संख्याः टीसीपी-ए (3)-1/2016-1.--हिमाचल प्रदेश के राज्यपाल, हिमाचल प्रदेश नगर और ग्राम योजना अधिनियम, 1977 (1977 का अधिनियम संख्यांक 12) की धारा 87 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, इस विभाग की अधिसूचना संख्याः टी.सी.पी.ए (3)-1/2014-1, तारीख 1 दिसम्बर, 2014 द्वारा 20-राजपत्र/2018-28-04-2018 (909) 910 राजपत्र, हिमाचल प्रदेश, 28 अप्रैल, 2018/08 वैशाख, 1940 अधिसूचित और तारीख 1 दिसम्बर, 2014 को राजपत्र (ई-गजट), हिमाचल प्रदेश में प्रकाशित हिमाचल प्रदेश नगर और ग्राम योजना नियम, 2014 का और संशोधन करने का प्रस्ताव करते हैं और इन्हें जनसाधारण की जानकारी के लिए राजपत्र (ई-गजट) हिमाचल प्रदेश में एतद्‌द्वारा प्रकाशित किया जाता है;

यदि इन प्रारूप नियमों द्वारा संभाव्य प्रभावित होने वाले व्यक्ति को इन प्रारूप नियमों की बावत कोई आक्षेप या सुझाव हैं तो वह उसे/उन्हें उक्त प्रारूप नियमों के राजपत्र (ई-गजट), हिमाचल प्रदेश में प्रकाशन की तारीख से तीस दिन की अवधि के भीतर अतिरिक्त मुख्य सचिव (नगर एवं ग्राम योजना) हिमाचल प्रदेश सरकार को भेज सकेगा;

उपरोक्त नियत अवधि के भीतर प्राप्त हुए आक्षेप (पों)/सुझाव (वों), यदि कोई हों, पर राज्य सरकार द्वारा इन प्रारूप नियमों को अंतिम रूप देने से पूर्व विचार किया जाएगा, अर्थात्‌ :-

1. संक्षिप्त नाम.--इन नियमों का संक्षिप्त नाम हिमाचल प्रदेश नगर और ग्राम योजना (तृतीय संशोधन) नियम, 2018 है।

2. नियम 16 का प्रतिस्थापन.--हिमाचल प्रदेश नगर एवं ग्राम योजना नियम, 2014 (जिन्हें इसमें इसके पश्चात्‌ 'उक्त नियम' कहा गया है) के नियम 16 के स्थान पर निम्नलिखित नियम रखा जाएगा, अर्थात :-

''(1) अधिनियम की धारा 15-क की उपधारा (2)धारा 16 के खण्ड (क) या धारा 30 की उपधारा (1) या धारा 30-क के अधीन यथाविनिर्दिष्ट सीमा से अधिक या धारा 78 त के अधीन किसी भूमि के विकास को कार्यान्वित करने का आशय रखने वाला कोई व्यक्ति ऐसे विकास हेतु आवेदन प्ररूप के साथ संलग्न विनिर्देश और क्षेत्र की अनुसूची के साथ प्ररूप-11 में भूमि के उप-खण्ड (सब डिविजन) हेतु और प्ररूप 12 में भवन के सन्निर्माण हेतु या तो व्यक्तिगत रूप से या ऑनलाईन आवेदन कर सकेगा :-

(2) अधिनियम की धारा 15 क की उपधारा (2) या धारा 16 के खण्ड (क) या धारा 30 की उपधारा (1) या धारा 30 क (धारा 30 क के अधीन यथाविनिर्दिष्ट सीमाओं से अधिक) या धारा 78 त के अधीन प्रस्तुत प्रत्येक आवेदन के साथ निम्न यथाविनिर्दिष्ट फीस संलग्न की जाएगी :--

टिप्पण.--(i) शहरी स्थानीय निकायों और विशेष क्षेत्र विकास प्राधिकरणों को उपरोक्त संघटकों के अधीन संशोधित एकात्मक फीस उपग्रहण करने की स्वतंत्रता होगी ।

