No. Per (AR)F(7) 2/98-Vol-I.—Whereas in exercise of the powers conferred by sub- section (1) of section 15 of the Right to Information Act 2005, (Central Act No. 22 of 2005) and all other powers enabling his in this behalf, the Governor, Himachal Pradesh has constituted the Himachal Pradesh State Information Commission vide notification No. Per(AR)F(7) 2/98-Vol-I, dated 4th February, 2006.

And whereas Shri Kali Dass Batish Advocate, Shimla has been included as State Information Commissioner, Himachal Pradesh in the H.P. State Information Commission vide Notification No. Per(AR)F(7) 2/98-Vol-I, dated 7/6/2012 and Shri Kali Dass Batish, made and subscribe the oath under sub-section (3) of Section 16 of the Right to Information Act, 2005, on 8/6/2012.

Now therefore, Governor, Himachal Pradesh is pleased to notify that the salary and allowances and other terms and conditions of Shri Kali Dass Batish, State Information Commissioner, Himachal Pradesh shall be as contained in the Annexure attached.

ANNEXURE TERMS AND CONDITIONS OF SERVICES OF SHRI KALI DASS BATISH, STATE INFORMATION COMMISSIONER, HIMACHAL PRADESH 1. Tenure

Shri Kali Dass Batish, State Information Commissioner shall hold office for a term of 5 (five years) w.e.f. 8/6/2012. Shri Kali Dass Batish State Information Commissioner shall not be eligible for reappointment. However, he may be appointed as the Chief Information Commissioner in accordance with the provisions of the Act.

2. Pay

He shall draw a pay of Rs. 80,000 P.M. (fixed) (Basic pay Rs. 80,000/- plus Dearness and other allowances if any.

3. Sumptuary Allowance

A monthly sumptuary allowance of Rs. 4,000/- (Rs. Four thousand) per month shall be admissible to Shri Kali Dass Batish, State Information Commissioner.

4. Leave

Shri Kali Dass Batish, State Information Commissioner shall be entitled for leave in accordance with the provisions of AIS (Rules).

The power to grant or refuse leave to the State Information Commissioner and to revoke or curtail leave to him shall vest in the HP State Chief Information Commissioner.

5. Accommodation

Shri Kali Dass Batish, State Information Commissioner shall be entitled to the use of an official residence in accordance with the rules prescribed for chief Secretary. Where the State Information commissioner does not avail himself of the use of an official residence, he may be paid every month an allowance equal to that payable for the purpose to the Chief Secretary of the State Government.

6. Medical Facilities

Sh. Kali Dass Batish, State Information Commissioner and the members of his family shall be entitled to such facilities for medical treatment and for accommodation in hospitals as prescribed for the Chief Secretary to the Govt of HP from time to time.

7. Conveyance allowance.

Shri Kali Dass Batish, State Information Commissioner shall be entitled to a staff car and the actual consumption of fuel.

8. TA/DA on Tour/LTC

He shall be entitled to Travelling Allowance/Daily Allowance as applicable to the Chief Secretary and leave Travel concession once in a year, for himself, spouse and dependent members of his family to any place in India.

9. Administrative and other Residuary matters

Administrative matters relating to terms and conditions of service of the State Information Commissioner with respect to which no express provision has been made shall be as applicable to the Chief Secretary of the State.

No. EDN-C-A(4)-1/2011.—The Governor, Himachal Pradesh is pleased to notify "policy to engage a Teacher(s) through the School Management Committees purely on period basis in Elementary/Higher Education Departments of Himachal Pradesh in Tribal/Difficult Areas" as per Annexure-A.

The said policy shall be applicable with immediate effect.

Procedure for the appointment of a Teacher by the SMC to the educational Institutions of

Tribal/ Difficult Areas

The School Management Committees of the educational institutions located in the Tribal/Difficult areas have requested to fill up vacant posts of teachers in their schools. The Government is making all efforts to fill up all the vacant posts in the educational institutions in the State but even then some posts in the Tribal/Difficult areas remain vacant due to retirement, transfers, promotions etc. As such the studies of the students suffers badly. Keeping in view the betterment of the study of students in these area, it has been decided by the Government to permit the School Management Committees of educational institution situated in Tribal/Difficult areas as notified by the by the Department of Personnel (Annexure-I), to provide the teachers against vacant post as per the clause 15 of the "Right of Children to Free and Compulsory Education, Himachal Pradesh, Rules 2011" and para 4.19 of the guidelines issued by the Government for the constitution of School Management Committees in the educational institutions under the "Right of Children to Free and Compulsory Education, Himachal Pradesh Act, 2009".

