शिमला की सड़कों का उपयोग करने वालों तथा पैदल चलने वालों के लिए (लोक सुरक्षा और सुविधा) अधिनियम, 2007 (2008 का अधिनियम संख्यांक 2) का और संशोधन करने के लिए अधिनियम।

भारत गणराज्य के छियासठवें वर्ष में हिमाचल प्रदेश विधान सभा द्वारा निम्नलिखित रूप में यह अधिनियमित हो :-

1. संक्षिप्त नाम.--इस अधिनियम का संक्षिप्त नाम शिमला की सड़कों का उपयोग करने वालों तथा पैदल चलने वालों के लिए (लोक सुरक्षा और सुविधा) संशोधन अधिनियम, 2015 है।

2. धारा 11 का संशोधन.--शिमला की सड़कों का उपयोग करने वालों तथा पैदल चलने वालों के लिए (लोक सुरक्षा और सुविधा) अधिनियम, 2007 (जिसे इसमें इसके पश्चात्‌ ''मूल अधिनियम'' कहा गया है) की धारा 11 के खण्ड (घ) में, ''उप-निरीक्षक'' शब्दों और चिन्ह के स्थान पर ''सहायक उप-निरीक्षक'' शब्द और चिन्ह रखे जाएंगे।

3. धारा 12 का संशोधन.--मूल अधिनियम की धारा 12 में,-

(क) उपधारा (1) के परन्तुक में, ''उप-निरीक्षक'' शब्दों और चिन्ह के स्थान पर ''सहायक उप-निरीक्षक'' शब्द और चिन्ह रखे जाएंगे; और

(ख) उपधारा (2) के परन्तुक में, ''उप-निरीक्षक'' शब्दों और चिन्ह के स्थान पर ''सहायक उप-निरीक्षक'' शब्द और चिन्ह रखे जाएंगे।

Act No. 22 of 2015 THE SHIMLA ROAD USERS AND PEDESTRIANS (PUBLIC SAFETY AND CONVENIENCE) AMENDMENT ACT, 2015

(AS ASSENTED TO BY THE GOVERNOR ON 11TH JUNE, 2015)

ACT

further to amend the Shimla Road Users and Pedestrians (Public Safety and Convenience)

Act, 2007 (Act No. 2 of 2008).

BE it enacted by the Legislative Assembly of Himachal Pradesh in the Sixty-sixth Year of the Republic of India as follows:—

1. Short title.—This Act may be called the Shimla Road Users and Pedestrians (Public Safety and Convenience) Amendment Act, 2015.

2. Amendment of section 11.—In section 11 of the Shimla Road Users and Pedestrians (Public Safety and Convenience) Act, 2007 (hereinafter referred to as the "principal Act"), in clause (d), for the words and sign, " Sub-Inspector", the words and sign "Assistant Sub-Inspector" shall be substituted.

3. Amendment of section 12.—In section 12 of the principal Act,—

(a) in sub-section (1), in proviso, for the words and sign "Sub-Inspector", the words and sign "Assistant Sub-Inspector" shall be substituted.; and

(b) in sub-section (2), in proviso, for the words and sign "Sub-Inspector", the words and sign "Assistant Sub-Inspector" shall be substituted.

HHC/Rules 23-1/S/80/III.—In exercise of the powers conferred by Article 229 of the Constitution of India, and all other powers enabling in this behalf, Hon'ble the Chief Justice of High Court of Himachal Pradesh is pleased to make the following amendments in the Rules known as "High Court of Himachal Pradesh (Supply of Liveries to court Servants Rules, 1983":-

Short Title.—These rules may be called the "High Court of Himachal Pradesh (Supply

of Liveries to Court Servants (11thAmendment-2015) Rules, 1983".

Commencement.— These rules shall come into force with immediate effect.

Ammendment.—(i) The words "terricot Grey" shall be substituted by the word "terricot Dark Grey" against the existing Sr. No.2 and 4 of the Annexure "A", "Summer Uniform to Drivers" and "Raincoat" as existing in Annexure "A" against Sr. No.10 under the caption(For Drivers) shall now be substituted as under:-

(ii) The words "and Motor Mechanic" shall be added after the title word "Drivers" as appearing in annexure 'A", annexed to the Rules (supra). Consequently, the Motor Mechanic shall be entitled to livery at par with Drivers.

RECRUITMENT AND PROMOTION RULES FOR THE POST OF SENIOR

ENVIRONMENT OFFICER, (GAZETTED) CLASS-I IN THE DEPARTMENT OF

ENVIRONMENT, SCIENCE & TECHNOLOGY, HIMACHAL PRADESH

1. Name of the Post.— Senior Environment Officer

2. Number of Post(s).—01 (One)

3. Classification.— Class-I (Gazetted)

4. Scale of Pay.— (i) Pay scale for regular incumbent: Pay Band ` 15600-39100+ `

6600/- Grade Pay

(ii) Emoluments for contract employee : ` 22,200/-as per details

given in Column 15-A.

5. Whether "Selection" post or "Non-Selection"post.—Selection.

6. Age for direct recruitment.—45 years and below.

Provided that the upper age limit for direct recruits will not be applicable to the candidates already in service of the Government including those who have been appointed on adhoc or on contract basis:

Provided further that if a candidate appointed on adhoc basis or on contract basis had become over-age on the date he/she was appointed as such he/she shall not be eligible for any relaxation in the prescribed age-limit by virtue of his/her such adhoc or contract appointment:

This concession will not, however, be admissible to such staff of the Public Sector Corporations/ Corporations/Autonomous Bodies who are/were subse- quently appointed by such Corporations/ Autonomous Bodies and who are/were finally absorbed in the service of such Corporations/ Autonomous Bodies after initial constitution of the Public Sector Corporations/Autonomous Bodies:

NOTES:

(1) Age limit for direct recruitment will be reckoned on the first day of the year in which the post(s) is/are advertised for inviting applications or notified to the Employment Exchanges or as the case may be.

(2) Age and experience in the case of direct recruitment, relaxable at the discretion of the H.P. Public Service Commission in case the candidate is otherwise well qualified.

7. Minimum educational and other qualifications required for direct recruit(s).—(a)

Essential Qualification(s):

i) Ph.D in relevant branch of Environmental Science or Master of Engineering in Environmental Science or Agriculture or Master of Technology in Environment Science/Agriculture from a recognized University or an Institution duly recognized by the Central/H.P. Government; and

ii) Atleast four years research/work experience in project formulation, implement- ation, feasibility analysis and monitoring, survey studies and evaluations, environment monitoring & planning, environment protection and conservation, community led environmental awareness, steering of environment projects, IEC and awareness campaign on environment related aspects in a reputed institution/organization.

OR

i) Master Degree in Environmental Science or Bachelor of Engineering in Environmental Science or Agriculture or Bachelor of Technology in Environment Science/ Agriculture from a recognized University or an Institution duly recognized by the Central/H.P. (b) Desirable Qualification(s).—Knowledge of customs, manners & dialects of Himachal Pradesh and suitability for appointment in the peculiar conditions prevailing in the Pradesh.

8. Whether age and educational qualification(s) prescribed for direct recruit(s) will

apply in the case of the promotee(s).—Age: Not Applicable.

Educational Qualification: Yes, as prescribed in Column No.7 (a) (i) above.

9. Period of probation, if any.—Two years subject to such further extension for a period not exceeding one year as may be ordered by the competent authority in special circumstances and reasons to be recorded in writing.

10. Method(s) of recruitment, whether by direct recruitment or by promotion, deputation, transfer and the percentage of post(s) to be filled in by variousn methods.—100 percent by promotion failing which on secondment basis and failing both by direct recruitmenton a 'regular' basis or by recruitment on contract basis, as the case may be.