(ii) गरीबी रेखा से नीचे (बी0पी0एल0) के परिवारों, समाज के आर्थिक रूप से कमजोर वर्गों और समय-समय पर सरकार द्वारा अधिसूचित सामाजिक आवास स्कीमों के 100 वर्गमीटर तक के प्लॉट क्षेत्र के आवेदकों से कोई फीस प्रभारित नहीं की जाएगी। यह प्रसुविधा किसी परिवार द्वारा केवल एक बार ही प्राप्त की जा सकेगी। तथापित, यदि प्लॉट क्षेत्र 100 वर्गमीटर से अधिक का है तो अतिरिक्त क्षेत्र पर फीस प्रभारित की जाएगी।

TOWN AND COUNTRY PLANNING DEPARTMENT

NOTIFICATION

Shimla-2, the 25th April, 2018

No. TCP-A(3)-1/2016-1.—In exercise of the powers conferred by section 87 of the Himachal Pradesh Town and Country Planning Act, 1977 (Act No. 12 of 1977), the Governor, Himachal Pradesh proposes to make the following rules to amend Himachal Pradesh Town and Country Planning Rules, 2014, notified vide this Department Notification No. TCP-A (3)-1/2014-I dated 1st December, 2014 and published in the Rajpatra (e-Gazette), Himachal Pradesh on 1st December, 2014, and the same are hereby published in the Rajpatra (e-Gazette), Himachal Pradesh for the information of the General Public;

If any person, likely to be affected by these draft rules has any objection(s) or suggestion(s) against these draft rules, he may send the same to the Additional Chief Secretary (TCP) to the Government of Himachal Pradesh, Shimla, within a period of thirty days from the date of publication of the said draft rules in the Rajpatra (e-Gazette), Himachal Pradesh;

The objections or suggestions, if any, received within the above stipulated period shall be taken into consideration by the State Government, before finalizing these draft rules, namely:—

1. Short title.—These rules may be called the Himachal Pradesh Town and Country planning (Third Amendment) Rules, 2018.

2. Substitution of rule 16.—For rule 16 of the Himachal Pradesh Town and Country Planning Rules, 2014 (hereinafter referred to as the 'said rules'), the following rule shall be substituted, namely:—

"(1) Any person, intending to carry out development of any land under sub-section (2) of section 15-A or clause (a) of section 16 or sub-section (1) of section 30 or section 30-A (beyond the limits as specified under section 30-A) or section 78p of the Act may apply for such development in Form-11 for sub-division of land and Form-12 for construction of building alongwith the Specification and Schedule of area attached with the application form either personally or online.

912 राजपत्र, हिमाचल प्रदेश, 28 अप्रैल, 2018/08 वैशाख, 1940 (2) Every application submitted under sub-section (2) of section 15-A or clause (a) of section 16 or sub-section (1) of section 30 or section 30-A (beyond the limits as specified under section 30-A) or section 78 p of the Act shall be accompanied by fee as specified below:—

Note.—(i) The Urban Local Bodies and Special Area Development Authorities shall have the liberty to levy amended unitary fee under above components.

(ii) No fee shall be charged from the Below Poverty Line (BPL) families, Economically Weaker Sections (EWS) of the society and from the applicants of Social Housing Schemes notified by the Government from time to time upto 100 M² plot area. This benefit may be availed by a family only once. However, if the plot area is above 100 M², the fee shall be charged on the additional area.

No. 11-1/85(Lab) ID/2014-Kangra.—Whereas Shri Dharam Chand s/o Shri Kikar Singh, r/o Village Dev Bharari, P.O. Sulyali, Tehsil Nurpur, District Kangra, H.P. had raised a demand notice dated 23-07-2011 regarding his illegal termination from the services by the Executive Engineer, H.P.P.W.D. Division, Jawali, District Kangra, H.P. The Labour Officer-cum-Conciliation Officer, Dharamshala, District Kangra, H.P. tried to settle the industrial dispute amicably, but the same could not be settled during the course of conciliation proceedings, where after he sent a report under Section 12(4) of the Industrial Disputes Act, 1947 to the Labour Commissioner, H.P.; And whereas the report sent by the Labour Officer-cum-Conciliation Officer, Dharamshala, District Kangra, H.P. was considered, examined and Deputy Labour Commissioner, H.P. as appropriate Government came to the conclusion that above worker had raised the dispute at a belated stage of after about 23 years and therefore declined the reference of the dispute vide order dated 13-11-2014;

