संख्याः टी0पी0टी0-एफ (7)-1/2017.--राज्य के नागरिकों को सुव्यवस्थ्ति, सुरक्षित यातायात एवं सार्वजनिक परिवहन की व्यवस्था उपलब्ध करवाने व इनका वातावरण पर प्रभाव कम करने हेतु हिमाचल प्रदेश 231-राजपत्र/2017-04-03-2017 (8055) 8056 राजपत्र, हिमाचल प्रदेश, 04 मार्च, 2017/13 फाल्गुन, 1938 के राज्यपाल, भारत के संविधान के अनुच्छेद 162 मेें प्रदत शक्तियोेंं का प्रयोग करते हुए, निम्नलिखित निधि का गठन करते हैं; अर्थात्‌ः-

1. नाम.--यह निधि हिमाचल प्रदेश परिवहन आधारभूत विकास निधि 2017 कहलएगी। 2. प्रभावशीलता.--यह निधि 1 अप्रैल, 2017 से प्रभावशील होगीे।

3. परिभाषाएं.--

1. ''निधि'' से तात्पर्य हिमाचल प्रदेश परिवहन आधारभूत विकास निधि-2017 है। 2. ''राज्य सरकार'' से आशय हिमाचल प्रदेश सरकार से है ।

3. ''सड़क सुरक्षा निधि'' से आशय हिमाचल प्रदेश सड़क सुरक्षा कार्य निधि-2006 है। 4. ''नोडल विभाग'' से तात्पर्य परिवहन विभाग हिमाचल प्रदेश से है ।

5. ''वित्तीय वर्ष'' का आशय 1 अप्रैल से शुरु होकर 31 मार्च को समाप्त होने वाली अवधि से है।

6. ''वित्त विभाग'' से आशय हिमाचल प्रदेश सरकार के वित्त विभाग से है ।

7. बजट नियायक समिति (बी.एफ.सी.) से आशय वित्त विभाग द्वारा गठित समिति जो बजट प्रस्तावों का परीक्षण करके अनुमोदित करती है, से है ।

8. 'व्यक्तिगत निक्षेप खाते'' से आशय राजकीय संस्था के राज्य के कोष कार्यालयों में खोले गए ऐसे खाते से है जिसमें सामान्यतः राज्य सरकार द्वारा राशि हस्तानान्तरित की जाती है।

4. निधि के गठन के उद्‌देश्यः--1. राज्य के नागरिकों को सुव्यवस्थ्ति, सुरक्षित यातायात एवं सार्वजनिक परिवहन की व्यवस्था उपलब्ध करवाना,

2. प्रदूषण रहित यातयात सुनिश्चित करने हेतु प्रदूषण रहित इंधन, तथा L.P.G. & C.N.G. इत्यादि वाहनों की व्यवस्था हेतु राजकीय संस्थाओं को अनुदान, ऋण, अंश-पूंजी उपलब्ध करना,

3. यातायात के साधनों से उत्पन्न प्रदूषण के प्रभाव को न्यून करने के उद्‌देश्य से सड़कों के दोनों ओर व विभाजक में तथा शहर में उपलब्ध राजकीय/सार्वजनिक भूमि पर वृक्षारोपण करना एवं उनका संरक्षण करना, तथा

4. सड़क सुरक्षा निधि के माध्यम से सड़क से सड़क सुरक्षा व्यवस्था को प्रभावी एवं गतिशील बनाने के लिए किए जा रहे कार्यों की आंशिक लागत वहन करना।

5. निधि के आय के स्त्रोत.--1. हिमाचल मोटर यान कराधान अधिनियम 1972 के तहत देय एक वारीय अथवा एक मुश्त कर पर 10 प्रतिशत तथा अन्य करों पर 5 प्रतिशत अधिभार से प्राप्त राशिः 2. पुराने तथा नवीन वाहनों पर अधिरोपित ग्रीन टैक्स से प्राप्त राशि का 5% के हिसाब से, 3. राज्य सरकार की संचित निधि से अंशदान के रूप में उपलब्ध कराई जाने वाली राशि, 4. निधि के उद्‌देश्यों की पूर्ति हेतु केन्द्र सरकार तथा अन्य सरकारी एवं गैर-सरकारी संगठनों से प्राप्त राशि,8057 राजपत्र, हिमाचल प्रदेश, 04 मार्च, 2017/13 फाल्गुन, 1938 5. औद्योगिक संस्थाओं से, सामाजिक उत्तरदायित्व के तहत प्राप्त राशि, तथा 6. अन्य स्त्रोत जिन्हें समय-समय पर विशिष्ट रूप से निर्धारित किया जाए ।

6. नोडल विभाग.--1. निधि के प्रबन्ध एवं संचालन के लिए परिवहन विभाग उत्तरदायी होगा। परिवहन सचिव, इस उद्‌देश्य के लिए नोडल अधिकारी होंगे। इस निधि के लिए प्रशासनिक विभाग परिवहन विभाग होगा ।

2. इस निधि की 50 प्रतिशत राशि का उपयोग परिवहन विभाग द्वारा सडक सुरक्षा निधि 2006 के अनुसार किया जाएगा। 25 प्रतिशत राशि का उपयोग हिमाचल प्रदेश शहरी परिवहन एवं बस अडडा प्रबन्धन एवं विकास प्राधिकरण (HPCT & BSM & DA) के माध्यम से किया जायेगा यह राशि cluster के आकार के अनुसार वितरित की जाऐगी व शेष 25 प्रतिशत राशि का उपयोग संचाालन समिति द्वारा निर्धारित वरियता के आधार पर किया जाऐगा ।

7. कार्यकारी अभिकरण (Implementing Agencies).--

1. निदेशक परिवहन हिमाचल प्रदेश।

2. हिमाचल प्रदेश शहरी परिवहन एंव बस अड्‌डा प्रबन्धन एवं विकास प्राधिकरण (HPCT & BSM & DA)

3. उक्त के अतिरिक्त किसी योजना विशेष के क्रियान्वयन हेतु आवश्यकता होने पर संचालन समिति की स्वीकृति से किसी अन्य राजकीय विभाग या राजकीय उपक्रम/संस्था को भी कार्यकारी अधिकरण बनाया जा सकता है। ऐसी स्थिति में योजना विशेष के सफल क्रियान्वयन एवं पर्यवेक्षण हेतु सम्बन्धित विभाग/संस्था उत्तरदायी होंगे।

8. संचालन समिति :-(1) निधि की धन राशि के उपयोग हेतु मुख्य सचिव की अध्यक्षता में संचालन समिति होगी जिसमें निम्नलिखित सदस्य होंगेः-

1. सचिव, परिवहन विभाग हिमाचल प्रदेश सदस्य 2. वित्त सचिव हिमाचल प्रदेश सदस्य 3. मुख्य कार्यकारी अधिकारी (HPCT & BSM & DA) सदस्य 4. निदेशक शहरी विकास हिमाचल प्रदेश सदस्य 5. निदेशक परिवहन हिमाचल प्रदेश सदस्य 6. अतिरिक्त निदेशक, परिवहन हि0 प्र0 सदस्य सचिव (2) समिति के कार्य :--1. निधि के उद्‌देश्यों की प्राप्ति के क्रम में विभिन्न विभागों एंव कार्यकारी अभिकरणों द्वारा तैयार किए गए प्रोजेक्ट, कार्यक्रम एवं योजनाओं को निधि से राशि उपलब्ध कराने के लिए अनुमोदित करना।

2. विभागों तथा कार्यकारी अभिकरणों द्वारा क्रियान्वित की जा रही योजनाओं की वित्तीय एवं भौतिक प्रगति की नियमित अन्तराल पर समीक्षा करना।

3. निधि के उद्‌देश्यों को प्राप्त करने हेतु नई योजनाएं एवं प्रोजेक्ट तैयार करवाना।