The Government hereby frames the following procedure for the appointment of teachers through the SMCs purely on period basis:

1. The SMC of the concerned educational Institution will submit request through the Head of the Institution to the respective Dy. Director of Education to allow them to provide the teacher against vacant post on period basis. The Head of the Institution will ensure that the teaching posts in his/her school are as per PTR norms. No posts will be filled up excess than PTR/Rationalization norms.

2. The concerned Dy. Director of Education after verifying the vacancies likely posting either on recruitment, transfers, promotion, availability of post as per PTR norms etc. may allow the SMC to provide the eligible teacher on period basis.

3. The concerned SMC of the Primary and Middle Schools will make an open advertisement at the Gram Panchayat/Nagar Panchayat/Urban local are and the SMC of the High and Senior Secondary Schools will make advertisement in all the Panchayats in the Patwar Circle of the concerned area also and ask all eligible candidates to apply within 15 days for said period based assignment.

4. Member of the selection committee will be as under:—

1. President SMC 2. Head of the Institution-cum-Member Secretary of SMC. 3. Subject expert from outside the concerned Institution. 4. Senior most Regular Teacher of the concerned institution. (If the regular Teacher is not available in the concerned institution, the same be called from the adjoining institution).

5. The SMC will conduct an interview and follow distribution of Marks for evaluation during the course of Selection Process as per Annexure-II. Preference will be given to local eligible candidates.

6. After conducting the interview, the President of the SMC will declare the result and issue order of assignment to the eligible candidate(s).

7. The Head of the Institution after verifying all the credentials, which include educational certificates as per R & P Rules and instructions issued by the Government, character certificates issued by the competent authority etc. will accept the joining of the said candidate(s).

8. The Head of the Institutions will ensure that no ineligible candidate joins the educational institution for teaching the students on period basis. If, it is found that the Head of Institution has permitted an ineligible candidate, the disciplinary action will be initiated against him/her as per the CCS (CCA) Conduct Rules, 1964.

9. The Head of the Institutions ensure that the services of the said SMC provided teachers will automatically be terminated as and when regular/contract teacher appointed/transferred by the Government joins against the said post or after completion of the academic session of the institution, whichever is earlier.

10. In the next academic session, a fresh selection process will be conducted. In no case, the SMC provided teacher earlier be allowed to be continue after completion of2381 राजपत्र, हिमाचल प्रदेश, 23 जुलाई, 2012/1 श्रावण, 1934 academic session nor after the joining of regular / contract teacher appointed by the Government.

11. The Grant-in-Aid is permissible only in favour of those Teachers, who have been provided by the SMCs after following these terms and conditions only.

12. The Grant-in-Aid will be released by the Government to the SMCs only against the vacant posts of PGTs, TGTs, LTs, Shastris, JBTs only. No GIA will be released against any other posts.

13. The amount of Grant-in-Aid to a SMC in respect of a Teacher engaged on period basis shall be calculated / provided by the Government in the following manners:—

1. (i) PGT Rs. 150/- per period (for 10+1 and 10+2 classes.) (ii) PGT Rs. 100/- per period (for 9th and 10th Classes.) 2. TGT Rs. 100/- per period. 3. LT Rs. 75/- per period. 4. Shastri Rs. 75/- per period. 5. JBTs Rs. 75/- per period.

14. Limit of Grant—The per month amount of GIA to a SMC provided teacher will not exceed the following limit:—

1. PGT Rs. 6000/- PM 2. TGT Rs. 6000/- PM 3. LT Rs. 4500/- PM 4. Shastri Rs. 4500/- PM 4. JBTs Rs. 3500/- PM

Any access amount, if any, will be born by the SMC of the concerned institute.

15. The Grant-in-Aid will be given by the Government only to the SMCs constituted in those institutions located in the Tribal/Difficult areas.

16. The Grant-in-Aid given by the Government for this purpose will be not be incurred for other purposes/works.

17. Application for Grant-in-Aid.—The SMC, after providing the teacher on the period basis, submit an application for grant-in-aid in Form-I. Character/antecedents of such teachers verified by a Gazetted Government officer should be enclosed with the application. Further, the request for grant in respect of teachers provided should be accompanied by a certificate from the Head of Institution to the effect that the work and conduct of the teachers was satisfactory. In case the educational institution does not have a regular Head of Institution, the request for grant should be accompanied by certificates from the teacher of the institution carrying out the functions of Head of Institution.

18. Non-admissibility during vacations/Holidays.—No grant shall be admissible to SMCs for teachers made available during the period of vacations/Holidays, unless specifically allowed by the Dy. Director of Education (Concerned) for reasons to be recorded in writing.

ANNEXURE-I The Tribal/Difficult Areas shall be as under, as notified by the Government:—

1. District Lahaul & Spiti. 2. Pangi and Bharmour Sub Division of Chamba District. 3. Dodra Kawar Area of Rohru Sub Division. 4. Pandrah Bis Pargana, Munish Darkali and Gram Panchayat Kashapat, Gram Panchayats of Rampur Tehsil of District Shimla.

