स्ांख्याः ई.डी.एन.-बी-बी(2)-3/2013.--हिमाचल प्रदेश के राज्यपाल, भारत के संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत शक्तियों का प्रयोग करते हुए, हिमाचल प्रदेश लोक सेवा आयोग के परामर्श से, इस विभाग की अधिसूचना संख्याः शिक्षा-11-(छ)6-3/2004- खण्ड-II, तारीख 09-10-2007 द्वारा अधिसूचित हिमाचल प्रदेश उच्च्तर/प्रारम्भिक शिक्षा विभाग, पंजाबी भाषा अध्यापक, वर्ग-III (अराजपत्रित) भर्ती और प्रोन्नति नियम्‌, 2007 का और संशोधन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्‌ ,ः- 50-राजपत्र/2015-10-06-2015 (1215) 1216 राजपत्र, हिमाचल प्रदेश, 10 जून, 2015/20 ज्येष्ठ, 1937 1. संक्षिप्त नाम और प्रारम्भ.-- (1) इन नियमों का संक्षिप्त नाम हिमाचल प्रदेश उच्चतर/प्रारम्भिक शिक्षा विभाग, पंजाबी भाषा अध्यापक, वर्ग-III (अराजपत्रित)भर्ती और प्रोन्नति (प्रथम संशोधन) नियम, 2015 है। (2) ये नियम राजपत्र, हिमाचल प्रदेश में प्रकाशित किए जाने की तारीख से प्रवृत्त होंगे । 2. उपाबन्ध-''क'' का संशोधन.-- हिमाचल प्रदेश उच्च्तर/प्रारम्भिक शिक्षा विभाग, पंजाबी भाषा अध्यापक, वर्ग-III, (अराजपत्रित) भर्ती और प्रोन्नति नियम, 2007 के उपाबन्ध-'क' मेंः-

(क) स्तम्भ संख्या-4 के सामने विद्यमान उपबन्धों के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌ः- (i) ''नियमित पदधारियों के लिए वेतनमानः--पे बैन्ड 10300-34800/-रूपए+रूपए 3200 ग्रेड पे (ii) संविदा पर नियुक्त कर्मचारियों के लिए उपलब्धियांः--13,500/- रूपए प्रतिमास स्तम्भ संख्या 15-क में दिए गए ब्यौरे के अनुसार "

(ख) स्तम्भ संख्याः 7 के सामने विद्यमान उपबन्धों के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌ः- 1. ''(क) अनिवार्य अर्हता :--(1) पंजाबी एक ऐच्छिक विशय सहित, कला स्नातक तथा प्रारम्भिक शिक्षा में द्विवर्षीय डिप्लोमा (चाहे किसी भी नाम से जाना जाए )।

या

पंजाबी एक ऐच्छिक विषय सहित, कम से कम पचास प्रतिशत अंकों के साथ, कला स्नातक तथा एक वर्षीय शिक्षा स्नातक (बी0एड0) ।

या

पंजाबी एक ऐच्छिक विषय सहित, कम से कम पैंतालीस प्रतिशत अंकों के साथ, कला स्नातक तथा इस बाबत समय-समय पर जारी राष्ट्रीय अध्यापक शिक्षा परिषद्‌ (एन0सी0टी0ई0) (मान्यता सन्नियम एवं परिक्रिया) के विनियमों के अनुसार एक वर्षीय शिक्षा स्नातक (बी0एड0)।

या

पंजाबी एक ऐच्छिक विषय सहित, कम से कम पचास प्रतिशत अंकों के साथ, कला स्नातक तथा एक वर्षीय शिक्षा स्नातक (बी0एड0) (विशेष शिक्षा)।

या

किसी मान्यता प्राप्त विश्वविद्यालय से, पचास प्रतिशत अंकों के साथ ज्ञानी सहित कला स्नातक (अंग्रेजी और एक अतिरिक्त विषय) पचास प्रतिशत अंकों के साथ, और एक वर्षीय शिक्षा स्नातक (बी0एड0)

या

किसी मान्यता प्राप्त विश्वविद्यालय से कम से कम पचास प्रतिशत अंकों के साथ एम0ए0 (पंजाबी) तथा एक वर्षीय शिक्षा स्नातक (बी0एड0) ।

टिप्पणः-- (I) किसी मान्यता प्राप्त विश्वविद्यालय से स्नातक, जिसमें स्नातक की तीन वर्षीय अवधि के दौरान पंजाबी एक विषय के रूप में हो। पंजाबी के अध्यापन के साथ बी0एड0 (राज्य शिक्षक पात्रता परीक्षा) औरः1217 राजपत्र, हिमाचल प्रदेश, 10 जून, 2015/20 ज्येष्ठ, 1937 (II) हिमाचल प्रदेश स्कूल शिक्षा बोर्ड, धर्मशाला द्वारा सम्यक्‌ रूप से संचालित शिक्षक पात्रता परीक्षा (टी0ई0टी0 भाषा अध्यापक) में उतीर्ण हो ।

परन्तु ऐसे अभ्यर्थी जिन्होंने हिमाचल प्रदेश अधीनस्थ सेवायें चयन बोर्ड, हमीरपुर द्वारा संचालित अध्यापक पात्रता परीक्षा (टी0ई0टी0) पहले ही अर्हित कर ली है, वे भी, राष्ट्रीय अध्यापक शिक्षा परिषद्‌ (एन0सी0टी0ई0) द्वारा अधिसूचना संख्या 76-4/2010/एन.सी.टी.ई./एकैड. तारीख 11-2-2011 द्वारा जारी दिशा निर्देशों के पैरा-II में अधिकथित शर्त के अध्यधीन पात्र होंगे।

