Dated the 10 April, 2015

No. SEC (16)-2/2014-601-718.—Whereas the general elections to the Municipal Councils and Nagar Panchayats are due in this year and therefore, the State Election Commission has decided to update the electoral roll of all Municipalities in Himachal Pradesh by using the data base of the Election Commission of India updated as on 1.1.2015;

Consequently the State Election Commission hereby notifies 1.1.2015 as qualifying date to determine the eligibility of a person to be registered in the electoral roll of a Municipality under Rule 5 (e) of the HP Municipal (Election) Rules, 1994.

Further, the Commission in exercise of the powers vested in it under Article 243-ZA of the Constitution of India, Section 281of the HP Municipal Act, 1994 read with Rule 3 of the HP Municipal Election Rules, 1994, hereby directs the revision of electoral roll and issues the following directions in this behalf:

1. The State Election Commission has created District User (UD) for each District The District User will create Municipal Users in respect of each Municipality for the use of ERMS Software immediately on the receipt of these instructions. District User will keep a proper account of Municipal Users and monitor their functioning on day to day basis.

2. The working copy of the draft electoral roll for each Municipality has been made available on line through Electoral Roll Management System Software (ERMS) by the NIC online in two parts. The composition of two parts will be as follows:-

Part-I:-

a. It will consist of previously finally published electoral rolls. The electors in this list are already segregated in municipal wards. So part-I will be ward-wise in respect of each Municipality. The names in this part will appear House No. wise. A copy of this part will be printed immediately. However one copy of this part will be saved in the computer hardware and one copy of the same will be retained as soft copy (in C Ds) for record.

b. The electors who have been deleted, modified or shifted will appear in Part-I as such with words '' हटाए गए'', ''संशोधित'' or स्थानान्त्रित''.

Part-II:-

a. This part will consist of those new electors, who are registered by the Election Commission of India during 2014 and 2015 with 1.1.2014 and 1.1.2015 respectively as qualifying date. These electors are yet not been segregated ward-wise in the Municipal area. All new electors will be marked as ''नया'',325 राजपत्र, हिमाचल प्रदेश, 17 अप्रैल, 2015/27 चैत्र, 1937 b. This part will also include those electors of Part-I who are:- i. without EPIC No. or Photograph ;

ii. Modified electors (marked as ''संशोधित'' in Part-I );

iii. Shifted electors (marked as स्थानान्त्रित'' in Part-I).

The existing Ward and Serial Number in Part-I of electors falling in all of the above 3 categories will also be shown with each other.

c. The electors in Part-II will be depicted Municipality / Revenue Village wise. These rolls will be in alphabetical order ( वर्णाक्रमानुसार ) of Elector's Name, Relative Name. This will bring multiple entries of an elector together in order to check the dual registration.

3. The Sub-Divisional Officer (SDO) (Civil) will print a copy of Part-I and Part-II of the working copy of the electoral roll immediately and hand over these copies to the respective Executive Officer / Secretary as the case may be.

Exercise to be undertaken in Part-I

4. The Executive Officer/Secretary of the Municipality concerned will be responsible to get the checking of the Part-I of working copies of electoral roll done for every ward and have comparison of these working copies with the previously finally published electoral roll and ensure that number of electors in each ward are correct. He may depute a team of responsible officials to do this work. He will certify that he has got the Part-I of the working electoral roll checked in respect of every ward and verify that:

(a) He has compared the working copy of the draft electoral roll in respect of each ward with previously finally notified electoral roll.

(b) that no elector is appearing in incorrect ULB or Ward or adjoining Panchayats. If there are any discrepancies in the Part-I of working copies, he will immediately bring this fact to the notice of District User (UD) in writing. The District User will inform the State User immediately.

5. If any elector(s) is (are) appearing in incorrect ward / ULB or adjoining Panchayat they shall be corrected at the working copy stage by shifting meaning thereby that the shifting of electors will be allowed at working stage also.

6. There is possibility of multiple appearances of a name of an elector against single EPIC No. in a particular ward. In such cases only one entry will be kept whereas all other multiple entries from the ward shall be deleted.

7. If an elector is appearing in more than one ward of a particular Municipality, in such cases a list of such cases will be prepared and sent to the Deputy Commissioner. The Deputy Commissioner will issue a notice to the person concerned in Annexure-A to choose one ward. Thereafter the name of that person shall be deleted by the Municipal user from all other wards except one chosen by the elector. The name shall be deleted after the permission of Deputy Commissioner. An entry to this effect will be made in the ERMS indicating permission number and date.

If it comes to the notice that the name of an elector is appearing in more than one Municipality / Panchayat simultaneously, his name shall be deleted from all the Municipalities / Panchayats except one by serving him notice by the Deputy Commissioner on Annexure-A and directing him to choose either one Municipality or Panchayat only.

9. If dead electors are appearing in the Part-I, a list of such any electors shall be prepared and the name of such electors shall be deleted with the permission of Deputy Commissioner and an entry to this effect will be made in the ERMS.

10. The deletion of electors at working stage will be allowed only in the case of dead electors and multiple entries with the permission of Deputy Commissioner. No other elector is allowed to be deleted at working stage.

11. If it is found that electors in a Ward or Municipality are considerably high or less the Executive Officer / Secretary will enquire from adjoining Panchayats or Municipalities as the case may be. If these electors are detected in some other Ward / Municipality or adjoining Panchayats the Executive Officer / Secretary will bring this fact into the notice of Deputy Commissioner and such elector will be shifted with the permission of Deputy Commissioner to the concerned Municipality or Panchayat. In such cases the Deputy Commissioner will make a continuous liaison with the District User (PRI) also.

12. If correct Municipality or Panchayat of extra electors is not identified, the Municipal User will forward these electors to District User (ULB) certifying that these electors do not belong to that Municipality. In no circumstances any of such electors shall be deleted repeat no such elector shall be deleted .

13. The District User (ULB) will enquire from all other Municipal users and District User (PRI) about such electors. If any of the District User or Municipal User accepts these electors they will be shifted to that Block by the District User; otherwise the District User will shift these electors to State User certifying that these electors do not belong to that District. Shifting of the electors frojm a Panchayat to ULB or ULB to Panchayat will be done by the District Users with whom the extra electors are appearing with the permission of Deputy Commissioner/District election Officer (Panchayat)as the case may be.

14. The State User will enquire from all District Users about such electors and if any District User accepts these electors they will be shifted to the concerned Districts otherwise such electors will be kept as floating data in a folder.

15. The Executive Officer / Secretary of every Municipality shall certify that they have compared all the working copies and no discrepancy have been found or the discrepancies, if found, have been corrected. removed / intimated to the District User Only then the District User will allow the printing of part-II of working copies of the electoral rolls of Municipalities.

16. The Municipal User will print only one copy of part-II of the electoral rolls of each Municipality and hand them over to the respective Executive Officer / Secretary on the same day. All work pertaining to Part-I shall be completed by 30th April, 2015.

Exercise to be undertaken in Part-II

17. The Executive Officer / Secretary will get the physical verification of new electors appearing in Part-II done through a team of responsible officials by house to house field visit. The team will insert the ward number of new electors so that the electors without wards could be mapped for wards through ERMS. The objective of this exercise will be as under:

i. To integrate the electors of part-II with the main electoral rolls i.e. part-I after physical field verification and ward wise segregation thereof for new/modified/shifted electors.

ii. Entry of EPIC Number of electors who are appearing in Part-I without EPIC Number (existing Ward and Sr. No. in Part-I of such electors will be shown in Part-II also).

iii. Insertion of Photograph of those electors of Part-I who are appearing in Part-I without photograph. (existing Ward and Sr. No. in Part-I of such electors will be shown in Part-II also).

