संख्या संख्या संख्या संख्या टीटीटीटी....एसएसएसएस....एम-एफ (6)-3/एम-एफ (6)-3/एम-एफ (6)-3/एम-एफ (6)-3/2009-2009-2009-2009-II.—हिमाचल प्रदेश की राज्यपाल, हिमाचल प्रदेश पर्यटन विकास और रजिस्ट्रीकरण अधिनियम, 2002 की धारा 64 की उपधारा (2) के खण्ड (च) और (छ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, इस विभाग की अधिसूचना संख्या टी.एस.एम-एफ(5)-9/2000 तारीख 10-6-2005 द्वारा राजपत्र, हिमाचल प्र्रदेश में तारीख 8-7-2005 को प्रकाशित हिमाचल प्र्रदेश रीवर राफ्टिंग नियम, 2005 में और संशोधन करने के लिए निम्नलिखित नियम बनाने का प्रस्ताव करती हैं और जिन्हें इसमें सम्भाव्य प्रभावित होने वाले व्यक्तियों की जानकारी के लिए राजपत्र हिमाचल प्रदेश में एतदद्वारा प्रकाशित किया जा रहा है ;

कोई हितबद्ध व्यक्ति जो प्रस्तावित संशोधनों के सम्बन्ध में कोई आक्षेप/सुझाव देना चाहता हो, तो वह उसे (उन्हें) इन प्रारूप नियमों के राजपत्र, हिमाचल प्रदेश में प्रकाशन की तारीख से तीन दिन की अवधि के भीतर निदेशक, (पर्यटन एवं नागरिक उड्‌डयन)/प्रधान सचिव (पर्यटन एवं नागरिक उड्‌डयन) हिमाचल प्रदेश सरकार को भेज सकेगा ;

177-राजपत्र/2011-1-12-2011 (4339) 4340 राजपत्र, हिमाचल प्रदेश, 1 दिसम्बर,, 2011/10 अग्रहायण, 1933 उपर्युक्त विनिर्दिष्ट अवधि के भीतर प्राप्त हुए आक्षेप (आक्षेपों) या सुझाव (सुझावों)े पर, यदि कोई हों, राज्य सरकार द्वारा इन प्रारूप नियमों को अंतिम रूप देने से पूर्व विचार किया जाएगा, अर्थात :-

1111.... संक्षिप्त नामसंक्षिप्त नामसंक्षिप्त नामसंक्षिप्त नाम....----इन नियमों का संक्षिप्त नाम हिमाचल प्रदेश रीवर राफ्टिंग (संशोधन) नियम, 2011 है।

2222.... नियम 2 कानियम 2 कानियम 2 कानियम 2 का ससससंंंंशशशशोधनोधनोधनोधन....----हिमाचल प्रदेश रीवर राफ्टिंग नियम, 2005 के नियम 2 के उपनियम (1) में, खण्ड (झ) के स्थान पर निम्नलिखित खण्ड रखा जाएगा, अर्थातः-

''(झ) ''सीजन'' से, इन नियमों के प्रयोजन के लिए, पन्द्रह जुलाई से पन्द्रह सितम्बर की अवधि, जिसके दौरान कोई भी रीवर राफ्टिंग प्रचालन अनुज्ञात नहीं होगा, को छोड़कर सम्पूर्ण वर्ष अभिप्रेत है;

परन्तु जिला लाहौल एवं स्पीति में एक जून से इक्तीस अक्तूबर के दौरान राफ्टिंग प्रचालन किया जा सकेगा यदि मौसम परिस्थितियां ऐसा करने दें।

NOTIFICAT ON

Shimla-2, the 14 th October, 2011

No.Tsm-F(6)-2/2009-II.—In exercise of the powers conferred by clauses (f) and (g) of subsection (2) of Section 64 of the Himachal Pradesh Tourism Development and Registration Act, 2002, the Governor, Himachal Pradesh proposes to make the following rules further to amend the Himachal Pradesh River Rafting Rules, 2005 published in the Rajpatra Himachal Pradesh on 8-7- 2005 vide this department Notification No.Tsm-F(5)-9/2000 dated 10-6-2005 and the same are hereby published in the Rajpatra of Himachal Pradesh for the information of the persons likely to be affected thereby;

Any interested person who has any objections(s) / suggestion(s) with regard to the proposed amendments, may send the same to the Director (Tourism & Civil Aviation) / Pr.Secretary (Tourism & Civil Aviation) to the Government of Himachal Pradesh within a period of thirty days from the date of publication of the said draft rules in the Rajpatra, Himachal Pradesh;

The Objection(s) or suggestion(s) if any, received within the period specified above shall be taken into consideration by the State Government before finalizing the draft rules, namely :-

1. Short title.—These rules may be called the Himachal Pradesh River Rafting (Amendment) Rules, 2011.

2. Amendment of rule 2.— In sub rule (1) of rule 2 of the Himachal Pradesh River Rafting Rules, 2005 for clause (i), the following clause shall be substituted, namely :—

"(i) "season" for the purposes of these rules means whole of the year excluding the period from 15th July to 15th September during which no river rafting operation shall be permitted.

