Hon'ble the Chief Justice of this Court has been pleased to amend Sl.No.23 of the Schedule-II(A) to the 'Delhi High Court Establishment (Appointment and Conditions of Service) Rules, 1972' so as to read as under:-

सं. 87/स्था./ई-IV/डी.एच.सी.—भारतीय संविधान के अनुच्छेद 229 के अंतर्गत निहित शक्तियों का प्रयोग करते हुए, इस न्यायालय के माननीय मुख्य न्यायाधीश 'दिल्ली उच्च न्यायालय स्थापना (नियुक्ति एवं सेवा की शतें) नियम, 1972' की अनुसूची-II (क) के क्रम सं.-18 को निम्नलिखित रूप से सहर्ष संशोधित करते हैं:-

| (ख) सीधी भर्ती हेतु : आशुलेखन एवं ट ंकण में क्रमशः 110 शब्द प्रति मिनट एवं 40 शब्द प्रति मिनट की न्यूनतम गति के साथ स्नातक | | ( ख) | "वे निजी सहायक जिन्होंने पांच (05) वषों की नियमित सेवा पूरी कर ली हो, वरिष्ठ निजी सहायक के रूप में पदोन्नत होंगे | ऐसे पदोन्नत निजी सहायक के संवर्ग में अपनी परस्पर वरिष्ठता बनाए रखेंगे | यदि उक्त श्रेणी में किसी कनिष्ठ कर्मचारी ने पांच वर्ष की नियमित सेवा पूरी कर ली हो तो उसके वरिष्ठ पर भी विचार किया जाएगा, बशते न्यूनता छः माह से कम की हो | इस परंतुक के अंतर्गत की गई पदोन्नतियां समायोजित की जाएंगी तथा 50% पदोन्नति कोटे से होंगी |" रिक्त पदों में से 50% प्रतिशत अंग्रेजी भाषा ( निबंध, व्याकरण, अनुवाद) के एक पेपर के उपरान्त कं प्यूटर/ टाइपराइटर पर लिप्यन्तरित किए जाने वाले आशुलिपि श्रुतलेख को शामिल करते हुए लिखित परीक्षा के आधार पर सीधी भर्ती द्वारा| चयनित अभ्र्यर्थयों की एक मौखिक परीक्षा** भी होगी | (नोट:- प्रत्येक प्रतिभागी को दो आशुलिपि श्रुतलेख परीक्षा में उपस्थित होने का अवसर दिया जाएगा तथा दोनों में से श्रेष्ठतम पर विचार किया जाएगा |) |

No. 87/Estt./E-IV/DHC.—In exercise of powers vested under Article 229 of the Constitution of India, Hon'ble the Chief Justice of this Court has been pleased to amend Sl.No.18 of Schedule-II(A) to 'Delhi High Court Establishment (Appointment and Conditions of Service) Rules, 1972' so as to read as under:-

For direct recruits: Graduate with speed of not less than 110 w.p.m. in shorthand and 40 w.p.m. in typewriting. | a. b . | 50% of the vacant posts by promotion from category 23 (Personal Assistant) mentioned in Schedule-I(A) on the basis of seniority- cum-suitability on the basis of shorthand dictation to be transcribed on Computer/ Typewriter, failing which :- " Personal Assistants, who have completed five (05) years' of regular service would be promoted as Senior Personal Assistant. Such promotees would maintain inter se seniority between them in the cadre of Personal Assistant. In case a junior in the said category has completed five years' of regular service, his senior would also be considered, provided the shortfall is less than six months. Promotions made under this proviso would be adjusted and from the 50% promotion quota." 5 0% of the vacant posts by direct recruitment on the basis of written examination comprising of one paper in English language (Essay, Grammar and Translation) followed by a Shorthand dictation to be transcribed on Computer/Typewriter. The short listed candidates would also undergo a viva voce** test. ( Note: Each participant will be given opportunity to appear in two shorthand dictation transcription tests and best of the two will be considered.) |