टिप्पण (1)ः- हिमाचल प्रदेश के अनुसूचित जाति/अनुसूचित जन जाति/अन्य पिछड़ा वर्ग/शारीरिक रूप से अक्षम प्रवर्गो से सम्बन्धित अभ्यर्थियों को न्यूनतम शैक्षिक अर्हताओं तथा अध्यापक पात्रता परीक्षा (टी0ई0टी0) के लिए न्यूनतम अर्हता अंकों में भी पांंच प्रतिशत तक की छूट अनुज्ञात की जाएगी।

टिप्पण (2)ः- वेे व्यक्ति जो बी0एड0 नहीं है और उपर्युक्त स्तम्भ संख्या 7(क)में विहित शैक्षिक अर्हताएॅं रखते है भी केवल 31 मार्च, 2014 तक ही टी.ई.टी. की परीक्षा देनें हेतु छूट के पात्र होंगे ।

टिप्पण (3)ः- सुसंगत विषय में पचास प्रतिशत अंकों के साथ स्नातक की योग्यता रखने वाले व्यक्ति भी भाषा अध्यापक (एल0टी0) हेतु 31 मार्च, 2014 तक टी.ई.टी. की परीक्षा देने के पात्र होंगे।

टिप्पण (4)ः- उन पात्र अभ्यर्थियोंं को पूर्विकता दी जाऐगी, जो समय-समय पर यथा संशोधित एन0सी0टी0ई0 की अधिसूचना, तारीख 23 अगस्त, 2010 में विनिर्दिष्ट न्यूनतम अर्हताएं रखते हों और तत्पश्चात्‌ छूट दी गई अर्हताओं के साथ अन्य अभ्यर्थियों पर विचार किया जाएगा। यह छूट 31-3-2014 तक विधिमान्य रहेगी।

टिप्पण (5)ः- ऐसे अध्यापकों को जो छूट के अर्हता सन्नियमों (नार्मज) के अन्तर्गत नियुक्त किए गए हैं, को नियुक्ति के वर्ष से दो वर्ष की अवधि के भीतर न्यूनतम्‌ अर्हताएं प्राप्त करनी होंगी।

वांछनीय अर्हताः-"हिमाचल प्रदेश की रूढ़ियों रीतियों और बोलियों का ज्ञान और प्रदेश में विद्यमान विशिष्ट दशाओं में नियुक्ति के लिए उपयुक्तता"

(ग) स्तम्भ संख्याः 15-क के सामने विद्यमान उपबन्धों के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌ः-

"इन नियमों में किसी बात के होते हुए भी संविदात्मक नियुक्तियां नीचे दिए गए निबन्धनों और शर्ताे के अध्यधीन की जाएंगीः-

(1) संकल्पना.--(क) इस पॉलिसी के अधीन हिमाचल प्रदेश उच्च/प्रारम्भिक शिक्षा विभाग में पंजाबी भाषा अध्यापक को संविदा के आधार पर प्रारम्भ में एक वर्ष के लिए लगाया जाएगा, जिसे वर्षानुवर्ष आधार पर बढ़ाया जा सकेगाः

परन्तु संविदा अवधि में वर्षानुवर्ष आधार पर विस्तारण/नवीकरण के लिए सम्बद्ध विभागाध्यक्ष यह प्रमाण-पत्र जारी करेगा कि संविदा पर नियुक्त व्यक्ति की सेवा और आचरण, वर्ष के दौरान संतोषजनक रहा है और केवल तभी उसकी संविदा की अवधि नवीकृत/विस्तारित की जाएगी।

(ख) पद का हिमाचल प्रदेश अधीनस्थ सेवायें चयन बोर्ड़, हमीरपुर के कार्यक्षेत्र में आनाः

सम्बद्व जिला का उप निदेशक, उच्च/प्रारम्भिक शिक्षा रिक्त पदाेंं को संविदा के आधार पर भरने के लिए सरकार का अनुमोदन प्राप्त करने के पश्चात्‌, अध्यपेक्षा को सम्बद्ध भर्ती अभिकरण, अर्थात्‌ हिमाचल प्रदेश अधीनस्थ सेवायें चयन बोर्ड हमीरपुर के समक्ष रखेगा। 1218 राजपत्र, हिमाचल प्रदेश, 10 जून, 2015/20 ज्येष्ठ, 1937 (ग) चयन, इन नियमों में विहित पात्रता शर्तों के अनुसार किया जाएगा।

(II) संविदात्मक उपलब्धियांं.-संविदा के आधार पर नियुक्त पंजाबी भाषा अध्यापक को 13,500/- रूपये की दर से समेकित नियत संविदात्मक रकम (जो पे बैण्ड के न्यूनतम जमा गे्रड पे के बराबर होगी) प्रति मास संदत्त की जाएगी। यदि संविदा में एक वर्श से अधिक की बढ़ौतरी की जाती है, तो पश्चात्‌वर्ती वर्ष/वर्षों के लिए संविदात्मक उपलब्धियों में 405/रूपये (पद के पे बैण्ड का न्यूनतम जमा गे्रड पे का तीन प्रतिशत) की रकम वार्षिक वृद्धि के रूप में अनुज्ञात की जाएगी।