Provided that rafting operation may be permitted in District Lahaul and Spiti during 1st June to 31st October, if the weather conditions permit to do so."

2. यह अधिसूचना ऐसे सभी व्यक्तियों को, जो इससे सम्बन्धित हो सकते हैं, की जानकारी के लिए भू-अर्जन अधिनियम, 1894 की धारा, 4 के उपबन्धों के अन्तर्गत जारी की जाती है।

3. पूर्वोक्त धारा द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए राज्यपाल, हिमाचल प्रदेश इस समय इस उपक्रम में कार्यरत सभी अधिकारियों उनके कर्मचारियों और श्रमिकों को इलाके की किसी भी भूमि में प्रवेश करने और सर्वेक्षण करने तथा उस धारा द्वारा अपेक्षित अथवा अनुमतः अन्य सभी कार्यों को करने के लिए सहर्ष प्राधिकार देते हैं।

4. कोई भी हितबद्व व्यक्ति जिसे उक्त परिक्षेत्र में कथित भूमि के अर्जन पर कोई आपत्ति हो तो वह इस अधिसूचना के प्रकाशित होने के तीस(30) दिन की अवधि के भीतर लिखित रुप में भू-अर्जन समाहर्ता, लोक निर्माण विभाग (मण्डी क्षेत्र) मण्ड़ी के समक्ष अपनी आपत्ति दायर कर सकता है।

2. ये तुरन्त प्रवृत होंगे ।

2222.... लागू होनालागू होनालागू होनालागू होना....----1. ये नियम हिमाचल प्रदेश राज्य सरकार के समस्त कर्मचारियों जो नियम 4(क) और (ख) में यथा-अधि कथित पात्रता शर्तों को पूर्ण करते हों, लागू होंगे ।

2. ये नियम हिमाचल प्रदेश में निगमों/बोर्डों/स्वायत निकायों/स्थानीय निकायों के उन कर्मचारियों को, जो नियम 4(क) और (ख) में यथा अधि-कथित पात्रता शर्तों को पूर्ण करते हों, लागू होंगे । 3333.... परिभाषाएंपरिभाषाएंपरिभाषाएंपरिभाषाएं....----इन नियमों मेें जब तक सन्दर्भ से अन्यथा अपेक्षित न होः-

(क) ''आयोग'' से जहां कही प्रयुक्त हुआ है, हिमाचल प्रदेश लोक सेवा आयोग अभिप्रेत हैं, (ख) ''विभाग'' से हिमाचल प्रदेश सरकार का वित (कोष, लेखा एवं लॉटरी) विभाग अभिप्रेत है , (ग) ''निदेशक'' से निदेशक, कोष, लेखा एवं लॉटरी विभाग अभिप्रेत है , (घ) ''कर्मचारियों'' से प्रशिक्षण के लिए प्रतियोगी परीक्षा के साथ-साथ अधीनस्थ लेखा सेवा भाग-I और II परीक्षा में बैठने वाले कर्मचारी और हिमाचल प्रदेश सरकार तथा इसके अधीनस्थ कार्यालयों के कर्मचारी तथा निगमों/बोर्डों/स्वायत निकायों/स्थानीय निकायों के कर्मचारी भी अभिप्रेत हैं,

(ङ) ''सरकार'' से हिमाचल प्रदेश सरकार अभिप्रेत है । (च) ''संक्षेपाक्षर'' एच0आई0पी0ए0 (हिपा) से हिमाचल प्रदेश लोक प्रशासन संस्थान, शिमला अभिप्रेत है, और

(छ) ''संक्षेपाक्षर'' एस0ए0एस0 (ओ0बी0) से हिमाचल प्रदेश अधीनस्थ लेखा सेवा (सामान्य शाखा) अभिप्रेत है ।

