संख्या-पी.सी.एच.-एच.ए.(1)11/2010-II.—हिमाचल प्रदेश की राज्यपाल, हिमाचल प्रदेश पंचायती राज अधिनियम, 1994 (1994 का अधिनियम संख्यांक 4) की धारा 186 के साथ पठित धारा 135 की उपधारा (2) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, पूर्वोक्त अधिनियम के प्रयोजनों को कार्यान्वित करने के लिए निम्नलिखित नियम बनाने का प्रस्ताव करती हैं और इन्हें जन साधारण की सूचना के लिए राजपत्र, हिमाचल प्रदेश में एतद्‌द्वारा प्रकाशित किया जाता है;

88-राजपत्र/2013-23-07-2013 (2427) 2428 राजपत्र, हिमाचल प्रदेश, 23 जुलाई, 2013/1 श्रावण 1935 इन प्रारूप नियमों से संभाव्य प्रभावित होने वाला कोई व्यक्ति, उक्त नियमों की बाबत यदि कोई आक्षेप करना या सुझाव देना चाहे, तो वह उसे प्रारूप नियमों के राजपत्र, हिमाचल प्रदेश में प्रकाशित किए जाने की तारीख से तीस दिन की अवधि के भीतर, निदेशक, पंचायती राज, हिमाचल प्रदेश, एस.डी.ए. काम्पलैक्स, ब्लाक नं0 27, कसुम्पटी, शिमला-171009 को भेज सकेगा;

उपरोक्त विनिर्दिष्ट अवधि के भीतर प्राप्त हुए आक्षेप (पों) या सुझाव (वों), यदि कोई हों, पर इन नियमों को अन्तिम रूप देने से पूर्व, राज्य सरकार द्वारा विचार किया जाएगा, अर्थात्‌ः

प्रारूप नियम

1. संक्षिप्त नाम.--इन नियमों का संक्षिप्त नाम हिमाचल प्रदेश पंचायती राज (जिला परिषद्‌ में कनिष्ठ वेतनमान आशुलिपिकों की नियुक्ति और सेवा की शर्तें) नियम, 2013 है।

2. परिभाषाएं.--(1) इन नियमों में, जब तक सन्दर्भ से अन्यथा अपेक्षित न हो,-

(क) "अधिनियम" से हिमाचल प्रदेश पंचायती राज अधिनियम, 1994 अभिप्रेत है ;

(ख) ''निदेशक'' से निदेशक, पंचायती राज, हिमाचल प्रदेश अभिप्रेत है; और

(ग) "प्ररूप" से इन नियमों से संलग्न प्ररूप अभिपे्रत है।

(2) उन शब्दों और पदों के, जो इसमें प्रयुक्त हैं और परिभाषित नहीं है, के वही अर्थ होंगे जो उनके अधिनियम में हैं।

3. पदों की संख्या.--कनिष्ठ वेतनमान आशुलिपिक के पदों की, अपने-अपने जिला परिषदों में, ऐसी संख्या होगी, जैसी सरकार द्वारा मंजूर की गई हो और समय-समय पर मंजूर की जाए।

4. वेतनमान.--कनिष्ठ वेतनमान आशुलिपिक के पद का वेतनमान निम्नलिखित होगाः- (क) नियमित रूप से नियुक्त व्यक्तियों के लिए वेतनमान : पे बैंड 5910-20200 रूपये 2800 रूपये ग्रेड पे; और

(ख) संविदा पर नियुक्त व्यक्तियों के लिए उपलब्धियां : नियम 14 में दिए गए ब्यौरे के अनुसार 8710/- रूपये प्रतिमास।

5. पद का प्रकार (चयन पद अथवा अचयन पद).--कनिष्ठ वेतनमान आशुलिपिक का पद अचयन होगा।

6. सीधी नियुक्ति के लिए आयु.--कोई व्यक्ति कनिष्ठ वेतनमान आशुलिपिक के रूप में नियुक्त किए जाने हेतु तभी पात्र होगा, यदि उसकी आयु 18 से 45 के मध्य हैः

परन्तु सीधे भर्ती किए जाने वाले व्यक्तियों के लिए ऊपरी आयु सीमा, तदर्थ या संविदा के आधार पर नियुक्त किए गए व्यक्तियों सहित पहले से ही सरकार की सेवा में रत अभ्यर्थियों को लागू नहीं होगीः परन्तु यह और कि यदि तदर्थ या संविदा के आधार पर नियुक्त किया गया अभ्यर्थी इस रूप में नियुक्ति की तारीख को अधिक आयु का हो गया हो, तो वह तदर्थ या संविदा के आधार पर नियुक्ति के कारण विहित आयु में छूट के लिए पात्र नहीं होगाः

परन्तु यह और कि अनुसूचित जातियों/अनुसूचित जनजातियों/अन्य वर्गों के व्यक्तियों के लिए ऊपरी आयु सीमा में उतनी ही छूट दी जा सकेगी, जितनी हिमाचल प्रदेश सरकार के साधारण या विशेष आदेश (आदेशों) के अधीन अनुज्ञेय हैः2429 राजपत्र, हिमाचल प्रदेश, 23 जुलाई, 2013/1 श्रावण 1935 परन्तु यह और भी कि पब्लिक सेक्टर, निगमों तथा स्वायत निकायों के सभी कर्मचारियों को, जो ऐसे पब्लिक सेक्टर, निगमों तथा स्वायत निकायों में आमेलन से पूर्व सरकारी कर्मचारी थे, सीधी भर्ती में आयु सीमा में ऐसी ही रियायत दी जाएगी, जैसी सरकारी कर्मचारियों को अनुज्ञेय है, किन्तु इस प्रकार की रियायत पब्लिक सेक्टर, निगमों तथा स्वायत्त निकायों के ऐसे कर्मचारिवृन्द को नहीं दी जाएगी, जो पश्चात्‌वर्ती ऐसे निगमों/ स्वायत्त निकायों द्वारा नियुक्त किए गए थे/किए गए हैं और उन पब्लिक सेक्टर निगमों/स्वायत निकायों के प्रारम्भिक गठन के पश्चात्‌ ऐसे निगमों/स्वायत्त निकायों की सेवा में अन्तिम रूप से आमेलित किए गए हैं/ किए गए थे।