5. Pandrah Bis Pargana of Kullu District. 6. Bara Bhangal Areas of Baijnath Sub Division of Kangra District. 7. District Kinnaur. 8. Kathwar and Korga Patwar circles of Kamrau Sub Tehsil, Bhaladh Bhalona and Sangna Patwar Circles of Renukaji Tehsil and Kota Pab Patwar Circle of Shillai Ttehsil, in Sirmour District.

9. Khanyol-Bagra Patwar Circle of Karsog Tehsil, Gada Gussaini, Mathyani, Ghanyar, Thachi, Baggi, Somgad and Kholanal of Bali-Chowki Sub Tehsil, Jharwar, Kutgarh, Graman, Devgarh, Trailla, Ropa, Kathog, Silh-Badhwani, Hastpur, Ghamrebar and Bhatehar Patwar Circle of Padhar Tehsil, Chiuni, Kalipar, Mangarh, Thach-Bagra, North Magru and South Magru Patwar Circles of Thunag Tehsil and Batwara Patwar circle of Sunder Nagar Tehsil in Mandi District.

संख्याः 5-8/2011-ईएलएन.--हिमाचल प्रदेश की राज्यपाल विभागीय पदोन्नति समिति की सिफारिशों के आधार पर श्री सुमन कपूर, निर्वाचन कानूनगो, उप-मण्डलीय निर्वाचन कार्यालय, हमीरपुर की नायब-तहसीलदार (निर्वाचन) श्रेणी-II (राजपत्रित) के पद पर वेतनमान 10300-34800/- रुपए जमा 4200/- रुपए ग्रेड पे में कार्यभार ग्रहण करने की तिथि से पदोन्नति के सहर्ष आदेश देती हैं।

हिमाचल प्रदेश की राज्यपाल उक्त अधिकारी को नायब-तहसीलदार (निर्वाचन) के पद पर पदोन्नति के फलस्वरूप जिला निर्वाचन कार्यालय, धर्मशाला में नायब-तहसीलदार (निर्वाचन) के रिक्त पद के विपरीत पदस्थापना के भी सहर्ष आदेश देती है।

पदोन्नति के फलस्वरूप उक्त अधिकारी दो वर्ष की अवधि के लिए परिवीक्षा पर रहेंगे, जिसका एक वर्ष से अनधिक और ऐसी अवधि के लिए विस्तार किया जा सकेगा, जैसाकि सक्षम प्राधिकारी विशेष परिस्थितियों में और लिखित कारणों से आदेश दें।

यदि उक्त पदोन्नत अधिकारी मूल नियमों के नियम-22(I)(a)(1) के अपवाद खण्ड, जो हिमाचल प्रदेश सिविल सेवाएं (संशोधित वेतन) नियम, 2009 के नियम-11 के साथ पठित है, के अधीन पूर्व पद पर वेतन वृद्धि अर्जित करने के उपरान्त्‌ वेतन निर्धारण के इच्छुक हों तो उस दशा में नायब तहसीलदार (निर्वाचन) के पद का कार्यभार ग्रहण करने की तिथि से एक मास के भीतर उन्हें विभाग को अपना विकल्प प्रस्तुत करना होगा अन्यथा उन्हें उक्त नियम के अधीन वेतन निर्धारण का लाभ देय नहीं होगा।

संख्या डब्लयू एल एफ-ए(3) 7/96-11.--हिमाचल प्रदेश की राज्यपाल, भारत के संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, हिमाचल प्रदेश लोक सेवा आयोग के परामर्श से, इस विभाग की अधिसूचना संख्याः डब्लयू एल एफ-ए(3) 7/96 तारीख 4-6-2007 द्वारा अधिसूचित, हिमाचल प्रदेश सामाजिक न्याय एवं अधिकारिता विभाग, बाल विकास परियोजना अधिकारी, वर्ग-II (राजपत्रित) भर्ती और प्रोन्नति नियम, 2007 में और संशोधन करने के लिए निम्नलिखित नियम बनाती हैं; अर्थात्‌ :--