ाा) प्रवेश परीक्षा के लिए पात्रता....--------(क) (1) इन ेगी अधीनस्थ लेखा सेवा (सामान्य शाख्शाख्शाख्शाखा) प्रवेश परीक्षा के लिए पात्रता 4444.... प्र्रतियाप्र्रतियाप्र्रतियाप्र्रतियोगी अधीनस्थ लेखा सेवा (सामान्य ाा) प्रवेश परीक्षा के लिए पात्रता ाा) प्रवेश परीक्षा के लिए पात्रता ेगी अधीनस्थ लेखा सेवा (सामान्य ेगी अधीनस्थ लेखा सेवा (सामान्य नियमों में विदित अन्य शर्तों के अध्यधीन, कर्मचारियों के निम्नलिखित प्रवर्ग, आयोग द्वारा, अधीनस्थ लेखा सेवा (सामान्य शाखा) प्रशिक्षण के लिए अभ्यार्थियों के प्रारम्भिक चयन हेतु, संचालित की जाने वाली प्रतियोगी परीक्षा में बैठने के लिए पात्र होंगे।

(2) हिमाचल प्रदेश सरकार और निगमों/बोर्डों/स्वायत निकायों/स्थानीय निकायों आदि के अधीन पांच वर्ष का सेवाकाल पूर्ण करने वाले समस्त कर्मचारी, जो किसी मान्यता प्राप्त विश्वविधालय से स्नातक की उपाधि या इसके समतुल्य उपाधि रखते हों।

(ख) प्रतियोगी अधीनस्थ लेखा सेवा (सामान्य शाखा)में बैठने के लिए अधिकतम आयु सीमा 42 (ब्यालीस) वर्ष होगी । 4344 राजपत्र, हिमाचल प्रदेश, 1 दिसम्बर,, 2011/10 अग्रहायण, 1933 टिप्पणटिप्पणटिप्पणटिप्पण....----प्रतियोगी प्रवेश परीक्षा में बैठने के लिए आयु सीमा की गणना, उस वर्ष के प्रथम दिवस से की जायेगी जिसमें कर्मचारियों से आवेदन आमन्त्रित करने के लिए हिमाचल प्रदेश लोक सेवा आयोग द्वारा विज्ञापन जारी किया गया है।

(ग) प्रतियोगी अधीनस्थ लेखा सेवा (सामान्य शाखा) प्रवेश परीक्षा में बैठने वाले अभ्यार्थी (कर्मचारी) विशेष अवकाश के हकदार नहीं होंगे, परन्तु जिसके लिए उन्हें अपने नियोजक से छुटटी लेनी अपेक्षित होगी। (घ) कर्मचारियों को प्रतियोगी लेखा सेवा (सामान्य शाखा) प्रवेश परीक्षा में बैठने के खर्च को स्वयं वहन करना होगा ।

(ड.) अधीनस्थ लेखा सेवा (सामान्य शाखा) भाग-I और II परीक्षा के लिए प्रशिक्षण ले रहे चयनित प्रभिक्षु अभ्यार्थियों को, पचास हजार रूपये की रकम का, इतनी ही रकम की दो प्रतिभ्ूतियों सहित, निदेशक, हिपा को उनके प्रवेश से पूर्व अधीनस्थ लेखा सेवा (सामान्य शाखा) भाग-I और II प्रशिक्षण/परीक्षा को सफलतापूर्वक पूर्ण करने और अर्हित करने के पश्चात, कम से कम पांच वर्ष की अवधि के लिए हिमाचल प्रदेश सरकार की सेवा करने का, बंधपत्र निष्पादित करना अपेक्षित होगा ।

टिप्पणटिप्पणटिप्पणटिप्पण-1-1-1-1.... अंग्रेजी के पेपर का स्तर, किसी मान्यता प्राप्त भारतीय विश्वविधालय की उपाधि की परीक्षा के समतुल्य होगा और हिन्दी पेपर का स्तर मान्यता प्राप्त विश्वविधालय या स्कूल शिक्षा बोर्ड की दस जमा दो की परीक्षा के बराबर या इसके समतुल्य होगा। टिप्पणटिप्पणटिप्पणटिप्पण-2-2-2-2. प्रत्येक पेपर 150 अंकों का होगा (पेपर-I अंग्रेजी 75 अंक, हिन्दी 75 अंक) और उसकी अवधि तीन घन्टें होगी।

टिप्पणटिप्पणटिप्पणटिप्पण-3-3-3-3 परीक्षा का माध्यम, अंग्रेजी होगा, सिवाय पेपर-I के, जिसके लिए परीक्षा का माध्यम भाग-अनुसार अंग्रेजी और हिन्दी दोनों होगें ।

ं बैठने के लिए अवसरों की संख्या....----(क) (1) किसी भी कर्मचारी को, प्रवेश 6666.... प्रवेश परीक्षा मेप्रवेश परीक्षा मेप्रवेश परीक्षा मेप्रवेश परीक्षा में बैठने के लिए अवसरों की संख्या ं बैठने के लिए अवसरों की संख्या ं बैठने के लिए अवसरों की संख्या परीक्षा में बैठने के लिए तीन से अधिक अवसर अनुज्ञात नहीं किए जाएंगे ।