11. In case of recruitment by promotion, secondment, transfer, grade from which promotion/secondment/transfer is to be made.—By promotion from amongst the Environment Engineers subject to possessing of educational qualification prescribed for direct recruitment against Column No.7 (a)(i) above with 8 (eight) years regular service or regular combined with continuous adhoc service, if any, in the grade failing which on secondment basis from amongst the incumbent of this post working in the identical pay scale from other Departments /Boards Corporations/Autonomous Bodies of Himachal Pradesh Government.

(1) In all cases of promotion, the continuous adhoc service rendered in the feeder post, if any, prior to regular appointment to the post shall be taken into account towards the length of service as prescribed in these Rules for promotion subject to the conditions that the adhoc appointment/promotion in the feeder category had been made after following proper acceptable process of selection in accordance with the provisions of R&P Rules:

Provided that in all cases where a junior person becomes eligible for consideration by virtue of his/her total length of service (including the service rendered on adhoc basis, followed by regularn service/appointment) in the feeder post in view of the provision referred to above, all persons senior to him/her in the respective category/post/cadre shall be deemed to be eligible for consideration and placed above the junior person in the field of consideration:

Provided that all incumbents to be considered for promotion shall possess the minimum qualifying service of at least three years' or that prescribed in the R & P Rules for the post, whichever is less:

Provided further that where a person becomes ineligible to be considered for promotion on account of the requirements of the proceeding proviso, the persons(s) junior to him/her shall also be deemed to be ineligible for consideration for such promotion.

Explanation.—The last proviso shall not render the junior incumbents ineligible for consideration for promotion if the senior ineligible person(s) happened to be Ex-Servicemen recruited under the provisions of Rule-3 of the Demobilized Armed Forces Personnel (Reservation of vacancies in Himachal State Non- Technical Service) Rules, 1972 and having been given the benefit of seniority there under or recruited under the provisions of Rule-3 of Ex-Servicemen (Reservation of vacancies in the Himachal Pradesh Technical Service) Rules, 1985 and having been given the benefit of seniority there-under.

(2) Similarly, in all cases of confirmation, adhoc service rendered on the feeder post, if any, prior to the regular appointment/promotion against such post shall be taken into account towards the length of service, if the adhoc appointment/promotion had been made after proper selection and in accordance with the provision of the Recruitment & Promotion Rules:

Provided that inter-se-seniority as a result of confirmation after taking into account, adhoc service rendered as referred to above shall remain unchanged.

12. If a Departmental Promotion Committee exists, what is its composition?.—As

may be constituted by the Government from time to time.

13. Circumstances under which the H.P.P.S.C. is to be consulted in making

recruitment.—As required under the law.

14. Essential requirement for a direct recruitment.—A candidate for appointment to any service or post must be a citizen of India.

15. Selection for appointment to post by direct recruitment.—Selection for appointment to the post in the case of direct recruitment shall be made on the basis of viva-voce test; if the Himachal Pradesh Public Service Commission or other recruiting authority, as the case may be, so consider necessary or expedient by a written test or practical test, the standard/syllabus etc. of which will be determined by the Commission/other recruiting authority, as the case may be.

15.A. Selection for appointment to the post by Contract recruitment.— Notwithstanding anything contained in these Rules, contract appointments to the post will be made subject to the terms and conditions given below:-

(I) CONCEPT:

(a) Under this policy the Senior Environment Officer in the Department of Environment, Science and Technology, H.P. will be engaged on contract basis initially for one year; which may be extendable fromyear to year basis:

Provided that for extension/renewal of contract period on year to year basis the concerned Head of Department shall issue a certificate that the service and conduct of the contract appointe is satisfactory during the year and only then his period of contract is to be renewed extended.

(b) POST FALLS WITHIN THE PURVIEW OF HPPSC:-

The Principal Secretary (Environment, Science and Technology) to the Government of Himachal Pradesh after obtaining the approval of the Government to fill up the vacant post on contract basis will place therequisition with the concerned recruiting agency i.e. Himachal Pradesh Public Service Commission;

(II) CONTRACTUAL EMOLUMENTS:

The Senior Environment Officer appointed on contract basis will be paid consolidated fixed contractual amount @ R 22,200/- per month (which shall be equal to minimum of pay band + grade pay). An amount of R 666/- (3% of the minimum of Pay band + Grade Pay of the post) as annual increase in contractual emoluments for the subsequent year(s) will be allowed if contract is extended beyond one year.

(III) APPOINTING/DISCIPLIANRY AUTHORITY:

The Principal Secretary (Environment, Science and Technology) to the Government of Himachal Pradesh will be appointing and disciplinary authority;

(IV) SELECTION PROCESS:

Selection for appointment to the post in the case of contract appointment will be made on the basis of viva-voce test or if considered necessary or expedient by a written test or practical test the standard/syllabus etc. of which will be determined by the concerned recruiting agency i.e. Himachal Pradesh Public Service Commission;

(V) COMMITTEE FOR SELECTION OF CONTRACTUAL APPOINTMENT :-

As may be constituted by the concerned recruiting agency i.e. the Himachal Pradesh Public ServiceCommission from time to time.

(VI) AGREEMENT:

After selection of a candidate he/she shall sign an agreement as per Annexure-B appended to these rules.

(VII) TERMS AND CONDITIONS:

(a) The contractual appointee will be paid fixed contractual amount @ R 22,200/- per month (which shall be equal to minimum of the pay band + grade pay). The contract appointee will be entitled for increase in contractual amount @ R 666/- (3% of minimum of the pay band + grade pay of the post) for further extended years and no other allied benefits such as senior/ selection scales etc. will be given;

(b) The service of the contract appointee will be purely on temporary basis. The appointment is liable to be terminated in case the performance/ conduct of the contract appointee is not found satisfactory;

(c) Contract Appointee will be entitled for one day's casual leave after putting one month service. However, the contract employee will also be entitled for 16 weeks Maternity Leave, 10 days Medical Leave and 5 days special leave. He/she shall not be entitled for Medical Re-imbursement and LTC etc. No leave of any other kind except above is admissible to the contract appointee:

Calendar Year and will not be carried forward for the next Calendar Year;

(d) Unauthorized absence from the duty without the approval of the controlling officer shall automatically lead to the termination of the contract. However, in exceptional cases where the circumstances for unauthorized absence from duty were beyond his/her control on medical grounds, such period shall not be excluded while considering his/her case for regularization but the incumbent shall have to intimate the controlling authority in this regard well in time. However, the contract appointee shall not be entitled for contractual amount for this period of absence from duty.

Provided that he/she shall submit the certificate of illness/fitness issued by the Medical Officer, as per prevailing instructions of the Government;

(e) An official appointed on contract basis who has completed three years tenure at one place of posting will be eligible for transfer on need based basis wherever required on adminis- trative grounds;

(f) Selected candidate will have to submit a certificate of his/her fitness from a Government/ Registered Medical Practitioner. Women candidate pregnant beyond 12 weeks will stand temporarily unfit till the confinement is over. The women candidate will be re-examined for the fitness from an authorized Medical Officer/Practitioner;

(g) Contract appointee will be entitled to TA/DA if required to go on tour in connection with his/her official duties at the same rate as applicable to regular counterpart officials at the minimum of pay scale; and

(h) Provisions of service rules like FR SR, Leave Rules, GPF Rules, Pension Rules & Conduct Rules etc. as are applicable in case of regular employees will not be applicable in case of contract appointees. They will be entitled for emoluments etc. as detailed in this Column.

16. Reservation.—The appointment to the service shall be subject to orders regarding reservation in the service for Scheduled Castes/ Scheduled Tribes/Other Backward Classes/ Other Categories of persons issued by the Himachal Pradesh Government from time to time.

