संख्या-पीसीएच-एचए-(1) 11/2010-I.—हिमाचल प्रदेश पंचायती राज (जिला परिषद्‌ में कनिष्ठ अभियन्ता की नियुक्ति और सेवा शर्तें) नियम, 2012 को इस विभाग की समसंख्यक अधिसूचना तारीख 30 अगस्त, 2012 द्वारा, हिमाचल प्रदेश पंचायती राज अधिनियम, 1994 (1994 का संख्यांक 4) की धारा 186 के उपबन्धों के अधीन यथा अपेक्षित जनसाधारण से आपेक्ष और सुझाव आमन्त्रित करने के लिए, तारीख 1 सितम्बर, 2012 को राजपत्र, हिमाचल प्रदेश में प्रकाशित किए गया था;

और नियत अवधि के दौरान प्राप्त हुए आक्षेप (पों)/सुझाव (वों) पर राज्य सरकार द्वारा सम्यक्‌ रूप से विचार किया गया है;

86-राजपत्र/2013-20-07-2013 (2389) 2390 राजपत्र, हिमाचल प्रदेश, 20 जुलाई, 2013/29 आषाढ़ 1935 अतः हिमाचल प्रदेश की राज्यपाल, हिमाचल प्रदेश पंचायती राज अधिनियम, 1994 (1994 का अधिनियम संख्यांक-4) की धारा 186 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए निम्नलिखित नियम बनाती हैं, अर्थातः-

1. संक्षिप्त नाम.--इन नियमों का संक्षिप्त नाम हिमाचल प्रदेश पंचायती राज (जिला परिषद्‌ में कनिष्ठ अभियन्ता की नियुक्ति और सेवा शर्तें) नियम, 2013 है।

2. परिभाषाएं.--(1) इन नियमों में, जब तक संदर्भ से अन्यथा अपेक्षित न हो,-

(क) ''अधिनियम'' से हिमाचल प्रदेश पंचायती राज अधिनियम, 1994 अभिप्रेत है; और (ख) ''प्ररूप'' से इन नियमों से संलग्न प्ररूप अभिप्रेत है।

(2) उन शब्दों और पदों के, जो इसमें प्रयुक्त हैं और परिभाषित नहीं है, के वही अर्थ होंगे जोे उनके अधिनियम में है।

3. पदों की संख्या.--कनिष्ठ अभियन्ता के पदों की, अपने अपने जिला परिषदों में, ऐसी संख्या होगी जैसी राज्य सरकार द्वारा मंजूर की गई हो और समय समय पर मंजूर की जाए।

4. वेतनमान.--कनिष्ठ अभियन्ता के पद का वेतनमान निम्नलिखित होगाः

(क) नियमित रूप से नियुक्त व्यक्तियों के लिए पे बेण्ड--पे बेण्ड-10300-34800 रूपए 3800 रूपए ग्रेड पे; और

(ख) संविदा पर नियुक्त किए गए व्यक्तियों के लिए उपलब्धियां.--नियम 14 में दिए गए ब्यौरे के अनुसार 14100/- रूपए प्रतिमास।

5. पद का प्रकार (चयन अथवा अचयन पद).--कनिष्ठ अभियन्ता का पद अचयन होगा। 6. सीधी नियुक्ति के लिए आयु.-- कोई व्यक्ति कनिष्ठ अभियन्ता के रूप में नियुक्त किए जाने के लिए तभी पात्र होगा यदि उसकी आयु 18 से 45 वर्ष के मध्य होः

परन्तु सीधे भर्ती किए जाने वाले व्यक्तियों के लिए ऊपरी आयु सीमा तदर्थ या संविदा के आधार पर नियुक्त किए गए व्यक्तियों सहित पहले से ही सरकार की सेवा में रत अभ्यर्थियों को लागू नहीं होगीः परन्तु यह और कि यदि तदर्थ या संविदा के आधार पर नियुक्त किया गया अभ्यर्थी इस रूप में नियुक्ति की तारीख को अधिक आयु का हो गया हो, तो वह तदर्थ या संविदा के आधार पर नियुक्ति के कारण विहित आयु में छूट के लिए पात्र नहीं होगाः

परन्तु यह और कि अनुसूचित जातियों/अनुसूचित जनजातियों/अन्य वर्गों के व्यक्तियों के लिए ऊपरी आयु सीमा में उतनी ही छूट दी जा सकेगी जितनी कि हिमाचल प्रदेश सरकार के साधारण या विशेष आदेश (आदेशों) के अधीन अनुज्ञेय हैः

परन्तु यह और भी कि पब्लिक सेक्टर, निगमों तथा स्वायत निकायों के सभी कर्मचारियों को, जो ऐसे पब्लिक सेक्टर, निगमों तथा स्वायत निकायों में आमेलन से पूर्व सरकारी कर्मचारी थे, सीधी भर्ती में आयु सीमा में ऐसी ही रियायत दी जाएगी जैसी सरकारी कर्मचारियोंं को अनुज्ञेय है, किन्तु इस प्रकार की रियायत पब्लिक सेक्टर, निगमों तथा स्वायत निकायों के ऐसे कर्मचारिवृन्द को नहीं दी जाएगी जो पश्चात्‌वर्ती ऐसे निगमों/ स्वायत निकायों द्वारा निुयक्त किए गए थे/किए गए हैं और उन पब्लिक सेक्टर निगमों/स्वायत निकायों के प्रारम्भिक गठन के पश्चात्‌ ऐसे निगमों/स्वायत निकायों की सेवा में अन्तिम रूप से आमेलित किए गए हैं/ किए गए थे।2391 राजपत्र, हिमाचल प्रदेश, 20 जुलाई, 2013/29 आषाढ़ 1935 (1) सीधी भर्ती के लिए आयु सीमा की गणना उस वर्ष के प्रथम दिवस से की जाएगी जिसमें कि पद (पदों) को आवेदन आमन्त्रित करने के लिए, यथास्थिति, विज्ञापित किया गया है या नियोजनालयों को अधिसूचित किया गया है।

