दिनांक 8 मई, 2018
संख्या सा०का०नि० 31/संवि०/अनु० 309/2018.- भारत के संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, हरियाणा के राज्यपाल, इसके द्वारा, हरियाणा वित्तायुक्त कार्यालय (ग्रुप क) राज्य सेवा नियम, 1980, को आगे संशोधित करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात् :- 1. ये नियम हरियाणा वित्तायुक्त कार्यालय (ग्रुप क) राज्य सेवा (संशोधन) नियम, 2018, कहे जा सकते हैं। 2. हरियाणा वित्तायुक्त कार्यालय (ग्रुप क) राज्य सेवा नियम, 1980 (जिन्हें, इसमें, इसके बाद, उक्त नियम कहा गया है) में, नियम 2 में, (i) खण्ड (ख) के स्थान पर, निम्नलिखित खंड प्रतिस्थापित किया जाएगा, अर्थात् ;–
''(ख) वित्तायुक्त से अभिप्राय है, अपर मुख्य सचिव एवं वित्तायुक्त राजस्व ;''
(ii) उक्त नियमों में, खंड़ (ड.) के उप खंड (ii) का लोप कर दिया जाएगा।
3. उक्त नियमों में, नियम 5 के बाद, निम्नलिखित नियम रखा जाएगा, अर्थात् ;–
"5क अर्हताएं तथा अनुभव.- कोई भी व्यक्ति, सेवा में तब तक नियुक्त, नहीं किया जाएगा जब तक वह इन नियमों के परिषिष्ट ख के खाना 4 में विनिर्दिष्ट अर्हताएं तथा अनुभव न रखता हो।''।श् 4. उक्त नियमों में, नियम 6 के स्थान पर, निम्नलिखित नियम प्रतिस्थापित किया जाएगा, अर्थात् ;–
"6 भर्ती का ढंग.- (1) सेवा में भर्ती निम्नलिखित ढंग से की जाएगी,- (क) संयुक्त सचिव की दशा में ,-
(i) उप सचिवों में से पदोन्नति द्वारा; अथवा (ii) किसी राज्य सरकार या भारत सरकार की सेवा में पहले से ही लगे किसी अधिकारी के स्थानान्तरण या प्रतिनियुक्ति द्वारा;
(ख) उप सचिव की दशा में ,-
(i) अवर सचिवों में से पदोन्नति द्वारा; अथवा (ii) किसी राज्य सरकार या भारत सरकार की सेवा में पहले से ही लगे किसी अधिकारी के स्थानान्तरण या प्रतिनियुक्ति द्वारा;
(ग) संयुक्त राज्य सम्पादक की दशा में ,-
(i) सम्पादकों में से पदोन्नति द्वारा; अथवा (ii) किसी राज्य सरकार या भारत सरकार की सेवा में पहले से ही लगे किसी अधिकारी के स्थानान्तरण या प्रतिनियुक्ति द्वारा; (घ) अवर सचिव की दशा में ,-
(i) अधीक्षकों और निजी सचिवों में से 4ः1 के अनुपात से पदोन्नति द्वारा; अथवा (ii) किसी राज्य सरकार या भारत सरकार की सेवा में पहले से ही लगे किसी अधिकारी के स्थानान्तरण या प्रतिनियुक्ति द्वारा;
(ड.) सचिव की दशा में ,-
(i) निजी सचिवों में से पदोन्नति द्वारा; अथवा (ii) किसी राज्य सरकार या भारत सरकार की सेवा में पहले से ही लगे किसी अधिकारी के स्थानान्तरण या प्रतिनियुक्ति द्वारा;
टिप्पण.- निजी सचिव, जो वितायुक्त कार्यालय (ग्रुप ख) का सदस्य है, अवर सचिव या सचिव के पद पर पदोन्नति के लिए अपना विकल्प प्रस्तुत करेगा।
5. उक्त नियमों में, नियम 11 के स्थान पर, निम्नलिखित नियम प्रतिस्थापित किया जाएगा, अर्थात् ;–
―11 अनुशासन, शास्तियां तथा अपीलें.- (1) अनुशासन, शास्तियों तथा अपीलों से सम्बन्धित मामलों में, सेवा के सदस्य समय-समय पर संशोधित हरियाणा सिविल सेवा (दण्ड तथा अपील) नियम, 2016, द्वारा शासित होंगे :
परन्तु ऐसी शास्तियों का स्वरूप, जो लगाई जा सकती हैं, ऐसी शास्तियां लगाने के लिए सशक्त प्राधिकारी तथा अपील प्राधिकारी, भारत के संविधान के अनुच्छेद 309 के अधीन बनाई गई किसी विधि या नियमों के उपबन्धों के अधीन रहते हुए वे होंगे, जो इन नियमों के परिशिष्ट ग में विनिर्दिष्ट हैं । (2) हरियाणा सिविल सेवा (दण्ड तथा अपील) नियम, 2016, के नियम 6 के अधीन आदेश करने के लिए सक्षम प्राधिकारी तथा अपील प्राधिकारी भी वह होगा जो नियमों के परिशिष्ट घ में विनिर्दिष्ट हैं ।436 HARYANA GOVT. Notification
The 8th May, 2018