4. योजनाओं की क्रियान्विति के लिए आवश्यक होने पर नई संस्थागत व्यवस्था निधारित करना। 8058 राजपत्र, हिमाचल प्रदेश, 04 मार्च, 2017/13 फाल्गुन, 1938 9. निधि का उपयोग :--निधि की धनराशि में से 50 प्रतिशत राशि का उपयोग परिवहन विभाग के माध्यम से तथा 25 प्रतिशत राशि का उपयोग (HPCT & BSM & DA) के माध्यम से किया जाएगा व शेष 25 प्रतिशत राशि का उपयोग संचालन समिति द्वारा निर्धारित वरियता के आधार पर निम्न अनुसार होगाः-- अ निधि की धन राशि से निम्नलिखित मदों पर व्यय अनुमत होगाः--निम्नांकित कार्यों/ परियोजनाओं के लिए, जो राजकीय विभागों या कार्यकारी अभिकरणों या सार्वजनिक तथा निजी क्षेत्र की भागीदारी (PPP) या संयुक्त उपक्रम (JV) या विशेष प्रयोजन माध्यम साधन, संस्था (SPV) के माध्यम से, क्रियान्वित की जा रही है, निधि को अंशदान उपलब्ध कराया जा सकेगा :-

1. प्रदूषण नियंत्रण के उद्‌देश्य से प्रदूषण रहित इंधन, तथा C.N.G. & L.P.G. इत्यादि वाहनों की व्यवस्था हेतु सहायता उपलब्ध करवाना।

2. शहरी यातायात में, न्यूनतम्‌ कार्बन उत्सर्जित करने वाले वाहनों, आवाज रहित टायरों (Silent Tyres) तथा ध्वनि अवशोषण रोड़ धरातल (Road surface) को प्रोत्साहित करना ताकि पर्यावरण प्रदूषण नियंत्रित हो सके।

उपरोक्त के अतिरिक्त अन्य कार्य जो निधि के उद्‌देश्यों की प्राप्ति के अनुक्रम में हों, संचालन समिति की स्वीकृति से करवाए जा सकेंगे।

व. निधि की धन राशि से, निम्नलिखित मदों पर व्यय पूर्णतः वर्जित होगा.--

1. भूमि एवं भवनों के अधिग्रहण हेतु मुआवजे का भुगतान ।

2. सामान्य मुरम्मत एवं सधारण पर व्यय ।

3. वेतन भत्तों पर व्यय।

4. चुनाव, वी.आई.पी. मूवमेन्ट अथवा किसी अभियान में यातायात व्यवस्था पर व्यय।

5. देश/विदेश में प्रशिक्षण, सेमीनार, वर्कशॉप, बैठकों एवं नवाचार के अध्ययन हेतु विभागीय अधिकारियों के भाग लेने हेतु व्यय।

6. नोडल विभाग से सम्बन्धित राजकीय विभागों में संस्था पर संबंधी नियमित व्यय ताकि अनावर्तक मद (Non-Recurring) वाहन क्रय, वाहन किराया, टेलीफोन, मोवाइल, कम्प्यूटर क्रय, कार्यालय सामग्री क्रय इत्यादि।

10. निधि के उपयोग की प्रक्रिया.--1. राजकीय विभाग/कार्यकारी अभिकरण (Programme Implementing Agencies) द्वारा कार्यों/प्रोजेक्ट के तकनीकी एवं वित्तीय प्रस्ताव तैयार किए जाएंगे। 2. कार्यकारी अभिकरण, अपने प्रस्ताव सम्बन्धित प्रशासनिक विभाग के अनुमोदन उपरांत संचालन समिति के समक्ष अनुमोदन हेतु प्रस्तुत करेंगे। परिवहन विभाग यह सुनिश्चित करेगा कि वर्ष के दौरान निधि का उपयोग निर्धारित अनुपात अर्थात निधि की 50 प्रतिशत राशि का उपयोग परिवहन विभाग द्वारा, 25 प्रतिशत राशि का उपयोग हिमाचल प्रदेश शहरी एवं बस अडडा प्रबन्धन एवं विकास प्राधिकरण (HPCT & BSM & DA) के माध्यम से व शेष 25 प्रतिशत राशि का उपयोग संचालन समिति द्वारा निर्धारित वरियता के आधार पर ही हो।

3. संचालन समिति राजकीय विभागों एवं कार्यकारी अभिकरणों से प्राप्त प्रस्तावों पर महत्व एवं आवश्यकता के मद्देनजर विचार कर उचित निर्णय लेगी। जिन कार्यों/योजनाओं के प्रस्तावों हेतु वित्त विभाग का अनुमोदन आवश्यक है, प्राप्त किया जाएगा।8059 राजपत्र, हिमाचल प्रदेश, 04 मार्च, 2017/13 फाल्गुन, 1938 4. नोडल विभाग (परिवहन विभाग), निधि में राजस्व प्राप्ति के आंकलन के आधार पर वार्षिक कार्य-योजना तैयार कर बी.एफ.सी. (Budget Finalizing Committee) के समक्ष उपयुक्त बजट प्रावधान हेतु प्रस्तुत करेंगे।

5. बी.एफ.सी. से प्रस्तावों के अनुमोदन उपरान्त बजट अनुभाग द्वारा, सम्बन्धित बजट शीर्षों में राशि का प्रावधान किया जाएगा। वर्ष के दौरान योजना के उद्‌देश्यों की पूर्ति के लिए अतिरिक्त राशि की आवश्यकता होने पर वित्त विभाग के माध्यम से आवश्यक प्रावधान स्वीकृत कराए जाएंगे।

6. अगर कार्य राजकीय विभागों द्वारा सम्पादित किए जाने हैं तो उनके द्वारा इस बजट प्रावधान का उपयोग कोषालय व्यवस्था के माध्यम से किया जाएगा।

7. अगर कार्य/योजना का क्रियान्वयन कार्यकारी अभिकरण द्वारा किया जाना है तो सम्बन्धित राजकीय विभाग उस कार्य/योजना विशेष की वित्त (व्यय) विभाग की सहमति से प्रशासनिक स्वीकृति जारी करेंगे तथा वित्तीय स्वीकृति के आधार पर वित्त (बजट) विभाग द्वारा कार्यकारी अभिकरण के व्यक्तिगत निक्षेप खाते (P.D. A/C) में हस्तान्तरित की जाएगी।

8. कार्यकारी अभिकरण, कार्यों/योजनाओं की वित्तीय तथा भौतिक प्रगति से निधि के नोडल विभाग को, मासिक आधार पर, अवगत कराएंगे।

9. निधि की संचालन समिति, कार्यों/योजनाओं/प्रोजेक्ट की वित्तीय एवं भौतिक प्रगति की नियमित अन्तराल पर समीक्षा करेगी एवं सुनिश्चित करेगी कि कार्य/योजना, स्वीकृति के अनुसार एवं निर्धारित समय में पूर्ण हों।

10. कार्य पूर्ण होने के तीन माह में, कार्यकारी अभिकरण/राजकीय विभाग द्वारा, कार्य-पूर्णता रिपोर्ट तथा उपयोगिता प्रमाण-पत्र नोडल विभाग (परिवहन विभाग) को प्रस्तुत किए जाएंगे।

11. निधि की राशि से बनी परिसम्पतियों पर, कार्यकारी अभिकरण या राजकीय विभाग का स्वामित्व होगा तथा इन परिसम्पाियों का नियमित संधारण, विभाग/संस्थाओं के नियमित बजट से किया जाएगा। 12. कार्य/योजनाएं/प्रोजेक्ट स्वीकृत करने की शक्तियाँ (Schedule of Powers).--नियमों में उल्लेखित उद्‌देश्यों हेतु संचालन समिति द्वारा निम्नानुसार स्वीकृतियां दी जा सकेंगी :-

1. राजस्व प्रकृति के व्यय हेतु ।

2. रुपये 5.00 करोड से अधिक लागत के पूंजीगत कार्य संचालन समिति की अनुशंषा पर, वित्त विभाग की सहमति उपरान्त स्वीकृत किए जाएंगे। उल्लेखित उद्‌देश्यों की पूर्ति हेतु आवश्यक कार्य/ योजनाएं/परियोजनाएं जिनके लिए इन नियमों के अन्तर्गत निधि से राशि उपलब्ध कराया जाना संभव नहीं है उनसे संबंधित समस्त प्रस्ताव वित्त विभाग की सहमति उपरान्त ही स्वीकृत किए जा सकेंगे।

