डा० आ० 762 (अ) - न्यूनतम मजदूरी अधिनियम, 1918 ( 1948 का 11 ) की धाग की उपधारा ( 1 ) के खण्ड ( iii ) के माथ पठित धारा 3 की उपधारा ( 1 ) के खण्ड ( क ) द्वारा प्रदत्त शक्तियो का प्रयोग वरत हुए, और भाग्न गरवार के यम मंत्रालय की अधिसूषना सं ० का० आ० ५८ ( २ ) , तारीख 2 फरवरी , 198। वा श्रधियान्न करते हुए केन्द्रीय सरकार ने इससे उपावद्ध अनुसूची के स्तम्भ 2 में विनिविष्ट मजदूरी की न्यूनतम दरों की जा उक्त अनुसूची के स्तम्भ 1 की तत्स्थानी प्रविष्टियो में विनिर्दिष्ट बुलफेभ खानो में उसके नियोजन में नियोजित प्रवर्ग के कर्मचारियों को सक्ष्य है, नियत करने के लिए निम्नलिखित प्रस्ताव बनाए है जो उक्त श्रधिनियम की धारा 5 की उपधारा ( 1 ) के खाण्ड (ख) की अपेक्षानुमार उन सभी व्यक्तियो की जानकारी के लिए प्रकाशित किए जा रहे है , जिनक उससे प्रभावित होने की संभावना है और यह मुचना दी जाती है कि उक्त प्रस्तावों पर श्रधिसूचना के राजपत्र में प्रकाशन की तारीख में वो माभ के अवमान के पश्चात् विचार किया जाएगा ।
ऊपर विनिर्दिष्ट अवधि के अवमान में पूर्व उक्त प्रस्तयों की बाबत जो भी आक्षेप या गुझाव किसी व्यक्ति से प्राप्त होंगे, केन्द्रीय सरकार उन ५२ निचार करेगी ।

स्पष्टीकरण:--
(1 ) इस अधिसूचना द्वारा प्रस्तावित न्यूनतम वरें सर्वसम्मिलित दरे है, जिनमें साप्ताहिक विश्राम के लिए बेय मजबूरी भी सम्मिलित है ।
( 2 ) मजदूरी की न्यूनतम वरे ठेकेदारों द्वारा नियोजित कर्मचारियो को भी लागू हैं ।
(3) अठारह वर्ष से कम आयु के और असमर्थ व्यक्तियों को देय मजदूरी की न्यूनतम वरे समुचित प्रवर्ग के वयस्क कर्मकारों का संवेय दरों का क्रमशः 80 प्रतिशत और 100 प्रतिशत होंगी ।
(4) इस अधिसूचना के प्रयोजन के लिए,
(क ) "अकुशल कार्य " से बह कार्य अभिप्रेत है जिसमे कार्य की बहुत थोड़ी कुशलता या अनुभव अपेक्षित करने वाली अथवा कुछ भी कुशलता था अनुभव न अपेक्षित करने काश्री माधारण क्रियाएं सम्मिलित हैं;
(ख) "मर्यकुशल कार्य " से वह कार्य अभिप्रेत है, जिसमें कार्य के अनुभव से अर्जित कुछ मात्रा में कुशलता या क्षमता सम्मिलित है और जो कुशल कर्मचारी के पर्यवेक्षण य । मार्ग वर्शन के अधीन किए जाने योग्य हैं और इसके अन्तर्गत अकुशल पर्यवेक्ष। कार्य भी झाता है ,
(ग ) "कुशल कार्य " से वह कार्य अभिप्रेत है जिसमे कार्य के अनुभव से अथवा शिक्षु के रूप में या किसी तकनीकी या व्यावसायिक संस्था में प्रशिक्षण के माध्यम से अर्जित कुशलता था सक्षमता अपेक्षित है और जिसके पालन में स्वप्रेरणा और विवेकवृद्धि आवश्यक है ।
( 5.) जहां किसी क्षेत्र में, इस अधिसूचना द्वारा नियत दरे किसी मजदूर की विद्यमान मजदूरी की वरों से निम्नतर हैं षहां इस अधिसूचना के प्रयोजन के लिए किसी ऐसे फर्मचारी की ऐसी उष्णतर वरे भ्यूनतम दरें मानी जाएंगी ।

5.0.762(E). The following proposals made by the Central Government in exercise of the powers conferred by clause (a) ofsub - section (1 ) of section 3 read with clause ( ili ) of sub - section (1) of the section 4 of the Minimum Wages Act , 1948 ( 11 of 1948) and in supersession of the Notification of the Government of
[PART II-SEC . 3 ( ii)]
IndiaIn the Ministry of Labour No. S.O. 84 (E) dated 2nd Feb- muarv , 1981 for fixing the minimum rates of wages as specified column 2 of the Schedule annexed hereto , payable to the categories of the employees employed in the employment in Wolfram Mines as specified in the corresponding entries in colton 1 of the said Schedule , are hereby published as required by clause (b ) of sub - section ( 1) of section 5 of the said Act for information of all persons likely to be affected thereby and notice is hereby given that the said proposal will be taken into consideration after the expiry of 2 months from the date of publication of the notification in the Official Gazette .
Any objection or suggestion which may be received from any person with respect to the said proposals before the expiry of the period specified above will be considered by the Central Govern- ment .

Explanation :
For the purpose of this notification:--
(1) the minimum rates of wages are all inclusive rates and includes also the wage payable for the weekly day ci rest ;
(2) the minimum rates of wages are applicable to employees employed by contractors also;

( 3) the minimum rates of wages payable to young persons below 18 years of age and for disabled persons shallbe 80 % and 100 % respectively of the rates fixed by this notification for aduk workers of the appropriate category
(4) ( a) "Unskilled work " means work which mycives simple operations requiring little or no skill or experience of the job
(b ) " Semi skilled work " means work which involves some degree of skill or competence acquired through expetence of the job and which capable of being performed under the supe ) - vision or guidance of a skilled employee and includes unskilled supervisory work
(c) "Skilled work " means work which involves skill or competence acquired through experience of the job or through training as an apprentice or in a technical or vocational institute and the performance of which calls for initiative and Judgement ,
(5) Where in any area , the minimum rates of wages fixed by this notification are lower than the prevailing tetes of wages of any employee , the higher wages shallbe treated as the mini- mum rates of wages applicable for the purpose of this nout cation to such employec
