No. PBW-A-B(1)-7/2003-I.—In order to execute the works of new National Highway-305 Sainj-Luhri-Ani-Jalori-Jot-Banjar-Aut, in partial modification of this department notification No. PBW(A)B(1)-7/2003 dated 8-12-2003 and letter dated 14-1-2004 wherein re-structuring of National Highways under HPPWD was done, the Governor, Himachal Pradesh is pleased to create two NH Sub Divisions at Ani and Banjar by way of closure of PIU Sub Division Rampur into NH Sub Division Ani and shifting of PIU Sub Division Karsog to NH Sub Division Banjar alongwith sanctioned/existing strength of regular establishment. The required workmen as per the norms of MORTH (GOI) for National Highway works would also be shifted. After this conversion, set up of new NH Sub Divisions and Sections shall be as under:—

संख्या का0 (नि-IV)-ए(3)-1/2010.--हिमाचल प्रदेश की राज्यपाल, भारत के संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, हिमाचल प्रदेश लोक सेवा आयोग के परामर्श से, इस विभाग की अधिसूचना संख्या 7-5/73-डी0 पी0 (नियुक्ति), तारीख 15-3-1973 द्वारा अधिसूचित और राजपत्र, हिमाचल प्रदेश (असाधारण) में तारीख 11-5-1973 को प्रकाशित दी हिमाचल प्रदेश एडमिनिस्ट्रेटिव सर्विस रूल्ज, 1973 में और संशोधन करने के लिए निम्नलिखित नियम बनाती हैं, अर्थात्‌ :--

1. संक्षिप्त नाम और प्रारम्भ.--(1) इन नियमों का संक्षिप्त नाम दी हिमाचल प्रदेश एडमिनिस्ट्रेटिव सर्विस (फस्र्ट अमेंडमेंट) रूल्ज, 2014 है।

(2) ये नियम राजपत्र, हिमाचल प्रदेश में प्रकाशित किए जाने की तारीख से प्रवृत्त होंगे। 2. रूल 7 का संशोधन.--दी हिमाचल प्रदेश एडमिनिस्ट्रेटिव सर्विस रूल्ज, 1973 के रूल 7 के सब रूल (1) के विद्यमान क्लॉज़ (b) और (c) के स्थान पर निम्नलिखित क्लॉज़ रखे जाएंगे, अर्थात्‌ :-- (b) 25% from amongst the Tehsildars who possess Bachelor's Degree or its equivalent of a recognized University and are substantively born on the cadre of Tehsildars of Revenue Department and have two years' continuous service in the grade both in the officiating and substantive capacity;

(c) 17% from the Block Development Officers who possess Bachelor's Degree or its equivalent of a recognized University and are substantively born on the cadre of Block Development Officers of Rural Development Department and have two years' continuous service in the grade both in the officiating and substantive capacity; and (d) 08% from amongst the substantive holders of the following categories of posts who possess Bachelor's Degree or its equivalent of a recognized University and have two years continuous service in the grade both in the officiating and substantive capacity:-

(1) District Panchayat Officer; (2) Manager, District Industries Centre; (3) Section Officer, H.P. Secretariat;

No. Per(A-IV)-A(3)-1/2010.—In exercise of the powers conferred by the proviso to Article 309 of the Constitution of India, the Governor, Himachal Pradesh, in consultation with the Himachal Pradesh Public Service Commission, is pleased to make the following rules further to amend the Himachal Pradesh Administrative Service Rules, 1973, notified vide this Department's Notification No. 7-5/73-DP(Apptt.), dated 15.03.1973 and published in the Rajpatra (Extra Ordinary) dated 11.05.1973, namely:-

1. Short title and commencement.— (1) These rules may be called the Himachal Pradesh Administrative Service (First Amendment), Rules, 2014.

(2) These rules shall come into force from the date of publication in Rajpatra, Himachal Pradesh.

2. Amendment of rule-7.—For the existing clauses (b) and (c) of subrule (1) of rule 7 of the Himachal Pradesh Administrative Service Rules, 1973, the following clauses shall be substituted, namely:-

(b) 25% from amongst the Tehsildars who possess Bachelor's Degree or its equivalent of a recognized University and are substantively born on the cadre of Tehsildars of Revenue Department and have two years' continuous service in the grade both in the officiating and substantive capacity;

No. FDS-Una.—In suppression of all previous orders and notification issued in this regard and in exercise of the powers conferred upon me under clause 2 (d)(i) of the Kerosene Oil (Restriction on use & fixation of ceiling price) order, 1993, I, Abhishek Jain, IAS District Collector Una, do hereby fix the wholesale and retail sale rate of kerosene Oil in Una District as under :—

Basic Rate= 13540-27 Per KL

TKD Rate= 14128-51 Per KL

This notification shall come into force with immediate effect.

Terms & Conditions:—

1. Every Wholesaler and Fair Price Shop Holder/Kerosene Oil Retailer under TPDs, authorized under the provisions of H.P. Specified Articles Regulation of Distribution Order, 2003, will strictly adhere to the provisions of relevant Control Orders, issued by the Central and State Government under the Essential commodities Act, 1955 (10 of 1955 and instructions issued there under in this behalf from time to time.

2. No delivery of Kerosene Oil (Blue Dyed) under TPDS will be Made by the Wholesaler to the authorized retailer before sun rise and after sun set and by the authorized retailer to the ration card holder after closing time of the FPS as per Shop and Establishment Act and on the day of weekly holiday of the FPS. The Wholesaler shall deliver monthly quota to every FPS and the authorized retailer on the wholesaler rate and quantity specified above and mentioned against their names by lifting whole of the allotted quantity before 25th. Of every month The wholesaler will add or deduct the increase or decrease in the procurement rate in the wholesale rate with prior intimation to the office of the District Controller, Food, Civil Supplies & Consumer Affairs, Una, H.P. Similarily the retailer will also add or deduct any increase or decrease in the wholesale rate respectively. Every wholesaler, FPS holder/ authorized retailer will ensure submission of required returns well in time, already specified.

3. Every ration card holder or holder of any other authorized document, issued by the competent authority, will not carry more than the quantity of blue dyed kerosene oil for which he is entitled at one time and shall not store quantity more than one and half times to which he is entitled at one time in his premise

4. No SKO Wholesaler will deviate from this route chart and rate notification without prior permission of the Distt. Collector.