17. Departmental Examination.—Every member of the service shall pass a Departmental Examination as prescribed in the H.P Departmental Examination Rule, 1997 as amended from time to time.

18. Powers to relax.— Where the State Government is of the opinion that it is necessary or expedient to do so, it may, by order for reasons to be recorded in writing and in consultation with the Himachal Pradesh Public Service Commission relax any of the provision(s) of these Rules with respect to any Class or Category of person(s) or post(s);

Annexure –B

FORM OF CONTRACT/AGREEMENT TO BE EXECUTED BETWEEN THE SENIOR

ENVIRONMENT OFFICER AND THE GOVERNMENT OF HIMACHAL PRADESH

THROUGH THE SECRETARY(ENVIRONMENT,SCIENCE & TECHNOLOGY) TO THE

GOVERNMENT OF HIMACHAL PRADESH.

This agreement is made on this………..….day of….………….………in the year …………………..between Sh./Smt……………………... S/o/D/o ……………………….

…..R/o………………. ……… contract appointee, (hereinafter called the FIRST PARTY) AND The Governor, Himachal Pradesh through Secretary (Environment, Science & Technology), Himachal Pradesh (hereinafter "SECOND PARTY").

Whereas the SECOND PARTY has engaged the aforesaid FIRST PARTY and the FIRST PARTY has agreed to serve as a Senior Environment Officer on contract basis on the following terms and conditions:-

1. That the FIRST PARTY shall remain in the service of the SECOND PARTY as a Senior Environment officer for a period of one year commencing on day of ………………….and ending on the day of …………………It is specifically mentioned and agreed upon by both the parties that the contract of the FIRST PARTY with SECOND PARTY shall ipso-facto stand terminated on the last working day i.e. on ………and information notice shall not be necessary:

Provided that for further extension/ renewal of contract period the HOD shall issue a certificate that the service and conduct of the contract appointee was satisfactory during the year and only than the period of contract is to be renewed/ extended.

2. That the contractual amount of the FIRST PARTY will be R 22,200/- per month (which shall be equal to minimum of pay band + grade pay).

3. That the services of FIRST PARTY will be purely on temporary basis. The appointment is liable to be terminated in case the performance/ conduct of the contract appointee is not found good or if a regular incumbent is appointed/posted against the vacancy for which the FIRST PARTY was engaged on contract.

4. That Contractual Senior Environment Officer will be entitled for one day's casual leave after putting in one month service. However, the contract employee will also be entitled for 16 weeks Maternity Leave, 10 day's Medical Leave and 5 days special leave. He/she will not be entitled for Medical Re-imbursement and LTC etc. No leave of any other kind except above is admissible to the contractual Senior Environment Officer:

Provided that the un-availed Casual Leave and Medical Leave can be accumulated upto Calendar Year and will not be carried forward for the next Calendar year:

संख्या : एसटीई-बी(3)-6/2010.-हिमाचल प्रदेश की राज्यपाल, भारत के संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदा शक्तियों का प्रयोग करते हुए, हिमाचल प्रदेश लोक सेवा आयोग के परामर्श से, हिमाचल प्रदेश पर्यावरण, विज्ञान एवं प्रौद्योगिकी विभाग में वरिष्ठ पर्यावरण अधिकारी, वर्ग-I (राजपत्रित), अलिपिक वर्गीय सेवाएं, पद के लिए इस अधिसूचना से संलग्न उपाबन्ध-'क' के अनुसार भर्ती और प्रोन्नति नियम बनाते हैं, अर्थात्‌ :-

1. संक्षिप्त नाम और प्रारम्भ.-(1) इन नियमों का संक्षिप्त नाम हिमाचल प्रदेश पर्यावरण, विज्ञान एवं प्रौद्योगिक विभाग, वरिष्ठ पर्यावरण अधिकारी वर्ग-I (राजपत्रित), अलिपिक वर्गीय सेवाएं भर्ती और प्रोन्नति नियम, 2015 है।

2. ये नियम राजपत्र (ई-गजट), हिमाचल प्रदेश में प्रकाशन की तारीख से प्रवृा होंगे।

आदेश द्वारा,

अति0 मुख्य सचिव (पर्यावरण, विज्ञान एवं प्रौद्योगिक)।1297 राजपत्र, हिमाचल प्रदेश, 20 जून, 2015/30 ज्येष्ठ, 1937 'उपाबन्ध-क' हिमाचल प्रदेश पर्यावरण, विज्ञान एवं प्रौद्योगिकी विभाग में वरिष्ठ पर्यावरण अधिकारी, वर्ग- I (राजपत्रित), अलिपिक वर्गीय सेवाएं, भर्ती एवं प्रोन्नति नियम,

1. पद का नाम.-वरिष्ठ पर्यावरण अधिकारी

4. वेतनमान.-(i) नियमित पदधारियों के लिए वेतनमानः

पे बैण्ड `15600-39100 6600 ग्रेड पे। ii) संविधा के आधार पर नियुक्त पदधारियों के लिए वेतनमान :

स्तम्भ सं0 15 क में दिए गए ब्यौरे के अनुसार `22,200/- प्रतिमास। 5. चयन पद अथवा अचयन पद.-चयन

6. सीधी भर्ती किए जाने वाले व्यक्तियों के लिए आयु.-45 वर्ष या इससे कमः

परन्तु सीधी भर्ती किए जाने वाले व्यक्तियों के लिए ऊपरी आयु सीमा तदर्थ या संविदा के आधार पर नियुक्त किए गए व्यक्तियों सहित पहले से ही सरकार की सेवा में रत अभ्यर्थियों को लागू नही होगी;

परन्तु यह और कि यदि तदर्थ या संविदा के आधार पर नियुक्त किया गया अभ्यर्थी इस रुप में नियुक्ति की तारीख को अधिक आयु का हो गया हो, तो वह तदर्थ या संविदा के आधार पर नियुक्ति के कारण विहित आयु में छूट का पात्रा नहीं होगा;

परन्तु यह और कि अनुसूचित जातियों/अनुसूचित जनजातियों/ अन्य प्रवर्गों के व्यक्तियों के लिए ऊपरी आयु सीमा में उतनी ही छूट दी जा सकेगी जितनी कि हिमाचल प्रदेश सरकार के साधारण या विशेष आदेश (आदेशों) के अधीन अनुज्ञेय है ;

परन्तु यह और भी कि समस्त पब्लिक सैक्टर, निगमों तथा स्वायत निकायों के सभी कर्मचारियों को, जो ऐसे पब्लिक सेक्टर निगमों/स्वायत निकायों के प्रारम्भिक गठन के समय ऐसे पब्लिक सेक्टर निगमों/ स्वायत निकायों में आमेलन से पूर्व सरकारी कर्मचारी थे, सीधी भर्ती में आयु सीमा में ऐसी ही रियायत दी जाएगी जैसी सरकारी कर्मचारियों को अनुज्ञेय है, किन्तु इस प्रकार की रियायत पब्लिक सैक्टर, निगमों तथा स्वायत निकायों के ऐसे कर्मचारिवृन्द को नहीं दी जायेगी, जो पश्चातवर्ती ऐसे निगमों/स्वायत निकायों द्वारा नियुक्त किए गए थे/किए गये हैं और उन पब्लिक सैक्टर, निगमों/स्वायत निकायों के प्रारम्भिक गठन के पश्चात ऐसे निगमों/स्वायत निकायों की सेवा में अन्तिम रुप से आमेलित किए गये हैं/किए गए थे । (1) सीधी भर्ती के लिए आयु सीमा की गणना उस वर्ष के प्रथम दिवस से की जाएगी, जिसमें पद (पदों) को आवेदन आमन्त्रिात करने के लिए, यथास्थिति विज्ञापित किया गया है या नियोजनालयों को अधिसूचित किया गया है।

