सं.फा. 4(429)/प्रशा./आरआर/एमवीआई/टीपीटी/2015/1460..—गृह मंत्रालय, भारत सरकार की दिनांक 13 जुलाई, 1959 की अधिसूचना सं.फा. 27(59)-एचआईएम (i) के साथ पठित संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदा शक्तियों का प्रयोग करते हुए तथा दिनांक 9 अप्रैल, 1999 की अधिसूचना सं.1(1)/आरईसीटीटी/ एमवीआई /टीपीटी/96 के अनुसार पुनः संशोधित तथा दिनांक 28 मार्च, 1968 की अधिसूचना सं. 2(8)/68/सेवाएं (ग) के अनुसार अधिसूचित मोटर वाहन निरीक्षक के भर्ती नियमों के अधिक्रमण में, ऐसे अधिक्रमण से पूर्व की गई या हटाए जाने के लिए की जाने वाली बातों को छोड़कर, राष्ट्रीय राजधानी क्षेत्र दिल्ली के उपराज्यपाल, संघ लोक सेवा आयोग के पूर्व परामर्श से परिवहन विभाग, राष्ट्रीय राजधानी क्षेत्र दिल्ली सरकार में मोटर वाहन निरीक्षक के पद हेतु निम्नलिखित भर्ती नियम बनाते हैंः-
1. संक्षिप्त शीर्षक एवं प्रारंभ :-(1) इन नियमों को परिवहन विभाग, राष्ट्रीय राजधानी क्षेत्र दिल्ली सरकार में (मोटर वाहन निरीक्षक), भर्ती नियमावली, 2018 कहा जायेगा।
(2) ये शासकीय राजपत्र में अपनी प्रकाशन की तिथि से लागू होंगे।
2. पदों की संख्या, वर्गीकरण एवं वेतन मैट्रिक्स में स्तर ः-उक्त पदों की संख्या, इसका वर्गीकरण तथा वेतन मैट्रिक्स में स्तर के साथ संबद्ध इन विनियमों के साथ संलग्न अनुसूची के कॉलम (2) से (4) में यथाविनिर्दिष्ट होंगे। 3. भर्ती पद्धति, आयु सीमा, योग्यताएं इत्यादि :-उक्त पद की भर्ती पद्धति, आयु सीमा, योग्यताएं तथा उससे संबंधित अन्य मामले उक्त अनुसूची के कॉलम (5) से (13) में यथाविनिर्दिष्ट होंगे।

(क) जिसने किसी ऐसे व्यक्ति से विवाह किया है जिसका जीवित पति/पत्नी है; या
(ख) जिसने जीवित पत्नी/पति के रहते हुए किसी अन्य व्यक्ति के साथ विवाह किया है,
वह उक्त पद पर नियुक्ति के लिये अयोग्य होगा :
उपबंध है कि सरकार यदि इस बात से संतुष्ट है कि ऐसा विवाह ऐसे व्यक्ति या अन्य पार्टी पर लागू व्यक्तिगत कानून के अन्तर्गत अनुमति योग्य है तथा ऐसा करने के अन्य आधार हैं तब किसी व्यक्ति को इस नियम के प्रचालन से छूट प्रदान की जा सकती है।
5. छूट प्रदान करने की शक्ति :-जहां सरकार का मत है कि ऐसा करना आवश्यक या समीचीन है तो वह आदेश द्वारा तथा कारणों को लिखित में अभिलेखबद्ध करते हुए तथा संघ लोक सेवा आयोग के साथ परामर्श से तथा सरकार के पूर्व अनुमोदन से व्यक्तियों के किसी वर्ग या श्रेणी के संबंध में इन विनियमों के उपबंधों से छूट प्रदान कर सकती है। 6. बचाव :-इस विनियम में कोई भी बात इस संबंध में सरकार द्वारा समय-समय पर जारी आदेशों के अनुसार अनुसूचित जाति, अनुसूचित जनजाति, अन्य पिछड़ा वर्ग, भूतपूर्व सैनिक तथा व्यक्तियों के अन्य विशेष वर्गों के लिये अपेक्षित आरक्षण, आयु सीमा में छूट एवं अन्य रियायतों पर प्रभाव नहीं डालेगी।

| 6. | सीधी भर्ती वाले उम्मीदवारों के लिए आयु सीमा | ः | तीस वर्ष से अधिक नहीं (केन्द्रीय सरकार द्वारा जारी अनुदेशों या आदेशों के अनुसार सरकारी कर्मचारियों के लिए पाँच वर्ष तक शिथिलनीय) टीपः आयु सीमा निर्धारित करने के लिए मान्य तारीख वही होगी जो भारत में रह रहे उम्मीदवारो के आवेदन पत्र प्राप्त करने की अंतिम तिथि होगी, लेकिन यह असम, मेघालय, अरूणाचल प्रदेश, मिजोरम, मणिपुर, नागालैंड़, त्रिपुरा, सिक्किम, जम्मू व कश्मीर राज्य की लद्दाख सब डिवीजन, हिमाचल प्रदेश का लाहौल व स्पीति जिला तथा चम्बा जिले की पांगी सब डिवीजन व अंडमान निकोबार द्वीपसमूह व लक्षद्वीप के उम्मीदवारों के लिए निर्धारित अंतिम तारीख नहीं है। |
| 7. | सीधी भर्ती वाले उम्मीदवारों से अपेक्षित शैक्षिक तथा अन्य योग्यताएॅं | ः | 1. मान्यता प्राप्त शिक्षा बोर्ड से 10वीं कक्षा उत्तीर्ण। 2. मान्यता प्राप्त संस्थान से ऑटोमोबाईल इंजीनियरिंग या मैकेनिकल इंजीनियरिंग में तीन वर्ष का डिप्लोमा। 3. पेट्रोल तथा डीजल इंजन लगे हल्के एवं भारी यात्री तथा माल वाहन की मरम्मत में ऑटोमोबाईल उद्योग उपक्रम की कर्मशाला से एक वर्ष का अनुभव। 4. मोटर साईकिल हल्के मोटर वाहन तथा भारी मोटर वाहनों को चलाने के लिये उसको अधिकृत करने वाला वैध ड्राईविंग लाइेंसस धारण करना आवश्यक है। टीप 1 ः अन्यथा सुयोग्य उम्मीदवारों के मामले में, कारणों को लिखित में अभिलेखबद्ध करते हुए, योग्यताएं सक्षम प्राधिकारी के विवेक पर शिथिलनीय है। टीप-2ः यदि चयन की किसी अवस्था में सक्षम प्राधिकारी के अभिमत से अनुसूचित जाति/ जनजातियों के लिए आरक्षित रिक्त पदों को भरने के लिए अपेक्षित अनुभव रखने वाले इन जातियों के उम्मीदवारों के पर्याप्त संख्या में मिलने की संभावना नहीं है, तो अनुभव संबंधी योग्यताएं सक्षम प्राधिकारी के विवेक पर शिथिलनीय है। |