(III) नियुक्ति और अनुशासन प्राधिकारी.--सम्बद्ध जिला का उप निदेशक, उच्चतर/प्रारम्भिक शिक्षा हिमाचल प्रदेश नियुक्ति और अनुशासन प्राधिकारी होगा।

(IV) चयन प्रक्रिया.--संविदा नियुक्ति की दशा में पद पर नियुक्ति के लिए चयन, मौखिक परीक्षा के आधार पर किया जाएगा। यदि आवश्यक या समीचीन समझा जाए, तो लिखित परीक्षा या व्यावहारिक परीक्षा के आधार पर किया जाएगा जिसका स्तर/पाठ्‌यक्रम इत्यादि, सम्बद्ध भर्ती अभिकरण अर्थात्‌ हिमाचल प्रदेश अधीनस्थ सेवायें चयन बोर्ड़, हमीरपुर द्वारा अवधारित किया जाएगा।

(V) संविदात्मक नियुक्तियों के लिए चयन समिति.--जैसी सम्बद्ध भर्ती अभिकरण अर्थात्‌ हिमाचल प्रदेश अधीनस्थ सेवायें चयन बोर्ड़, हमीरपुर द्वारा समय-समय पर गठित की जाए।

(VI) करार.--अभ्यर्थी को, चयन के पश्चात्‌ इन नियमों से संलग्न उपाबन्ध-ख के अनुसार करार हस्ताक्षरित करना होगा।

(VII) निबन्धन और शर्ते.-- (क) संविदा के आधार पर नियुक्त व्यक्ति को 13,500/- रूपये की दर से नियत संविदात्मक रकम (जो पे बैण्ड के न्यूनतम जमा गे्रड पे के बराबर होगी) प्रति मास संदत्त की जाएगी। संविदा पर नियुक्त व्यक्ति आगे बढ़ाए गए वर्ष/वर्षों के लिए संविदात्मक उपलब्धियों मे 405/- रूपये (पे बैण्ड का न्यूनतम जमा गे्रड पे का तीन प्रतिशत) की दर से वृद्धि का हकदार होगा और अन्य कोई सहबद्ध प्रसुविधाएं जैसे वरिष्ठ/चयन वेतनमान आदि नहीं दिया जाएगा।

(ख) संविदा पर नियुक्त व्यक्ति की सेवा पूर्णतया अस्थायी आधार पर होगी। यदि संविदा पर नियुक्त व्यक्ति का कार्य/आचरण ठीक नहीं पाया जाता है, तो, नियुक्ति समाप्त किए जाने के लिए दायी होगी। (ग) स्ांविदा पर नियुक्त व्यक्ति एक मास की सेवा पूरी करने के पश्चात्‌ एक दिन के आकस्मिक अवकाश का हकदार होगा। तथापि संविदा पर नियुक्त कर्मचारी सोलह सप्ताह के प्रसूति अवकाश, दस दिन के चिकित्सा अवकाश और पांच दिन के विशेष अवकाश के लिए भी हकदार होगा/होगी। वह चिकित्सा प्रतिपूर्ति और एल0टी0सी0 आदि के लिए हकदार नहीं होगा/होगी। संविदा पर नियुक्त व्यक्ति को उपरोक्त के सिवाय अन्य किसी प्रकार का कोई अवकाश अनुज्ञात नहीं होगाः

परन्तु अनुपभुक्त आकस्मिक अवकाश, चिकित्सा अवकाश और विशेष अवकाश एक कलैण्डर वर्ष तक संचित किया जा सकेगा और आगामी कलैण्डर वर्ष के लिए अग्रनीत नहीं किया जाएगा।

(घ) नियन्त्रक अधिकारी के अनुमोदन के बिना कर्तव्य से अनधिकृत अनुपस्थिति से स्वतः ही संविदा का पर्यावसान (समापन) हो जाएगा । तथापि आपवादिक मामलों में जहां पर चिकित्सा आधार पर कर्तव्य (ड्‌यूटी) से अनधिकृत अनुपस्थिति के हालात संविदा पर नियुक्त व्यक्ति के नियन्त्रण से बाहर हों तो उसके नियमितीकरण के मामले में विचार करते समय ऐसी अवधि अपवर्जित नहीं की जाएगी, परन्तु पदधारी को इस बाबत समय पर नियन्त्रण अधिकारी को सूचित करना होगा। तथापि संविदा पर नियुक्त व्यक्ति कर्तव्य से अनुपस्थिति की ऐसी अवधि के लिए संविदात्मक रकम का हकदार नहीं होगाः

परन्तु उसे सरकार के प्रचलित अनुदेशों केे अनुसार चिकित्सा अधिकारी द्वारा जारी बीमारी/आरोग्य प्रमाण-पत्र प्रस्तुत करना होगा।1219 राजपत्र, हिमाचल प्रदेश, 10 जून, 2015/20 ज्येष्ठ, 1937 (ङ) संविदा पर नियुक्त व्यक्ति, जिसने तैनाती के एक स्थान पर तीन वर्ष का सेवाकाल पूर्ण कर लिया है, आवश्यकता के आधार पर स्थानान्तरण के लिए पात्र होगा, जहां भी प्रशासनिक आधार पर ऐसा करना अपेक्षित हो।