1. संक्षिप्त नाम और प्रारम्भ.--(1) इन नियमों का संक्षिप्त नाम, हिमाचल प्रदेश सामाजिक न्याय एवं अधिकारिता विभाग, बाल विकास परियोजना अधिकारी, वर्ग-II (राजपत्रित) भर्ती और प्रोन्नति (प्रथम संशोधन) नियम, 2012 है।2385 राजपत्र, हिमाचल प्रदेश, 23 जुलाई, 2012/1 श्रावण, 1934 (2) ये नियम राजपत्र, हिमाचल प्रदेश में प्रकाशित किए जाने की तारीख से प्रवृत्त होंगे। 2. उपाबन्ध "क" का संशोधन.--(1) हिमाचल प्रदेश, सामाजिक न्याय एवं अधिकारिता विभाग, बाल विकास परियोजना अधिकारी, वर्ग-II (राजपत्रित), भर्ती आरै प्रोन्नति नियम, 2007 के उपाबन्ध-"क" में (1) स्तम्भ संख्या-10 के सामने विद्यमान उपबन्धों के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌ :-- "(i) नब्बे प्रतिशत प्रोन्नति द्वारा ऐसा न होने पर सीधी भर्ती द्वारा ।

(ii) दस प्रतिशत सीधी भर्ती द्वारा या संविदा के आधार पर।"

(2) स्तम्भ संख्या 11 के सामने विद्यमान मुख्य उपबन्धों के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌ :--

"(i) पच्चीस प्रतिशत सहायक बाल विकास परियोजना अधिकारियों में से प्रोन्नति द्वारा, जिनका पांच वर्ष का नियमित सेवाकाल या ग्रेड में की गई लगातार तदर्थ सेवा यदि कोई हो, को सम्मिलित करके पांच वर्ष का नियमित सेवाकाल हो।

(ii) बीस प्रतिशत तहसील कल्याण अधिकारियों में से प्रोन्नति द्वारा, जिनका कम से कम पांच वर्ष का नियमित सेवाकाल या ग्रेड में की गई लगातार तदर्थ सेवा यदि कोई हो, को सम्मिलित करके पांच वर्ष का नियमित सेवाकाल हो।

(iii) बीस प्रतिशत सांख्यिकी सहायकों में से प्रोन्नति द्वारा जिनका कम से कम पांच वर्ष का नियमित सेवाकाल या ग्रेड में की गई लगातार तदर्थ सेवा सहित यदि कोई हो, को सम्मिलित करके पांच वर्ष का नियमति सेवाकाल हो।

(iv) पच्चीस प्रतिशत वरिष्ठ सहायकों में से प्रोन्नति द्वारा जिनका कम से कम बारह वर्ष का नियमित सेवाकाल या गे्रड में की गई लगातार तदर्थ सेवा, यदि कोई हो, को सम्मिलित करके बारह वर्ष का नियमित सेवाकाल हो।

पदों को भरने के लिए निम्नलिखित रोस्टर लागू होगा :--

NO. WLF-A(3)-7/96-Vol.-II.—In exercise of the powers conferred by proviso to Article 309 of the Constitution of India, the Governor, Himachal Pradesh, in consultation with the H.P. Public Service Commission is pleased to make the following rules further to amend the Himachal Pradesh Social Justice & Empowerment, Child Development Project Officer Class-II Gazetted Recruitment and Promotion Rules 2007 notified vide this Department notification No. WLF-A(3)- 7/96 dated 4-6-2007, namely :—

1. Short title and Commencement.—(1) These rules may be called the Himachal Pradesh Social Justice & Empowerment Department, Child Development Project Officer, Class-II (Gazetted) Recruitment and Promotion ( Ist Amendment) Rules, 2012.

(2) These rules shall come into force from the date of publication in Rajpatra, Himachal Pradesh.

2. Amendment of Annexure-A.—(1) In Annexure-A to the Himachal Pradesh Social Justice & Empowerment Department Child Development Project Officer, Class-II (Gazetted) Recruitment and Promotion Rules, 2007, for the existing provisions against Col. No. 10 the following shall be substituted, namely:—

" (i) 90% by promotion failing which by Direct Recruitment.

(ii) 10% by direct Recruitment or on contract basis.";

(2) For the existing main provisions of Column No. 11 the following shall be substituted namely :—

" (i) 25% by promotion from amongst Assistant Child Development Project Officer having at least 5 years regular service or regular combined with continuous adhoc service rendered, if any, in the grade.

(ii) 20% by promotion from amongst the Tehsil Welfare Officers having at least 5 years regular service or regular combined with continuous adhoc service rendered, if any, in the grade.

(iii) 20% by promotion from amongst the Statistical Assistants having at least 5 years regular service or regular combined with continuous adhoc service rendered, if any, in the grade.

(iv) 25% by promotion from amongst the Senior Assistants having at least 12 years regular service or regular combined with continuous adhoc service, rendered, if any, in the grade.

The following roster shall be applied for filling up the posts:—

1st, 4th, 7th, 11th, 17th …….. ACDPO

5th, 9th, 12th, 19th ……. Tehsil Welfare Officer

3rd, 6th, 10th, 15th……… Statistical Assistant

2nd, 8th, 13th, 16th, 18th…… Senior Assistant

14th & 20th ……… Direct recruitment."