18. The list of voters appearing in part-II will have two blank columns to enter ward Number and name of Panchayat /ULB (In case the elector is appearing in incorrect Panchayat /ULB).

19. The deputed team will verify that the electors appearing in Part-II reside in the respective Municipality ward .

20. The electors who are without EPIC Number but verified and are still residing in the concerned ward, will be asked whether or not they have been registered with ECI. In case of affirmative response, their EPIC Number will be obtained and noted.

21. If any new (नया), modified (संशोधित) or shifted ''स्थानान्त्रित''. electors appearing in Part- II are not verified, the Executive Officer / Secretary will prepare a list of such electors on Annexure-C and supply this list to the Sub-Divisional Officer (Civil), who will cause this list to be published at the notice board of Sub-Division/Tehsil/ Headquarters and Municipal Headquarters for the information of general public.

22. If any unverified elector is verified after publication of such list on the Notice Board his name shall be mapped in the respective ward otherwise such names will be retained in the list of unused electors.

23. The electors who are without photograph and still not registered with the ECI but residing in the same area their photo will be obtained for being scanned at Sub- Division / District Headquarters in order to insert the same in the electoral roll.

24. The work pertaining to verification shall be completed by 15th May, 2015.

Integration of Part-I and Part-II

25. After verification exercise, data entry work including the integration of part-I and Part- II will be taken w.e.f. 18th May, 2015 at Sub Division / Municipal Headquarter through ERMS software for which user ID and user manual have already been provided to you. If, for any reasons, this work cannot be handled at Sub Division /328 राजपत्र, हिमाचल प्रदेश, 17 अप्रैल, 2015/27 चैत्र, 1937 Municipal Headquarter it can be done at District Headquarters at the discretion of Deputy Commissioner concerned.

26. No addition, deletion or correction (except for deletion in case of death, multiple entries and modification in case of EPIC Number and Photograph is missing)) shall be allowed at the working stage. The Commission shall notify a separate programme for this exercise as per relevant Election Rules.

27. The Executive Officer/Secretary of the Municipality will issue a certificate to the Deputy Commissioner, annexed as Annexure-D

28. The Sub Divisional Officer (Civil) will further issue a certificate to the Deputy Commissioner annexed as Annexure E.

29. The dates for shifting of stage of working copy of the electoral roll to Draft Electoral Roll shall be intimated by the Commission. The Deputy Commissioner shall allow to shift the stage of a Panchayat only if certificate mentioned above has been obtained from the Sub Divisional Officer(Civil).

30. The required stationary for printing CDs etc. will be procured by the Deputy Commissioners from local market after completing codal formalities, and the bills of the same may be sent to District Election Officer (Panchayat)

No. SEC (16) -2/2014-437-592.—Whereas the general elections to the Panchayati Raj Institutions are due in this year and therefore, the State Election Commission has decided to update the electoral roll of all Gram Sabhas in Himachal Pradesh by using the data base of the Election Commission of India updated as on 1.1.2015;

Consequently the State Election Commission hereby notifies 1.1.2015 as qualifying date to determine the eligibility of a person to be registered in the electoral roll of a Gram Sabha under Rule 14 (e) of the Himachal Pradesh Panchayati Raj (Election) Rules, 1994.

Further, the Commission in exercise of the powers vested in it under Article 243-K of the Constitution of India, Section 160 of the Himachal Pradesh Panchayati Raj Act, 1994 read with Rule 12 of the Himachal Pradesh Panchayati Raj (Election) Rules, 1994, hereby directs the revision of electoral rolls and issues the following directions in this behalf:

31. The State Election Commission has created District User (PRI) for each District. The District User will create Block Users for each Block, who will further create sub-user at the Block level as per requirement for the use of ERMS Software immediately on the receipt of these instructions. District user will keep a proper account of Block user and monitor their functioning on day to day basis.

32. The working copy of the draft electoral roll for each Panchayat has been made available on line through Electoral Roll Management System Software (ERMS) by the NIC in two parts. The composition of two parts will be as follows:-

Part-I:-

33. The Sub-Divisional Officer (Civil) Assistant Electoral Roll Registration Officer (AERO) i.e. Block Development Officer will print a copy of Part-I and Part-II of the working copy of the electoral roll immediately and hand over these copies to the respective Panchayat Secretary or GPVA or Panchayat Sahayak as the case may be (hereinafter referred as Panchayat Secretary.

34. The Panchayat Secretary will check the Part-I of working copies of electoral roll of every ward and compare these working copies with the previously finally published electoral roll and ensure that number of electors in each ward are correct. He will certify that he has checked the Part-I of the working roll in respect of every ward and verify that:

(a) He has compared the working copy of the draft electoral roll in respect of each ward with previously notified electoral roll.

(b) That no elector is appearing in incorrect Block or Panchayat / ULB or Ward. If there are any discrepancies in the Part-I of working copies, he will immediately bring this fact to the notice of Block User in writing with a copy to the District User. The District User will inform the State User immediately.

35. If any elector(s) is (are) appearing in wrong ward, incorrect Panchayat / ULB or incorrect Development Block, they shall be corrected at the working copy stage by shifting meaning thereby, that the shifting of electors will be allowed at working stage also.

36. There is possibility of multiple appearances of a name of an elector against single EPIC No. in a Particular Ward. In such cases only one entry will be kept whereas all other multiple from the ward shall be deleted.

37. If an elector is appearing in more than one ward of a particular Panchayat, in such cases a list of such cases will be prepared and sent to the AERO. The AERO will issue a notice to the person concerned in Annexure-A to choose one ward. Thereafter the name of that person shall be deleted by the Block User from all other wards except one chosen by the elector. The name shall be deleted after the permission of AERO. An entry to this effect will be made in the ERMS indicating permission number and date.

38. If it comes to the notice that the name of an elector is appearing in more than one Panchayat / Municipality simultaneously, his name shall be deleted from all the Panchayats / Municipalities except one by serving him notice by the AERO on Annexure-A and directing him to choose either one Panchayat or Municipality only.

39. If dead electors are appearing in the Part-I, a list of such electors shall be prepared and the name of such electors shall be deleted with the permission of AERO indicating permission number and date and an entry to this effect will be made in the ERMS.

40. The deletion of electors at working stage will be allowed only in the case of dead electors and multiple entries with the permission of AERO. No other elector is allowed to be deleted at working stage.

41. If it is found that electors in a Ward or Panchayat are considerably high or less, the Panchayat Secretary will enquire from their counterparts in the adjoining Panchayats or Municipalities as the case may be. If these electors are detected in some other Ward/ Panchayat or Municipality, the Panchayat Secretary will bring this fact into the notice of AERO and seek his permission who will cause these electors to be shifted to the concerned Panchayat or Municipality indicating permission number in the ERMS Software. In such cases the Block User will make a continuous liaison with the District User (ULB)331 राजपत्र, हिमाचल प्रदेश, 17 अप्रैल, 2015/27 चैत्र, 1937 42. If correct Municipality or Panchayat of extra electors is not identified, the Block User will forward these electors to District User (PRI) certifying that these electors do not belong to that Block. 45. The Panchayat Secretaries of every Panchayat shall certify in Annexure-B that he has compared Part-I of the working copies with the previously published final Electoral Roll and no discrepancy have been found or the discrepancies, if found, have been corrected.

46. The Assistant Electoral Roll Registration Officer (BBD) will print only one copy of part-I & II of the electoral rolls of each Panchayat and hand them over to the respective Panchayat Secretary on the same day. All work pertaining to Part-I shall be completed by 30th April, 2015.

47. 56. No addition, deletion or correction (except for deletion in case of death, multiple entries and modification in case of EPIC number Photograph is missing) shall be allowed at the working stage. The Commission shall notify a separate programme for this exercise as per relevant Election Rules.