(2) अन्यथा सुअर्हित अभ्यर्थियों की दशा में सीधी भर्ती के लिए आयु सीमा और अनुभव, राज्य सरकार के विवेकानुसार शिथिल किया जा सकेगा।

7. सीधी नियुक्ति के लिए अपेक्षित न्यूनतम शैक्षिक अर्हताएं.--(1) किसी मान्यता प्राप्त संस्थान से न्यूनतम 50 प्रतिशत अंकों सहित सिविल इंजीनियरिंग में डिग्री/डिप्लोमा या इसके समतुल्य और अनुसूचित जाति/अनुसूचित जनजाति के अभ्यर्थियों के लिए न्यूनतम उतीर्ण अंक।

(2) उन अभ्यर्थियों को अधिमान दिया जाएगा जो हिमाचल प्रदेश की रूढ़ियों, रीतियों, और बोलियों का ज्ञान और प्रदेश में विद्यमान विशिष्ट दशाओं में नियुक्ति के लिए उपयुक्तता रखते हैं।

8. परिवीक्षा की अवधि.--नियमित आधार पर नियुक्त व्यक्ति दो वर्ष की अवधि के लिए परिवीक्षा पर रहेगा, जिसका एक वर्ष से अनधिक ऐसी और अवधि के लिए विस्तार किया जा सकेगा जैसा निदेशक विशेष परिस्थितियों में और लिखित कारणों से आदेश दे।

9. नियुक्ति की पद्धति.--अभ्यर्थी, यथास्थिति, या तो सीधी भर्ती द्वारा, नियमित आधार पर या संंविदा के आधार पर नियुक्त किया जाएगा।

10. सीधी/संविदा नियुक्ति हेतु अनिवार्य अपेक्षा.--कनिष्ठ अभियन्ता के रूप में नियुक्त किए जाने के लिए अभ्यर्थी का भारत का नागरिक होना अनिवार्य है।

11. नियुक्ति के लिए चयन.--यथास्थिति सीधी या संविदात्मक नियुक्ति के मामले में, पद पर नियुक्ति के लिए चयन, मौखिक परीक्षा के आधार पर किया जाएगा। यदि, यथास्थिति, हिमाचल प्रदेश अधीनस्थ सेवाएं चयन बोर्ड, हमीरपुर या अन्य भर्ती प्राधिकरण ऐसा करना आवश्यक या समीचीन समझे, तो लिखित परीक्षा/व्यवहारिक परीक्षा के आधार पर किया जाएगा जिसका स्तर/पाठ्‌यक्रम आदि, यथास्थिति, बोर्ड/अन्य भर्ती प्राधिकरण द्वारा अवधारित किया जाएगा।

12. भविष्य निधि.--नियमित आधार पर नियुक्त व्यक्ति राज्य सरकार द्वारा अधिसूचित की जाने वाली भविष्य निधि की सुविधा प्राप्त करने के हकदार होंगे।

13. नियमित आधार पर नियुक्त व्यक्तियों की सेवा की शर्तें.--नियमित आधार पर नियुक्त व्यक्तियों की दशा में सेवा की अन्य शर्तें, जो राज्य सरकार के कनिष्ठ अभियन्ताओं को लागू है, आवश्यक परिवर्तनों सहित लागू होंगी।

14. संविदा नियुक्ति द्वारा पद पर नियुक्ति के लिए चयन.--इन नियमों में किसी बात के होते हुए भी पद पर संविदा नियुक्तियां नीचे दिए गए निबन्धनों और शर्तोंं के अध्यधीन की जाएंगीः-

(i) संकल्पना.--(क) इस पॉलिसी के अधीन जिला परिषद्‌ में कनिष्ठ अभियन्ता को संविदा के आधार पर प्रारम्भ में एक वर्ष के लिए लगाया जाएगा जिसे वर्षानुवर्ष आधार पर बढ़ाया जा सकेगाः परन्तु संविदा अवधि में वर्षानुवर्ष आधार पर विस्तारण/नवीकरण हेतु संबंधित मुख्य कार्यकारी अधिकारी एक प्रमाण पत्र जारी करेगा कि संविदा पर नियुक्त व्यक्ति की सेवा और आचरण वर्ष के दौरान संतोषजनक पाया गया है और केवल तभी निदेशक का पूर्व अनुमोदन प्राप्त करके उसकी संविदा अवधि नवीकृत/विस्तारित की जाएगी।