(2) अन्यथा सुअर्हित अभ्यर्थियों की दशा में सीधी भर्ती के लिए आयु सीमा और अनुभव, हिमाचल प्रदेश लोक सेवा आयोग के विवेकानुसार शिथिल किया जा सकेगा।

7. सीधे भर्ती किए जाने वाले व्यक्ति (व्यक्तियों) के लिए अपेक्षित न्यूनतम शैिक्षक और अन्य अर्हताएं.- (क) अनिवार्य अर्हता(एं)ः 1298 राजपत्र, हिमाचल प्रदेश, 20 जून, 2015/30 ज्येष्ठ, 1937 i) किसी मान्यता प्राप्त विश्वविद्यालय या केन्द्रीय सरकार/हिमाचल प्रदेश द्वारा सम्यक्‌ रूप से मान्यता प्राप्त किसी संस्था से पर्यावरण विज्ञान की सुसंगत शाखा में पी0एच0डी या पर्यावरण विज्ञान या कृषि में इंजीनियरिंग निूणात या पर्यावरण विज्ञान/कृषि में प्रौद्योगिकी निष्णात; और ii) किसी ख्यााति प्राप्त संस्थान/संगठन में पर्यावरण से संबंधित पहलुओं पर परियोजना सूत्राीकरण, कार्यान्वयन, व्यवहार्यता विश्लेषण और अनुश्रवण, सर्वेक्षण अध्ययन और मूल्यांकन, पर्यावरण अनुश्रवण एवं योजना, पर्यावरण सुरक्षा और संरक्षण, सामुदायिक मार्गदर्शक पर्यावणीय जागरूकता, पर्यावरण परियोजनाओं के परिचाालन, आई0ई0सी0 और जागरूकता अभियाान में कम से कम चार वर्ष का अनुसंधान कार्य/अनभव।

या

i) किसी मान्यता प्राप्त विश्वविद्यालय या केन्द्रीय सरकार/हिमाचल प्रदेश सरकार द्वारा सम्यक्‌ रूप से मान्यता प्राप्त किसी संस्थान से पर्यावरण विज्ञान में स्नातकोतर उपाधि या पर्यावरण विज्ञान या कृषि में इंजीनियरिंग स्नातक या पर्यावरण विज्ञान/कृषि में प्रौद्योगिकी स्नातक; और ii) किसी ख्यााति प्राप्त संस्थान/संगठन में पर्यावरण से संबंधित पहलुओं पर परियोजना सूत्राीकरण, कार्यान्वयन, व्यवहार्यता विश्लेषण और अनुश्रवण, सर्वेक्षण अध्ययन और मूल्यांकन, पर्यावरण अनुश्रवण एवं योजना, पर्यावरण सुरक्षा और संरक्षण, सामुदायिक मार्गदर्शक पर्यावणीय जागरूकता, पर्यावरण परियोजनाओं के परिचाालन, आई0ई0सी0 और जागरूकता अभियाान में कम से कम आठ वर्ष का अनुसंधान/कार्य अनुभव ।

(ख) वांछनीय अर्हता(एं).-हिमाचल प्रदेश की रुढ़ियों, रीतियों और बोलियों का ज्ञान और प्रदेश में विद्यमान विशिष्ट दशाओं में नियुक्ति केलिए उपयुक्तता।

8. सीधे भर्ती किए जाने वाले व्यक्ति (व्यक्तियों) के लिए विहित आयु और शैक्षणिक अहर्ता (अर्हताएं) प्रोन्नत व्यक्ति (व्यक्तियों) की दशा में लागू हाेंगी या नहीं.-आयु.-लागू नहीं ।

शैक्षिक अर्हता.-हां, जैसी उपरोक्त स्तम्भ 7(क) (i) में विहित की गई है।

9. परिवीक्षा की अवधि, यदि कोई हो.-दो वर्ष, जिसका एक वर्ष से अनधिक ऐसी और अवधि के लिए विस्तार किया जा सकेगा जैसा सक्षम प्राधिकारी विशेष परिस्थितियों में और लिखित कारणों से आदेश दे। 10. भर्ती की पद्वतिः भर्ती सीधी होगी या प्रोन्नति, सैकेण्डमैंट, स्थानान्तरण आधार पर और विभिन्न पद्वतियों द्वारा भरे जाने वाले पद (पदों) की प्रतिशतता.-शतप्रतिशत प्रोन्नति द्वारा ऐसा न होने पर सैकेण्डमैंट आधार पर दोनों के न हांने पर, यथास्थिति, सीधी भर्ती द्वारा या संविदा के आधार पर भर्ती द्वारा। 11. प्रोन्नति, सैकेण्डमैंट, स्थानान्तरण भर्ती की दशा में, वे श्रेणियां (ग्रेड) जिनसे प्रोन्नति/ सैकेण्डमैंट/स्थानान्तरण किया जाएगा.-उपरोक्त स्तम्भ 7(क) (i) के सामने सीधी भर्ती के लिए विहित शैक्षिक अहर्ता धारण करने के अध्यधीन पर्यावरण अभियन्ताओं में से प्रोन्नति द्वारा जिनका (आठ) वर्ष का नियमित सेवाकाल हो या गे्रड में की गई लगातार तदर्थ सेवा, यदि कोई हो, को सम्मिलित करके आठ वर्ष का नियमित सेवाकाल हो ऐसा न होने पर हिमाचल प्रदेश के सरकार के अन्य विभागों/बोर्डों/निगमों/स्वायत निकायों में इस पद के समरूप वेतनमान में कार्यरत पदधारियों में से सैकेण्डमैंट के आधार पर ।

(1) प्रोन्नति के सभी मामलों में पद पर नियमित नियुक्ति से पूर्व सम्भरक (पोषक) पद में की गई लगातार तदर्थ सेवा, यदि कोई हो, प्रोन्नति के लिए इन नियमों में यथाविहित सेवाकाल के लिए, इस शर्त के अधीन रहते हुए गणना में ली जाएगी, कि सम्भरक (पोषक) प्रवर्ग में तदर्थ नियुक्ति/प्रोन्नति भर्ती और प्रोन्नति नियमों के उपाबन्धों के अनुसार चयन की उचित स्वीकार्य प्रक्रियाको अपनाने के पश्चात्‌ की गई थीः1299 राजपत्र, हिमाचल प्रदेश, 20 जून, 2015/30 ज्येष्ठ, 1937 परन्तु उन सभी मामलों में जिनमें कोई कनिष्ठ व्यक्ति सम्भरक (पोषक) पद में अपने कुल सेवाकाल (तदर्थ आधार पर की गई सेवा सहित, जो नियमित सेवा सहित, जो नियमित सेवा/नियुक्ति के अनुसरण में हो) के आधार पर उपर्युक्त निर्दिष्ट उपबन्धों के कारण विचार किए जाने का पात्र हो जाता है, वहां अपने-अपने प्रवर्ग/पद/काडर में उससे वरिष्ठ सभी व्यक्ति विचार किए जाने के पात्र समझे जाएंगे और विचार करते समय कनिष्ठ व्यक्ति से ऊपर रखे जाएंगेः

परन्तु यह और कि उन सभी पदधारियों की, जिन पर प्रोन्नति के लिए विचार किया जाना है, की कम से कम तीन वर्ष की न्यूनतम अर्हता सेवा या पद के भर्ती औरप्रोन्नति नियमों में विहित सेवा, जो भी कम हो, होगीः

परन्तु यह और भी कि जहां कोई व्यक्ति पूर्वगामी परन्तुक की अपेक्षाओं के कारण प्रोन्नति किए जाने सम्बन्धी विचार के लिए अपार् िंहो जाता है, वहां उससे कनिष्ठ व्यक्ति भी ऐसी प्रोन्नति के विचार के लिए अपात्र समझा जाएगा/समझे जाएंगे ।