57. The Panchayat Secretary will submit a certificate, annexed as Annexure-D, in writing to the Assistant Electoral Roll Registration Officer (BDO). This Certificate shall be countersigned by the respective Panchayat Inspector / Sub-Inspector.

58. The Assistant Electoral Roll Registration Officer (BDO) will further issue a certificate to the Deputy Commissioner, annexed as Annexure-E

59. The dates for shifting of stage of working copy of the electoral roll to Draft Electoral Roll shall be intimated by the Commission. The District Election Officer (Panchayat)- cum- The Deputy Commissioner shall allow to shift the stage of a Panchayat only if certificate mentioned above has been obtained from the Assistant Electoral Roll Registration Officer (BDO).

60. The required stationary for printing CDs etc. will be procured by the AERO from local market after completing formalities, the bills of the same may be sent to District Election Officer (P) (Deputy Commissioner).

हिमाचल प्रदेश विधान सभा अध्यक्ष और उपाध्यक्ष वेतन अधिनियम, 1971 (1971 का अधिनियम संख्यांक 4) का और संशोधन करने के लिए विधेयक।

भारत गणराज्य के छियासठवें वर्ष में हिमाचल प्रदेश विधान सभा द्वारा निम्नलिखित रूप में यह अधिनियमित होः-

1. संक्षिप्त नाम.-इस अधिनियम का संक्षिप्त नाम हिमाचल प्रदेश विधान सभा अध्यक्ष और उपाध्यक्ष वेतन (संशोेधन) अधिनियम, 2015 है।

2. धारा 10-क का संशोधन.-हिमाचल प्रदेश विधान सभा अध्यक्ष और उपाध्यक्ष वेतन अधिनियम, 1971 की धारा 10-क की उपधारा (1) के स्थान पर निम्नलिखित उपधारा रखी जाएगी, अर्थातः- ''(1) अध्यक्ष और उपाध्यक्ष अपनी पदावधि के दौरान अपने कुटुम्ब के साथ या यात्रा के दौरान उसकी देखभाल और सहायता करने के लिए उसके साथ यात्रा करने वाले किसी व्यक्ति के साथ किसी भी समय किसी भी श्रेणी में रेलमार्ग द्वारा या वायुमार्ग द्वारा देश के भीतर या बाहर यात्रा करने का हकदार होगा और वह प्रत्येक वित्तीय वर्ष में अधिकतम दो लाख रूपए के अध्यधीन, इस प्रकार उपगत वास्तविक व्यय की प्रतिपूर्ति का हकदार ऐसी की गई यात्रा की टिकटों को प्रस्तुत करने पर होगा :

334 राजपत्र, हिमाचल प्रदेश, 17 अप्रैल, 2015/27 चैत्र, 1937 परन्तु वित्तीय वर्ष में रेलमार्ग द्वारा या वायुमार्ग द्वारा की गई यात्रा के लिए संदेय कुल रकम दो लाख रूपये से अधिक नहीं होगी ।

स्पष्टीकरण.-इस उपधारा के प्रयोजन के लिए पद ''कुटुम्ब'' से पति-पत्नी उनके अविवाहित दत्तक पुत्र और पुत्री सहित अविवाहित पुत्र और पुत्री (पुत्रियां) अभिप्रेत होगा ।''।

उद्‌देश्यों और कारणों का कथन

हिमाचल प्रदेश विधान सभा की सदस्य सुख-सुविधा समिति ने सदस्यों के भत्तों और अन्य परिलब्धियों मेंं बढ़ोतरी करने की सिफारिश की है, जिसे स्वीकार कर लिया गया है। अतः सदस्या,ें अध्यक्ष और उपाध्यक्ष में एकरूपता बनाए रखने के लिए हिमाचल प्रदेश विधान सभा अध्यक्ष और उपाध्यक्ष वेतन अधिनियम, 1971 के उपबन्धों को भी हिमाचल प्रदेश विधान सभा (सदस्यों के भत्ते और पेंशन) अधिनियम, 1971 के उपबन्धों के अनुरूप लाने के आशय से अध्यक्ष और उपाध्यक्ष द्वारा मुफ्त यात्रा (फ्री ट्रांजिट) सुविधा के कारण उपगत व्ययों की प्रतिपूर्ति, एक लाख किलोमीटर के रेलवे टैरिफ के बजाय, दो लाख रूपए की सीमा तक करने का विनिश्चय किया गया है। इसलिए पूर्वोक्त अधिनियम में संशोधन करना आवश्यक हो गया है।

यह विधेयक उपर्युक्त उद्‌देश्यों की पूर्ति के लिए है ।

further to amend the Himachal Pradesh Legislative Assembly Speaker's and Deputy

Speaker's Salaries Act, 1971 (Act No. 4 of 1971).

BE it enacted by the Legislative Assembly of Himachal Pradesh in the Sixty – sixth Year of the Republic of India as follows:-

1. Short title.—This Act may be called the Himachal Pradesh Legislative Assembly Speaker's and Deputy Speaker's Salaries (Amendment) Act, 2015.

2. Amendment of section 10-A.—In section 10-A of the Himachal Pradesh Legislative Assembly Speaker's and Deputy Speaker's Salaries Act, 1971, for sub-section (1) the following sub-section shall be substituted, namely:-

"(1) Speaker and Deputy Speaker during the term of their office shall be entitled to travel at any time by railway or by air by any class within or outside the country alongwith his family or any person accompanying him to look after and assist him during travel and shall be entitled for the reimbursement of actual expenses so incurred on production of tickets of such journey performed, subject to maximum of two lac rupees in each financial year:

Provided that the aggregate amount payable for the journey performed by railway or by air in a financial year shall not exceed two lac rupees.

Explanation.—For the purpose of this sub-section, the expression "family" shall mean the spouse their unmarried son(s) and daughter(s) including unmarried adopted son and daughter.".

STATEMENT OF OBJECTS AND REASONS

The Members Amenities Committee of Himachal Pradesh Vidhan Sabha has recommended to enhance allowances and other perquisites to the Members which has been accepted.Thus, in order to maintain the parity amongst the Members, Speaker and Deputy Speaker and also to bring the provisions of the Himachal Pradesh Legislative Assembly Speaker's and Deputy Speaker's Salaries Act, 1971 in conformity with the provisions of the Himachal Pradesh Legislative Assembly (Allowances and Pension of Members) Act, 1971, it has been decided to 336 राजपत्र, हिमाचल प्रदेश, 17 अप्रैल, 2015/27 चैत्र, 1937 provide reimbursement of expenses incurred by the Speaker and Deputy Speaker on account of free transit facility to the limit of two lac rupees instead of Railway tariff of one lac kilometers. This has necessitated amendment in the Act ibid.

This Bill seeks to achieve the aforesaid objectives.