13. निधि का लेखांक.--संचालन समिति द्वारा अनुमोदित व्यय हेतु निधि में उपलब्ध धन राशि को, परिवहन विभाग के बजट मदों के जरिये व्यय किया जायेगा। उक्तानुसार परिवहन विभाग के बजट शीर्षों में बजटीय प्रावधान हेतु अपेक्षित समन्वय करने का दायित्व नोडल विभाग (परिवहन विभाग) का होगा। बजट प्रावधान के प्रस्ताव परिवहन विभाग द्वारा ही प्रस्तुत किए जाएंगे। निधि की प्राप्तियों एवं निधि से व्यय से सम्बन्धित विवरण-पत्र तथा अपेक्षित रजिस्टर संधारण करने का उत्तरदायित्व नोडल विभाग का होगा। 14. अंकेक्षण.--निधि की प्राप्तियों एवं व्यय के नोडल विभाग में संधारित लेखों का अंकेक्षण निदेशक, स्थानीय निरीक्षण विभाग द्वारा किया जायेगा। अंकेक्षण प्रतिवेदन की प्रति, निधि की संचालन समिति तथा वित्त (व्यय) विभाग को भी प्रस्तुत की जाएगी।

TRANSPORT DEPARTMENT

NOTIFICATION

Shimla-2, the 21st February, 2017

No. TPT-F (7)-1/2017.— In order to provide organized and safe traffic and public transport and to mitigate its effects on environment the Governor, Himachal Pradesh in exercise of the powers conferred by article 162 of the Constitution of India, is pleased to create the following fund namely:-

1. Short title.—The Fund may be called the Himachal Pradesh Transport Infrastructure Fund.

2. Commencement.— The fund will become operational from 1st April, 2017.

3. Definitions.—Unless the subject or context otherwise requires:

1. 'Fund' means Himachal Pradesh Transport Infrastructure Development Fund.

2. "State Government'' means Government of Himachal Pradesh.

3. 'Road Safety Fund' means Himachal Pradesh Road Safety Fund-2006.

4. 'Nodal Department' means Transport Department, Himachal Pradesh.

5. 'Financial Year' means duration starting from 1st April and ending at 31st March.

6. 'Finance Department' means Finance Department, Government of Himachal Pradesh.

7. 'Budget Finalising Committee' means committee constituted by Finance Department that approves Budget proposals after examining them.

8. 'Personal Deposit Account' means those accounts of Government Institutes opened in Treasury Office in which State Government transfer funds.

4. Objectives.—The objectives of Himachal Pradesh Transport Infrastructure Development Fund are:

(a) To provide organized and safe traffic and public Transport.

(b) To provide incentives to encourage the use of alternate fuels such L.P.G & C.N.G etc., for pollution free environment.

(c) To encourage plantation and its maintenance by the road side, to mitigate the effects the pollution.

(d) To partly fund Road Safety activities to make the roads of the State safer for the users.

5. Sources.—The Himachal Pradesh Transport Infrastructure Development Fund is proposed to be generated from the following sources:

(a) By imposing 10% cess on one time tax and 5% cess on other taxes levied under Himachal Motor Vehicle Taxation Act, 1972.

(b) Amount received at the rate of 5% of green tax charged from old and new vehicles.

(c) Amount received as Grant from consolidated fund of the State Government. (d) Amount contributed by the Central Government, State Government and other Non Governmental Organisation to fulfill the objectives of the Fund.

(e) Amount received from Industrial Institutions under Corporate Social Responsibility.

(f) Other sources which are decided for the purpose from time to time.

6. Nodal Department.—The Transport Department will be responsible for management and running of the Fund. For this purpose Secretary (Transport) to the Government of Himachal Pradesh will be Nodal Officer and Transport Department will be Administrative Department. 7. Implementing Agencies:—The following will be the implementing agencies for the effective implementation of the fund:

(a) Director, Transport, Himachal Pradesh

(b) Chief Executive Officer, Himachal Pradesh City Transport and Bus Stand Management and Development Authority.

(c) Apart from the above, for implementation of any special scheme, after approval from Managing Committee, any Government Department or Government Undertaking/ Organization could be designated as implementing agency. In such case the concerned department/organization will be responsible for the successful supervision and implementation of the said scheme.

8. Managing Committee.—The Himachal Pradesh Transport Infrastructure Development Fund will managed by a committee constituting of the following:

(a) Chief Secretary to the Govt. of H.P. Chairman

(b) Secretary (Transport) to the Govt. of H.P. Member

(c) Secretary (Finance) to the Govt. of H.P. Member

(d) Chief Executive Officer, HPCTBSMDA Member

(e) Director, Urban Transport, H.P. Member

(f) Director, Transport, H.P. Member

(g) Additional Director, Transport, H.P. Member Secretary8062 राजपत्र, हिमाचल प्रदेश, 04 मार्च, 2017/13 फाल्गुन, 1938 (B) Functions of Managing Committee: (i) To approve/sanction amount from the Fund to the projects, programmes, schemes proposed by various departments and programme implementing agencies that fulfill the objectives of the Fund.

(ii) To review, on regular intervals, the financial and physical progress of the schemes being implemented by various departments and agencies.

(iii) To formulate new schemes and projects to achieve the objectives of the Fund.

(iv) To create new Institutional System, if required, for successful implementation of Schemes.

(C) Schedule of Powers:—To fulfill the objectives of the Fund the Managing Committee can approve the following:

(i) For expenditure of revenue nature.

(ii) The works having capital expenditure of more than ` 5 Crore, will be undertaken after the recommendation of Managing Committee and approval of Finance Department. (iii) All the proposals of the works/Schemes/projects undertaken for fulfillment of objectives of the Fund and for whom amount could not be allocated from the Fund, will be undertaken after the approval of Finance Department.

9. Utilisation of Fund.—The 50% of the amount received under Himachal Pradesh Transport Infrastructure Development Fund is to be utilized through the Transport Department and 25% through the Himachal Pradesh City Transport and Bus Stand Management and Development Authority and remaining 25% of the amount will be utilized according to the priorities fixed by the Managing Committee as per the following:

A. The spending from the Fund will be permitted on the following works/schemes that are being implemented through Government Departments or Programme Implementing Agencies or through Public Private Partnership or Joint Venture or Special Purpose Venture:

(i) Schemes to encourage pollution free fuel and C.N.G and L.P.G etc Vehicles for controlling pollution.

(ii) To encourage, minimum Carbon emission of vehicles, silent tyres and sound absorbing road surface in Urban Transport, for controlling various forms of environmental pollution.

(iii) Apart from these, any other work which is in line with the objectives of the Fund, and approved by the managing committee.

B. The expenditure from the Fund, on the following heads, will be totally prohibited:

(i) Compensation for acquired land and buildings.

(ii) Expenditure on general repair and maintenance.

(iii) Expenditure on salary and allowances.

(v) Expenditure on National/International Training, Seminars, Workshops, Meetings and for attendance of departmental officers to study new innovations.

(vi) Non recurring Expenditure on rent of vehicles, purchase of vehicles, telephone, mobile, computers, office stationery etc., of Nodal Department and related State Departments.

10. Procedure for Utilisation of fund:—

(a) Government Departments/Programme Implementing Agencies will prepare Technical and Financial proposals of the Works/Projects.

(b) Programme Implementing Agencies will place its proposals, after approval from concerned Administrative Department, before the Managing Committee for approval. The Transport Department will ensure that Fund is being utilized in approved proportions that is the 50% of the Fund is being utilized by the Transport Department and 25% by the Himachal Pradesh City Transport and Bus Stand Management and Development Authority and remaining 25% as per the priorities fixed by the Managing Committee.

(c) The Managing Committee will consider the proposals of Government Departments and Programme Implementing Agencies keeping in view the importance and need of the proposal and will take appropriate decision. The approval of Finance Department will be taken for works/schemes wherever required.

(d) Nodal Department will prepare Annual Action Plan after assessing the revenue received in the Fund and will place it before the Budget Finalising Committee for making appropriate budge provisions.

(e) After taking approval of Budget Finalising Committee, the Budget Section will make provision of Funds in the concerned Budget Heads. If during the year, additional sum is required for fulfilling the objectives of the Fund, the necessary provisions will be approved through Finance Department.

