राज्य में तकनीकी शिक्षा के लिए हिमाचल प्रदेश तकनीकी विश्वविद्यालय की स्थापना, निगमन और विनियमन करने और उसके क्रियाकलापों को विनियमित करने तथा उससे सम्बन्धित या उसके आनुषंगिक विषयों का उपबन्ध करने के लिए अधिनियमअधिनियमअधिनियमअधिनियमअधिनियम।

भारत गणराज्य के इकसठवें वर्ष में हिमाचल प्रदेश विधान सभा द्वारा निम्नलिखित रूप में यह अधिनियमित होः-

1.1.1.1.1. (1) इस अधिनियम का संक्षिप्त नाम हिमाचल प्रदेश तकनीकी संक्षिप्त नाम और प्रारम्भ। विश्वविद्यालय (स्थापना और विनियमन) अधिनियम, 2010 है।

(2) यह ऐसी तारीख को प्रवृत्त होगा जैसी राज्य सरकार, राजपत्र में

प्रकाशित अधिसूचना द्वारा नियत करे।

परिभाषाएं। 2.2.2.2.2. इस अधिनियम में, जब तक कि सन्दर्भ से अन्यथा अपेक्षित न हो,-

(क) ''महाविद्यालय'' से इस अधिनियम के अधीन विश्वविद्यालय द्वारा अनुरक्षित या इसके विशेषाधिकार प्राप्त महाविद्यालय या संस्था अभिप्रेत है;

(ख) ''दीक्षांत समारोह'' से उपाधियां, खिताब या अन्य विद्या सम्बन्धी विशेष उपाधियां प्रदान करने के प्रयोजन के लिए कार्यकारी परिषद्‌ की बैठक अभिप्रेत है;

(ग) विश्वविद्यालय के सम्बन्ध में ''कर्मचारी'' से विश्वविद्यालय द्वारा नियोजित शिक्षक या किसी अधिकारी से अन्यथा कोई व्यक्ति अभिप्रेत है;

(घ) ''वित्तीय वर्ष'' से 31 मार्च को समाप्त होने वाला वर्ष अभिप्रेत है;

(ङ) ''राज्यपाल'' से हिमाचल प्रदेश का राज्यपाल अभिप्रेत है;

(च) ''हॉल या छात्रावास'' से विश्वविद्यालय द्वारा अनुरक्षित छात्रों के

आवास की एक इकाई अभिप्रेत है;

(छ) ''स्ांस्था'' से प्रशिक्षण, शिक्षण, अनुसंधान या अध्ययन के लिए महाविद्यालय, अनुसंधान संगठन या कोई अन्य स्थान, चाहे किसी भी नाम से पुकारा जाए, अभिप्रेत है;

(ज) ''सदस्य'' से इस अधिनियम की धारा 20 के अधीन स्थापित गवर्नर बोर्ड का सदस्य अभिप्रेत है और इसका अध्यक्ष भी इसके अन्तर्गत है;

(झ) ''प्रधानाचार्य'' से महाविद्यालय का प्रमुख अभिप्रेत है (चाहे किसी भी नाम से पुकारा जाए) और इसके अन्तर्गत जब कोई प्रधानाचार्य नहीं है, तो तत्समय प्रधानाचार्य के रूप में कार्य करने के लिए सम्यक्‌ रूप से नियुक्त व्यक्ति और प्रधानाचार्य या कार्यवाहक प्रधानाचार्य की अनुपस्थिति में इस प्रकार सम्यक्‌ रूप से नियुक्त उप-प्रधानाचार्य भी है;

() ''विनियमों'' से इस अधिनियम के अधीन बनाए गए विश्वविद्यालय

के विनियम अभिप्रेत है;

(ट) ''तकनीकी शिक्षा'' से इंजीनियरिंग प्रौद्योगिकी, सूचना प्रौद्योगिकी, विज्ञान, प्रबन्धन, फार्मेसी और वास्तुकला के विषयों तथा ऐसे अन्य विषयों, जैसे राज्य सरकार द्वारा समय-समय पर उचित समझे जाएं, में शिक्षा अभिप्रेत है;

(ठ) ''विश्वविद्यालय'' से इस अधिनियम की धारा 4 के अधीन यथा निगमित हिमाचल प्रदेश तकनीकी विश्वविद्यालय अभिप्रेत है;

(ड) ''गैर अध्यापन कर्मचारिवृन्द'' से निम्नलिखित अभिप्रेत है- राजपत्र, हिमाचल प्रदेश, 30 जुलाई, 2010/8 श्रावण, 1932

2483 (ंi) विश्वविद्यालय के सम्बन्ध में, कोई अध्यापन पद (अशंकालिक अध्यापन पद सहित) धारण न करने वाला, विश्वविद्यालय द्वारा इस प्रकार नियुक्त या मान्यता प्राप्त अध्यापनेतर कर्मचारिवृन्द; और

(ii) सम्बद्ध महाविद्यालय के सम्बन्ध मेें, कोई अध्यापन पद (अशंकालीन अध्यापन पद सहित) धारण न करने वाला विश्वविद्यालय द्वारा इस प्रकार नियुक्त या मान्यता प्राप्त या ऐसे महाविद्यालय द्वारा नियुक्त अध्यापनेतर कर्मचारिवृन्द किन्तु इसके अन्तर्गत कोई पुस्तकालयाध्यक्ष नहीं है;

(ढ) ''विहित'' से इस अधिनियम के अधीन बनाए परिनियमों या

विनियमों द्वारा विहित अभिप्रेत है;

(ण) ''परिनियमों'', ''विनियमों'' और ''नियमों'' तथा ''अध्यादेशों'' से इस अधिनियम के अधीन बनाए गए क्रमशः परिनियम, विनियम, नियम और अध्यादेश अभिप्रेत हैं; और

(त) ''राज्य सरकार'' से हिमाचल प्रदेश सरकार अभिप्रेत है।

3.3.3.3.3. विश्वविद्यालय के अन्य बातों के साथ-साथ निम्नलिखित मुख्य विश्वविद्यालय के उद्‌देश्य। उद्‌देश्य होंगे, अर्थात्‌ः-

(क) ऐसी तकनीकी शिक्षा प्रणाली का उपबन्ध करना जो तकनीकी मानवशक्ति की बदलती अपेक्षाओं के अनुसार कार्य करने में समर्थ हो।

(ख) अध्यापन और विद्यार्जन प्रक्रिया में गुणात्मक सुधार लाना;

(ग) सत्‌त शिक्षा परामर्शदात्री और अनुसंधान तथा विकास क्रियाकलापों

के लिए सौहार्दपूर्ण वातावरण उपलब्ध करवाना;

(घ) पारस्परिक प्रसुविधाओं की व्यवस्था करना तथा उद्योग के साथ प्रभावशाली सम्बन्ध विकसित करना और नए उद्योगों और कारबार संगठनों के आन्तरिक संसाधनों में बढ़ौतरी हेतु परामर्शदात्री और परीक्षण सेवाओं का उपबन्ध करना तथा बौद्धिक सम्पत्ति अधिकार के संरक्षण के लिए संगठनों को प्रेेरित करना;

(ङ) छात्रों के मध्य उद्यम को प्रोत्साहित करने के लिए संस्थाओं को

आवश्यक सहायता उपलब्ध करवाना;

(च) पूर्व छात्रों के साथ आजीवन सम्पर्क बनाए रखना और पूर्वछात्रों के

प्रायोजित कार्यक्रमों को विकसित करना;

(छ) प्रौद्योगिकी में नवाचार के लिए राष्ट्रीय संस्थाओं से सहकार करना;

(ज) उत्कृष्ट शिक्षा का वातावरण विकसित करना और छात्रों का अन्तर्राष्ट्रीय स्तर की संस्थाओं के साथ सीधा सम्पर्क रखना;

(झ) बौद्धिक योग्यताओं के उच्चतर स्तर सृजित करने के दृष्टिगत उच्चतर शिक्षा में शिक्षण, अध्यापन और प्रशिक्षण का उपबन्ध करना;

() शिक्षा और प्रशिक्षण के लिए सुविधाएं स्थापित करना;

(ट) अध्यापन, अनुसंधान, सम्बद्धता, परीक्षा को कार्यान्वित करना और

सतत्‌ शिक्षा कार्यक्रम प्रस्थापित करना;

(ठ) राज्य की आवश्यकताओं से सुसंगत अनुसंधान और विकास के लिए ज्ञान तथा इसके उपयोजन में सहभागी होने के लिए श्रेष्ठता के केन्द्रों का सृजन करना;

(ड) लागू नियमों और विनियमों के अध्यधीन नई संस्था स्थापित करना और हमीरपुर में हिमाचल प्रदेश तकनीकी विश्वविद्यालय की सम्ब़द्धता का उपबन्ध करना;

(ढ) परीक्षा केन्द्र स्थापित करना और छात्रों को उपाधियां प्रदान करना;

2485 (ण) परीक्षा या ऐसी किसी अन्य पद्धति के आधार पर उपाधियां और अन्य विद्या सम्बन्धी विशेष उपाधियां प्रदत्त करना, ऐसा करतेे समय विश्वविद्यालय यह सुनिश्चित करेगा कि उपाधियां और अन्य विद्या सम्बन्धी विशेष उपाधियाें का स्तर उससे कम नहीं हो जो विनियमन निकायों द्वारा अधिकथित किया गया है;

(त) बहुविध मेधाओं का विकास और आवर्धन करना तथा विद्या सम्बन्धी

समुदाय के सदस्यों में सृजनशीलता को बढ़ावा देना;

(थ) अल्पावधि और दीर्घकालीन दोनों प्रकार की संस्थागत योजनाओं के लिए संयुक्त रुप से योजना बनाने हेतु अवसरों की व्यवस्था करना;

(द) जीवन के समस्त क्षे़त्रों में उचित प्रकार से कार्य करने के संस्कार,

वृत्तिक सुविज्ञता और नेतृत्व की व्यवस्था करना;

(ध) विश्व स्तरीय व्यावसायिक और अन्तर-विद्या की विशिष्ट शाखा से

सम्बन्धित पाठ्‌यक्रमों, जो अध्यवसाय परक हों, का उपबन्ध करना;

(न) राज्य में समस्त इंजीनियरिंग महाविद्यालयों के मूलस्त्रोत (फाउन्टेन हैड) और राज्य में तकनीकी शिक्षा के केन्द्र के रुप में कार्य करना;

(प) समय पर परीक्षाओं का संचालन करना और समस्त सम्बद्ध इंजीनियरिंग महाविद्यालयों के अभ्यर्थियों को उपाधियां प्रदान करना;

(फ) समस्त सम्बद्ध को जीवनपर्यन्त विद्यार्जन के अवसरों की व्यवस्था

करना;

(ब) हिमाचल प्रदेश राज्य को अध्यापन, विद्यार्जन, अनुसंधान, व्यवसाय और कारबार का एक वरीय गंतव्य बनाने के लिए राष्ट्रीय और अन्तर्राष्ट्रीय संस्थाओं, विश्वविद्यालयों और संगठनों के साथ अंतव्र्यवहार विकसित करना; और

(भ) नई जानकारी प्राप्त और विकसित करना, अनुसंधान और विकासात्मक क्रियाकलापों के माध्यम से वृद्धि के क्रियाकलाप में प्रभावशाली रुप 2486 राजपत्र, हिमाचल प्रदेश, 30 जुलाई, 2010/8 श्रावण, 1932

से और निर्भीकता से लग जाना और नए आविष्कारों और खोजों के दृष्टिगत समस्त जानकारी और विश्वास का निर्वचन करना;

4.4.4.4.4. विश्वविद्यालय के प्रथम कुलाधिपति और प्रथम कुलपति तथा गवर्नर बोर्ड तथा विद्यापरिषद्‌ के प्रथम सदस्य और समस्त ऐसे व्यक्ति, जो इसके पश्चात्‌ ऐसे अधिकारी या सदस्य हो सकेंगे, जब तक वे ऐसा पद धारण करतेे रहते हैं या सदस्य बने रहते हैं, एतद्‌द्वारा मिलकर "हिमाचल प्रदेश तकनीकी विश्वविद्यालय", जिसका मुख्यालय हमीरपुर में होगा, का गठन करेंगे।

विश्वविद्यालय का सम्पत्ति अर्जित करने, धारित करने, व्ययन करने और संविदा करने की शक्ति सहित, शाश्वत्‌ उत्तराधिकार होगा और उसकी एक सामान्य मुद्रा होगी और उक्त नाम से वह वाद ला सकेगा और उस पर वाद लाया जा सकेगा।

5.5.5.5.5. विश्वविद्यालय की निम्नलिखित शक्तियां और कृत्य होंगें, अर्थात्‌ः-

शक्तियां और कृत्य।

(क) राज्य सरकार के अनुमोदन से ऐसी शर्तों और निर्बंधनों के अध्यधीन, जिन्हें राज्य सरकार अधिरोपित करे, किसी महाविद्यालय/संस्था या केन्द्र को सम्बद्ध करना;

(ख) उन व्यक्तियों की परीक्षाएं लेना और उन्हें उपाधियां और विद्या सम्बन्धी विशेष उपाधियां देना और प्रदान करना जिन्होंने-

(i) विश्वविद्यालय में अध्ययन के किसी पाठ्‌यक्रम का अध्ययन किया है या विनियमाें द्वारा यथाविहित और विश्वविद्यालय द्वारा विहित परीक्षाएं उत्तीर्ण की हैं; और

(ii) विनियमों द्वारा यथाविहित अनुसंधान को जारी रखा है;

(ग) तकनीकी शिक्षा को प्रदान करने, उन्नयन (अपग्रेड) करने और संवर्धित करने तथा तकनीकी शिक्षा में प्रशिक्षण और अनुसंधान के लिए उपबंध करना तथा उद्योग के साथ निकट सहकार में तकनीकी शिक्षा के क्रियाकलाप के लिए उद्यमिता तथा प्रेरक वातावरण तैयार करना;

2487 (घ) परामर्शदात्री सेवाओं, सतत्‌ शिक्षा कार्यक्रमों, राष्ट्रीय और अन्तर्राष्ट्रीय सहयोग के माध्यम से संसाधन उत्पन्न करना और उनका अनुरक्षण करना और बौद्धिक सम्पदा अधिकारों का अन्तरण करना;

(ङ) उपाधियां, अवार्ड, ग्रेड, श्रेयस (क्रेडिट्‌स) और विद्या सम्बन्धी विशेष

उपाधियां संस्थित करना और प्रदान करना;

(च) अन्य मान्यता प्राप्त विश्वविद्यालयों की उपाधि के समतुल्य या तत्सम

उपाधि के लिए उपबन्ध करना;

(छ) कैम्पस स्थापित करने के लिए समस्त आवश्यक उपाय करना;

(ज) मानद उपाधियाँ, जैसी विहित की जाएं, संस्थित करना और प्रदान

करना;

(झ) विद्यार्थियों को छात्रवृत्तियां, जैसी विनिर्दिष्ट की जाएं, संस्थित करना

और प्रदान करना;

() समाज के शैक्षिक दृष्टि से पिछड़े वर्ग (स्ट्रेटा) में, शैक्षिक प्रसुविधाओं

का प्रसार करने के लिए विशेष उपाय करना;

(ट) खेलकूद और साहसिक क्रियाकलापों को प्रोत्साहन और बढ़ावा देना;

(ठ) तकनीकी, प्रशासनिक, अनुसचिवीय (लिपिकीय) और अन्य आवश्यक

पदों का सृजन करना और उन पर नियुक्तियां करना;

(ड) परामर्श सेवाएं प्रदान करना;

(ढ) अधिनियम के उपबन्धों के अनुसार विश्वविद्यालय के उद्‌देश्यों को

कार्यान्वित करने के लिए परिनियम और विनियम बनाना;

(ण) विश्वविद्यालय के संकाय, छात्रों और कर्मचारियों के व्यक्तित्व के विकास के लिए पाठ्‌यक्रमेत्तर गतिविधियों को प्रोत्साहन और बढ़ावा देना ;

(त) राज्य सरकार, भारत सरकार और विश्वविद्यालय अनुदान आयोग के अनुदेशों के अनुसार देश के भीतर तथा बाहर पारस्परिक आधार पर अन्य विश्वविद्यालयों के साथ-साथ ड्‌यूल उपाधियों के लिए उपबन्ध करना ;

(थ) विश्वविद्यालय के शैक्षणिक कार्यक्रमों के विभिन्न विषयों में एकीकृत

पाठ्‌यक्रमों के लिए उपबन्ध करना ;

(द) राज्य सरकार, केन्द्रीय सरकार और विश्वविद्यालय अनुदान आयोग द्वारा समय-समय पर जारी अनुदेशों अनुसार महाविद्यालय, संस्थाएं, आफ-कैम्पस केन्द्र, ऑफ शोर कैम्पस और विद्या केन्द्र स्थापित करना ;

(ध) विश्वविद्यालय के प्रयोजनों और उद्‌देश्यों के लिए दान, उपहार और अनुदान प्राप्त करना और हिमाचल प्रदेश के भीतर या बाहर न्यास या विन्यस्त सम्पत्ति सहित किसी स्थावर या जंगम सम्पत्ति को अर्जित करना ,धारित करना उसका प्रबन्ध और व्ययन करना और निधियों का ऐसी रीति,जिसे विश्वविद्यालय उचित समझे, में विनिधान करना;

(न) विभिन्न पाठ्‌यक्रमों के लिए समय-समय पर इस अधिनियम के

उपबन्धों के अनुसार फीस संरचना विहित करना ;

(प) ऐसी फीस और अन्य प्रभारों, जो समय-समय पर विनिर्दिष्ट किए

जाएं, के संदाय की मांग करना और प्राप्त करना ;

(फ) पारस्परिक रूप से स्वीकार्य निबन्धनों और शर्तों पर अन्य संस्थाओं

से सहयोग करना ;

(ब) विश्वविद्यालय अनुदान आयोग और अन्य विनियामक निकायों द्वारा विनिर्दिष्ट मानकों के अनुसार विश्वविद्यालय के संकाय और कर्मचारियों के लिए वेतन,पारिश्रमिक, मानदेय (आनरेरिया) अवधारित करना;