संख्या-पी.सी.एच.-एच.ए.(1)11/2010-1-6674-6815.--हिमाचल प्रदेश पंचायती राज (जिला परिषद्‌ में पंचायत सहायकों की नियुक्ति और सेवा शर्तें) नियम, 2014 को इस विभाग की समसंख्यक अधिसूचना तारीख 21 जनवरी, 2014 द्वारा, हिमाचल प्रदेश पंचायती राज अधिनियम, 1994 (1994 का संख्यांक 4) की धारा 186 के उपबन्धों के अधीन यथा अपेक्षित जनसाधारण से आपेक्ष और सुझाव आमन्त्रित करने के लिए, तारीख 7 फरवरी, 2014 को राजपत्र, हिमाचल प्रदेश में प्रकाशित किया गया था;

और नियत अवधि के भीतर इस सम्बन्ध में कोई भी आक्षेप/सुझाव प्राप्त नहीं हुआ है ;

अतः हिमाचल प्रदेश की राज्यपाल, हिमाचल प्रदेश पंचायती राज अधिनियम, 1994 (1994 का अधिनियम संख्यांक-4) की धारा 186 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए निम्नलिखित नियम बनाती हैं, अर्थातः-

1. संक्षिप्त नाम.--इन नियमों का संक्षिप्त नाम हिमाचल प्रदेश पंचायती राज (जिला परिषद्‌ में पंचायत सहायकों की नियुक्ति और सेवा शर्तें) नियम, 2014 है।

2. परिभाषाएं.--(1) इन नियमों में जब तक कि सन्दर्भ से अन्यथा अपेक्षित न हो,-

(क) "अधिनियम" से हिमाचल प्रदेश पंचायती राज अधिनियम, 1994 (1994 का अधिनियम संख्यांक 4) अभिप्रेत है ;

(ख) ''निदेशक'' से निदेशक, पंचायती राज हिमाचल प्रदेश अभिप्रेत है; और

(ग) "प्ररूप" से इन नियमों से संलग्न प्ररूप अभिपे्रत है।

(2) उन शब्दों और पदों के, जो इन नियमों में प्रयुक्त हैं और परिभाषित नहीं है, के वही अर्थ होंगे जो अधिनियम में उनके हैं।

3. पदों की संख्या.--पंचायत सहायकों के पदों की, अपनीे-अपनी पंचायतों में, ऐसी संख्या होगी, जैसी सरकार द्वारा मंजूर की गई हो और समय-समय पर मंजूर की जाए।

4. पारिश्रमिक.--पंचायत सहायकों को ऐसी दरों पर पारिश्रमिक संदत किया जाएगा जैसी सरकार द्वारा समय-समय पर अधिसूचित की जाए। पंचायत सहायकों को मासिक पारिश्रमिक इस प्रयोजन के लिए सरकार द्वारा उपलब्ध करवाए गए सहायता अनुदान में से सम्बद्ध जिला परिषद्‌ के सचिव के माध्यम से संवितरित किया जाएगा।

परन्तु पंचायत सहायकों को मासिक पारिश्रमिक केवल सम्बद्ध पंचायत के यथास्थिति, प्रधान या उप- प्रधान से उपस्थिति प्रमाण-पत्र प्राप्त करने के पश्चात्‌ ही संवितरित किया जाएगा।

5. सीधी नियुक्ति के लिए आयु और अन्य पात्रताएं.--(1) कोई भी व्यक्ति पंचायत सहायक के रूप में नियुक्त के लिए पात्र होगा, यदि उसकी आयु 18 और 45 वर्ष के बीच हैः

परन्तु यह और कि अनुसूचित जातियों/अनुसूचित जनजातियों/अन्य प्रवर्गों के व्यक्तियों के लिए ऊपरी आयु सीमा में उतनी ही छूट दी जा सकेगी, जितनी हिमाचल प्रदेश सरकार के साधारण या विशेष आदेश (आदेशों) के अधीन अनुज्ञेय है।1960 राजपत्र, हिमाचल प्रदेश, 22 जुलाई, 2014/31 आषाढ़, 1936 (2) अन्य पात्रता शर्तेंः- (क) सीधी भर्ती के लिए आयु सीमा की गणना उस वर्ष के प्रथम दिवस से की जाएगी, जिसमें पद (पदों) को आवेदन आमन्त्रित करने के लिए, यथास्थिति, विज्ञापित किया गया है या नियोजनालयों को अधिसूचित किया गया है;

(ख) अन्यथा सुअर्हित अभ्यर्थियों की दशा में, सीधी भर्ती के लिए आयु सीमा और अनुभव, राज्य सरकार के विवेकानुसार शिथिल किया जा सकेगा;

(ग) वह सम्बद्ध जिला का वास्तविक (बोनाफाइड) निवासी हो;

(घ) वह स्वस्थचित्त और अच्छे स्वास्थ्य का हो;

(ङ) उसे नियुक्ति के लिए निरर्हित न किया गया हो या उसे अनुशासनिक आधारों पर लोक सेवा से पदच्युत न किया गया हो;

(च) उसे नैतिक अधमता से अन्तवर्लित किसी अपराध के लिए दोषसिद्ध न किया गया हो; और (छ) उसका राज्य सरकार या पंचायतों को काई बकाया संदेय न हो।

6. सीधे नियुक्त किए जाने वाले व्यक्तियों के लिए अपेक्षित न्यूनतम अर्हताएं.--(1) पंचायत सहायक के पद पर नियुक्त किया जाने वाला अभ्यर्थी, किसी मान्यता प्राप्त बोर्ड/विश्वविद्यालय से न्यूनतम दस जमा दो की शैक्षिक अर्हता रखता हो या इसके समकक्ष हो।

(2) उन अभ्यर्थियों को अधिमान दिया जाएगा, जो हिमाचल प्रदेश की रूढ़ियों, रीतियों और बोलियों का ज्ञान और प्रदेश में विद्यमान विशिष्ट दशाओं में नियुक्ति के लिए उपयुक्तता रखते हों।

7. नियुक्ति की पद्धति.--अभ्यर्थी सीधी भर्ती द्वारा संविदा के आधार पर नियुक्त किया जाएगा। 8. संविदा नियुक्ति द्वारा पद पर नियुक्ति के लिए चयन.--इन नियमों में किसी बात के होते हुए भी पद पर संविदा नियुक्तियां, नीचे दिए गए निबन्धनों और शर्तों के अध्यधीन की जाएंगीः-