स्पष्टीकरणः-अंतिम परन्तुक के अन्तर्गत कनिष्ठ पदधारी प्रोन्नति के लिए अपात्र नहीं समझा जाएगा, यदि वरिष्ठ अपात्र व्यक्ति भूतपूर्व सैनिक है जिसे डिमोबीलाइज्ड आमर्ड फोर्सिज परसोनल (रिजर्वेशन ऑफ वैकेन्सीज इन हिमाचल स्टेट नॉन टैक्नीकल सर्विसीज) रूल्ज, 1972 के नियम, 3 के उपबन्धों के अन्तर्गत भर्ती किया गया है और इनके अन्तर्गत वरीयता लाभ दिए गए हों या जिसे एक्स सर्विसमैंन; (रिजर्वेशन ऑफ वैकेन्सीज इन दी हिमाचल प्रदेश टैक्नीकल सर्विसीज) रूल्ज, 1985 के नियम 3 के उपबन्धों के अन्र्तगत भर्ती किया गया हो और इनके अन्तर्गत वरीयता लाभ दिए गए हों ।

(2) इसी प्रकार स्थायीकरण के सभी मामलों में ऐसे पद पर नियमित नियुक्ति/प्रोन्नति से पूर्व की सम्भरक (पोषक) पद पद की गई लगातार तदर्थ सेवा, यदि कोई हो, सेवाकाल के लिए गणना में ली जाएगी, यदि तदर्थ नियुक्ति/प्रोन्नति उचित चयन के पश्चात्‌ और भर्ती और प्रोन्नति नियमों के उपबन्धों के अनुसार की गई थी ।

परन्तु की गई उपर्युक्त निर्दिष्ट तदर्थ सेवा को गणना में लेने के पश्चात्‌ जो स्थायीकरण होगा उसके फलस्वरूप पारस्परिक वरीयता अपरिवर्तित रहेगी ।

12. यदि विभागीय प्रोन्नति समिति विद्यमान हो, तो उसकी संरचना.-जैसी सरकार द्वारा समय- समय पर गठित की जाए।

13. भर्ती करने में जिन परिस्थितियों में हिमाचल प्रदेश लोक सेवा आयोग से परामर्श किया जाएगा.- जैसा विधि द्वारा आपेक्षित हो ।

14. सीधी भर्ती किए जाने वाले व्यक्तियों के लिए अनिवार्य अपेक्षा.-किसी सेवा या पद पर नियुक्ति के लिए अभ्यर्थी का भारत का नागरिक होना अनिवार्य है ।

15. सीधी भर्ती द्वारा पद पर नियुक्ति के लिए चयन.-सीधी भर्ती के मामले में पद पर नियुक्ति के लिए चयन, मौखिक परीक्षा के आधार पर किया जाएगा। यदि, यथास्थिति, हिमाचल प्रदेश लोक सेवा आयोग या अन्यभर्ती प्राधिकरण ऐसा करना आवश्यक या समीचीन समझे तो लिखित परीक्षा या व्यावहारिक परीक्षा के आधार पर किया जायेगा जिसका स्तर/पाठ्‌यक्रम इत्याादि, यथास्थिति, आयोग/अन्य भर्ती प्राधिकरण द्वारा अवधारित किया जायेगा।

15.-क, संविदा नियुक्ति द्वारा पद पर नियुक्ति के लिए चयन.-इन नियमों में किसी बात के होते हुए भी संविदात्कम नियुक्तियां नीचे दिए गए निबन्धनों और शर्तों े अध्यधीन की जाएगी :

(I) संकल्पना.-(क) इस पॅालिसी के अधीन हिमाचल प्रदेश पर्यावरण, विज्ञान एवं प्रौद्योगिकी विभाग में वरिष्ठ पर्यावरण अधिकारी को संविदा के आधार पर प्रारम्भ में एक वर्ष के लिए लगाया जाएगा जिसे वर्षानुवर्ष आधार पर बढ़ाया जा सकेगा :

परन्तु संविदा अवधि में वर्षानुवर्ष आधार पर विस्तारण/नवीकरण के लिए सम्बन्ध विभागाध्यक्ष यह प्रमाण पत्र जारी करेगा कि संविदा पर नियुक्त व्यक्ति की सेवा और आचरण वर्ष के दौरान संतोषजनक रहा है और केवल तभी उसकी संविदा की अवधि नवीकृत/विस्तारित की जायेगी।

(ख) पद का हिमाचल प्रदेश लोक सेवा आयोग के कार्यक्षेत्र में आना :

प्रधान सचिव (पर्यावरण, विज्ञान एवं प्रौद्योगिकी) हिमाचल प्रदेश लोक सेवा आयोग पद को संविदा के आधार पर भरने के लिए सरकार का अनुमोदन प्राप्त करने के पश्चात अध्यपेक्षा को सम्बद्ध भर्ती अभिकरण अर्थात्‌ हिमाचल प्रदेश लोक सेवा आयोग के समक्ष रखेगा ।

(ग) चयन इन नियमों में विहित पात्रता शर्ताें के अनुसार किया जाएगा।

(II) संविदात्मक उपलब्धियां.-स्ांविदा के आधार पर नियुक्त वरिष्ठ पर्यावरण अधिकारी को `22,2000/- की दर से समेकित नियत संविदात्मक रकम (जो पे बैण्ड के न्यूनतम जमा ग्रेड पे के बराबर होगी) प्रति मास संदत्त की जाएगी। यदि संविदा में एक वर्ष से अधिक की बढौतरी की जाती है तो प''चातवर्ती वर्ष/वर्षों के लिए संविदात्मक उपलब्धियों के ` 666/- (पद के पे बैण्ड का न्यूनतम जमा ग्रेड पे का तीन प्रतिशत) की रकम वार्षिक वृद्धि के रूप् में अनुज्ञात की जाएगी।

(III) नियुक्ति और अनुशासनिक प्राधिकारी.-प्रधान सचिव (पर्यावरण, विज्ञान एवं प्रौद्यौगिक), हिमाचल प्रदेश सरकार नियुक्ति और अनुशासन प्राधिकारी होगा।

(IV) चयन प्रक्रिया.-संविदा नियुक्ति की दशा में पद पर नियुक्ति के लिए चयन, मौखिक परीक्षा के आधार पर किया जाएगा। यदि आवश्यक या समीचीन समझा जाए तो लिखित परीक्षा या व्यवहारिक परीक्षा के आधार पर किया जाएगा जिसका स्तर/पाठ्‌यक्रम आदि सम्बद्ध भर्ती अभिकरण अर्थात्‌ हिमाचल प्रदेश लोक सेवा आयोग द्वारा अवधारित किया जाएगा ।

(V) संविदात्मक नियुक्ति व्यक्तियों के लिए चयन समिति.- जैसी सम्बद्ध भर्ती अभिकरण अर्थात्‌ हिमाचल लोक सेवा आयोग द्वारा समय-समय पर गठित की जाए।

(VI) करार.-अभ्यर्थी को, चयन के पश्चात ्‌ इन नियमों से संलग्न उपाबन्ध-ख के अनुसार करार हस्ताक्षरित करना होगा।

VII निबन्धन और शर्तें.-(क) स्ांविदा के आधार पर नियुक्त व्यक्ति को `22,2000/- की दर से नियत संविदात्मक रकम (जो पे बैण्ड के न्यूनतम जमा ग्रेड पे के बराबर होगी) प्रति मास संदत्त की जाएगी। संविदा पर नियुक्त व्यक्ति आगे बढ़ाए गए वर्ष/वर्षों में के लिए संविदात्मक उपलब्धियों में ` 666/- की दर से (पे बैण्ड का न्यूनतम जमा ग्रेड पे का तीन प्रतिशत) की वृद्धि का हकदार होगा, और अन्य कोई सहब0 प्रसुविधाएं जैसे, वरिष्ठ/चयन वेतनमान आदि नहीं दिया जाएगा।

