संख्संख्संख्संख्यायायायाः टीः टीः टीः टी....पीपीपीपी....टीटीटीटी....-एफ (6)-एफ (6)-एफ (6)-एफ (6)-2/2000-2/2000-2/2000-2/2000....--------प्रारूप संशोधन नियम नामतः हिमाचल प्रदेश मोटर व्हीकलज़ (तृतीय संशोधन) नियम, 2010, मोटरयान अधिनियम, 1988 की धारा 212 के उपबन्धों के अनुसरण में समसंख्यक अधिसूचना तारीख 30-07-2010 द्वारा इनसे सम्भाव्य प्रभावित व्यक्तियों से मोटरयान अधिनियम, 1988 की धारा 212 के अधीन यथा अपेक्षित, इनके प्रकाशन की तारीख से 30 दिन की अवधि के भीतर आक्षेप और सुझाव आमन्त्रित करने के लिए राजपत्र, हिमाचल प्रदेश (असाधारण) में 3-08-2010 को प्रकाशित किए गए थे ।

2222.... नियम 69-ख कानियम 69-ख कानियम 69-ख कानियम 69-ख का प्रतिस्थापनाप्रतिस्थापनाप्रतिस्थापनाप्रतिस्थापना.--हिमाचल प्रदेश मोटर यान नियम, 1999 के विद्यमान नियम 69-ख के स्थान पर निम्नलिखित रखा जाएगा, अर्थात :-

जिस्ट्रीकरण नम्बर (चिन्ह) के आबंटन के लिये विशेष रजिस्ट्रीकरलिये विशेष रजिस्ट्रीकरलिये विशेष रजिस्ट्रीकरलिये विशेष रजिस्ट्रीकरण फीसण फीसण फीसण फीस....----हिमाचल प्रदेश ''''69-ख,69-ख,69-ख,69-ख, रजिस्ट्रीकरण नम्बर (चिन्ह) के आबंटन के जिस्ट्रीकरण नम्बर (चिन्ह) के आबंटन के जिस्ट्रीकरण नम्बर (चिन्ह) के आबंटन के राज्य में, समस्त रजिस्ट्रीकरण एवं अनुज्ञापन प्राधिकारियों द्वारा केन्द्रीय मोटरयान नियम, 1989 के नियम 81 के अधीन मोटरयानों के लिए निम्नलिखित रजिस्ट्रीकरण नम्बरों (चिन्हाें) के आबंटन के लिए रजिस्ट्रीकरण फीस के अतिरिक्त, निम्नलिखित दरों पर विशेष रजिस्ट्रीकरण फीस प्रभारित की जाएगीः-

75,000/रुपए (पचहत्तर हजार रुपए) 1. 0001 2. 0002 से 0009 50,000/रुपए (पचास हजार रुपए) 3. 0010 से 0100 35,000/रुपए (पैंतीस हजार रुपए) 4. 0101 से 9999 20,000/रुपए (बीस हजार रुपए) परन्तु क्रम संख्या 1 से 3 के सामने विनिर्दिष्ट विशेष रजिस्ट्रीकरण नम्बर (चिन्ह) पूर्णतः समादत्त नम्बर होंगे, और पहले आओ पहले पाओ, के आधार पर आबंटित किए जाएंगे । तथापि, जहां किसी विशिष्ट नम्बर के लिए एक से अधिक आवेदन प्राप्त होते हैं, वहां उसे लॉटरी के द्वारा आबंटित किया जाएगा :

परन्तु यह और कि रजिस्ट्रीकरण एवं अनुज्ञापन प्राधिकारी उपयोग न किए गए नम्बरों को राज्य सरकार के स्वामित्व वाले यानों को विशेष रजिस्ट्रीकरण फीस प्रभारित किए बिना आबंटित कर सकेगा :