(ii) पद का हिमाचल प्रदेश अधीनस्थ सेवाएं चयन बोर्ड, हमीरपुर के कार्यक्षेत्र में आना.--सम्बद्ध जिला परिषद्‌ का मुख्य कार्यकारी अधिकारी संविदा के आधार पर पदों को भरने के लिए सरकार का अनुमोदन 2392 राजपत्र, हिमाचल प्रदेश, 20 जुलाई, 2013/29 आषाढ़ 1935 प्राप्त करने के पश्चात्‌्‌ अघ्यपेक्षा को हिमाचल प्रदेश अधीनस्थ सेवाएं चयन बोर्ड, हमीरपुर को 5नियुक्ति/ चयन के लिए भेजेगा।

(ग) चयन इन नियमों में विनिर्दिष्ट पात्रता शर्तों के अनुसार किया जाएगा।

(iii) संविदात्मक उपलब्धियां.--संविदा के आधार पर नियुक्त कनिष्ठ अभियन्ता को 14100/- रूपए की समेकित नियत संविदात्मक रकम (जो पे बैंड के न्यूनतम जमा ग्रेड पे के बराबर होगी) प्रतिमास संदत्त की जाएगी। यदि संविदा में एक वर्ष से अधिक की बढ़ौतरी की जाती है, तो पश्चात्‌वर्ती वर्ष/वर्षों के लिए संविदात्मक उपलब्धियों में पद के पे बैण्ड के न्यूनतम ग्रेड पे का तीन प्रतिशत वार्षिक वृद्धि के रूप में अनुज्ञात किया जाएगा।

(iv) नियुक्ति/अनुशासन प्राधिकारी.--संबंन्धित जिला परिषद्‌ का मुख्य कार्यकारी अधिकारी नियुक्ति और अनुशासन प्राधिकारी होगा।

(v) चयन प्रक्रिया.--संविदा नियुक्ति की दशा में पद पर नियुक्ति के लिए चयन, यथास्थिति, हिमाचल प्रदेश अधीनस्थ चयन बोर्ड, हमीरपुर या अन्य नियुक्ति प्राधिकरण द्वारा मौखिक परीक्षा के आधार पर किया जाएगा या यदि आवश्यक या समीचीन समझा जाए तो लिखित परीक्षा या व्यावहारिक परीक्षा के आधार पर किया जाएगा जिसका स्तर/पाठ्‌यक्रम आदि यथास्थिति, बोर्ड या किसी अन्य भर्ती प्राधिकरण द्वारा अवधारित किया जाएगा।

(vi) नियुक्ति और करार.--अभ्यर्थी की नियुक्ति के पश्चात्‌्‌ इन नियमों से संलग्न प्ररूप-II के अनुसार करार हस्ताक्षरित करना होगा।

(vii) निबन्धन और शर्तें.--(क) संविदा के आधार पर नियुक्त व्यक्ति को 14100/- रूपए की नियत संविदात्मक रकम (जो पे बैण्ड के न्यूनतम जमा ग्रेड पे के बराबर होगी) 6 प्रतिमास संदत्त की जाएगी। संविदा पर नियुक्त व्यक्ति आगे बढ़ाए गए वर्ष/वर्षों के लिए संविदात्मक रकम में पद के पे बैण्ड के न्यूनतम ग्रेड पे का 3 % वार्षिक वृद्धि का हकदार होगा और अन्य कोई प्रसुविधाएं, जैसे वरिष्ठ/चयन वेतनमान आदि नहीं दिया जाएगा।

(ख) संविदा पर नियुक्त व्यक्ति की सेवा पूर्णतया अस्थायी आधार पर होगी। यदि संविदा पर नियुक्त व्यक्ति का कार्य/आचरण ठीक नहीं पाया जाता है तो नियुक्ति समाप्त किए जाने के लिए दायी होगी। (ग) संविदा पर नियुक्त व्यक्ति एक मास की सेवा पूरी करने के पश्चात्‌्‌ एक दिन के आकस्मिक अवकाश का हकदार होगा। यह अवकाश एक वर्ष तक संचित किया जा सकेगा। संविदा पर नियुक्त व्यक्ति को किसी भी प्रकार का अन्य कोई अवकाश अनुज्ञात नहीं होगा। वह चिकित्सा प्रतिपूर्ति और एल0टी0सी0 इत्यादि के लिए भी हकदार नहीं होगा/होगी। केवल प्रसूति अवकाश, नियमानुसार दिया जाएगा। (घ) मुख्य कार्यकारी अधिकारी, जिला परिषद्‌ के अनुमोदन के बिना सेवा से अनधिकृत अनुपस्थिति से स्वतः ही संविदा का पर्यावसान (समापन) हो जाएगा। संविदा पर नियुक्त व्यक्ति कर्तव्य (ड्‌यूटी) से अनुपस्थिति की अवधि के लिए संविदात्मक रकम का हकदार नहीं होगा।

(ङ) संविदा आधार पर नियुक्त कर्मचारी, जिसने तैनाती के एक स्थान पर तीन वर्ष का कार्यकाल पूर्ण कर लिया है, अपनी जिला परिषद्‌ के भीतर आवश्यकतानुसार प्रशासनिक आधार पर स्थानांतरण के लिए पात्र होगा।