(f) If the work is to be undertaken through Government Department then they will use the Budget provision through Government Treasury.

(g) If the work/project is to be implemented through Progamme Implementing Agencies then the concerned Government Department will issue Administrative Approval after getting approval from Finance (Expenditure) Department and as per the approval of Finance Department, the Finance (Budget) Department will transfer the amount to Personal Deposit Account of the Programme Implementing Agencies.

(h) Programme Implementing Agencies will inform Nodal Department of the financial and physical progress of the works/schemes on the monthly basis.

(i) The Managing Committee of the Fund will review the financial and physical progress of the works/schemes/ projects on regular intervals and will ensure that the works/schemes are being implemented as approved and within the approved time frame.

(k) The assets created from the fund will be owned by the Programme Implementing Agencies/Government Department and the regular maintenance of these assets will be undertaken by the Department/Agencies from the regular budget.

11. Accounting of the Fund.—For expenditure approved by the Managing Committee, the amount will be released through the budget heads of Transport Department. It will be the responsibility of Nodal Department to coordinate between Budget Heads of Transport Department and Budgetary provisions. The proposal for making Budget provisions, will be made by Transport Department. The Statement of receipts of Funds and expenditure from fund and expected maintenance of Register is also the responsibility of the Nodal Department.

12. Audit.—The receipt and expenditure accounts as maintained by Nodal Department will be audited by Director, Local Audit Department. The copy of Audit Report will be placed before Managing Committee and Finance (Expenditure) Department.

संख्याः एस.डब्लू.डी.(बी)2-12/2016.--हिमाचल प्रदेश के राज्यपाल, भारत के संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, हिमाचल प्रदेश लोक सेवा आयोग के परामर्श से, हिमाचल प्रदेश सैनिक कल्याण विभाग में चालक, वर्ग-III (अराजपत्रित), लिपिक वर्गीय सेवाएं के पद के लिए इस अधिसूचना से संलग्न उपाबन्ध- 'क' के अनुसार भर्ती और प्रोन्नति नियम बनाते हैं, अर्थात्‌ः- 1. संक्षिप्त नाम, और प्रारम्भ.-(1) इन नियमों का संक्षिप्त नाम हिमाचल प्रदेश सैनिक कल्याण विभाग, चालक, वर्ग-III (अराजपत्रित), लिपिक वर्गीय सेवाएं, भर्ती और प्रोन्नति नियम, 2017 है। (2) ये नियम राजपत्र, हिमाचल प्रदेश में प्रकाशित किए जाने की तारीख से प्रवृत होंगे।

5. ''चयन'' पद अथवा ''अचयन'' पद.--अचयन।

6. सीधी भर्ती के लिए आयु.--18 से 45 वर्ष

परन्तु सीधे भर्ती किए जाने वाले व्यक्तियों के लिए ऊपरी आयु सीमा, तदर्थ या संविदा के आधार पर नियुक्त व्यक्तियों सहित, पहले से ही सरकार की सेवा में रत अभ्यर्थियों को लागू नहीं होगी :

परन्तु यह और कि यदि तदर्थ या संविदा के आधार पर नियुक्त किया गया अभ्यर्थी इस रूप में नियुक्ति की तारीख को अधिक आयु का हो गया हो, तो वह उसकी ऐसी तदर्थ या संविदा पर की गई नियुक्ति के कारण विहित आयु में शिथिलीकरण का पात्र नहीं होगाः

परन्तु यह और कि ऊपरी आयु सीमा में, अनुसूचित जातियों/अनुसूचित जनजातियों/अन्य पिछड़ा वर्गों और व्यक्तियों के अन्य प्रवर्गो के लिए, उस विस्तार तक शिथिलीकरण किया जाएगा जितना की हिमाचल प्रदेश सरकार के साधारण या विशेष आदेश (आदेशों) के अधीन अनुज्ञेय हैः

परन्तु यह और भी कि समस्त पब्लिक सेक्टर निगमों तथा स्वायत निकायों के कर्मचारियों को, जो ऐसे पब्लिक सेक्टर निगमों तथा स्वायत निकायों के प्रारम्भिक गंठन के समय ऐसे पब्लिक सेक्टर निगमों/स्वायत निकायों में आमेलन से पूर्व सरकारी कर्मचारी थे, सीधी भर्ती के लिए आयु सीमा में ऐसी ही रियायत अनुज्ञात की जाएगी जैसी सरकारी कर्मचारियों को अनुज्ञेय है। ऐसी रियायत, तथापि पब्लिक सेक्टर निगमों तथा स्वायत निकायों के ऐसे कर्मचारिवृन्द को अनुज्ञेय नहीं होगी जो तत्पश्चात ऐसे निगमों/स्वायत निकायों द्वारा नियुक्त किए गए थे/किए गए हैं और उन पब्लिक सेक्टर निगमोें/स्वायत निकायों के प्रारम्भिक गठन के पश्चात्‌ ऐसे निगमों/स्वायत निकायों की सेवा में अन्तिम रूप से आमेलित किए गए हैं/किए गए थे। टिप्पण.--सीधी भर्ती के लिए आयु सीमा की गणना उस वर्ष के प्रथम दिवस से की जाएगी जिसमें कि पद (पदों) को आवेदन आमन्त्रित करने के लिए, यथास्थिति, विज्ञापित किया गया है या नियोजनालयों को अधिसूचित किया गया है। 8066 राजपत्र, हिमाचल प्रदेश, 04 मार्च, 2017/13 फाल्गुन, 1938 7. सीधी भर्ती किए जाने वाले व्यक्ति (व्यक्तियों) के लिए अपेक्षित न्यूनतम शैक्षिक और अन्य अर्हताएं.--(क) अनिवार्य अर्हता(एं)ः (i) किसी मान्यता प्राप्त स्कूल शिक्षा बोर्ड से दसवीं पास।

(ii) पहाड़ी क्षेत्र में भारी/हल्के वाहन चलाने हेतु विधिमान्य चालन अनुज्ञप्ति अवश्य रखता हो। (iii) भूतपूर्व सैनिक, भूतपूर्व सैनिक की परिभाषा के अन्तर्गत अवश्य आता हो।

(ख) वांछनीय अर्हता(एं).--हिमाचल प्रदेश की रूढ़ियों, रीतियों और बोलियों का ज्ञान और प्रदेश में विद्यमान विशिष्ट दशाओं में नियुक्ति के लिए उपयुक्तता।

8. सीधे भर्ती किए जाने वाले व्यक्तियों के लिए विहित आयु और शैक्षिक अर्हताएं प्रोन्नत व्यक्ति (व्यक्तियों) की दशा में लागू होंगी या नही.--आयु : लागू नहीं।

शैक्षिक अर्हता--लागू नहीं।

9. परिवीक्षा की अवधि, यदि कोई हो.--(क) दो वर्ष, जिसका एक वर्ष से अनधिक ऐसी और अवधि के लिए विस्तार किया जा सकेगा, जैसा सक्षम प्राधिकारी विशेष परिस्थ्तिियों में और कारणों को लिखित में अभिलिखित करके आदेश दें।

(ख) संविदा के आधार पर, सेवाधृति के आधार पर नियुक्ति पर, अधिवर्षिता के पश्चात्‌ पुनर्नियोजन पर और आमेलन पर कोई परिवीक्षा नहीं होगी।

10. भर्ती की पद्धतिः भर्ती सीधी होगी या प्रोन्नति, सैंकेण्डमैंट, स्थानान्तरण द्वारा और विभिन्न पद्धतियों द्वारा भरे जाने वाले पद(पदों) की प्रतिशतता.--हिमाचल प्रदेश के भूतपूर्व सैनिकों में से शतप्रतिशत सीधी भर्ती द्वारा, यथास्थिति नियमित आधार पर या संविदा के आधार पर भर्तीे द्वारा।

11. प्रोन्नति/सैंकेण्ड़मैंट/स्थानान्तरण द्वारा भर्ती की दशा में वे श्रेणियां (ग्रेड)जिनसे प्रोन्नति/ सैंकेण्डमैंट/स्थानान्तरण किया जाएगा.--लागू नही।