2489 (भ) विश्वविद्यालय के छात्रों तथा कर्मचारियों में अनुशासन विनियमित करना तथा उसे प्रवर्तित कराना और ऐसे अनुशासनिक उपाय करना, जो आवश्यक समझे जाएं ;

(म) विश्वविद्यालय और इससे सम्बद्ध संस्थाओं/महाविद्यालयों में सूचना

का अधिकार अधिनियम, 2005 कार्यान्वित करना ;

(य) सम्बद्ध संस्थाओं /महाविद्यालयों में हिमाचल प्रदेश शैक्षणिक संस्था

(रैगिंग का प्रतिषेध) अधिनियम, 2009 कार्यान्वित करना;

(यक) उद्योग के साथ सम्बन्ध स्थापित करना और उनका अनुरक्षण करना और उनके साथ अन्तव्र्यवहार का संवर्धन करना और विश्व में चारों ओर अन्य विश्वविद्यालयों, अनुसंधान संस्थाओं और विद्वत समाज तथा उद्योगों, जो विश्वविद्यालयों के उद्‌देश्य को अग्रसर करने से सम्बन्धित है, के साथ सहयोगी करार करना ;

(यख) साधारणतः राष्ट्रीय विकास और विशेषतया आधुनिक प्रौद्योगिकी पर आधारित उद्योग के विकास मेें योगदान देने में समर्थ उच्चस्तरीय कुशल मानव शक्ति के सृजन का संवर्धन करना;

(यग) उच्चतर शिक्षा में स्तरमानों को बनाए रखने और गुणवत्ता में वृद्धि के

लिए समुचित उपाय करना;

(यघ) उपाधियों या अन्य विद्या सम्बन्धी विशेष उपाधियाें को ऐसी शर्तों, जैसी परिनियमों द्वारा विहित की जाएं, के अधीन और प्रभावित व्यक्ति को अपना मामला प्रस्तुत करने का युक्तियुक्त अवसर देने के पश्चात्‌, प्रत्याहृत करना या रद्‌द करना ;

(यङ) इस अधिनियम के उपबन्धों के अध्यधीन, विश्वविद्यालय के अधिकारियों और कर्मचारियों के पदों के लिए आचार और अनुशासन के नियम और उपलब्धियों सहित, सेवा के निबन्धन और शर्तें विहित करना;

(यच) स्थावर या जंगम सम्पत्ति को अर्जित करना, धारित करना और उसका व्ययन करना तथा इसके उद्‌देश्यों को अग्रसर करने के लिए अनुदान और अग्रिम देना;

(यछ) दान, विन्यास स्वीकार करना और प्रशासित करना और इसके

उद्‌देश्यों को अग्रसर करने के लिए अनुदान और अग्रिम देना;

(यज) अनुदान स्वीकार करना और उधार लेना या केन्द्रीय या किसी राज्य सरकार या विश्वविद्यालय अनुदान आयोग और अन्य स्त्रोतों से भी उधार स्वीकार करना;

(यझ) विश्वविद्यालय के स्वतन्त्र वित्तीय आधार के सृजन के लिए समुचित

उपाय करना ;

(य) तत्सम्बद्ध बाध्यताओं और वचनबंधताओं जो विश्वविद्यालय के उद्‌देश्यों या हैसियत से असंगत न हों, के साथ प्राइवेट स्त्रोतों से दान और अंशदान से निधि का सृजन करना;

(यट) परीक्षा और अन्य प्रयोजनों के लिए फीस या अन्य प्रभार विहित करना और इस प्रकार विहित फीस या अन्य प्रभारों की मांग करना और प्राप्त करना ;

(यठ) विश्वविद्यालय के छात्रों और कर्मचारियों के स्वास्थ्य और सामान्य

कल्याण को बढ़ावा देने के लिए व्यवस्था करना ;

(यड) विश्वविद्यालय के प्रयोजन और उद्‌देश्यों के समरूप प्रयोजनों और उद्‌देश्यों की अभिवृद्धि को ध्यान में रखते हुए, देश के भीतर या बाहर किसी अन्य विश्वविद्यालय, प्राधिकरण या किसी अन्य पब्लिक या प्राइवेट निकाय के साथ ऐसे प्रयोजनों, जो करार पाए जाएं, के लिए ऐसे निबन्धनों और शर्तों पर, जो समय-समय पर विनिर्दिष्ट की जाएं, सहकार करना ;

(यढ) प्रश्न पत्रों और अन्य संकर्मों जो विश्वविद्यालय द्वारा अपेक्षित हों,

के मुद्रण की व्यवस्था करना; और

(यण) ऐसे आनुषंगिक या सहायक समस्त कार्य करना, जो विश्वविद्यालय

के सभी या किन्हीं उद्‌देश्यों की प्राप्ति के लिए आवश्यक हों।

शक्तियों का क्षेत्रीय प्रयोग ।

6.6.6.6.6. (1) क्षेत्रीय परिसीमाएं जिनमें विश्वविद्यालय शक्तियाें का प्रयोग और अपने कर्त्तव्यों का पालन करेगा, सम्पूर्ण हिमाचल प्रदेश राज्य और हिमाचल प्रदेश राज्य से बाहर के अन्य क्षे़़़त्रों जिन्हें समय-समय पर गवर्नर बोर्ड द्वारा किन्हीं विनियमों और परिनियमों के अध्यधीन विनिश्चित किया जाए, में हाेंगी। राजपत्र, हिमाचल प्रदेश, 30 जुलाई, 2010/8 श्रावण, 1932

2491 (2) तत्समय प्रवृत्त किसी अन्य विधि में किसी बात के होते हुए भी उपधारा (1) के अधीन विनिर्दिष्ट क्षेत्र की सीमाओं में स्थित तकनीकी शिक्षा प्रदान करने वाला कोई भी महाविद्यालय, ऐसी तारीख से, जो इस निमित्त राज्य सरकार द्वारा अधिसूचित की जाए, विश्वविद्यालय के साथ सम्बद्ध और विशेषाधिकार प्राप्त समझा जाएगा तथा उसकी हिमाचल प्रदेश विश्वविद्यालय, शिमला के साथ किसी भी प्रकार से सम्बद्धता या किसी भी प्रकार के विशेषाधिकार नहीं रहेंगे :

परन्तु उक्त तारीख से पूर्व हिमाचल प्रदेश विश्वविद्यालय, शिमला से सम्बद्ध किसी ऐसे महाविद्यालय के किसी छात्र, जो उक्त विश्वविद्यालय की किसी उपाधि या डिप्लोमा परीक्षा के लिए अध्ययनरत था, को उसकी तैयारी में उसके पाठ्‌यक्रम को पूर्ण करना अनुज्ञात किया जाएगा और विश्वविद्यालय ऐसे छात्रों की परीक्षा, उन महाविद्यालयों में प्रवृत्त अध्ययन पाठयक्रम के अनुसार ऐसी अवधि के लिए, जैसी विनियमों द्वारा विहित की जाए, आयोजित करेगा :

परन्तु यह और कि जब तक विश्वविद्यालय द्वारा ऐसी परीक्षा आयोजित नहीं की जाती है, तब तक ऐसे छात्र को उक्त विश्वविद्यालयों की परीक्षा में प्रवेश दिया जाएगा और उन विश्वविद्यालयों, जिनके लिए वह ऐसी परीक्षा के परिणाम पर अर्हता प्राप्त करता है, की उपाधि, डिप्लोमा या कोई अन्य विशेषाधिकार प्रदान किया जाएगा ।

7.7.7.7.7. (1) किसी भी व्यक्ति को, केवल धर्म, वंश जाति, लिंग, जन्म स्थान या इनमें से किसी भी आधार पर विश्वविद्यालय के किसी पद या इसके किन्हीं प्राधिकरणों की सदस्यता से या किसी उपाधि, डिप्लोमा या अन्य विद्या सम्बन्धी विशेष उपाधि या अध्ययन के पाठ्‌यक्रम से अपवर्जित नहीं किया जाएगा :

विश्वविद्यालय का धर्म, वंश, जाति लिंग या जन्म स्थान का विचार किए बिना सभी के लिए खुला होना। परन्तु विश्वविद्यालय केवल महिलाओं के लिए किसी महाविद्यालय को या तो शिक्षा या आवास के लिए अनुरक्षित कर (चला) सकेगा या महिलाओं या शैक्षणिक रूप से पिछड़ी श्रेणी के सदस्यों और समुदायों को किसी भी महाविद्यालय में छात्रों के रूप में प्रवेश के प्रयोजन के लिए आरक्षित कर सकेगा।

(2) विश्वविद्यालय के लिए किसी व्यक्ति पर, विश्वविद्यालय में कोई पद या पदवी धारण करने या विश्वविद्यालय के किसी विशेषाधिकार या उसकी 2492 राजपत्र, हिमाचल प्रदेश, 30 जुलाई, 2010/8 श्रावण, 1932

उपकृति के लिए हकदार बनाने हेतु वंश, जाति, लिंग, जन्म-स्थान से सम्बन्धित किसी भी प्रकार का टैस्ट अधिरोपित करना विधिपूर्ण नहीं होगा।

सम्बद्धता की

88888. विश्वविद्यालय को किसी अन्य संस्था के साथ सम्बद्धता की या

शक्ति। अन्यथा अपने विशेषाधिकार में लाने की शक्ति होगी।

9. 9. 9. 9. 9. (1) विश्वविद्यालय के लिए निम्नलिखित अधिकारी होंगे, अर्थात्‌ :-

विश्वविद्यालय के अधिकारी।

(क) कुलाधिपति ; (ख) कुलपति ; (ग) रजिस्ट्रार ; (घ) वित्त अधिकारी ; और (ङ) ऐसे अन्य व्यक्ति जो परिनियमों द्वारा विश्वविद्यालय के अधिकारी

घोषित किए जाएं।

(2) कुलाधिपति, कुलपति और रजिस्ट्रार से भिन्न विश्वविद्यालय के अधिकारियों की नियुक्तियों की रीति, सेवा के निबन्धन और शर्तें और कृत्य जहां तक वे इसमें उपबन्धित नहीं हैं, विनियमों द्वारा विहित किए जाएंगे।

कुलाधिपति। 10. 10. 10. 10. 10. (1) राज्यपाल, अपने पद के फलस्वरूप विश्वविद्यालय का कुलाधिपति होगा। वह विश्वविद्यालय का प्रमुख (हैड) और कार्यकारी परिषद्‌ का अध्यक्ष होगा तथा जब उपस्थित हो तो कार्यकारी परिषद्‌ की बैठकों की अध्यक्षता करेगा।

(2) कुलाधिपति ऐसी शक्तियों का प्रयोग करेगा जैसी उसे इस अधिनियम

द्वारा या के अधीन प्रदत्त की जाएं।

(3) जहां कुलाधिपति को विश्वविद्यालय के किसी प्राधिकरण या निकाय के लिए नामनिर्देशन करने की शक्ति प्रदत्त की गई है, वहां कुलाधिपति उस विस्तार तक जो आवश्यक है व्यक्तियों को उन हितों को प्रस्तुत करने के लिए नामनिर्दिष्ट करेगा जिनको अन्यथा समुचित रूप से प्रतिनिधित्व नहीं दिया गया हो।

(4) किसी मानक उपाधि को प्रदत्त करने का प्रत्येक प्रस्ताव कुलाधिपति

कुलपति। 11. 11. 11. 11. 11. (1) कुलपति की नियुक्ति गवर्नर बोर्ड द्वारा नामनिर्दिष्ट की जाने वाली समिति के माध्यम से गवर्नर बोर्ड द्वारा संस्तुत व्यक्तियों के पैनल में से, कुलाधिपति द्वारा राज्य सरकार के परामर्श से तकनीकी शिक्षा के क्षेत्र में उत्कृष्ट व्यक्तियों के पैनल में से की जाएगी :

परन्तु विश्वविद्यालय का प्रथम कुलपति तीन वर्ष की अवधि के लिए या उसके 65 वर्ष की आयु पूर्ण करने तक, जो भी पूर्वतर हो, नियुक्त किया जाएगा, और इस धारा के उपबन्धों के अध्यधीन राज्य सरकार द्वारा विश्वविद्यालय के दिन-प्रतिदिन के कार्यकलापों का प्रबन्ध करने हेतु तीन वर्ष से अनधिक और अवधि के लिए पुनर्नियुक्ति का पात्र होगा।

(2) कुलपति विश्वविद्यालय का पूर्णकालिक अधिकारी होगा और उसे विश्वविद्यालय निधि से ऐसा वेतन और भत्ते संदत्त किए जाएंगे जैसे कि कुलाधिपति, राज्य सरकार और वित्त विभाग के परामर्श से विनिश्चित करे।

(3) कुलाधिपति, कुलपति के पारिश्रमिक की रकम और सेवा की अन्य

शर्तें अभिधारित करेगा :

परन्तु सेवा के निबन्धन और शर्तें कुलपति की पदावधि के दौरान उसके

अहित में परिवर्तित नहीं की जाएंगी।

(4) कुलपति की बीमारी या अनुपस्थिति या छुट्‌टी की दशा में अथवा किसी अन्य आकस्मिकता में रजिस्ट्रार विश्वविद्यालय के कुलपति के रूप में कार्य करेगा।

(5) कुलपति विश्वविद्यालय का प्रधान कार्यपालक और शैक्षणिक अधिकारी होगा और विनियमों के अनुसार इसके कार्यकलापों पर साधारण नियन्त्रण रखेगा और विश्वविद्यालय के प्राधिकरणों के विनिश्चयों को प्रभावी बनाएगा।

(6) कुलपति का कत्र्तव्य होगा कि वह सुनिश्चित करे कि अधिनियम और विनियमों के उपबन्धों का कड़ाई से पालन हो और उसके पास इस प्रयोजन के लिए समस्त शक्तियां होंगी।

(7) यदि, कुलपति की राय में, कोई आपात स्थिति उत्पन्न हो गई है, जिस पर तुरन्त कार्रवाई की जानी आवश्यक हो, तो कुलपति ऐसी कार्रवाई करेगा 2494 राजपत्र, हिमाचल प्रदेश, 30 जुलाई, 2010/8 श्रावण, 1932

जैसी वह आवश्यक समझे और उसकी रिपोर्ट प्राधिकरण (अथॉरिटी) की अगली बैठक में पुष्टि के लिए करेगा, जिसने सामान्य अनुक्रम में मामले को निपटाया होताः

परन्तु जहां कुलपति द्वारा की गई ऐसी कोई कार्रवाई सम्बद्ध प्राधिकरण (अथॉरिटी) द्वारा अनुमोदित नहीं की जाती है, तो वह ऐसा मामला कुलाधिपति को निर्दिष्ट कर सकेगा, जिस पर उसका विनिश्चय अन्तिम होगा :

परन्तु यह और कि जहां कुलपति द्वारा की गई ऐसी कार्रवाई विश्वविद्यालय की सेवा में रत किसी व्यक्ति को प्रभावित करती है, तो ऐसा व्यक्ति, ऐसी तारीख, जिसको वह ऐसी कार्रवाई का नोटिस प्राप्त करता है, से तीस दिन के भीतर गवर्नर बोर्ड को अपील करने का हकदार होगा।

(8) कुलपति ऐसी अन्य शक्तियों का प्रयोग करेगा जैसी विनियमों या

परिनियमों द्वारा विहित की जाएं।

कुलपति की शक्तियां और कृत्य।

12.12.12.12.12. (1) कुलपति, कुलाधिपति की अनुपस्थिति में कार्यकारी परिषद्‌ की बैठक की अध्यक्षता करेगा। वह, अपने पद के फलस्वरूप (की हैसियत से) स्नात्तकोतर और स्नातकपूर्व अध्ययन के लिए गवर्नर बोर्ड और विद्या परिषद्‌ का सदस्य तथा अध्यक्ष होगा और विश्वविद्यालय के किसी अन्य प्राधिकरण या निकाय, जिसका वह सदस्य हो, का अध्यक्ष भी होगा, परन्तु वह उसमें मतदान करने का हकदार नहीं होगा।

(2) कुलपति के पास कार्यकारी परिषद्‌, गवर्नर बोर्ड और विश्वविद्यालय

के किसी अन्य प्राधिकरण या निकाय की बैठक बुलाने की शक्तियां होंगी।

(3) कुलपति को विश्वविद्यालय के समस्त अन्य अधिकारियों और समस्त शिक्षकों तथा कर्मचारियों पर तथा साधारणतया विश्वविद्यालय के सभी मामलों पर नियन्त्रण तथा पर्यवेक्षण की शक्ति होगी।

(4) कुलपति ऐसी अन्य शक्तियों का प्रयोग और ऐसे अन्य कर्त्तव्यों का निर्वहन कर सकेगा जो विश्वविद्यालय के किसी प्राधिकरण या निकाय द्वारा उसे प्रत्यायोजित किए जाएं।

(5) कुलपति, विश्वविद्यालय की ओर से किसी मामले में ऐसी कार्रवाई कर सकेगा जैसी वह समीचीन समझे, जो उसकी राय में या तो अत्यावश्यक है राजपत्र, हिमाचल प्रदेश, 30 जुलाई, 2010/8 श्रावण, 1932

2495 या आपात्तिक स्वरूप की है और उसकी रिपोर्ट प्राधिकरण या निकाय की अगली बैठक में पुष्टि के लिए करेगा, जिसने सामान्य अनुक्रम में मामले को निपटाया होताः

परन्तु यदि कुलपति द्वारा की गई कार्रवाई का सम्बद्ध प्राधिकरण या निकाय द्वारा अनुमोदन नहीं किया जाता है, तो मामला तत्काल कुलाधिपति को निर्दिष्ट किया जाएगा, जिस पर उसका विनिश्चय अन्तिम होगा।