(च) चयनित अभयर्थी को सरकारी/रजिस्ट्रीकृत चिकित्सा व्यवसायी से अपना आरोग्य प्रमाण-पत्र प्रसतुत करना होगा। बारह सप्ताह से अधिक समय से गर्भवती महिला प्रसव होने तक, अस्थायी तौर पर अनुपयुक्त समझी जाएगी। महिला अभ्यर्थियों का किसी प्राधिकृत चिकित्सा अधिकारी/व्यवसायी द्वारा उपयुक्तता के लिए पुनः परीक्षण किया जाएगा।2393 राजपत्र, हिमाचल प्रदेश, 20 जुलाई, 2013/29 आषाढ़ 1935 (छ) संविदा पर नियुक्त व्यक्ति का यदि अपने पदीय कर्तव्यों के सम्बन्ध में दौर पर जाना अपेक्षित हो, तो वह उसी दर पर, जैसी कि नियमित प्रतिस्थानी कर्मचारी को वेतनमान के न्यूनतम पर लागू है, यात्रा भत्ते/दैनिक भत्ते का हकदार होगा।

(ज) नियमित कर्मचारियों की दशा में यथा लागू सेवा नियमों के उपबन्ध जैसे एफ0आर0-एस0आर0, छुट्‌टी नियम, साधारण भविष्य निधि नियम, पेंशन नियम तथा आचरण नियम आदि संविदा पर नियुक्त व्यक्तियों की दशा में लागू नहीं होंगे। वे इस स्तम्भ में यथावर्णित उपलब्धियों आदि के लिए हकदार होंगे। 15. नियुक्ति प्राधिकारी और पंचायतों का आबंटन.--(1) सम्बद्ध जिला परिषद का मुख्य कार्यकारी अधिकारी नियुक्ति प्राधिकारी होगा और नियुक्ति-पत्र मुख्य कार्यकारी अधिकारी, जिला परिषद्‌, जो किसी कनिष्ठ अभियन्ता को पंचायत समिति आबंटित करेगा, द्वारा जारी किया जाएगा।

(2) सम्बद्ध जिला परिषद्‌ का सचिव प्रवास कार्यक्रम, छुट्‌टी आदि के लिए नियंत्रण अधिकारी होगा। जिला परिषद का सचिव कार्यकारी अधिकारी, पंचायत समिति के परामर्श से पंचायतों का आबंटन इस प्रकार करेगा ताकि आबंटित पंचायतों का सामीप्य सुनिश्चित किया जा सके।

16. कनिष्ठ अभियन्ताओं की वरिष्ठता.--नियमित कनिष्ठ अभियन्ताओं की वरिष्ठता उनके कार्यग्रहण की तारीख से अवधारित की जाएगी और निदेशालय स्तर पर समेेकित और अनुरक्षित की जाएगी। 17. आरक्षण.--सेवा में नियुक्ति, हिमाचल प्रदेश सरकार द्वारा, समय-समय पर अनुसूचित जातियों/ अनुसूचित जनजातियों/अन्य पिछड़े वर्गों और अन्य प्रवर्ग के व्यक्तियों के लिए सेवा में आरक्षण की बाबत जारी किए गए अनुदेशों के अधीन होगी।

18. जॉब चार्ट.--कनिष्ठ अभियन्ता का जॉब चार्ट ऐसा होगा, जैसा निदेशक, पंचायती राज द्वारा समय समय पर विनिर्दिष्ट किया जाए।

19. प्रशिक्षण और परीक्षा.--सेवा के सदस्यों को परीक्षा उत्तीर्ण करनी होगी या ऐसा प्रशिक्षण प्राप्त करना होगा जो निदेशक द्वारा समय-समय पर विनिर्दिष्ट किया जाएः

परन्तु पांच वर्ष के भीतर ऐसी परीक्षा उत्तीर्ण करने के लिए तीन अवसर प्रदान किए जाएंगे और सम्बद्ध कर्मचारी द्वारा परीक्षा उत्तीर्ण न किए जाने की दशा में, ऐसे कर्मचारी की सेवाएं पर्यवसित (समाप्त) की जाने के लिए दायी होगी।

20. शिथिल करने की शक्ति.--जहां राज्य सरकार की यह राय हो कि ऐसा करना आवश्यक या समीचीन है, वहां वह, कारणों को लिखित में अभिलिखित करके, आदेश द्वारा, इन नियमों के किन्हीं उपबन्धों को किसी वर्ग या व्यक्ति (व्यक्तियों) के प्रवर्ग या पद (पदों) की बाबत, शिथिल कर सकेगी।

21. निरसन और व्यावृत्तियां.--(1) इन नियमों के प्रवृत होने की तारीख से और पर, अधिसूचना संख्या पी0सी0एच0-एच0बी0 (1) 12/02-II तारीख 4 नवम्बर, 2010 द्वारा, पंचायत समिति द्वारा संविदा आधार पर कनिष्ठ अभियन्ता की नियुक्ति हेतु अधिसूचित स्कीम, निरसित हो जाएगी।

(2) ऐसे निरसन के होते हुए भी, इस प्रकार निरसित स्कीम के अधीन की गई कोई नियुक्ति, बात या कार्रवाई, इन नियमों के अधीन विधिमान्य रूप में की गई समझी जाएगी।

इसलिए, उसे निम्नलिखित निबन्धनों और शर्तों पर कनिष्ठ अभियन्ता के रूप में नियुक्ति प्रस्तावित की जाती है :-

1. उसे प्रतिमास .....................रूपए (अंकाें में)...................................... (अक्षरों में) पारिश्रमिक संदत किया जाएगा;

2. कोई अन्य भत्ता, जैसा भी राज्य सरकार के कर्मचारियों को समय-समय पर अनुज्ञेय है, उसे संदत नहीं किया जाएगा;