(च) चयनित अभ्यर्थी को सरकारी/रजिस्ट्रीकृत चिकित्सा व्यवसायी से अपना आरोग्य प्रमाण-पत्र प्रस्तुत करना होगा। बारह सप्ताह से अधिक समय से गर्भवती महिलाऐं प्रसव होने तक, अस्थायी तौर पर अनुपयुक्त बनी रहेगी। ऐसी महिला अभ्यर्थी का किसी प्राधिकृत चिकित्सा अधिकारी/व्यवसायी द्वारा उपयुक्तता के लिए पुनः परीक्षण किया जाएगा।

(छ) संविदा पर नियुक्त व्यक्ति का यदि अपने पदीय कर्तव्यों के सम्बन्ध में दौरे पर जाना अपेक्षित हो, तो वह उसी दर पर जैसी नियमित प्रतिस्थानी पदधारी को पद के वेतनमान के न्यूनतम पर लागू है, यात्रा भत्ते/दैनिक भत्ते का हकदार होगा/होगी।

(ज) नियमित कर्मचारियों की दशा में यथा लागू सेवा नियमों के उपबन्ध, जैसे एफ0आर0-एस0 आर0, छुट्‌टी नियम, साधारण भविष्य निधि नियम, पेंशन नियम तथा आचरण नियम आदि संविदा पर नियुक्त व्यक्तियों की दशा में लागू नहीं होंगे। वे इस स्तम्भ में यथावर्णित उपलब्धियों आदि के लिए हकदार होंगे"।

उपाबन्ध- "ख" पंजाबी भाषा अध्यापक और हिमाचल प्र्रदेश सरकार के मध्य निदेशक, उच्चतर/प्र्रारम्भिक शिक्षा विभाग हिमाचल प्रदेश के माध्यम से निश्पादित की जाने वाली संविदा/करार का प्र्रारूप

यह करार श्री/श्रीमति............................................................ पुत्र/पुत्री श्री............................................................. ...... निवासी..............................................................., संविदा पर नियुक्त व्यक्ति (जिसे इसमें इसके पश्चात्‌ "प्रथम पक्षकार" कहा गया है) और हिमाचल प्रदेश के राज्यपाल के मध्य उप निदेशक/उच्च्तर/प्रारम्भिक शिक्षा, हिमाचल प्रदेश नियुक्त प्राधिकारी का नाम (जिसे इसमें इसके पश्चात्‌ "द्वितीय पक्षकार" कहा गया है) के माध्यम से आज तारीख............................... को किया गया।

"द्वितीय पक्षकार" ने उपरोक्त प्रथम पक्षकार को लगाया है और प्रथम पक्षकार ने पंजाबी भाषा अध्यापक के रूप में संविदा के आधार पर निम्नलिखित निबन्धन और शर्तों पर सेवा करने के लिए सहमति दी हैः- 1. यह कि प्रथम पक्षकार पंजाबी भाषा अध्यापक के रूप में .........................से प्रारम्भ होने और..............

....को समाप्त होने वाले दिन तक, एक वर्ष की अवधि के लिए द्वितीय पक्षकार की सेवा में रहेगा। यह विर्निंदिष्ट रूप से उल्लिखित किया गया है और दोनों पक्षकारों द्वारा करार पाया गया है कि प्रथम पक्षकार की द्वितीय पक्षकार के साथ संविदा, आखिरी कार्य दिवस्‌ अर्थात.्‌ ................... दिन को स्वयंमेव पर्यवसित (समाप्त) हो जाएगी तथा सूचना नोटिस आवश्यक नहीं होगाः परन्तु संविदा अवधि में वर्षानुवर्ष आधार पर विस्तारण/नवीकरण के लिए सम्बद्ध विभागाध्यक्ष यह प्रमाण-पत्र जारी करेगा कि संविदा पर नियुक्त व्यक्ति की सेवा और आचरण, उस वर्ष के दौैरान संतोषजनक रहा है और केवल तभी उसकी संविदा की अवधि नवीकृत/विस्तारित की जाएगी । 2. प्रथम पक्षकार की संविदात्मक रकम -13500/- रू0 प्रतिमास होगी। 1220 राजपत्र, हिमाचल प्रदेश, 10 जून, 2015/20 ज्येष्ठ, 1937 3. प्रथम पक्षकार की सेवा पूर्णतया अस्थाई आधार पर होगी। यदि संविदा पर नियुक्त व्यक्ति का कार्य/आचरण ठीक नहीं पाया जाता है या यदि नियमित पदधारी उस रिक्ति के विरूद्ध नियुक्त/तैनात कर दिया जाता है, जिसके लिए प्रथम पक्षकार को संविदा पर लगाया गया है, तो नियुक्ति पर्यवसित (समाप्त) की जाने के लिए दायी होगी।

4. संविदा पर नियुक्त पंजाबी भाषा अध्यापक एक मास की सेवा पूरी करने के पश्चात्‌ एक दिन के आकस्मिक अवकाश का हकदार होगा। यह अवकाश एक वर्ष तक संचित किया जा सकेगा। तथापि संविदा पर नियुक्त व्यक्ति सोलह सप्ताह के प्रसूति अवकाश, दस दिन के चिकित्त्सा अवकाश और 5 दिन के विशेष अवकाश के लिए भी हकदार होगा/होगी। वह चिकित्सा प्रतिपूर्ति और एल0टी0सी0 आदि के लिए हकदार नहीं होगा/होगी। संविदा पर नियुक्त पंजाबी भाषा अध्यापक को उपरोक्त के सिवाय अन्य किसी प्रकार का कोई अवकाश अनुज्ञात नहीं होगा :

