का. मा . 644(अ) .-यतः केन्द्रीय सरकार को अहमदाबाद स्टाक एक्सचेंज की ओर से इस आशाय का एक लिखित बनुरोध प्राप्त हुआ है , कि उसके द्वारा बनाई गई उप - विधियों में संशो- धन कर दिया जाए ।
अतः अब प्रतिभूति संविदा (विनियमन) अधिनियम , 1956 (1956को 42) की धारा 10 की उप- धारा ( 1) के द्वारा प्रवत्त शक्तियों का प्रयोग करते हुए , केन्द्रीय सरकार एतद्वारा अहमदाबाद स्टाक एक्सचेंज की उप- विधियों में , नीचे दी गई अनुसूची में विनिर्दिष्ट संशोधन करती है और उस धारा की उप-धारा (4) के परन्तुक के अनुसरण में , केन्द्रीय सरकार के व्यापार के हित में तथा विनिर्दिष्ट शेयरों के मम्बन्ध में किए गए संविधाओं के अविलम्ब अनुपालनअनुपालन के लिए दिदा देने के निमित्त , एतद्वारा उप- विधियों में उक्त संशोधन के पूर्व प्रकाशन की शर्त से भी अभिमुक्ति प्रदान करती है ।

अनुसूची
अहमदाबाद स्टाक एक्सचेंज की उप- विधियों में:-
(1) उप- विधि 48 में , वर्तमान खण्ड (2) के अन्त में निम्नलिखित परन्तुक जोड़ दिया जाएगा ,, अर्थात:-
" किन्तु यह व्यवस्था भी की गई है कि ऐसे शेयरों के मामले में जिनको शासी बोर्ड द्वारा " विनिर्दिष्ट शेयर' आभिहित किया गया है , सुपुर्दगी तथा अदायगी की अवधियां शासी मोड द्वारा प्रत्येक मामले में 14 दिन और आगे तक इस तरह से बढ़ाई तथा स्थगित की जा सकेंगी कि कुल मिलाकर वह अवधि संविदा की तारीख से 90 दिन से ज्यादा की न हो जाए । "
(2) उप-विधि ' 52 ' के बाद , एक नाई उप-विधि '52-क' जोड़ दी जाएगी:-
" विनिदिष्ट शेयरों में सौदे । "
52-क. जब तक शासी बोर्ड द्वारा अन्यथा निर्धारित न किया जाए " विनिर्दिष्ट शेयरों में निम्नलिखित रीति से सौदे पूरे किए जाएंगे :

(क) समस्त सौदों का निपटान हर 11 दिन के बाद , जिसे इसमें इसके पश्चात " निपटान अवधि" कहा गया है सुपुर्दगी तथा अदायगी के द्वारा अथवा उस रीति से किया जाएगा जिसका निर्धारण शासी बोर्ड द्वारा उपर्युक्त रीति के अतिरिक्त अथवा उसमें संशोधन करते हुए किया जाए ।
(ख) शासी बोर्ड प्रत्येक निपटान अवधि के सम्बन्ध में अग्रिम आधार पर प्रथमा तथा अन्तिम व्यापार दिवस निश्चित करेगा ।
(ग) सौदे हाजिर सुपुर्वगी अथवा दस्ती सूपुर्वगी अथवा विशेष सपूर्वगी अथवा व्यवस्थापन के लिए किए जा सकेंगे किन्तु सौदा करते समय अब तक अन्यथा अनुबन्धित न किया जाए तब तक समस्त सौदों को तत्मामयिक व्यवस्थापन के लिए सौदे माना जाएगा ।
(घ) निर्धारित व्यापारिक एकक अथवा उसके गुणितों से भिन्न एककों के सौदों को उप- विधि 48 (2) में याथा परिभाषित व्यवस्था के अनुसार दस्ती सपुर्दगी के सौदों के रूप में माना जाएगा ।
(ङ) जो सौदे चालू तथा अनुवर्ती निपटान अवधियों के आगे तक की अवधियों के लिए किए गए होंगे वे शून्य सौदे माने जाएंगे ।
(अ) एक निपटान अवधि से दूसरी निपटान अवधि में अग्रणित सौदे कार्यकारी निवेशक द्वारा अथवा उसकी अनुपस्थिति में सचिव द्वारा किसी भी प्रति- भूति के लिए निश्चित किए गए पूरक मूल्य पर किए गए सौदे माने चाएंगे ।
(छ) निपटान अवधि के दौरान किए गए सौदों को क्रय अथवा विक्रय के द्वारा बन्धित किया जा सकेगा अथवन अगली निपटान अवधि में आगे तक ले जाया जा सकेगा । अन्य समस्त सौधे जो बकाया रहें उनको इस प्रयोजन के लिए निश्चित दिनों पर सुपुर्दगी तथा अदायगी द्वारा पूरा करना आवश्यक होगा ।
(अ) इन उप-विधियों और विनियमों के समस्त उपबत्तत्ध जो इस समय समाशोषित प्रतिभूतियों के सौदों के निपटारे पर लागू हैं और जो उपयुक्त व्यवस्था के विरुद्ध नहीं हैं वे " विनिदिष्ट शेयरों" में सम्पन्न सौदों के निपटारे की व्यवस्था पर यथोचित परिवर्तनों सहित लागू होंगे ।"
(3) उप-विधि 72 के खण्ड (ग) के बाद एक नया खण्ड
(घ) जोड़ दिया जाएगा , अर्थात्:-
"(घ) यदि शासी बोर्ड की राय में किसी प्रतिभूति में उपयुक्तः विनिदिष्ट किस्म की कोई आपात स्थिति उत्पन्न हो गई हो , तो यह एक विशेदाः संकल्प के द्वारा विक्रेता द्वारा क्रेता को दिए जाने वाले बिलम्ब छूट प्रभारों का विनियमन कर सकेगा । "

