G.S.R 621.—In exercise of the powers conferred by the proviso to article 3(19 read with clause (5) ot' article 148 of the Constitution, the President after consultation with the Comptroller and Auditor General in relation lo persons serv" ing in the Indian Autlil and Accounts Department, hereby makes the following rules further to amend the Fundamental Rules, namely:—
1. (1) These Rules may be called Fundamental (Amend- ment) Rules, 1979.
(2) They shall be deemed to have come into force on thf 26th July, 1965.
2. After rule 17 of the Fundamental Rules, the following rule shall be inserted, namely :—
"17A. Without prejudice to the piovisions of rule 2J of the Central Civil Services (Pension) Rules, 1972 a period of an unauthorised absence—
(i) in the case of employees working in industrial estab- lishments, during a strike which hai been declared illegal under the provisions of ihe Industrial Dis- putes Act, 1947 or any other law for the time being in force ;
(ii) in the case of other employees as a result of act- ing in combination or in concerted manner, such as during a strike, without any authority from, or valid reason to the satisfaction of, the competent authority ; and
(iii) in the case of an individual employee, remaining absent unauthorisedly or deserting the powt shall be deemed to cause an interruption or breaking in the service of the employees, unless otherwise decided by the competent authority for the pm- poscs of leave travel concession, qiuisi-perma- nency and eligibility for appearing in depart- mental examinations, for which a minimum period of continuous service h required.
Fxplanation.—For purposes of this rule, "
EXPLANATORY MEMORANDUM
Under the proviso to sub-rule (1) of rule 17 of the Funda- mental Rules, an officer who is absent from duty vLbout am1 authority shall not be entitled to any pay and allowances dur- ing the period of such absence.
2. When the officer is pot in ieu)ipt of any pay and allow- ances for the period of such unauthorised absence, this causes an interruption jn the service, as the period of unautho- rised absence is not treated .is duty. Executive instructions were, Iherefore. issued when certain Central Government ern- p'oyees went on strike in September, 1968 that, apart from losing pny and allowances for the period of strike, they would face the consequences of break in scivice for purposes of eligibility for leuve travel concession, quasi-permanency, con- firmation or departmental piotnotion examinations which is decided on the basis of (he continuous length of service. As a result, the employees, who participated in the strike, suffered the above consequences fill the bieak in service was condoned by the Government at a subsequent cKite i.e< 3rd March, 1970.
3. Sonic employees of the PosN and Telegraphs Department challenged the orders of "break in service" imposed by the authorities in Ihe High Court of Kerala, which quashed the orders of "brenk in service" imposed on them. Government of Tndia filed nn appeal against the judgment of the Single Judge with the Pull Bench, The Full Bench white upholding the judgment of the Single Judge obseived:—-
"In these circumstances we are unable to hold definitely that a more unauthorised absence from duty would entail an interruption in continuous service or would cause such a break as to disrupt continuous service. Perhaps it would be desirable that there should noi lie the benefit of continuous service to those who unauthorisedly nbseni themselves from duty, if that ia the intention, it would be appropriate to define continuous service in ihe rules providing for such consequences. This is for the Government to decide."
4. The matter was, therefore, re-examined in the light of the Kerala High Court Judgment and as desired bv the Full Bench it was decided that it would be desirable to incorporate a provision in the Fundamental Ru'es so as to make clear the consequences that would arise ffom unauthorised absence fry an employee. This notification contains a new provision lo be incorporated in the Fundamental Rules.
5 This would cover also past cases arising with effect from 26th July, 1V)65, fis it is intended to validate the executive instructions which had been w foice all along. Ft is not pro- posed to impose any freih disability by re-openine the cases of employees where no such ordcis were issued, by making 'he rule retrospectively. But where some disabilities had al- ready been Imposed under the executive instructions Ihat were in force thii> amendment will have the effect of validating these executive instructions and action tnken thereunder.