परन्तु यह और कि यदि तदर्थ या संविदा के आधार पर नियुक्त किया गया अभ्यर्थी इस रुप में नियुक्ति की तारीख को अधिक आयु का हो गया हो, तो वह तदर्थ या संविदा के आधार पर नियुक्ति के कारण विहित आयु में छूट Måü ÍsÉL पात्रा नही होगा ;

परन्तु यह और भी कि xÉqÉxiÉ पब्लिक xÉåYOûU / निगमों तथा xuÉÉrÉ¨É निकायों के सभी कर्मचारियों को, जो ऐसे पब्लिक xÉåYOûU / निगमों तथा xuÉÉrÉ¨É निकायों के प्रारम्भिक गठन के समय ऐसे पब्लिक xÉåYOûU / निगमों/xuÉÉrÉ¨É निकायों में आमेलन से पूर्व सरकारी कर्मचारी थे, सीधी भर्ती में आयु सीमा में ऐसी ही रियायत दी eÉÉLaÉÏ, जैसी सरकारी कर्मचारियों को अनुज्ञेय है, किन्तु इस प्रकार की रियायत पब्लिक xÉåYOûU / निगमों तथा xuÉÉrÉ¨É निकायों के ऐसे कर्मचारिवृन्द को नही दी eÉÉLaÉÏ, जो पश्चातवर्ती ऐसे निगमों/ xuÉÉrÉ¨É निकायों ़द्वारा नियुक्त किए गए थे / किए गए है और उन पब्लिक xÉåYOûU /निगमों/xuÉÉrÉ¨É निकायों के प्रारम्भिक गठन के पश्चात ऐसे निगमों/ xuÉÉrÉ¨É निकायों की सेवा में अन्तिम रुप से आमेलित किए गए है/ किए गए थे ।

(1) सीधी भर्ती के लिए आयु सीमा की गणना उस वर्ष के प्रथम दिवस से की जाएगी, जिसमें पद (पदों) को आवेदन आमन्त्रिात करने के लिए, यथास्थिति, विज्ञापित किया गया हैं या नियोजनालयों को अधिसूचित किया गया है। (2) अन्यथा सुअर्हित अभ्यर्थियों की दशा में सीधी भर्ती के लिए आयु सीमा और अनुभव, हिमाचल प्रदेश लोक सेवा आयोग के विवेकानुसार शिथिल ÌMürÉÉ जा सकेगा।

परन्तु यह और कि उन सभी पदधारियों की, जिन पर प्रोन्नति के लिए विचार किया जाना है, कम से कम तीन वर्ष की न्यूनतम अर्हता सेवा या पद के भर्ती और प्रोन्नति नियमों में विहित सेवा, जो भी कम हो, होगीः

परन्तु यह और भी कि जहां कोई व्यक्ति पूर्वगामी परन्तुक की अपेक्षाओं के कारण प्रोन्नति किए जाने सम्बन्धी विचार के लिए अपा§É हो जाता है, वहां उससे कनिष्ठ व्यक्ति भीऐसी प्रोन्नति के विचार के लिए अपा§É समझा जाएगा/समझे जाएंगे ।

स्पष्टीकरणः- अंतिम परन्तुक के अन्तर्गत कनिष्ठ पदधारी प्रोन्नति के लिए अपा§É नहीं समझा जाएगा, यदि वरिष्ठ अपा§É व्यक्ति भूतपूर्व सैनिक है जिसे डिमोबीलाइज्ड आमर्ड फोर्सिज परसोनल (रिजर्वेशन ऑफ वैकेन्सीज इन हिमाचल स्टेट नॉन टैक्नीकल सर्विसीज) रूल्ज, 1972 के नियम 3 के उपबन्धों के अन्तर्गत भर्ती किया गया हो और इनके अन्तर्गत वरीयता लाभ दिए गए हों या जिसे एक्स सर्विसमैंन; (रिजर्वेशन ऑफ वैकेन्सीज इन दी हिमाचल प्रदेश टैक्नीकल सर्विसीज) रूल्ज, 1985 के नियम 3 के उपबन्धों के अन्र्तगत भर्ती किया गया हो और इनके अन्तर्गत वरीयता लाभ दिए गए हों ।

(2) इसी प्रकार स्थायीकरण के सभी मामलों में ऐसे पद पर नियमित नियुक्ति/प्रोन्नति से पूर्व की सम्भरक (पोषक) पद पर की गई लगातार तदर्थ सेवा, यदि कोई हो, सेवाकाल के लिए गणना में ली जाएगी, यदि तदर्थ नियुक्ति/ प्रोन्नति, उचित चयन के पश्चात्‌ और भर्ती और प्रोन्नति नियमों के उपबन्धों के अनुसार की गई थी । 12. यदि विभागीय प्रोन्नति समिति विद्यमान हो, तो उसकी संरचना.-eÉæxÉÏ xÉUMüÉU ²ÉUÉ xÉqÉrÉ- xÉqÉrÉ mÉU aÉÌPûiÉ MüÐ eÉÉL |

13. भर्ती करने में जिन परिस्थितियों में हिमाचल प्रदेश लोक सेवा आयोग से परामर्श लिया

जाLगा.-जैसा कि विधि द्वारा आपेक्षित हो ।

14. सीधी भर्ती किए जाने वाले व्यक्तियों के लिए अपेक्षा.-किसी सेवा या पद पर नियुक्ति के लिए अभ्यर्थी का भारत का नागरिक होना अनिवार्य है ।

15. सीधी भर्ती द्वारा पद पर नियुक्ति के लिए चयन :.-सीधी भर्ती के मामले में पद पर नियुक्ति के लिए चयन, मौखिक परीक्षा के आधार पर किया जाLगा । यदि, यथास्थिति, हिमाचल प्रदेश लोक सेवा आयोग या अन्य भर्ती341 राजपत्र, हिमाचल प्रदेश, 17 अप्रैल, 2015/27 चैत्र, 1937 प्राधिकरण ऐसा करना आवश्यक या समीचीन समझे, तो लिखित परीक्षा या व्यावहारिक परीक्षा के आधार पर किया जायेगा। जिसका स्तर/पाठ्‌यक्रम, यथास्थिति, आयोग/अन्य भर्ती प्राधिकरण द्वारा AuÉkÉÉËUiÉ किया जाLगा ।

15. क संविदा नियुक्ति द्वारा पद पर नियुक्ति के लिए चयन.-

I. संकल्पना : (क) इस पॅालिसी के अधीन हिमाचल प्रदेश पर्यावरण, विज्ञान एवं प्रौद्योगिकी विभाग में mÉëqÉÑZÉ uÉæ¥ÉÉÌlÉMü अधिकारी (mÉrÉÉïuÉUhÉ) MüÉå संविदा के आधार पर प्रारम्भ में एक वर्ष के लिए लगाया जाLगा जिसे वर्षानुवर्ष आधार पर बढ़ाया जा सकेगा :

परन्तु संविदा अवधि में वर्षानुवर्ष अधार पर विस्तारण नवीकरण के लिए xÉqoÉ® विभागाध्यक्ष यह प्रमाण पत्रा जारी करेगा कि संविदा पर नियुक्त व्यक्ति की सेवा और आचरण वर्ष के दौरान संतोषजनक रहा है और केवल तभी उसकी संविदा की अवधि नवीकृत/विस्तारित की जाएगी।

(ख) mÉS ÌWûqÉÉcÉsÉ प्रदेश sÉÉåMü xÉåuÉÉ AÉrÉÉåaÉ Måü MüÉrÉï¤Éå§É qÉåÇ AÉlÉÉ: mÉëkÉÉlÉ xÉÍcÉuÉ (पर्यावरण, विज्ञान एवं प्रौद्योगिकी) हिमाचल प्रदेश xÉUMüÉU ËU£ü पदों MüÉå xÉÇÌuÉSÉ Måü AÉkÉÉU mÉU pÉUlÉå Måü ÍsÉL xÉUMüÉU MüÉ AlÉÑqÉÉåSlÉ mÉëÉmiÉ MüUlÉå Måü पश्चात AkrÉÉmÉå¤ÉÉ MüÉå xÉqoÉ® pÉiÉÏï अिpÉMüUhÉ, AjÉÉïiÉ ÌWûqÉÉcÉsÉ प्रदेश sÉÉåMü xÉåuÉÉ AÉrÉÉåaÉ Måü xÉqÉ¤É रखेगा |

(aÉ) चयन इन pÉiÉÏï AÉæU mÉëÉæ³ÉìÌiÉ नियमों में विहित पात्राता शर्तो के अनुसार किया जाएगा।