रजिस्ट्रार। 13.13.13.13.13. (1) रजिस्ट्रार विश्वविद्यालय का पूर्णकालिक अधिकारी होगा और अध्यक्ष के रुप में कुलपति, कुलाधिपति के नामनिर्देशिती, गवर्नर बोर्ड के दो नामनिर्देशितियों और राज्य सरकार के एक नामनिर्देशिती से गठित एक समिति की सिफारिश पर गवर्नर बोर्ड द्वारा तीन वर्ष की अवधि के लिए नियुक्त किया जाएगा, जिसे और तीन वर्ष की अवधि के लिए बढ़ाया जा सकेगा।

(2) रजिस्ट्रार की सेवा के निबन्धन और शर्तें ऐसी होंगी जैसी गवर्नर

बोर्ड द्वारा अवधारित की जाएं।

(3) रजिस्ट्रार, गवर्नर बोर्ड और विद्या परिषद्‌ का पदेन सचिव होगा ।

14.14.14.14.14. रजिस्ट्रार-

रजिस्ट्रार की शक्तियां और कृत्य। (क) विश्वविद्यालय के अभिलेखों, सामान्य मुद्रा और ऐसी अन्य सम्पत्ति का अभिरक्षक होगा जैसी गवर्नर बोर्ड उसके प्रभार में उसे सौंपे ;

(ख) गवर्नर बोर्ड और विद्या परिषद्‌ की समस्त बैठकों के कार्यवृत्त

रखेगा;

(ग) गवर्नर बोर्ड और विद्या परिषद्‌ के शासकीय पत्रव्यवहार का

संचालन करेगा ;

(घ) विश्वविद्यालय की परीक्षा की व्यवस्था करेगा तथा अधीक्षण

करेगा;

(ङ) विश्वविद्यालय के प्राधिकरणों की बैठकों की कार्यसूची की प्रतियों को, जैसे ही वे जारी की जाती हैं, यथाशीघ्र और साधारणतया बैठकों के आयोजित होने के एक मास के भीतर प्राधिकरणों की बैठकों के कार्यवृत्त, कुलाधिपति को प्रेषित करेगा; और 2496 राजपत्र, हिमाचल प्रदेश, 30 जुलाई, 2010/8 श्रावण, 1932

(च) ऐसे अन्य कर्त्तव्यों का पालन करेगा जैसे विश्वविद्यालय के कुलाधिपति

या गवर्नर बोर्ड द्वारा समय-समय पर उसे सौंपे जाएं।

वित्त अधिकारी ।

15. 15. 15. 15. 15. (1) वित्त अधिकारी विश्वविद्यालय का पूर्णकालिक अधिकारी होगा और अध्यक्ष के रुप में कुलपति, गवर्नर बोर्ड के दो नामनिर्देशितियों , कुलाधिपति के एक नामनिर्देशिती और राज्य सरकार के एक नामनिर्देशिती से गठित समिति की सिफारिश पर गवर्नर बोर्ड द्वारा तीन वर्ष की अवधि के लिए नियुक्त किया जाएगा जिसे तीन वर्ष की और अवधि के लिए बढ़ाया जा सकेगा।

(2) वित्त अधिकारी की सेवा के निबन्धन और शर्तें ऐसी होंगी जैसी

गवर्नर बोर्ड द्वारा अवधारित की जाएं।

(3) वह, कुलपति और गवर्नर बोर्ड के पर्यवेक्षण, निदेश और नियन्त्रण के अध्यधीन विश्वविद्यालय की निधि के प्रशासन वित्त, सम्पत्तियों और परिसम्पत्तियों तथा समस्त न्यासों और विन्यासों का प्रभारी होगा ।

(4) उसकी उन सभी क्रियाकलापों में विशेष रुचि रहेगी जिनका उद्‌देश्य (लक्ष्य) विश्वविद्यालय की निधियों को जुटाना और विश्वविद्यालय के स़्त्रोतों (साधनों) का संवर्द्धन हो ।

(5) उसे, इस अधिनियम के उपबन्धों के अध्यधीन, अपने प्रभार के अध्यधीन विभागों में कार्यरत समस्त अधिकारियों और कर्मचारियों पर पर्यवेक्षण और नियन्त्रण की शक्ति होगी और वह ऐसी अनुशासनात्मक शक्तियों का प्रयोग करेगा, जैसी उसे इस अधिनियम के द्वारा या अधीन प्रदत्त की जाएं।

16.16.16.16.16. विश्वविद्यालय के निम्नलिखित प्राधिकरण होंगे, अर्थात्‌ :-

विश्वविद्यालय के प्राधिकरण।

(क) कार्यकारी परिषद्‌ ; (ख) गवर्नर बोर्ड ; (ग) विद्या परिषद्‌ ; (घ) वित्त समिति ;

2497 (ङ) चयन समिति ; और (च) ऐसे अन्य प्राधिकरण जो परिनियमों के अधीन स्थापित किए जाएं।

1717171717. (1) कार्यकारी परिषद्‌ निम्नलिखित सदस्यों से गठित होगी, अर्थात्‌ः- कार्यकारी परिषद्‌। पदेन सदस्य :-

(क) कुलाधिपति ;

(ख) कुलपति ;

(ग) ठीक पूर्ववती कुलपति ;

(घ) सचिव, तकनीकी शिक्षा विभाग, हिमाचल प्रदेश सरकार या उसका नामनिर्देशिती जो विशेष सचिव, हिमाचल प्रदेश सरकार, की पंक्ति से नीचे का न हो;

(ङ) सचिव, वित्त विभाग, हिमाचल प्रदेश सरकार या उसका नामनिर्देशिती जो विशेष सचिव, हिमाचल प्रदेश सरकार की पंक्ति से नीचे का न हो;

(च) निदेशक, तकनीकी शिक्षा व्यावसायिक एवं औद्योगिक प्रशिक्षण

विभाग ;

(छ) अध्ययन अधिष्ठाता (डीन आफ स्टडीज) ;

(ज) स्कूल शिक्षा के निदेशक ;

(झ) विश्वविद्यालय अनुदान आयोग का एक नामनिर्देशिती ;

(ञ) अखिल भारतीय तकनीकी शिक्षा परिषद्‌ का एक नामनिर्देशिती ;

(ट) हिमाचल प्रदेश विधान सभा के सदस्यों द्वारा चयनित (निर्वाचित)

हिमाचल प्रदेश विधान सभा के दो सदस्य;

(ठ) दो प्राध्यापक, एक क्रमशः राष्ट्रीय तकनीकी संस्थान, हमीरपुर

से और एक हिमाचल प्रदेश विश्वविद्यालय, शिमला से;

(ड) विश्वविद्यालय के गैर-शिक्षण कर्मचारियों के सदस्यों द्वारा

अपने में से चयनित (निर्वाचित) दो सदस्य;

(ढ) विश्वविद्यालय के अधिकारियों और पर्यवेक्षी स्टाफ द्वारा

अपने में से चयनित (निर्वाचित) दो सदस्य;

(ण) व्यावसायिक, औद्योगिक, वैज्ञानिक, तकनीकी, शैक्षणिक और अन्य विद्वत समाज का प्रतिनिधित्व सुनिश्चित करने के लिए राज्य सरकार द्वारा नामनिर्दिष्ट किए जाने वाले तीन व्यक्ति;

(त) कुलाधिपति द्वारा नामनिर्दिष्ट किए जाने वाले दो व्यक्ति; और

(थ) विश्वविद्यालय के कर्मचारियों में से निर्वाचन द्वारा चयनित

(निर्वाचित) एक व्यक्ति।

(2)(2)(2)(2)(2) कार्यकारी परिषद्‌ के लिए समस्त निर्वाचन ऐसी रीति में होंगे

जैसी परिनियमों द्वारा विहित की जाएं।

18.18.18.18.18. कार्यकारी परिषद्‌ की निम्नलिखित शक्तियां और कृत्य होंगें,

अर्थात्‌ः-

कार्यकारी परिषद्‌ की शक्तियां और कृत्य ।

(क) गवर्नर बोर्ड द्वारा तैयार की गई वार्षिक रिपोर्ट पर विचार करना और उससे सम्बन्धित ऐसा प्रस्ताव पारित करना जैसा आवश्यक समझा जाए ;

(ख) गवर्नर बोर्ड या अन्य किसी निकाय से ऐसी अन्य रिपोर्टों पर विचार

और परामर्श करना, जैसी इसके समक्ष रखी जाएं ।

(ग) गवर्नर बोर्ड से अन्य विश्वविद्यालय,संस्थाओं ओैर शैक्षणिक प्राधिकरणों के साथ ऐसे मामलों में सहकार और सहयोग के लिए प्रस्तावों पर विचार करना और परामर्श देना जो विश्वविद्यालय के शैक्षणिक/उद्‌देश्यों से सम्बन्धित हो या उन्हेें प्रोत्साहित करते हों । राजपत्र, हिमाचल प्रदेश, 30 जुलाई, 2010/8 श्रावण, 1932

2499 (घ) गवर्नर बोर्ड द्वारा अनुमोदित लेखाओं के र्वार्षिक विवरण और वार्षिक वित्तीय प्राक्कलनों पर विचार करना और उनसे सम्बद्ध ऐसे संकल्प पारित करना जो आवश्यक समझे जाएंः

परन्तु संकल्प पारित करने, ऐसे किसी वार्षिक वित्तीय प्राक्कलनों को उपांतरित करने या अस्वीकृत करने के प्रयोजन के लिए, तत्समय विद्यमान कार्यकारी परिषद्‌ के कुल सदस्योंं में से बहुमत के लिए संकल्पों के पक्ष में मतदान करना आवश्यक होगा ;

(ङ) विश्वविद्यालय के प्रशासन और वित्त में सुधार के लिए, और साधारणतया इसके उद्‌देश्य को अग्रसर करने के लिए उपायों पर विचार करना और सुझाव देना;

(च) अध्ययन और अनुसंधान हेतु विभागों, इंजीनियरिंग महाविद्यालयों, बहुतकनीकी संस्थानों और बहुविद्या शाखा अनुसंधान के केन्द्रों, पुस्तकालयों, प्रयोगशालाओं, कार्यशालाओं और संग्रहालयों की स्थापना करना;

(छ) राज्य सरकार के अनुमोदन से विश्वविद्यालय, केन्द्रों और पुस्तकालयों की स्थापना के लिए अधिकारियों और अधीनस्थ कर्मचारिवृन्द के उतने पद जितने आवश्यक हों, सृजित करना और संस्थित करना;

(ज) विश्वविद्यालय निधि में से अध्येतावृत्ति, छात्रवृत्ति अध्ययनवृत्ति, वृत्तिका, वजीफा, प्रदर्शनियां, दिए जाने वाले पदकों और दिए जाने वाले और ईनामों को संस्थित करना;

(झ) ऐसे व्यक्तियों जिन्होंने,-

(i) विहित पाठ्‌यक्रम किए है या जिन्हें विहित रीति में छूट दी गई है और ऐसी परीक्षा उत्तीर्ण की है, जैसी विहित की जाए, या

(ii) ऐसी शर्तों के अनुसार जो विहित की जाएं, अनुसंधान किया

हो,

पर उपाधि, डिप्लोमा, प्रमाण-पत्र और अन्य विद्या संबंधी उपाधि संस्थित करना;

(ञ) ऐसी शर्तें, जो परिनियमों द्वारा विहित की जाएं के अधीन और प्रभावित व्यक्ति को अपना मामला प्रस्तुत करने के लिए युक्तियुक्त अवसर देने के पश्चात्‌ उपाधि, डिप्लोमा, प्रमाण-पत्रों और अन्य विद्या संबंधी उपाधि का प्रत्याहरण करना या रद्‌द करना;

(ट) मानद्‌ उपाधि और विद्या संबंधी उपाधियां प्रदान करना;

(ठ) इसके अपने कारबार के संव्यवहार के लिए नियम बनाना; और

(ड) इस अधिनियम द्वारा या के अधीन कार्यकारी परिषद्‌ पर प्रदत्त समस्त अन्य शक्तियों का प्रयोग करना और अधिरोपित समस्त अन्य कृत्यों का पालन करना।

कार्यकारी परिषद्‌ की बैठक ।

19.19.19.19.19. (1) कार्यकारी परिषद्‌, दीक्षान्त समारोह से अन्यथा के लिए, एक वित्तीय वर्ष में कम से कम तीन बार, कुलपति द्वारा नियत की जाने वाली तारीखों को, बैठक करेगी। इस प्रकार की एक बैठक मार्च से पूर्व आयोजित की जाएगी और उसे वार्षिक बैठक के नाम से जाना जाएगा । कार्यकारी परिषद्‌ ऐसे अन्य समयों पर भी बैठक कर सकेगी, जैसी यह समय-समय पर विनिश्चित करे।

(2) कार्यकारी परिषद्‌ की बैठक के लिए कार्यकारी परिषद्‌ के सदस्यों

की कुल संख्या के एक-तिहाई से गणपूर्ति होगीः

परन्तु दीक्षान्त समारोह की बैठक में ऐसी गणपूर्ति अपेक्षित नहींं होगी।

(3) कुलपति, जहां वह उचित समझे, और कार्यकारी परिषद्‌ के सदस्यों की कुल संख्या के पचास प्रतिशत्‌ से अन्यून द्वारा लिखित में हस्ताक्षरित अध्यपेक्षा पर, कार्यकारी परिषद्‌ की बैठक आयोजित करेगा। ऐसी अध्यपेक्षा पर बैठक कुलपति द्वारा अध्यपेक्षा की प्राप्ति के पन्द्रह दिन के भीतर आयोजित की जाएगी।

गवर्नर

20. 20. 20. 20. 20. (1) गवर्नर बोर्ड अध्यक्ष, सात पदेन सदस्यों और चार नाम निर्देशित

बोर्ड । सदस्यों से गठित होगा।

(2) गवर्नर बोर्ड के अध्यक्ष की नियुक्ति, कुलाधिपति द्वारा गवर्नर बोर्ड के पदावरोही अध्यक्ष की सिफारिश पर उद्योग, प्रौद्योगिकी या तकनीकी शिक्षा के क्षेत्र में राष्ट्रीय ख्याति के व्यक्तियों की नामसूची (पैनल) में से की जाएगी :

2501 परन्तु विश्वविद्यालय का प्रथम गवर्नर बोर्ड राज्य सरकार द्वारा

नियुक्त किया जाएगा।

(3) गवर्नर बोर्ड के अध्यक्ष की नियुक्ति की पदावधि तीन वर्ष की अवधि के लिए होगी और वह उतनी ही अवधि के एक अन्य कार्यकाल के लिए पुनर्नियुक्ति हेेतु पात्र होगा।

(4) गवर्नर बोर्ड का अध्यक्ष सामान्यतया कुलाधिपति की अनुपस्थिति में गवर्नर बोर्ड की बैठकों और विश्वविद्यालय के दीक्षान्त समारोह की अध्यक्षता करेगा।

(5) कुलाधिपति, गवर्नर बोर्ड के निम्नलिखित सदस्यों को तीन वर्ष की अवधि के लिए नियुक्त करेगा और वे उतनी ही अवधि के एक अन्य कार्यकाल के लिए पुनर्नियुक्ति हेतु पात्र होेंगे, अर्थात्‌ः-

(i) पदेन सदस्यः- पदेन सदस्यः- पदेन सदस्यः- पदेन सदस्यः- पदेन सदस्यः-

(क) कुलपति, हिमाचल प्रदेश विश्वविद्यालय, शिमला;

(ख) कुलपति, चौधरी सरवन कुमार हिमाचल प्रदेश कृषि विश्वविद्यालय

(सी. एस. क.े एच. पी. क.े वी., पालमपुर),

(ग) निदेशक, भारतीय प्रौद्योगिकी संस्थान, मण्डी;

(घ) सचिव, हिमाचल प्रदेश सरकार, तकनीकी शिक्षा, व्यावसायिक

और औद्योगिक प्रशिक्षण विभाग;

(ङ) निदेशक, तकनीकी शिक्षा, व्यावसायिक और औद्योगिक प्रशिक्षण;

(च) सचिव (वित्त), हिमाचल प्रदेश सरकार ; और

(छ) अध्यक्ष, उत्तर-पश्चिमी समिति, अखिल भारतीय तकनीकी

शिक्षा परिषद्‌, चण्डीगढ़।

परन्तु कुलाधिपति, कुलपति की सिफारिशों पर किसी व्यक्ति, जो उस आधार पर पद धारण करने से प्रवरित हो जाता है, जिस आधार पर वह ऐसा सदस्य बना, की सदस्यता रद्‌द कर सकेगा ।

(6) जब गवर्नर बोर्ड में, किसी सदस्य के त्यागपत्र या मृत्यु या अन्यथा कोई रिक्ति होती है, तो रिक्ति अधिनियम द्वारा उपबन्धित रीति में भरी जाएगीः

परन्तु जो व्यक्ति ऐसी रिक्ति को भरता है, वह ऐसे कार्यकाल के अनवसित भाग के लिए पद धारण करेगा जिसके लिए वह व्यक्ति, जिसके स्थान पर वह सदस्य बनता है , अन्यथा अपने पद पर बना रहता।

(7) गवर्नर बोर्ड विश्वविद्यालय का सर्वोच्च प्राधिकरण (अथॉरिटी) होगा

और उसकी निम्नलिखित शक्तियां और कृत्य होंगें,अर्थात्‌ :-

(क) विश्वविद्यालय के कार्यकलापों का अधीक्षण और नियन्त्रण करना;

(ख) कुलाधिपति को, उद्योग/प्रौद्योगिकी/तकनीकी शिक्षा के क्षेत्र में सुप्रसिद्ध तीन व्यक्तियों से गठित उच्च स्तरीय "समिति" द्वारा तैयार उद्योग/प्रौद्योगिकी/तकनीकी शिक्षा के क्षेत्रों से तीन से अन्यून और पांच से अनधिक सुप्रसिद्ध व्यक्तियों की नामसूची (पैनल) से कुलपति की नियुक्ति की सिफारिश करना;

(ग) कुलपति की सेवा की ंउपलब्धियों और निबन्धनों और शर्तों की

सिफारिश करना ;

(घ) शैक्षणिक कार्यक्रम अनुमोदित करना ;

(ङ) विश्वविद्यालय के नियमों और विनियमों को बनाना और अनुमोदित

करना ;