(1) सीधी भर्ती के लिए आयु सीमा की गणना उस वर्ष के प्रथम दिवस से की जाएगी, जिसमें पद (पदों) को आवेदन आमन्त्रित करने के लिए, यथास्थिति, विज्ञापित किया गया है या नियोजनालयों को अधिसूचित किया गया है।

(2) अन्यथा सुअर्हित अभ्यर्थियों की दशा में सीधी भर्ती के लिए आयु सीमा और अनुभव, राज्य सरकार के विवेकानुसार शिथिल किया जा सकेगा।

7. सीधे नियुक्त किए जाने वाले व्यक्तियों के लिए अपेक्षित और अन्य अर्हताएं.--(1) कनिष्ठ वेतनमान आशुलिपिक के पद पर नियुक्ति के लिए अभ्यर्थी, हिमाचल प्रदेश सरकार द्वारा मान्यता प्राप्त स्कूल शिक्षा बोर्ड से, कम से कम दस जमा दो या इसके समतुल्य शैक्षित अर्हता रखता हो।

(2) कनिष्ठ वेतनमान आशुलिपिक के रूप में नियुक्त के लिए प्रत्येक अभ्यर्थी की हिन्दी और अंग्रेजी आशुलिपि में क्रमशः सत्तर शब्द और अस्सी शब्द प्रति मिनट की गति होनी चाहिए और अंग्रेजी और हिन्दी टंकण में क्रमशः चालीस और तीस शब्द प्रति मिनट की गति होनी चाहिएः

परन्तु यथा उपरोक्त वर्णित आशुलिपि और टंकण में अपेक्षित गति रखने वाला कोई अभ्यर्थी केवल एक भाषा में भी पद के लिए आवेदन करने के लिए पात्र होगा और पद पर नियुक्ति के लिए चयन की दशा में, उसे पद पर कार्यग्रहण करने की तारीख से छह मास के भीतर, दूसरी भाषा में परीक्षा उत्तीर्ण करनी होगी। (3) उन अभ्यर्थियों को अधिमान दिया जाएगा, जो हिमाचल प्रदेश की रूढ़ियों, रीतियों और बोलियों का ज्ञान और प्रदेश में विद्यमान विशिष्ट दशाओं में नियुक्ति के लिए उपयुक्तता रखते हों।

8. परिवीक्षा की अवधि.--नियमित आधार पर नियुक्त व्यक्ति, दो वर्ष की अवधि के लिए परिवीक्षा पर रहेगा, जिसका एक वर्ष से अनधिक ऐसी और अवधि के लिए विस्तार किया जा सकेगा, जैसा निदेशक विशेष परिस्थितियों में और लिखित कारणों से आदेश दे।

9. नियुक्ति की पद्धति.--अभ्यर्थी, सीधी भर्ती द्वारा, यथास्थिति, नियमित आधार पर या संविदा के आधार पर नियुक्त किया जाएगा।

10. सीधी/संविदा नियुक्ति हेतु अनिवार्य अपेक्षा.--कनिष्ठ वेतनमान आशुलिपिक के रूप में नियुक्त किए जाने के लिए अभ्यर्थी का भारत का नागरिक होना अनिवार्य है।

11. नियुक्ति के लिए चयन.--यथास्थिति सीधी या संविदात्मक नियुक्ति के मामले में, पद पर नियुक्ति के लिए चयन, मौखिक परीक्षा के आधार पर किया जाएगा। यदि, यथास्थिति, हिमाचल प्रदेश अधीनस्थ सेवाएं चयन बोर्ड, हमीरपुर या अन्य भर्ती प्राधिकरण, ऐसा करना आवश्यक या समीचीन समझे, तो लिखित परीक्षा/व्यावहारिक परीक्षा के आधार पर किया जाएगा, जिसका स्तर/ पाठ्‌यक्रम आदि, यथास्थिति, बोर्ड या अन्य नियुक्ति प्राधिकारी द्वारा अवधारित किया जाएगा।

12. अंशदायी पेंशन स्कीम.--नियमित आधार पर नियुक्त व्यक्ति, राज्य सरकार द्वारा यथा अधिसूचित की जाने वाली अंशदायी पेंशन की सुविधा प्राप्त करने के हकदार होंगे। 2430 राजपत्र, हिमाचल प्रदेश, 23 जुलाई, 2013/1 श्रावण 1935 13. नियमित आधार पर नियुक्त व्यक्तियों की सेवा की शर्तें.--नियमित आधार पर नियुक्त व्यक्तियों की दशा में, सेवा की वे अन्य शर्तें, जो राज्य सरकार के कनिष्ठ वेतनमान आशुलिपिक को लागू हैं, आवश्यक परिवर्तनों सहित लागू होंगी।

14. संविदा नियुक्ति द्वारा पद पर नियुक्ति के लिए चयन.--इन नियमों में किसी बात के होते हुए भी पद पर संविदा नियुक्तियां, नीचे दिए गए निबन्धनों और शर्तों के अध्यधीन की जाएंगीः-