परन्तु अनुपभुक्त आकस्मिक अवकाश, चिकित्सा अवकाश और विशेष अवकाश एक कलैन्डर वर्ष तक संचित किया जा सकेगा और आगामी कलैन्डर वर्ष के लिए अग्रणीत नहीं किया जाऐगा ।

5. नियन्त्रक अधिकारी के अनुमोदन के बिना कर्त्तव्य से अनधिकृत अनुपस्थिति से स्वतः ही संविदा का पर्यावसान (समापन) हो जाएगा। तथापि आपवादिक मामलों में जहा (ड्‌यूटी) से अंधीकृत अनुपस्थिति के हालात, संविदा पर नियुक्त व्यक्ति के नियन्त्रण से बाहर हो, तो उसके नियमितिकरण के मामले पर विचार करते समय ऐसी अवधि अपवर्जित नहीं की जाऐगी, परन्तु पदधारी को इस बाबत समय पर नियन्त्रक अधिकारी को सूचित करना होगा। तथापि संविदा पर नियुक्त व्यक्ति कर्तव्य से अनुपस्थिति की ऐसी अवधि के लिए संविदात्मक रकम का हकदार नहीं होगा। परन्तु उसे सरकार के प्रचलित अनुदेशों के अनुसार चिकित्सा अधिकारी द्वारा जारी बीमारी/आरोग्य प्रमाण-पत्र प्रस्तुत करना होगा।

6. संविदा के आधार पर नियुक्त पदधारी, जिसने तैनाती के एक स्थान पर तीन वर्ष का कार्यकाल पूर्ण कर लिया है, आवश्यकता के आधार पर स्थानान्तरण के लिए पात्र होगा, जहां प्रशासनिक कारणों से ऐसा करना आवश्यक हो।

7. चयनित अभ्यर्थी को सरकारी/रजिस्ट्रीकृत चिकित्सा व्यवसायी से अपना आरोग्य प्रमाण-पत्र प्रस्तुत करना होगा। महिला अभ्यर्थियों की दशा में, बारह सप्ताह से अधिक की गर्भवती महिला प्रसव होने तक, अस्थाई तौर पर अनुपयुक्त बनी रहेगी। ऐसी महिला अभ्यर्थी का किसी प्राधिकृत चिकित्सा अधिकारी/व्यवसायी द्वारा उपयुक्तता के लिए पुनः परीक्षण किया जाना चाहिए।

8. संविदा पर नियुक्त व्यक्ति का यदि अपने पदीय कर्तव्यों के सम्बन्ध में दौरे पर जाना अपेक्षित हो, तो वह उसी दर पर, जैसी नियमित प्रतिस्थानी पदधारी को वेतनमान के न्यूनतम पर लागू है, यात्रा भत्ते/दैनिक भत्ते का हकदार होगा/होगी।

NOTIFICATION

Shimla-171002, the 21st May, 2015

No. EDN-B-B(2)-3/2013.—In exercise of the powers conferred by proviso to Article 309 of the Constitution of India, the Governor, Himachal Pradesh, in consultation with the Himachal Pradesh Public Service Commission, is pleased to make the following Rules further to amend the "Himachal Pradesh, Higher/Elementary Education Department, Punjabi Language Teacher, Class-III (Non-Gazetted) Recruitment and Promotion Rules, 2007 notified vide this Department Notification No.Shiksha-II-(Chha)6-3/2004-Vol-II dated 9.10.2007 namely:--

1. Short title and Commencement.—(1) These rules may be called the "Himachal Pradesh Higher/elementary Education Department, Punjabi Language Teacher, Class-III (Non- Gazetted) Recruitment and Promotion (First amendment) Rules, 2015.

(2) These rules shall come into force from the date of publication in the Rajpatra, Himachal Pradesh.

2. Amendments of Annexure-"A ".— In Annexure- "A" to the "Himachal Pradesh, Higher /Elementary Education Department, Punjabi Language Teacher, Class-III (Non-Gazetted) Recruitment and Promotion Rules, 2007:-,

(a) for the existing provisions against Col. No.4 following shall be substituted, namely;-- "(i) Pay scale for regular incumbents :—Pay Band Rs.10300-34800+3200/-Grade pay (ii) Emoluments for contract employees.—Rs.13500/-P.M. as per details given in column No.15-A";

(b) for the existing provision against Col. 7, the following shall be substituted, namely:-- (a) Essential Qualification.—(i) B.A. with Punjabi as an elective subject and 2-year Diploma in Elementary Education (by whatever name known).

BA with atleast 50% marks with Punjabi as an elective subject and 1-year Bachelor in Education (B.Ed.)

OR

BA with at least 45% marks with Punjabi as an elective subject and 1-year Bachelor in Education (B.Ed.) in accordance with the NCTE(Recognition Norms & Procedure) Regulations issued from time to time in this regard.

OR

B.A. with at least 50% marks with Punjabi as an elective subject and 1-year Bachelor in Education(B.Ed.) (Special Education).

OR

Giani with 50% marks followed by B.A. Examination (English and one additional subject) with 50% marks from a recognized University and 1-year Bachelor in Education (B.Ed.).

OR

M.A. (Punjabi) with at least 50% marks from a recognized university and 1-year Bachelor in Education(B.Ed.).