II. xÉÇÌuÉSÉiqÉMü उपलब्धियां .-स्ांविदा के आधार पर नियुक्त mÉëqÉÑZÉ uÉæ¥ÉÉÌlÉMü अधिकारी (mÉrÉÉïuÉUhÉ) को 23,400/- ÂmÉrÉå MüÐ SU xÉå xÉqÉåÌMüiÉ ÌlÉrÉiÉ xÉÇÌuÉSÉiqÉMü UMüqÉ (eÉÉå mÉå oÉæhQû Måü lrÉÔlÉiÉqÉ eÉqÉÉ aÉëåQû mÉå Måü oÉUÉoÉU WûÉåaÉÏ) mÉëÌiÉqÉÉxÉ xÉÇSiiÉ MüÐ eÉÉLaÉÏ | rÉÌS xÉÇÌuÉSÉ qÉåÇ LMü uÉwÉï xÉå AÍkÉMü MüÐ oÉRûÉæiÉUÏ MüÐ eÉÉiÉÏ Wæû iÉÉå पश्चातवर्ती uÉwÉï (uÉwÉÉåïÇ) Måü ÍsÉL xÉÇÌuÉSÉiqÉMü ûEmÉsÉÎokÉrÉÉåÇ qÉå 702/- MüÐ UMüqÉ (mÉS Måü mÉå oÉæhQû MüÉ lrÉÔlÉiÉqÉ eÉqÉÉ aÉëåQû mÉå MüÉ iÉÏlÉ प्रतिशत) uÉÉÌwÉïMü uÉ×ή Måü ÂmÉ qÉåÇ AlÉÑ¥ÉÉiÉ MüÐ eÉÉLaÉÏ |

III. नियुक्ति/अनुशासनिक प्राधिकारी .-प्रधान सचिव (पर्यावरण, विज्ञान एवं प्रौद्योगिकी) हिमाचल प्रदेश सरकार नियुक्ति और अनुशासनिक प्राधिकारी होगा/होगी ।

IV. चयन प्रक्रिया .-संविदा नियुक्ति MüÐ दशा में. पद पर ÌlÉrÉÑÌ£ü के लिए चयन, मौखिक परीक्षा के आधार पर किया जाएगा या आवश्यक या समीचीन WûÉå तो लिखित परीक्षा या व्यवहारिक परीक्षा के आधार पर किया जाएगा जिसका स्तर/पाठ्‌यक्रम, AÉÌS xÉqoÉ® pÉiÉÏï AÍpÉMüUhÉ AjÉÉïiÉ ÌWûqÉÉcÉsÉ प्रदेश sÉÉåMü xÉåuÉÉ AÉrÉÉåaÉ ²ÉUÉ AuÉkÉÉËUiÉ किया जाएगा ।

V. संविदात्मक नियुक्तियों के लिए चयन समिति.-eÉæxÉÏ xÉqoÉ® pÉiÉÏï AÍpÉMüUhÉ AjÉÉïiÉ ÌWûqÉÉcÉsÉ प्रदेश sÉÉåMü xÉåuÉÉ AÉrÉÉåaÉ ²ÉUÉ xÉqÉrÉ-xÉqÉrÉ mÉU aÉÌPûiÉ MüÐ eÉÉL |342 राजपत्र, हिमाचल प्रदेश, 17 अप्रैल, 2015/27 चैत्र, 1937 VI. करार.-अभ्यर्थी MüÉå चयन के पश्चात इन नियमों से संलग्न उपाबन्ध-ख के अनुसार करार हस्ताक्षरित करना होगा।

(ZÉ) संविदा पर नियुक्त व्यक्ति की सेवा पूर्णतया अस्थाई आधार पर होगी । यदि संविदा पर नियुक्त व्यक्ति का कार्य/आचरण ठीक नहीं पाया जाता है तो, नियुक्ति समाप्त किए जाने के लिए दायी होगा ।

(aÉ) संविदा पर नियुक्ति व्यक्ति एक मास की सेवा पूरी करने के पश्चात्‌ एक दिन के आकस्मिक अवकाश का हकदार होगा। तथापि संविदा पर नियुक्त कर्मचारी सोलह सप्ताह के प्रसूति अवकाश, दस दिन के चिकित्सा अवकाश और पांच दिन के विशेष अवकाश के लिए भी हकदार होगा/होगी। वह चिकित्सा प्रतिपूर्ति और एल0टी0सी0 इत्यादि के लिए भी हकदार नहीं होगा/होगी । संविदा पर नियुक्त व्यक्ति को उपरोक्त के सिवाय अन्य किसी प्रकार का कोई अवकाश अनुज्ञात नहीं होगा :

परन्तु अनुपभुक्त आकस्मिक अवकाश,चिकित्सा अवकाश और विशेष अवकाश एक कलैण्डर uÉwÉï तक संचित किया जा सकेगा और आगामी कैलेण्डर uÉwÉï के लिए अग्रनीत नहीं किया जाएगा ।

(घ) नियन्§Éक अधिकारी के अनुमोदन के बिना सेवा से अनधिकृत अनुपस्थिति से स्वतः ही संविदा का पर्यावसान (समापन) हो जाएगा। तथापि आपवादिक मामलों म,ें जहां पर चिकित्सा आधार पर संविदा पर नियुक्त व्यक्ति के नियन्§Éण से बाहर हों तो ऐसी अवधी नियमितीकरण के मामले में विचार करते समय ऐसी अवधि ऐसी अवधी उसके नियमितिकरण के मामले में विचार करते समय अपवर्जित नहीं की जाएगी, परन्तु पदधारी को इस बाबत समय पर नियन्त्रण प्राधिकारी को सूचित करना होगा। तथापि संविदा पर नियुक्त व्यक्ति कर्त्तव्य (QûrÉÔOûÏ) से अनुपस्थिति की अवधि के लिए संविदात्मक रकम का हकदार नहीं होगा । परन्तु उसे सरकार के प्रचलित अनुदेशों के अनुसार चिकित्सा अधिकारी द्वारा जारी बीमारी/आरोग्य प्रमाण-प§É MüÉå प्रस्तुत करना होगा।

(ङ) संविदा पर नियुक्त पदधारी, जिसने तैनाती के एक स्थान पर तीन वर्ष का कार्यकाल पूर्ण कर लिया है, आवश्यकता के आधार पर स्थानान्तरण हेतु पा§É होगा, जहां भी प्रशासनिक आधार पर ऐसा करना अपेक्षित हो। (च) चयनित अभ्यर्थी को सरकारी/रजिस्ट्रीकृत चिकित्सा व्यवसायी से अपना आरोग्यता प्रमाण-प§É प्रस्तुत करना होगा । बारह सप्ताह से अधिक समय से गर्भवती महिला प्रसव होने तक, अस्थाई तौर पर अनुपयुक्त समझी जाएगी। ऐसी महिला अभ्यर्थी का किसी प्राधिकृत चिकित्सा अधिकारी/व्यवसायी द्वारा उपयुक्तता के लिए पुनः परीक्षण किया जाएगा।343 राजपत्र, हिमाचल प्रदेश, 17 अप्रैल, 2015/27 चैत्र, 1937 (छ) संविदा पर नियुक्त व्यक्ति का यदि अपने पदीय कर्त्तव्यों के सम्बन्ध में दौरे पर जाना अपेक्षित हो, तो वह उसी दर पर जैसी नियमित प्रतिस्थानी पदधारी को वेतनमान के न्यूनतम पर लागू है, यात्राा भत्ते/दैनिक भत्ते का हकदार होगा/होगी।