(i) संकल्पना.--(क) इस पॉलिसी के अधीन जिला परिषद्‌ में कनिष्ठ वेतनमान आशुलिपिक को संविदा के आधार पर प्रारम्भ में एक वर्ष के लिए लगाया जाएगा, जिसे वर्षानुवर्ष आधार पर बढ़ाया जा सकेगाः

परन्तु संविदा अवधि में वर्षानुवर्ष आधार पर विस्तारण/नवीकरण हेतु सम्बद्ध मुख्य कार्यकारी अधिकारी यह प्रमाण पत्र जारी करेगा कि संविदा पर नियुक्त व्यक्ति की सेवा और आचरण, वर्ष के दौरान संतोषजनक पाया गया है और केवल तभी निदेशक का पूर्व पूर्व अनुमोदन प्राप्त करके, उसकी संविदा अवधि नवीकृत/विस्तारित की जाएगी। (ii) पद का हिमाचल प्रदेश अधीनस्थ सेवाएं चयन बोर्ड, हमीरपुर के कार्यक्षेत्र में आना.--सम्बद्ध जिला परिषद्‌ का मुख्य कार्यकारी अधिकारी, रिक्त पदों को संविदा के आधार पर भरने के लिए सरकार का अनुमोदन प्राप्त करने के पश्चात्‌ अध्यपेक्षा को हिमाचल प्रदेश अधीनस्थ सेवाएं चयन बोर्ड, हमीरपुर को नियुक्ति/चयन के लिए भेजेगा।

(ग) चयन, इन नियमों में विनिर्दिष्ट पात्रता शर्तों के अनुसार किया जाएगा।

(iii) संविदात्मक उपलब्धियां.--संविदा के आधार पर नियुक्त कनिष्ठ वेतनमान आशुलिपिक को 8710/- रूपए की समेकित नियत संविदात्मक रकम (जो पे बैंड का न्यूनतम जमा ग्रेड पे के बराबर होगी) प्रतिमास संदत्त की जाएगी। यदि संविदा में एक वर्ष से अधिक की बढ़ौतरी की जाती है, तो पश्चात्‌वर्ती वर्ष/वर्षों के लिए संविदात्मक उपलब्धियों में पद के पे बैण्ड का न्यूनतम जमा ग्रेड पे का तीन प्रतिशत, वार्षिक वृद्धि के रूप में अनुज्ञात किया जाएगा।

(iv) नियुक्ति/अनुशासन प्राधिकारी.--सम्बद्ध जिला परिषद्‌ का मुख्य कार्यकारी अधिकारी, नियुक्ति और अनुशासन प्राधिकारी होगा।

(v) चयन प्रक्रिया.--संविदा नियुक्ति की दशा में पद पर नियुक्ति के लिए चयन, यथास्थिति, हिमाचल प्रदेश अधीनस्थ सेवाएं चयन बोर्ड, हमीरपुर या अन्य नियुक्ति प्राधिकारी द्वारा मौखिक परीक्षा के आधार पर किया जाएगा या यदि आवश्यक या समीचीन समझा जाए, तो लिखित परीक्षा या व्यावहारिक परीक्षा के आधार पर किया जाएगा, जिसका स्तर/पाठ्‌यक्रम आदि, यथास्थिति, बोर्ड या किसी अन्य भर्ती प्राधिकरण द्वारा अवधारित किया जाएगा। (vi) नियुक्ति और करार.--अभ्यर्थी को, चयन और प्ररूप-I में उसे नियुक्ति पत्र जारी करने के पश्चात्‌, इन नियमों से संलग्न प्ररूप-II के अनुसार करार हस्ताक्षरित करना होगा। (vii) निबन्धन और शर्तें.--(क) संविदा के आधार पर नियुक्त व्यक्ति को 8710/- रूपये की नियत संविदात्मक रकम (जो पे बैण्ड का न्यूनतम जमा ग्रेड पे के बराबर होगी) प्रतिमास संदत्त की जाएगी। संविदा पर नियुक्त व्यक्ति आगे बढ़ाए गए वर्ष/वर्षों के लिए संविदात्मक रकम में पद के पे-बैण्ड का न्युनतम जमा ग्रेड पे का तीन प्रतिशत वार्षिक वृद्धि के रूप में प्राप्त करने का हकदार होगा और अन्य कोई प्रसुविधाएं, जैसे वरिष्ठ/चयन वेतनमान आदि नहीं किया जाएगा।2431 राजपत्र, हिमाचल प्रदेश, 23 जुलाई, 2013/1 श्रावण 1935 (ख) संविदा पर नियुक्त व्यक्ति की सेवा पूर्णतया अस्थायी आधार पर होगी। यदि संविदा पर नियुक्त व्यक्ति का कार्य/आचरण ठीक नहीं पाया जाता है, तो नियुक्ति समाप्त किए जाने के लिए दायी होगी।

(ग) संविदा पर नियुक्त व्यक्ति एक मास की सेवा पूरी करने के पश्चात्‌ एक दिन के आकस्मिक अवकाश का हकदार होगा। यह अवकाश एक वर्ष तक संचित किया जा सकेगा। संविदा पर नियुक्त व्यक्ति को किसी भी प्रकार का अन्य कोई अवकाश अनुज्ञात नहीं होगा। वह चिकित्सा प्रतिपूर्ति और एल0टी0सी0 इत्यादि के लिए भी हकदार नहीं होगा/होगी। केवल प्रसूति अवकाश, नियमानुसार दिया जाएगा।