Note:--Graduation from a recognised University with Punjabi as a subject during the three year of graduation. B.Ed. with teaching of Punjabi(State Teacher Eligibility Test)

AND

(ii) Pass in Teacher Eligibility Test(TET) Language Teacher) duly conducted by H.P. Board of School Education, Dharamsala.

Provided that the incumbents who have already qualified the Teacher Eligibility Test(TET) conducted by the H.P. Subordinate Services Selection Board, Hamirpur shall also be eligible subject to the condition as laid down in Para-11 of the guidelines issued by the National Council for Teacher Education vide Notification No.76-4/2010/NCTE/Acad. Dated 11.2.2011.

Note(1):-- Relaxation up to 5% will be allowed in minimum educational qualifications and also in minimum qualifying marks for TET to the candidates belonging to SC/ST/OBC/PH categories of Himachal Pradesh.

Note(2) :-- Relaxation to those persons who are not B.Ed. and posses the academic qualification prescribed in Column-7(a) above shall also be eligible for appearing in the TET up to 31st March, 2014 only.

Note(3):-- The persons possessing graduation with 50% marks in the relevant subject shall also be eligible for appearing in TET for LT upto 31st March, 2014.

Note (4):-- Priority shall be given to those eligible candidates who possess the minimum qualifications specified in NCTE Notification dated 23rd August, 2010, as1223 राजपत्र, हिमाचल प्रदेश, 10 जून, 2015/20 ज्येष्ठ, 1937 amended from time to time and thereafter other candidates will be considered with the relaxed qualifications. This relaxation shall be valid up to 31.3.2014.

Note(5):-- Teachers who are appointed under the relaxed qualification norms shall have to acquire the minimum qualification within a period of two years from the year of appointment.

(b) Desirable.—Knowledge of customs, manner and dialects of Himachal Pradesh and suitability for appointment in the peculiar conditions prevailing in the Pradesh.

(c) for the existing provisions against Col. No.15-A-the following shall be substituted, namely:--

Notwithstanding anything contained in these Rules, contract appointments to the post will be made subject to the conditions given below:--

(i) Concept.—(a) Under this policy the Punjabi Language Teacher in the Department of Higher/Elementary Education H.P. will be engaged on contract basis initially for one year, which may be extendable on year to year basis:

Provided that for extension /renewal of contract period on year to year basis the concerned HOD shall issue a certificate that the service and conduct of the contract appointee is satisfactory during the year and only then his period of contract is to be renewed/extended.

(b) POST FALLS WITHIN THE PURVIEW OF HPSSSB:--The Deputy Director of Higher/Elementary Education of the concerned District after obtaining the approval of the Government to fill up the vacant posts on contract basis will place the requisition with the concerned recruiting agency i.e H.P. subordinate Services Selection Board, Hamirpur.

(c) The selection will be made in accordance with the eligibility conditions prescribed in these rules.

(II) CONTRACTUA EMOLUMENTS.—The Punjabi Language Teacher appointed on contract basis will be paid consolidated fixed contractual amount @ Rs. 13500/- P.M.(which shall be equal to minimum of the pay band + grade pay). An amount of Rs. 405/- (3% of the minimum of pay band + grade pay of the post) as annual increase in contractual emoluments for the subsequent year(s) will be allowed if contract is extended beyond one year.

(III) APPOINTING/DISCIPLINARY AUTHORITY.—The Deputy Director of Higher/ Elementary Education of the concerned District H.P. will be the appointing and disciplinary authority.

(IV) SELECTION PROCESS.—Selection for appointment to the post in the case of contract appointment will be made on the basis of viva-vice test or if considered necessary or expedient by a written test or practical test the standard/syllabus etc. of which will be determined by the concerned recruiting Agency i.e. HIMACHAL PRADESH SUBORDINATE SERVICES SELECTION BOARD, HAMIRPUR.

(V) COMMITTEE FOR SELECTION OF CONTRACTUAL APPOINTMENTS.—As may be constituted by the concerned recruiting agency i.e. HIMACHAL PRADESH SUBORDINATE SERVICES SELECTION BOARD ,Hamirpur from time to time.

(VI) AGREEMENT.—After selection of a candidate, he/she shall sign an agreement as per Annexure-B appended to these Rules.

1224 राजपत्र, हिमाचल प्रदेश, 10 जून, 2015/20 ज्येष्ठ, 1937 (VII) TERMS AND CONDITIONS.—(a)The contractual appointee will be paid fixed contractual amount @ Rs. 13500/- P.M. (which shall be equal to minimum of the pay band + grade pay). The Contract appointee will be entitled for increase in contractual amount @ Rs.405/- (3% of the minimum of the pay band + grade pay of the post) for further extended years and no other allied benefits such as senior/selection scales etc. will be given.

(b) The service of the Contract Appointee will be purely on temporary basis. The appointment is liable to be terminated in case the performance/conduct of the contract appointee is not found satisfactory .

(c) Contract Appointee will be entitled for one day's casual leave after putting one month service. However, the contract employee will also be entitled for 16 weeks Materrnity Leave and 10 days Medical Leave and 5 days special leave. He/She shall not be entitled for Medical Reimbursement and LTC etc. No leave of any other kind except above is admissible to the contract appointee.

Provided that the un-availed casual leave, Medical leave and special leave can be accumulated up to the calendar year and will not be carried forward for the next Calendar Year.

