संख्या 04/22/2020-3एफ.आर./9497.- भारत के संविधान के अनुच्छेद 309 के परन्तुक के अधीन प्रदत्त शक्तियों का प्रयोग करते हुए, हरियाणा के राज्यपाल, इसके द्वारा, हरियाणा सिविल सेवा (सामान्य) नियम, 2016 को आगे संषोधित करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात् :-
1. (1) ये नियम हरियाणा सिविल सेवा (सामान्य) द्वितीय संषोधन नियम, 2023, कहे जा सकते हैं।
(2) ये नियम राजपत्र में इनके प्रकाषन की तिथि से लागू होंगे।
2. हरियाणा सिविल सेवा (सामान्य) नियम, 2016 में, नियम 22 के स्थान पर, निम्नलिखित नियम प्रतिस्थापित किया जाएगा, अर्थात् :-
''22. सरकारी सेवा में प्रवेष हेतु आयु .-
(1) हरियाणा सरकार के किसी भी विभाग के सरकारी कर्मचारियों की सेवा के निबन्धनों और शर्तों से संबंधित किन्हीं भी सेवा नियमों में यथा उपबन्धित के सिवाय, सरकारी सेवा में प्रवेष के लिए न्यूनतम आयु सीमा अठारह वर्ष से कम नहीं होगी और अधिकतम आयु सीमा बयालीस वर्ष से अधिक नहीं होगी। तथापि, जहाँ सरकारी सेवा में प्रवेष के लिए कर्तव्यों की प्र—ति तथा आवश्यक योग्यता के कारण किसी विभाग में किसी विशेष पद के लिए सीधी भर्ती हेतु न्यूनतम आयु सीमा अठारह वर्ष से अधिक या अधिकतम आयु सीमा बयालीस वर्ष से कम या अधीक है, तो आयु अपरिवर्तनीय रहेगी।
(2) निम्नलिखित प्रवर्गों के व्यक्ति, जो हरियाणा सरकार द्वारा समय-समय पर जारी किए गए अनुदेषों के अधीन सीधी भर्ती में आरक्षण का लाभ प्राप्त करने के लिए पात्र हैं, प्रत्येक के सामने वर्णित सीमा तक अधिकतम आयु सीमा में छूट का लाभ प्राप्त करने के लिए हकदार होंगे :-

| (iii) | दिव्यांगजन अधिकार अधिनियम, 2016 (201़6 का केन्द्रीय अधिनियम 49) के अधीन आने वाले दिव्यांगजन। | (i) ग ्रुप ग और घ के चिहि्नत पदों के लिए, तथा ग्रुप क और ख, जहाँ भर्ती खुली प्रतियोगिता परीक्षा से अन्यथा की जाती है, के चिहि्नत पदों के लिए भी अधिकतम बावन वर्ष के अध्यधीन आयु में दस वर्ष की छुट (जमा पाँच वर्ष यदि दिव्यांगजन अनुसूचित जातियों, पिछडे़ वर्गों या आर्थिक रूप से कमजोर वर्ग से सम्बन्धित है)। (ii) ग ्रुप क और ख पदों, जहाँ भर्ती खुली प्रतियोगिता परीक्षा के माध्यम से की जाती है, के लिए अधिकतम बावन वर्ष के अध्यधीन आयु में पाँच वर्ष की छूट (जमा पाँच वर्ष यदि दिव्यांगजन अनुसूचित जातियों, पिछडे़ वर्गों से सम्बन्धित है)। टिप्पण :- दिव्यांगजनों को ऊपरी आयु सीमा में छूट स्वीकार्य होगी इस तथ्य को ध्यान मेें रखे बिना कि चाहे विज्ञापित पद दिव्यांगजन के लिए आरक्षित है या नहीं, बशर्ते पद को सम्बन्धित दिव्यांगजन के लिए उपयुक्त चिहि्नत किया जाना चाहिए। |
| (iv) | पुलिस कार्मिक और ज ेल कार्मिक (उदाहरणार्थ सिपाही, सहायक उप- निरीक्षक) के ग्रुप ग पद जहॅां ऊपरी आयु सीमा बयालीस वर्ष से कम है। | अनुसूचित जातियों, पिछडे़ वर्गों और आर्थिक रूप से कमजोर वर्ग के लिए आयु में पाँच वर्ष की छूट। तथापि, भूतपूर्व सैनिकों को छूट, पुलिस विभाग या जेल विभाग, हरियाणा, जैसी भी स्थिति हों, के नियमों में दिए गए उपबन्धों के अनुसार स्वीकार्य होगी। |
| (v) | उन सैन्य कार्मिकोंं की पत्नियाँ जो सैन्य सेवा के दौरान अषक्त हो जाते हैं। | ग ्रुप क, ख, ग और घ के सभी पदों पर आयु में पाँच वर्ष की छूट। |
| (vi) | विधवा या विधिक रूप से तलाकशुदा महिलाएँ। | ग ्रुप क, ख, ग और घ के सभी पदों पर आयु में पाँच वर्ष की छूट। |