12. यदि विभागीय प्रोन्नति समिति/विभागीय स्थायीकरण समिति विद्यमान हो तो उसकी संरचना.--(क) प्रोन्नति के लिए.--लागू नहीं।

(ख) स्थायीकरण के लिए.--जैसी सरकार द्वारा समय-समय पर गठित की जाए।

13. भर्ती करने मेें जिन परिस्थितियों में हिमाचल प्रदेश लोक सेवा आयोग से परामर्श किया जाएगा.--जैसा विधि द्वारा अपेक्षित हो।

14. सीधी भर्ती के लिए अनिवार्य अपेक्षा.--किसी सेवा या पद पर नियुक्ति के लिए अभ्यर्थी का भारत का नागरिक होना अनिवार्य है।

15. सीधी भर्ती द्वारा पद पर नियुक्ति के लिए चयन.--सीधी भर्ती के मामले में, पद पर नियुक्ति के लिए चयन, भूतपूर्व सैनिक विशेष रोजगार कक्ष, हमीरपुर द्वारा प्रायोजित/संस्तुत पात्र अभ्यर्थियों में से साक्षात्कार/व्यक्तित्व परीक्षण के आधार पर किया जाएगा या यदि, ऐसा करना आवश्यक या समीचीन समझा जाए तो पूर्व में ली गई छन्टनी परीक्षा (वस्तुनिष्ठ प्रकार की)/लिखित परीक्षा या व्यावहारिक परीक्षा या शारीरिक परीक्षण के अनुसार साक्षात्कार/व्यक्तित्व परीक्षण के आधार पर किया जाएगा, जिसका स्तर/ पाठयक्रम आदि सम्बद्ध भर्ती प्राधिकरण द्वारा अवधारित किया जाएगा।

15-क संविदा नियुक्ति द्वारा पद पर नियुक्ति के लिए चयन.--इन नियमों में किसी बात के होते हुए भी पद पर संविदात्मक नियुक्तियां नीचे दिए गए निबन्धनों और शर्तो के अध्यधीन की जाएगीं।8067 राजपत्र, हिमाचल प्रदेश, 04 मार्च, 2017/13 फाल्गुन, 1938 (I) संकल्पना.-- (क) इस पॉलिसी के अधीन हिमाचल प्रदेश सैनिक कल्याण विभाग, में चालक को संविदा के आधार पर प्रारम्भ में एक वर्ष के लिए लगाया जाएगा, जिसे वर्षानुवर्ष आधार पर बढ़ाया जा सकेगाः

परन्तु संविदा अवधि में वर्षानुवर्ष आधार पर विस्तारण/नवीकरण के लिए सम्बन्ध विभागाध्यक्ष यह प्रमाण पत्र जारी करेगा कि संविदा पर नियुक्त व्यक्ति की सेवा और आचरण वर्ष के दौरान संतोषजनक रहा है और केवल तभी उसकी संविदा की अवधि नवीकृत/विस्तारित की जाएगीे।

(ख) पद का हिमाचल प्रदेश कर्मचारी चयन आयोग के कार्यक्षेत्र से बाहर होनाः-निदेशक, सैनिक कल्याण विभाग, हिमाचल प्रदेश, सरकार से रिक्त पद को संविदा के आधार पर भरने के लिए सरकार का अनुमोदन प्राप्त करने के पश्चात्‌ भूतपूर्व सैनिक विशेष रोजगार कक्ष, हमीरपुर से इन नियमाें के अनुसार यथाविहित अर्हताओं और अन्य पात्रता शर्ताें को पूर्ण करने वाले भूतपूर्व सैनिकों के अनुरक्षित पैनल में से नाम मंगवाएगा।

(ग) चयन इन नियमों में विहित पात्रता शर्तोंं के अनुसार किया जाएगा।

(II) संविदात्मक उपलब्धियां.--

संविदा के आधार पर नियुक्त चालक को ` 7,910/-रूपए की दर से समेकित नियत संविदात्मक रकम (जो पे बैण्ड के न्यूनतम जमा ग्रेड पे के बराबर होगी) प्रतिमास संदत्त की जाएगी। यदि संविदा में एक वर्ष से अधिक की बढ़ौतरी की जाती है तो पश्चात्‌वर्ती वर्ष/वर्षोें के लिए संविदात्मक उपलब्धियों में ` 237/-रूपए (पद के पे बैण्ड जमा ग्रेड पे का तीन प्रतिशत) की रकम की वार्षिक वृद्धि का हकदार होगा और अन्य कोई सहबद्ध प्रसुविधाएं जैसे वरिष्ठ/चयन वेतनमान, आदि नहीं दिया जाएगा।

(III) नियुक्ति/अनुशासन प्राधिकारी-

निदेशक, सैनिक कल्याण, हिमाचल प्रदेश नियुक्ति और अनुशासन प्राधिकारी होगा।

(IV) चयन प्रक्रिया.--

संविदा नियुक्ति की दशा में पद पर नियुक्ति के लिए चयन, भूतपूर्व सैनिक विशेष रोजगार कक्ष, हमीरपुर द्वारा प्रायोजित/संस्तुत पात्र अभ्यर्थियों में से साक्षात्कार/व्यक्तित्व परीक्षण के आधार पर किया जाएगा या यदि, ऐसा करना आवश्यक या समीचीन समझा जाए तो पूर्व में ली गई छन्टनी परीक्षा वस्तुनिष्ठ प्रकार की/लिखित परीक्षा या व्यावहारिक परीक्षा या शारीरिक परीक्षा के अनुसार साक्षात्कार/व्यक्तित्व के आधार पर किया जाएगा, जिसका स्तर/पाठ्‌यक्रम आदि, सम्बद्ध भर्ती प्राधिकरण द्वारा अवधारित किया जाएगा।

(V) संविदात्मक नियुक्तियों के लिए चयन समिति.--

जैसी सम्बद्ध भर्ती अभिकरण अर्थात्‌ निदेशक, सैनिक कल्याण विभाग, हिमाचल प्रदेश द्वारा समय-समय पर गठित की जाए।

(VI) करार.--

अभ्यर्थी को चयन के पश्चात्‌ इन नियमों से संलग्न उपाबन्ध-"ख" के अनुसार करार हस्ताक्षरित करना होगा।8068 राजपत्र, हिमाचल प्रदेश, 04 मार्च, 2017/13 फाल्गुन, 1938 (VII) निबन्धन और शर्तेंः- (क) संविदा पर नियुक्त व्यक्ति को ` 7910/-प्रतिमास की दर से नियत संविदात्मक रकम (जो पे बैण्ड के न्यूनतम जमा ग्रेड पे के बराबर होगी) प्रतिमास संदत की जाएगी। संविदा पर नियुक्त व्यक्ति आगे बढ़ाए गए वर्ष/वर्षों के लिए संविदात्मक रकम में ` 237/-(पद के पे बैण्ड का न्यूनतम।

(ख) संविदा पर नियुक्त व्यक्ति की सेवा पूर्णतया अस्थायी आधार पर होगी। यदि संविदा पर नियुक्त व्यक्ति का कार्यपालन/आचरण ठीक नहीं पाया जाता है तो नियुक्ति पर्यवसित (समाप्त) किए जाने के लिए दायी होगी।

(ग) संविदा पर नियुक्त व्यक्ति, एक मास की सेवा पूरी करने के पश्चात्‌ एक दिन के आकस्मिक अवकाश का हकदार होगा। तथापि संविदा पर नियुक्त कर्मचारी एक सौ पैंतीस दिन के प्रसूति अवकाश, दस दिन के चिकित्सा अवकाश और पांच दिन के विशेष अवकाश के लिए भी हकदार होगा/होगी। संविदा पर नियुक्त महिला पूरी सेवा के दौरान, गर्भपात हो जाने सहित गर्भपात कराने की दशा में, प्राधिकृत चिकित्सा अधिकारी द्वारा जारी चिकित्सा प्रमाण-पत्र प्रस्तुत करने पर पैंतालीस दिन से अनधिक प्रसूति अवकाश(जीवित बच्चों की संख्या का विचार किए बिना) के लिए भी हकदार होगी। वह चिकित्सा प्रतिपूर्ति और एल0टी0सी0 आदि के लिए हकदार नहीं होगा/होगी। संविदा पर नियुक्त व्यक्ति को उपरोक्त के सिवाय किसी अन्य प्रकार का कोई अवकाश अनुज्ञात नही होगा :