(d) Unauthorized absence from the duty without the approval of the controlling officer shall automatically lead to the termination of the contract. However, in exceptional cases where the circumstances for un-authorized absence from duty were beyond his/her control on medical grounds, such period shall not be excluded while considering his/her case for regularization but the incumbent shall have to intimate the controlling authority in this regard well in time.

However, the contract appointee shall not be entitled for contractual amount for this period of absence from duty.

Provided that he/she shall submit the certificate for illness/fitness issued by the Medical Officer, as per prevailing instructions of the Government.

(e) An official appointed on contract basis who have completed 3 years tenure at one place of posting will be eligible for transfer on need based basis wherever required on administrative grounds

(f) Selected candidate will have to submit a certificate of his/her fitness from a Government/Registered Medical Practitioner. In case of women candidates pregnancy beyond twelve weeks will render her temporarily unfit till confinement is over. The Women candidate will be re-examined for the fitness from an authorized Medical Officer/Petitioner.

(g) Contract appointee will be entitled to TA/DA if required to go on tour in connection with his/her official duties at the same rate as applicable to regular counterpart at the minimum of pay scale.

(h) Provisions of service rules like FR-SR, Leave Rules, GPF Rules, Pension Rules and conduct Rules etc. as are applicable to regular employees will not be applicable in case of contract appointees. They will be entitled for emoluments etc. as detailed in this column.

Form of contract/ agreement to be executed between the Punjabi Language Teacher and the

Government of Himachal Pradesh through Director of Higher /Elementary Education.

This agreement is made on this _______________ day of ____________ in the year____________ between Sh./Smt.______________________________S/O Shri_________________R/O________________________________________Contract appointee (hereinafter called the EIRST PARTY), AND The Governor of Himachal Pradesh through Deputy Director of Higher/ Elementary Education Himachal Pradesh (here-in-after the SECOND PARTY). Whereas, the SECOND PARTY has engaged the aforesaid FIRST PARTY and the FIRST PARTY has agreed to serve as a Punjabi Language Teacher on contract basis on the following terms & conditions:--

1. That the FIRST PARTY shall remain in the service of the SECOND PARTY as Punjabi Language Teacher for a period of one year commencing on day of ________________ and ending on the day of . It is specifically mentioned and agreed upon by both the parties that the contract of the FIRST PARTY with SECOND PARTY shall ipso- facto stand terminated on the last working day i.e on _________________and information notice shall not be necessary.

Provided that for further extension /renewal of contract period the concerned HOD shall issue a certificate that the service and conduct of the contract appointee was satisfactory during the year and only then his period of contract is to be renewed/extended.

2. The contractual amount of the FIRST PARTY will be Rs.13,500/- per month.

3. The service of FIRST PARTY will be purely on temporary basis. The appointment is liable to be terminated in case the performance/ conduct of the contract appointee is not found good or if a regular incumbent is appointed/ posted against the vacancy for which the first party was engaged on contract.

4. Contractual Punjabi Language Teacher will be entitled for one day casual leave after putting in one month service. However, the contract employee will also be entitled for 16 weeks Maternity Leave and 10 days Medical Leave and 5 days special leave. He/She shall not be entitled for Medical Re-imbursement and LTC etc. No leave of any other kind except above is admissible to the contractual Language Teacher.

Provided that the unavailed Casual Leave, Medical Leave and special leave can be accumulated upto the Calendar Year and will not be carried forward for the next Calendar Year.

5. Unauthorized absence from the duty without the approval of the controlling Officer shall automatically lead to the termination of the contract. However, in exceptional cases where the circumstances for un-authorised absence from duty were beyond his/her control on medical grounds, such period shall not be excluded while considering his/her case for regularization but the incumbent shall have to intimate the controlling authority in this regard well in time.

7. Selected candidate will have to submit a certificate of his/her fitness from a Government/Registered Medical Practitioner. In case of Woman candidate pregnancy beyond twelve weeks will render her temporarily unfit till the confinement is over. The woman candidate should be re-examined for fitness from an authorized Medical Officer/ Practitioner.

8. Contract appointee shall be entitled to TA/DA if required to go on tour in connection with his /her official duties at the same rate as applicable to regular counter-part official at the minimum of pay scale.

9. The Employees Group Insurance Scheme as well as EPF/GPF will not be applicable to contractual appointee(s).IN WITNESS the FIRST PARTY AND SECOND PARTY have herein to set their hands the day, month and year first, above written.

1. यतः, उपर्युक्त नियमों के अनुसरण में, आयोग ने बैलेटिंग यूनिट पर प्रदर्शित किए जाने वाले मत पत्र एवं डाक मत पत्र पर और परिषद्‌ निर्वाचन क्षेत्रों से निर्वाचनों एवं विधान सभा सदस्यों द्‌वारा निर्वाचनों के लिए मत पत्रों पर मुद्रित किए जाने वाले विवरणों को विनिर्दिष्ट कर दिया है; और