3. नियुक्ति, संविदा आधार पर, कार्यग्रहण करने की तारीख से एक वर्ष की अवधि के लिए होगी;

4. नियुक्ति, नियमों और करार में अधिकथित निबन्धनों आ ैर शर्तों के भी अध्यधीन होगी;

5. कार्यग्रहण रिपोर्ट प्रस्तुत करते समय, उसके द्वारा कार्यकारी मजिस्ट्रेट या पिछले कम से कम तीन वर्ष से उसे जानने वाले दो राजपत्रित अधिकारियों से, पंचायत के समाधान के लिए, पूर्ववृत सत्यापन प्रमाणपत्र दिया जाएगा;

6. नियुक्ति, पद पर कार्यग्रहण करने से पूर्व सम्बद्ध जिले के मुख्य चिकित्सा अधिकारी द्वारा आरोग्य प्रमाण पत्र प्रस्तुत करने के अध्यधीन होगी; और

7. यथास्थिति, शैक्षिक अर्हताओं, जाति, स्थायी निवासी, शारीरिक अक्षमता, गरीबी रेखा से नीचे से संबन्धित सदस्य या पूर्व अनुभव की बाबत, मूल प्रमाणपत्रों की अनुप्रमाणित प्रतियां कार्यग्रहण रिपोर्ट के साथ प्रस्तुत की जाएंगी।

यदि उसे, उपरोक्त निबन्धन और शर्तें स्वीकार्य हैं, तो वह, अधोहस्ताक्षरी के कार्यालय में तुरन्त, किन्तु इस नियुक्ति पत्र के जारी करने की तारीख से 15 दिन के अपश्चात्‌ नहीं, संविदा करार के निष्पादन के साथ-साथ कार्यग्रहण के लिए रिपोर्ट कर सकेगा।

2. प्रथम पक्षकार की संविदात्मक रकम 14100/- रूपए प्रतिमास होगी।

3. प्रथम पक्षकार की सेवा पूर्णतया अस्थायी आधार पर होगी। यदि संविदा पर नियुक्त व्यक्ति का कार्य/आचरण ठीक नहीं पाया जाता है या यदि नियमित पदधारी उस रिक्ति के विरूद्ध नियुक्त/तैनात कर दिया जाता है जिसके लिए प्रथम पक्षकार को संविदा पर लगाया गया है तो नियुक्ति पर्यवसित (समाप्त) की जाने के लिए दायी होगी।

4. संविदा पर नियुक्त कनिष्ठ अभियन्ता एक मास की सेवा पूरी करने के पश्चात्‌ एक दिन के आकस्मिक अवकाश का हकदार होगा। यह अवकाश एक वर्ष तक संचित किया जा सकेगा। संविदा पर नियुक्त कनिष्ठ अभियन्ता को किसी भी प्रकार का अन्य कोई अवकाश अनुज्ञात नहीं होगा। वह चिकित्सा प्रतिपूर्ति और एल0टी0सी0 इत्यादि के लिए भी हकदार नहीं होगा/होगी। केवल प्रसूति अवकाश, नियमानुसार दिया जाएगा।

5. नियन्त्रक अधिकारी के अनुमोदन के बिना कर्तव्यों से अनधिकृत अनुपस्थिति से स्वतः ही संविदा का पर्यावसान (समापन) हो जाएगा। संविदा पर नियुक्त कनिष्ठ अभियन्ता कर्तव्य (डि्‌यूटी) से अनुपस्थिति की अवधि के लिए संविदात्मक रकम का हकदार नहीं होगा।

6. संविदा पर नियुक्त व्यक्ति, जिसने तैनाती के एक स्थान पर तीन वर्ष का कार्यकाल पूर्ण कर लिया हो, आवश्यक्ता के आधार पर स्थानान्तरण हेतु पात्र होगा, जहां भी प्रशासनिक आधार पर ऐसा करना अपेक्षित हों।

7. चयनित अभ्यर्थी को सरकारी/रजिस्ट्रीकृत चिकित्सा व्यवसायी से अपना आरोग्य प्रमाण-पत्र प्रस्तुत करना होगा। महिला अभ्यर्थियों की दशा में, बारह सप्ताह से अधिक की गर्भावती महिला प्रसव होने तक, उसे अस्थाई तौर पर अनुपयुक्त बना देगी। महिला अभ्यर्थियों का किसी प्राधिकृत चिकित्सा अधिकारी/व्यवसायी द्वारा उपयुक्तता के लिए पुनः परीक्षण किया जाना चाहिए।

8. संविदा पर नियुक्त व्यक्ति का यदि अपने पदीय कर्तव्यों के संबन्ध में दौरे पर जाना अपेक्षित हो, तो वह उसी दर पर, जैसी कि नियमित प्रतिस्थानी कर्मचारी को वेतनमान के न्यूनतम पर लागू है, यात्रा भत्ते/दैनिक भत्ते का हकदार होगा/होगी।

9. संविदात्मक नियुक्त व्यक्ति (यों) को कर्मचारी सामूहिक बीमा योजना के साथ-साथ ई0पी0एफ0/जी0पी0फ0 भी लागू नहीं होगा।