(ख) संविदा पर नियुक्त व्यक्ति की सेवा पूर्णतया अस्थाई आधार पर होगी। यदि सेविदा पर नियुक्त व्यक्ति का कार्यपालन/आचरण ठीक नहीं पाया जाता है तो, नियुक्ति समाप्त किए जाने के लिए दायी होगी। (ग) संविदा पर नियुक्ति व्यक्ति एक मास की सेवा पूरी करने के पश्चात्‌ एक दिन के आकस्मिक अवकाश का हकदार होगा। तथापि संविदा पर नियुक्त कर्मचारी सोलह सप्ताह के प्रसूति अवकाश, दस दिन के चिकित्सा अवकाश और पांच दिन के विशेष अवकाश के लिए भी हकदार होगा/होगी। वह चिकित्सा प्रतिपूर्ति और एल0टी0सी0 आदि के लिए हकदार नहीं होगा/होगी । संविदा पर नियुक्त व्यक्ति को उपरोक्त के सिवाय अन्य किसी प्रकार का कोई अवकाश अनुज्ञात नहीं होगा :

राजपत्र, हिमाचल प्रदेश, 20 जून, 2015/30 ज्येष्ठ, 1937 परन्तु अनुपभुक्त आकस्मिक अवकाश,चिकित्सा अवकाश और विशेष अवकाश एक कलैण्डर वर्ष तक संचित किया जा सकेगा और आगामी कैलेण्डर वर्ष के लिए अग्रनीत नहीं किया जाएगा ।

(घ) नियन्त्रक अधिकारी के अनुमोदन के बिना कर्तव्य (डयूटि) से अनधिकृत अनुपस्थिति से स्वतः ही संविदा का पर्यावसान (समापन) हो जाएगा तथापि आपवादिक मामलों में जहां पर चिकित्सा आधार पर कर्तव्य (डयूटि) से अनधिकृत अनुपस्थिति के हालात संविदा पर नियुक्त व्यक्ति के नियन्त्रण से बाहर हों तो ऐसी नियमितिकरण के मामले में विचार करते समय ऐसी अवधि ऐसी अवधी अपवर्जित नहीं की जाएगी, परन्तु पदधारी को इस बाबत समय पर नियन्त्रण अधिकारी को सूचित करना होगा। तथापि संविदा पर नियुक्त व्यक्ति कर्त्तव्य (डयूटि) से अनुपस्थिति की अवधि के लिए संविदात्मक रकम का हकदार नहीं होगा। परन्तु उसे सरकार के प्रचलित अनुदेशों के अनुसार चिकित्सा अधिकारी द्वारा जारी बीमारी/आरोग्य प्रमाण-पत्र को प्रस्तुत करना होगा।

(ङ) संविदा पर नियुक्त व्यक्ति जिसने तैनाती के एक स्थान पर तीन वर्ष का सेवाकाल पूर्ण कर लिया है, आवश्यकता के आधार पर स्थानान्तरण हेतु पात्र होगा, जहां भी प्रशासनिक कारणों से ऐसा करना अप्रक्षित होः

(च) चयनित अभ्यर्थी को सरकारी/रजिस्ट्रीकृत चिकित्सा व्यवसायी से अपना आरोग्यता प्रमाण-पत्र प्रस्तुत करना होगा । बारह सप्ताह से अधिक समय से गर्भवती महिला प्रसव होने तक, अस्थायी तौर पर अनुपयुक्त बनी रहेगी। ऐसी महिला अभ्यर्थी का किसी प्राधिकृत चिकित्सा अधिकारी/व्यवसायी द्वारा उपयुक्तता के लिए पुनः परीक्षण किया जाएगा।

(छ) संविदा पर नियुक्त व्यक्ति का यदि अपने पदीय कर्त्तव्यों के सम्बन्ध में दौरे पर जाना अपेक्षित हो, तो वह उसी दर पर जैसी नियमित प्रतिस्थानी पदधारी को पद के वेतनमान के न्यूनतम पर लागू है, यात्राा भत्ते/दैनिक भत्ते का हकदार होगा/होगीः और

(ज) नियमित कर्मचारियों की दशा में यथा लागू सेवा नियमों के उपबन्ध जैसे कि एफ0 आर0- एस0 आर0, छुटटी नियम, साधारण भविष्य निधि नियम, पेंशन नियम तथा आचरण नियम आदि संविदा पर नियुक्त व्यक्तियों की दशा में लागू नहीं हाेंगे। वे इस स्तम्भ में यथावर्णित उपलब्धियों आदि के लिए हकदार होंगे।

16. आरक्षण.-सेवा में नियुक्ति, हिमाचल प्रदेश सरकार द्वारा समय-समय पर अनुसूचित जातियों/ अनुसूचित जन-जातियों/अन्य पिछड़े वर्गो और अन्य प्रवर्ग के व्यक्तियों के लिए सेवा में आरक्षण की बाबत जारी किए गए आदेशों के अधीन होगी।

17. विभागीय परीक्षा.-सेवा में प्रत्येक सदस्य को समय-समय पर यथा संशोधित हिमाचल प्रदेश विभागीय परीक्षा नियम, 1997 में यथा विहित विभागीय परीक्षा उत्तीर्ण करनी होगी।

18. शिथिल करने की शक्ति.-जहां राज्य सरकार की यह राय हो कि ऐसा करना आवश्यक या समीचीन है, वहां वह, कारणों को लिखित में अभिलिखित करके और हिमाचल प्रदेश लोक सेवा आयोग के परामर्श से, आदेश द्वारा, इन नियमों के किन्हीं उपबन्धों को किसी वर्ग या व्यक्ति (व्यक्तियों ) के प्रवर्ग या पद (पदों) की बाबत, शिथिल कर सकेगी।

को समाप्त होने वाले दिन तक एक वर्ष की अवधि के लिए द्वितीय पक्षकार की सेवा में रहेगा। यह विनिर्दिष्ट रुप से उल्लिखित किया गया है और दोनो पक्षकारों द्वारा करार पाया गया है कि प्रथम पक्षकार की द्वितीय पक्षकार के साथ संविदा. आखिरी कार्य दिवस्‌ अर्थात्‌ ..........दिन को स्वयंमेव ही पर्यवसित (समाप्त) हो जाएगी तथा सूचना नोटिस आवश्यक नही होगा :

परन्तु संविदा अवधि में वर्षानुवर्ष आधार पर विस्तारण/नवीकरण करने के लिए सम्बद्ध विभागाध्यक्ष यह प्रमाणपत्र जारी करेगा कि संविदा पर नियुक्त व्यक्ति की सेवा और आचरण, वर्ष के दौरान संतोषजनक रहा है और केवल तभी उसकी संविदा की अवधि नवीकृत/विस्तारित की जाएगी।

9. संविदा पर नियुक्त व्यक्ति(यों) को कर्मचारी सामूहिक बीमा योजना के साथ-साथ ई0पी0 एफ0/जी0पी0एफ0 भी लागू नहीं होगा।

इसके साक्ष्यस्वरूप प्रथम पक्षकार और द्वितीय पक्षकार ने साक्षियों की उपस्थिति में इसमें सर्वप्रथम उल्लिखित तारीख को अपने-अपने हस्ताक्षर कर दिए हैं।

NOTIFICATION

Shimla-2, 12th June,2015

No. Shram (A) 3-7/2012.—In exercise of the powers conferred by section 14 of the Unorganized Workers Social Security Act, 2008, the Governor of Himachal Pradesh is pleased to make the following rules, namely:

Pradesh Unorganized Workers Social Security Rules, 2015.