2. यतः, आयोग ने यह नोट किया है कि ऐसे बहुत से मामले हैं जहां अभ्यर्थी एक जैसे या समान नाम से एक ही निर्वाचन क्षेत्र से निर्वाचन लड़ते हैं, और यद्‌यपि एक समान नाम वाले दो या दो से अधिक अभ्यर्थियों के मामले में, अभ्यर्थियों के नाम में उपयुक्त प्रत्यय जोड़े जाते हैं, फिर भी आयोग ने विचार किया है कि मतदान के समय निर्वाचकों के मस्तिष्क से भ्रम को निकालने के लिए अतिरिक्त उपाय किए जाने अपेक्षित हैं और इसके अतिरिक्त आयोग ने यह विचार किया है कि मत पत्र पर अभ्यर्थियों के फोटोग्राफ से निर्वाचकों को अपना मत डालने में और अभ्यर्थियों को भी अपना प्रचार करने में सुविधा होगी।

3. अतः, अब, मामले के सभी पहलुओं पर विचार करने के पश्चात्‌, निर्वाचनों के संचालन नियम 1961 के नियम 70 के साथ पठित नियम 22, नियम 30 तथा नियम 49ख के अधीन आयोग द्‌वारा समय-समय पर जारी किए गए विद्‌यमान निदेशों के आंशिक संशोधन में, आयोग एतद्‌दवारा विनिर्दिष्ट करता है कि 1 मई, 2015 के बाद कराए जाने वाले सभी निर्वाचनों में ईवीएम की बैलेटिंग यूनिट पर प्रदर्शित किए जाने वाले मत पत्रों, साधारण मत पत्रों तथा डाक मत पत्रों में विद्‌यमान निदेशों के अनुसार विवरणों के अतिरिक्त इन पर अभ्यर्थियों के फोटो भी मुद्रित होंगे। अभ्यर्थियों के फोटो, अभ्यर्थियों के नाम के लिए पैनल में मुद्रित होंगे तथा अभ्यर्थी के नाम तथा प्रतीक के मध्य में नाम के दाहिने ओर या मत/प्राथमिकता चिन्हित करने के कॉलम, जैसी भी स्थिति हो, में आएंगे। फोटोग्राफ के लिए विनिर्देशन निम्नलिखित अनुसार होंगे :-- (क) अभ्यर्थियों को अपनी नवीनतम फोटो प्रस्तुत करना अपेक्षित है (अधिसूचना की तिथि से 3 माह पहले की पूर्ववर्ती अवधि के दौरान लिया गया हो)

(ii) फोटो व्हाइट/ऑफ व्हाइट पृष्ठभूमि में स्टाम्प आकार 2 से.मी.×2.5 से.मी. (चौड़ाई में 2 से.मी. तथा ऊंचाई में 2.5 से.मी.) होनी चाहिए, पूरा चेहरा सीधे कैमरे की तरफ हो, चेहरे की तटस्थ अभिव्यक्ति हो तथा आंखें खुली हों। फोटो अभ्यर्थी की सुविधानुसार रंगीन या काला और सफेद हो।

(iii) फोटो साधारण पोशाक में होना चाहिए। वर्दी में फोटो की अनुमति नहीं है। टोपी/हैट लगाने से बचना चाहिए/गहरे रेग के चश्मे से भी बचना चाहिए।

4. उपर्युक्त निदेश, इसके पश्चात्‌ आयोजित किए जाने वाले सभी लोक सभा, राज्य सभा, विधान सभा तथा विधान परिषद्‌ के निर्वाचनों पर लागू होंगे।

No. 576/3/2015/SDR.— Whereas, under Rules 22, 30 and 49B read with Rule 70 of the Conduct of Elections Rules, 1961, the ballot paper to be displayed on the balloting unit of the EVM, ordinary ballot papers, and postal ballot papers shall contain such particulars as the Election Commission may specify ; and

1. Whereas, in terms of abovementioned Rules, the Commission has specified the particulars to be printed on the ballot paper to be displayed on the balloting unit and the postal ballot paper, and on ballot papers for elections from Council Constituencies and at elections by Assembly members; and 2. Whereas, the Commission has noted that there are many cases where candidates with same or similar names contest from the same Constituency, and although appropriate suffixes are added to the names of candidates in the event of two or more candidates having same name, the Commission considers that additional measures are required for removing confusion in the minds of electors at the time of voting, and further, the Commission considers that photographs of candidates on ballot paper will facilitate the electors in casting their votes and also the candidates in their campaign:

Now, therefore, after having considered all aspects of the matter, the Commission, in partial modification of its existing directions under Rule 22, Rule 30 and Rule 49B read with Rule 70 of the Conduct of Elections Rules 1961, issued from time to time, hereby specifies that for all elections to be held from 1st May 2015 onwards, the postal ballot papers, the ordinary ballot papers and the ballot papers to be displayed on the balloting unit of EVM shall, in addition to the particulars as per the existing directions, also contain the photograph of the candidates printed thereon. The photograph of the candidates shall be printed in the panel for the name of the candidates and shall appear to the right side of the name in between the name and symbol of the candidate or the column for marking vote/preference, as the case may be. The specification for the photograph shall be as follows:--

(a) The candidates are required to submit their recent photograph (taken during the preceding period of 3 months before the date of notification.)

(ii) The photograph should be of stamp size 2 cm. X 2.5 cm. (2 cm. in breadth and 2.5 cm. in height) in white/off white background, with full face view directly facing the camera, neutral facial expression with eyes open. The photo may be in colour or black and white as may be convenient for the candidate.

(iii) Photograph should be in normal clothing. Photograph in uniform is not permitted.

Caps/hats should be avoided. Dark glasses also are to be avoided.

4. The above direction shall apply in relation to all elections to the House of the People, Council of States, Legislative Assembly and Legislative Council to be held hereafter.