(i) संकल्पना.--(क) इन नियमों के अधीन पंचायत्‌ में पंचायत सहायक को, संविदा के आधार पर प्रारम्भ में एक वर्ष के लिए लगाया जाएगा, जिसे वर्षानुवर्ष आधार पर बढ़ाया जा सकेगाः

परन्तु संविदा अवधि में वर्षानुवर्ष आधार पर विस्तारण/नवीकरण हेतु सम्बद्ध पंचायत समिति का मुख्य कार्यकारी अधिकारी यह प्रमाण पत्र जारी करेगा कि वर्ष के दौरान संविदा पर नियुक्त कर्मचारी की सेवा और आचरण संतोषजनक रही है, केवल तभी मुख्य कार्यकारी अधिकारी, जिला परिषद्‌ द्वारा उसकी संविदा की अवधि नवीकृत/विस्तारित की जाएगी।

(ii) संविदात्मक उपलब्धियां.--पंचायत सहायकों को पारिश्रमिक ऐसी दरों पर संदत किया जाएगा, जैसी राज्य सरकार द्वारा समय-समय पर अधिसूचित की जाएं। पंचायत सहायकों को मासिक पारिश्रमिक इस प्रयोजन हेतु राज्य सरकार द्वारा उपलब्ध करवाए गए सहायता अनुदान में से सम्बद्ध जिला परिषद्‌ के सचिव के माध्यम से संवितरित किया जाएगा।

(iii) नियुक्ति/अनुशासन प्राधिकारी.--सम्बद्ध जिला परिषद्‌ का मुख्य कार्यकारी अधिकारी, नियुक्ति और अनुशासन प्राधिकारी होगा।

(iv) चयन प्रक्रिया.--(क) संबद्ध जिला परिषद्‌ अपने सचिव के माध्यम से व्यापक प्रचार करते हुए संबद्ध जिला परिषद्‌ के सुचना पट्ट (नोटिस बोर्ड) पर सूचना (नोटिस) प्रदर्शित करते हुए और दो स्थानीय1961 राजपत्र, हिमाचल प्रदेश, 22 जुलाई, 2014/31 आषाढ़, 1936 समाचार पत्रों के माध्यम से विज्ञापन द्वारा आवेदन आमंत्रित करेगा। ये रिक्तियां नियोजनालय द्वारा भी अधिसूचित की जाएगी। आवेदन आमंत्रित करने हेतु सूचना (नोटिस) की तारीख से न्यूनतम पन्द्रह दिन की अवधि प्रदान की जाएगी और आवेदन जिला परिषद्‌ के सचिव द्वारा प्राप्त किए जाएंगे। आवेदन जिला परिषद्‌ के सचिव द्वारा सम्यक रूप से हस्ताक्षरित और स्टाम्पित रसीद सहित अभिस्वीकृत किया जाएगा। (ख) आवेदन आमंत्रित करने हेतु विनिर्दिष्ट अवधि के अवसान के ठीक पश्चात्‌ संबद्ध जिला परिषद्‌ का सचिव चयन समिति के अध्यक्ष के परामर्श से पंचायत सहायकों के साक्षात्कार संचालित करने के लिए तारीख, समय और स्थान नियत करेगा। सचिव, चयनसमिति के सदस्यों के साथ-साथ आवेदकों को भी साक्षात्कार के लिए नियत की गई समय अनुसूची की सूचना देते हुए, एक सूचना (नोटिस) जारी करेगाः परन्तु सूचना (नोटिस) जारी करने की तारीख और साक्षात्कार की तारीख के बीच कम से कम दस दिन की अवधि का अन्तर रहेगा; और

(ग) साक्षात्कार, निम्नलिखित चयन समिति द्वारा संचालित किया जाएगाः-

(i) संबद्ध जिला परिषद का मुख्य कार्यकारी अधिकारी ः अध्यक्ष (ii) उप-निदेशक एवं परियोजना अधिकारी डी.आर.डी.ए. ः सदस्य (iii) जिला पंचायत अधिकारी एवं सचिव, जिला परिषद्‌ ः सदस्य

(घ) चयन समिति, प्रमाण पत्रों को उनके मूल प्रमाण पत्रों के साथ सत्यापित करेगी।

(ङ) सचिव, जिला परिषद्‌ अभ्यर्थियों द्वारा उनके आवेदनों सहित दी गई सूचना के आधार पर, इसमें नीचे दिए गए मापदण्ड का अनुसरण करते हुए, एक आंकड़ा सूची का संकलन करेगा, और उक्त आंकड़ों को संकलित करने का कार्य साक्षात्‌कार की तारीख से पूर्व पूर्ण कर लिया जाएगा। वह यह सुनिश्चित करेगा कि यह आंकड़े (डाटा), चयन समिति को, अभ्यर्थियों द्वारा साक्षात्कार की तारीख पर लाए गए मूल अभिलेख के साथ, साक्षात्कार की तारीख पर, इसके सत्यापन के लिए उपलब्ध करवा दिए गए हैं। अभ्यर्थियों का चयन उनकी योग्यता (परफारमैन्स) के आधार पर, पूर्णतया गुणागुण के आधार पर कुल एक सौ अंकों में से किया जाएगा जोकि निम्नलिखित रीति में विभाजित किए जाएंगे, अर्थात्‌ः-

(क) शैक्षणिक अर्हताएं

ः अधिकतम 40 अंकों

(1) दस जमा दो (10़ 2) में अंकों की प्रतिशतता को 2.5 द्वारा विभाजित करके।

(2) बीबीए, बीसीए, बीए, बीएससी, बी कॉम, सिविल इंजीनियरिंग में डिप्लोमा में अंको की प्रतिशतता को 5 द्वारा विभाजित करके। (3) वाणिज्य, विज्ञान, अर्थशास्त्र, गणित में अधिस्नातक की उपाधि, (मास्टर डिग्री) एमसीए, एमबीए, एम कॉम किसी भी विषय में बीई/बी-टैक वाले अभ्यर्थियों की दशा में अंक (ख) अनुभव (1) किसी पंचायती राज संस्थान/सरकारी कार्यालय/सरकारी उपक्रम/संस्था/अभिकरण (एैजेन्सी) में लिपकीय हैसियत से सुसंगत कार्य करने के प्रत्येक एक वर्ष के अनुभव के लिए एक अंक प्रदान किया जाएगा। (2) यदि अभ्यर्थी संबद्ध जिला परिषद्‌ के क्षेत्र का निवासी है। (3) (क) यदि अभ्यर्थी ने कम्प्यूटर में न्यूनतम छह मास का डिप्लोमा किया है।1962 राजपत्र, हिमाचल प्रदेश, 22 जुलाई, 2014/31 आषाढ़, 1936 ः 5 अंक