सं. 88/स्था./ई.-IV/डी.एच.सी.—भारतीय संविधान के अनुच्छेद 229 के अंतर्गत निहित शक्तियों का प्रयोग करते हुए, इस न्यायालय के माननीय मुख्य न्यायाधीश 'दिल्ली उच्च न्यायालय स्थापना (नियुक्ति एवं सेवा की शतें) नियम, 1972' के नियम 5 में निम्नलिखित संशोधन सहर्ष करते हैं:-
| 5. | नियुक्ति हेतु शर्त एवं योग्यता | उच्च न्यायालय की स्थापना में नियुक्ति हेतु वह व्यक्ति योग्य होगा जो- (क) भारत का नागरिक हो; या (ख) भारत सरकार द्वारा समय-समय पर जारी निदेशानुसार नेपाल का नागरिक हो; तथा (ग) चिकित्सीय रूप से दुरुस्त हो; (घ) अच्छे चरित्र का हो; (ङ) किसी मान्यता प्राप्त विश्वविद्यालय से निर्धारित शैक्षणिक अर्हता प्राप्त की हो; (च) उस वर्ष में जिसमें भर्ती की प्रक्रिया शुरू होगी, जनवरी के पहले दिन, 18 वर्ष से कम तथा 27 वर्ष से अधिक, आयु का न हो | ब शते अनुसूचित जाति या अनुसूचित जनजाति के सदस्य के लिए ऊपरी आयु सीमा 32 वर्ष होगी | ब शते अन्य पिछ्ड़े वर्ग से सम्बंधित अभ्र्यर्थयों के लिए सीधी भर्ती हेतु ऊपरी आयु सीमा 30 वर्ष होगी | ब शते सीधी भर्ती प्रक्रिया के अंतर्गत उप निबंधक ( लेखा) के पद हेतु सामान्य श्रेणी के अभ्यर्थी के लिए ऊपरी आयु सीमा 45 वर्ष होगी , अन्य पिछड़े वर्ग से सम्बंधित अभ्यर्थी के लिए 48 वर्ष तथा अनुसूचित जाति/ अनुसूचित जनजाति वर्ग के अभ्र्यर्थयों हेतु 50 वर्ष होगी | ब शते निजी सचिव/ पुस्तकालयाध्यक्ष के पद हेतु सामान्य श्रेणी के लिए ऊपरी आयु सीमा 35 वर्ष होगी एवं अनुसूचित जातियों / अनुसूचित जनजातियों/ अन्य पिछड़े वगों के सदस्यों के लिए 40 वर्ष होगी | ब शते वरिष्ठ निजी सहायक / निजी सहायक/ कनिष्ठ न्यायिक सहायक / रिस्टोरर के पद हेतु सामान्य श्रेणी के अभ्र्यर्थयों के लिए ऊपरी आयु सीमा 32 वर्ष होगी, अन्य पिछड़े वर्ग से सम्बन्धित अभ्र्यर्थयों हेतु 35 वर्ष तथा अनुसूचित जाति/ अनुसूचित जनजाति वर्ग से सम्बंधित अभ्र्यर्थयों हेतु 37 वर्ष होगी | परन्तु यह और कि उपरोक्त किसी भी परंतुक की ऊपरी आयु सीमा |
| स व्यक्ति पर लागू नहीं होगी जो पहले से ही उच्च न्यायालय की स्थापना में सेवारत है | ऐ सा कोई अभ्यर्थी जो इस न्यायालय द्वारा ली जाने वाली किसी भी परीक्षा में अनुचित साधनों का प्रयोग करता पाया जाता है उसकी अभ्र्यर्थता न के वल उस परीक्षा हेतु खारिज की जाएगी बल्कि उसे दिल्ली उच्च न्यायालय द्वारा संचालित आगामी अन्य सभी भर्ती प्रक्रियाओं के लिए भी प्रतिबंधित कर दिया जाएगा | |