| 11. | यदि पदोन्नति/प्रतिनियुक्ति/आमेलन द्वारा भर्ती होनी हो तो ग्रेड जिनसे पदोन्नति/प्रतिनियुक्ति/आमेलन किया जाना है | ः | पदोन्नति :- ग्रेड में छह वर्ष की नियमित सेवा वाले स्तर-5 (29200-923/-रुपये) ड्राइविंग निरीक्षक में से पदोन्नति। टीपः- जिन कनिष्ठ अधिकारियों ने अपनी अर्हक/पात्रता सेवा पूरी कर ली है वे पदोन्नति के लिए विचारणीय है। उनके वरिष्ठ अधिकारी भी पदोन्नति के लिए विचारणीय होंगे बशर्तें कि उनके लिए अपेक्षित अर्हक/पात्रता सेवा ऐसी अपेक्षित अर्हक/पात्रता सेवा की अवधि के आधे से न्यून या दो वर्ष से कम न हो और उन्होंने आगामी उच्च ग्रेड पर पदोन्नति के लिए अपनी परिवीक्षा अवधि अपने कनिष्ठ अधिकारियों के साथ सफलतापूर्वक पूरी कर ली होे, जिन्होंने (कनिष्ठ अधिकारी) उतनी अर्हक/पात्रता पहले ही पूरी कर ली है। |

Delhi, the 25th February, 2019
No. F. 4 (429)/Admn)/RR/MVI/TPT/2015/1460.—In exercise of the powers conferred by the proviso to article 309 of the Constitution, read with the Government of India, Ministry of Home Affairs' Notification No. F. 27(59)-Him(i), dated 13th July, 1959 and in supersession of the MVI Recruitment Rules notified vide notification No. F. 2(8)/68/Services (C) dated 28th March, 1968 and further amended vide notification no. F. 1(1)/Rectt./MVI/Tpt/ 96 dated 9th April, 1999, except as respects things done or omitted to be done before such supersession, the Lt. Governor of the National Capital Territory of Delhi after prior consultation with the Union Public Service Commission, is pleased to make following recruitment rules for the post of Motor Vehicle Inspector in Transport Department, Government of National Capital Territory of Delhi, namely:-
1. Short title and commencement – (1) These rules may be called the Transport Department, Govt. of National Capital Territory of Delhi (Motor Vehicle Inspector), Recruitment Rules, 2018. (2) They shall come into force on the date of their publication in the Official Gazette.
4 DELHI GAZETTE : EXTRAORDINARY PART IV]2. Number of posts, classification and level in the pay matrix – The number of posts, its classification and level in the pay matrix attached thereto, shall be as specified in columns (2) to(4) of the Schedule annexed to these rules.
3. Method of recruitment, age-limit, qualification etc. – The method of recruitment, age-limit, qualifications and other matters relating thereto shall be as specified in columns (5) to (13) of the said schedule.
4. Disqualification – No person,
(a) who has entered into or contracted a marriage with a person having a spouse living; or (b) who, having a spouse living, has entered into or contracted a marriage with any person, shall be eligible for appointment to the said post:
Provided that the Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.
5. Powers to relax – Where the Government is of the opinion that it is necessary or expedient so to do, it may, by order and for reasons to be recorded in writing and in consultation with the Union Public Service Commission, relax any of the provisions of these rules with respect to any class or category of persons.
6. Saving – Nothing in these rules shall affect reservations, relaxation of age-limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, Other Backward Classes, Ex- Serviceman and other categories of persons in accordance with the orders issued by the Government from time to time in this regard.

One year experience from a workshop of Automobile Industry undertaking repair of light & heavy passenger and goods vehicle fitted with petrol and diesel engine. 4. Must hold a valid driving license authorizing him to drive motor cycle, light motor vehicles and heavy motor vehicles. Note 1: Qualifications are relaxable at the discretion of the Competent Authority, for reasons to be recorded in writing, in the case of candidates otherwise well qualified. Note 2: The qualification(s) regarding experience is/are relaxable at the discretion of the Competent Authority, for reasons to be recorded in writing in the case of candidates belonging to scheduled castes or scheduled tribes if at any state of selection the competent authority, is of the opinion that sufficient number of candidates from these communities |