(2) जो अभ्यार्थी प्रशिक्षण पूर्ण करने के पश्चात्‌ आयोजित की गई अधीनस्थ लेखा सेवा परीक्षा में अन्तिम रूप से असफल घोषित किए गए हैं, वे पुनः प्रवेश परीक्षा में बैठने के पात्र नहीं होंगे ।

7777.... प्रशिक्षण के लिए अभ्यार्थियों का चयनप्रशिक्षण के लिए अभ्यार्थियों का चयनप्रशिक्षण के लिए अभ्यार्थियों का चयनप्रशिक्षण के लिए अभ्यार्थियों का चयन....---- (क) सरकार अधीनस्थ लेखा सेवा (सामान्य शाखा) प्रवेश परीक्षा की खुली प्रतियोगिता संचालित करने के लिए, वर्ष के 31 मार्च तक की संभाव्य रिक्तियों, जिसमें सरकार ने संभाव्य रिक्तियों को भरने का विनिश्चय किया है, के बारे में हिमाचल लोक सेवा आयोग को अध्यपेक्षा भेजेगी। आयोग उस वर्ष के मई/जून मास में, जब तक आयोग परिस्थितियों पर निर्भर रहते हुए अन्यथा विनिश्चय नहीं करता है, प्रवेश परीक्षा के पाठ्‌यक्र्रम को ध्यान में रखते हुए, उसके द्वारा विहित रीति में पूर्वोत्तर परीक्षा, संचालित करेगा। सरकार अध्यपेक्षा को वित्त विभाग में भेजते समय, आगामी दो वर्षों के दौरान भरी जाने वाली अवधारित रिक्तियों की संख्या, विभिन्न प्रवर्गों आदि के लिए आरक्षित रिक्तियों की संख्या, की बाबत ब्यौरे स्पष्ट रूप से प्रस्तुत करेगी ।4345 राजपत्र, हिमाचल प्रदेश, 1 दिसम्बर, 2011/9 अग्रहायण, 1933 (ख) प्रशिक्षण के लिए अभ्यार्थियों का चयन, हिमाचल प्रदेश सरकार द्वारा समय समय पर अनुसूचित जातियों/अनूसूचित जनजातियों, पिछडे प्रवर्ग, अन्य प्रवर्ग के व्यक्तियों के लिए सेवा में आरक्षण की बाबत जारी आदेशों के अध्यधीन होगा ।

(ग) (1) प्रत्येक पेपर में न्यूनतम्‌ पास अंक चालीस प्रतिशत और संकलित पेपरों में पैंतालिस प्रतिशत होंगे, किन्तु आरक्षित प्रवर्ग के लिए प्रतिशत्ता क्रमशः पांच प्रतिशत कम होगी ।

(2) अन्तिम चयन, आरक्षित प्रवर्गों के लिए स्थानों के आरक्षण को ध्यान में रखते हुए सर्वथा पाठ्‌यक्रम के गुणागुण के क्रम में किया जाएगा ।

(3) आयोग हिपा में अधीनस्थ लेखा सेवा (सामान्य शाखा) भाग-I और II परीक्षा के प्रशिक्षण के लिए भाग लेने वाले अभ्यार्थियों का अन्तिम चयन, सम्बद्व अभ्यार्थियों के साथ-साथ सम्बद्व अभ्यार्थियों के सम्बद्व विभागाध्यक्षों/नियुक्ति प्राधिकारियों, निदेशक, हिमाचल प्रदेश लोक प्रशासन संस्थान, सरकार और वित्त विभाग को सूचित करेगा ।

8888.... प्रशिक्षणप्रशिक्षणप्रशिक्षणप्रशिक्षण....----(क) निदेशक, हिपा प्रशिक्षण हेतु चयनित सम्बद्व अभ्यार्थियों को, अधीनस्थ लेखा सेवा भाग-I और II (सामान्य शाखा) परीक्षा के लिए प्रशिक्षण के प्रारम्भ हेतु नियत तारीख को, प्रशिक्षण के लिए रिर्पोट करने हेतु सूचित करेगा ।