And whereas Shri Dharam Chand S/O Shri Kikar Singh agitated the above orders of declining of reference before the Hon'ble High Court of Himachal Pradesh vide C.W.P. No. 250/ 2016. The Hon'ble High Court of Himachal Pradesh has disposed off the civil writ petition on 23-02-2016 and directed the respondents to consider the case of the petitioner, in terms of the 920 राजपत्र, हिमाचल प्रदेश, 28 अप्रैल, 2018/08 वैशाख, 1940 judgment, dated 30th December, 2014 delivered by Hon'ble High Court of H.P. in a batch of writ petitions, CWP No. 9467 of 2014 case titled Pratap Chand versus Himachal Pradesh State Electricity Board and others within eight weeks. The operative part of the judgment is reproduced as follows;

"3. In the given circumstances, we deem it proper to direct the respondents to consider

the cases of the petitioners, in terms of the judgment (supra), and make a decision

within eight weeks. The said judgment shall form part of this judgment also.

4. The writ petitions is disposed of accordingly, alongwith pending applications, if any."

Therefore, in view of above the undersigned while exercising the powers vested in me vide Himachal Pradesh Government Notification No. Shram(A)4-9/2006- IV-Loose, dated 15th February, 2014 and as per power vested under sub-section 1 of Section 10 of the Industrial Disputes Act, 1947 (14 of 1947) this industrial dispute is referred to the Labour Court-cum- Industrial Tribunal, Dharamshala, constituted under Section 7 of Act ibid, on the following issue/issues for legal adjudication;

"Whether alleged termination of services of Shri Dharam Chand s/o Shri Kikar Singh, r/o Village Dev Bharari, P.O. Sulyali, Tehsil Nurpur, District Kangra, H.P. during October, 1988 by the Executive Engineer, H.P.P.W.D. Division, Jawali, District Kangra, H.P., who had worked on daily wages as beldar and has raised his industrial dispute after nearly 23 years vide demand notice dated 23-07-2011, without complying the provisions of the Industrial Disputes Act, 1947, is legal and justified? If not, keeping in view of delay of nearly 23 years in raising the industrial dispute, what amount of back wages, seniority, past service benefits and compensation the above ex-worker is entitled to from the above employer/ management?"

No. 11-23/84(Lab) ID/2012-Mandi.—Whereas Smt. Guddi Devi w/o Shri Krishan Chand, r/o Village Putlipald, P.O. Mandap, Tehsil Sarkaghat, District Mandi, H.P. had submitted her demand notice dated 03-02-2009 regarding her illegal termination from the services by the Executive Engineer, H.P.P.W.D. Division, Dharampur, Tehsil Sarkaghat, District Mandi, H.P. The Labour Officer-cum-Conciliation Officer, Mandi, District Mandi, H.P. tried to settle the industrial dispute amicably, but the same could not be settled during the course of conciliation proceedings, where after he sent a report under Section 12(4) of the Industrial Disputes Act, 1947 to the Labour Commissioner, Himachal Pradesh;

And whereas the report sent by the Labour Officer-cum-Conciliation Officer, Mandi, District Mandi, H.P. was considered, examined and the Labour Commissioner, Himachal Pradesh vested with the powers of appropriate Government came to the conclusion that above worker had raised the industrial dispute at a belated stage after period of nearly 9 years from the date of her921 राजपत्र, हिमाचल प्रदेश, 28 अप्रैल, 2018/08 वैशाख, 1940 alleged illegal termination and therefore declined the reference of the dispute vide order dated 17-03-2012 for adjudication;

And whereas Smt. Guddi Devi w/o Shri Krishan Chand agitated the above orders of declining of reference for adjudication of her industrial dispute to the Ld. Labour Court before the Hon'ble High Court of Himachal Pradesh vide C.W.P. No. 2646/2013. The Hon'ble High Court of Himachal Pradesh has dismissed the civil writ petition on 18.06.2013. Thereafter, Smt. Guddi Devi w/o Shri Krishan Chand agitated the Judgment of the Hon'ble High Court dated 18.06.2013 before the Hon'ble Supreme Court of India vide Civil Appeal No. 18012-18013 of 2017 [Special Leave Petition (C) Nos. 30103-30104 of 2017]. The Hon'ble Supreme Court of India has decided the Civil Appeal (above) on 06-11-2017. The operative part of the judgment is reproduced as follows;

"5. Therefore, these appeals are allowed with a direction to respondent No.-1 that the

cases of the appellants shall also be considered for reference, ignoring the objection in

the matter of delay.

6. Needful be done within two months from the date of production of a copy of this

judgment."

