सा.का. नि . 595 ( भ्र) :-केन्द्रीय सरकार महापत्तन न्याम श्रधि- नियम, 1963 ( 1963 का 38 ) की धारा 132, उपधारा ( 1 ) के साथ पठित धारा 124, उपधारा ( 1 ) द्वारा प्रदत्त मशक्तियों का प्रयोग करते हुए संलग्न अनुसूची में यथा प्रस्तावित तूतीकोरिन पत्तन कर्मचारी (श्रश्चरण) तृतीय संशोधन विनियम, 1984 का अनुमोदन करती है ।
2. उक्त विनियम इस अधिसूचना के शासकीय राजपक्ष में प्रकाशन की तारीख से प्रवृत्त होंगे ।

तूतीकोरिन पत्तन कर्मचारी ( यावरण ) तृतीय संशोधन विनियम , 1984
महापत्तन न्यास अधिनियम, 1963 ( 1963 का 38) की धारा 28 द्वारा प्रवत्त शक्तियों का प्रयोग करते हुए तूतीकोरिन पत्तनन्यास बोर्ड एतद्वारा उपर्युक्त अधिनियम की धारा 124 के अधीन [ 1 मार्च 1979

के भारत के प्रसाधारण राजपत्र में सा.का. नि . 100 ( भ) के रूप में प्रकाशित] तूतीकोरिन पत्तन कर्मचारी ( आचरण) विनियम 1979 में और संशोधन करने के लिए निम्नलिखित विनियम बनाता है बशर्ते कि केन्द्रीय सरकार इसका अनुमोदन करें:-
1. ये तूतीकोरिन पत्तन कर्मचारी ( भाचरण ) तृतीय संशोधन विनियम, 1984है ।
2. तूतीकोरिन पत्तन कर्मचारी ( आचरण) विनियम, 1979 में (एतत्पश्चात जिनका उल्लेख कथित विनियम के रूप में किया गया है ) विनियम 1 के उप-विनियम ( 2 ) के सखंड ( ख) के अधीन दोनों उपबंध निकाल दियेजाएंगे ।
3. कथित विनियमों के विनियम 4 में उप-विनियम ( 5 ) के खंड ( ii) के अधीन निम्नलिखित उपबंध जोड़ा जायेगा:-
"इस -उपविनियम में किये गये किसी प्रकार के उल्लेख के बावजूद औद्योगिक विवाद अधिनियम , 1947 ( 1947 का 14वां) के अधीन " कर्मकार" की परिभाषा के अन्तर्गत भाने वाले कर्मचारी को, बहरहाल, उपर्युक्त अधिनियम में दी गयी अनुमति के अनुसार अपनी शिकायतें दूर करवाने का अवसर दिया जायेगा"
4. कथित विनियमों के विनियम 9 में:-
( i) व्याख्या ( 34 ) ( ii) को निकाल दिया जायेगा ।

The Schedule
(ii ) व्याख्या ( 4) के स्थान पर निम्नलिखित को प्रनिग्थापित किया
जायेगा:--
TUTICORIN PORT EMPLOYEES (CON- DUCT) AMENDMENT REGULATIONS , 1984 "बोर्ड का कोई भी कर्मचारी श्राम जनना अथवा किसी ऐस व्यक्ति प्रथवा औद्योगिक या वाणिज्यिक फर्म , सगठन श्रादि से यूनियनों के लिए बंदा इकट्ठा करने नही जाएगा, जिसके साथ पनन का किसी प्रकार का बाम्ता पड़ता है । "
5. कथित विनियमों के विनियम 10 मेंउप दिनियम ( 1 ) को निम्न- लिखिरा द्वारा प्रनिन्थापित किया जायेगा:--
In exercise of the powers conferred by Sec- tion 28 of the Major Port Trust Act, 1963 (38 of 1963 ) , the Tuticorin Port Trust Board hereby makes , subject to the approval of the following Regulations to further amend the Tuticorin Port Employees (Conduct ) Regulations , 1979 [pub- lished as GSR 100 ( E ) in the Gazette of India , Extraordinary, dated he 1st March , 1979 ]:-
"पनन में नियोजित कोई भी कर्मचारी किसी ऐसे व्याक्त से जिसके माथ उगका मरकारी म्मर पर बास्ता पड़ता हो अथवा किसी ऐसे श्रीद्योगिक या वाणिज्यिक फर्म , संगठन आदि से जिसके मात्र पत्तनन्यास का वास्ता पड़ता हो, न तो स्वयं कोई उपहार स्वीकार करेगा और न ही अपने परिवार के किसी नदस्य अथया अपनी ओर से किमी अन्य व्यक्ति को ऐमा करने की अनुमति देगा । "
1. These Regulation may be called the Tuti- corin Port Employees . ( Conduct ) Third Amendment Regulations , 1984.
(1. प्रमुख विनियमः
नौवहन एवं परिवहन मंत्रालय (परिवहन स्कन्ध ) जी० एम० श्रा२० 100 ( ई ) की अधिसूचना दिनांक 1 मार्च, 19791
2. In the Tuticorin Port Employees (Conduct ) Regulations , 1979 (hereinafter referred to as the said regulations ) , both the provisos under clause (b) of sub - regulation ( 2 ) of regulation 1 shall be deleted .
2. प्रमुख विनियमों में पहले से किये गाए संशोधन:
(i) तूतीकोरिन पत्तन कर्मचारी (आचरण) संशोधन विनियम 1980, नौवहन एवं परिषष्ठन मत्रालय की अधिसूचना सं० पी इन्व्य/पी ई टी-13/ 80 , दि . 4 अक्टूबर , 19801
3. In Regulation 4 of the said regulations , the following proviso shall be inserted under clause (ii ) of sub - regulation (5 ) : ---
(ii ) तूतीकोरिन पत्तन कर्मचारी (भाचरण ) द्वितीय संशोधन विनियम, 1980 नौवहन एवं परिवहन मंत्रालय की अधिसूचना सं. पी. 'डब्ल्यू. /पी ई टी 43/80 , दि. 4 अक्टूबर 1980 ) ।

"Notwithstanding anything contained in this sub- regulation, an employee covered by the definition of ' Workman' under the Industrial Disputes Act, 1947 ( 14 of 1947) , would however , have the op- portunity for redressal of his grievances as permissible under the aforesaid Act" .
तूतीकोरिन पत्तनन्यास
4. In Regulation 9 of the said regulations :--
( i ) explanation ( ii ) shall be deleted .
MINISTRY OF SHIPPING AND TRANSPORT (Ports Wing)
( ii) explanation (4 ) shall be substituted by the following :
NOTIFICATION
New Delhi , the 7th August, 1984
"No employee of the Board shall approach the general public or any individual or any industrial or commercial firm , or- ganisation, etc. with whom the Port has any type of dealings for collecting funds for the Unions" .
5. In Regulation 10 of the said regulations , sub- regulation (1) shall be substituted by the fol- lowing:-
G.S.R. 595 ( E) .-- In exercise of the powers con- ferred by sub - section ( 1 ) of section 124 read with sub - section ( i ) of section 132, of the Major Port Trusts Act, 1963 (38 of 1963 ) , the Central Govt . hereby approves the Tuticorin Port Emp- loyees ( Conduct ) Third Amendment Regulations , 1984 as set out in the schedule attached .
2. The said regulations shall come into force from the date of publication of this Notification in the Official Gazette .

"No person employed in the Port shall accept or permit any member of his family or any person acting on his be- half to accept any gift frorh any indi- vidual having official dealings with him or from any industrial or commercial firm , organisations , etc. with whom the Port Trust has dealings".