(ख) यदि कोई प्रशिक्षु अभ्यार्थी प्रशिक्षण के आरम्भ के लिए नियत तारीख तक निदेशक, हिपा को प्रशिक्षण के लिए रिपोर्ट करने में असफल रहता है, तो निदेशक, हिपा, ऐसी अनुपस्थिति की अवधि को प्रशिक्षु के लिखित अनुरोध पर माफ कर सकेगा यदि ऐसी अनुपस्थिति के लिए दिए गए कारण आवेदक के नियन्त्रण से परे थे और निदेशक, हिपा की यह राय है कि आवेदक के लिए व्यतीत अवधि की कमी को पूरा करना सम्भव है ।

(ग) अधीनस्थ लेखा सेवा भाग-I और II के प्रत्येक भाग के लिए प्रशिक्षण की अवधि पांच मास होगी ।

(घ) अधीनस्थ लेखा सेवा भाग-I और II को सफलतापूर्वक पूर्ण करने के पश्चात, वित्त विभाग में प्रशिक्षु अभ्यार्थियों की निुयक्ति, उसके पक्ष में, पैतृक कार्यालय/नियुक्त व्यक्ति के विभाग द्वारा सतर्कता विभाग से सतर्कता अनापत्ति प्रमाणपत्र प्राप्त करने के अध्यधीन होगी ।

(ड.) अधीनस्थ लेखा सेवा भाग-I और II के प्रशिक्षण की अवधि को, कर्तव्य (डियूटी) अवधि ही समझा जाएगा :

परन्तु नियम 9 के उप नियम क (VI) (छूट खण्ड) के अनुसार अधीनस्थ लेखा सेवा भाग- II के लिए प्रशिक्षण में भाग लेने के लिए अनुज्ञात किए गए अभ्यार्थियों की बाबत, प्रशिक्षण की अवधि को केवल कर्तव्य (डियूटी) पर समझा जाएगा यदि वे देय छुटटी की अवधि के रूप में पश्चातवर्ती सत्र में अधीनस्थ लेखा सेवा भाग-1 की परीक्षा अर्हित कर लेते हैं तथा वे किसी यात्रा भत्ता/दैनिक भत्ते के लिए हकदार नहीं हाेंगे । 9999.... परीक्षा और परिणामपरीक्षा और परिणामपरीक्षा और परिणामपरीक्षा और परिणाम....----(क) हिमाचल प्रदेश लोक प्रशासन संस्थान शिमला में अधीनस्थ लेखा सेवा के लिए प्रशिक्षण ले रहे अभ्यार्थियों के लिए अधीनस्थ लेखा सेवा (सामान्य शाखा) भाग-I और II परीक्षा, हिमाचल प्रदेश लोक सेवा आयोग द्वारा निम्न प्रकार से संचालित की जाएगीः

I. अधीनस्थ लेखा सेवा (सामान्य शाखा) भाग-I और II परीक्षा हेतु पाठ्‌यक्रम, संलग्न उपबन्ध के अनुसार होगा। (A & AI)

II. हिमाचल प्रदेश लोक सेवा आयोग, निदेशक, हिमाचल प्रदेश लोक प्रशासन संस्थान से अधीनस्थ लेखा सेवा (सामान्य शाखा) भाग-I और II के प्रशिक्षण के पूर्ण होने की तारीख की बाबत सूचना प्राप्त होने पर, प्रशिक्षण के पूर्ण होने के तुरन्त पश्चात की तारीख को परीक्षा4346 राजपत्र, हिमाचल प्रदेश, 1 दिसम्बर,, 2011/10 अग्रहायण, 1933 संचालित करेगा। निदेशक, हिमाचल प्रदेश लोक प्रशासन संस्थान ऐसी सूचना को प्रशिक्षण के पूर्ण होने से कम से कम डेढ मास पूर्व भेजेगा।

III. अभ्यार्थी को परीक्षा के किसी भी भाग में तीन से अधिक बार भाग लेना अनुज्ञात नहीं होगा। IV. परीक्षा के पास करने के आशय से, अभ्यार्थी को प्रत्येक पेपर में पचास प्रतिशत अंक प्राप्त करने होंगे। जहां पेपर में दो भाग होंगे, वहां दोनों भागों में प्राप्त किए गए अंकों को इकटठे संगणित किया जाएगा ।

V. अभ्यार्थी जिसने किसी पेपर (पेपरों) में पच्चपन प्रतिशत या अधिक अंक प्राप्त किए हैं, परन्तु परीक्षा में पूर्णतः अनुर्तीण हो जाता है, तो उससे परीक्षा में उस पेपर (पेपरों) में बैठने की अपेक्षा नहीं की जाएगी ।