Therefore, in view of above Judgment / directions of the Hon'ble Supreme Court of India, the undersigned while exercising the powers of appropriate Government vested in me vide Himachal Pradesh Government Notification No. Shram(A)4-9/2006-IV-Loose, dated 15th February, 2014 and as per power vested under sub-section 1 of Section 10 of the Industrial Disputes Act, 1947 (14 of 1947) make a reference to the Labour Court-cum-Industrial Tribunal, Dharamshala, constituted under Section 7 of Act ibid, on the following issue/issues for legal adjudication;

"Whether termination of the services of Smt. Guddi Devi w/o Shri Krishan Chand, r/o Village Putlipald, P.O. Mandap, Tehsil Sarkaghat, District Mandi, H.P. by the Executive Engineer, H.P.P.W.D. Division, Dharampur, Tehsil Sarkaghat, District Mandi, H.P. w.e.f. 01-06-2000 without complying with the provisions of the Industrial Disputes Act, 1947, is legal and justified? If not, what amount of back wages, seniority, past service benefits and amount of compensation the above aggrieved worker is entitled to from the above employer?"

No. 11-1/85(Lab) ID/2014-Kangra.—Whereas Shri Hoshiyar Singh s/o Shri Babu Ram, r/o Village Dev Bharari, P.O. Sulyali, Tehsil Nurpur, District Kangra, H.P. had raised a demand notice dated 23-07-2011 regarding his illegal termination from the services by the Executive Engineer, H.P.P.W.D. Division, Jawali, District Kangra, H.P. The Labour Officer-cum-Conciliation Officer, Dharamshala, District Kangra, H.P. tried to settle the industrial dispute amicably, but the same could not be settled during the course of conciliation proceedings, where after he sent a report under Section 12(4) of the Industrial Disputes Act, 1947 to the Labour Commissioner, H.P. ;

And whereas Shri Hoshiyar Singh s/o Shri Babu Ram agitated the above orders of declining of reference before the Hon'ble High Court of Himachal Pradesh vide C.W.P. No. 404/2016. The Hon'ble High Court of Himachal Pradesh has disposed of the civil writ petition on 01-03-2016 and directed the Labour Commissioner, H.P. to make reference to the Industrial Tribunal-cum-Labour Court within six weeks. The operative part of the judgment is reproduced as follows;

"3 In the given circumstances, we deem it proper to quash the impugned orders in the writ

petitions and direct the Labour Commissioner, H.P. to make reference to the Industrial

Tribunal-cum-Labour Court within six weeks from today. Ordered accordingly. The

writ petitions are disposed of, as indicated hereinabove, along with all pending

applications, if any."

Therefore, in view of above the undersigned while exercising the powers vested in me vide Himachal Pradesh Government Notification No. Shram(A)4-9/2006-IV-Loose, dated 15th February, 2014 and as per power vested under sub-section 1 of Section 10 of the Industrial Disputes Act, 1947 (14 of 1947) this industrial dispute is referred to the Labour Court-cum-Industrial Tribunal, Dharamshala, constituted under Section 7 of Act ibid, on the following issue/issues for legal adjudication;

"Whether alleged termination of services of Shri Hoshiyar Singh s/o Shri Babu Ram, r/o Village Dev Bharari, P.O. Sulyali, Tehsil Nurpur, District Kangra, H.P. during December, 1988 by the Executive Engineer, H.P.P.W.D. Division, Jawali, District Kangra, H.P., who had worked on daily wages as beldar and has raised his industrial dispute after about 23 years vide demand notice dated 23-07-2011, without complying the provisions of the Industrial Disputes Act, 1947, is legal and justified? If not, keeping in view of delay of after about 23 years in raising the industrial dispute, what amount of back wages, seniority, past service benefits and compensation the above ex-worker is entitled to from the above employer/ management?"

And whereas Shri Lekh Raj s/o Shri Prem Chand agitated the above orders of declining of reference before the Hon'ble High Court of Himachal Pradesh vide C.W.P. No. 400/ 2016. The Hon'ble High Court of Himachal Pradesh has disposed off the civil writ petition on 02-03-2016 and directed the respondents to consider the case of the petitioner, in terms of the judgment, dated 30th December, 2014 delivered by Hon'ble High Court of H.P. in a batch of writ petitions, CWP No. 9467 of 2014 case titled Pratap Chand Versus Himachal Pradesh State Electricity Board and others within eight weeks. The operative part of the judgment is reproduced as follows;

"3. In the given circumstances, we deem it proper to direct the respondents to consider the

cases of the petitioners, in terms of the judgment (supra), and make a decision within

eight weeks. The said judgment shall form part of this judgment also.