(च) विभिन्न शैक्षणिक कार्यक्रमों को चलाने हेतु विभाग/केन्द्र/

महाविद्यालय/शैक्षणिक परिषद्‌ सृजित करना;

2503 (छ) विश्वविद्यालय में संंकाय और कर्मचारिवृन्द के पदों (पोजीशन) का

सृजन करना;

(ज) विश्वविद्यालय के बजट का अनुमोदन करना;

(झ) विश्वविद्यालय की निधियों का प्रबन्ध और नियंत्रण करना और बैंक

लेखे खोलने और उनके प्रवर्तन को प्राधिकृत करना;

(ञ) विश्वविद्यालय की जंगम, स्थावर और बौद्धिक सम्पदा को स्वीकार

करना, अन्तरण करना और अन्यथा नियंत्रण करना;

(ट) विश्वविद्यालय की सामान्य मुद्रा के रूप और उपयोग पर विनिश्चय

करना;

(ठ) ऐसी समितियाें की नियुक्ति करना, जो विश्वविद्यालय के दक्ष

कार्यकरण हेतु अपेक्षित हों;

(ड) विश्वविद्यालय के संकाय और कर्मचारिवृन्द की सेवा की उपलब्धियां

और निबन्धनों और शर्तों का अनुमोदन करना; और

(ढ) संविदा पर सेवा की उपलब्धियांें और निबन्धनों और शर्तों का

अनुमोदन करना ।

(8) गवर्नर बोर्ड की वार्षिक बैठक, गवर्नर बोर्ड के अध्यक्ष के परामर्श से कुलपति द्वारा नियत की जाने वाली तारीख को आयोजित की जाएगी । ऐसी वार्षिक बैठक में, प्राप्तियों एवं व्यय के विवरण, तुलन पत्र और वित्तीय प्राक्कलनों के साथ, पूर्ववर्ती वर्ष के दौरान विश्वविद्यालय के कार्यकरण की रिपोर्ट प्रस्तुत की जाएगी ।

(9) गवर्नर बोर्ड की विशेष बैठक, गवर्नर बोर्ड के अध्यक्ष द्वारा, जब कभी

आवश्यक हो, आयोजित की जाएगी ।

(10) गवर्नर बोर्ड का सदस्य, ऐसे भत्तों, यदि कोई हों, और विश्वविद्यालय से ऐसी बैठक फीस, जैसी विनियमों में उपबन्धित की जाए का हकदार होगा । 2504 राजपत्र, हिमाचल प्रदेश, 30 जुलाई, 2010/8 श्रावण, 1932 विद्या परिषद्‌ ।

21. 21. 21. 21. 21. (1) विद्या परिषद्‌ विश्वविद्यालय का शेैक्षणिक निकाय होगी और, इस अधिनियम और विनियमों के उपबन्धों के अध्यधीन नियंत्रण और साधारण विनियमन रखेगी और विश्वविद्यालय के भीतर शिक्षण, शिक्षा और परीक्षा के स्तरमानों को बनाए रखने के लिए उत्तरदायी होगी तथा ऐसी अन्य शक्तियों का प्रयोग करेगी और ऐसे अन्य कर्त्तव्यों का पालन करेगी, जैसे विनियमों द्वारा इस पर प्रदत्त या अधिरोपित किए जाएं । इसे गवर्नर बोर्ड को, समस्त शैक्षणिक मामलों पर परामर्श देने का अधिकार होगा ।

(2) विद्या परिषद्‌ निम्नलिखित सदस्यों से गठित होगी, अर्थात्‌ः-

(क) कुलपति - अध्यक्ष;

(ख) संकायाध्यक्ष (डीन) - सदस्य;

(ग) महाविद्यालयों के प्रधानाचार्य, - सदस्य;

(घ) प्रधानाचार्यों द्वारा नामनिर्देशित किया - सदस्य; और

जाने वाला एक विभागाध्यक्ष या सरकारी महाविद्यालयों के प्रत्येक विभाग का एक आचार्य ।

(ङ) विख्यात उद्योगपति - सदस्यः

परन्तु नामनिर्देेशित सदस्यों का कार्यकाल तीन वर्ष का होगा ।

वित्त समिति । 22. 22. 22. 22. 22. (1) वित्त समिति निम्नलिखित व्यक्तियों से गठित होगी,अर्थात्‌ :-

(क) कुलपति - अध्यक्ष;

(ख) सचिव (वित्त), हिमाचल प्रदेश - सदस्य;

सरकार या उसका प्रतिनिधि

(ग) सचिव (तकनीकी शिक्षा, व्यावसायिक - सदस्य;

एवं औद्योगिक प्रशिक्षण विभाग),

हिमाचल प्रदेश सरकार

2505 (घ) गवर्नर बोर्ड के अध्यक्ष द्वारा नामनिर्देशित -सदस्य; और

सचिव होगा ।

(2) वित्त समिति, गवर्नर बोर्ड को समस्त वित्तीय मामलों पर सलाह देगी

और उसकी निम्नलिखित शक्तियां होगींः-

(क) विश्वविद्यालय के वार्षिक लेखाओं की परीक्षा करना और उन पर

बोर्ड को सलाह देना;

(ख) वार्षिक प्राक्कलनों की परीक्षा करना और बोर्ड को सलाह देना ;

(ग) वार्षिक संपरीक्षा रिपोर्ट और कृत कार्रवाई रिपोर्ट की परीक्षा

करना;

(घ) विश्वविद्यालय की वित्तीय स्थिति का पुनर्विलोकन करना ; और

(ङ) विश्वविद्यालय के वित्त पोषण से सम्बन्धित समस्त मामलों पर

विश्वविद्यालय को सिफारिशें करना ।

चयन समिति । 23. 23. 23. 23. 23. (1) चयन समिति निम्नलिखित से गठित होगी :-

(क) कुलपति - अध्यक्ष;

(ख) रजिस्ट्रार - सदस्य;

(ग) सम्बद्ध संकायाध्यक्ष (डीन) - सदस्य;

(घ) कुलाधिपति द्वारा नामनिर्देशित एक - सदस्य;

व्यक्ति, जो विश्वविद्यालय के अधीन कोई लाभ का पद धारण न कर रहा हो, और

(2) तीन सदस्यों, जिनमें से कम से कम दो व्यक्ति सम्बद्ध विषय में विशेष ज्ञान रखने वाले होंगे, से चयन समिति की बैठक के लिए गणपूर्ति होगी ।

चयन समिति के कृत्य।

24. 24. 24. 24. 24. (1) चयन समिति, कार्यकारी परिषद्‌ को विश्वविद्यालय के अधिकारियों एवं कर्मचारियों की नियुक्ति हेतु व्यक्तियों के चयन के मामलों में अपनी सिफारिशें करेगी और ऐसे चयनों की प्रक्रिया और पद्धति हेतु व्यवस्था भी करेगी ।

(2) यदि कार्यकारी समिति, चयन समिति की सिफारिशों को स्वीकार नहीं करती है, तो यह सिफारिशों को कारणों सहित पुनर्विचार हेतु वापिस भेजेगी और यदि कार्यकारी समिति, चयन समिति के पुनर्विचारित विचारों को स्वीकार नहींं करती है, तो मामले को कारणों सहित कुलाधिपति को निर्दिष्ट किया जाएगा, और उस पर कुलाधिपति का विनिश्चय अंतिम होगा ।

25. 25. 25. 25. 25. (1) विश्वविद्यालय के प्रत्येक अधिकारी और कर्मचारी को ऐसी नियुक्ति पर, नियुक्ति के ऐसे निबन्धनों तथा शर्तें जैसे विहित की जाएं, से युक्त नियुक्ति पत्र दिया जाएगा ।

अधिकारियों और कर्मचारियों के नियुक्ति पत्र ।

(2) स्थाई रिक्ति के विरूद्ध नियुक्त किया गया कोई अधिकारी या कर्मचारी, ऐसी नियुक्ति की तारीख से एक वर्ष की अवधि के लिए साधारणतया परिवीक्षा पर रहेगा और परिवीक्षा की ऐसी अवधि, विश्वविद्यालय के नियुक्ति प्राधिकारी के विवेकाधिकार पर एक वर्ष से अनधिक और अवधि के लिए बढ़ाई जा सकेगी । परिवीक्षा की अवधि के दौरान यदि किसी समय पर, परिवीक्षाधीन व्यक्ति का कार्य संतोषप्रद नहीं माना जाता है, तो परिवीक्षाधीन व्यक्ति, सम्बद्ध प्राधिकरण (अथॉरिटी) द्वारा उन्मोचित किया जाएगा ।

(3) परिवीक्षा की अवधि के संतोषप्रद समापन पर कोई शिक्षक या कोई अधिकारी या कोई कर्मचारी, यथास्थिति, विश्वविद्यालय द्वारा इस निमित्त लिखित में किए गए आदेश द्वारा उसकी परिवीक्षा पर नियुक्ति की तारीख से पुष्ट किया जाएगा और ऐसी पुष्टि का तथ्य सम्बद्ध व्यक्ति को संसूचित किया जाएगाः

परन्तु यदि, परिवीक्षा की अवधि के समापन पर यदि ऐसी पुष्टि को कोई भी ऐसा आदेश परिवीक्षा की अवधि के पूर्ण होने के दो मास के भीतर नहीं किया जाता है जो सम्बद्ध व्यक्ति को संसूचित नहीं किया जाता है तो सम्बद्ध व्यक्ति परिवीक्षा पर उसकी नियुक्ति की तारीख से पुष्ट हुआ समझा जाएगा। राजपत्र, हिमाचल प्रदेश, 30 जुलाई, 2010/8 श्रावण, 1932

अस्थाई अधिकारी या कर्मचारी की सेवा की समाप्ति । 26. 26. 26. 26. 26. किसी भी अस्थायी अधिकारी या कर्मचारी की सेवाएं, उस अवधि जिसके लिए उसे नियुक्त किया गया है, की समाप्ति के पूर्व एक मास का नोटिस देने के पश्चात्‌ या उसके बदले में उसे एक मास का वेतन का भुगतान करने के पश्चात्‌ के सिवाय, समाप्त नहीं की जाएंगी ।

विवाद । 27. 27. 27. 27. 27. यदि कोई प्रश्न उद्‌भूत (उत्पन्न) होता है कि क्या कोई व्यक्ति विश्वविद्यालय के किसी प्राधिकरण या निकाय का सदस्य सम्यक्‌ रूप से नियुक्त या निर्वाचित हुआ है या सदस्य होने का हकदार है तो मामले को कुलाधिपति को सौंपा जाएगा जिस पर उसका विनिश्चय अन्तिम होगा ।

निरर्हताएं । 2828282828. कोई भी व्यक्ति, विश्वविद्यालय के किसी प्राधिकरण या निकाय का सदस्य के रूप में निर्वाचन या नामनिर्देशन हेतु अर्हित नहीं होगा या ऐसे सदस्य के रूप में बना नहीं रहेगा यदि वह :-

(क) विकृतचित्‌ है या गूंगा है; या

(ख) अनुन्मोचित दिवालिया है; या

(ग) किसी न्यायालय द्वारा नैतिक अधमता से अन्तर्वलित किसी अपराध

के लिए सिद्धदोष ठहराया गया है ।

29. 29. 29. 29. 29. इस अधिनियम में अन्यत्र किसी बात के होते हुए भी कोई व्यक्ति, यदि वह अध्यापनेतर कर्मचारिवृन्द (स्टाफ) का सदस्य /कर्मचारी है, नियमित वेतनमान पर नियुक्त नहीं हुआ है या किसी पूर्णकालिक अध्यापनेतर पद पर न हो तो वह मतदाता के रूप में नामांकित होने, या विश्वविद्यालय के किसी प्राधिकरण या निकाय के निर्वाचन में मतदान करने अथवा किसी ऐसे निकाय या प्राधिकरण के लिए नामनिर्दिष्ट किए जाने हेतु हकदार नहीं होगा ।

अंशकालिक अध्यापनेत्तर कर्मचारिवृन्द (स्टॉफ)/कर्मचारी का मतदाता के रूप में अभ्यावेशित होने या नामनिर्देशित होने का हकदार न होना। स्पष्टीकरण.-स्पष्टीकरण.-स्पष्टीकरण.-स्पष्टीकरण.-स्पष्टीकरण.-"नियमित वेतनमान" से ऐसा वेतन अभिप्रेत होगा जो विश्वविद्यालय द्वारा विहित किसी शर्त के अध्यधीन, न्यूनतम से अधिकतम तक कालिक वेतन वृद्धियाें द्वारा बढ़ता हो । 2508 राजपत्र, हिमाचल प्रदेश, 30 जुलाई, 2010/8 श्रावण, 1932 सदस्यों की पदावधि ।

30. 30. 30. 30. 30. (1) विश्वविद्यालय के किसी प्राधिकरण या निकाय का निर्वाचित या नामनिर्दिष्ट सदस्य, यथास्थिति, उसके निर्वाचन या नामनिर्देशन की तारीख से चार वर्ष की अवधि के लिए पद धारण करेगा :

परन्तु इस अधिनियम के अधीन प्रथम निर्वाचन या नाम- निर्देशन की बाबत, चार वर्ष की उक्त अवधि ऐसे निर्वाचन या नामनिर्देशन के पश्चात्‌ हुई प्राधिकरण या निकाय की प्रथम बैठक की तारीख से आरम्भ होगी ।

(2) समय के व्यतिक्रम द्वारा व्युत्पन्न हुई रिक्तियाेंे को भरने के लिए, विश्वविद्यालय के किसी प्राधिकरण या निकाय के पदेन सदस्यों से भिन्न, सदस्यों की पदावधि जो उक्त पदावधि के अवसान और ऐसे प्राधिकरण या निकाय के नए सदस्यों के निर्वाचन के मध्य व्यपगत हो, सम्मिलित की गई मानी जाएगीः

परन्तु जब निर्वाचन एक से अधिक तारीख को आयोजित होते हैं, तो इस धारा के प्रयोजनों के लिए, ऐसी तारीखों की अन्तिम तारीख निर्वाचन की तारीख मानी जाएगी ।

(3) किसी आकस्मिक रिक्ति को भरने हेतु कोई निर्वाचित या नामनिर्दिष्ट सदस्य, सदस्य के पद की अनवसित अवधि के भाग के लिए पद ग्रहण करेगा जिसके स्थान पर वह निर्वाचित या नामनिर्दिष्ट हुआ है ।

कतिपय मामलों में सदस्यता की समाप्ति ।

31. 31. 31. 31. 31. (1) जब कोई व्यक्ति, किसी प्राधिकरण या निकाय में उसकी सदस्यता के फलस्वरूप, विश्वविद्यालय के किसी प्राधिकरण या निकाय का सदस्य बनने के लिए अर्हित है, तो वह विश्वविद्यालय के प्राधिकरण या निकाय का सदस्य नहीं रह जाएगा, जब वह ऐसे अन्य प्राधिकरण या निकाय का भी सदस्य नहीं रह जाता है ।

(2) जब कोई व्यक्ति किसी निर्वाचन क्षेत्र से विश्वविद्यालय के किसी प्राधिकरण या निकाय के सदस्य के रूप में निर्वाचित या नामनिर्दिष्ट होता है, तो वह ऐसा सदस्य नहीं बना रहेगा जब उसका सम्बन्ध उस निर्वाचन क्षेत्र से समाप्त हो जाता है । राजपत्र, हिमाचल प्रदेश, 30 जुलाई, 2010/8 श्रावण, 1932

रिक्तियों का भरा जाना । 32. 32. 32. 32. 32. (1) विश्वविद्यालय के किसी प्राधिकरण या निकाय के निर्वाचित सदस्यों में से कोई आकस्मिक रिक्ति, ऐसी रीति और ऐसे समय के भीतर भरी जाएगी, जैसा उस सदस्य के हितों का प्रतिनिधित्व करने वाले ऐसे प्राधिकरण या व्यष्टि निकाय द्वारा निर्वाचन द्वारा विहित किया जाए, जिसका स्थान रिक्त हुआ है, प्रतिनिधित्व करता ।

(2) विश्वविद्यालय के किसी प्राधिकरण या निकाय के नामनिर्दिष्ट सदस्यों की कोई रिक्ति ऐसे समय के भीतर भरी जाएगी, जैसी ऐसे व्यक्ति या प्राधिकरण द्वारा नाम निर्देशन द्वारा विहित की जाए जिसने उस सदस्य को नामनिर्दिष्ट किया था जिसका स्थान रिक्त हुआ है ।

(3) समय के व्यतिक्रम द्वारा विश्वविद्यालय के किसी प्राधिकरण या निकाय के निर्वाचित सदस्यों के स्थानों (सीटोंं) में व्युत्पन्न हुई रिक्तियां, छहः मास के अपश्चात्‌ या रिक्तियां व्युत्पन्न होने की तारीख, जो कुलपति नियत करे, से ऐसी विस्तारित अवधि, जो कुलाधिपति द्वारा इस निमित्त किए गए आदेश द्वारा विनिर्दिष्ट की जाए, ऐसी तारीख या तारीखोें को निर्वाचन द्वारा भरी जाएंगी ।

33. 33. 33. 33. 33. विश्वविद्यालय या विश्वविद्यालय के किसी प्राधिकरण या निकाय का कोई भी कृत्य या कार्यवाहियां मात्र इसके सदस्यों के मध्य रिक्ति या रिक्तियों के विद्यमान रहने अथवा सदस्यों में से किसी के निर्वाचन की अविधिमान्यता के कारण अविधिमान्य नहीं समझी जाएगी ।

रिक्तियों से विश्वविद्यालय या विश्वविद्यालय के प्राधिकरणों या निकायों की कार्यवाहियों का अविधि- मान्य न होना। स्पष्टीकरण.-स्पष्टीकरण.-स्पष्टीकरण.-स्पष्टीकरण.-स्पष्टीकरण.- शंका को दूर करने के लिए, यह एतद्‌द्वारा घोषित किया जाता है कि जहां विश्वविद्यालय के किसी प्राधिकरण या निकाय के किसी सदस्य का पद, जब ऐसा प्राधिकरण या निकाय प्रथम बार के लिए गठित हुआ है, किसी निर्वाचन या नियुक्ति के कारण किसी साध्य कारण के न होते हुए भरा नहीं जा सकता है, वहां ऐसे सदस्य के पद में रिक्ति होना समझा जाएगा जब तक कि ऐसा निर्वाचन नहीं हो जाता या ऐसी नियुक्ति नहीं कर दी जाती।