No.PCH-HA-(1)11/2010-I.—Whereas the draft Himachal Pradesh Panchayati Raj (Appointment and Conditions of Service of Junior Engineer in Zila Parishads) Rules, 2013 were published in the Rajpatra, Himachal Pradesh dated 1st September, 2012 for inviting objections and suggestions from the general public, vide this department notification of even number dated 30th August, 2012 as required under the provisions of section 186 of the Himachal Pradesh Panchayati Raj Act, 1994 (Act No. 4 of 1994);

And whereas, the objection(s)/suggestion(s) received during the stipulated period have been duly considered by the State Government;

Now, therefore, in exercise of the powers conferred by section 186 of the Himachal Pradesh Panchayati Raj Act, 1994 (Act No. 4 of 1994), the Governor of Himachal Pradesh is pleased to make the following rules, namely:—

1. Short title.—These rules may be called the Himachal Pradesh Panchayati Raj (Appointment and Conditions of Service of Junior Engineer in Zila Parishads) Rules, 2013.

2. Definitions.—(1) In these rules, unless the context otherwise requires.—

(a) "Act" means the Himachal Pradesh Panchayati Raj Act, 1994; and

(b) "Form" means a form appended to these rules.

(2) The words and expressions used but not defined in these rules shall have the same meaning as respectively assigned to them in the Act.

3. Number of Posts.—There shall be such number of posts of Junior Engineers as sanctioned and may be sanctioned by the State Government from time to time in the respective Zila Parishads.

4. Scale of Pay.—The scale of pay for the post of Junior Engineer shall be as under:—

(a) Pay band for regular appointees: PB-Rs.10300-34800 + 3800 Grade Pay; and (b) Emoluments for contractual appointees: Rs.14100/- per month, as per details given in rule 14.

5. Type of post (whether selection or non- selection post.).—The post of the Junior Engineer shall be Non-Selection.

6. Age for direct appointment.—A person to be appointed as Junior Engineer shall be eligible if he is having the age between 18 and 45 years:

Provided that the upper age limit for direct recruits will not be applicable to the candidates already in service of the Government including those who have been appointed on ad-hoc or on contract basis;

Provided further that if a candidate appointed on ad-hoc basis had become overage on the date when he was appointed as such he shall not be eligible for any relaxation in the prescribed age limit by virtue of his such ad-hoc or contract appointment;

Provided further that upper age limit is relaxable for Scheduled Castes/Scheduled Tribes/ Other Categories of persons to the extent permissible under the General or Special Order (s) of the State Government;

Provided further that the employees of all the Public Sector Corporations and Autonomous Bodies who happened to be Government Servant before absorption in Public Sector Corporations/Autonomous Bodies at the time of initial constitution of such corporations/Autonomous Bodies shall be allowed age concession in direct recruitment as admissible to Government servants. This concession will not, however, be admissible to such staff of the Public Sector Corporations/Autonomous Bodies who were/are subsequently appointed by such Corporation/Autonomous Bodies and who are/were finally absorbed in the service of such2398 राजपत्र, हिमाचल प्रदेश, 20 जुलाई, 2013/29 आषाढ़ 1935 Corporations/Autonomous Bodies after initial constitution of the Public Sector Corporations/Autonomous Bodies.

(1) Age limit for direct recruitment will be reckoned on the first day of the year in which the Post(s) is/ are advertised for inviting applications or notified to the Employment Exchanges, as the case may be.

(2) Age and experience, in the case of direct appointment, are relax able at the discretion of the State Government in case the candidate is otherwise well qualified.

7. Minimum educational qualifications required for direct appointment.—(1) Degree/Diploma in Civil Engineering with minimum 50% marks or its equivalent, from any recognized Institution and minimum pass marks for SC/ST candidates.

(2) Preference shall be given to those candidates who have knowledge of customs, manners and dialect of Himachal Pradesh and suitability for appointment in the peculiar condition prevailing in the Pradesh.

8. Period of Probation.—The regular appointee shall remain under probation for a period of two years subject to such further extension for a period not exceeding one year, as may be ordered by the Director in special circumstances and reasons thereof to be recorded in writing.

9. Method of appointment.—The candidate shall be appointed either by direct recruitment on regular basis or on contract basis, as the case may be.

10. Essential requirement for direct/contract appointment.—The candidate to be appointed as Junior Engineer must be a citizen of India.

11. Selection for appointment.—The selection to the post in case of direct or contractual appointment, as the case may be, shall be made on the basis of viva-voce test, if Himachal Pradesh Subordinate Services Selection Board Hamirpur or other Appointing Authority, as the case may be, so considers necessary or expedient by a written test or practical test, the standard/ syllabus etc. of which, will be determined by the Board or other Appointing Authority, as the case may be.

12. Provident Fund.—The regular appointees shall be entitled for availing the facility of provident fund as may be notified by the State Government.

13. Conditions of Service for regular appointees.—The other conditions of service in the case of regular appointees shall apply mutatis-mutandis as are applicable in the case of State Government Junior Engineers.

14. Selection for appointment to the post by Contract Appointment.—Notwithstanding anything contained in these rules, contract appointments to the post will be made subject to the Terms and Conditions given below:—

(I) CONCEPT:—(a) Under this policy the Junior Engineers in Zila Parishad will be engaged on contract basis initially for one year, which may be extendable on year to year basis:

Provided that for extension/renewal of contract period on year to year basis, the concerned Chief Executive Officer shall issue a certificate that the service and conduct of the contract appointee is satisfactory during the year and only then his period of contract is to be renewed/ extended after taking prior approval of the Director.