No. 88/Estt./E-IV/DHC.—In exercise of powers vested under Article 229 of the Constitution of India, Hon'ble the Chief Justice of this Court has been pleased to amend Rule 5 of the 'Delhi High Court Establishment (Appointment and Conditions of Service) Rules, 1972' so as to read as under:-
| 5. | Condition of and eligibility for appointment | A person shall be eligible for appointment on the establishment of the High Court who:- a. is a citizen of India: or b. is a subject of Nepal, as per instructions issued by Government of India from time to time; and c. is medically fit: d. is of a good character. e. possesses the prescribed education qualifications from a recognized University; f. is not below 18 years of age and over 27 years of age on the first day of January of the year in which the process of recruitment is initiated. Provided that the upper age limit for a member of a Scheduled Caste or Scheduled Tribe shall be 32 years. Provided that the upper age limit for direct recruitment in respect of candidates belonging to Other Backward Classes shall be 30 years. Provided that the upper age limit for the post of Deputy Registrar (Accounts) under direct recruitment process shall be 45 years for General Category Candidate, 48 years for Candidates belonging to Other Backward Classes and 50years for candidates belonging to Scheduled Castes / Scheduled Tribes Categories. Provided that the upper age limit for the post of Private Secretary / Librarian shall be 35 years for the General Candidates and 40 years for the members of Scheduled Castes/ Scheduled Tribes/ Other Backward Classes. Provided that the upper age limit for the post of Senior Personal Assistant / Personal Assistant/ Junior Judicial Assistant/ Restorer shall be 32 years for General Category Candidates, 35 years for Candidates belonging to Other Backward Classes and 37 years for candidates belonging to Scheduled Castes/ Scheduled Tribes Categories. Provided further that the upper age limits in any of the aforesaid |
| proviso shall not apply to a person already serving on the establishment of the High Court. T he candidature of such candidate, who would be found using unfair means in any of the Examinations conducted by this Court, shall not only be rejected for the said Examination, but he/she shall also be debarred for all times to come for any of the other recruitment processes conducted by High Court of Delhi. |
Note: The above amendment shall come into force with immediate effect.

| (रिस्टोरर) में से किसी पर भी 5 वषों की सेवा सहित स्नातक अथवा 8 वषों की सेवा सहित मैट्रिक/ उच्चतर माध्यमिक अथवा इनमें से किसी पद पर भी सम्मिलित सेवा। ( ख) (ii) सीधी भर्ती के लिए: स्नातक | ( ख) (ii) | ि लखित परीक्षा और साक्षात्कार** के आधार पर सीधी भर्ती द्वारा न ोट: (i) उपरोक्त (क) एवं (ख) के अंतर्गत कोर्ट ऑफ़िसर के पद के लिए उन्हीं कर्मचारियों पर विचार किया जाएगा जो कोर्ट ऑफ़िसर के कर्तव्य को पूरा करने के लिए और उच्च न्यायालय परिसर में रहने के लिए तैयार हों। इस पद पर नियुक्ति प्रारम्भ करने से पहले कर्मचारियों की सम्मति एक परिवचन के रूप में ली जाएगी। इस पद पर नियुक्ति पूरी तरह से शतों और कोर्ट ऑफ़िसर के कर्तव्य को पूरा करने के अधीन होगी। (ii) उपरोक्त (i) के अंतर्गत कोर्ट ऑफ़िसर के कर्तव्य को निभाने के लिए कर्मचारियों की अनुपलब्धता/ अनिच्छा की दशा में, कोर्ट ऑफ़िसर के पद को न्यायिक सहायक के संवर्ग या उसके समतुल्य पद पर 3 वर्ष की सेवा सहित वरिष्ठता-सह- उपयुक्तता के आधार पर पदोन्नति द्वारा भरा जाएगा और (iii) उपरोक्त (i) और (ii) के अंतर्गत अनुपलब्धता की दशा में, कनिष्ठ न्यायिक सहायक/ रिस्टोरेर के संवर्ग में से 5 वर्ष की सेवा या न्यायिक सहायक और कनिष्ठ न्यायिक सहायक/ रिस्टोरर के संवर्ग में 5 वर्ष की सम्मिलित सेवा के साथ वरिष्ठता-सह- उपयुक्तता के आधार पर पदोन्नति द्वारा। |
**विभागीय परीक्षा के माध्यम से नियुक्ति करते समय, मौखिक परीक्षा/साक्षात्कार के अंक लिखित परीक्षा के कु ल अंकों के 15% से अधिक नहीं होंगे और सीधी भर्ती के मामले में 25% से अधिक नहीं होंगे।

**Viva-voce/interview marks shall not be more than 15% of the total marks of the written examination while making appointment through departmental examination and 25% in the case of direct recruitment.