(ख) यदि अभ्यर्थी ने कम्प्यूटर में न्यूनतम एक वर्ष का डिप्लोमा किया है। (ग) निजी साक्षात्कार

ः 15 अंक

(च) सचिव, जिला परिषद्‌ उपरोक्त (क) और (ख) में उपबंधित अंकों के मापदण्डों के आधार पर योग्यता सूची तैयार करेगा और साक्षात्कार हेतु एक रिक्ति के विरूद्ध दस अभ्यर्थी बुलाएगाः

(छ) सचिव, जिला परिषद्‌, गुणागुण के क्रम और पंचायत सहायकों की रिक्तियों की संख्या को ध्यान में रखते हुए अभ्यर्थियों का एक पैनल बनाएगा; अभ्यर्थी जो पैनल में प्रथम स्थान पर हैं, को पंचायत सहायकों के पदों पर नियुक्ति के लिए चयनित किया जाएगा। पंचायत सहायकों की अपेक्षित संख्या के चयन के पश्चात्‌ रिक्तियों को भरने के लिए अभ्यर्थियों की उनके गुणागुण के क्रम में प्रतीक्षा सूची भी तैयार की जाएगी और ऐसी प्रतीक्षा सूची उस कैलेण्डर वर्ष के लिए जिसमें अभ्यर्थियों का चयन किया गया है, विधिमान्य होगी। (v) कार्य समय.--पंचायत सहायक पूर्णकालिक कर्मी होगा और वह प्रत्येक कार्य दिवस को ग्राम पंचायत द्वारा अनुरक्षित उपस्थिति रजिस्टर में अपनी उपस्थिति चिन्हित करेगा। उपस्थिति रजिस्टर प्रधान या उप-प्रधान द्वारा सत्यापित और प्रतिहस्ताक्षरित किया जाएगाः

परन्तु, यथास्थिति, प्रधान या उप-प्रधान प्रत्येक मास की समाप्ति पर उपस्थिति प्रमाण-पत्र जारी करेगा।

(vi) नियुक्ति और करार.--किसी अभ्यर्थी के चयन के पश्चात्‌ उसको प्ररूप-1 में नियुक्ति पत्र जारी किया जाएगा। तत्पश्चात्‌, उसको प्ररूप-II के अनुसार एक करार हस्ताक्षरित करना होगा।

(vii) निबन्धन और शर्तें.--(क) पंचायत सहायक को ऐसी दरों पर पारिश्रमिक संदत्त किया जाएगा, जैसी राज्य सरकार द्वारा समय-समय पर अधिसूचित की जाएं। पंचायत सहायक को मासिक पारिश्रमिक, इस प्रयोजन हेतु राज्य सरकार द्वारा उपबंधित सहायता अनुदान में से सम्बद्ध जिला परिषद्‌ के सचिव के माध्यम से संवितरित किया जाएगा।

(ख) संविदा पर नियुक्त व्यक्ति की सेवा पूर्णतया अस्थायी आधार पर होगी। यदि पंचायत सहायक अनाचार में संलिप्त पाया जाता है या अपने कर्तव्यों का निर्वहन नहीं करता है या दाण्डिक अपराध में संलिप्त पाया जाता है या अनुशासनहीनता का कार्य करता है या निधियों के दुरूपयोग या गबन में संलिप्त पाया जाता है तो उसे सम्बद्ध जिला परिषद्‌ के मुख्य कार्यकारी अधिकारी द्वारा उसके आचरण का स्पष्टिकरण देने हेतु कहा जा सकेगा। यदि उसका स्पष्टीकरण समाधानप्रद नहीं पाया जाता है तो उक्त मुख्य कार्यकारी अधिकारी उक्त संविदा पर नियुक्त व्यक्ति के विरूद्ध अनुशासनात्मक कार्यवाहियां आरम्भ कर सकेगा। इसके अतिरिक्त, यदि उसको आबंटित ग्राम पंचायत, दो-तिहाई बहुमत से कोई संकल्प पारित करती है और उसको संबद्ध जिला परिषद के मुख्य कार्यकारी अधिकारी को अग्रेषित करती है, कि वह उसको सौंपे गए कर्त्तव्यों का निर्वहन उचित प्रकार से नहीं कर रहा है या अनुशासनहीनता के किसी कृत्य में संलिप्त है, तो उक्त मुख्य कार्यकारी अधिकारी संविदा पर नियुक्त कर्मचारी के विरूद्ध अनुशासनात्मक कार्यवाहियां आरम्भ करेगा। इन नियमों के अधीन अनुशासनात्मक कार्यवाहियां संचालित करते हुए अनुशासनात्मक प्राधिकारी यह सुनिश्चित करेगा कि नैसर्गिक न्याय के नियमों का अनुसरण किया जाए। मुख्य कार्यकारी अधिकारी अवचार की गंभीरता पर निर्भर करते हुए निम्नलिखित शास्तियों में से एक या एक से अधिक अधिरोपित कर सकेगाः-

(i) परिनिंदा (सैनशयूर); (ii) 5000/- रूपए का जुर्माना उसके पारिश्रमिक में से घटाकर; (iii) की गई किसी हानि की वसूली; (iv) वेतनवृद्धि रोकना; और (v) संविदा की समाप्ति और सेवा से हटाया जानाः

(ग) संविदा पर नियुक्त व्यक्ति एक मास की सेवा पूरी करने के पश्चात्‌ एक दिन के आकस्मिक अवकाश का हकदार होगा। यह अवकाश एक वर्ष तक संचित किया जा सकेगा। संविदा पर नियुक्त व्यक्ति1963 राजपत्र, हिमाचल प्रदेश, 22 जुलाई, 2014/31 आषाढ़, 1936 को किसी भी प्रकार का अन्य कोई अवकाश अनुज्ञात नहीं होगा। वह चिकित्सा प्रतिपूर्ति और एल0टी0सी0 इत्यादि के लिए भी हकदार नहीं होगा/होगी। केवल प्रसूति अवकाश, नियमानुसार दिया जाएगा। (घ) सक्षम प्राधिकारी के अनुमोदन के बिना सेवा से अनधिकृत अनुपस्थिति से स्वतः ही संविदा का पर्यावसान हो जाएगा। संविदा पर नियुक्त व्यक्ति कर्तव्य (ड्‌यूटि) से अनुपस्थिति की अवधि के लिए संविदात्मक रकम का हकदार नहीं होगा।