परन्तु अनुपभुक्त आकस्मिक अवकाश, चिकित्सा अवकाश और विशेष अवकाश एक कैलेण्डर वर्ष तक संचित किया जा सकेगा और आगामी कलैण्डर वर्ष के लिए अग्रनीत नहीं किया जाएगा।

(घ) नियन्त्रक अधिकारी के अनुमोदन के बिना कत्र्तव्य (ड्‌यूटी) से अनधिकृत अनुपस्थिति से स्वतः ही संविदा का पर्यवसान (समापन) हो जाएगा। तथापि आपवादिक मामलों में जहां पर चिकित्सा आधार पर कत्र्तव्य (ड्‌यूटी) से अनधिकृत अनुपस्थिति के हालात संविदा पर नियुक्त व्यक्ति के नियन्त्रण से बाहर हों तो उसके नियमितीकरण के मामले में विचार करते समय ऐसी अवधि अपवर्जित नहीं की जाएगी, किन्तु पदधारी को इस बावत समय पर नियन्त्रक प्राधिकारी को सूचित करना होगा तथापि संविदा पर नियुक्त व्यक्ति कत्र्तव्य (ड्‌यूटी) से अनुपस्थिति की अवधि के लिए संविदात्मक रकम का हकदार नहीं होगाः

परन्तु उसे सरकार के प्रचलित अनुदेशों के अनुसार, चिकित्सा अधिकारी द्वारा जारी किए गए बीमारी/ आरोग्य प्रमाण-पत्र को प्रस्तुत करना होगा।

(ड.) संविदा के आधार पर नियुक्त पदधारी जिसने तैनाती के एक स्थान पर तीन वर्ष का कार्यकाल पूर्ण कर लिया हो, आवश्यकता के आधार पर स्थानान्तरण हेतु पात्र होगा, जहां भी प्रशासनिक आधार पर ऐसा करना अपेक्षित हो।

(च) चयनित अभ्यर्थी को सरकारी/रजिस्ट्रीकृत चिकित्सा व्यवसायी से अपना आरोग्य प्रमाण-पत्र प्रस्तुत करना होगा। बारह सप्ताह से अधिक की गर्भवती महिला अभ्यर्थी प्रसव होने तक अस्थायी तौर पर अनुपयुक्त समझी जाएगी। ऐसी महिला अभ्यर्थी का किसी प्राधिकृत चिकित्सा अधिकारी/व्यवसायी द्वारा उपयुक्तता के लिए पुनः परीक्षण किया जाएगा।

(छ) संविदा पर नियुक्त व्यक्ति का, यदि अपने पदीय कर्तव्यों के सम्बन्ध में दौरे पर जाना अपेक्षित हो, तो वह उसी दर पर, जैसी कि नियमित प्रतिस्थानी पदधारी को वेतनमान के न्यूनतम पर लागू है, यात्रा भत्ते/दैनिक भत्ते का हकदार होगा।8069 राजपत्र, हिमाचल प्रदेश, 04 मार्च, 2017/13 फाल्गुन, 1938 (ज) नियमित कर्मचारियों की दशा में यथा लागू सेवा नियमों जैसे एफ0आर0-एस0आर0, छुट्‌टी नियम, साधारण भविष्य निधि नियम, पेंशन नियम तथा आचरण नियम आदि के उपबन्ध संविदा पर नियुक्त व्यक्तियों की दशा में लागू नहीं होंगे। स्ांविदा पर नियुक्त व्यक्ति (व्यक्तियों) को कर्मचारी सामूहिक बीमा योजना के साथ-साथ ई0पी0एफ0/जी0पी0एफ0 भी लागू नहीं होगा। 16. आरक्षण.--सेवा में नियुक्ति, हिमाचल प्रदेश सरकार द्वारा, समय-समय पर अनुसूचित जातियों/अनुसूचित जन जातियों/अन्य पिछड़े वर्गों और व्यक्तियों के अन्य प्रवर्गों के लिए सेवा में आरक्षण की बाबत जारी किए गए आदेशों के अधीन होगी।

17. विभागीय परीक्षा.--लागू नहीं।

18. शिथिल करने की शक्ति.--जहां राज्य सरकार की यह राय हो कि ऐसा करना आवश्यक या समीचीन है, वहां वह, कारणों को लिखित में अभिलिखित करके और हिमाचल प्रदेश लोक सेवा आयोग के परामर्श से, आदेश द्वारा, इन नियमों, के किसी/किन्हीं उपबन्ध (उपबन्धों) को किसी वर्ग या व्यक्ति (व्यक्तियों) के प्रवर्ग या पद (पदों) की बाबत, शिथिल कर सकेगी।

उपाबन्ध "ख" चालक हिमाचल प्रदेश सरकार के मध्य निदेशक, सैनिक कल्याण, हिमाचल प्रदेश के माध्यम से निष्पादित की जाने वाली संविदा/करार का प्रारूप।

यह करार श्री/श्रीमति......................................... पुत्र/पुत्री श्री..........................निवासी......................................... संविदा पर नियुक्त व्यक्ति (जिसे इसमें इसके पश्चात्‌ "प्रथम पक्षकार" कहा गया है), और हिमाचल प्रदेश के राज्यपाल, के मध्य निदेशक, सैनिक कल्याण, हिमाचल प्रदेश (जिसे इसमें इसके पश्चात्‌ "द्वितीय पक्षकार" कहा गया हेै) के माध्यम से आज तारीख ................. को किया गया।

"द्वितीय पक्षकार" ने उपरोक्त प्रथम पक्षकार को लगाया है और प्रथम पक्षकार ने चालक के रूप में संविदा के आधार पर निम्नलिखित निबन्धन और शर्तों पर सेवा करने के लिए सहमति दी हैः-

1. यह कि प्रथम पक्षकार चालक के रूप में ............................................. से प्रारम्भ होने और....................

...............को समाप्त होने वाले दिन तक एक वर्ष की अवधि के लिए द्वितीय पक्षकार की सेवा में रहेगा। यह विनिर्दिष्ट रूप से उल्लिखित किया गया है और दोनों पक्षकारों द्वारा करार पाया गया है कि प्रथम पक्षकार की द्वितीय पक्षकार के साथ संविदा, आखिरी कार्य दिवस अर्थात्‌...................... .......दिन को स्वयंमेव ही पर्यवसित(समाप्त) हो जाएगी तथा सूचना नोटिस आवश्यक नहीं होगाः परन्तु संविदा की अवधि में वर्षानुवर्ष आधार पर विस्तारण/नवीकरण के लिए निदेशक, सैनिक कल्याण, हिमाचल प्रदेश यह प्रमाणपत्र जारी करेगा कि संविदा पर नियुक्त व्यक्ति की सेवा और आचरण वर्ष के दौरान संतोषजनक रहा है और केवल तभी उसकी संविदा की अवधि नवीकृत/विस्तारित की जाएगी।

3. प्रथम पक्षकार की सेवा पूर्णतया अस्थाई आधार पर होगी। यदि संविदा पर नियुक्त व्यक्ति का कार्यपालन/आचरण ठीक नहीं पाया जाता है तो नियुक्ति पर्यवसित (समाप्त) की जाने के लिए दायी होगी।

4. संविदात्मक चालक एक मास की सेवा पूरी करने के पश्चात्‌ एक दिन के आकस्मिक अवकाश का हकदार होगा। तथापि संविदा पर नियुक्त कर्मचारी एक सौ पैंतीस दिन के प्रसूति अवकाश,8070 राजपत्र, हिमाचल प्रदेश, 04 मार्च, 2017/13 फाल्गुन, 1938 दस दिन के चिकित्सा अवकाश और पांच दिन के विशेष अवकाश के लिए भी हकदार होगा/होगी। संविदा पर नियुक्त महिला कर्मचारी पूरी सेवा के दौरान, गर्भपात हो जाने सहित गर्भपात कराने की दशा में, प्राधिकृत चिकित्सा अधिकारी द्वारा जारी प्रमाण पत्र प्रस्तुत करने पर पैंतालीस दिन से अनधिक प्रसूति अवकाश (जीवित बच्चों की संख्या का विचार किए बिना) के लिए भी हकदार होगी। वह चिकित्सा प्रतिपूर्ति और एल0टी0सी0 आदि के लिए हकदार नहीं होगा/होगी। संविदा पर नियुक्त व्यक्ति को उपरोक्त के सिवाय अन्य किसी प्रकार का कोई अवकाश अनुज्ञात नहीं होगा :