परन्तु यह और कि क्रम संख्या 4 के सामने विनिर्दिष्ट रजिस्ट्रीकरण नम्बर की दशा में विशेष रजिस्ट्रीकरण फीस, केवल तभी प्रभारित की जाएगी यदि मोटर यान के स्वामी द्वारा क्रम संख्या 4 के सामने विनिदिर्ष्ट रजिस्ट्रीकरण नम्बर में से किसी विशिष्ट राजिस्ट्रीकरण नम्बर के लिए चयन उपदर्शित किया जाता है, ऐसा न होने पर ये चिन्ह क्रमानुसार/कालानुक्रम में, पहले आओ, के आधार पर आबंटित किए जाएंगे । क्रम संख्या 4 के सामने विनिदिर्ष्ट रजिस्ट्रीकरण नम्बर के प्रयोजन के लिए क्रमानुसार/कालानुक्रम रजिस्ट्रीकरण नम्बर 0101 से आगे प्रारम्भ होंगे :-

परन्तु यह और कि यदि कोई मोटर यान दुर्घटनाग्रस्त हो जाता है और बीमा कम्पनी द्वारा सम्यक, रूप से पूर्ण क्षति प्रमाणित की जाती है, तो उक्त मोटर यान के स्वामी से, नए यान हेतु उसी रजिस्ट्रीकरण नम्बर के लिए विहित विशेष फीस संदत्त करनी अपेक्षित नहीं होगी, यदि उसने बीमा कम्पनी द्वारा पूर्ण क्षति के प्रमाण-पत्र को जारी करने की तारीख से छह मास की अवधि के भीतर, नया यान क्रय कर लिया है :-

परन्तु यह और कि स्वामी, अपने यान के विक्रय के पश्चात केवल तभी अपने यान का रजिस्ट्रीकरण नम्बर रख सकेगा, जब विक्रीत यान को राजिस्ट्रीकरण और अनुज्ञापन प्राधिकारी द्वारा नया रजिस्ट्रीकरण नम्बर पुनः आबंटित कर दिया गया हो और पहला (प्राइमरी) नम्बर इस शर्त के अध्यधीन/अभ्यर्पित कर दिया गया कि स्वामी को रजिस्ट्रीकरण नम्बर के छोड़ने/अभ्यर्पित करने की तारीख से, दो मास के भीतर, नया यान रजिस्ट्रीकृत करवाना होगा । रजिस्ट्रीकरण नम्बर को रखे रखने के लिए, पहले स्वामी से कोई विशेष रजिस्ट्रीकरण फीस प्रभारित नही की जाएगी' ।

Shimla-2, the 3rd September, 2010

No. TPT-F(6)2/2000.—Whereas the draft Himachal Pradesh Motor Vehicles (Third Amendment) Rules, 2010 were published in the Rajpatra, Himachal Pradesh on dated 02/08/2010, vide notification of even number dated 30/07/2010 in pursuance of the provision of section 212 of the Motor Vehicles Act, 1988 (Act NO. 59 of 1988) for inviting objections and suggestion from person(s) likely to be affected thereby, within a period of 30 days from the date of publication;

2. And , whereas the Government has considered the objections/suggestions received from general public on the said draft rules.

3. Now, therefore, in exercise of the powers conferred by section 211 of the Motor Vehicles Act, 1988, (Act No. 59 of 1988), the Governor of Himachal Pradesh is pleased to make the following rules, namely:-

1. Short title.—These rules shall be called the Himachal Pradesh Motor Vehicles (Third Amendment) Rules, 2010.

2. Substitution of rule-69-B.—For the existing rule-69-B of the Himachal Pradesh Motor Vehicles Rules, 1999, the following shall be substituted, namely:-

"69-B-Special Registration Fee for allotment of registration marks.—There shall be charged a Special Registration Fee, in addition to the registration fee, prescribed under Rule-81 of the Central Motor Vehicles Rules, 1989, for allotment of the following registration marks to the Motor Vehicles by all Registering and Licensing Authorities in the State of Himachal Pradesh, at the following rates:-

1. 0001 Rs. 75,000/- (Seventy five thousand) 2. 0002 to 0009 Rs. 50,000/- (Fifty Thousand) 3. 0010 to 0100 Rs. 35,000/- (Thirty five thousand 4. 0101 to 9999 Rs. 20,000/- (Twenty Thousand)

Provided that registration marks specified against Sr. No. 1 to 3 shall be totally paid numbers and shall be allotted on first come, first serve basis. However, where more than one application is received for a particular number, the same shall be allotted by draw of lots.