4. The writ petitions is disposed of accordingly, alongwith pending applications, if any."

Division, Dharampur, Tehsil Sarkaghat, District Mandi, H.P. The Labour Officer-cum- Conciliation Officer, Mandi, District Mandi, H. P. tried to settle the industrial dispute amicably, but the same could not be settled during the course of conciliation proceedings, where after he sent a report under Section 12(4) of the Industrial Disputes Act, 1947 to the Labour Commissioner, Himachal Pradesh;

And whereas the report sent by the Labour Officer-cum-Conciliation Officer, Mandi, District Mandi, H. P. was considered, examined and the Labour Commissioner, Himachal Pradesh vested with the powers of appropriate Government came to the conclusion that above worker had raised the industrial dispute at a belated stage after period of about 11years from the date of his alleged illegal termination and therefore declined the reference of the dispute vide order dated 16-03-2012 for adjudication;

And whereas Shri Pal Singh s/o Shri Hari Chand agitated the above orders of declining of reference for adjudication of his industrial dispute to the Ld. Labour Court before the Hon'ble High Court of Himachal Pradesh vide C.W.P. No. 2646/2013. The Hon'ble High Court of Himachal Pradesh has dismissed the civil writ petition on 18-06-2013. Thereafter, Shri Pal Singh s/o Shri Hari Chand agitated the Judgment of the Hon'ble High Court dated 18-06-2013 before the Hon'ble Supreme Court of India vide Civil Appeal No. 18012-18013 of 2017 [Special Leave Petition (C) Nos. 30103-30104 of 2017]. The Hon'ble Supreme Court of India has decided the Civil Appeal (above) on 06-11-2017. The operative part of the judgment is reproduced as follows;

"5. Therefore, these appeals are allowed with a direction to respondent No. 1 that the

cases of the appellants shall also be considered for reference, ignoring the objection in

the matter of delay.

6. Needful be done within two months from the date of production of a copy of this

judgment."

Therefore, in view of above Judgment /directions of the Hon'ble Supreme Court of India, the undersigned while exercising the powers of appropriate Government vested in me vide Himachal Pradesh Government Notification No. Shram(A)4-9/2006-IV-Loose, dated 15th February, 2014 and as per power vested under sub-section 1 of Section 10 of the Industrial Disputes Act, 1947 (14 of 1947) make a reference to the Labour Court-cum-Industrial Tribunal, Dharamshala, constituted under Section 7 of Act ibid, on the following issue/issues for legal adjudication;

"Whether termination of the services of Shri Pal Singh s/o Shri Hari Chand, r/o Village Thati, P.O. Kot, Tehsil Sarkaghat, District Mandi, H.P. by the Executive Engineer, H.P.P.W.D. Division, Dharampur, Tehsil Sarkaghat, District Mandi, H.P. from 01-09-1999 without complying with the provisions of the Industrial Disputes Act, 1947, is legal and justified? If not, what amount of back wages, seniority, past service benefits and amount of compensation the above aggrieved worker is entitled to from the above employer?"

संख्याः टी0सी0पी0-(बी)2-4/2010(रुल्ज)एस.टी.पी.--हिमाचल प्रदेश के राज्यपाल, भारत के संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, हिमाचल प्रदेश लोक सेवा आयोग के परामर्श से, हिमाचल प्रदेश नगर एवं ग्राम योजना विभाग में, राज्य नगर योजनाकार, वर्ग-I (राजपत्रित) के पद के लिए इस अधिसूचना से संलग्न उपाबन्ध-'क' के अनुसार भर्ती और प्रोन्नति नियम बनाते हैं, अर्थात्‌ः--

1. संक्षिप्त नाम और प्रारम्भ.--(1) इन नियमों का संक्षिप्त नाम हिमाचल प्रदेश नगर एवं ग्राम योजना विभाग, राज्य नगर योजनाकार, वर्ग-I (राजपत्रित), भर्ती और प्रोन्नति नियम, 2018 है।