(ज) नियमित कर्मचारियों की दशा में यथा लागू सेवा नियमों के उपबन्ध जैसा एफ0आर0, एस0आर0, छुट्टी नियम,साधारण भविष्य निधि नियम, पेंशन नियम तथा आचरण नियम आदि संविदा पर नियुक्त व्यक्तियों की दशा में लागू नहीं होगें। वे इस स्तम्भ में यथावर्णित उपलब्धियों आदि के लिए हकदार होंगे।

16. आरक्षण.- xÉåuÉÉ में ÌlÉrÉÑÌ£ü, हिमाचल प्रदेश सरकार द्वारा समय-समय पर अनुसूचित जातियों/ अनुसूचित जनजातियों/अन्य पिछडे़ वर्गो और अन्य प्रवर्ग के व्यक्तियों के लिए सेवा में आरक्षण के बाबत जारी किए गए आदेशों के AkrÉkÉÏlÉ होगी।

17. विभागीय परीक्षा.-सेवा में प्रत्येक xÉSxrÉ MüÉå xÉqÉrÉ-xÉqÉrÉ mÉU rÉjÉÉ संशोधित हिमाचल प्रदेश विभागीय परीक्षा नियम 1997 में rÉjÉÉÌuÉÌWûiÉ विभागीय परीक्षा mÉÉxÉ करनी WûÉåaÉÏ |

18. शिथिल करने की शक्ति.-जहां राज्य सरकार की यह राय हो कि ऐसा करना आवश्यक या समीचीन है, वहां वह,कारणाें को लिखित में अभिलिखित करके, और हिमाचल प्रदेश लोक सेवा आयोग के परामर्श से, आदेश द्वारा, इन नियमों के किसी उपबन्ध (उपबन्धों) को किसी वर्ग या व्यक्ति (यों)के प्रवर्ग या पद (पदों) की बाबत शिथिल कर सकेगी।

संविदा पर नियुक्त व्यक्ति (जिसे इसमें इसके पश्चात्‌ "प्रथम पक्षकार" कहा गया है). और हिमाचल प्रदेश के राज्यपाल के qÉkrÉ xÉÍcÉuÉ पर्यावरण, विज्ञान एवं प्रौद्योगिकी विभाग (जिसे इसमें इसके पश्चात्‌ "द्वितीय पक्षकार" कहा गया है) के qÉÉkrÉqÉ xÉå आज तारीख ...................... को किया गया।

4. संविदात्मक mÉëqÉÑZÉ uÉæ¥ÉÉÌlÉMü AÍkÉMüÉUÏ (mÉrÉÉïuÉUhÉ) एक मास की सेवा पूरी करने के पश्चात्‌ एक दिन के आकस्मिक अवकाश का हकदार होगा। तथापि संविदा पर नियुक्त कर्मचारी सोलह सप्ताह के प्रसूति अवकाश,दस दिन के चिकित्सा अवकाश और पांच दिन के विशेष अवकाश का भी हकदार होगा/होगी । वह चिकित्सा प्रतिपूर्ति और एल0टी0सी0 इत्यादि के लिए भी हकदार नहीं होगा/होगी। संविदात्मक प्रमुख वैज्ञानिक अधिकारी (पर्यावरण) को किसी भी प्रकार का अन्य कोई अवकाश अनुज्ञात नहीं होगा | परन्तु अनुपभुक्त आकस्मिक अवकाश, चिकित्सा अवकाश और विशेष अवकाश एक कलैण्डर वर्ष तक संचित किया जा सकेगा और आगामी कलैण्डर वर्ष के लिए अग्रनीत नहीं किया जाएगा।

5. नियंन्त्राक अधिकारी के अनुमोदन के बिना कर्त्तव्य से अनधिकृत अनुपस्थिति से स्वतः ही संविदा का पर्यवसान(समापन) हो जाएगा। तथापि आपवादिक मामलों में जहां पर चिकित्सा आधार पर कर्त्तव्य (ड्‌यूटी) से अनधिकृत अनुपस्थिति के हालात संविदा पर नियुक्त व्यक्ति के नियन्त्राण से बाहर हों तो उसके नियमितीकरण के मामले पर विचार करते समय ऐसी अवधि अपवर्जित नहीं की जाएगी, परन्तु पदधारी को इस बाबत समय पर नियन्त्राक अधिकारी को सूचित करना होगा। तथापि संविदा पर नियुक्त व्यक्ति कर्त्तव्य से अनुपस्थिति की ऐसी अवधि के लिए संविदात्मक रकम का हकदार नहीं होगाः परन्तु उसे सरकार के प्रचलित अनुदेशों के अनुसार चिकित्सा अधिकारी द्वारा जारी किए गए बीमारी/आरोग्य प्रमाण-पत्रा को प्रस्तुत करना होगा।345 राजपत्र, हिमाचल प्रदेश, 17 अप्रैल, 2015/27 चैत्र, 1937 6. संविदा पर नियुक्त पदधारी जिसने तैनाती के एक स्थान पर तीन वर्ष का कार्यकाल पूर्ण कर लिया है, आवश्यकता के आधार पर स्थानान्तरण हेतु पात्रा होगा, जहां भी प्रशासनिक आधार पर ऐसा करना अपेक्षित हो।

7. चयनित अभ्यर्थी को सरकारी/रजिस्ट्रीकृत चिकित्सा व्यवसायी से अपना आरोग्य प्रमाण पत्रा प्रस्तुत करना होगा । महिला अभ्यर्थियों की दशा में, बारह सप्ताह से अधिक की गर्भावस्था प्रसव होने तक, उसे अस्थायी तौर पर अनुपयुक्त बना देगी। ऐसी महिला अभ्यर्थी का किसी प्राधिकृत चिकित्सा अधिकारी/व्यवसायी द्वारा उपयुक्तता के लिए पुनः परीक्षण किया जाना चाहिए।

8. संविदा पर नियुक्त व्यक्ति का यदि अपने पदीय कर्त्तव्यो के सम्बन्ध में दौरे पर जाना अपेक्षित हो, तो वह उसी दर पर, जैसी नियमित प्रतिस्थानी पदधारी को वेतनमान के न्यूनतम पर लागू है, यात्राा भत्ते/ दैनिक भत्ते का हकदार होगा/होगी।

9. संविदा पर नियुक्त व्यक्ति (यों) को कर्मचारी सामूहिक बीमा योजना के साथ-साथ ई0पी0एफ0/ जी0पी0एफ0 भी लागू नहीं होगा।

No.STE-B(3)-5/2010.—In exercise of the Powers conferred by proviso of Article, 309 of the Constitution of India, the Governor, Himachal Pradesh, in consultation with the Himachal Pradesh, Public Service Commission is pleased to make the Recruitment & Promotion Rules for the post of Principal Scientific Officer (Environment), Class-I (Gazetted in the Department of 346 राजपत्र, हिमाचल प्रदेश, 17 अप्रैल, 2015/27 चैत्र, 1937 Environment, Science & Technology, Himachal Pradesh as per Annexure-'A' attached to this notification, namely:—

1. Short title and commencement.—(1) These rules may be called the Himachal Pradesh, Department of Environment, Science & Technology, Principal Scientific Officer (Environment), Class-I (Gazetted) Recruitment and Promotion Rules, 2015.

(2) These rules shall come into force from the dated of publication in the Rajpatra, Himachal Pradesh.

RECRUITMENT AND PROMOTION RULES FOR THE POST OF PRINCIPAL SCIENTIFIC OFFICER (ENVIRONMENT), CLASS-I (GAZETTED) IN THE DEPARTMENT OF ENVIRONMENT, SCIENCE & TECHNOLOGY, HIMACHAL PRADESH 1. Name of the Post.—Principal Scientific Officer (Environment)

2. Number of Posts.—'01 (One)'

3. Classification.—'Class-I (Gazetted)'

4. Scale of Pay.—(i) Pay scale for regular incumbent.—Pay Band a 15600-39100+ a 7800/- Grade Pay.

(ii) Emoluments for contract employees.— ` 23,400/-P.M. as per details given in col.15-A

5. Whether selection post Or non-selection post.—'Selection'

6. Age for direct recruitment.—45 years and below.

Provided that the upper age limit for direct recruits will not be applicable to the candidates already in service of the Government including those who have been appointed on adhoc or on contract basis;

Provided further that if a candidate appointed on adhoc basis or on contract basis had become overage on the date he/she was appointed as such he/she shall not be eligible for any relaxation in the prescribed agelimit by virtue of his/her such adhoc or contract appointment.