| (vii) | अन्य प्रवर्गों के आवेदकों हेतु आयु के प्रयोजन के लिए यथा विहित तिथि से दो वर्ष से अधिक समय तक अलग रहने वाली न्यायिक रूप से पृथक महिलाएँ। | ग ्रुप क, ख, ग और घ के सभी पदों पर आयु में पाँच वर्ष की छूट। |
| (viii) | अविवाहित महिलाएँ। | ग ्रुप क, ख, ग और घ के सभी पदों पर आयु में पाँच वर्ष की छूट। |
| (ix) | शॉर्ट सर्विस कमीशन अधिकारियों और आपातकालीन कमीशन अधिकारियों सहित भूतपूर्व सैनिक। | ग ्रुप क, ख, ग और घ के सभी पदो ं पर तीन वर्ष जोड़ते हुए उसकी सैन्य सेवा की सीमा तक आयु में छूट बषर्तेंः- (क) उसने अपनी निर्मुक्ति से पूर्व कम से कम छह मास की अवधि के लिए लगातार सैन्य सेवा की है; तथा (ख) वह कदाचार या अयोग्यता के कारण पदच्युति या सेवामुक्ति से अन्यथा निर्मुक्त किया गया था। |
| (x) | ऐसा व्यक्ति, जिसने सरकारी सहायता प्राप्त संस्थानों सहित हरियाणा सरकार के किसी भी विभाग/ बोर्ड/ निगम में पहले से ही तदर्थ /संविदा/वर्क-चार्जड / दैनिक मजदूरी आधार पर कार्य किया हैं या वर्तमान में कार्य कर रहा हैं। | बावन वर्ष की सीमा के अध्यधीन तथा इस शर्त के अध्यधीन भी कि यदि कोई व्यक्ति आयु में छूट के लाभ के साथ हरियाणा सरकार के किसी विभाग/बोर्ड/निगम इत्यादि में एक बार नियमित आधार पर नियुक्त किया गया है तो वह किसी पष्चात्वर्ती नियुक्ति के लिए लाभ प्राप्त करने का हकदार नहीं होगा, विराम अवधि, यदि कोई हो, को निकालते हुए आयु में किसी अन्य स्वीकार्य छूट, यदि कोई हो, सहित केवल तदर्थ/संविदा/ वर्क-चार्जड /दैनिक मजदूरी आधार पर समकक्ष पद पर पूर्ण किए गए वर्षों की संख्या के बराबर आयु में छूट। |
टिप्पण 1.- ग्रुप क, ख, ग और घ के किसी पद पर किसी भूतपूर्व सैनिक की नियुक्ति के लिए, उसकी आयु की गणना (सैन्य सेवा की वास्तविक अवधि सैन्य और सिविल सेवा के बीच तीन वर्ष तक की विराम अवधि, यदि कोई हो) को घटाते हुए वास्तविक आयु को ध्यान में रखते हुए की जाएगी। यदि परिणामिक आयु पद, जिसके लिए वह नियुक्ति चाहता है, के लिए विहित आयु उसे स्वीकार्य आयु में किसी अन्य छूट के वर्षों की संख्या सहित अधिकतम आयु सीमा से अधिक नहीं हैं, तो उसे आयु सीमा के संबंध में शर्तों को पूरा करने वाला माना जाएगा।
टिप्पण 2.- किसी भी प्रवर्ग (भूतपूर्व सैनिकों को छोड़कर) जो उपरोक्त वर्णित एक या से अधिक प्रवर्गों की आयु में छूट का लाभ प्राप्त करने का हकदार है, के आवेदक की ऊपरी आयु सीमा बावन वर्ष से अधिक नहीं होगी।
टिप्पण 3.- केवल सम्बन्धित विभाग/बोर्ड/निगम/सरकारी सहायता प्राप्त संस्था के नियुक्ति प्राधिकारी द्वारा जारी किया गया समकक्ष पद का अनुभव प्रमाणपत्र ही वैध होगा/होंगे। आयु में छूट का लाभ प्रदान करने से पूर्व, अनुभव प्रमाणपत्र(त्रों) को हरियाणा लोक सेवा आयोग या हरियाणा कर्मचारी चयन आयोग, जैसी भी स्थिति हो, द्वारा सम्बन्धित नियुक्ति प्राधिकारी (प्राधिकारियों) से सत्यापित करवाया जाएगा।''।

No.04/22/2020-3FR/9497.— In exercise of the powers conferred under the proviso to article 309 of the Constitution of India, the Governor of Haryana hereby makes the following rules further to amend the Haryana Civil Services (General) Rules, 2016, namely:-
1. (1) These rules may be called the Haryana Civil Services (General) Second Amendment Rules, 2023.