(2) येे नियम राजपत्र (र्ई गजट), हिमाचल प्र्रदेेश मेेंं प्र्रकाशित किए जानेे की तारीख सेे प्र्रवृृत्त होेंंगेे।

2. निरसन और व्यावृत्तियां.--(1) इस विभाग की अधिसूचना संख्याः पीबीडब्ल्यू-I (3)-1/78 (टी0सी0पी0) तारीख 6 फरवरी, 1998 द्वारा अधिसूचित और समय- समय पर यथासंशोधित हिमाचल प्रदेश नगर एवं ग्राम योजना विभाग, राज्य नगर योजनाकार, (वर्ग-I, राजपत्रित) तकनीकी, भर्ती और प्रोन्नति नियम, 1998 का एतद्‌द्वारा निरसन किया जाता है।

(2) ऐेसेे निरसन केे होेतेे हुुए भी उपर्युुक्त उप-नियम 2 (1) केे अधीन इस प्र्रकार निरसित नियमोेंं केे अधीन की गर्ई कोेर्ई नियुुक्ति, बात या कार्रवार्ई इन नियमोेंं केे अधीन विधिमान्य रूप मेेंं की गर्ई समझी जाएगी।

5. चयन पद अथवा अचयन पद.--चयन।926 राजपत्र, हिमाचल प्रदेश, 28 अप्रैल, 2018/08 वैशाख, 1940 6. सीधी भर्ती के लिए आयु.--लागू नहीं। 7. सीधे भर्ती किए जाने वाले व्यक्ति (व्यक्तियों) के लिए अपेक्षित न्यूनतम शैक्षिक और अन्य अर्हताएं.--(क) अनिवार्य अर्हता (एं)ः--लागू नहीं।

8. सीधे भर्ती किए जाने वाले व्यक्ति (व्यक्तियों) के लिए विहित आयु और शैक्षिक अर्हताएं प्रोन्नत व्यक्ति (व्यक्तियों) की दशा में लागू होंगी या नहीं.--आयु :--लागू नहीं।

शैक्षिक अर्हताः--हां, जैसी नीचे स्तम्भ संख्या 11 में विहित है।

9. परिवीक्षा की अवधि, यदि कोई हो.--लागू नहीं।

10. भर्ती की पद्धति.-भर्ती, सीधी होगी या प्रोन्नति/सैकण्डमैंट/स्थानातरण द्वारा और विभिन्न पद्धतियों द्वारा भरे जाने वाले पद (पदों) की प्रतिशतता.--शत प्रतिशत प्रोन्नति द्वारा।

11. प्रोन्नति, सैकण्डमैंट, स्थानान्तरण की दशा में श्रेणियां, जिनसे प्रोन्नति/सैकण्डमैंट/स्थानान्तरण किया जाएगा.--उन नगर व ग्राम योजनाकारों में से प्रोन्नति द्वारा जो अरबन या सिटी या टाऊन या रीजनल या हाउसिंग या कन्ट्री या रुरल या इंफ्रास्ट्र्रकचर या ट्रांसपोर्ट या रूरल और अरबन या इन्वाइरन्मेन्टल प्लानिंग में मान्यता प्राप्त एम. टैक/एम. प्लानिंग/स्नातकोतर की उपाधि रखते हों या इंस्टीच्यूट ऑफ टाउन प्लानर से एआईटीपी और जिनका पांच वर्ष का नियमित सेवाकाल या गे्रड में की गई लगातार तदर्थ सेवा, यदि कोई हो, को सम्मिलित करके पांच वर्ष का नियमित सेवाकाल हो। (1) प्रोन्नति के सभी मामलों में, पद पर नियमित नियुक्ति से पूर्व सम्भरक (पोषक) पद में की गई लगातार तदर्थ सेवाएं यदि कोई हो, प्रोन्नति के लिए इन नियमों में यथाविहित सेवाकाल के लिए, इस शर्त के अधीन रहते हुए गणना में ली जाएगी, कि सम्भरक (पोषक) प्रवर्ग में तदर्थ नियुक्ति/प्रोन्नति, भर्ती और प्रोन्नति नियमों के उपबन्धों के अनुसार चयन की उचित स्वीकार्य प्रक्रिया को अपनाने के पश्चात्‌ की गई थीः परन्तु यह कि उन सभी मामलों में जिनमें कोई कनिष्ठ व्यक्ति सम्भरक (पोषक) पद में अपने कुल सेवाकाल (तदर्थ आधार पर की गई सेवा सहित, जो नियमित सेवा/नियुक्ति के अनुसरण में हो) के आधार पर उपर्युक्त निर्दिष्ट उपबन्धों के कारण विचार किए जाने का पात्र हो जाता है, वहां अपने-अपने प्रवर्ग/ पद/काडर में उससे वरिष्ठ सभी व्यक्ति विचार किए जाने के पात्र समझे जाएंगे और विचार करते समय कनिष्ठ व्यक्तियों से उपर रखे जाएंगेः