(4) उप-विधि 343 के खण्ड (1) में " एक्स्चेंज का (आफ दी एक्सचेंज) " शब्दों के बाद निम्नलिखित शब्द जोड़ दिए जाएंगे , अर्थात्
"अथवा जिनमें दावेदार ने या तो स्वयं अदायगी न की हो , या किसी भी प्रतिभूति में सम्पन्न सौदों के सम्बन्ध में देय मार्जिन के अपवंचन के मामले में व्यतिक्रमी के साथ अवैध रूप से तालमेल जोड़ लिया हो । "

S.O. 644 ( E ) . Whereas the Central Govern- ment has received a request in writing from the Stock Exchange , Ahmedabad that the bye -laws made by it may be amended .
Now, therefore , in exercise of the powers confer- red by sub- section ( 1 ) of section 10 of the Securi- ties Contracts ( Regulation ) Act, 1956 ( 42 of 1956) , the Central Government hereby makes the amendments to the bye - laws of the stock Exchange , Ahmedabad, specified in the Schedule below , and in pursuance of the proviso to sub -section (4) of that section the Central Government, in the in- terest of the trade , and to facilitate performance of contracts in respect of specified shares without delay hereby dispenses with the condition of pre- vious publication of the said amendments to the bye-laws.
SCHEDULE In the bye- laws of the Stock Exchange , Ahmeda- bad,----
(1) in Bye- laws 48 , at the end of the exist- ing clause ( ii) the following proviso shall be added, namely,--
"Provided however that in the case of such shares as may be designated by the Governing Board as " specified shares", delivery and payment may be exten- ded or postponed by the Governing Board by further periods of 14 days each, so that the overall period does not exceed 90 days from the date of the contract . "
(2) after Bye - law 52 , a new bye- law 52.A shall be added , namely,-
"Bargains in specified shares .

52A . Unless otherwise determined by theGo- verning Board , bargains in " specified shares " will be performed in the following manner :
( a) All bargains shall be settled every four- teen days hercinafter called a " Settle- ment Period " by delivery and payment or as the Governing Board may from time to time prescribe in addition there- to or in modification thereof .
(b) The Governing Board shali fix in advance the first and last business day for each settlement period .
(c) The bargains may be for spot delivery or for hand delivery or for special delivery or for the settlement but unless otherwise stipulated when entering into the bar- gain , all bargains shall be deemed to be for the current settlement .
(d) Bargains in other than the prescribed trading unit or multiples thereof shall be deemed to be for hand delivery as defined in Bye - law 48 (ii ) .
(e) Bargains made for a period beyond the current and ensuing settlement periods shall be void .
( f ) Bargains carried over from one settle- ment to another shall be at the making- up price fixed for any security by the Executive director or in his absence by the Secretary.
(g) Bargain entered into during the settlement period may be closed by purchase or sale or carried over to the next settle- ment period . All other bargains which remain outstanding must be performed by delivery and payment on the days fixed for the purpose .
(h) All the provisions in these bye - laws and regulations which are at present appli- cable to the settlement of bargains in cleared securities and which are not in conflict with the above will apply muta- tis mutandis to the settlement of bar- gains in " specified shares " .
( 3 ) after clause ( c ) of Bye - law 72 , a new clause ( d) shall be added , namely,-
"( d) If in the opinion of the Governing Board an emergency of the type re- ferred to above has arisen in any se- curity it may be a special resolution regulate the backwardation charges payable to the buyer by the seller" .
(4, in cluase ( i) of Bye -law 343 , after the words " of the Exchange" , the following words , shall be added, namely,-
" or in which the claimant has either not paid himself or colluded with the de- faulter in the evasion of margin pay- able on bargains in any security" . [F. No. 2/ 7 / SE/ 83 ]