(ङ) संविदा पर नियुक्त कर्मचारी, जिसने तैनाती के एक स्थान पर तीन वर्ष का कार्यकाल पूर्ण कर लिया है, अपने-अपने जिला परिषद्‌ जिला के भीतर आवश्यकतानुसार प्रशासनिक आधार पर स्थानातंरण के लिए पात्र होगा। पंचायत सहायक का स्थानांन्तरण सम्बद्ध जिला परिषद के मुख्य कार्यकारी अधिकारी द्वारा किया जाएगा।

(च) चयनित अभ्यर्थी को सरकारी/रजिस्ट्रीकृत चिकित्सा व्यवसायी से अपना आरोग्य प्रमाण-पत्र प्रस्तुत करना होगा। बारह सप्ताह से अधिक समय से गर्भवती महिला प्रसव होने तक, अस्थायी तौर पर अनुपयुक्त समझी जाएगी। महिला अभ्यर्थियों का किसी प्राधिकृत चिकित्सा अधिकारी/व्यवसायी द्वारा उपयुक्तता के लिए पुनः परीक्षण किया जाएगा।

(छ) संविदा पर नियुक्त व्यक्ति का यदि अपने पदीय कर्तव्यों के सम्बन्ध में दौरे पर जाना अपेक्षित हो, तो वह उसी दर पर, जैसी नियमित प्रतिस्थानी कर्मचारियों को वेतनमान के न्यूनतम पर लागू है, यात्रा भत्ते/दैनिक भत्ते का हकदार होगा/होगी।

(ज) नियमित कर्मचारियों की दशा में यथा लागू सेवा नियमों के उपबन्ध जैसे एफ0आर0, एस0आर0, छुट्‌टी नियम, साधारण भविष्य निधि नियम, पेंशन नियम तथा आचरण नियम आदि संविदा पर नियुक्त व्यक्तियों की दशा में लागू नहीं होंगे। वे इस स्तम्भ में यथावर्णित उपलब्धियों आदि के लिए हकदार होंगे। 9. नियुक्ति प्राधिकारी और पंचायतों का आबंटन.--(1) सम्बद्ध जिला परिषद का मुख्य कार्यकारी अधिकारी नियुक्ति प्राधिकारी होगा और नियुक्ति-पत्र उसके द्वारा जारी किया जाएगा। वह पंचायत सहायक को ग्राम पंचायत का आंबंटन अनुमोदित करेगा।

परन्तु पंचायत सहायक को गृह ग्राम पंचायत/निकटवर्ती ग्राम पंचायत आबंटित नहीं की जाएगी। (2) सम्बद्ध पंचायत समिति का मुख्य कार्यकारी अधिकारी, दौरा कार्यक्रम, छुट्‌टी, कार्य और आचरण प्रमाण-पत्र आदि के लिए नियंत्रण अधिकारी होगा। जिला परिषद्‌ का सचिव, मुख्य कार्यकारी अधिकारी, पंचायत समिति के परामर्श से, पंचायतों का आबंटन इस प्रकार करेगा कि आबंटित पंचायतों का सामीप्य सुनिश्चित किया जा सके।

10. आरक्षण.--सेवा में नियुक्ति, हिमाचल प्रदेश सरकार द्वारा, समय-समय पर अनुसूचित जातियों/ अनुसूचित जनजातियों/पिछड़े वर्गों/अन्य प्रवर्गों के व्यक्तियों के लिए सेवा में आरक्षण की बाबत जारी किए गए अनुदेशों के अधीन होगी।

11. जॉब चाट.--पंचायत सहायक के लिए जॉब चार्ट ऐसा होगा, जैसा समय-समय पर विनिर्दिष्ट किया जाए।

12. प्रशिक्षण और परीक्षा.--सेवा के सदस्यों को परीक्षा उत्तीर्ण करनी होगी या समय-समय पर विनिर्दिष्ट किए जाने वाले प्रशिक्षण के ऐसे क्रम प्राप्त करने होंगे।

परन्तु यह कि पांच वर्ष के भीतर ऐसी परीक्षा उत्तीर्ण करने के लिए तीन अवसर प्रदान किए जाएंगे और सम्बद्ध कर्मचारी द्वारा परीक्षा उत्तीर्ण न किए जाने की दशा में, ऐसे कर्मचारी भविष्य में वेतनवृद्धियों, स्थानन, पुनःपदनाम इत्यादि के लिए हकदार नहीं होगा। 1964 राजपत्र, हिमाचल प्रदेश, 22 जुलाई, 2014/31 आषाढ़, 1936 13. शिथिल करने की शक्ति.--जहां राज्य सरकार की यह राय हो कि ऐसा करना आवश्यक या समीचीन है, वहां यह कारणों को लिखित में अभिलिखित करके, आदेश द्वारा, इन नियमों के किन्हीं उपबन्धों को, किसी वर्ग या व्यक्ति (व्यक्तियों) के प्रवर्ग या पद (पदों) की बाबत, शिथिल कर सकेगी।

14. निरसन और व्यावृत्तियां.--(1) अधिसूचना संख्या पी0सी0एच0-एच0ए0 (3) 25/2007 तारीख 4 सितम्बर 2008 द्वारा अधिसूचित हिमाचल प्रदेश पंचायती राज (पंचायत सहायकों की नियुक्ति और सेवा की शर्तें) नियम, 2008 का एतत्‌द्वारा निरसन किया जाता है।

(2) ऐसे निरसन के होते हुए भी, उप-नियम 14 (1) के अधीन इस प्रकार निरसित नियमों के अधीन की गई कोई नियुक्ति, बात या कार्रवाई, इन नियमों के अधीन विधिमान्य रूप में की गई समझी जाएगी।

1. उसे प्रतिमास ..................... रूपए (अंको में) .............................. (अक्षरों में) पारिश्रमिक संदत किया जाएगा;

2. कोई अन्य भत्ता, जो भी राज्य सरकार के कर्मचारियों को समय-समय पर अनुज्ञेय है, उसे संदत नहीं किया जाएगा;