परन्तु अनुपभुक्त आकस्मिक अवकाश, चिकित्सा अवकाश और विशेष अवकाश एक कलैण्डर वर्ष तक संचित किया जा सकेगा ओैर आगामी कलैण्डर वर्ष के लिए अग्रनीत नहीं किया जाएगा। 5. नियन्त्रक प्राधिकारी के अनुमोदन के बिना कत्र्तव्य (ड्‌यूटी) से अनधिकृत अनुपस्थिति से स्वतः ही संविदा का पर्यवसान (समापन) हो जाएगा। तथापि आपवादिक मामलोें में जहां पर चिकित्सा आधार पर कत्र्तव्य(ड्‌यूटी) से अनधिकृत अनुपस्थिति के हालात संविदा पर नियुक्त व्यक्ति के नियन्त्रण से बाहर हो तो उसकेे नियमितिकरण के मामले में विचार करते समय ऐसी अवधि अपवर्जित नहीं की जाएगी, परन्तु पदधारी को इस बाबत समय पर उसके नियन्त्रण प्राधिकारी को सूचित करना होगा तथापि संविदा पर नियुक्त व्यक्ति कत्र्तव्य (ड्‌यूटी) से अनुपस्थिति की ऐसी अवधि के लिए संविदात्मक रकम का हकदार नहीं होगा :

परन्तु उसे सरकार के प्रचलित अनुदेशों के अनुसार, चिकित्सा अधिकारी द्वारा जारी किए गए बीमारी/ आरोग्य प्रमाण-पत्र को प्रस्तुत करना होगा।

6. स्ांविदा के आधार पर नियुक्त चालक जिसने तैनाती के एक स्थान पर तीन वर्ष का कार्यकाल पूर्ण कर लिया हो, आवश्यकता के आधार पर स्थानान्तरण हेतु पात्र होगा, जहां भी प्रशासनिक आधार पर ऐसा करना अपेक्षित हो।

7. चयनित अभ्यर्थी को सरकारी/रजिस्ट्रीकृत चिकित्सा व्यवसायी से अपना आरोग्य प्रमाण-पत्र प्रस्तुत करना होगा। महिला अभ्यर्थियों की दशा में, बारह सप्ताह से अधिक की गर्भावस्था प्रसव होने तक, उसे अस्थाई तौर पर अनुपयुक्त बना देगी। ऐसी महिला अभ्यर्थी का किसी प्राधिकृत चिकित्सा अधिकारी/व्यवसायी द्वारा उपयुक्तता के लिए पुनः परीक्षण किया जाना चाहिए। 8. स्ांविदा पर नियुक्त व्यक्ति का, यदि अपने पदीय कत्र्तव्यों के सम्बन्ध में दौरे पर जाना अपेक्षित हो, तो वह उसी दर पर, जैसी कि नियमित प्रतिस्थानी पदधारी को पद के वेतनमान के न्यूनतम पर लागू है, यात्रा भत्ते/दैनिक भत्ते का हकदार होगा/होगी।

9. कर्मचारी सामूहिक बीमा योजना के साथ-साथ ई0पी0एफ0/जी0पी0एफ0 भी लागू नहीं होगा। इसके साक्ष्यस्वरूप प्रथम पक्षकार और द्वितीय पक्षकार ने साक्षियों की उपस्थिति में इसमें सर्वप्रथम उल्लिखित तारीख को अपने-अपने हस्ताक्षर कर दिए हेैं।

No. SWD-(B)2-12/2016 Dated—In exercise of the powers conferred by proviso to article 309 of the Constitution of India, the Governor, Himachal Pradesh, in consultation with the Himachal Pradesh Public Service Commission, is pleased to make the Recruitment and Promotion Rules for the post of Driver, Class-III (Non-Gazetted) Ministerial Services in Sainik Welfare Department as per Annexure "A" attached to this notification, namely.—

1. Short title and commencement—(1) These rules may be called the Himachal Pradesh Sainik Welfare Department, Driver, Class-III (Non- Gazetted), Ministerial Services, Recruitment and Promotion Rules, 2017.

(2) These rules shall come into force from the date of publication in the Rajpatra, Himachal Pradesh.

Recruitment & Promotion Rules for the post of Driver, (Non-Gazetted) Class-III,

Ministerial Services in Sainik Welfare Department, Himachal Pradesh.

1. Name of Post.—Driver

2. Number of Posts.—11(Eleven)

3. Classification.—Class-III (Non-Gazetted) (Ministerial Services)

4. Scale of Pay.—(i) Pay Scale for regular incumbents:

Pay Band `5910-20200 + ` 2000 Grade pay

(ii) Pay Band `5910-20200 + `2400 Grade pay

(This Pay Band will be given after 2 years of regular service.)

(iii) Emoluments for Contract Employees:

` 7910/- PM as per details given in Column No. 15A.

5. Whether "Selection" post or " Non-Selection" Post.—Non Selection.

6. Age for direct recruitment.—18 to 45 years

Provided that the upper age limit for direct recruits will not be applicable to the candidates already in service of the Government including those who have been appointed on adhoc or on contract basis:

Provided further that if a candidate appointed on adhoc basis or on contract basis had become over-age on the date he/she was appointed as such, he/she shall not be eligible for any relaxation in the prescribed age limit by virtue of his/her such adhoc or contract appointment:

Provided further that upper age limit is relaxable for Scheduled Castes/Scheduled Tribes/Other Backward classes and other categories of persons to the extent permissible under the general or special order (s) of the Himachal Pradesh Government:

Provided further that the employees of all the Public Sector Corporations and Autonomous Bodies who happened to be Government servant before absorption in Public Sector Corporation/ Autonomous Bodies at the time of initial constitution of such Corporation/Autonomous Bodies shall be allowed age concession in direct recruitment as admissible to Government servants. This concession will not, however, be admissible to such staff of the Public Sector Corporations/ Corporations/Autonomous Bodies who are/were subsequently appointed by such Corporation/ Autonomous Bodies and who are/were finally absorbed in the service ofsuch Corporations/ Autonomous Bodies after initial constitution of the Public Sector Corporations/Autonomous Bodies.

Note.—Age limit for direct recruitment will be reckoned on the first day of the year in which the post(s) is/are advertised for inviting application or notified to the Employment Exchanges, as the case may be.

7. Minimum Educational and other qualifications required for direct recruit(s)— a) ESSENTIAL QUALIFICATION(s)—(i) Matric from a recognized Board of School Education.

(ii) Must possess valid driving licence for the plying of heavy/light motor vehicles in hilly terrain.

(iii) Must be Ex-servicemen within meaning of definition of an Ex-serviceman.

(b) DESIRABLE QUALIFICATION:

Knowledge of customs, manners and dialects of Himachal Pradesh and suitability for appointment in the peculiar conditions prevailing in the Pradesh.

8. Whether age and educational qualification(s) prescribed for direct recruit(s) will

apply in the case of the promotee(s).—Age.—Not applicable.

Education Qualification.—Not Applicable

9. Period of Probation, if any.— (a) Two years subject to such further extension for a period not exceeding one year as may be ordered by the competent authority in special circumstances and reasons to be recorded in writing.

(b) No probation in case of appointment on contract basis, tenure basis, re-employment after superannuation and absorption.

10. Method(s) of recruitment, whether by direct recruitment or by promotion, secondment, transfer and the percentage of post(s) to be filled in by various methods.—100% by direct recruitment on a regular basis or by recruitment on contract basis, as the case may be, from amongst the ex- servicemen of Himachal Pradesh.