No. G.S.R. 31/Const./Art. 309/2018.— In exercise of the powers conferred by the proviso to article 309 of the Constitution of India, the Governor of Haryana hereby makes the following rules further to amend the Haryana Financial Commissioner's Office (Group A) State Service Rules, 1980, namely :- 1. These rules may be called the Haryana Financial Commissioner's Office (Group A) State Service (Amendment) Rules, 2018. 2. In the Haryana Financial Commissioner's Office (Group A) State Service Rules, 1980 (hereinafter called the said rules), in rule 2 (i) for clause (b), the following clause shall be substituted, namely;-
―(b) ―Financial Commissioner‖ means the Additional Chief Secretary and Financial Commissioner Revenue;‖
(ii) In clause (e), Sub clause (ii) shall be omitted. 3. In the said rules, after rule 5, the following rule shall be inserted, namely;-
―5A. Qualification and experience.— No person shall be appointed to the service unless he is in possession of qualifications and experience specified in column 4 of Appendix B to these rules.‖.
4. In the said rules, for rule 6, the following rule shall be substituted, namely;-
―Method of recruitment.-
6 (1) Recruitment to the Service shall be made,-
(a) in the case of Joint Secretary-
(i) by promotion from amongst the Deputy Secretaries; or (ii) by transfer or deputation of an officer already in the service of the Government of India or a State Government;
(b) in the case of Deputy Secretary-
(i) by promotion from amongst the Under Secretaries; or (ii) by transfer or deputation of an officer already in the service of the Government of India or a State Government;
(c) in the case of Joint State Editor -
(i) by promotion from amongst the Editors; or
(ii) by transfer or deputation of an officer already in the service of the Government of India or a State Government;
(d) in the case of Under Secretary -
(i) by promotion from amongst the Superintendents and Private Secretaries, in the ratio of 4:1; or
(ii) by transfer or deputation of an official already in the service of the Government of India or a State Government;
(e) in the case of Secretary -
(i) by promotion from amongst the Private Secretaries; or (ii) by transfer or deputation of an official already in the service of the Government of India or a State Government;
Note.— Private Secretary, who is a member of the Financial Commissioner's Office (State Service, Group B)
shall furnish option for promotion to the post of Under Secretary or to the post of Secretary.
5. In the said rules, for rule 11, the following rule shall be substituted, namely;–
―Discipline, penalties and appeals;- 11. (1) In the matter relating to discipline, penalties and appeals, members of the Service shall be governed by the Haryana Civil Services (Punishment and Appeal) Rules, 2016, as amended from time to time:
Provided that the nature of penalties which may be imposed, the authority empowered to impose such penalties and appellate authority shall, subject to the provisions of any law of rules made under article 309 of the Constitution of India, be such as are specified in Appendix C to these rules.
(2) The authority competent to pass an order under rule 6 of The Haryana Civil Services (Punishment and Appeal) Rules, 2016, shall be as is specified in Appendix D to these rules.