Provided further that the Registering and Licensing Authority may allot unutilized specified marks to the motor vehicles owned by the State Government without charging any special Registration Fee.

Provided further that in the case of registration marks specified against Serial number 4, Special Registration Fee shall be charged only if choice is indicated by the owner of the motor vehicle for any particular registration mark out of the registration marks specified against Serial number 4, failing which these marks shall be allotted on first come first serve basis in seriatum / chronological order. For the purpose of registration marks specified against serial number 4, the seriatum / chronological order shall start from registration marks 0101 onwards.

Provided further that in case of any motor vehicles meets with an accident and is a total loss duly certified by the Insurance Company, the owner of the said motor vehicle shall not be required to pay the special registration fee prescribed for the same registration number for a new vehicles only if he purchased the new vehicle within six month from the date of issuance of total loss certificate by the Insurance Company.

Provided further that the owner may retain the registration mark of his vehicle after the sale or scrapping of old vehicle only when the sold motor vehicle is re-assigned a new registration mark by the Registering and Licensing Authority and the primary number is vacated/ surrendered subject to the condition that the owner has to get the new vehicle registered within two months from the date of surrender/vacation of the registration number. For retaining the registration mark, no special registration fee shall be charged from the primary owner.

केस नं0 4-टी ऑफ 2009.

बनाम

उपरोक्त प्रार्थीगण ने इस न्यायालय मे दावा दायर कर रखा है कि भूमि खेवट/खतौनी नं0 424/502, खसरा नं0 1103, रकबा तादादी 5-18-0 बीघा स्थित फाटी कनौन, कोठी बूगा, उप-तहसील सैंज, जिला कुल्लू पर उनका कब्जा काश्त अरसा 35 सालों से चला आ रहा है। प्रार्थीगण ने अपने प्रार्थना-पत्र/दावा में यह भी वर्णित कर रखा है कि यह भूमि उन्हें प्रत्यार्थी मनमोहन लाल के पिता श्री दीवान चन्द जो अब मृत्यु पा चुका है ने बराए काश्त साैंपी थी तथा कागजात माल में प्रत्यार्थी मालक अराजी दर्ज है। तब से आज दिन तक प्रार्थीगण इस भूमि को लगातार काश्त करते चले आ रहे हैं। इसके अलावा प्रार्थीगण ने अपने प्रार्थना-पत्र/दावा में यह जिक्र भी कर रखा है कि प्रत्यार्थी काफी लम्बे अरसा से जहां भूमि स्थित है में नहीं रह रहा है तथा उसका कोई भी अता-पता नहीं है।

अतः इस इश्तहार द्वारा प्रत्यार्थी एवं आम जनता को सूचित किया जाता है कि वह दिनांक 15-9-2010 को असालतन/वकालतन इस न्यायालय मेें उपस्थित आकर अपना पक्ष एवं एतराज रख सकते हैं। उपरोक्त तिथि पर किसी के न उपस्थित होने की सूरत में उनके खिलाफ एकतरफा कार्यवाही अमल में लाई जाएगी व प्रार्थीगणों के नाम उक्त भूमि की काश्त दर्ज करने बारे अगली कार्यवाही अमल में लाई जाएगी।

आज दिनांक 4-2-2010 को मेरे हस्ताक्षर व मोहर न्यायालय द्वारा जारी किया गया।