(II) POST SHALL BE IN THE PURVIEW OF HPSSSB, HAMIRPUR:—The Chief Executive Officer of the concerned Zila Parishad after obtaining the approval of the Government to fill up the posts on contract basis shall send requisition to the Himachal Pradesh Subordinate Services Selection Board Hamirpur for appointment/ selection.

(c) The selection shall be made in accordance with the eligibility conditions specified in these rules.

(III) CONTRACTUAL EMOLUMENTS:—The Junior Engineer appointed on contract basis will be paid consolidated fixed contractual amount @14100/-P.M. (which shall be equal to minimum of the pay band+ Grade pay). 3% of the minimum of pay band + grade pay of the post as annual increase in contractual emoluments for the subsequent years(s) will be allowed if contract is extended beyond one year.

(IV) APPOINTING/DISCIPLINARY AUTHORITY:—The Chief Executive Officer of the concerned Zila Parishad will be the appointing and disciplinary authority.

(V) SELECTION PROCESS:—Selection for appointment to the post in the case of Contract Appointment will be made by the Himachal Pradesh Subordinate Services Selection Board, Hamirpur or other Appointing Authority, as the case may be, on the basis of viva-voce test or if so considered necessary or expedient by a written test or practical test the standard/syllabus etc. of which will be determined by the Board or any other Appointing Authority, as the case may be.

(VI) APPOINTMENT AND AGREEMENT:—After appointment of a candidate, he/she shall sign an Agreement as per Form-II appended to these rules.

(VII) TERMS AND CONDTIONS:—(a) The contractual appointee will be paid fixed contractual amount @ Rs. 14100/- P.M. (which shall be equal to minimum of the pay band+ grade pay). The contractual appointee will be entitled for increase in contractual amount i.e. 3% of minimum of the pay band+ grade pay of the post for further extended year(s) and no other allied benefits such as senior /selection scales etc. will be given.

(b) The service of the Contract Appointee will be purely on temporary basis. The appointment is liable to be terminated in case the performance/conduct of the contract appointee is not found satisfactory.

(c) Contract Appointee will be entitled for one day causal leave after putting one month service. This leave can be accumulated up to one year. No leave of any other kind is admissible to the contract appointee. He/She shall not be entitled for Medial Re-imbursement and LTC etc., only maternity leave will be given as per rules.

(d) Unauthorized absence from the duty without the approval of the Chief Executive Officer, Zila Parishad shall automatically lead to the termination of the contract. Contract Appointee shall not be entitled for contractual amount for the period of absence from duty.

(e) An official appointed on contract basis who has completed three years tenure at one place of positing will be eligible for transfer on need basis within the respective Zila Parishad on administrative ground.

(f) Selected candidate will have to submit a certificate of his/her fitness from a Government/Registered Medical Practitioner. Woman candidate pregnant beyond 12 weeks will2400 राजपत्र, हिमाचल प्रदेश, 20 जुलाई, 2013/29 आषाढ़ 1935 stand temporarily unfit till the confinement is over. The woman candidate will be re-examined for the fitness from an authorized Medical Officer/Practitioner.

(g) Contract appointee will be entitled to TA/DA if required to go on tour in connection with his/her official duties at the same rate as applicable to regular counter-part official at the minimum of pay scale.

(h) Provisions of service rules like FR/SR Leave Rules, GPF Rules, Pension Rules and Conduct rules etc. as are applicable in case of regular employees will not be applicable in case of contract appointees. They will be entitled for emoluments etc. as detailed in this Column.

15. Appointing Authority and allocation of Panchayats.—(1) The Chief Executive Officer of concerned Zila Prishad shall be the appointing authority and letter of appointment shall be issued by the Chief Executive Officer, Zila Parishad, who shall allocate the Panchayat Samiti to a Junior Engineer.

(2) The Secretary of the concerned Zila Parishad shall be the controlling officer for tour programme, leave etc. The Secretary of Zila Parishad shall allocate the Panchayats in consultation with Executive Officer, Panchayat Samiti in such a way that contiguity of the allocated Panchayats are ensured.

16. Seniority of Junior Engineer.—The seniority of the regular Junior Engineers shall be determined from the date of joining and consolidated and maintained at Directorate level.

17. Reservation.—The appointment to the service shall be subject to orders regarding reservation in the service for Scheduled Castes/Scheduled Tribes/Backward Classes/Other Categories of persons issued by the Himachal Pradesh Government from time to time.

18. Job Chart.—The job chart for the Junior Engineer shall be such as may be specified by the Director Panchayati Raj from time to time.

19. Training and Examination.—The members of the service shall have to qualify examination or to undergo such courses for training to be specified by the Director, from time to time:

Provided that three chances shall be provided to qualify such examination within five years and in the event of not qualifying the examination by the concerned employee, the services of such employee shall be liable to be terminated.

20. Power to relax.—Where the State Government is of the opinion that it is necessary or expedient to do so, it may, by order for reasons to be recorded in writing, relax any of the provisions(s) of these rules with respect to any class or category of person (s) or post (s). 21. Repeal and Savings.—(1) On and from the date of commencement of these rules, the Scheme notified for the appointment of Junior Engineers on contract basis by Panchayat Samitis vide notification No. PCH-HB (1) 12/02-II, dated 4th November, 2010 shall stand repealed.