3. नियुक्ति, संविदा आधार पर, कार्यग्रहण करने की तारीख से एक वर्ष की अवधि के लिए होगी;

4. नियुक्ति आगे, नियमों और करार में अधिकथित निबन्धनों और शर्तों के भी अध्यधीन होगी;

5. कार्यग्रहण रिपोर्ट प्रस्तुत करते समय, उसके द्वारा कार्यकारी मजिस्ट्रेट या पिछले कम से कम तीन वर्ष से उसे जानने वाले दो राजपत्रित अधिकारियों से, अधोहस्ताक्षरी के समाधान के लिए, पूर्ववृत सत्यापन प्रमाणपत्र दिया जाएगा;

6. नियुक्ति, पद पर कार्यग्रहण करने से पूर्व किसी सरकारी/रजिस्ट्रीकृत चिकित्सा व्यवसायी द्वारा स्वस्थतता प्रमाण पत्र प्रस्तुत करने के अध्यधीन होगी; और

7. यथास्थिति, शैक्षिक अर्हताओं, जाति, स्थायी निवासी, शारीरिक अक्षमता, गरीबी रेखा से नीचे से संबन्धित सदस्य या पूर्व अनुभव की बाबत, मूल प्रमाणपत्रों की अनुप्रमाणित प्रतियां कार्यग्रहण रिपोर्ट के साथ प्रस्तुत की जाएगी।

यदि उसे, उपरोक्त निबन्धन और शर्ते स्वीकार्य हैं, तो वह, अधोहस्ताक्षरी के कार्यालय में तुरन्त, किन्तु इस नियुक्ति पत्र के जारी करने की तारीख से 15 दिन के अपश्चात्‌, संविदा करार के निष्पादन के साथ-साथ कार्यग्रहण के लिए रिपोर्ट कर सकेगा/सकेगी।

2. प्रथम पक्षकार की संविदात्मक रकम ..............................रूपए प्रतिमास होगी।

4. पंचायत सहायक एक मास की सेवा पूरी करने के पश्चात्‌ एक दिन के आकस्मिक अवकाश का हकदार होगा। यह अवकाश एक वर्ष तक संचित किया जा सकेगा। संविदा पर नियुक्त पंचायत सहायक को किसी भी प्रकार का अन्य कोई अवकाश अनुज्ञात नहीं होगा। वह चिकित्सा प्रतिपूर्ति और एल0टी0सी0 इत्यादि के लिए भी हकदार नहीं होगा/होगी। केवल प्रसूति अवकाश, नियमानुसार दिया जाएगा।

5. नियन्त्रक अधिकारी के अनुमोदन के बिना कर्तव्यों से अनाधिकृत अनुपस्थिति से स्वतः ही संविदा का पर्यावसान (समापन) हो जाएगा। संविदा पर नियुक्त पंचायत सहायक कर्तव्य (ड्‌यूटी) से अनुपस्थिति की अवधि के लिए संविदात्मक रकम का हकदार नहीं होगा।

6. संविदा पर नियुक्त व्यक्ति, जिसने तैनाती के एक स्थान पर तीन वर्ष का कार्यकाल पूर्ण कर लिया हो सम्बद्ध जिला परिषद्‌ (जिला) के भीतर आवश्यक्तानुसार प्रशासनिक आधार पर स्थानान्तरण हेतु पात्र होगा। स्थानान्तरण सम्बद्ध जिला परिषद के मुख्य कार्यकारी अधिकारी द्वारा किया जाएगा।

NO.PCH-HA-(1) 11/2010-I-6674-6815.—Whereas the draft Himachal Pradesh Panchayati Raj (Appointment and Conditions of Service of Panchayat Sahayaks in Zila Parishads) Rules, 2014 were published in the Rajpatra, Himachal Pradesh dated 7th February, 2014 for inviting1967 राजपत्र, हिमाचल प्रदेश, 22 जुलाई, 2014/31 आषाढ़, 1936 objectiohgns and suggestions from the general public, vide this department notification of even number dated 21st January, 2014 as required under the provisions of section 186 of the Himachal Pradesh Panchayati Raj Act, 1994 (Act No. 4 of 1994);

And whereas no objection/suggestion has been received in this behalf during the stipulated period ;

Now, therefore, in exercise of the powers conferred by section 186 of the Himachal Pradesh Panchayati Raj Act, 1994 (Act No. 4 of 1994), the Governor of Himachal Pradesh is pleased to make the following rules, namely:-

1. Short title.These rules may be called the Himachal Pradesh Panchayati Raj (Appointment and Conditions of Service of Panchayat Sahayaks in Zila Parishads) Rules, 2014.

2. Definitions.—(1) In these rules, unless the context otherwise requires,-

"Act" means the Himachal Pradesh Panchayati Raj Act, 1994; (Act No.4 of 1994) "Director" means the Director of Panchayati Raj, Himachal Pradesh; and

"Form" means a form appended to these rules.

(2) The words and expressions used but not defined in these rules shall have the same meaning as respectively assigned to them in the Act.

3. Number of Posts.There shall be such number of posts of Panchayat Sahayaks as sanctioned and may be sanctioned by the State Government from time to time in the respective Panchayats.

4. Remuneration.—The Panchayat Sahayak shall be paid remuneration at such rates as may be notified by the State Government from time to time. The monthly remuneration shall be disbursed to the Panchayat Sahayaks through the Secretary of the Zila Parishad concerned out of the Grant-in-Aid provided by the State Government for this purpose:

Provided that the monthly remuneration to the Panchayat Sahayaks will be disbursed only after obtaining certificate of attendance from the Pradhan or Up-Pradhan, as the case may be, of the Gram Panchayat concerned.

5. Age for direct appointment & other eligibilities.— (1) A person to be appointed as Panchayat Sahayak shall be eligible if he is between 18 and 45 years of age:

Provided further that upper age limit is relaxable for Scheduled Castes/Scheduled Tribes/ Other Categories of persons to the extent permissible under the General or Special Order (s) of the State Government:

(2) Other Eligibility Conditions:-

(a) age limit for direct recruitment will be reckoned on the first day of the year in which the post(s) is/ are advertised for inviting applications or notified to the Employment Exchanges, as the case may be.

(b) age and experience, in the case of direct appointment, are relaxable at the discretion of the State Government in case the candidate is otherwise well qualified.

