सं.फा. 7(320)/डीओएफएस/प्रशा0/2017/2067-77.—गृह मंत्रालय, भारत सरकार की दिनांक 24 सितम्बर, 1968 की अधिसूचना सं0 24/78/68-डीएच(एस) के साथ पठित संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदा शक्तियों का प्रयोग करते हुए तथा दिल्ली राजपत्र भाग-4 में प्रकाशित दिनांक 2 दिसम्बर, 1994 की अधिसूचना सं0 फा0 53/1/127/89-एम एण्ड पीएच के अनुसार उप खाद्य सुरक्षा आयुक्त के पद की भर्ती नियमावली के अधिक्रमण में, ऐसे अधिक्रमण से पूर्व की गई या हटाये जाने के लिये की जाने वाली बातों को छोडकर, राष्ट्रीय राजधानी क्षेत्र दिल्ली के उपराज्यपाल, एतद् द्वारा खाद्य सुरक्षा विभाग, राष्ट्रीय राजधानी क्षेत्र दिल्ली सरकार में ''उप खाद्य सुरक्षा आयुक्त'' के पद के लिये निम्नलिखित नियम बनाते हैं।
1. संक्षिप्त शीर्षक एवं प्रारंभ :- (1) इन नियमों को खाद्य सुरक्षा विभाग, राष्ट्रीय राजधानी क्षेत्र दिल्ली सरकार में ''उप खाद्य सुरक्षा आयुक्त'' के पद हेतु भर्ती (संशोधन) नियमावली, 2018 कहा जायेगा। (2) ये दिल्ली राजपत्र में प्रकाशन की तारीख से लागू होंगे।

(1)2 DELHI GAZETTE : EXTRAORDINARY PART IV] 2. पदों की संख्या, उनका वर्गीकरण तथा वेतन मैट्रिक्स में स्तर/वेतनमान ः- उक्त पद की संख्या, इनका वर्गीकरण तथा उससे संलग्न वेतन मैट्रिक्स में स्तर/वेतनमान इन नियमों के साथ संलग्न अनुसूची के कॉलम (2) से (4) में यथाविनिर्दिष्ट होंगे।
3. भर्ती पद्धति, आयु सीमा तथा योग्यता इत्यादि :- उक्त पद की भर्ती पद्धति, आयु सीमा, योग्यताएं एवं इससे संबंधित अन्य मामले उक्त अनुसूची के कॉलम (5) से (13) में यथाविनिर्दिष्ट होंगे। 4. अयोग्यता :- ऐसा कोई भी व्यक्ति
(क) जो किसी व्यक्ति के जीवित पति/पत्नी के होते हुए विवाह करता है या विवाह का अनुबंध करता है, या
(ख) जो एक जीवित पति/पत्नी के होते हुए किसी व्यक्ति से विवाह कर चुका है या विवाह अनुबंध कर चुका है, वह उक्त पद पर नियुक्ति का पात्र नहीं होगा।
शर्त यह है कि यदि सरकार संतुष्ट है कि ऐसा विवाह ऐसे व्यक्ति एवं विवाह के अन्य पक्षकार पर लागू व्यक्तिगत कानून के अंतर्गत अनुमत है और इस बात से संतुष्ट हो जाने पर कि ऐसा करने के लिये विशेष आधार है/हैं किसी भी ऐसे उम्मीदवार को इस नियम के प्रवर्तन की छूट दे सकेगा। 5. शिथिल करने की शक्ति :-जहां सरकार का यह मत हो कि ऐसा करना आवश्यक अथवा समीचीन है, तो वह कारणों को अभिलिखित करते हुए संघ लोक सेवा आयोग के परामर्श से आदेश द्वारा व्यक्तियों/पदों को किसी श्रेणी या वर्ग के संबंध में इन नियमों के उपबंध में से किसी को भी शिथिल कर सकेंगे।
6. बचावः- इन नियमों की किसी भी बात का सरकार द्वारा इस संबंध में समय-समय पर जारी किए गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों भूतपूर्व सैनिक, अन्य पिछड़ा वर्ग तथा अन्य विशेष वर्गों के व्यक्तियों के लिये उपबन्धित किये जाने के लिये आरक्षण अपेक्षित आयु सीमा में छूट और अन्य रियायतों पर कोई प्रभाव नहीं पड़ेगा।