VI. कोई अभ्यार्थी जब तक अधीनस्थ लेखा सेवा भाग-I की परीक्षा अर्हित नहीं कर लेता है, तब तक वह अधीनस्थ लेखा सेवा भाग-II के प्रशिक्षण और परीक्षा में प्रवेश का पात्र नहीं होगा तथापि उन अभ्यार्थियों को, जिन्हें उपरोक्त पैरा (V) के अधीन कम से कम तीन (3) पेपरों में छूट अनुज्ञात की गई है, उन्हें अधीनस्थ लेखा सेवा भाग-II के लिए प्रशिक्षण लेने और अधीनस्थ लेखा सेवा भाग-11 परीक्षा में प्रवेश लेने के लिए अनुज्ञात किया जाएगा, किन्तु उनका अधीनस्थ लेखा सेवा भाग-II का परिणाम तब तक घोषित नहीं किया जाएगा, जब तक वे अधीनस्थ लेखा सेवा भाग-I परीक्षा अर्हित नहीं कर लेते हैं। यदि कोई अभ्यार्थी अधीनस्थ लेखा सेवा भाग-I परीक्षा को तीन अवसर प्राप्त करने के बाबजूद भी अर्हित करने में असफल रहता है, तो उसका अधीनस्थ लेखा सेवा भाग-II का परिणाम स्वतः ही रदद्‌ हो जाएगा। VII. अभ्यार्थी से, उन पेपरों की परीक्षा में, जिनमें ऐसी पुस्तकों की सहायता अनुज्ञात है, अपनी पुस्तकें लानी अपेक्षित होंगी। उन पुस्तकों में कोई अप्रासंगिक विषय अन्तर्विष्ट नहीं होने चाहिए, किन्तु वे केवल सन्दर्भ की पुस्तकें होनी चाहिए । यदि कोई अभ्यर्थी अनुचित तरीके अपनाने में लिप्त पाया जाता है और परीक्षा के दौरान कोई अनाधिकृत पुस्तक/सामग्री लाता है, तो वह कार्यवाही के लिए दायी होगा/होगी, तथा जो निम्न प्रकार से होगीः (क) यदि, वह परीक्षा के लिए किसी प्रकार के अनुचित तरीकों को अपनाने का दोषी पाया जाता है/पाई जाती है, तो उसे प्रवेश के लिए निरर्हित किया जा सकेगा, या

No. 13-1/75-Fin(T&A)-III.—In exercise of the powers conferred by proviso to Article 309 of the Constitution of India, the Governor, Himachal Pradesh, in consultation with the Himachal Pradesh Public Service Commission is pleased to make the following Rules for initial selection of candidates for undergoing training in a recognized SAS Training Institute(i.e Himachal Pradesh Institute of Public Administration "HIPA) and Subordinate Accounts Service (Ordinary Branch) Part-I & II Examination in the Department of Treasuries, Accounts & Lotteries, Himachal Pradesh, namely:-

1. Short title and Commencement.—(1) These rules shall be called The Himachal Pradesh Subordinate Accounts Service (Ordinary Branch) Training and Examination Rules, 2011.

(2) They shall come into force with immediate effect.

2. Applicability.—(1) These rules shall be applicable to all employees of the State Government of Himachal Pradesh who fulfill the eligibility conditions as laid down in rule 4 (a) and (b).

(2) These rules shall also be applicable to the employees of the Corporations/ Boards/ Autonomous Bodies/ Local Bodies in Himachal Pradesh who fulfill the eligibility conditions as laid down in rule 4 (a) and (b).

3. Definitions.—In these rules, unless the context otherwise requires,

(a) The "Commission" wherever used means the Himachal Pradesh Public Service Commission;

(b) The "Department" means the Finance (Treasuries, Accounts and Lotteries) Department of Himachal Pradesh Government;

(c) The "Director" means the Director, Treasuries, Accounts and Lotteries, Himachal Pradesh;

(d) "Employees" means the Employees appearing in the competitive examination for training as well as Subordinate Accounts Service Part I & II examination and working in the offices of the State Government of Himachal Pradesh and its subordinate offices and also the employees of the Corporations/Boards/ Autonomous Bodies/ Local Bodies;

(e) "Government" means the Government of Himachal Pradesh;

(f) The abbreviation "HIPA" means the Himachal Pradesh Institute of Public Administration, Shimla; and.

Accounts Service (Ordinary Branch).

4. Eligibility for competitive SAS(OB) entrance examination.—(a) (i) Subject to other conditions prescribed in these rules, the following categories of employees shall be eligible to sit in a competitive examination to be conducted by the Commission for initial selection of candidates for SAS(OB) training;

(ii) All employees having 5 years service under the Government of Himachal Pradesh and the employees of the Corporations/Boards/Autonomous Bodies/Local Bodies etc., possessing a Bachelor's Degree or equivalent thereto from a recognized University.