11. In case of recruitment by promotion/ secondment/ transfer, grades from which

promotion/ secondment / transfer is to be made—.Not applicable.

12. If a Departmental Promotion Committee /Department Confirmation Committee exists, what is its composition.—(a) For promotion—Not applicable

(b) For confirmation—As may be constituted by the Government from time to time.

13. Circumstances under which the H.P.P.S.C. is to be consulted in making recruitment.—As required under the law.

14. Essential requirement for a direct recruitment.—A candidate for appointment to any service or post must be a Citizen of India.

15. Selection for appointment to the post by direct recruitment—Selection for appointment to the post in the case of direct recruitment shall be made from amongst the eligible candidates sponsored/recommended by Special Ex-Servicemen Employment Cell, Hamirpur, on the basis of interview/personality test or if considered necessary or expedient on the basis of interview/personality test preceeded by a screening test (objective type)/written test or practical test or physical test, the standard/syllabus, etc. of which, will be determined by the concerned recruiting authority.

8074 राजपत्र, हिमाचल प्रदेश, 04 मार्च, 2017/13 फाल्गुन, 1938 15-A. Selection for appointment to the post by contract appointment.— Notwithstanding anything contained in these rules, contract appointments to the post will be made subject to the terms and conditions given below:—

(I) CONCEPT:

(a) Under this policy the Driver in extended beyond one year.

(III) APPOINTING/DISCIPLINARY AUTHORITY:

The Director, Sainik Welfare, H.P will be appointing and disciplinary authority.

(IV) SELECTION PROCESS:

Selection for appointment to the post in the case of contract appointment shall be made from amongst the eligible candidates sponsored/ recommended by Special Ex-Servicemen Employment Cell, Hamirpur on the basis of interview/personality test or if considered necessary or expedient on the basis of interview/personality test preceded by a screening test (Objective type)/written test or practical test or physical test, the standard/ syllabus, etc. of which, will be determined by the concerned recruiting authority.

(V) COMMITTEE FOR SELECTION OF CONTRACTUAL APPOINTMENTS:

As may be constituted by the concerned recruiting agency i.e. The Director, Sainik Welfare, H.P from time to time.

(VI) AGREEMENT:

After selection of a candidate, he/she shall sign an agreement as per Annexure-"B" appended to these rules.

(VII) TERMS AND CONDITIONS:

(a) The Contractual appointee will be paid fixed contractual amount @ ` 7910/- per month (which shall be equal to minimum of the pay band+grade pay). Sainik Welfare Department, Himachal Pradesh will be engaged on contract basis initially for one year; which may be extendable on year to year basis:

Provided that for further extension/ renewal of contract period on year to year basis, the concerned HOD shall issue a certificate that the service and conduct of the contract appointee is satisfactory during the year and only then the period of contract is to be renewed/extended.

(b) POST FALLS OUT OF THE PURVIEW OF HPSSC:

The Director, Sainik Welfare Himachal Pradesh, after obtaining the approval of the Government for filling up the vacant posts on contract basis will ask the names from the Special Ex-Servicemen Employment Cell, Hamirpur, from the panel of Ex-servicemen maintained as per prescribed qualifications and fulfilling the other eligibility conditions as prescribed in these rules.

(c) The selection will be made in accordance with the eligibility conditions prescribed in these rules.

The Driver appointed on contract basis will be paid consolidated fixed amount @ `7910 per month (which shall be equal to minimum of the payband +grade pay). An amount of `237/- (3% of the minimum of pay band plus grade pay of the post) as annual increase in contractual emoluments for the subsequent year(s) will be allowed if contract is The contract appointee will be entitled for increase in contractual amount of ` 237/- (3% of minimum of the pay band plus grade pay of the post) for further extended years and no other allied benefits such as senior/selection scales etc. will be given.

(b) The service of the Contract appointee will be purely on temporary basis. The appointment is liable to be terminated in case the performance/conduct of the contract appointee is not found satisfactory.

(c) Contract appointee will be entitled for one day's casual leave after putting in one month's service. However, the contractual appointee will also be entitled for 135 days Maternity Leave, 10 days Medical Leave and 5 days Special Leave. A female contract appointee shall also be entitled for maternity leave not exceeding 45 days (Irrespective of the number of surviving children) during the entire service, in case of miscarriage including abortion, on production of medical certificate issued by the authorized government Medical Officer. He/she shall not be entitled for medical re-imbursement and LTC etc. No leave of any other kind except above, is admissible to the contract appointee:

Provided that the un-availed Casual Leave, Medical Leave and Special Leave can be accumulated upto the calendar year and will not be carried forward for the next Calendar year.

(d) Unauthorized absence from the duty without the approval of the controlling officer shall automatically lead to the termination of the contract. However, in exceptional cases where the circumstances for un-authorized absence from duty were beyond his/her control on medical grounds, such period shall not be excluded while considering his/her case for regularization but the incumbent shall have to intimate the controlling authority in this regard well in time. However, the contract appointee shall not be entitled for contractual amount for this period of absence from duty:

Provided that he/she shall submit the certificate of illness/fitness issued by the Medical Officer, as per prevailing instructions of the Government.

(e) An official appointed on contract basis shall be eligible for consideration for transfer after completion of three years of service on need based basis and against vacant posts or wherever required on administrative grounds.

(f) Selected candidate will have to submit a certificate of his/her fitness from a Government/Registered Medical Practitioner. Women candidate pregnant beyond 12 weeks will stand temporarily unfit till the confinement is over. The women candidate will be re-examined for the fitness from an authorized Medical Officer/ Practitioner.

(g) Contract appointee will be entitled to TA/DA if required to go on tour in connection with his/her official duties at the same rate as applicable to regular counterpart official at the minimum of pay scale.

8076 राजपत्र, हिमाचल प्रदेश, 04 मार्च, 2017/13 फाल्गुन, 1938 (h) Provisions of service rules like FR SR, Leave Rules, GPF Rules, Pension Rules & Conduct Rules etc. as are applicable in case of regular employees will not be applicable in case of contract appointees. The Employees Group Insurance Scheme as well as EPF/GPF will not be applicable to contract appointee(s).

16. Reservation—The appointment to the service shall be subject to the orders regarding reservation in the service for Scheduled Castes/Scheduled Tribes/Other Backward Classes/other categories of persons issued by the Himachal Pradesh Government from time to time.

17. Departmental Examination—Not Applicable

18. Power to Relax—Where the State Government is of the opinion that it is necessary or expedient to do so, it may, by order for reasons to be recorded in writing and in consultation with the Himachal Pradesh Public Service Commission relax any of the provision(s) of these Rules with respect to any class or category of person(s) or post(s).

ANNUEXURE- "B" FORM OF CONTRACT/AGREEMENT TO BE EXECUTED BETWEEN THE DRIVER AND THE GOVERNMENT OF HIMACHAL PRADESH THROUGH DIRECTOR, SAINIK WELFARE.

This agreement is made on this______________day of _________________in the year____________between Sh./Smt._____________________________S/o/D/o Shri ________________________R/o __________________________________ Contract appointee (hereinafter called the FIRST PARY), AND the Governor of Himachal Pradesh through Director Sainik Welfare H.P (here-in-after called the SECOND PARTY).

Whereas, the SECOND PARTY has engaged the aforesaid FIRST PARTY and the FIRST PARTY has agreed to serve as a Driver on contract basis on the following terms and conditions—

1. That the FIRST PARY shall remain in the service of the SECOND PARTY as a Driver for a period of one year commencing on day of ________________and ending on the day of ____________. It is specifically mentioned and agreed upon by both the parties that the contract of the FIRST PARTY with SECOND PARTY shall ipso-facto stand terminated on the last working day i.e on _______________ and information notice shall not be necessary:

Provided that for further extension/renewal of contract period on year to year basis the Director, Sainik Welfare H.P. shall issue a certificate that the service and conduct of the contract appointee is satisfactory during the year and only then his period of contract is to be renewed/extended.

2. The contractual amount of the FIRST PARTY will be ______/-per month.

3. The service of FIRST PARTY will be purely on temporary basis. The appointment is liable to be terminated in case the performance/conduct of the contract appointee is not found good.

4. Contractual Driver will be entitled for one day casual leave after putting one month service.