परन्तु उन सभी पदधारियों की जिन पर प्रोन्नति के लिए विचार किया जाना है, कम से कम तीन वर्ष की न्यूनतम अर्हता सेवा या पद के भर्ती और प्रोन्नति नियमों में विहित सेवाएं जो भी कम हो, होगी :

परन्तु यह और भी कि जहां कोई व्यक्ति पूर्वगामी परन्तुक की अपेक्षाओं के कारण प्रोन्नति किए जाने सम्बन्धी विचार के लिए अपात्र हो जाता है, वहां उससे कनिष्ठ व्यक्ति भी ऐसी प्रोन्नति के विचार के लिए अपात्र समझा जाएगा/समझे जाएंगे।

स्पष्टीकरण.--अन्तिम परन्तुक के अन्तर्गत कनिष्ठ पदधारी प्रोन्नति के लिए अपात्र नहीं समझा जाएगा/समझे जाएंगे यदि वरिष्ठ अपात्र व्यक्ति भूतपूर्व सैनिक है, जिसे डिमोबिलाइजड आर्मड फोर्सिस परसोनल (रिजर्वेशन आफ वेकेन्सीज इन हिमाचल स्टेट नान टैक्नीकल सर्विसिज) रुल्ज, 1972 के नियम 3 के उपबन्धों के अन्तर्गत भर्ती किया गया हो तथा इनके अन्तगर्त वरीयता लाभ दिए गए हों या जिसे एक्स सर्विसमैन (रिजर्वेशन आफ वेकेन्सीज इन दी हिमाचल प्रदेश टैक्नीकल सर्विसिज) रुल्ज, 1985 के नियम 3 के उपबन्धों के अन्तर्गत भर्ती किया गया हो तथा इनके अन्तर्गत वरीयता लाभ दिए गए हों।927 राजपत्र, हिमाचल प्रदेश, 28 अप्रैल, 2018/08 वैशाख, 1940 (2) इसी प्रकार स्थायीकरण के सभी मामलों में ऐसे पद पर नियमित नियुक्ति/प्रोन्नति से पूर्व सम्भरक (पोषक) पद पर की गई लगातार तदर्थ सेवाएं यदि कोई हो, सेवाकाल के लिए गणना में ली जाएगी, यदि तदर्थ नियुक्ति/प्रोन्नति, उचित चयन के पश्चात्‌ और भर्ती और प्रोन्नति नियमों के उपबन्धों के अनुसार की गई थीः

परन्तु की गई उपर्युक्त निर्दिष्ट तदर्थ सेवा को गणना मे लेने के पश्चात्‌ जो स्थायीकरण होगा, उसके फलस्वरूप पारस्परिक वरीयता अपरिवतिर्त रहेंगी।

12. यदि विभागीय प्रोन्नति/स्थायीकरण समिति विद्यमान हो, तो उसकी संरचना.--जैसी कि सरकार द्वारा समय-समय पर गठित की जाए।

13. भर्ती करने में जिन परिस्थितियों में हिमाचल प्रदेश लोक सेवा आयोग से परामर्श किया जाएगा.-- जैसा विधि द्वारा अपेक्षित हो।

14. सीधी भर्ती के लिए अनिवार्य अपेक्षा.-- लागू नहीं।

15. सीधी भर्ती द्वारा पद पर नियुक्ति के लिए चयन.-- लागू नहीं।

16. आरक्षण.--सेवा में नियुक्ति, हिमाचल प्रदेश सरकार द्वारा समय-समय पर अनुसूचित जातियों/अनुसूचित जनजातियों/अन्य पिछडे़ वर्गों और व्यक्तियों के अन्य प्रवर्ग के लिए सेवा में आरक्षण की बाबत जारी किए गए आदेशों के अधीन होगी।