(b) Maximum age limit for appearing in the competitive SAS (OB) Entrance Examination shall be 42 years.

Note.—The age limit for appearing in the competitive Entrance Examination shall be

reckoned as on 1st day of the year in which the advertisement for inviting applications from

the employees is issued by the Himachal Pradesh Public Service Commission.

(c) The Candidates (Employees) appearing in the competitive SAS(OB) Entrance Examination shall not be entitled for special leave for which they shall require to take leave from their employers.

(d) The employees shall have to bear their own expenditure for appearing in the competitive SAS(OB) Entrance Examination.

(e) The selected trainee candidates for undergoing the training for SAS(OB) Part-I & II Examination shall be required to execute a bond for an amount of Rs. 50,000/- with two sureties of the like amount to the Director of HIPA to serve the Government of Himachal Pradesh for a period of at least 5 years after successfully completing and qualifying the SAS(OB) Part I & II training/ Examination before their admission. The Director, HIPA shall submit the aforesaid executed bond to the Director of Treasuries, Accounts and Lotteries for safe custody.

5. Subject and syllabus for the entrance examination.—The subjects and syllabus for the entrance examination shall be as under: -

Note 1.—Standard of English Paper will be similar to that of the Degree Examination of any recognized Indian University and standard of Hindi paper shall be similar to that of 10+2 examination or equivalent of recognized University or Board of School Education.

Note 3.—The medium of examination shall be English except for Paper-I for which the medium of examination shall be both English and Hindi part-wise.

6. Number of chances for appearing in entrance examination.—(a) (i) No employee shall be allowed more than three chances to sit in the entrance examination.

(ii) The candidates who have finally been declared unsuccessful in SAS examination held after completion of training will not be eligible to sit in the entrance examination again.

7. Selection of candidates for training.— (a). The Government shall send a requisition to the Himachal Pradesh Public Service Commission for conducting the open competitive SAS(OB) Entrance Examination against the likely vacancies latest by 31st March of the year in which the Government decides to commence the training for filling of likely vacancies. The Commission shall conduct the aforesaid examination in the manner prescribed by it keeping in view the syllabus for the entrance Examination in the month of May/June of the same year unless the Commission decides otherwise depending upon the circumstances. The Government in the Finance Department while sending the requisition shall clearly furnish the details regarding number of vacancies determined to be filled in during the next two years, number of vacancies reserved for various categories, etc.

(b) The selection of candidates for training shall be subject to the orders regarding reservation in the service for Scheduled Castes/ Scheduled Tribes/Backward Classes, other categories of persons issued by the Himachal Pradesh Government from time to time.

(c) (i) The minimum pass marks shall be 40 % in each paper and 45% in aggregate, but for reserved category the percentage will respectively be 5% less. (ii) The final selection shall be made strictly in order of merit, of course keeping in view the reservation of seats for reserved categories. (iii) The Commission shall intimate the final selection of candidates for undergoing training for Part-I & II SAS(OB) Examination at HIPA to the concerned Heads of Departments/Appointing Authorities of the candidates concerned, the Director, Himachal Pradesh Institute of Public Administration and the Government in Finance Department as well as to the candidates concerned.

8. Training.—(a) The Director of HIPA shall intimate the candidates concerned selected for undergoing training, the scheduled date of commencement of training for Part-I and II SAS(OB) Examination to report for training.

(b) In case any trainee candidates fails to report for training to the Director, HIPA by the scheduled date of the commencement of training, the period of such absence may be condoned by the Director of HIPA on the written request of the trainee provided the reasons for such absence were beyond the control of the applicant and the Director, HIPA is of the opinion that it is possible for the applicant to make up for the lost period.

(c ) The period of training for SAS(OB) Part-I & II shall be 5 months in each part.

(d) The appointment of the trainee candidate in the Finance Department after the successful completion of Part-I & II SAS(OB) Examination shall be subject to the obtaining of the Vigilance Clearance Certificate in his favour by the parent office/ Department of the appointee from the Vigilance Department.

Provided that the period of training in respect of the candidates allowed to undergo training for SAS (OB)Part II in accordance with sub rule (a)(vi) of rule 9 (exemption clause), shall be treated as duty only if they qualify the SAS (OB) Part-I examination in the subsequent session as leave of the kind due and they shall not be entitled for any T.A/ D.A.