(घ) मुख्य कार्यकारी अधिकारी, जिला परिषद्‌ के अनुमोदन के बिना सेवा से अनधिकृत अनुपस्थिति से, स्वतः ही संविदा का पर्यावसान (समापन) हो जाएगा। संविदा पर नियुक्त व्यक्ति कर्तव्य (ड्‌यूटि) से अनुपस्थिति की अवधि के लिए संविदात्मक रकम का हकदार नहीं होगा।

(ड.) संविदा पर नियुक्त कर्मचारी, जिसने तैनाती के एक स्थान पर पांच वर्ष का कार्यकाल पूर्ण कर लिया है, अपने-अपने जिला परिषद्‌ के भीतर आवश्यकतानुसार प्रशासनिक आधार पर स्थानातंरण के लिए पात्र होगा।

(च) चयनित अभ्यर्थी को सरकारी/रजिस्ट्रीकृत चिकित्सा व्यवसायी से अपना आरोग्य प्रमाण-पत्र प्रस्तुत करना होगा। बारह सप्ताह से अधिक समय से गर्भवती महिला प्रसव होने तक, अस्थायी तौर पर अनुपयुक्त समझी जाएगी। महिला अभ्यर्थियों का किसी प्राधिकृत चिकित्सा अधिकारी/व्यवसायी द्वारा उपयुक्तता के लिए पुनः परीक्षण किया जाएगा।

(छ) संविदा पर नियुक्त व्यक्ति का यदि अपने पदीय कर्तव्यों के सम्बन्ध में दौरे पर जाना अपेक्षित हो, तो वह उसी दर पर, जैसी नियमित तत्स्थानी कर्मचारियों को वेतनमान के न्यूनतम पर लागू है, यात्रा भत्ते/दैनिक भत्ते का हकदार होगा/होगी।

(ज) नियमित कर्मचारियों की दशा में यथा लागू सेवा नियमों के उपबन्ध जैसे एफ0आर0, एस0आर0, छुट्‌टी नियम, साधारण भविष्य निधि नियम, पेंशन नियम तथा आचरण नियम आदि संविदा पर नियुक्त व्यक्तियों की दशा में लागू नहीं होंगे। वे इस स्तम्भ में यथावर्णित उपलब्धियों आदि के लिए हकदार होंगे।

15. नियुक्ति प्राधिकारी.--(1) सम्बद्ध जिला परिषद्‌ का मुख्य कार्यकारी अधिकारी नियुक्ति प्राधिकारी होगा और नियुक्ति-पत्र उसके द्वारा जारी किया जाएगा।

(2) सम्बद्ध जिला परिषद का सचिव प्रवास कार्यक्रम, छुट्‌टी आदि के लिए नियंत्रण अधिकारी होगा। 16. कनिष्ठ वेतनमान आशुलिपिक की वरिष्ठता.--नियमित कर्मचारियों की वरिष्ठता, उनके कार्यग्रहण की तारीख से अवधारित की जाएगी और निदेशालय स्तर पर समेकित या अनुरक्षित की जाएगी। 17. आरक्षण.--सेवा में नियुक्ति, हिमाचल प्रदेश सरकार द्वारा, समय-समय पर अनुसूचित जातियों/अनुसूचित जनजातियों/अन्य पिछड़े वर्गों और अन्य प्रवर्ग के व्यक्तियों के लिए सेवा में आरक्षण की बाबत जारी किए गए अनुदेशों के अधीन होगी।

18. जॉब चार्ट.--कनिष्ठ वेतनमान आशुलिपिक का जॉब चार्ट ऐसा होगा, जैसा निदेशक द्वारा समय-समय पर विनिर्दिष्ट किया जाए।

19. शिथिल करने की शक्ति.--जहां राज्य सरकार की यह राय हो कि ऐसा करना आवश्यक या समीचीन है, वहां यह, कारणों को लिखित में अभिलिखित करके, आदेश द्वारा, इन नियमों के किन्हीं उपबन्धों को, किसी वर्ग या व्यक्ति (व्यक्तियों) के प्रवर्ग या पद (पदों) की बाबत, शिथिल कर सकेगी। 2432 राजपत्र, हिमाचल प्रदेश, 23 जुलाई, 2013/1 श्रावण 1935 20. निरसन और व्यावृत्तियां.--(1) इन नियमों के प्रवृत्त होने की तारीख से और, अधिसूचना संख्या पी0सी0एच0-एच0ए0 (3) 25/2007-1407-31, तारीख 22 मई 2009 द्वारा, पंचायत समिति द्वारा, संविदा आधार पर कनिष्ठ वेतनमान आशुलिपिक की नियुक्ति हेतु अधिसूचित स्कीम, निरसित हो जाएगी। (2) ऐसे निरसन के होते हुए भी, इस प्रकार निरसित स्कीम के अधीन की गई कोई नियुक्ति, बात या कार्रवाई, इन नियमों के अधीन विधिमान्य रूप में की गई समझी जाएगी।

श्री/श्रीमति/कुमारी...........................................................पुत्र/पत्नी/पुत्री, श्री.........................................निवासी गॉव.................................तहसील..................................जिला..................................... से कनिष्ठ वेतनमान आशुलिपिक के पद के लिए प्राप्त आवेदन के संदर्भ में, यह सूचित किया जाता है कि उक्त श्री/श्रीमति/कुमारी......................... ....................को उक्त पद के लिए चयनित किया गया है। इसलिए, उसे निम्नलिखित निबन्धनों और शर्तों पर कनिष्ठ वेतनमान आशुलिपिक के रूप में नियुक्ति प्रस्तावित की जाती हैः-

1. उसे प्रतिमास ..............................रुपए (अंकों में)..............................................................अक्षरों में) पारिश्रमिक संदत किया जाएगा;