(2) These rules shall come into force on the date of their publication in the Official Gazette.
2. In the Haryana Civil Services (General) Rules, 2016, for rule 22, the following rule shall be substituted, namely:-
"22. Age for entry into Government service.-
(1) Save as otherwise provided in any service rules pertaining to terms and conditions of service of Government employees of any department of Haryana Government, the lower age limit shall not be less than eighteen years and the upper age limit shall not be more than forty-two years for entry into Government service. However, where for direct recruitment the lower age limit is more than eighteen years or upper age limit is less or more than forty-two years to a particular post in a department due toPART I] HARYANA GOVT. GAZ., OCT. 31, 2023 (KRTK. 9, 1945 SAKA) 975 nature of duties and essential qualification for entry into Government service, the same shall remain unchanged.
(2) The persons of following categories who are eligible to avail the benefit of reservation in direct recruitment under the instructions issued by Haryana Government from time to time shall be entitled to avail the benefit of relaxation in upper age limit upto the extent mentioned against each:-

| (i) | Scheduled Castes | Five years' relaxation in age on all posts of Group A, B, C and D. |
| (ii) | Backward Classes | Five years' relaxation in age on all posts of Group A, B, C and D. |
| (iii) | Persons with disabilities covered under the Rights of Persons with Disabilities Act, 2016 (Central Act 49 of 2016). | (i) ten years' relaxation in age (plus five years if a person with disability belongs to Scheduled Caste, Backward Classes or Economically Weaker Section) subject to maximum fifty-two years for identified posts of Group C and D, and also for the identified posts of Group A and B where the recruitment is made otherwise than through open competitive examination. (ii) five years' relaxation in age (plus five years if a person with disability belongs to Scheduled Caste, Backward Classes) subject to maximum fifty-two years for Group A & B posts where recruitment is made through open competitive examination. Note.— Relaxation in upper age limit shall be admissible to the person with disability irrespective of the fact whether the advertised post is reserved for person with disability or not, provided that the post should be identified suitable for person with disability concerned. |
| (iv) | Group C posts of Police Personnel and Prisons Personnel (e.g. Constable, Assistant Sub- Inspector) where upper age limit is less than forty-two years. | Five years' relaxation in age to Scheduled Caste, Backward Classes or Economically Weaker Section. However, relaxation to Ex-servicemen shall be admissible as per provision in the rules of Police Department or Prisons Department, Haryana, as the case may be. |
| (v) | Wives of military personnel who are disabled while in military service. | Five years' relaxation in age on all posts of Group A, B, C and D. |
| (vi) | Widowed or legally divorced women. | Five years' relaxation in age on all posts of Group A, B, C and D. |
| (vii) | Judicially separated women residing separately for more than two years from the date as prescribed for the purpose of age for applicants of other categories. | Five years' relaxation in age on all posts of Group A, B, C and D. |
| (viii) | Unmarried women. | Five years' relaxation in age on all posts of Group A, B, C and D. |
| (ix) | Ex-serviceman including Short Service Commissioned Officers and Emergency Commissioned Officers. | Relaxation in age on all posts of Group A, B, C and D to the extent of his military service added by three years provided— (a) he has rendered continuous military service for a period of not less than six months before his release; and (b) he was released otherwise than by way of dismissal or discharge on account of misconduct or inefficiency. |
| (x) | Persons who have already worked or presently working on adhoc/ contract/work-charged/ daily wages basis in any Department/ Board/ Corporation of Haryana Government including Government-aided Institutions. | Relaxation in age equal to the number of completed years only on equivalent post on adhoc/contract/work-charged/ daily wages basis excluding the period of break, if any, including any other age relaxation admissible, if any, subject to maximum age of fifty-two years and also subject to the condition that if once a person has been appointed on regular basis in any Department/Board/Corporation etc. of Haryana Government with the benefit of relaxation in age he shall not be entitled to avail the same again for any subsequent appointment. |
Note 1.— For appointment of an ex-serviceman to a post of Group A, B, C and D, his age shall be calculated keeping in view the actual age minus (actual period of military service plus upto three years of break, if any, between military and civil service). If the resultant age does not exceed the maximum age limit, including the number of years of any other relaxation in age admissible to him prescribed for the post for which he is seeking appointment, he shall be deemed to satisfy the condition regarding age limit.
Note 2.— The upper age limit of an applicant of any category (except Ex-servicemen) who is entitled to avail the benefit of relaxation in age of one or more of the categories mentioned above shall not exceed fifty-two years.
Note 3.— The experience certificate(s) of equivalent post issued by the appointing authority of respective Department//Board/ Corporation/Government-aided Institution only shall be valid. Before grant of benefit of relaxation in age, the experience certificate(s) shall be got verified by the Haryana Public Service Commission or Haryana Staff Selection Commission, as the case may be, from the Appointing Authority(ties) concerned.