निर्वाचन अधिकरण । 34.34.34.34.34. (1) एक निर्वाचन अधिकरण होगा, जिसेे कोई भी ऐसा प्रश्न निर्दिष्ट किया जाएगा जो इस बारे में उद्‌भूत होता हो कि क्या कोई व्यक्ति निर्वाचन या नामनिर्देशन के लिए पात्र है या सम्यक्‌ रूप से निर्वाचित अथवा नामनिर्दिष्ट हुआ है या विश्वविद्यालय के किसी प्राधिकरण या निकाय का सदस्य बनने के लिए हकदार है या नहीं, और ऐसे प्रश्न पर निर्वाचन अधिकरण का विनिश्चिय अंतिम होगा । 2510 राजपत्र, हिमाचल प्रदेश, 30 जुलाई, 2010/8 श्रावण, 1932

(2) निर्वाचन अधिकरण का गठन (संविधान) ऐसा होगा जैसा परिनियमों

द्वारा विहित किया जाए ।

(3) यदि, विश्वविद्यालय के किसी प्राधिकरण या निकाय के सदस्यों के निर्वाचन की प्रक्रिया (प्रगति) के दौरान, निर्वाचन अधिकरण का समाधान हो जाता हेै कि ऐसा निर्वाचन कपट या भ्रष्ट आचरण द्वारा दूषित हुआ है तो निर्वाचन अधिकरण इस अधिनियम और परिनियम तथा तद्‌धीन बनाए गए विनियमनों के अनुसार ऐसे निर्वाचन या इसके किसी भाग की बाबत कार्यवाहियों का बात्तिलीकरण करने का आदेश कर सकेगा और नई कार्यवाहियों को उस स्तर से आरम्भ करने हेतु निर्दिष्ट करने का आदेश दे सकेगा, जैसी उस आदेश में विनिर्दिष्ट की जाएं और निर्वाचन अधिकरण का ऐसा आदेश अंतिम होगा ।

(4) निर्वाचन अधिकरण के किसी विनिश्चय या आदेश के विरूद्ध किसी सिविल न्यायालय में कोई वाद या अन्य विधिक कार्यवाही नहीं लाई जाएगी ।

अध्यक्ष का निर्णायक मत ।

35. 35. 35. 35. 35. कार्यकारी परिषद्‌, गवर्नर बोर्ड, परिषद्‌ों या विश्वविद्यालय के किसी अन्य प्राधिकरण या निकाय की बैठक में, बैठक की अध्यक्षता करने वाला व्यक्ति प्रथमतः मतदान नहीं करेगा, परन्तु मतों की बराबरी की दशा में उसका निर्णायक मत होगा और वह उसका प्रयोग करेगा।

36. 36. 36. 36. 36. (1) विश्वविद्यालय की एक निधि होगी, जिसे विश्वविद्यालय निधि के नाम से जाना जाएगा, जिसमें फीस, जुर्मानों, अभिदायों, दानों, ऋणों और अग्रिमों तथा किसी भी अन्य स्रोतों से प्राप्त इसकी समस्त आय जमा की जाएगी ।

(2) विश्वविद्यालय, इस अधिनियम द्वारा या के अधीन विन्यासों, न्यासों या विनिर्दिष्ट अनुदान या अन्य विशेष प्रयोजनों के लिए अनुदानों के प्रशासन हेतु पृथक विशेष निधियों का सृजन भी कर सकेगा ।

37. 37. 37. 37. 37. (1) किसी वित्तीय वर्ष के लिए विभिन्न लेखाओं पर विश्वविद्यालय की प्राप्तियां और व्यय दर्शाते हुए विश्वविद्यालय का बजट ऐसे प्रारूप में जैसे राज्य सरकार द्वारा विनिर्दिष्ट किया जाए, ऐसे वित्तीय वर्ष के प्रारम्भ से कम से कम चार मास पूर्व अनुमोदन हेतु, राज्य सरकार को प्रस्तुत किया जाएगा ।

2511 (2) राज्य सरकार, उस वित्तीय वर्ष, जिससे बजट सम्बन्धित है, के प्रारम्भ होने से कम से कम दो मास पूर्व बजट पर अपना अनूुमोदन या अन्यथा विश्वविद्यालय को संसुचित करेगी :

परन्तु राज्य सरकार, विश्वविद्यालय को बजट के अनुमोदित होने

तक व्यय उपगत करने के लिए अनुदान जारी (निर्मुक्त) करेगी ।

(3) इस अधिनिमय में अन्तर्विष्ट किसी बात के प्रतिकूल होते हुए भी, विश्वविद्यालय, राज्य सरकार के पूर्व अनुमोदन के सिवाय, किसी भी लेखे पर कोई भी व्यय, बजट में उस लेखे पर विनिर्दिष्ट राशि से अधिक उपगत नहीं करेगा :

परन्तु यदि ऐसा व्यय विश्वविद्यालय अपने स्वयं के साधनों से पूरा करता है, तो बजट में उपबन्धित न की गई किसी स्कीम पर किसी व्यय की बाबत ऐसा कोई पूर्व अनुमोदन आवश्यक नहीं होगा ।

अभिदायी भविष्य निधि । 38. 38. 38. 38. 38. विश्वविद्यालय द्वारा अपने शिक्षकों, अधिकारियों या कर्मचारियों की प्रसुविधा हेतु संस्थित कोई अभिदायी भविष्य निधि, भविष्य निधि अधिनियम के उपबन्धों द्वारा विनियमित की जाएगी, मानों ऐसी निधि कोई अभिदायी भविष्य निधि हो और कार्यकारी परिषद्‌ को निधि के प्रशासन हेतु ऐसे नियम बनाने की शक्ति होगी, जो उस अधिनियम के उपबन्धों से असंगत न हाें ।

निरीक्षण । 39. 39. 39. 39. 39. (1) राज्य सरकार को,-

(क) विश्वविद्यालय, इसके भवनों, प्रयोगशालाओं, पुस्तकालयों, संग्रहालयों,

प्रैस स्थापनाओं, कार्यशालाओं और उपस्करों;

(ख) विश्वविद्यालय द्वारा अनुरक्षित या से सम्बद्ध किसी महाविद्यालय या

संस्थान;

(ग) विश्वविद्यालय के समस्त कार्यकलापों का और विश्वविद्यालय या संस्थान द्वारा करवाए या किए गए ऐसे अन्य कार्यो का; और 2512 राजपत्र, हिमाचल प्रदेश, 30 जुलाई, 2010/8 श्रावण, 1932

(घ) विश्वविद्यालय की किसी आय, व्यय, सम्पत्तियों, परिसम्पत्तियों और दायित्वों का, और विश्वविद्यालय द्वारा अनुरक्षित या से सम्बद्ध किसी महाविद्यालय या संस्थान का,

निरीक्षण कराने का अधिकार होगा जो ऐसे व्यक्ति या व्यक्तियों द्वारा किया जाएगा जैसे ये निर्दिष्ट करे ;

(2) राज्य सरकार, निरीक्षण या जांच के ऐसे प्रत्येक मामले में ऐसे निरीक्षण या जांच करवाने के अपने आशय की पूर्व सूचना विश्वविद्यालय को, या ऐसे महाविद्यालय या संस्थान को देगी ।

(3) राज्य सरकार कार्यकारी परिषद्‌ को या, यथास्थिति, ऐसे महाविद्यालय या संस्था को ऐसे निरीक्षण या जांच के परिणामों पर अपने विचार संसूचित करेगी और उस पर कार्यकारी परिषद्‌ की या ऐसे महाविद्यालय या संस्था की राय पर विचार करने के पश्चात्‌ विश्वविद्यालय या ऐसे महाविद्यालय या संस्था को, सम्बंधित मामले में ऐसी कार्रवाई, जिसे राज्य सरकार विश्वविद्यालय या ऐसे महाविद्यालय या संस्था द्वारा किए जाने के लिए उचित समझती है, के बारे में सलाह दे सकेगी और विश्वविद्यालय या ऐसा महाविद्यालय या संस्था, राज्य सरकार की ऐसी सलाह को प्रभावी करने हेतु विश्वविद्यालय द्वारा की जाने वाली प्रस्तावित कार्रवाई की रिपोर्ट राज्य सरकार को ऐसे समय, जैसा राज्य सरकार निर्दिष्ट करें, के भीतर करेगी।

(4) राज्य सरकार, उपधारा (3) में निर्दिष्ट रिपोर्ट पर विचार करने के पश्चात्‌, यथास्थिति, विश्वविद्यालय या ऐसे महाविद्यालय या संस्था को सम्बन्धित मामले में ऐसी और कार्रवाई जैसी राज्य सरकार की राय में आवश्यक हो करने की सलाह दे सकेगी, और विश्वविद्यालय या ऐसा महाविद्यालय या संस्था, ऐसे समय के भीतर, जो राज्य सरकार द्वारा उस निमित्त विनिर्दिष्ट किया जाए, ऐसी आगामी कार्रवाई करेगा या करवाएगा ।

40. 40. 40. 40. 40. परिनियम इस अधिनियम के उपबन्धों के अध्यधीन निम्नलिखित

सभी या इनमें से किन्हीं विषयों के लिए उपबन्ध कर सकेेंगे, अर्थात्‌ :-

(क) पदों की, विश्वविद्यालय के अधिकारियों के पदों के रूप में घोषणा;

2513 (ख) विश्वविद्यालय के प्राधिकरणों (अथॉरिटिज) की स्थापना ;

(ग) विश्वविद्यालय के प्राधिकरणों (अथॉरिटिज) का गठन, शक्तियां और कर्त्तव्य, जहां तक कि इनके बारे में अधिनियम में विनिर्दिष्ट रूप से उपबन्ध नहीं किया गया है ;

(घ) विश्वविद्यालय के अधिकारियों की शक्तियां, कर्त्तव्य और सेवा के निबन्धन और शर्तें जहां तक कि इनके बारे में अधिनियम में विनिर्दिष्ट रूप से उपबन्ध नहीं किया गया है;

(ङ) विश्वविद्यालय की कार्यकारी परिषद्‌ और अन्य प्राधिकरणों और

निकायों का निर्वाचन करवाने हेतु नियम और प्रक्रिया;

(च) विश्वविद्यालय के अधिकारियों और कर्मचारियों की नियुक्ति, उनकी उपलब्धियां, कर्त्तव्य और सेवा के निबन्धन और शर्तें जहां तक कि इनके बारे में अधिनियम में विनिर्दिष्ट रूप से उपबन्ध नहीं किया गया है ;

(छ) मानक उपाधियों तथा विशिष्टताओं (सम्मान) सहित उपाधियां, खिताब (टाईटल्ज), डिप्लोमों, प्रमाण-पत्र और अन्य विद्या सम्बन्धी उपाधियां प्रदान करने हेतु दीक्षान्त समारोह आयोजित करना; और

(ज) समस्त अन्य विषय, जो इस अधिनियम के अधीन परिनियमों द्वारा विहित किए जाने अपेक्षित हैं या विहित किए जा सकेंगे ।

41.41.41.41.41. (1) कार्यकारी परिषद्‌ इस धारा में उपबन्धित रीति में परिनियम बना

सकेगी या इसके पश्चात्‌ परिनियमों का संशोधन या निरसन कर सकेगी :

परिनियम बनाने की शक्ति । परन्तु कार्यकारी परिषद्‌ विश्वविद्यालय के किसी विद्यमान प्राधिकरण की प्रास्थिति, शक्तियों या गठन पर प्रभाव डालने वाला कोई ऐसा परिनियम तब तक नहीं बनाएगी या परिनियम में कोई संशोधन नहीं करेगी, जब तक कि ऐसे प्राधिकरण को प्रस्ताव पर राय अभिव्यक्त करने का अवसर न दे दिया गया हो और इस प्रकार अभिव्यक्त किसी भी प्रकार की राय लिखित रूप में होगी और उस पर कार्यकारी परिषद्‌ द्वारा विचार किया जाएगा । 2514 राजपत्र, हिमाचल प्रदेश, 30 जुलाई, 2010/8 श्रावण, 1932

(2) प्रत्येक परिनियम या परिनियमों में परिवर्धन या परिनियमों के किसी संशोधन या निरसन के लिए कुलाधिपति का अनुमोदन अपेक्षित होगा, जो उस पर अपनी अनुमति दे सकेगा या अनुमति रोक सकेगा या उसे कार्यकारी परिषद्‌ को अपने सुझावों सहित पुनर्विचार के लिए भेज सकेगा । यदि कार्यकारी परिषद्‌ इसको उसी प्ररूप और रीति में पुनः पारित करती है और यदि कुलाधिपति का समाधान हो जाता है कि यह विश्वविद्यालय के हित में नहीं है, तो वह ऐसे परिनियम, संशोधन या निरसन को नामंजूर कर सकेगा ।

(3) किसी नए परिनियम या विद्यमान परिनियम को संशोधित या निरसित करने वाले परिनियम को तब तक कोई विधिमान्यता नहीं होगी, जब तक उसे कुलाधिपति द्वारा अनुमति न दी गई हो ।

अध्यादेश।

42. 42. 42. 42. 42. (1) इस अधिनियम और परिनियमों के उपबन्धों के अध्यधीन, अध्यादेश निम्नलिखित सभी या किन्हीं विषयों के लिए उपबन्ध कर सकेगें, अर्थात्‌ः-

(क) विश्वविद्यालय और महाविद्यालयों में छात्रों का प्रवेश और इस रूप

में उनका नामांकन ;

(ख) विश्वविद्यालय और महाविद्यालयों के छात्रों के निवास की शर्तें और अनुशासन के नियम और छात्र निवास (हाल) में निवास हेतु फीस का उद्‌ग्रहण ;

(ग) विश्वविद्यालय के अधिकारियों और कर्मचारियों की नियुक्ति, उनकी उपलब्धियों, उनके कर्त्तव्य और उनकी सेवा के अन्य निबन्धन और शर्तें, जहां तक कि ये इस अध्यादेश या परिनियम में विनिर्दिष्ट रूप से उपबन्धित नहीं किए गए हैं।

(घ) छात्रों का रजिस्ट्रीकरण;

(ङ) परीक्षकों, प्राश्निकों (पेपर सेटरज), संवीक्षकों और ऐसे अन्य व्यक्तियों,

जो परीक्षा से सम्बद्ध है, की नियुक्ति, कर्त्तव्य और उपलब्धियां ;

(च) विश्वविद्यालय के शिक्षकों, अधिकारियों और कर्मचारियों की प्रसुविधा

हेतु भविष्य निधि या अन्य निधियां संस्थित करना ;

2515 (छ) विश्वविद्यालय पुस्तकालयों, परीक्षा हालों और अन्य विश्वविद्यालय

संस्थाओं की स्थापना, रख-रखाव और प्रबन्धन ;

(ज) विश्वविद्यालय द्वारा स्थापित, अनुरक्षित और प्रबन्धित से अन्यथा, पुस्तकालयों, छात्रावासों और अध्ययन संस्थानों, अनुसन्धान और निवास को मान्यता ;

(झ) विश्वविद्यालय को संदेय फीस, जुर्माना और अन्य देयों का अधिरोपण

और वसूली ;

(ञ) विभागाध्यक्षों सहित, विश्वविद्यालय के अधिकारियों के कर्तव्य एवं

कृत्य ;

(ट) दान, विन्यास और उपकृतियों का प्रबन्ध करना;

(ठ) अध्येतावृत्तियां, यात्रा अध्येतावृत्तियां, छात्रवृत्तियां, अध्ययनवृत्तियां, वृत्तिका, वजीफा, छात्र-सहायता वृत्ति, पदक और पुरस्कार, संस्थित करना और प्रदान करना ;

(ड) केन्द्रीय या किसी राज्य या विश्वविद्यालय अनुदान आयोग के उधार से अन्यथा, अनुदान स्वीकार करने और उधार लेने या स्वीकार करने हेतु प्रक्रिया ;

(ढ) समस्त अन्य विषय, जो इस अधिनियम के या परिनियमों के अधीन, अध्यादेशोंं द्वारा विहित किए जाने अपेक्षित है या विहित किए जा सकेंगे ।

(2) अध्यादेश कार्यकारी परिषद्‌ द्वारा बनाए जाएंगे और इस प्रकार बनाए गए अध्यादेशों का किसी भी समय कार्यकारी परिषद द्वारा, परिनियमों द्वारा विहित रीति में संशोधन, निरसन या अभिवर्धन किया जा सकेगा ;

(3) उपधारा (2) के अधीन अध्यादेशों के संशोधन या निरसन की तब तक कोई विधिमान्यता नहीं होगी, जब तक उसे राज्य सरकार के परामर्श से कुलाधिपति द्वारा अनुमति न दी गई हो । 2516 राजपत्र, हिमाचल प्रदेश, 30 जुलाई, 2010/8 श्रावण, 1932 विनियम ।

43. 43. 43. 43. 43. (1) कार्यकारी परिषद्‌, कुलाधिपति की मंजूरी से, विश्वविद्यालय से सम्बद्ध समस्त मामलों के बारे में इस अधिनियम, परिनियमों और अध्यादेशों से संगत विनियम बना सकेगी ।

(2) विशिष्टतः और पूर्वगामी शक्ति की व्यापकता पर प्रतिकूल प्रभाव डाले बिना, ऐसे विनियम, विश्वविद्यालय के प्राधिकरणों के सम्बन्ध में निम्नलिखित उपबन्ध कर सकेंगे :-

(क) उनकी बैठक में अनुसरण की जाने वाली प्रक्रिया और गणपूर्ति के लिए अपेक्षित सदस्यों की संख्या को अधिकथित करना ;