2. कोई अन्य भत्ता, जैसा भी राज्य सरकार के कर्मचारियों को समय-समय पर अनुज्ञेय है, उसे संदत नहीं किया जाएगा;

3. नियुक्ति, संविदा आधार पर, कार्यग्रहण करने की तारीख से एक वर्ष की अवधि के लिए होगी;

4. नियुक्ति, नियमों और करार में अधिकथित निबन्धनों और शर्तों के भी अध्यधीन होगी;

5. कार्यग्रहण रिपोर्ट प्रस्तुत करते समय, उसके द्वारा कार्यकारी मजिस्ट्रेट या पिछले कम से कम तीन वर्ष से उसे जानने वाले दो राजपत्रित अधिकारियों से, पंचायत के समाधान के लिए, पूर्ववृत सत्यापन प्रमाणपत्र दिया जाएगा;

6. नियुक्ति, पद पर कार्यग्रहण करने से पूर्व सम्बद्ध जिले के मुख्य चिकित्सा अधिकारी द्वारा स्वस्थतता प्रमाण पत्र प्रस्तुत करने के अध्यधीन होगी; और

7. यथास्थिति, शैक्षिक अर्हताओं, जाति, स्थायी निवासी, शारीरिक अक्षमता, गरीबी रेखा से नीचे से संबन्धित सदस्य या पूर्व अनुभव की बाबत, मूल प्रमाणपत्रों की अनुप्रमाणित प्रतियां कार्यग्रहण रिपोर्ट के साथ प्रस्तुत की जाएगी।

यदि उसे, उारोक्त निबन्धन और शर्ते स्वीकार्य हैं, तो वह, अद्योहस्ताक्षरी के कार्यालय में तुरन्त, किन्तु इस नियुक्ति पत्र के जारी करने की तारीख से 15 दिन के अपश्चात्‌, संविदा करार के निष्पादन के साथ-साथ कार्यग्रहण के लिए रिपोर्ट कर सकेगा/सकेगी।

परन्तु संविदा अवधि में वर्षानुवर्ष आधार पर विस्तारण/नवीकरण के लिए यह प्रमाण पत्र जारी करेगा कि संविदा पर नियुक्त व्यक्ति की सेवा और आचरण वर्ष के दौरान संतोषजनक रहा है और केवल तभी संविदा की अवधि नवीकृत/विस्तारित की जाएगी।

2. प्रथम पक्षकार की संविदात्मक रकम 8710/- रूपए प्रतिमास होगी।

3. प्रथम पक्षकार की सेवा पूर्णतया अस्थाई आधार पर होगी। यदि संविदा पर नियुक्त व्यक्ति का कार्य/ आचरण ठीक नहीं पाया जाता है या यदि नियमित पदधारी उस रिक्ति के विरूद्ध नियुक्त/तैनात कर दिया जाता है, जिसके लिए प्रथम पक्षकार को संविदा पर लगाया गया है, तो नियुक्ति पर्यवसित (समाप्त) की जाने के लिए दायी होगी।

4. संविदा पर नियुक्त कनिष्ठ वेतनमान आशुलिपिक एक मास की सेवा पूरी करने के पश्चात्‌ एक दिन के आकस्मिक अवकाश का हकदार होगा। यह अवकाश एक वर्ष तक संचित किया जा सकेगा। संविदा पर नियुक्त कनिष्ठ वेतनमान आशुलिपिक को किसी भी प्रकार का अन्य कोई अवकाश अनुज्ञात नहीं होगा। वह चिकित्सा प्रतिपूर्ति और एल0टी0सी0 इत्यादि के लिए भी हकदार नहीं होगा/होगी। केवल प्रसूति अवकाश, नियमानुसार दिया जाएगा।

5. नियन्त्रक अधिकारी के अनुमोदन के बिना कर्तव्यों से अनधिकृत अनुपस्थिति से स्वतः ही संविदा का पर्यावसान (समापन) हो जाएगा। संविदा पर नियुक्त पंचायत सचिव कर्तव्य (ड्‌यूटी) से अनुपस्थिति की अवधि के लिए संविदात्मक रकम का हकदार नहीं होगा।

6. संविदा पर नियुक्त व्यक्ति, जिसने तैनाती के एक स्थान पर तीन वर्ष का कार्यकाल पूर्ण कर लिया हो, आवश्यक्ता के आधार पर स्थानान्तरण हेतु पात्र होगा, जहॉं भी प्रशासनिक आधार पर ऐसा करना अपेक्षित हों।

7. चयनित अभ्यर्थी को सरकारी/रजिस्ट्रीकृत चिकित्सा व्यवसायी से अपना आरेाग्य प्रमाण-पत्र प्रस्तुत करना होगा। महिला अभयर्थियों की दशा में, बारह सप्ताह से अधिक की गर्भावस्था प्रसव होने तक, उसे अस्थाई तौर पर अनुपयुक्त बना देगी । महिला अभ्यर्थियों का किसी प्राधिकृत चिकित्सा अधिकारी/व्यवसायी द्वारा उपयुक्तता के लिए पुनः परीक्षण किया जाना चाहिए। 2434 राजपत्र, हिमाचल प्रदेश, 23 जुलाई, 2013/1 श्रावण 1935 8. संविदा पर नियुक्त व्यक्ति का यदि अपने पदीय कर्तव्यों के संबन्ध में दौरे पर जाना अपेक्षित हो, तो वह उसी दर पर, जैसी कि नियमित प्रतिस्थानी कर्मचारी को वेतनमान के न्यूनतम पर लोग है, यात्रा भत्ते/दैनिक भत्ते का हकदार होगा/होगी।