(2) They shall come into force on the date of publication in the official gazette.

2. Definitions.—(1) In these rules, unless the context otherwise requires:-

(a) "Act" means the Unorganized Workers' Social Security Act, 2008 (33 of 2008);

(b) "Board" means the Himachal Pradesh State Social Security Board constituted under sub-section (1) of section 6 of the Act;

(c) "Chairperson" means the Chairperson of the Board;

(d) "member" means the member of the Board; and

(e) "section" means the section of the Act.

(2) The words and expressions used and not defined in these rules but defined in the Act shall have the same meanings respectively as assigned to them in the Act.

3. Term of office of members—(1) A member other than an ex-officio member shall hold office for a period not exceeding three years from the date of his nomination.

(2) A member nominated under sub-clause (iii) of clause (c) of sub-section (2) of section 6 shall cease to be a member of the Board, if he ceases to be a member of the State Legislative Assembly by which he was so elected.

(3) A member nominated under sub clauses (i), (ii) and (iv) of clause (c) of sub-section of section 6 shall cease to be a member of the Board, if he ceases to represent the category of interest from which he was nominated:

Provided that out of seven persons nominated under sub-clause (i), one member each from the Scheduled Caste, the Scheduled Tribe, the Minorities and Women shall be represented.

(4) A member shall be eligible for re-nomination.

4. Resignation—(1) A member of the Board, not being an ex-officio member, may resign his office by a letter in writing addressed to the Chairperson.

(2) The seat of such a member shall fall vacant from the date on which his resignation is accepted or on the expiry of thirty days from the date of receipt of intimation of resignation, whichever is earlier.

(3) The power to accept the resignation of member shall vest in the Chairperson who, on accepting the resignation, shall report to the Board at its next meeting.

5. Change of Address—If a member changes his address, he shall notify his new address to Member- Secretary of the Board who shall thereupon enter his new address in the official records:

6. Manner of filling vacancies—When a vacancy occurs or is likely to occur in the membership of the Board, the Chairperson shall submit a report to the State Government and on receipt of such report, the State Government may, by notification, nominate a person to fill the vacancy and the person so nominated shall hold office for the remainder of the term of office of the member in whose place he is nominated.

7. Allowance of members—(1) The travelling allowance of an official member of the Board shall be governed by the rules applicable to him for journey performed by him on official duties and shall be paid by the authority paying his salary.

(2) The non-official members of the Board shall be paid travelling allowance for attending the meetings of the Board at such rates as are admissible to a Group 'A' Officer of the State Government and daily allowances shall be calculated at the maximum rate admissible to Group 'A' Officer of the State Government in respect of their places.

8. Disposal of business—Every matter which the Board is required to take into consi- deration shall be considered at a meeting of the Board, or if the Chairperson so directs, by sending the necessary papers to every member for opinion, and the matter shall be disposed of in accordance with decision of the majority:

Provided that where there is no opinion of majority on a matter and the members of the Board are equally divided, the Chairperson shall have a second or a casting vote.

9. Meetings—(1) The Board shall meet at such places and at such times as may be decided by the Chairperson and it shall meet at least once in three months.

(2) The Chairperson shall preside over every meeting of the Board in which he is present and in his absence he may nominate a member of the Board to preside over such meeting and in the absence of such nomination by the Chairperson, the members of the Board present in such meeting may choose from amongst themselves a member to preside over the meeting.

10. Notice of meeting and list of business—(1) Ordinarily, two weeks' notice shall be given to the members of the Board of a proposed meeting:

Provided that the Chairperson, if he is satisfied that it is expedient so to do, may give notice of longer period not exceeding one month for such meeting.

(2) No business other then the business included in the agenda for a meeting of the Board shall be considered at the meeting without the permission of the Chairperson.

(3) The Chairperson may at any time call a special meeting of the Board in case of urgency, after giving a notice of reasonable time to this effect by informing the members in advance about the subject-matter of discussion and the reasons of urgency.

11. Quorum—(1) No business shall be transacted at any meeting of the Board unless at least one third members are present in that meeting which shall include at least on member of Legislative Assembly; and one member each out of unorganized workers and employees of unorganized worker:

Provided that if at a meeting, less than six members are present, the Chairperson may adjourn the meeting to another date informing the members present and giving notice to the other members that he proposes to dispose of the business at the adjourned meeting whether there is prescribed quorum or not, and it shall thereupon be lawful for him to dispose of the business at the adjourned meeting irrespective of the number of members attending.

(2) The State Government may debar any member, other than ex-officio members, from taking part in the meeting of the Board if-

(a) he absents himself from three consecutive meetings of the Board without leave of the Chairperson; or

(b) the State Government is of the view that such member has ceased to represent the interest which he purports to represent on the Board.

12. Manner of making application for registration of unorganized workers—The

application referred to in sub-section (2) of section 10 of the Act shall be made in Form I, to the District Administration or its authorized officer or agencies.

1. संक्षिप्त नाम और प्रारम्भः-(1) इन नियमों का संक्षिप्त नाम हिमाचल प्रदश असंगठित कर्मकार सामाजिक सुरक्षा नियम, 2015 है।

(2) ये नियम राजपत्र, हिमाचल प्रदेश में प्रकाशन की तारीख को प्रवृत्त होंगे।

2. परिभाषाएंः-(1) इन नियमों में जब तक कि सन्दर्भ से अन्यथा अपेंक्षित न हों,-

(क) "अधिनियम" से असंगठित कर्मकार सामाजिक सुरक्षा अधिनियम, 2008 (2008 का 33) अभिपे्रत है;

(ख) "बोर्ड" से अधिनियम की धारा 6 की उपधारा (1) के अधीन गठित हिमाचल प्रदेश राज्य सामाजिक सुरक्षा बोर्ड अभिपे्रत है;

(ग) "अध्यक्ष" से बोर्ड का अध्यक्ष अभिपे्रत है;

(घ) "सदस्य" से बोर्ड का सदस्य अभिपे्रत है; और

(ङ) "धारा" से अधिनियम की धारा अभिपे्रत है।

(2) उन शब्दों और पदों के जो इन नियमों में प्रयुक्त हैं किन्तु परिभाषित नहीं हैं क्रमशः वही अर्थ होंगे जो अधिनियम में उनके हैं। 1310 राजपत्र, हिमाचल प्रदेश, 20 जून, 2015/30 ज्येष्ठ, 1937 3. सदस्यों की पदावधिः-(1) पदेन सदस्य से भिन्न कोई सदस्य अपने नाम निर्देशन की तारीख से तीन वर्ष से अनधिक अवधि के लिए पद धारण करेगा।

(2) धारा 6 की उपधारा (2) के खण्ड (ग) के उपखण्ड ;पपपद्ध के अधीन नाम निर्देषित कोई सदस्य बोर्ड का सदस्य नहीं रहेगा यदि वह राज्य विधान सभा, जिसके द्वारा वह इस प्रकार निर्वाचित हुआ था, का सदस्य नहीं रह जाता है।

(3) धारा (6) की उपधारा (2) के खण्ड (ग) के उपखण्ड ;पद्ध ;पपद्ध और ;पअद्ध के अधीन नामनिर्देशित कोई सदस्य बोर्ड का सदस्य नहीं रहेगा यदि वह उस प्रवर्ग, जिससे वह इस प्रकार नामनिर्देशित किया था, का प्रतिनिधित्व नहीं करता हैः

परन्तु उप खण्ड ;पद्ध के अधीन नाम निर्देशित सात व्यक्तियों में अनुसूचित जाति, अनुसूचित जनजाति, अल्पसंख्यकों और महिलाओं का प्रतिनिधित्व करने के लिए प्रत्येक से एक -एक सदस्य होगा।

