EXPLANATORY MEMORANDUM

Rule 2 of the High Court Judges Rules, 1956 lays down that the conditions of service of a Judge of a High Court for which no express provision has been made in the High Court Judges (Conditions of Service) Act, 1954, shall be, and shall from the commencement of the Constitution be deemed to have been determined by the rules for the time being applicable to a member of the Indian Administrative Service noldinj? the rank of Secretary to the Government of a State in which the principal seat of the High Court is situated. There are two High Couria namely, the Delhi High Court and the Punjab and Haryana High Court which are situated in the Union Territories of Delhi and Chandigarh respectively. There is a special provision in the first proviso to Rule 2 of the High Court Judges Rules, 1956 for determining certain con- ditions of service of the Judges of the Delhi High Court There is, however, no such provision for the Punjab anH Haryana High Court in the rules at present. The Union Terri- tory of Chandigarh was formed as and from 1st November, 1966 and before that date it was part of the undivided Pun- jab State. It is, therefore necessary to make provision in res- pect of Punjab and Haryana High Court in the High Court Judges Rules with effect from 1st November, 1966 and give retrospective effect to the amendment. It may be mentioned in this connection that though the High Court Judges RuV were framed in 1956, Rule 2 has been given retrospective effect from the commencement of the Constitution.

2, No Judge is likely to be affected adversely by the retros- pective effect being given to the High Court Judges (Amend- ment) Rules, 1979.