9. संविदा पर नियुक्त व्यक्ति (यों) को कर्मचारी सामुहिम बीमा योजना के साथ-साथ ई0पी0एफ0/जी0पी0फ0 भी लागू नहीं होगा।

NOTIFICATION

Shimla-171 009, the 10th July, 2013

No. PCH-HA-(1) 11/2010-I.—In exercise of the powers conferred by sub-section (2) of section 135 read with section 186 of the Himachal Pradesh Panchayati Raj Act, 1994(Act No. 4 of 1994), the Governor, Himachal Pradesh, proposes to make the following rules for carrying out the purposes of the Act ibid and the same are hereby published in the Rajpatra, Himachal Pradesh, for the information of the general public ;

If any person, likely to be affected by these draft rules has any objection(s) or suggestions(s) to make with regard to the said rules, he may send the same to the Director of Panchayati Raj, Himachal Pradesh, SDA Complex, Block No. 27, Kasumpti, Shimla-171009, within a period of thirty days from the date of publication of the draft rules in the Rajpatra, Himachal Pradesh ;

The objections(s) or suggestions(s), if any, received within the period specified above shall be taken into consideration by the State government, before finalizing these rules, namely:—

DRAFT RULES

1. Short title.—These rules may be called the Himachal Pradesh Panchayati Raj (Appointment and Conditions of Service of Junior Scale Stenographers in Zila Parishads) Rules, 2013.

2. Definitions.—(1) In these rules, unless the context otherwise requires,--

(a) "Act" means the Himachal Pradesh Panchayati Raj Act, 1994;

(b) "Director" means the Director of Panchayati Raj, Himachal Prdesh; and (c) "Form" means a form appended to these rules.

(2) The words and expressions used but not defined in these rules shall have the same meaning as respectively assigned to them in the Act.

3. Number of Posts.—There shall be such number of posts of Junior Scale Stenographers as may be sanctioned by the State Government from time to time in the respective Zila Parishads.

4. Scale of Pay.—The scale of pay for the post of Junior Scale Stenographers shall be as under:—

(a) Pay band for regular appointees: PB-Rs.5910+20200 + Rs.2800 Grade Pay; and (b) Emoluments for contractual appointees: Rs.8710/- per month, as per details given in rule 14.

5. Type of post (whether selection or non selection post).—The post of the Junior Scale Stenographers shall be Non-Selection.

6. Age for direct appointment.—A person to be appointed as Junior Scale Stenographer shall be eligible if he is having age between 18 and 45 years:

Provided that the upper age limit for direct recruits will not be applicable to the candidates already in service of the Government including those who have been appointed on ad-hoc or on contract basis:

Provided further that if a candidate appointed on ad-hoc basis had become overage on the date when he was appointed as such he shall not be eligible for any relaxation in the prescribed age limit by virtue of his such ad-hoc or contract appointment:

Provided further that upper age limit is relaxable for Scheduled Castes/Scheduled Tribes/ Other Categories of persons to the extent permissible under the General or Special Order (s) of the State Government:

Provided further that the employees of all the Public Sector Corporations and Autonomous Bodies who happened to be Government Servant before absorption in Public Sector Corporations/Autonomous Bodies at the time of initial constitution of such corporations/Autonomous Bodies shall be allowed age concession in direct recruitment as admissible to Government servants. This concession will not, however, be admissible to such staff of the Public Sector Corporations/Autonomous Bodies who were/are subsequently appointed by such Corporation/Autonomous Bodies and who are/were finally absorbed in the service of such Corporations/Autonomous Bodies after initial constitution of the Public Sector Corporations/Autonomous Bodies.

(1) Age limit for direct recruitment will be reckoned on the first day of the year in which the Post(s) is/ are advertised for inviting applications or notified to the Employment Exchanges, as the case may be.

(2) Age and experience, in the case of direct appointment, are relax able at the discretion of the State Government in case the candidate is otherwise well qualified.

7. Minimum educational qualifications required for direct appointment.—(1) The candidate to be appointed as Junior Scale Stenographer shall possess minimum educational qualification of Ten Plus Two (10+2) or its equivalent, from Board of School Education recognized by the Himachal Pradesh Government.

(2) Every candidate to be appointed as Junior Scale Stenographer shall have a speed of eighty and seventy words per minute in English and Hindi shorthand respectively and forty and thirty words per minute in English and Hindi typewriting respectively:

Provided that a candidate shall also be eligible to apply for the post having the requisite speed as mentioned above in shorthand and typewriting in one language only, and in the event of his selection to the post, he shall have to qualify the test in other language within six months from the date of joining the post.

(3) Preference shall be given to those candidates who have knowledge of customs, manners and dialects of Himachal Pradesh and suitability for appointment in the peculiar conditions prevailing in the State.

8. Period of Probation.—The regular appointee shall remain under probation for a period of two years subject to such further extension for a period not exceeding one year, as may be ordered by the Director in special circumstances and reasons thereof to be recorded in writing.

9. Method of appointment.—The candidate shall be appointed either by direct recruitment on regular basis or on contract basis, as the case may be.

10. Essential requirement for direct/contract appointment.—The candidate to be appointed as Junior Scale Stenographer must be a citizen of India.

11. Selection for appointment.—The selection to the post, in case of direct or contractual appointment, as the case may be, shall be made on the basis of viva-voce test or if Himachal Pradesh Subordinate Services Selection Board Hamirpur or other Appointing Authority, as the case may be, so considers necessary or expedient by a written test or practical test, the standard/ syllabus etc. of which, will be determined by the Board or other Appointing Authority, as the case may be.