(4) सदस्य पुनः नामनिर्देशन के लिए पात्र होगा।

3. त्यागपत्रः-(1) बोर्ड का कोई सदस्य, जो पदेन सदस्य नहीं है, अध्यक्ष को लिखित में सम्बोधित पत्र द्वारा अपने पद का त्याग कर सकेगा।

(2) ऐसे सदस्य का स्थान, उस तारीख से जिसको उसका त्यागपत्र स्वीकार होता है या त्यागपत्र की सूचना की प्राप्ति की तारीख से तीस दिन के अवसान के पश्चात्‌, जो भी पूर्वतर हो, रिक्त हो जाएगा। (3) सदस्य के त्यागपत्र को स्वीकार करने की शक्ति अध्यक्ष में निहित होगी त्यागपत्र

स्वीकार करने पर बोर्ड के उसकी आगामी बैठक में रिपोर्ट करेगा।

5. पते में परिर्वतनः-यदि कोई सदस्य अपने पते में परिवर्तन करता है तो वह बोर्ड के सदस्य- सचिव को अपना नया पता सूचित करेगा जो तदुपरान्त सरकारी अभिलेख में उसका नया पता दर्ज करेगाः परन्तु यदि कोई सदस्य अपना नया पता सूचित करने में असफल रहता है तो सरकारी अभिलेख में पता सभी प्रयोजनों के लिए सदस्य का सही पता समझा जाएगा।

6. रिक्तियों के भरने की रीतिः-जब कभी बोर्ड की सदस्यता में कोई रिक्ति होती है या होने की संभावना है तो अध्यक्ष राज्य सरकार को रिपोर्ट प्रस्तुत करेगा और ऐसी रिपोर्ट की प्राप्ति पर राज्य सरकार, अधिसूचना द्वारा, रिक्ति को भरने के लिए किसी व्यक्तिका नाम निर्देशन कर सकेगी और इस प्रकार नाम निर्देशित व्यक्ति उस सदस्य की शष पदावधि के लिए, जिसके स्थान पर वह नामनिर्देशित किया जाता है, पद धारण करेगा।

7. सदस्यों के भत्तेः-(1) बोर्ड के किसी सरकारी सदस्य का यात्रा भत्ता सरकारी कर्त्तव्य डयूटी पर उसके द्वारा की गई यात्रा के लिए लागू नियमों द्वारा मासित किया जाएगा और उसके वेतन का संदाय करने वाले प्राधिकारी द्वारा संदत्त किया जाएगा।

(2) बोर्ड के गैर-सरकारी सदस्यों को बोर्ड की बैठकों में उपस्थित होने के लिए ऐसी दरों पर यात्रा भत्ता संदत्त किया जाएगा जो राज्य सरकार के समूहक संदाय के अधिकारियों को देय है और दैनिक भत्ते की गणना उनके अपने-अपने स्थानों में राज्य के समूहक के अधिकारी को देय अधिकतम दर पर की जाएगी। 8. कारबार का निपटानः-प्रत्येक ऐसा विषय जिस पर बोर्ड द्वारा विचार किया जाना अपेक्षित है, बोर्ड की किसी बैठक में या यदि अध्यक्ष ऐसा निर्देश देता है तो प्रत्येक सदस्य की राय के लिए आवश्यक कागज़ात भेजकर विचार किया जाएगा और उस विषय का बहुमत के विनिश्चय के अनुसार निपटारा किया जाएगा :

राजपत्र, हिमाचल प्रदेश, 20 जून, 2015/30 ज्येष्ठ, 1937 परन्तु जहाँ किसी विषय पर बहुमत की राय नहीं है और बोर्ड के सदस्य समान रूप से विभाजित हैं, तो अध्यक्ष का द्वितीय और निर्णायक मत होगा।

9. बैठकेंः-(1) बोर्ड की बैठक ऐसे स्थानों और ऐसे समयों पर होगी जो अध्यक्ष द्वारा विनिश्चित किए जाएं और यह तीन मास में कम से कम एक बार बैठक करेगा।

(2) अध्यक्ष बोर्ड की प्रत्येक बैठक की अध्यक्षता करेगा जिसमें यह उपस्थित हो और उसकी अनुपस्थिति में वह बोर्ड के किसी सदस्य को ऐसी बैठक की अध्यक्षता करने के लिए नामनिर्देशित कर सकेगा और अध्यक्ष द्वारा ऐसे नामनिर्देशन के अभाव में ऐसी बैठक में उपस्थित बोर्ड के सदस्य अपने में से किसी सदस्य को बैठक की अध्यक्षता करने के लिए चुन सकेंगे।

10. बैठक की सूचना और कारबार की सूचीः-(1) बोर्ड के सदस्यों को साधारणतया प्रस्तावित बैठक की दो सप्ताह की सूचना दी जाएगीः

परन्तु अध्यक्ष, यदि उसका समाधान हो जाता है कि ऐसा करना समीचीन है तो वह ऐसी बैठक के लिए एक मास से अनधिक की दीर्घ अवधि की सूचना दे सकेगा।

(2) बोर्ड की बैठक के लिए कार्यसूची में सम्मिलित से भिन्न किसी कारबार पर अध्यक्ष की अनुज्ञा के बिना विचार नहीं किया जाएगा।

(3) अध्यक्ष अत्यावश्यकता की दशा में, विचार- विमर्श की विषय-वस्तु के बारे में सदस्यों को अग्रिम में सूचित करके इस प्रभाव का युक्तियुक्त समय का नोटिस देने के पश्चात्‌, किसी भी समय बोर्ड की विशेष बैठक बुला सकेगा।

11. गणपूर्तिः-(1) बोर्ड की किसी बैठक में तब तक किसी कारबार का संव्यवहार नहीं किया जाएगा जब तक उस बैठक में कम से कम एक-तिहाई सदस्य उपस्थित न हों जिसमें कम से कम विधान सभा का एक सदस्य और असंगठित कर्मकारों और असंगठित कर्मकार के कर्मचारियों में से प्रत्येक का एक-एक सदस्य सम्मिलित होगाः

परन्तु यदि किसी बैठक में छह से कम सदस्य उपस्थित हैं तो अध्यक्ष उपस्थित सदस्यों को सूचित करके और अन्य सदस्यों को नोटिस देकर कि वह स्थगित बैठक में कारवाई का निपटान करना प्रस्तावित करता है, चाहे उसमें विहित गणपूर्ति हो अथवा नहीं, अन्य तारीख के लिए बैठक स्थगित कर सकेगा और तदुपरि उसके लिए यह विधिपूर्ण होगा कि वह स्थगित बैठक उपस्थित सदस्यों की संख्या को ध्यान में लाए बिना कारबार का निपटान करे ।

(2) राज्य सरकार, पदेन सदस्य से भिन्न किसी सदस्य को बोर्ड की बैठक में भाग लेने से विवर्जित कर सकेगी यदि-

(क) वह अध्यक्ष की अनुमति के बिना बोर्ड की तीन लगातार बैठकों में अनुपस्थित रहता हैं,

या

(ख) राज्य सरकार की राय में ऐसा सदस्य उस हित का प्रतिनिधित्व नहीं करता है जिसके लिए वह बोर्ड में प्रतिनिधित्व करने के लिए तात्पर्यित हैं।

12. असंगठित कर्मकार के रजिस्ट्रीकरण के लिए आवेदन करने की रीतिः-अधिनियम की (धारा 10 की उपधारा (2) में निर्दिष्ट आवेदन प्ररूप 1 में जिला प्रशासन या इसके प्राधिकृत अधिकारी या अभिकरणों को किया जाएगा।1312 राजपत्र, हिमाचल प्रदेश, 20 जून, 2015/30 ज्येष्ठ, 1937 प्ररूप-1