Provided further that upper age limit is relaxable for Scheduled Caste/Scheduled Tribes/Other categories of persons to the extent permissible under the general or special order (s) of the Himachal Pradesh Government.

Provided further that the employees of all the Public Sector Corporations and Autonomous Bodies who happened to be Government servants before absorption in public sector Corporations/ Autonomous Bodies at the time of initial constitutions of such Corporations/Autonomous Bodies shall be allowed age concession in direct recruitment as admissible to Government servants. This concession will not, however, be admissible to such staff of the Public Sector Corporations/ Autonomous Bodies who were/are subsequently appointed by such Corporations/Autonomous Bodies and who are/were finally absorbed in the service of such Corporations/ Autonomous Bodies after initial constitution of the public sector corporations/autonomous bodies.

1. Age limit for direct recruitment will be reckoned on the first day of the year in which the post(s) is/are advertised for inviting applications or notified to the Employment Exchanges as the case may be.

2. Age and qualification/experience in the case of direct recruitment is relaxable at the discretion of the Himachal Pradesh Public Service Commission in case the candidate is otherwise well qualified.

7. Minimum educational and other qualifications required for direct recruit(s).— (a) Essential Qualification(s) :

i) Ph.D. in relevant branch of Environmental Science or M.E./M.Tech. Degree in Environmental Science or Environmental Engineering from a recognized University or an Institution duly recognized by the Central/H.P. Government.

ii) Atleast five years experience in project formulation, implementation, feasibility analysis and monitoring, planning, project formulation, environment protection survey studies, environment monitoring, community led environmental awareness etc. steering of projects like preparation of Environment Master Plan.

OR

i) M.Sc. in Environmental Science or B.E./B.Tech. Degree in Environmental Science or Environmental Engineering or Agriculture Engineering from a recognized University or an Institution duly recognized by the Central/H.P. Government.

ii) Atleast ten years experience in project formulation, implementation, feasibility analysis and monitoring, planning, project formulation, environment protection survey studies, environment monitoring, community led environmental awareness etc. steering of projects like preparation of Environment Master Plan.

(b) Desirable Qualification(s).— Knowledge of customs, manners & dialects of Himachal Pradesh and suitability for appointment in the peculiar conditions prevailing in the Pradesh.

8. Whether age and educational qualifications prescribed for direct recruit(s) will

apply in the case of the promotee(s) ?.—Age : Not Applicable.

Educational Qualification: As prescribed in Column No. 7(a) (i) above.

9. Period of probation, if any.—Two years subject to such further extension for a period not exceeding one year as may be ordered by the competent authority in special circumstances and reasons to be recorded in writing.

Method(s) of recruitment, whether by direct recruitment or by promotion, deputation/ secondment, transfer and the percentage of post(s) to be filled in by various methods.—100% by promotion failing which on secondment basis failing both by direct recruitment on a regular basis or by recruitment on contract basis as the case may be.

11. In case of recruitment by promotion, deputation, transfer, grades from which promotion/deputation/transfer is to be made.—By promotion from amongst the Senior Environment Officer(s) subject to possessing of educational qualification prescribed for direct recruitment against Column No. 7(a) (i) above with five years regular service or regular combined with continuous adhoc service, if any, in the grade failing which on secondment basis from amongst the incumbent(s) of this post subject to possessing of educational qualification prescribed for direct recruitment against Column No. 7(a) (i) above and working in the identical pay scales from other Himachal Pradesh Government Department(s)/ Board(s)/ Corporation(s)/Universities/ Autonomous Bodies.

(1) In all cases of promotion, the continuous adhoc service rendered in the feeder post, if any, prior to regular appointment to the post shall be taken into account towards the length of service as prescribed in these Rules for promotion subject to the conditions that the adhoc appointment/promotion in the feeder category had been made after following proper acceptable process of selection in accordance with the provisions of R&P Rules:

Provided that in all cases where a junior person becomes eligible for consideration by virtue of his/her total length of service (including the service rendered on adhoc basis followed by regular service/appointment) in the feeder post in view of the provisions referred to above, all persons senior to him/her in the respective category/post/cadre shall be deemed to be eligible for consideration and placed above the junior person in the field of consideration:

Provided that all incumbents to be considered for promotion shall possess the minimum qualifying service of atleast three years or that prescribed in the Recruitment & Promotion Rules for the post, whichever is less:

Provided further that where a person becomes ineligible to be considered for promotion on account of the requirements of the proceeding proviso, the persons(s) junior to him/her shall also be deemed to be ineligible for consideration for such promotion;

Explanation-—The last proviso shall not render the junior incumbent(s) ineligible for consideration for promotion if the senior ineligible person(s) happened to be Ex-Servicemen recruited under the provisions of Rule-3 of the Demobilized Armed Forces Personnel (Reservation of vacancies in Himachal State Non- Technical Service) Rules, 1972 and having been given the benefit of seniority thereunder or recruited under the provisions of Rule-3 of Ex-Servicemen (Reservation of vacancies in the Himachal Pradesh Technical Services) Rules, 1985 and having been given the benefit of seniority thereunder.

(2) Similarly, in all cases of confirmation, continuous adhoc service rendered in the feeder post, if any, prior to the regular appointment against such posts shall be taken into account towards the length of service, if the adhoc appointment/promotion had been made after proper selection and in accordance with the provision of the Recruitment & Promotion Rules:

Provided that inter-se-seniority as a result of confirmation after taking into account, adhoc service rendered as referred to above shall remain unchanged.

12. If a Departmental Promotion Committee exists, what is its composition?.—As may be constituted by the Government from time to time.

13. Circumstances under which the H.P.P.S.C. is to be consulted in making recruitment.— As required under the law.

14. Essential requirement for a direct recruitment.—A candidate for appointment to any service or post must be a citizen of India.

15. Selection for appointment to the post by direct recruitment.—Selection for appointment to the post in the case of direct recruitment shall be made on the basis of vivavoce test if Himachal Pradesh Public Service Commission or other recruiting authority, as the case may be, so consider necessary or expedient by a written test or practical test, the standard/ syllabus etc. of which will be determined by the Commission or other recruiting authority, as the case may be.

15.A Selection for appointment to the post by Contract recruitment.—Notwithstanding anything contained in these rules, contract appointment to the post will be made subject to the terms and conditions given below:

(I) CONCEPT:

(a) Under this policy, the Principal Scientific Officer (Environment) in the Department of Environment, Science & Technology, H.P. will be engaged on contract basis initially for one year which may be extendable from year to year basis.

Provided that for extension/renewal of contract period on year to year basis the concerned HOD shall issue a certificate that the service and conduct of the contract appointee is satisfactory during the year and only then his period of contract is to be renewed/extended.

(b) POST FALLS WITHIN THE PURVIEW OF HP PSC.—The Principal Secretary (Environment, Science & Technology) to the Government of Himachal Pradesh after obtaining the approval of the Government to fill up the vacant posts on contract basis will place the requisition with the concerned recruiting agency i.e. Himachal Pradesh Public Service Commission.

(c) The selection will be made in accordance with the eligibility conditions prescribed in these R&P Rules.

