग अधिकारी या केन्द्रीय सचिवालय श्राशुलिपिक सेया का वह श्रेणी ' क' अधिकारी,

जो काडर बाह्य पद पर या स्थानान्तरण पर किसै

किया गया है और जिमका, यथास्थिति , अनुभाग

केन्द्रीय सचिवालय श्राशुलिपिक श्रेणी को श्रेणी 'क'

नही है, परीक्षा में प्रविष्टि किए जाने के लिए पात्र नह। होगा ।

5. पात्रता के सबन्ध में विनिश्चयः परीक्षा में प्रवेश के लिए अभ्यर्थी की पानना या अन्यथा के संबन्ध मे थायोग का विनिश्चय अन्तिम होगा और ऐसी किसी अभ्यर्थी को जिसे प्रयोग द्वारा प्रवेश प्रमाणपत्त नही दिया गया है, परीक्षा में प्रविष्टि नहीं किया जाएगा ।

6. परीक्षा परिणामः ( 1 ) ऐसे अभ्यर्थियों के नाम, जिन्हें किसी परीक्षा के परिणाम पर चयन के लिए आयोग द्वारा उपयुक्त समझा जाए , योग्यता के अनुक्रमानुमार दो अलग-अलग सूचियों में , एक अनुसूचित जातियों के अभ्यर्थियो के लिए और दूसरी अनुसूचित जनजातियों के अभ्य- थियो के लिए, सूचीबद्ध किए जाएंगे और आयोग द्वारा ऐसे अहित पाए गए अभ्यर्थियों में से उक्त योग्यताक्रमानुमार उत्तने अभ्यर्थियों के नामों को सिफारिश की जाएगी जितने का, चयन सूची में अभ्यर्थियों के उपर्युक्त दो प्रवर्गों में से प्रत्येग प्रवर्ग को बावन सम्मिलित किया जाना है ।

( 2) आयोग द्वारा परीक्षा के परिणाम अभ्यर्थियों को व्यक्तिगत रूप से ऐसी रीति से मंसूचिन किए जाएंगे जैसी आयोग अपने विवेकानुमार विनिश्नित करे ।

7. चयनः परीक्षा में उत्तीर्ण हो जाने से ही श्रेणी 1 को श्रयन सूची में सम्मिलित किए जाने का अधिकार नही प्राप्त हो जाता है जब तक कि केन्द्रीय सरकार का, ऐसी जांच करने के पश्चात् जो वह श्रावश्यक समझे, यह समाधान नहीं हो जाता कि अभ्यर्थी , सेवा में उसके आचरण की दृष्टि से, मब तरह से चयन के लिए उपयुक्त है:

परन्तु यह विनिश्चय कि आयोग द्वारा चयन के लिए सिफारिण किया गया कोई विशिष्ट अभ्यर्थी उपयुक्त नहीं है, आयोग के परामर्श से किया जाएगा ।

8. श्रवचार के लिए शास्तिः यदि किसी अभ्यर्थी के बारे में आयोग द्वारा यह घोषित कर दिया जाता है या कर विया गया है कि वह,

(क) अपनी अभ्यर्थी के लिए किमी साधन से समर्थन प्राप्त करने का, या

(ख) प्रतिरूपण का, या

(ग) किसी व्यक्ति से प्रतिरूपण उपाप्त करने का , या

(घ) गड़े गए दस्तावेज या ऐसे दस्तावेज प्रस्तुत करने का , जिनमें हेर फेर किया गया है , या

(ङ) ऐसे कथन करने का, जो अशुद्ध या मिथ्या है या कोई तात्विक जानकारी वयाने का है , या

( च) परीक्षा के लिए अपनी अभ्यर्थिता के संबन्ध में किसी अन्य अनियमितन या अनुचित साधन का सहारा लेने का, या

(छ) परीक्षा भवन में अनुचित माधनों का प्रयोग करने का, या

(ज) परीक्षा भवन में दुर्व्यवहार करने का, या

( झ) पूर्वगामी खण्डों में विनिर्दिष्ट सभी या किसी कार्य के , यथा- स्थिति, प्रयाम का या उसके लिए दुष्प्रेरण का,

दोषी है , नां वह दाण्डिक अभियोजन के लिए दायी होने का अति- रिक्त,-

(क) आयोग द्वारा उस परीक्षा में जिसके लिए वह अभ्यर्थी है, अर्नाहृत किया जा सकता है , या 473

(ख ) स्थायी रूप से या किसी विनिर्दिष्ट श्रधि के लिए,--

( i) आयोग द्वारा आयोजित की जाने वाली किसी परीक्षा या चयन से विजित किया जा सकता है,

( ii) केन्द्रीय सरकार द्वारा , उसके अधीन किमी नियोजन से, विजिन किया जा सकता है , और

(ग) समुचित नियमो के अधीन , उसके विरुद्ध अनुशासनिक कार्रवाई की जा सकती है ।

G.S.R. 259(E) . In pursuance of sub - rule ( 2a) of rule 12 and rule 23 of the Central Secretariat Service Rules , 1962 , the Department of Personnel and Administrative Reforms in the Ministry of Home Affairs , hereby makes the following regulations , namely :-

1. Short title . ( 1 ) These regulations may be called the Central Secretariat Service Grade I ( Limited Departmental Competitive Examination for filling vacancies reserved for Scheduled Castes and Scheduled Tribes ) Regulations , 1979

(2) They shall come into force on the date of their publication in the Official Gazette .