(2) Notwithstanding such repeal, any appointment made or anything done or any action taken, under the scheme so repealed, shall be deemed to have been validly made, done or taken under these rules.

With reference to the application for the post of Junior Engineer received from Shri/Smt./Kumari ……………………… son/wife/daughter of Shri ………………………………….., resident of village ………….., Tehsil …………….., district ……………….. it is informed that the said Shri/Smt./Kumari ……………………… has been selected for the said post. Therefore, he/she is hereby offered appointment as Junior Engineer on the following Terms and Conditions:—

1. That there shall be paid to him a remuneration of rupees …………… (in figures) …………………. (in words) per month;

2. That no other allowance, whatsoever admissible to the employees of State Government from time to time shall be paid to him;

3. That the appointment shall be on contract basis for a period of one year from the date of joining;

4. That the appointment shall further be subject to terms and conditions laid down in the rules and agreement ;

5. That the antecedent verification certificate to the satisfaction of the Panchayat from the Executive Magistrate or two Gazetted officers known to him at least for the last three years shall be given by him at the time of submission of joining report;

6. That the appointment shall be subject to the production of Certificate of Medical Fitness issued by the Chief Medical Officer of the concerned district before joining to the post; and

7. That the attested copies of original certificates in respect of educational qualifications, caste, bonafide resident, physically handicapped, member belonging to below poverty line or past experience, as the case may be, shall be submitted along with joining report.

In case, the above terms and conditions are acceptable to him, he/she may report for execution of the contract agreement as well as for joining duty in the office of undersigned immediately but not later than fifteen days from the date of issue of this appointment letter.

AGREEMENT

Form of contract/agreement to be executed between the Junior Engineer and the Chief

Executive Officer, Zila Parishad _______________ Designation of the Appointing Authority).

This agreement is made on this ____________________ day of ______________________ in the year__________________ Between Sh./Smt. __________________________ S/o/D/o/W/o Shri__________________ R/o ______________________________________________________ Contract appointee (hereinafter called the FIRST PARY), AND the Zila Parishad ____________________________ through its Chief Executive Officer (hereinafter referred to as the SECOND PARTY).

Whereas, the SECOND PARTY has engaged the aforesaid FIRST PARTY and the FIRST PARTY has agreed to serve as a Junior Engineer on contract basis on the following terms and conditions:—

1. That the FIRST PARTY shall remain in the service of the SECOND PARTY as a Junior Engineer for a period of 1 (one) year commencing on day of___________ and ending on the day of______________ It is specifically mentioned and agreed upon by both the parties that the contract of the FIRST PARTY with SECOND PARTY shall ipso-facto stand terminated on the last working day i.e. on__________________and information notice shall not be necessary:

Provided that for further extension/renewal of contract period the Chief Executive Officer shall issue a certificate that the service and conduct of the contract appointee was satisfactory during the year and only then the period of contract is to be renewed/extended.

2. The contractual amount of the FIRST PARTY will be Rs.14100/- per month.

3. The service of FIRST PARTY will be purely on temporary basis. The appointment is liable to be terminated in case the performance/conduct of the contract appointee is not found good or if a regular incumbent is appointed/posted against the vacancy for which the FIRST PARTY was engaged on contract.

4. Contractual Junior Engineer will be entitled for one day casual leave after putting in one month service. This leave can be accumulated upto one year. No leave of any kind is admissible to the contractual Junior Engineer. He will not be entitled for Medical Reimbursement and LTC etc. Only Maternity Leave will be given as per rules.

5. Unauthorized absence from the duty without the approval of the Controlling Officer shall automatically lead to the termination of the contract. A contractual Junior Engineer will not be entitled for contractual amount for the period of absence from duty.

6. An official appointed on contract basis who has completed three years tenure at one place of posting shall be eligible for transfer on need based basis within the concerned Zila Prishad on administrative grounds.

7. Selected candidate will have to submit a certificate of his/her fitness from a Government/Registered Medical Practitioner. In case of women candidates pregnant beyond twelve weeks will render her temporarily unfit till the confinement is over. The woman candidate shall be re-examined for fitness from an authorized Medical Officer/ Practitioner.

8. Contract appointee shall be entitled to TA/DA if required to go on tour in connection with his/her official duties at the same rate as applicable to regular counter-part official at the minimum of pay scale.

9. The Employees Group Insurance Scheme as well as EPF/GPF will not be applicable to contractual appointee(s). IN WITNESS the FIRST PARTY AND SECOND PARTY have herein to set their hands the day, month and year first, above written.

Whereas the above named applicants have made an application under section 8 (4) of the Himachal Pradesh Registration of Marriages Act, 1996 alongwith an affidavit stating therein that they have solemnized their marriage on 5-10-2009 at Tangroti but has not been found entered in the records of the Registrar of Marriages, Tangroti.

And whereas, they have also stated that they were not aware of the laws for the registration of marriage with the Registrar of Marriages and now, therefore, necessary orders for the registration of their marriage be passed so that their marriage can be registered by the concerned authority.

Now, therefore, objections are invited from the general public that if anyone has any objection regarding the registration of the marriage of the above named applicants, then they should appear before the court of undersigned on 31-8-2013 at Tehsil Office Dharamshala at 10.00 A.M. either personally or through their authorized agent.

In the event of their failure to do so, orders shall be passed ex-parte for the registration of marriage without affording any further opportunity of being heard.