(ख) ऐसे समस्त मामले, जिनके लिए इस अधिनियम, परिनियमों या

अध्यादेशों के अधीन विनियमों द्वारा उपबन्ध किया जाना है ;

(ग) कोई अन्य मामला, जो केवल किसी प्राधिकरण से सम्बन्धित हो, और जिसके लिए इस अधिनियम, परिनियमों या अध्यादेशों द्वारा उपबन्ध नहीं किया गया हो ;

(घ) इसके सदस्यों को बैठकों की तारीखों और उसमें संव्यवहृत किए जाने वाले कारबार तथा ऐसी बैठक की कार्यवाहियों का अभिलेख रखने की सूचना (नोेटिस) देना ।

44. 44. 44. 44. 44. (1) राज्य सरकार इस अधिनियम के उपबन्धों को कार्यान्वित करने

नियम बनाने

की शक्ति । के लिए राजपत्र में अधिसूचना द्वारा नियम बना सकेगी।

(2) उपधारा (1) के अधीन बनाए गए नियम, राजपत्र में पूर्ववर्ती प्रकाशन

की शर्तों के अध्यधीन हाेंगे ।

(3) इस अधिनियम के अधीन बनाए गए प्रत्येक नियम, उनके इस प्रकार बनाए जाने के पश्चात्‌, यथाशक्यशीघ्र, राज्य विधान सभा के सम़़क्ष, जब वह सत्र में हो कुल दस दिन की अवधि के लिए, जो एक सत्र में या दो या अधिक आनुक्रमिक सत्रों में पूरी हो सकेगी, रखे जाएंगे और यदि, उस सत्र के जिनमें वे इस प्रकार रखे गए हों या ठीक बाद के सत्र के अवसान से पूर्व, राज्य विधान सभा नियमों में कोई उपान्तरण करती है, या सहमत हो जाती है कि नियम नहीं बनाए राजपत्र, हिमाचल प्रदेश, 30 जुलाई, 2010/8 श्रावण, 1932

2517 जाने चाहिए, तो तत्पश्चात्‌, यथास्थिति, ऐसे नियम केवल ऐसे उपान्तरित रूप मेंं ही प्रभावी होंगे या उनका कोई प्रभाव नहीं होगा, तथापि ऐसा कोई भी उपान्तरण या बातिलीकरण उस नियम के अधीन पूर्व में की गई किसी बात की विधिमान्यता पर कोई प्रतिकूल प्रभाव नहीं डालेगा ।

प्रत्यायोजन। 45. 45. 45. 45. 45. (1) कुलपति इस अधिनियम के उपबन्धों के अध्यधीन, इसके सीधे प्रशासनिक नियंत्रणाधीन, विश्वविद्यालय के किसी अधिकारी को इस अधिनियम के अधीन या के द्वारा प्रदत्त या अधिरोपित ऐसी शक्तियों या कर्त्तव्यों को प्रत्यायोजित कर सकेगा, जैसा परिनियमों द्वारा विहित किया जाए ।

(2) इस अधिनियम के उपबन्धों के अध्यधीन, -

(क) कार्यकारी परिषद्‌ इस अधिनियम के अधीन या के द्वारा प्रदत्त या अधिरोपित अपनी किन्ही शक्तियों या कर्त्तव्यों को निम्नलिखित को प्रत्यायोजित कर सकेगीः -

(i) कुलपति ; या (ii) इसके अपने सदस्यों में से गठित समिति; या (iii) परिनियमों के अनुसार नियुक्त समिति ।

(ख) वित्त समिति, इस अधिनियम के अधीन या द्वारा प्रदत्त या अधिरोपित अपनी किन्हीं शक्तियों या कर्त्तव्यों को निम्नलिखित को प्रत्यायोजित कर सकेगीः-

(i) कुलपति ; या (ii) इसके अपने सदस्यों में से गठित समिति।

46. 46. 46. 46. 46. किसी महाविद्यालय की सम्बद्धता की शर्तें ऐसी होंगी जैसी विहित

की जाएं ।

सम्बद्धता के लिए शर्तें।

परीक्षाएं और प्रवेश। 47. 47. 47. 47. 47. छात्र, विश्वविद्यालय द्वारा संस्थित अध्ययन के विभिन्न पाठ्‌यक्रमों के लिए प्रवेश हेतु पात्र होंगे, और उनको यथाविहित विभिन्न उपाधियों, डिप्लोमों, प्रमाण-पत्रों और अन्य विशिष्टताओं (सम्मान) परीक्षाओं में प्रवेश दिया जाएगा। 48. 48. 48. 48. 48. (1) विश्वविद्यालय के विनियम राज्य सरकार द्वारा बनाए जाएंगे

और राजपत्र में प्रकाशित किए जाएंगे ।

(2) गवर्नर बोर्ड, समय-समय पर नए या अतिरिक्त विनियम बना सकेगा

या उनमें संशोधन या निरसन कर सकेगा :

परन्तु यह कि गवर्नर बोर्ड तब तक विश्वविद्यालय के किसी विद्यमान प्राधिकरण की प्रास्थिति, शक्तियों या गठन को प्रभावित करने वाले विनियमों में संशोधन का प्रारूप प्रस्तावित नहीं करेगा, जब तक कि ऐसे प्राधिकरण को प्रस्ताव पर राय व्यक्त करने का अवसर प्रदान नहीं किया गया हो और इस प्रकार व्यक्त कोई राय लिखित रूप में होगी या गवर्नर बोर्ड द्वारा इस पर विचार किया जाएगा।

(3) प्रत्येक नए विनियम या विनियमों में परिवर्धन या विनियमों में कोई संशोधन या निरसन के लिए गवर्नर बोर्ड का अनुमोदन अपेक्षित होगा, जो इसे अनुमोदित कर सकेगा, नामंजूर कर सकेगा या आगामी विचारार्थ वापस कर सकेगा ।

वार्षिक रिपोर्ट ।

49. 49. 49. 49. 49. (1) विश्वविद्यालय की वार्षिक रिपोर्ट तैयार की जाएगी, जिसे गवर्नर बोर्ड की वार्षिक बैठक में ऐसी तारीख को जो विनियम द्वारा विहित की जाए, या उससे पूर्व, अनुमोदनार्थ प्रस्तुत किया जाएगा ।

(2) उपधारा (1) के अधीन गवर्नर बोर्ड को प्रस्तुत की गई वार्षिक रिपोर्ट की एक प्रति, गवर्नर बोर्ड द्वारा उस पर की गई टिप्पणियों, यदि कोई हों, सहित राज्य सरकार को प्रस्तुत की जाएगी, जिसे, यथाशीघ्र राज्य विधान मण्डल के समक्ष रखा जाएगा ।

वार्षिक लेखे ।

50. 50. 50. 50. 50. (1) विश्वविद्यालय के वार्षिक लेखे और तुलनपत्र कार्यकारी परिषद्‌ के निदेशों के अधीन तैयार किए जाएंगे और राज्य सरकार द्वारा इस निमित्त विशिष्ट रूप से समय-समय पर प्राधिकृत किसी अभिकरण (एजेन्सी) द्वारा प्रत्येक वर्ष में एक बार और पन्द्रह महीनों से अनधिक के अन्तरालों पर संपरीक्षित किए जाएंगे ।

(2) लेखा परीक्षा रिपोर्ट सहित वार्षिक लेखों की एक प्रति राज्य सरकार को प्रस्तुत की जाएगी, जिसे यथाशीघ्र राज्य विधान मण्डल के समक्ष रखा जाएगा। राजपत्र, हिमाचल प्रदेश, 30 जुलाई, 2010/8 श्रावण, 1932

2519 51. 51. 51. 51. 51. यदि कोई प्रश्न उत्पन्न होता है कि क्या कोई व्यक्ति सम्यक्‌ रूप से नामनिर्देशित या नियुक्त किया गया है या विश्वविद्यालय के किसी प्राधिकरण या निकाय का सदस्य बनाए जाने का हकदार है, तो ऐसे मामले को कुलाधिपति को भेजा जाएगा जिस पर उसका विनिश्चय अन्तिम होगा।

प्राधिकरणों और निकायों के गठन की बाबत विवाद ।

विश्वविद्यालय के प्राधिकरणों की शक्तियां

और कर्त्तव्य । 52. 52. 52. 52. 52. विश्वविद्यालय की स्थापना के सम्बन्ध में या विश्वविद्यालय के किसी प्राधिकरण की प्रथम बैठक के सम्बन्ध में या अन्यथा इस अधिनियम के उपबन्धों को प्रथमतः प्रभावी (कार्यान्वित) करने में कोई कठिनाई होती है, तो राज्य सरकार विश्वविद्यालय के किसी प्राधिकरण के गठित होने से पूर्व किसी भी समय, आदेश द्वारा कोई नियुक्ति कर सकेगी या जहां तक हो सके इस अधिनियम के उपबन्धों से सुसंगत कोई बात कर सकेगी जिससे इसे ऐसा प्रतीत हो कि इस अधिनियम में उपबन्धित रीति में आवश्यक कार्रवाई कर दी है ।

अस्थायी उपबन्ध। 53. 53. 53. 53. 53. इस अधिनियम में या परिनियमों या अध्यादेशों में किसी बात के होते हुए भी, महाविद्यालय का कोई छात्र, जो इस अधिनियम के प्रारम्भ होने से ठीक पूर्व हिमाचल प्रदेश विश्वविद्यालय, शिमला में किसी उपाधि, डिप्लोमा या प्रमाण-पत्र के लिए अध्ययनरत था, को विश्वविद्यालय द्वारा अपनी उपाधि, डिप्लोमा या प्रमाणपत्र के पाठ्‌यक्रम को पूर्ण करने के लिए अनुज्ञात किया जाएगा, और यथास्थिति, विश्वविद्यालय या महाविद्यालय हिमाचल प्रदेश विश्वविद्यालय की अध्ययन विवरण पत्रिका (प्रॉस्पेक्टस्‌) के अनुसार ऐसे छात्र को अनुदेश के लिए उपबन्ध करेगा ओैर उसे विश्वविद्यालय की सम्बद्ध परीक्षा में प्रवेश करने की अनुमति दी जाएगी ।

कठिनाइयां दूर करने की शक्ति। 54. 54. 54. 54. 54. यदि इस अधिनियम के उपबन्धों को कार्यान्वित करने में कोई कठिनाई उत्पन्न होती है तो राज्य सरकार, राजपत्र, हिमाचल प्रदेश में प्रकाशित आदेश द्वारा ऐसे उपबन्ध कर सकेगी, जो इस अधिनियम के उपबन्धों से असंगत न हो और जो ऐसी कठिनाई को दूर करने के प्रयोजन हेतु इसे आवश्यक प्रतीत हो :

परन्तु यह कि इस अधिनियम के प्रारम्भ होने के दो वर्ष के अवसान

AND REGULATION) ACT, 2010

(AS ASSENTED TO BY THE GOVERNOR ON 28 JULY, 2010)

ACT

to provide for establishment, incorporation and regulation of the Himachal Pradesh

Technical University in the State for technical education and to regulate its functioning

and for matters connected therewith or incidental thereto.

BE it enacted by the Legislative Assembly of Himachal Pradesh in

the Sixty- first Year of the Republic of India as follows:—

CHAPTER—I

PRELIMINARY AND DEFINITIONS

1. (1) This Act may be called the Himachal Pradesh Technical

University (Establishment and Regulation) Act, 2010.

Short title and commence- ment.

(2) It shall come into force on such date as the State Government

may, by notification published in the Official Gazette, appoint.

Definitions.

2. In this Act, unless the context otherwise requires,—

(a) "College" means a college or an institution maintained by or

admitted to the privileges of the University under this Act;

(b) "convocation" means a meeting of the Executive Council for the purpose of conferring degrees, titles or other academic distinctions;

(d) "financial year" means the year ending on the 31st day of

March;

(e) "Governor" means the Governor of Himachal Pradesh;

(f) "hall" or "hostel " means a unit of residence of the students

maintained by the University;

(g) "institution" means a College, Research Organization or any other place, by whatever name called, for training, instruction, research or study;

(h) "Member" means a member of the Board of Governors established under section 20 of this Act and includes its Chairman;

(i) "Principal" means the head of a College (by whatever name called) and includes when there is no Principal, the person for the time being duly appointed, to act as Principal, and in the absence of Principal or the acting Principal, a Vice- Principal duly appointed as such;

(j) "regulations " means the regulations of the University made

under this Act;

(k) "technical education" means the education in the subjects of Engineering Technologies, Information Technologies, sciences, management, pharmacy and architecture and such other subjects as may be deemed fit by the State Government from time to time;

(l) "University" means the Himachal Pradesh Technical

University, as incorporated under section 4 of this Act;

(m) "non-teaching staff" means—

2525 (ii) in relation to an affiliated College, the non –teaching staff, not holding any teaching post(including part- time teaching post), appointed or recognized by the University or appointed by such College, but does not include any librarian;

(n) "prescribed" means prescribed by statutes or regulations

made under this Act;

(o) "statutes", "regulations", "rules" and "ordinances" means respectively, the statutes, regulations, rules and ordinances made under this Act; and

(p) "State Government" means the Government of Himachal

Pradesh.

CHAPTER—II

THE OBJECTS OF THE UNIVERSITY AND ITS OFFICERS

3. The University shall inter alia have the following main objects,

namely:—

Objects of the University.

(a) to provide a system of technical education capable of responding to the changing requirements of technical manpower;

(b) to bring about qualitative improvement in teaching and learning

(e) to provide necessary help to the institutions to encourage

entrepreneurship amongst students;

(f) to maintain life time contact with alumni and develop alumni

other distinctions to and on persons who,—

(i) have persued a course of study in the University or as prescribed by regulations and have passed the examinations prescribed by the University; and

(ii) have carried on research as prescribed by the

regulations;

(c) to make provisions for providing, upgrading and promoting technical education and training and research in technical education and to create entrepreneurship and a conducive environment for the pursuit of the technical education in close cooperation with industry;

(d) to generate and maintain resources through consultancy services, continuing education programs, national and international collaborations and transfer of intellectual property rights;

(e) to institute and confer degrees, awards, grades, credits and

other academic distinctions;

(f) to provide for the degree equivalent or corresponding to the

degree of other recognized Universities;

2529 (g) to take all necessary measures for setting up campuses;

(h) to institute and confer honorary degrees as may be

prescribed;

(i) to institute and award scholarships to students as may be

specified;

(j) to take special measures for spreading educational facilities

among the educationally backward strata of the society;

(k) to encourage and promote sports and adventure activities;

(l) to create technical, administrative, ministerial and other necessary posts and to make appointments thereto;

(m) to provide consultancy services;

(n) to frame statutes and regulations for carrying out the objects of the University in accordance with the provisions of the Act;

(o) to encourage and promote co-curricular activities for personality development of the faculty, students and employees of the University;

(p) to provide for dual degrees vis-à-vis other Universities on reciprocal basis within and outside the country as per instructions of the State Government, Government of India and University Grants Commission;

(q) to make such provisions for integrated courses in different disciplines in the educational programmes of the University;

(r) to set up Colleges, institutions, off-campus centres, off-shore campus and study centres, as per the instructions issued by the State Government, Central Government and University Grants Commission from time to time;

(s) to receive donations, gifts and grants and to acquire hold, manage and dispose of any property, movable or immovable, including trust or endowed property within or outside Himachal Pradesh for the purpose and objects of the University and to invest funds in such manner as the University thinks fit;

(t) to prescribed the fee structure for various courses from time

to time as per provisions of the Act;

(u) to demand and receive payments of such fees and other

charges as may be specified from time to time;

(v) to seek collaborations with other institutions on mutually

acceptable terms and conditions;

(w) to determine salaries, remunerations, honoraria to faculty and employees of the University in accordance with the norms, specified by the University Grants Commission and other regulatory bodies;

(x) to regulate and enforce discipline among students and employees of the University and to take such disciplinary measures as may be deemed necessary;

(y) to implement Right to Information Act,2005 in the University

and its affiliating Institutes/Colleges;

(z) to implement Himachal Pradesh Educational Institutions (Prohibition of Ragging) Act, 2009 in affiliating Institutes/ Colleges;

(za) to establish and maintain linkage with industry and to promote interaction and enter into collaborative agreement with other Universities, research instructions and learned societies and industries around the world in matter that relates to the furtherance of the objective of the University;

2531 (zb) to promote creation of higher skilled manpower capable of contributing towards national development in general and development of industry based on modern technology in particular;

(zc) to take appropriate measures for maintenance of standards

and enhancement of quality in higher education;

(zd) to withdraw or to cancel degrees or other academic distinctions under such conditions as may be prescribed by statutes and after giving the person affected a reasonable opportunity to present his case;

(ze) to prescribe, subject to provisions of this Act, the terms and conditions of service, including the rules of conduct and discipline, and the emoluments for the posts of officers and employees of the University;

(zf) to acquire, hold and dispose of property, movable or immovable and to make grants and advances for furthering its objects;

(zg) to accept and administer gifts, endowments and to make

grants and advances for furthering its objects;

(zh) to accept grants and to raise loans or to accept loans from Central or any State Government or the University Grants Commission, and also from other resourses;

(zi) to make appropriate measures for creation of an independent

financial base of the University;

(zj) to create fund out of donations and contributions from private sources with attendant obligations and engagements not inconsistent with the objects or standing of the University;

(zk) to prescribe fees or other charges for examination and other purposes and to demand and receive the fees or other charges so prescribed;

(zl) to make arrangements for promoting health and general welfare of the students and the employees of the University;

(zm) to co-operate with any other University in and outside the country, authority or any public or private body having in view the promotion of purpose and objects similar to those of the University for such proposes as may be agreed upon, on such terms and conditions as may, from time to time, be specified;

(zn) to provide for the printing of question papers and other

works, which may be required by the University; and (zo) to do all such things as may be necessary, incidental or conducive to the attainment of all or any of the objects of the University.

Territorial exercise of the powers.

6. (1) The territorial limits in which the University shall exercise powers and perform its duties shall be the whole of the State of Himachal Pradesh and other regions outside the State of Himachal Pradesh as may be decided by the Board of Governors from time to time subject to any regulation and statutes.