| 7. | सीधी भर्ती वाले उम्मीदवारों से अपेक्षित शैक्षिक तथा अन्य योग्यताएं | ः | अनिवार्यः- क (i) किसी मान्यता प्राप्त वि"वविद्यालय से खाद्य प्रौद्योगिकी या डेयरी प्रौद्योगिकी या जैव प्रौद्योगिकी या तेल प्रौद्योगिकी या कृषि विज्ञान या पशु चिकित्सा आयुर्विज्ञान या जैव रसायन या सूक्ष्म जीव विज्ञान में स्नातक उपाधि या रसायन विज्ञान में स्नाकोत्तर उपाधि या औषध में उपाधि अथवा ii) इस पद के लिए केन्द्र सरकार द्वारा अधिसूचित कोई अन्य समकक्ष /मान्यता प्राप्त योग्यता तथा ख. खाद्य अपमिश्रण निवारण अधिनियम /खाद्य सुरक्षा एवं मानक अधिनियम तथा इसके अन्तर्गत बनाये गये नियमों के प्रवर्तन में पांच वर्ष का अनुभव ट ीप-1 अन्यथा सुयोग्य उम्मीदवारों के मामले में कारणों को लिखित में अभिलेखबद्व करते हुए योग्यताएं संघ लोक सेवा आयोग के विवेक पर शिथिलनीय हैं। ट ीप-2 यदि चयन की किसी अवस्था में संघ लोक सेवा आयोग के अभिमत से अनुसूचित जाति/जनजातियों के लिए आरक्षित रिक्त पदों को भरने के लिए अपेक्षित अनुभव रखने वाले इन जातियों के उम्मीदवारों के पर्याप्त संख्या में मिलने की संभावना नहीं है, तो अनुभव संबंधी योग्यताएं संघ लोक सेवा आयोग के विवेक पर शिथिलनीय हैं। वांछनीय : I) किसी मान्यता प्राप्त विश्वविद्यालय से रसायन विज्ञान में डॉक्टरेट उपाधि या जैव रसायन विज्ञान /खाद्य प्रौद्योगिकी में स्नातकोत्तर उपाधि I I) खाद्य विश्लेषण, खाद्य संयोजन तथा सम्बद्व विषयों में शिक्षण /अनुसंधान में दो वर्षीय अनुभव |

| 11. | यदि पदोन्नति / प्रतिनियुक्ति / समावेशन द्वारा भर्ती होनी हो तो ग्रेड जिनसे पदोन्नति / प्रतिनियुक्ति / समावेशन किया जाना है | ः | पदोन्नतिः ि नयुक्ति के उपरान्त नियमित आधार पर ग्रेड में सात वर्षों की नियमित सेवा सहित वेतन मैट्रिक्स का स्तर-7 (44900-142400/-रुपये) (पूर्व संशोधित 9300-34800/-रुपये ग्रेड पे 4600/-रुपये) के अनुसार वेतनमान में पदनामित अधिकारी जिन्होंने उच्च पद अर्थात् उप-खाद्य सुरक्षा आयुक्त के कर्त्तव्यों एवं दायित्वों पर एक माह का विभागीय प्रशिक्षण सफलतापूर्वक पूर्ण किया हो। ट ीपः- जिन कनिष्ठ अधिकारियों ने अपनी अर्हक/पात्रता सेवा पूरी कर ली है वे पदोन्नति के लिए विचारणीय है। उनके वरिष्ठ अधिकारी भी पदोन्नति के लिए विचारणीय होंगे बशर्तें कि उनके लिए अपेक्षित अर्हक/पात्रता सेवा ऐसी अपेक्षित अर्हक/पात्रता सेवा की अवधि के आधे से न्यून या दो वर्ष से कम न हो और उन्होंने आगामी उच्च ग्रेड पर पदोन्नति के लिए अपनी परीवीक्षा अवधि अपने कनिष्ठ अधिकारियों के साथ सफलतापूर्वक पूरी कर ली होे, जिन्होंने (कनिष्ठ अधिकारी) उतनी अर्हक/पात्रता पहले ही पूरी कर ली है। ट ीप 2ः- पदोन्नति के लिये न्यूनतम अर्हक सेवा की गणन के प्रयोजन के लिये 01.01.2006 (जिस तिथि से सातवें केन्द्रीय वेतन आयोग की संस्तुतियों पर आधारित संशोधित वेतन संरचना लागू की गई है) से पहले किसी अधिकारी द्वारा नियमित आधार पर की गई सेवा जिस तिथि से छठे केन्द्रीय वेतन आयोग की संस्तुतियों पर आधारित संशोधित वेतन संरचना लागू की गई है। यह तिथि वेतन आयोग की संस्तुतियों पर आधारित लागू सम्बद्ध ग्रेड पे/वेतनमान में की गई सेवा मान ली जाएगी। प ्रतिनियुक्तिः क न्द्र/राज्य सरकार/संघ राज्य क्षेत्र के निम्नलिखित अधिकारीः- े क . (1) मूल संवर्ग/विभाग में नियमित आधार पर समरूप पदधारण करने वाले; अथवा ( 2) मूल संवर्ग/विभाग में नियमित आधार पर वेतन मैट्रिक्स का स्तर-10 (56100-177500/-रुपये) (पूर्व संशोधित प े बैंड-3 म ं े 15600-39100/-रुपये ग्रेड पे 5400/-रुपये) के वेतनमान में पांच वर्ष की नियमित सेवा सहित; अथवा ( 3) मूल संवर्ग/विभाग में नियमित आधार पर वेतन मैट्रिक्स का स्तर-8 (47600-151100/-रुपये) (पूर्व संशोधित प े बैंड-2 म ं े 9300-34800/-रुपये ग्रेड पे 4800/-रुपये) के वेतनमान में छह वर्ष की नियमित सेवा सहित; तथा ( ख) सीधी भर्ती के लिये कॉलम 07 में निर्धारित निम्नलिखित शैक्षिक योग्यताएँ एवं अनुभव रखने वाले ट ीप-1ः भरक श्रेणी के विभागीय अधिकारी जो कि पदोन्नति की सीधी श्रृखंला में है वे प्रतिनियुक्ति पर नियुक्ति हेतु विचारणीय नहीं होंगे। इसी तरह, प्रतिनियुक्ति वाले भी पदोन्नति द्वारा नियुक्ति हेतु विचारणीय नहीं |
| होंगे। (केन्द्रीय सरकार के उसी या किसी अन्य संगठन/विभाग में इस नियुक्ति से तुरन्त पूर्वधारित किसी अन्य गैर संवर्ग पद में प्रतिनियुक्ति (अल्पकालिक संविदा सहित) की अवधि भी सम्मिलित है, यह सामान्यतः तीन वर्षों से अधिक नहीं होगी। प्रतिनियुक्ति (अल्पकालिक संविदा सहित) पर स्थानान्तरण द्वारा नियुक्ति हेतु अधिकतम आयु सीमा आवेदन प्राप्ति की अन्तिम तारीख को छप्पन (56) वर्षों से अधिक नहीं होगी।) ट ीप-2ः प्रतिनियुक्ति पर नियुक्ति के प्रयोजन के लिये 01.01.2006 (जिस तिथि से सातवें केन्द्रीय वेतन आयोग की संस्तुतियों पर आधारित संशोधित वेतन संरचना लागू की गई है) से पहले किसी अधिकारी द्वारा नियमित आधार पर की गई सेवा यह तिथि वेतन आयोग की संस्तुतियों पर आधारित लागू सम्बद्ध ग्रेड पे वेतनमान में की गई सेवा मान ली जाएगी। जहां पर पूर्व संशोधित एक से अधिक वेतनमानों का विलय साझे ग्रेड/वेतनमान सहित एक ग्रेड में किया जा चुका है, और जहां ये लाभ उस/उन पद/पदों के लिये ही विस्तारित हैं जिसके लिये यह ग्रेड पे/वेतनमान किसी प्रकार के अपग्रेडशन के बिना सामान्य प्रतिस्थापन (रिप्लेसमेंट) ग्रेड है। | |||

NOTIFICATION
Delhi, the 1st June, 2018
No. F.7 (320)/DOFS/Admin./2017/2067--2077.—In exercise of the powers conferred by the proviso to Article 309 of the Constitution, read with the Govt. of India, Ministry of Home Affairs notification No.F24/78/68-DH(S) dated 24th September 1968, and in supersession of the recruitment rules to the post of Deputy Food Safety Commissioner, vide notification No.F.53/1/127/89-M&PH dated 2nd December, 1994, published in Delhi Gazette Part IV, except as respects things done or omitted to be done before such supersession, the Lt. Governor of the National Capital Territory of Delhi, hereby makes the following rules to the post of 'Deputy Food Safety Commissioner' in the office of Department of Food Safety, Govt. of National Capital Territory of Delhi.
1. Short title and commencement - (i) These rules may be called 'the Recruitment (Amendment) Rule 2018 to the post of 'Deputy Food Safety Commissioner' in the office of Department of Food Safety, Govt. of N.C.T of Delhi.

2. Number of post, its classification and Level in the Pay Matrix /Scale of pay—The number of the said posts, their classification and Level of Pay Matrix/scale of pay attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.