(II) CONTRACTUAL EMOLUMENTS.—The Principal Scientific Officer (Environment) appointed on contract basis will be paid consolidated fixed contractual amount @ Rs. 23,400/- per month (which shall be equal to minimum of Pay band + Grade pay). An amount of Rs. 702/- A/D may ensure at their own (3% of the minimum of Pay band + Grade Pay of the post) as annual increase in contractual emoluments for the subsequent year(s) will be allowed if contract is extended beyond one year.

(III) APPOINTING/DISCIPLIANRY AUTHORITY.—The Principal Secretary (Environment, Science & Technology) to the Government of H.P. will be appointing and disciplinary authority.

(IV) SELECTION PROCESS.—Selection for appointment to the post in the case of contract appointment will be made on the basis of viva voice test or if considered necessary or expedient by a written test or practical test the standard/syllabus etc. of which will be determined by the concerned recruitment agency i.e. Himachal Pradesh Public Service Commission.

350 राजपत्र, हिमाचल प्रदेश, 17 अप्रैल, 2015/27 चैत्र, 1937 (V) COMMITTEE FOR SELECTION OF CONTRACTUAL APPOINTMENT.— As may be constituted by the concerned recruiting agency i.e. the Himachal Pradesh Public Service Commission from time to time.

(VI) AGREEMENT.— After selection of a candidate he/she shall sign an agreement as per Annexure-B appended to these rules.

(VII) TERMS AND CONDITIONS.— (a) The contract appointee will be paid fixed contractual amount @ Rs. 23,400/- per month (which shall be equal to minimum of Pay band plus Grade pay). The Contract Appointee will be entitled for increase in contractual amount @ Rs. 702/- (3% of the minimum of Pay band + Grade Pay of the post) for further extended years and no other allied benefits such as senior/selection scales etc. will be given.

(b) The service of the Contract Appointee will be purely on temporary basis. The appointment is liable to be terminated in case the performance/conduct of the contract appointee is not found satisfactory.

(c) Contract Appointee will be entitled for one day's casual leave after putting one month service. However, the contract employee will also be entitled for 16 weeks Maternity Leave, 10 day's Medical Leave and 5 days special leave. He/She shall not be entitled for Medical Re- imbursement and LTC etc. No leave of any other kind except above is admissible to the contract appointee.

Provided that the un-availed Casual Leave, Medical Leave and Special Leave can be accumulated up to the Calendar Year and will not be carried forward for the next Calendar Year.

(d) Unauthorized absence from the duty without the approval of the Controlling Officer shall automatically lead to the termination of the contract. However, in exceptional cases where the circumstances for un-authorized absence from duty were beyond his/her control on medical grounds, such period shall not be excluded while considering his/her case for regularization but the incumbent shall have to intimate the controlling authority in this regard well in time. However, the contract appointee shall not be entitled for contractual amount for this period of absence from duty: Provided that he/she shall submit the certificate of illness/fitness issued by the Medical Officer, as per prevailing instructions of the Government.

(e) An official appointed on contract basis who have completed three years tenure at one place of posting will be eligible for transfer on need based basis wherever required on administrative grounds.

(f) Selected candidate will have to submit a certificate of his/her fitness from a Government/ Registered Medical Practitioner. Women candidate pregnant beyond 12 weeks will stand temporarily unfit till the confinement is over.

The women candidate will be re-examined for the fitness from an authorised Medical Officer/Practitioner.

(g) Contract appointee will be entitled to TA/DA if required to go on tour in connection with his/her official duties at the same rate as applicable to regular counter part official at the minimum of pay scale.

(h) Provisions of service rules like FR, SR, Leave Rules, GPF Rules, Pension Rules and Conduct Rules etc. as are applicable in case of regular employees will not be applicable in case of contract appointees. They will be entitled for emoluments etc. as detailed in this column.

16. Reservation.—The appointment to the service shall be subject to orders regarding reservation in the service for Scheduled Castes/ Scheduled Tribes/Other Backward Classes/ Other Categories of persons issued by the Himachal Pradesh Government from time to time.

17. Departmental Examination.—Every member of the Service shall pass a Departmental Examination as prescribed in the H.P Department Examination Rule, 1997, as amended from time to time.

18. Powers to relax.—Where the State Government is of the opinion that it is necessary or expedient to do so, it may, by order for reasons to be recorded in writing and in consultation with the Himachal Pradesh Public Service Commission relax any of the provision(s) of these Rules with respect to any Class or Category of person(s) or post(s).

Annexure –B

FORM OF CONTRACT/AGREEMENT TO BE EXECUTED BETWEEN THE PRINCIPAL SCIENTIFIC OFFICER (ENVIRONMENT) AND THE GOVERNMENT OF HIMACHAL PRADESH THROUGH THE SECRETARY OF ENVIRONMENT & SCIENTIFIC TECHNOLOGIES

This agreement is made on this………..….day of….………….………in the year ………… between Sh./Smt…………………. S/o/D/o ………………………. R/o………………. ……… contract appointee, (hereinafter called the FIRST PARTY), AND The Governor, Himachal Pradesh through Secretary of Environment & Scientific Technologies Department, Himachal Pradesh (hereinafter called "SECOND PARTY").

Whereas the SECOND PARTY has engaged the aforesaid FIRST PARTY and the FIRST PARTY has agreed to serve as a Principal Scientific Officer (Environment) on contract basis on the following terms and conditions:-

1. That the FIRST PARTY shall remain in the service of the SECOND PARTY as a Principal Scientific Officer (Environment) for a period of one year commencing on day of ………………….and ending on the day of …………………It is specifically mentioned and agreed upon by both the parties that the contract of the FIRST PARTY with SECOND PARTY shall ipso-facto stand terminated on the last working day i.e. on ………and information notice shall not be necessary:

Provided that for extension/ renewal of contract period the HOD shall issue a certificate that the service and conduct of the contract appointee was satisfactory during the year and only then the period of contract is to be renewed/ extended.

2. The contractual amount of the FIRST PARTY will be Rs.23,400/= per month which shall be equal to maximum of the pay band + grade pay, an amount of Rs.702/- (3% of the minimum of Pay Band + Grade Pay of the post) as annual increase in contractual emoluments for the subsequent year(s) will be allowed if the contract is extended beyond one year.

3. The service of FIRST PARTY will be purely on temporary basis. The appointment is liable to be terminated in case the performance/ conduct of the contract appointee is not found good or if a regular incumbent is appointed/posted against the vacancy for which the FIRST PARTY was engaged on contract.

हर आम जनता को सूचित किया जाता है कि श्रीमती व्यांसा देवी पत्नी श्री वेशरु राम, निवासी गांव चुराड़ी, डा0 हवाण, तहसील घुमारवीं, जिला बिलासपुर (हि0 प्र0) ने इस न्यायालय में दरख्वास्त इन्तकाल दर्ज करने बारे प्रस्तुत की है। आवेदिका का पति श्री वेशरु राम, निवासी गांव चुराड़ी, डा0 हवाण, तहसील घुमारवीं, जिला बिलासपुर लगभग 25 वर्षों से लापता है। इन्तकाल जायज वारसान श्रीमती व्यांसा देवी पत्नी श्री वेशरु राम के नाम होना है। अगर इस इन्तकाल को दर्ज करने बारे किसी को एतराज है, तो वह अपनी आपाि इस न्यायालय को दिनांक 1-5-2015 से पूर्व असालतन या वकालतन प्रस्तुत कर सकता है। बाद गुजरने मियाद एतराज काबिले समायत नहीं होगा तथा अग्रिम आदेश इन्तकाल दर्ज करने बारे जारी कर दिए जाएंगे। आज दिनांक 1-4-2015 को मेरे हस्ताक्षर व मोहर अदालत द्वारा जारी हुआ।