9. Examination and result.—(a) The SAS(OB) Part-I and II examination for the candidates undergoing training for SAS in Himachal Pradesh Institute of Public Administration Shimla shall be conducted by the Himachal Pradesh Public Service Commission as under:-

(i) The syllabus for SAS (OB) Part-I & II examination shall be as per annexure enclosed.(A & AI)

(ii) The Himachal Pradesh Public Service Commission shall, on receipt of information regarding the date of completion of training of SAS (Ordinary Branch) Part-I & II from the Director of HIPA, conduct the examination on a date immediately after the completion of training. The Director, HIPA will send such information at least 1- 1/2months before the completion of the training.

(iii) A candidate shall not be allowed to appear in either part of the examination more than three times.

(iv) In order to pass the examination, a candidate must obtain 50% marks in each paper. Where there are two parts in a paper, marks obtained in both the parts shall be counted together.

(v) A candidate who obtains 55% or more marks in any paper (s), but fails in the examination as a whole, shall not be required to appear in that paper (s) in the subsequent examination.

(vi) Unless a candidate qualifies SAS(OB) Part-I examination, he shall not be eligible to be admitted for part-II SAS training and examination. However, candidates who are allowed exemption at least in 3 (three) papers under Para (v) above, shall be allowed to undergo training for SAS(OB) Part-II and to appear in SAS (OB)Part-II examination but their result of SAS(OB) Part-II shall not be declared till they qualify the SAS(OB) Part-I examination. In case a candidate fails to qualify SAS(OB) Part-I examination even after availing three chances, his result for SAS (OB)Part-II shall stand cancelled automatically.

(vii) Candidate shall be required to bring their own books in examination in those papers in which the aid of such books is allowed. Those books shall not contain any extraneous matter but shall be bare reference books. In case a candidate is found to have indulged in unfair means and brings in any un-authorized book /material during the examination he/she shall be liable for action and the same shall be as under:-

(a) He /She may be disqualified if found guilty of adopting any kind of unfair means for the test, he/ she is appearing in, or

(b) He/She may be disqualified for the entire examination if found guilty of adopting any kind of unfair means in 2 tests or more of the said examination, he/she is appearing in.

10. Repeal and Savings.—(1) The rules for initial selection of candidates for undergoing training in a recognized Institute and Subordinate Accounts Service (OB) Part-I & Part-II examination notified vide this Department Notification No. 13-1/75-Fin (T&A) dated the 16th May, 1985 are hereby repealed.

(2) Notwithstanding such repeal, anything done, or any action taken under the rules so repealed, shall be deemed to have been done or taken under the corresponding provisions of these rules.

No. FDS-A(3)-3/90-II.—In exercise of the powers conferred by clause 18 of the Himachal Pradesh Trade Articles (Licensing & Control) Order, 1981 read with S.O.2447(E), dated 28.10.2011 issued by the Ministry of Consumer Affairs, Food and Public Distribution (Department4355 राजपत्र, हिमाचल प्रदेश, 1 दिसम्बर, 2011/9 अग्रहायण, 1933 of Consumer Affairs), Government of India and published in the Gazette of India, Extra–Ordinary, dated 28.10.2011, the Governor of Himachal Pradesh is pleased to make the following Order further to amend Schedule-1 appended to the Himachal Pradesh Trade Articles (Licensing & Control) Order, 1981, namely:—

1. Short title .—This Order may be called the Himachal Pradesh Trade Articles (Licensing and Control) Amendment Order, 2011.

2. Amendmet of Schedule-1.— In the Himachal Pradesh Trade Articles (Licensing

And Control) Order, 1981, for Schedule-1 for the articles under "PART-

"A" (FOODGRAINS)' , the following shall be substituted, namely:-

" PART-A(FOODGRAINS)" 1. "Rice" 2. "Paddy"

No. FDS-B(2)-1/2005.—The Governor, Himachal Pradesh, in exercise of the powers conferred under Section 16(1) (a), 16(2) and 16(3) of the Consumer Protection Act, 1986 (as amended by Act No. 62 of 2002) and in consultation with the Hon'ble Chief Justice of the High Court of H.P., is pleased to appoint Mr. Justice Surjit Singh, Judge of H. P. High Court, as President of H. P. State Consumer Disputes Redressal Commission (to be known as State Commission) with effect from the date he assumes the charge as such on the terms and conditions stated below:—

1. Mr. Justice Surjit Singh, Judge of High Court shall be entitled to salary, allowances and other perquisites as were available to him as Judge of High Court (Last pay drawn minus pension). He shall also be entitled to the increase in Dearness allowance on account of revision from time to time subject to the condition that no I. R. and relief on pension shall be payable during the currency of tenure of his appointment as President of State Commission after his retirement as sitting Judge of High Court.

2. Mr. Justice Surjit Singh shall hold office of the President, State Commission for a term of 5 years or upto the age of 67 years, whichever is earlier and shall not be eligible for re-appointment.