2. Definitions .-( 1 ) In these regulations , unless the context otherwise requires-

( a) " crucial date " means the thirty- first day of December, of the year preceding the year in which the exami- nation is held ;

(b) " examination " means the limited departmental com petitive examination held by the Commission and confined to the candidates belonging to the Scheduled Castes and Scheduled Tribes for making additions to the Select List for Grade I against reserved vacanices .

(2) All other words and expressions used in these regula tions and not defined but defined in the Central Secretariat Service Rules , 1962 , shall have the meanings respectively assigned to them in those Rules .

3. Holding of the examination. ( 1 ) The examination shall be conducted by the Commission in the manner notified by the Department of Personnel and Administrative Reforms in the Ministry of Home Aflairs from time to time .

(2) The dates on which and the places at which the exami nation shall be held shall be fixed by the Commission.

4. Conditions of eligibility. Any permanent officer of the Section Officers' Grade of the Central Secretariat Service or Grade 'A ' of the Central Secretariat Stenographers and Service or any officer whose name has been included in the Select List for the Section Officers' Grade or the Select List for Grade 'A' of the Central Secretariat Stenographers ' Service and who belongs to any Scheduled Caste or Scheduled Tribe and who, on the crucial date , satisfies the following conditions shall be eligible to appear at the examination , namely :

(1) Length of service. He should have rendered not less than 4 years' approved and continuous service in the Section Officers Grade of the Central Secretariat Service or in Grado 'A' of the Central Secretariat Stenographers ' Service or in both , as the case may be .

Note : ( i) In the case of Grade ' A' officers of the Central Secretariat Stenographers' Service , the approved service , shall include half of the approved service rendered in Grade ' B' of that Service .

(ii ) Any period of absence on military duties may be allowed to be counted towards the pres- cribed length of service in any of the above posts.

(2) Section Officers of the Central Secretariat Service and Officers of Grade ' A' of the Central Secretariat Stenographers ' Service who are on deputation to ex- cadre posts shall be eligi ble to appear at the examination if otherwise eligible .

(3 ) A Section Officer of the Central Secretariat Service or an officer of Grade 'A' of the Central Secretariat Stenogra- phers' Service who has been appointed to an ex- cadre post or to another service on transfer and does not have a lien in the Section Officers ' Grade or Grade 'A ' of the Ceutral Secretariat Stenographers' Service as the case may be , shall not be eligible to appear at the examination.

5. Decision as to eligibility. The decision of the Com- mission as to the eligibility or otherwise of a candidate for admission to the examination shall be final and no candidate to whom a certificate of admission has not been issued by the Commission shall be admitted to the examination.

6. Results . ( 1 ) The names of the candidates who are considered by the Commission to be suitable for selection on the results of any examination shall be arranged in the order of merit in two separate lists , one being for candidates belonging to the Scheduled Castes and the other being for candidates belonging to the Scheduled Tribes , and in that order as many candidates , as are found by the Commission to be qualified , shall be recommended for inclusion in the Select Listfor cach of the aforesaid two categories of candi- dates upto the required number .

(2) The results of the examination shall be communicated to individual candidates by the Commission in such manner as may be determined by the Commission .

7. Selection. Success in the examination confers no right to be included in the Select List for Grade I unless the Central Government is satisfied , after such enquiry as may be consi dered necessary , that the candidate , having regard to his con- duct in service , is suitable in all respects for selection :

Provided that the decision as to whether a particular candi date recommended for selection by the Commission is not suitable shall be taken in consultation with the Commission .

8. Penalty for misconduct . A candidate who is or has been declared by the Commission to be guilty of-

ог (a) obtaining support for his candidature by any means ;

(b) Impersonating ; or

(d) submitting fabricateddocuments or documents which have been tampered with ; or

(e) making statements which are incorrect or false , or suppressing material information ; or

(f) resortingto any other irregular or improper means in connection with his candidature for the examina- tion; or

(g) using unfair means in the examination hall ; or

(h) misbehaving in the examination hall ; or

(i) attempting to commit or, as the case may be , abetting the commission of all or any of the acts specified in the foregoing clauses ,

may in addition to rendering himself liable to criminal prose- cution, be liable-

(a) to be disqualified by the Commission from the examination for which he is a candidate , or

(b) to be debarred either permanently or for a specified period-

(i ) by the Commission, from any examination selection held by them ; or

( ii) by the Central Government from any employment under them ; and