(c) he is a bonfide resident of the district concerned;

(d) he is of sound mind and good health;

(e) he has not been disqualified for appointment in public service or dismissed from public service on disciplinary grounds;

(f) he has not been convicted of any offence involving moral turpitude; and (g) he has not any outstanding dues payable to the State Government or the Panchayats.

6. Minimum educational qualifications required for direct appointment.—(1) The candidate to be appointed as Panchayat Sahayak must possess minimum educational qualification of 10 + 2 or its equivalent, from a recognized Board/university.

(2) Preference shall be given to those candidates who have knowledge of customs, manners and dialects of Himachal Pradesh and suitability for appointment in the peculiar conditions prevailing in the State.

7. Method of appointment.—The candidate shall be appointed by direct recruitment on contract basis.

8. Selection for appointment to the post by Contract Appointment.Notwithstanding anything contained in these rules, contract appointments to the post will be made subject to the terms and conditions given below:-

(I) CONCEPT.—Under these rules the Panchayat Sahayak in Panchayats will be engaged on contract basis initially for one year, which may be extended on year to year basis:

Provided that for extension/renewal of contract period on year to year basis, the concerned Executive Officer of Panchayat Samiti shall issue a certificate that the service and conduct of the contract appointee is satisfactory during the year and only then his period of contract is to be renewed/ extended by Chief Executive Officer, Zila Parishad.

(II) CONTRACTUAL EMOLUMENTS.—The Panchayat Sahayak shall be paid remuneration at such rates as may be notified by the State Government from time to time. The monthly remuneration shall be disbursed to the Panchayat Sahayaks through the Secretary of the Zila Parishad concerned out of the Grant-in-Aid provided by the State Government for this purpose.

(III) APPOINTING/DISCIPLINARY AUTHORITY.—The Chief Executive Officer of the concerned Zila Parishad will be the appointing and disciplinary authority.

(IV) SELECTION PROCESS.—(a) The Zila Parishad concerned, through its Secretary, shall invite applications by making wide publicity by displaying a notice on the notice board of the concerned Zila Parishad and advertisement through two local newspapers. These vacancies shall also be notified to the Employment Exchange. A minimum period of 15 days shall be given for inviting applications from the date of notice and the applications shall be received by the Secretary of the Zila Parishad. The application shall be acknowledged with receipt duly signed and stamped by the Secretary of Zila Parishad.

(b) Immediately after the expiry of the period specified for inviting of applications, the Secretary of the Zila Parishad concerned shall fix the date, time and place for conduct of interview of Panchayat Sahayaks in consultation with the Chairman of the slection committee. The Secretary shall issue a notice, intimating the time scheduled fixed for interview, to the members of the selection committee and as well as to the applicants:

Provided that there shall be a minimum period of ten days between the date of issue of notice and date of interview; and.

(c) Interview will be conducted by the following selection Committee:-

(i) Chief Executive Officer of the concerned Zila Parishad : Chairman

(ii) Deputy Director-cum-Project Officer, DRDA : Member (iii) District Panchayat Officer-cum-Secretary, Zila Parishad : Member

(d) The selection committee shall verify the certificates with their originals.

(e) The Secretary, Zila Parishad on the basis of the information supplied by the candidates alongwith their applications shall compile a data list by following the criteria given hereunder and the exercise of compilation of said data shall be completed before the date of interview. He shall ensure that this data is provided to the selection committee on the date of interview for verification of the same with the original record brought by the candidates on the date of interview. The selection shall be made on the basis of the performance of the candidates purely on merit basis out of the total one hundred marks which shall be divided in the following manner:-

(A) Educational Qualifications:

: 10 marks

(1) Percentage of marks in (10 + 2) divided by 2.5 : maximum of 40 marks : maximum of 20 marks (2) Percentage of marks in BBA, BCA, BA, BSc, B.Com, Diploma in Civil Engineering divided by 5. (3) Marks in case of the candidate having Master's degree in Commerce, Science, Economics, Mathematics, MCA, MBA, M.Com, BE/B-Tech in any subject.

(B) Experience

: maximum of 5 marks (1) One mark shall be awarded for evey one year of experience in relevant field of duties in any Panchayati Raj Institution. Government office, Government undertaking/Institution/agency in clerical capacity

(2) In case the candidate is resident of the area of : 5 marks

concerned Zila Parishad.

(3) (a) In case candidate has done minimum six months diploma in computer. (b) In case candidate has done minimum one year diploma in computer. (C) Personal Interview.

(f) The Secretary, Zila Parishad shall workout the merit on the basis of criteria of marks provided in (A) to (B) above and shall call 10 candidates against one vacancy for interview.

(g) The Secretary of the Zila Parishad shall draw a panel of the candidates in the order of merit and in view of the number of vacancies of Panchayat Sahayaks; the candidates who are first on the panel shall be selected for appointment to the posts of Panchayat Sahayaks. After the selection of the required number of Panchyat Sahayaks, a waiting list of the candidates, in the order of their merit, shall also be prepared for filling up of vacancies and such waiting list shall be valid for the calendar year in which selection of candidates has been done.

(V) WORKING HOURS.—The Panchayat Sahayak shall be the whole time worker and he shall mark his presence in the attendance register maintained by the Gram Panchyat on each working day. The attendance register shall be verified and countersigned by the Pradhan or the Up- Pradhan:

Provided that the Pradhan or the Up-Pradhan, as the case may be, at the close of each month will issue a certificate of attendance.

(VI) APPOINTMENT AND AGREEMENT.—After selection of a candidate and the appointment letter is issued to him in Form-I. Thereafter, he shall have to sign an agreement as per Form-II.

(VII) TERMS AND CONDTIONS.—The Panchayat Sahayak shall be paid remuneration at such rates as may be notified by the State Government from time to time. The monthly remuneration shall be disbursed to the Panchayat Sahayaks through the Secretary of the Zila Parishad concerned out of the Grant-in-Aid provided by the State Government for this purpose.