(2) Notwithstanding anything contained in any other law for the time being in force, any College imparting technical education and situated within the limits of the area specified under sub-section (i) shall, with effect from such date, as may be notified in this behalf by the State Government, be deemed to be associated with and admitted to the privileges of the University and shall cease to be associated in any way with, or be admitted to any privileges of, the Himachal Pradesh University, Shimla:

Provided that any student of any such College affiliated to the Himachal Pradesh University, Shimla before the said date, who was studying for any degree or diploma examination of the said University shall be permitted to complete his course in preparation thereof and the University shall hold for such students examination in accordance with the curricula of study in force in those Universities for such period, as may be prescribed by regulations:

2533 Provided further that such student may, until any such examination is held by the University, be admitted to the examination of the said Universities and be conferred the degree, diploma or any other privileges of those Universities for which he qualifies on the result of such examination.

7. (1) No person shall be excluded from any office of the University or from membership of any of its authorities or from admission to any degree, diploma or other academic distinction or course of study on grounds only of religion, race, caste, sex, place of birth or any of them:

University open to all irrespective of religion, race, caste, sex or place of birth.

Provided that the University may maintain any College exclusively for women either for education or residence or, reserve for women or members of classes and communities which are educationally backward for purposes of admission as students in any College.

(2) It shall not be lawful for the University to impose on any person any test whatsoever relating to religion, race, caste, sex, place of birth in order to entitle him to hold any post or any office in the University or to enjoy or exercise any privileges of the University or benefactions thereof.

8. The University shall have power to affiliate or otherwise as Power of affiliation.

9. The following shall be the officers of the University, namely:— Officers of the University.

(a) The Chancellor;

(b) The Vice-Chancellor;

(d) The Finance Officer; and

(e) Such other persons as may be declared by the statutes to be

the officers of the University.

(2) The mode of appointments, terms and conditions of service and the functions of the officers of the University, other than the Chancellor, the Vice-Chancellor and the Registrar, shall be prescribed by regulations in so far as they are not provided herein.

T h e Chancellor.

10. (1) The Governor shall, by virtue of his office, be the Chancellor of the University. He shall be the head of the University and the President of the Executive Council and shall, when present, preside over the meeting of the Executive Council.

(2) The Chancellor shall exercise such powers as may be

conferred on him by or under the provisions of this Act.

(3) Where power is conferred upon the Chancellor to make nominations to any authority or body of the University, the Chancellor shall, to the extent necessary, nominate persons to represent interest not otherwise adequately represented.

(4) Every proposal to confer any honorary degree shall be

subject to confirmation by the Chancellor.

T h e Vice-

Chancellor.

11. (1) The Vice-Chancellor shall be appointed by the Chancellor from amongst distinguished persons in the field of technical education on the advice of the State Government from the panel of persons recommended by the Board of Governors through a Committee to be nominated by the Board of Governors:

Provided that the first Vice-Chancellor of University shall be appointed for a period of three years or till he attains the age of 65 years, whichever is earlier, and shall, subject to the provisions of this section, be eligible for re- appointment for a further period not exceeding three years by the State Government to manage the day to day affairs of the University.

(2) The Vice-Chancellor shall be whole time officer of the University and shall be paid from the University fund such salary and allowances as the Chancellor may decide in consultation with the State Government and Finance Department.

(3) The Chancellor shall determine the amount of remuneration

and other conditions of service of the Vice-Chancellor:

Provided that terms and conditions of service shall not be altered to

the disadvantage of the Vice-Chancellor during the term of office.

2535 (4) In case of illness or absence or leave of the Vice-Chancellor or in any other contingency, Registrar shall act as Vice-Chancellor of the University.

(5) The Vice-Chancellor shall be Principal Executive and academic officer of the University and shall exercise general control over its affairs in accordance with the regulations and give effect to the decisions of the authorities of the University.

(6) It shall be the duty of the Vice-Chancellor to ensure that the provisions of the Act and the regulations are strictly observed and he shall have all powers necessary for this purpose.

(7) If, in the opinion of the Vice-Chancellor, an emergency has arisen which requires immediate action to be taken, the Vice-Chancellor shall take such action as he deems necessary and shall report the same for confirmation at the next meeting to the authority, which in the ordinary course, would have dealt with the matter:

Provided that where any such action taken by the Vice-Chancellor is not approved by the authority concerned he may refer that matter to the Chancellor whose decision thereon shall be final:

Provided further that where any such action taken by the Vice- Chancellor affects any person in the service of the University, such person shall be entitled to prefer, within thirty days from the date on which he receives notice of such action, an appeal to the Board of Governors.

(8) The Vice-Chancellor shall exercise such other powers as

may be prescribed by the regulations or statutes.

Powers and functions of the Vice- Chancellor.

12. (1) The Vice-Chancellor shall, in the absence of the Chancellor, preside over the meeting of the Executive Council. He shall, by virtue of his office, be a member and the Chairman of the Board of Governors and the Academic Council for post-graduate and undergraduate studies and also the Chairman of any other authority or body of the University of which he may be member, but shall not be entitled to vote thereat.

(2) The Vice-Chancellor shall have the powers to convene meeting of the Executive Council, the Board of Governors and of any other authorities or body of the University.

(3) The Vice-Chancellor shall have the power to exercise general control and supervisions over all others officers of the University and over all teachers and employees of the University and generally over all the affairs of the University.

(4) The Vice-Chancellor shall exercise such other powers, and discharge such other duties, as may be delegated to him by any authority or body of the University.

(5) The Vice-Chancellor may take on behalf of the University such action as he may deem expedient in any matter which in his opinion, is either urgent or of an emergent nature and shall report the same for confirmation at the next meeting of the authority or body which, in the ordinary course, would have dealt with the matter:

Provided that if the action taken by the Vice-Chancellor is not approved by the authority or body concerned, the matter shall immediately be referred to the Chancellor whose decision thereon shall be final.

The Registrar.

13. (1) The Registrar shall be whole time officer of the University and shall be appointed by the Board of Governors, on the recommendation of a committee consisting of the Vice-Chancellor as Chairman, a nominee of the Chancellor, two nominees of the Board of Governors and a nominee of the State Government, for a period of three years which may be extended by another term of three years.

(2) The term and conditions of service of the Registrar shall be

such as may be determined by the Board of Governors.

(3) The Registrar shall be ex-officio-Secretary of the Board of

Governors and the Academic Council.

14. The Registrar shall—

(a) be custodian of the records, common seal and such other property of the University as the Board of Governors may commit to his charge;

2537 (b) keep the minutes of all the meetings of the Board of Governors

and the Academic Council;

Governors and the Academic Council;

(d) arrange for and superintend the examination of the University;

(e) supply to the Chancellor copies of the agenda of the meetings of the authorities of the University as soon as they are issued and minutes of the meetings of the authorities ordinarily within a month of holding of the meetings; and

(f) perform such other duties as may, from time to time, be assigned to him by the Vice-Chancellor or the Board of Governors of the University.

The Finance Officer.

15. (1) The Finance Officer shall be a whole time officer of the University and shall be appointed by the Board of Governors, on the recommendation of a Committee consisting of Vice-Chancellor as the Chairman, two nominees of the Board of Governors, a nominee of the Chancellor and a nominee of the State Government, for a period of three years which may be extended by another term of three years.

(2) The terms and conditions of service of the Finance Officer

shall be such as may be determined by the Board of Governors.

(3) He shall, subject to the supervision, direction and control of the Vice-Chancellor and the Board of Governors, be in charge of administration of the funds, the finance, and the properties and assets of the University and of all trusts and endowments.

(4) He shall have special interest in the activities that aim at raising

funds of the University and augmenting the resources of the University.

(5) He shall, subject to the provisions of this Act, have the power of supervision and control over all officers and employees serving in departments under his charge and shall exercise such disciplinary powers as may be conferred on him by or under this Act.

CHAPTER—III

AUTHORITIES OF THE UNIVERSITY

16. The following shall be the authorities of the University,

namely:—

Authorities of the University.

(a) Executive Council;

(b) Board of Governors;

(d) Finance Committee;

(e) Selection Committee; and

(f) Such other authorities as may be established under the

statutes.

17. (1) The Executive Council shall consist of the following

members, namely:—

Vocational & Industrial Training;

(i) One nominee of University Grants Commission;

(j) One nominee of All India Council for Technical

Education;

(k) Two Members of the Himachal Pradesh Legislative Assembly, elected by the Members of the Himachal Pradesh Legislative Assembly;

(l) Two Professors respectively one each from National Institute of Technology Hamirpur and Himachal Pradesh University, Shimla;

(m) Two members elected by the members of the non- teaching staff of the University from amongst themselves;

(n) Two members elected by the officers and the supervisory staff of the University from amongst themselves;

(o) Three persons to be nominated by the State Government to secure the representations of the professional, industrial, scientific, technical, academic and other learned societies;

(p) Two persons to be nominated by the Chancellor;

and

(q) One elected member from the employees of the

University by election.

(2) All elections to the Executive Council shall be held in the

manner prescribed by the statutes.

18. The Executive Council shall have the following powers and

functions, namely:—

(a) to consider the annual report as prepared by the Board of Governors and to pass such resolution relating thereto as may be considered necessary;

(b) to consider and advise on such other reports from the Board of Governors or any other body as may be placed before it;

(c) to consider, and advise on, proposals from the Board of Governors for co-operation and collaboration with other Universities, institutions and educational authorities in matters that relate to or further the academic objectives of the University;

(d) to consider the Annual Statement of Accounts and the Annual Financial Estimates approved by the Board of Governors and to pass such resolutions relating thereto as may be considered necessary:

Provided that for the purpose of passing the resolution, modifying or rejecting any such Annual Financial Estimates, it shall be necessary for a majority of the total number of members of the Executive Council existing at the time to vote in favour of the resolutions;

(e) to consider and suggest measures for the improvement of the administration and finances of the University, and generally for the furtherance of its objectives;

(f) to establish departments, engineering colleges, polytechnics and centres of multidisciplinary research, libraries, laboratories, workshops and museums for study and research;

2541 be necessary for the establishment of University, centres, and libraries;

(h) to institute fellowship, scholarship, studentship, stipend, bursaries, exhibitions, medals and prizes to be awarded out of the University Fund;

(i) to institute degree, diploma, certificates and other academic

distinction on person who—

(i) have pursued prescribed courses of studies or have been exempted therefrom in the manner prescribed, and have passed such examination as may be prescribed; or

(ii) have carried on research in accordance with such

conditions as may prescribed;

(j) to withdraw or to cancel degree, diploma, certificates and other academic distinction under such conditions as may be prescribed by statutes and after giving the person affected a reasonable opportunity to present his case;

(k) to confer honorary degree and other academic distinctions;

(l) to make rules for the transaction of its own business; and

(m) to exercise all other powers and perform all other functions conferred and imposed on the Executive Council by or under this Act.

Meeting of the Executive Council.

19. (1) The Executive Council shall meet at least thrice in a financial year, other than for convocation, on dates to be fixed by the Vice- Chancellor. One of such meetings shall be held before March and shall be called the Annual Meeting. The Executive Council may also meet at such other times as it may, from time to time, decide.

(2) One third of the total number of members of the Executive

Council shall be quorum for a meeting of the Executive Council:

Provided that such quorum shall not be required at a convocation

meeting.

(3) The Vice-Chancellor may, where he thinks fit, and shall, upon a requisition in writing signed by not less than fifty per cent of the total number of members of the Executive Council, convene a meeting of the Executive Council . A meeting on such requisition shall be held fifteen days of the receipt of the requisition by the Vice-Chancellor.

20. (1) The Board of Governors shall consist of a Chairman,

(2) The Chairman of the Board of Governors shall be appointed by the Chancellor out of a panel of persons of national eminence in the field of Industry, Technology or Technical Education on the recommendation of the outgoing Chairman of the Board of Governors:

Provided that the first Board of Governors of the University shall be

appointed by the State Government.

(3) The term of appointment of the Chairman of the Board of Governors shall be for a period of three years and he shall be eligible for re- appointment for another term for the same period.

(4) The Chairman of the Board of Governors shall ordinarily preside over the meetings of the Board of Governors and the convocation of the University in the absence of the Chancellor.

(5) The Chancellor shall appoint the following members of the Board of Governors for a period of three years and they shall be eligible for re-appointment for another term of the same period, namely:—

(i) Ex-Officio members:

(a) Vice-Chancellor, Himachal Pradesh University

Shimla;

(b) Vice-Chancellor, Chaudhary Sarwan Kumar Himachal Pradesh Krishi Vishwavidyalaya (CSKHPKV) Palampur;

2543 (c1) Director of Indian Institute of Technology, Mandi;

(d) Secretary to Government of Himachal Pradesh, Department of Technical Education, Vocational and Industrial Training;

(e) Director, Technical Education, Vocational and

Industrial Training;

(f) Secretary (Finance) to the Government of Himachal

Pradesh; and

(g) Chairman of the North-West Committee, All India

Council for Technical Education, Chandigarh.

(ii) Nominated members:

(a) one member from the eminent industrialists;

(b) two eminent technologists; and

Provided that the Chancellor may, on the recommendations of the Vice-Chancellor, cancel membership of any person who ceases to hold office by virtue of which he became such a member.

(6) When a vacancy occurs in the Board of Governors by resignation or death of a member or otherwise, the vacancy shall be filled in the manner provided by the Act:

Provided that the person who fills such vacancy shall hold office for the unexpired period of the term for which the person in whose place he becomes a member would have otherwise continued in office.

(7) The Board of Governors shall be the supreme authority of the University and shall have the following powers and functions, namely:—

(a) to superintend and control affairs of the University;

(b) to recommend to the Chancellor, the appointment of the Vice-Chancellor from a panel of not less than three and not more than five persons of eminence from the fields of Industry/ Technology/Technical Education, as prepared by a high- level "Committee" comprising three persons of eminence in the field of Industry/Technology/ Technical Education;

service of the Vice-Chancellor;

(d) to approve academic programmes;

(e) to frame and approve rules and regulations of the University;

(f) to create Departments/Centre/Colleges/Academic Council

for running various academic programmes;

(g) to create faculty and staff positions in University;

(h) to approve the University budget;

(i) to administer and control the funds of the University and to

authorize the opening and operation of Bank Account;

(j) to accept, transfer and otherwise control the moveable,

immoveable and intellectual property of the University;

(k) to decide upon the form and use of common seal of the

University;

(l) to appoint such committees as may be required for the efficient

functioning of the University;

(m) to approve the emoluments and terms and conditions of service of the faculty and staff of the University; and

(n) to approve the emoluments and terms and conditions of

service on contract.

2545 (8) An annual meeting of the Board of Governors shall be held on a date to be fixed by the Vice-Chancellor in consultation with the Chairman of the Board of Governors. In such annual meeting report of working of University during the previous year together with the statement of the receipts and expenditure, the balance sheet and financial estimates shall be presented.

(9) Special meeting of the Board of Governors may be convened

by the Chairman of the Board of Governors as and when necessary.

(10) The member of the Board of Governors shall be entitled to such allowances, if any, and the sitting fee from the University as may be provided in the regulations.

Academic Council.

21. (1) The Academic Council shall be the academic body of the University and shall, subject to the provisions of this Act and regulations have control and general regulations and be responsible for the maintenance of standard, instructions, education and examination within the University and shall exercise such other powers and perform such other duties as may be conferred or imposed upon it by regulations. It shall have the right to advise the Board of Governors on all Academic matters.

(2) The Academic Council shall consist of the following members,

namely:—

(a) Vice-Chancellor, — Chairman;

(b) Dean, — Member;

(d) One Heads of Department or one — Member; and

Professor of each department of Government Colleges, to be nominated by the Principal,

(e) Eminent Industrialist, — Member:

Provided that the term of nominated members shall be three years.

22. (1) The Finance Committee shall consist of the following

on all financial matters and shall have the powers,—

(a) to examine the annual accounts of the University and to advise

the Board thereon;

(b) to examine the annual budget estimates and to advise the

Board;

(d) to review the financial position of the University; and

(e) to make recommendations to the University on all matters

relating to the finances of the University.

2547 23. (1) The Selection Committee shall consist of,—

Functions of the Selection Committee.

24. (1) The Selection Committee shall make its recommendations to the Executive Council in the matters of selection of persons for appointment of officers and employees of the University and also provide for procedure and method of such selections.

(2) If the Executive Council does not accept the recommendation of Selection Committee, it shall refer the recommendation back to it with reasons for reconsideration and if the Executive Council does not accept the reconsidered views of the Selection Committee, the matter shall be referred to the Chancellor with reasons, and the decision of the Chancellor thereon shall be final.

25. (1) Every officer and employee of the University shall, on appointment as such, be provided with a letter of appointment containing such terms and conditions of appointment as may be prescribed.

Letter of appointment of officers and employees.

(2) An officer or an employee appointed against a permanent vacancy shall be on probation ordinarily for a period of one year from the date of such appointment and such period of probation may at the discretion of the appointing authority of the University, be extended for a further period not exceeding one year. probationer's work is not considered satisfactory, the probationer shall be discharged by the authority concerned.

(3) On satisfactory completion of the period of probation, a teacher or an officer or an employee, as the case may be, shall be confirmed with effect from the date of his appointment on probation by an order in writing made by the University in this behalf and the fact of such confirmation shall be communicated to the person concerned:

Provided that if, on completion of the period of probation, no such order of confirmation is made and communicated to the person concerned within a period of two months of the completion of the period of probation, the person concerned shall be deemed to have been confirmed with effect from the date of his appointment on probation.

Termination of service of temporary officer or employee.

26. The services of a temporary officer or employee shall not be terminated before the expiration of the period for which he is appointed, except after serving one month's notice or paying him one month's salary in lieu thereof.

Disputes.

27. If any question arises whether any person has been duly appointed or elected as, or is entitled to be, a member of any authority or other body of the University, the matter shall be referred to the Chancellor whose decision thereon shall be final.

CHAPTER—IV

GENERAL PROVISIONS GOVERNING ALL AUTHORITIES AND OTHER BODIES OF THE UNIVERSITY

Disqualifi- cations.