17. विभागीय परीक्षा.--सेवा के प्रत्येक सदस्य को समय-समय पर यथा संशोधित हिमाचल प्रदेश विभागीय परीक्षा नियम, 1997 में यथा विहित विभागीय परीक्षा पास करनी होगी।

18. शिथिल करने की शक्ति.--जहां राज्य सरकार की यह राय हो कि ऐसा करना आवश्यक या समीचीन है, वहां वह, कारणों को लिखित में अभिलिखित करके और हिमाचल प्रदेश लोक सेवा आयोग के परामर्श से, आदेश द्वारा, इन नियमों के किन्हीं उपबन्ध (उपबन्धों) को किसी वर्ग या व्यक्ति (व्यक्तियों) के प्रवर्ग या पद (पदों) की बाबत, शिथिल कर सकेगी।

No. TCP-(B)2-4/2010(Rules)STP.—In exercise of the powers conferred by proviso to Article 309 of the Constitution of India, the Governor, Himachal Pradesh, in consultation with the Himachal Pradesh Public Service Commission, is pleased to make the Recruitment and Promotion Rules for the post of State Town Planner, Class-I (Gazetted) in the Department of Town & Country Planning, Himachal Pradesh, as per Annexure-"A" attached to this notification, namely :—

928 राजपत्र, हिमाचल प्रदेश, 28 अप्रैल, 2018/08 वैशाख, 1940 1. Short title and commencement.—(1) These rules may be called the Himachal Pradesh, Town & Country Planning Department, Town & Country Planner, Class-I (Gazetted), Recruitment and Promotion Rules, 2018.

(2) These rules shall come into force from the date of publication in the Rajpatra (e-Gazette), Himachal Pradesh.

2. Repeal & savings.—(1) The Himachal Pradesh, Town & Country Planning Department, State Town Planner, Class-I (Gazetted) (Technical) Recruitment and Promotion Rules, 1998 notified vide this Department's Notification number PBW-I(3)-1/78(TCP) dated 6-2-1998 as amended from time to time are hereby repealed.

(2) Notwithstanding such repeal, any appointment made or anything done or any action taken under the rules so repealed under sub-rule 2 (1) supra shall be deemed to have been validly made, done or taken under these rules.

(1) In all cases of promotion, the continuous adhoc service rendered in the feeder post, if any, prior to regular appointment to the post shall be taken into account towards the length of service as prescribed in these Rules for promotion subject to the condition that the adhoc appointment/promotion in the feeder category had been made after following proper acceptable process of selection in accordance with the provisions of R& P Rules:

Provided that in all cases where a junior person becomes eligible for consideration by virtue of his/her total length of service (including the service rendered on adhoc basis, followed by regular service/appointment) in the feeder post in view of the provision referred to above, all persons senior to him/ her in the respective category/ post/cadre shall be deemed to be eligible for consideration and placed above the junior person in the field of consideration:

Provided that all incumbents to be considered for promotion shall possess the minimum qualifying service of at least three years or that prescribed in the R&P Rules for the post, whichever is less:

Provided further that where a person becomes ineligible to be considered for promotion on account of the requirements of the preceding proviso, the person (s) junior to him/ her shall also be deemed to be ineligible for consideration for such promotion:

Explanation.—The last proviso shall not render the junior incumbent (s) ineligible for consideration for promotion if the senior ineligible person (s) happened to be Ex- Servicemen recruited under the provisions of Rule-3 of the Demobilized Armed Forces Personnel (Reservation of Vacancies in Himachal State Non-Technical Service) Rules, 1972 and having been given the benefit of seniority thereunder or recruited under the provisions of Rule-3 of the Ex-Serviceman (Reservation of Vacancies in the Himachal Pradesh Technical Service) Rules, 1985 and having been given the benefit of seniority thereunder.

(2) Similarly, in all cases of confirmation, continuous adhoc service rendered on the feeder post, if any, prior to the regular appointment/promotion against such post shall be taken into account towards the length of service, if the adhoc appointment/promotion had been made after proper selection and in accordance with the provision of the R&P Rules:—

Provided that inter-se seniority as a result of confirmation after taking into account, adhoc service rendered as referred to above shall remain unchanged.

12. If a Departmental Promotion/Confirmation Committee exists, what is its composition?.—As may be constituted by the Government from time to time.

13. Circumstances under which the HP Public Service Commission is to be consulted in making recruitment.—As required under the law.