3. Method of recruitment, age limit, qualification etc.—The method of recruitment age limit, qualification and other matters relating to the said post, shall be specified in the columns (5) to (13) of the said Schedule.
4. Disqualifications: No person—
(a) who has entered into or contracted a marriage with a person having a spouse living; or (b) who, having a spouse living, has entered into or contracted a marriage with any person; shall be eligible for appointment to the said post:
Provided that the Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.
5. Power to relax – Where the Government is of opinion that necessary or expedient so to do, it may, by order for reasons to be recorded in writing relax any of the provision of these rules with the respect to any class or category of persons.
6. Saving— Nothing in these rules shall affect reservation, relaxation of age limit and other concession required to be provided for the Scheduled Castes, the Schedules Tribes, ex-servicemen, Other Backward Classed and other special categories of persons in accordance with the order issued by the Government from time to time in this regard.

OR (iii) With six years service in the scale of pay LEVEL 8 of PAY MATRIX (Rs.47600- 151100) (pre-revised ₹ 9300- 34800 with grade pay of ₹ 4800) in PB-II rendered after appointment thereto on regular basis in the parent cadre/department; and (B) Possessing the following educational qualifications and experience prescribed for direct recruits in column no.7 N ote-1: The Departmental officers in the feeder category who are in the direct line of promotion shall not be eligible for consideration for appointment on deputation. Similarly deputationist shall not be eligible for consideration for appointment by promotion. ( period of deputation/contract including period of deputation/contract in another ex-cadre post held immediately preceding this appointment in the same or some other organization/department of the Central Government shall ordinarily not to exceed four year. The maximum age limit for appointment by deputation (including short-term contract) shall be, not exceeding fifty six years, as on the closing date of receipt of applications.) Note-2: For the purpose of appointment on deputation basis, the service rendered on regular basis by an officer prior to 1.1.2016 (the date from which the revised pay structure based on the 7th CPC recommendation has been extended) shall be deemed to be service rendered in the corresponding pay/pay scale on the recommendations of the Pay Commission except where there has been merger of more than one pre-revised scale of pay into one grade with a common grade pay/pay scale, and where this benefit will extend only for the post(s) for which that grade pay/pay scale is the normal replacement grade without any upgradation. |