28. No person shall be qualified for election or nomination as a member of any authority or body of the University or shall continue as such member if he,—

2549 (b) is un-discharged insolvent; or

moral turpitude.

29. Notwithstanding anything contained elsewhere in this Act, no person shall, if he is a member of non-teaching staff/employee, not appointed on a regular scale of pay or not holding any whole time non- teaching post, be entitled to be enrolled as a voter for, or to cast his vote at, an election to any authority or body of the University or to be nominated to any such authority or body.

Part time non-teaching staff/ employee not to be entitled to be enrolled as voter or to be nominated.

Explanation.—"regular scale of pay" shall mean pay which, subject to any condition prescribed by the University rises by periodical increments from a nomination to a maximum.

Term of office of members.

30. (1) Elected or nominated member of any authority or body of the University shall hold office for a period of four years from the date of his election or nomination, as the case may be:

Provided that in respect of the first elections or nominations under this Act, the said period of four years shall commence from the date of the first meeting of the authority or body held after such elections or nominations.

(2) The term of office of members other than ex-officio-members of any authority or body of the University shall be held to include any period which may elapse between the expiry of the said term and the date of election of new members to such authority or body to fill vacancies arising by efflux of time:

Provided that when elections are held on more than one date, the last of such dates shall be taken to be the date of election for the purposes of this section.

(3) Any member elected or nominated to fill a casual vacancy shall hold office for the unexpired period of the term of office of the member in whose seat he is so elected or nominated.

Cessation of membership in certain cases.

31. (1) When a person is qualified to be a member of any authority or body of the University by virtue of his membership of any other authority or body, he shall cease to be a member of the authority or body of 2550 राजपत्र, हिमाचल प्रदेश, 30 जुलाई, 2010/8 श्रावण, 1932

the University when he ceases to be member of such other authority or body.

(2) When a person is elected or nominated as a member of any authority or body of the University from any constituency, he shall cease to be such a member when he ceases to belong to that constituency.

Filling up of vacancies.

32. (1) Any casual vacancy among the elected members of any authority or body of the University shall be filled up, in such manner and within such time, as may be prescribed, by election by such authority or body of a person representing the interest which the member, whose seat has become vacant, represented.

(2) Any vacancy among the nominated members of any authority or body of the University shall be filled up, within such time as may be prescribed, by nomination by the person or authority that nominated the member whose seat has become vacant.

(3) Vacancies arising by efflux of time in the seats of elected members of any authority or body of the University shall be filled up by election to be held on such date or dates, not later than six months or such extended period as the Chancellor may, by order made in this behalf, specify, from the date on which the vacancies arise, as the Vice-Chancellor may fix.

33. No Act or proceedings of the University or of any authority or body of the University shall be deemed to be invalid merely by reason of the existence of a vacancy or vacancies among its members or the invalidity of the election of any of the members.

Proceedings of the University or the authorities or body of the University not to be invalidated by vacancies.

Explanation.—For the avoidance of doubt it is hereby declared that where the office of any member of any authority or body of the University cannot be filled up, when such authority or body is constituted for the first time, on account of any election or appointment not being for any reason feasible, there shall be deemed to be a vacancy in the office of such member until such election takes place or such appointment is made.

Election Tribunal.

34. (1) There shall be an Election Tribunal to which shall be referred any question that may arise as to whether any person is eligible for election or nomination or has been duly elected or nominated as, or is entitled to be a member of any authority or body of the University, and the decision of the Election Tribunal on such question shall be final.

(2) The constitution of the Election Tribunal shall be such as

may be prescribed by the statutes.

(3) If, during the progress of any election of members to any authority or body of the University, the Election Tribunal is satisfied that such election is vitiated by fraud or corrupt practices, the Election Tribunal may make an order annulling the proceedings in respect of such election or any part thereof and directing fresh proceedings to be started, in accordance with the provisions of this Act and the statutes, and the regulations made there under from such stage as may be specified in the order, and such order of the Election Tribunal shall be final.

(4) No suit or other legal proceedings shall lie in any civil court

against a decision or an order of the Election Tribunal.

Casting Vote by the Chairman.

35. At a meeting of the Executive Council, the Board of Governors, the Councils or any other authority or body of the University, the person presiding at the meeting shall not vote in the first instance, but shall have and exercise a casting vote in the case of an equality of votes.

CHAPTER—V

FUNDS OF THE UNIVERSITY, ACCOUNTS, AUDIT AND INSPECTION

T h e University Fund.

36. (1) The University shall have a fund to be known as the University Fund to which shall be credited all its income from fees, fines, contributions, donations, loans and advances and from any other source whatsoever.

(2) The University may also create by or under this Act separate special funds for the administration of endowments, trust or specific grant or grants for other special purposes.

General limitations on financial powers of the University.

37. (1) The budget of the University showing the receipt and expenditure of the University on different accounts for a financial year shall be submitted to the State Government for approval at least four months before the beginning of such financial year in such form as may be specified by the State Government.

(2) The State Government shall, at least two months before beginning of the financial year to which the budget relates, communicate its approval or otherwise of the budget to the University:

Provided that the State Government shall release grants to the

University to incur expenditure till the budget is approved.

(3) Notwithstanding anything to the contrary contained in this Act, the University shall not, except with the prior approval of the State Government, incur any expenditure on any account to excess of the amount specified in the budget on that account:

Provided that no such prior approval shall be necessary in respect of any expenditure on any scheme not provided in the budget, if such expenditure is met by the University out of its own resources.

Contributory Provident Fund.

38. Any Contributory Provident Fund instituted by the University for the benefit of its teachers, officers or employees shall be governed by the provisions of the Provident Funds Act, as if such fund were a Contributory Provident Fund and the Executive Council shall have power to frame rules, not inconsistent with the provisions of that Act, for the administration of the fund.

Inspection.

39. (1) The State Government shall have the right to cause an

inspection, to be made by such person or persons as it may direct,—

(a) of the University, its buildings, laboratories, libraries, museums, press establishments, workshops and equipments;

2553 (b) of any college or institution maintained by, or affiliated to,

the University;

(c) of all affairs of the University, and of such other work, conducted or done by the University or the institution; and

(d) of any income, expenditure, properties, assets and liabilities of the University, and of any College or institution maintained by or affiliated to the University.

(2) The State Government shall, in every such case of inspection or enquiry, give previous notice to the University, or to such College or institution, of its intention to cause such inspection or enquiry.

(3) The State Government shall communicate to the Executive Council or to such College or institution, as the case may be, its views on the results of such inspection or enquiry, and may, after considering the opinion of the Executive Council or of such College or institution, thereon, advise the University or such College or institution regarding the action which the State Government considers fit to be taken by the University or such College or institution in the matter concerned and the University or such College or institution shall report to the State Government within such time as the State Government may direct the action which is proposed to be taken by the University to give effect to such advise of the State Government.

(4) The State Government may, after considering the report referred to in sub-section (3), advise the University or such College or institution, as the case may be, to take such further action in the matter concerned, as may, in the opinion of the State Government, be necessary, and the University or such College or institution shall take or cause to be taken such further action within such time as may be specified in that behalf by the State Government.

CHAPTER—VI

STATUTES, ORDINANCES AND REGULATIONS

Statutes.

40. Subject to the provisions of this Act, statutes may provide

for all of any of the following matters, namely:—

(a) the declaration of posts as posts of officers of the University;

(b) the establishment of authorities of the University;

(c) the constitution, powers and duties of the authorities of the University in so far as these have not been specifically provided for in this Act;

(d) the powers, duties, and terms and conditions of service of the officers of the University in so far as these have not been specifically provided for in this Act;

(e) the rules and procedure for holding elections to the Executive Council and other authorities and bodies of the University;

(f) the appointment of officers and employees of the University, their emoluments, duties and terms and conditions of service in so far as these have not been specifically provided for in this Act;

(g) the holding of convocations to confer degrees, titles, diplomas, certificates and other academic distinctions including honorary degrees and distinctions; and

(h) All other matters which under this Act are required to be, or

may be, prescribed by statutes.

41. (1) The Executive Council may, make statutes or may amend or repeal the statutes in the manner hereinafter provided in this section:

Power to make statutes.

Provided that the Executive Council shall not make any statutes or any amendment of a Statute affecting the status powers or constitution of any existing authority of the University, until such authority has been given an opportunity of expressing an opinion on the proposal, and any opinion so expressed shall be in writing and shall be considered by the Executive Council.

(2) Every statute or addition to the statutes, or any amendment or repeal, of the statutes, shall require the approval of the Chancellor, who may assent thereto or withhold assent or remit to the Executive Council for reconsideration with his suggestions. In case the Executive Council passes it again in the same form and manner and if the Chancellor is satisfied that it is राजपत्र, हिमाचल प्रदेश, 30 जुलाई, 2010/8 श्रावण, 1932

2555 not in the interests of the University, he may disallow such statutes, amendment or repeal.

(3) A new statute or a statute amending or repealing an existing statute shall have no validity unless it has been assented to by the Chancellor.

Ordinances.

42. (1) Subject to the provisions of this Act and the statutes,

ordinances may provide for all or any of the following matters, namely :—

(a) the admission of students to the University and the Colleges

and their enrolment as such;

(b) the conditions of residence and rules of discipline of the students of the University and the Colleges and the levy of fees for residence in halls;

(c) the appointment of officers and employees of the University, their emoluments, their duties and other terms and conditions of their service, in so far as these have not been specifically provided for in this ordinance or in the statutes;

(d) the registration of students;

(e) the appointment, duties and remuneration of examiners, paper setters, scrutineers and such other persons as are related to examination;

(f) the institution of Provident Fund or other funds for the benefit

of the teachers, officers and employees of the University;

(g) the establishment, maintenance and management of University libraries, examination halls and other University institutions;

(h) the recognition of libraries, hostels, and institutions for study, research and residence, other than those established, maintained and managed by the University;

(i) the imposition and collection of fees, fines and other dues

payable to the University;

(j) the duties and functions of the officers of the University

including the Heads of the Departments;

(k) the administration of gifts, endowments and benefications;

(l) the institution and award of fellowships, traveling fellowships, scholarships, studentships, stipends, bursaries, exhibitions, medals and prizes;

(m) the procedure for accepting grants and for raising or accepting loans other than loans from the Central or any State Government or the University Grants Commission;

(n) All other matters which under this Act or the statutes are required to be or may be prescribed by ordinances.

(2) The ordinances shall be made by the Executive Council and the ordinances so made may be amended, repealed or added to at any time by the Executive Council in the manner prescribed by the statutes.

(3) The amendments or the repeal of the ordinances under sub- section (2) shall have no validity unless it has been assented to by the Chancellor in consultation with the State Government.

Regulations.

43. (1) The Executive Council may, with the sanction of the Chancellor, make regulations consistent with this Act, the statutes and the ordinances for all matters relating to the University.

(2) In particular and without prejudice to the generality of the foregoing powers, such regulations may, in relation to the authorities of the University, provide for,—

(a) laying down the procedure to be followed at their meeting and number of members required to form quorum;

(b) all matters which by this Act, the statutes, or the ordinances

are to be provided by the regulations;

2557 (c) any other matter solely concerning any authority and not

provided by this Act, the statutes and the ordinances; and

(d) the giving of the notice to its members of the dates of the meetings and the business to be transacted there at and for the keeping of the record of the proceedings of such meeting.

44. (1) The State Government may, by notification in the Official Power to make Rules.

Gazette, make rules to carry out the provisions of this Act.

(2) Rules made under sub-section (1) shall be subject to the

condition of previous publication in the Official Gazette.

(3) Every rule made under this Act shall be laid, as soon as may be after it is made, before the Legislative Assembly, while it is in session for a total period of ten days which may comprise in one session or in two or more successive sessions and if, before expiry of the session in which it is so laid or the successive sessions, aforesaid, the Legislative Assembly agrees in the making any modification in the rule or agrees that the rules should not be made, the rule shall, thereafter have effect only in such modified form or be of no effect, as the case may be, so, however, that any such modification or annulment shall be without prejudice to the validity of anything previously done under the rule.

CHAPTER—VII

MISCELLANEOUS AND TRANSITORY PROVISIONS

Delegation.

45. (1) The Vice-Chancellor may, subject to the provisions of this Act, delegate such powers or duties conferred or imposed by or under this Act as may be prescribed by the statutes to an officer of the University under his direct administrative control.

(2) Subject to the provisions of this Act,—

(a) the Executive Council may delegate any of its powers or

duties, conferred or imposed by or under this Act to—

(ii) a committee constituted from amongs its own

members ; or

(iii) a committee appointed in accordance with the

statutes.

(b) The Finance Committee may delegate any of its powers or

duties, conferred or imposed by or under this Act to—

(i) the Vice-Chancellor; or

(ii) a committee constituted from amongst its own

members.

46. The conditions of affiliation of a college shall be such as may

be prescribed.

Conditions for affiliation.

Examinations and admissions.

47. Students shall be eligible for admission to the various courses of study instituted by the University and shall be admitted to examinations for various degrees, diplomas, certificates and other distinctions as may be prescribed.

48. (1) The regulations of University shall be made by the State

Government and notified in the Official Gazette.

Making amendment, repeal and operations of regulations.

(2) The Board of Governors may, from time to time, make new

or additional regulations or may amend or repeal the regulations:

Provided that the Board of Governors shall not propose the draft of amendment of the regulations affecting the status, powers, constitution of any existing authority of the University until such authority has been given an opportunity of expressing an opinion upon the proposal and any opinion so expressed shall be in writing and shall be considered by the Board of Governors.

2559 (3) Every new regulation or addition to the regulations or any amendment or repeal of a regulation shall require the approval of the Board of Governors who may approve, disallow or remit it for further consideration.

Annual report.

49. (1) The annual report of the University shall be prepared and submitted to the Board of Governors for approval at its annual meeting on or before such date as may be prescribed by regulations.

(2) A copy of the annual report, as submitted to the Board of Governors under sub-section(1), alongwith the observations, if any, made by the Board of Governors thereon, shall be submitted to the State Government, which shall, as soon as may be, cause the same to be laid before the State Legislature.

Annual accounts.

50. (1) The annual accounts and balance sheet of the University shall be prepared under the directions of the Executive Council and shall, once at least every year and at intervals of not more than fifteen months, be audited by an agency specifically authorised in this behalf by the State Government from time to time.

(2) A copy of the annual accounts together with the audit report, shall be submitted to the State Government, which shall, as soon as may be, cause the same to be laid before the State Legislature.

Disputes about constitution of authorities and bodies.

51. If any question arises whether a person has been duly nominated or appointed or is entitled to be a member of any authority or body of the University, the matter shall be referred to the Chancellor whose decision thereon shall be final.

Powers and duties of the authorities of the University.

52. If any difficulty arises with respect to the establishment of the University or in connection with the first meeting of any authority of the University or otherwise in first giving effect to the provisions of this Act, the State Government may, at any time, before any authority of the University has been constituted, by order, make any appointment or do anything consistent so far as may be with the provisions of this Act, which appears to it necessary or where action had been made or taken in the manner provided in this Act.

Transitory provision.

53. Notwithstanding anything contained in this Act, or in the statutes or ordinances, any student of a College who immediately before the commencement of this Act was studying for a degree, diploma or certificate of the Himachal Pradesh University, Shimla, shall be permitted by the University to complete his course for the degree, diploma, or certificate and the University or the College, as the case may be, shall provide for the instruction of such student in accordance with the prospectus of studies of the Himachal Pradesh University, and he shall be admitted to the examination concerned of the University.

Powers to Remove difficulties.

54. If any difficulty arises in giving effect to the provisions of this Act, the State Government may, by order published in the Official Gazette, make such provisions, not inconsistent with the provisions of this Act as appear to it to be necessary for the purpose of removing the difficulty:

Provided that no such order shall be made after the expiry of two

years from the commencement of this Act.

भूमि अर्जित करनी अपेक्षित है, अतएव एतद्‌द्वारा यह अधिसूचित किया जाता है कि उक्त परिक्षेत्र में जैसा कि निम्न विवरणी में निर्दिष्ट किया गया है, उपरोक्त प्रयोजन के लिए भूमि का अर्जन अपेक्षित है। 2. यह अधिसूचना ऐसे सभी व्यक्तियोेेंं को, जो इससे सम्बन्धित हो सकते हैं, की जानकारी के लिए भू-अर्जन अधिनियम, 1894 की धारा, 4 के उपबन्धों के अन्तर्गत जारी की जाती है।

3. पूर्वोक्त धारा द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए राज्यपाल हिमाचल प्रदेश इस समय इस उपक्रम में कार्यरत सभी अधिकारियों उनके कर्मचारियों और श्रमिकों को इलाके की किसी भी भूमि में प्रवेश करने और सर्वेक्षण करने तथा उस धारा द्वारा अपेक्षित अथवा अनुमतः अन्य सभी कार्र्यों को करने के लिए सहर्ष प्र्राधिकार देते हैं।

4. कोई भी हितबद्ध व्यक्ति जिसे उक्त परिक्षेत्र मेेंं कथित भूमि के अर्जन पर कोई आपत्ति हो तो वह इस अधिसूचना के प्रकाशित होने के तीस (30) दिन की अवधि के भीतर भू-अर्जन समाहर्ता, लोक निर्माण विभाग, मण्डी, हिमाचल प्रदेश के समक्ष लिखित आपत्ति दायर कर सकता है।

2565 Non-Gazetted), presently in the Pay Band of Rs. 10300-34800 + Rs. 3800 Grade Pay, to the post of Section Officer (Class-II-Gazetted) in the Pay Band Rs.10300-34800+Rs.4400 Grade Pay, with immediate effect.

(2) The Governor, Himachal Pradesh is also pleased to promote Shri Anil Kumar (216), Junior Auditor of Local Audit Department presently in the Pay Band of Rs. 10300-34800 + Rs. 3800 Grade Pay, to the post of Section Officer Class-II (Gazetted) in the Pay Band of Rs.10300-34800 + Rs. 4400 Grade Pay, purely on an officiating basis, till further orders.