(a) The service of the Contract Appointee will be purely on temporary basis. In case the Panchayat Sahayak is found indulging in malpractices or does not perform his duties or has involvement in criminal offences or commits acts of indiscipline or is involved in misutilization or embezzlements of funds, he may be asked to explain his conduct by the Chief Executive Officer of the Zila Parishad concerned. In case his explanation is not found satisfactory, the said Chief Executive Officer may initiate the disciplinary proceedings against the said Contract Appointee. Further, in case, the Gram Panchayat allotted to him passes a resolution with two-third majority and forward the same to the Chief Executive Officer, of the Zila Parishad concerned that he is not performing the duties assigned to him properly and is indulging in an act of indiscipline, the said Chief Executive Officer shall initiate the disciplinary proceedings against the Contract Appointee. While conducting the disciplinary proceedings under these rules, the Disciplinary Authority shall ensure that the rules of natural justice are followed. The Chief Executive Officer may impose one or more of the following penalties depending on the gravity of misconduct:-

(i) Censure; (ii) Fine up to Rs.5000/- by deduction from his remuneration; (iii) Recovery of any loss caused; (iv) Stopage of increment; and (v) Termination of contract and removal from service.

(c) The Contract Appointee will be entitled to one day causal leave after putting one month's service. This leave can be accumulated up to one year. Leave of any other kind will not be admissible to the contract appointee. He/She shall not be entitled for Medial Re-imbursement and LTC etc. Only maternity leave will be given as per rules.

Unauthorized absence from the duty without the approval of the competent authority shall automatically lead to the termination of the contract. Contract Appointee shall not be entitled for contractual amount for the period of absence from duty.

An official appointed on contract basis who has completed three years tenure at one place of positing will be eligible for transfer on need basis within the respective Zila Parishad (District) on administrative ground (s). The transfer of the Panchayat Sahayak shall be done by the Chief Executive Officer of the concerned Zila Parishad.

Selected candidate will have to submit a certificate of his/her fitness from a Government/Registered Medical Practitioner. Woman candidate pregnant beyond 12 weeks will stand temporarily unfit till the confinement is over. The woman candidate will be got re-examined for fitness from an authorized Medical Officer/Practitioner.

Contract appointee will be entitled to TA/DA if required to go on tour in connection with his/her official duties at the same rate as are applicable to their regular counter-part officials at the minimum of pay scale.

Provisions of service rules like FR/SR, Leave Rules, GPF Rules, Pension Rules and Conduct rules etc. as are applicable in case of regular employees will not be applicable in case of contract appointees. They will be entitled to emoluments etc. at such rates as may be notified by the State Government from time to time.

9. Appointing Authority and allocation of Panchayats.—(1) The Chief Executive Officer of concerned Zila Prishad shall be the appointing authority and letter of appointment shall be issued by him. He shall approve the allocation of Gram Panchyat to the Panchayat Sahayak.

Provided that home Gram Panchayat/ adjoining Gram Panchayat shall not be allocated to the Panchayat Sahayak.

(2) The Chief Executive Officer of the concerned Panchyat Samiti shall be the controlling officer for tour programme, leave, work & conduct certificate etc. The Secretary of Zila Parishad shall allocate the Panchayats in consultation with the Chief Executive Officer, Panchayat Samiti in such a way that contiguity of the allocated Panchayats is ensured.

10. Reservation.The appointment to the service shall be subject to orders regarding reservation in the service for Scheduled Castes/ Scheduled Tribes/ Backward Classes/ Other Categories of persons issued by the Himachal Pradesh Government from time to time.

11. Job Chart.The job chart for the Panchayat Sahayak shall be such as may be specified by the Director from time to time.

12. Training and Examination.The members of the service shall have to qualify examination or to undergo such courses of training to be specified, from time to time:

Provided that three chances shall be provided to qualify such examination within five years and in the event of not qualifying the examination by the concerned employee, such employee shall not be entitled for future increment, placement, redesignation etc.

13. Power to relax.Where the State Government is of the opinion that it is necessary or expedient to do so, it may, by order for reasons to be recorded in writing, relax any of the provisions(s) of these rules with respect to any class or category of person (s) or post (s).

14. Repeal and Savings. (1) The Himachal Pradesh Panchayti Raj (Appointment and conditions of service of Panchayat Sahayaks) Rules, 2008 notified vide notification No.PCH-HA (3) 25/2007 dated 4th September, 2008 are here by repealed.

(2) Notwithstanding such repeal, any appointment made, or anything done or any action taken, under the scheme so repealed under sub-rule 14(1), shall be deemed to have been validly made, done or taken under these rules.

5. the antecedent verification certificate to the satisfaction of the undersigned from the Executive Magistrate or two Gazetted officers known to him/her at least for the last three years shall be given by him/her at the time of submission of joining report;

6. the appointment shall be subject to the production of Certificate of Medical Fitness issued by a Government/Registered Medical Practitioner before joining the post; and 7. the attested copies of original certificates in respect of educational qualifications, caste, bonafide resident, physically handicapped, member belonging to below poverty line or past experience, as the case may be, shall be submitted along with joining report.

In case, the above terms and conditions are acceptable to him, he/she may report for execution of the contract agreement as well as for joining duty in the office of undersigned immediately but not later than fifteen days from the date of issue of this appointment letter.

No leave of any other kind will be admissible to the contractual Panchayat Sahayak. He will not be entitled to Medical Reimbursement and LTC etc. Only Maternity Leave will be given as per rules.

5. Unauthorized absence from duty without the approval of the Controlling Officer shall automatically lead to the termination of the contract. A contractual Panchayat Sahayak will not be entitled for contractual amount for the period of absence from duty.

6. An official appointed on contract basis who has completed three years tenure at one place of posting will be eligible for transfer on need based basis within the concerned Zila Prishad (District) on administrative grounds. The transfer shall be done by the Chief Executive Officer of the concerned Zila Parishad.

7. Selected candidate will have to submit a certificate of his/her fitness from a Government/Registered Medical Practitioner. She shall be got re-examined for fitness from an authorized Medical Officer/ Practitioner.

No. 5-21/2012-ELN-Loose.—On the recommendations of Departmental Promotion Committee, the Governor, Himachal Pradesh, is pleased to order promotion of Sh. Upender Nath Shukla, Naib-Tehsildar (Election) to the post of Tehsildar (Election) in the pay scale of Rs. 10300- 34800/- plus Rs. 5000/- Grade Pay against vacancy of Tehsildar (Election), with immediate effect.

The Governor, Himachal Pradesh, is further pleased to order posting of aforesaid officer as Tehsildar (Election) in the District Election Office, Kullu against vacancy.

The above officer will remain on probation for a period of two years subject to such further extension for a period not exceeding one year as may be ordered by the competent authority in special circumstances and reasons to be recorded in writing.

The above officer will have to exercise option for fixation of pay under the provisions of saving clause of FR-22(I)(a)(1) within a period of one month from the date of joining as Tehsildar(Election).