12. Contributory Pension Scheme.—The regular appointees shall be entitled for availing the facility of contributory pension scheme as may be notified by the State Government.

13. Conditions of Service for regular appointees.—The other conditions of service in the case of regular appointees shall apply mutatis-mutandis as are applicable in the case of State Government Junior Scale Stenographers.

14. Selection for appointment to the post by Contract Appointment.—Notwithstanding anything contained in these rules, contract appointments to the post will be made subject to the terms and conditions given below:—

(I) CONCEPT.—(a) Under these rules the Junior Scale Stenographers in Zila Parishad will be engaged on contract basis initially for one year, which may be extendable on year to year basis:

Provided that for extension/renewal of contract period on year to year basis, the concerned Chief Executive Officer shall issue a certificate that the service and conduct of the contract appointee is satisfactory during the year and only then his period of contract will be renewed/ extended after taking prior approval of the Director.

(II) POST SHALL BE IN THE PURVIEW OF HIMACHAL PRADESH SUBORDINATE SERVICES SELECTION BOARD, HAMIRPUR.—The Chief Executive Officer of the concerned Zila Parishad after obtaining the approval of the Government to fill up the post on contract basis shall send requisition to the Himachal Pradesh Subordinate Services Selection Board Hamirpur for appointment/ selection.

(c) The selection shall be made in accordance with the eligibility conditions specified in these rules.

(III) CONTRACTUAL EMOLUMENTS.—The Junior Scale Stenographers appointed on contract basis will be paid consolidated fixed contractual amount @8710/-P.M. (which shall be equal to minimum of the pay band+ Grade pay). 3% of the minimum of pay band + grade pay of the post as annual increase in contractual emoluments for the subsequent years(s) will be allowed if contract is extended beyond one year.

(IV) APPOINTING/DISCIPLINARY AUTHORITY:-—The Chief Executive Officer of the concerned Zila Parishad will be the appointing and disciplinary authority.

(V) SELECTION PROCESS-—Selection for appointment to the post in the case of Contract Appointment will be made by the Himachal Pradesh Subordinate Services Selection Board, Hamirpur or other Appointing Authority, as the case may be, on the basis of viva-voce test or if so considered necessary or expedient by a written test or practical test the standard/syllabus etc. of which will be determined by the Board or any other Appointing Authority, as the case may be.

(VI) APPOINTMENT AND AGREEMENT.—After selection of a candidate an appointment letter will be issued to him in Form-I and he shall sign an Agreement as per Form-II appended to these rules.

(VII) TERMS AND CONDTIONS.—(a) The contractual appointee will be paid fixed contractual amount @ Rs. 8710/- P.M. (which shall be equal to minimum of the pay band+ grade pay). The contract appointee will be entitled to increase in the contractual amount i.e. 3% of minimum of the pay band+ grade pay of the post for further extended year(s) and no other allied benefits such as senior /selection scales etc. will be given.

(b) The service of the Contractual Appointee will be purely on temporary basis. The appointment is liable to be terminated in case the performance/conduct of the contract appointee is not found satisfactory.

(c) Contractual Appointee will be entitled to one day's causal leave after putting in one month's service. This leave can be accumulated up to one year. No leave of any other kind will be admissible to the contract appointee. He/She shall not be entitled to Medical Re-imbursement and LTC etc. Only maternity leave will be given as per rules.

(d) Unauthorized absence from the duty without the approval of the Chief Executive Officer, Zila Parishad shall automatically lead to the termination of the contract. Contractual Appointee shall not be entitled to contractual amount for the period of absence from duty.

(e) An official appointed on contract basis who has completed three years tenure at one place of positing will be eligible for transfer on need based basis within the respective Zila Parishad on administrative ground (s).

(f) Selected candidate will have to submit a certificate of his/her fitness from a Government/Registered Medical Practitioner. Woman candidate pregnant beyond 12 weeks will stand temporarily unfit till the confinement is over. The woman candidate will be got re-examined for fitness from an authorized Medical Officer/Practitioner.

(g) Contractual appointee will be entitled to TA/DA if required to go on tour in connection with his/her official duties at the same rate as are applicable to the regular counter-part official at the minimum of pay scale.

(h) Provisions of service rules like FR/SR Leave Rules, GPF Rules, Pension Rules and Conduct rules etc. as are applicable in case of regular employees will not be applicable in case of contractual appointees. They will be entitled to emoluments etc. as detailed in this Column.

15. Appointing Authority.—(1) The Chief Executive Officer of concerned Zila Prishad shall be the appointing authority and letter of appointment shall be issued by him.

(2) The Secretary of the concerned Zila Parishad shall be the controlling officer for tour programme and leave etc.

16. Seniority of Junior Scale Stenographer.—The seniority of the regular Junior Scale Stenographers shall be determined from the date of joining and consolidated and maintained at Directorate level.

17. Reservation.—The appointment to the service shall be subject to orders regarding reservation in the service for Scheduled Castes/ Scheduled Tribes/ Backward Classes/ Other Categories of persons issued by the Himachal Pradesh Government from time to time.

18. Job Chart.—The job chart for the Junior Scale Stenographers shall be such as may be specified by the Director from time to time.

19. Power to relax.—Where the State Government is of the opinion that it is necessary or expedient to do so, it may, by order for reasons to be recorded in writing, relax any of the provisions(s) of these rules with respect to any class or category of person (s) or post (s).

20. Repeal and Savings.—(1) On and from the date of commencement of these rules, the rules notified for the appointment of Junior Scale Stenographers on contract basis by Zila Parishad vide notification No. PCH-HA (3) 25/2007-1407-31 dated 22nd May, 2009 shall stand repealed.

(2) Notwithstanding such repeal, any appointment made or anything done or any action taken, under the scheme so repealed, shall be deemed to have been validly made, done or taken under these rules.

2. no other allowance, whatsoever admissible to the employees of State Government from time to time shall be paid to him/ her;

3. the appointment shall be on contract basis for a period of one year from the date of joining;

4. the appointment shall further be subject to terms and conditions laid down in the rules and agreement ;

5. the antecedent verification certificate to the satisfaction of the Zila Parishad from the Executive Magistrate or two Gazetted officers known to him at least for the last three years shall be given by him at the time of submission of joining report;

6. the appointment shall be subject to the production of Certificate of Medical Fitness issued by the Chief Medical Officer of the concerned district before joining the post; and

7. attested copies of original certificates in respect of educational qualifications, caste, bonafide resident, physically handicapped, member belonging to below poverty line or past experience, as the case may be, shall be submitted along with the joining report.

In case, the above terms and conditions are acceptable to him, he/she may report for execution of the contract agreement as well as for joining duty in the office of undersigned immediately but not later than fifteen days from the date of issue of this appointment letter.

Form of contract/agreement to be executed between the Junior Scale Stenographer

and the Chief Executive Officer, Zila Parishad ______________________ (Designation of the

This agreement is made on this ____________________ day of ______________________ in the year__________________ Between Sh./Smt. __________________________ S/o/D/o/W/o Shri_________________________________ R/o _______________________________________ Contract appointee (hereinafter called the FIRST PARY), AND the Zila Parishad ____________________________ through its Chief Executive Officer (hereinafter referred to as the SECOND PARTY).

Whereas, the SECOND PARTY has engaged the aforesaid FIRST PARTY and the FIRST PARTY has agreed to serve as a Junior Scale Stenographer on contract basis on the following terms and conditions:—

1. That the FIRST PARTY shall remain in the service of the SECOND PARTY as a Junior Scale Stenographer for a period of 1 (one) year commencing on day of___________ and ending on the day of______________ It is specifically mentioned and agreed upon by both the parties that the contract of the FIRST PARTY with SECOND PARTY shall ipso-facto stand terminated on the last working day i.e. on__________________and information notice shall not be necessary:

Provided that for further extension/renewal of contract period the Chief Executive Officer shall issue a certificate that the service and conduct of the contract appointee was satisfactory during the year and only then the period of contract shall be renewed/extended.

2. The contractual amount payable to the FIRST PARTY will be Rs.8710/- per month.

3. The services of the FIRST PARTY will be purely on temporary basis. The appointment is liable to be terminated in case the performance/conduct of the contractual appointee is not found good or if a regular incumbent is appointed/posted against the vacancy for which the FIRST PARTY was engaged on contract.

4. Contractual Junior Scale Stenographer will be entitled to one day's casual leave after putting in one month's service. This leave can be accumulated upto one year. No leave of any other kind is admissible to the contractual Junior Scale Stenographer. He will not be entitled to Medical Reimbursement and LTC etc. Only Maternity Leave will be given as per rules.

5. Unauthorized absence from the duty without the approval of the Controlling Officer shall automatically lead to the termination of the contract. A contractual Junior Scale Stenographer will not be entitled to contractual amount for the period of absence from duty.

6. An official appointed on contractual basis who has completed three years tenure at one place of posting will be eligible for transfer on need based basis within the concerned Zila Prishad on administrative grounds.

7. Selected candidate will have to submit a certificate of his/her fitness from a Government/Registered Medical Practitioner. 2. उप मण्डल मजिस्टे्रट। 3. तहसीलदार (तहसील) 4. पुलिस विभाग में, पुलिस अधिकारी जो सहायक उप-निरीक्षक की पंक्ति से नीचे का न हो। हिमाचल प्रदेश की राज्यपाल, पूर्वोक्त अधिनियम की धारा 8, 9, 10, 12 एवं 54, के अधीन, उपरोक्त आबकारी अधिकारियों को प्रवेश करने, निरीक्षण करने, अन्वेषण करने, तलाशी लेने और अभिग्रहण करने, सूचना प्राप्त करने और जमानत देने की शक्तियां प्रदत्त करती है :

परन्तु उक्त अधिनियम की धारा 8 के अधीन शक्ति का, उस पुलिस अधिकारी द्वारा प्रयोग किया जाएगा जो उप-अधीक्षक पुलिस की पंक्ति से नीचे का न हो, जिसके साथ अधिकारिता रखने वाला आबकारी एवं कराधान विभाग का एक अधिकारी होगा, जो कम से कम आबकारी एवं कराधान निरीक्षक की पंक्ति से नीचे का न हो।

No. EXN-F(4)-1/2009-Loose.—In exercise of the powers conferred by Sub-Section (1), (2) and (3) of Section 6 of the Himachal Pradesh Excise Act, 2011, the Governor of Himachal Pradesh is pleased to appoint following classes of Officers as 'Excise Officers' within their respective jurisdiction:—

1. Excise and Taxation Inspector and all ranks above in the Excise Department. 2. Sub-Divisional Magistrate.

3. Tehsildar (Tehsils).

4. Police Officer not below the rank of Asstt. Sub-Inspector in the Police Department.

The Governor of Himachal Pradesh is further pleased to confer the powers to the above Excise Officers to enter, inspect, investigate, search and seize, obtain information and grant bail, under Sections 8, 9, 10, 12 and 54 of the Act ibid:

Provided that the power under Section 8 of the said Act shall be exercised by a police officer not below the rank of Deputy Superintendent of Police who shall be accompanied at least by an officer of the Excise and Taxation Department not below the rank of Excise and Taxation Inspector having jurisdiction.
