NOTIFICATION

Shimla-2, the 7th September, 2018

No. STE-E(3)-22/2018.—In compliance to the orders passed by Hon'ble National Green Tribunal on 07-08-2018 in the matter of Original Application No. 138 / 2016 and OA No. 139/2016, the Governor Himachal Pradesh is pleased to constitute the Special Task Forces (STFs) at State Level 127-राजपत्र/2018-17-09-2018 (4691)4692 राजपत्र, हिमाचल प्रदेश, 17 सितम्बर, 2018/26 भाद्रपद, 1940 and District Level for the purpose of identifying the persons responsible for discharging effluents beyond standards into tributaries of river Ghaggar leading to water pollution and thus violating the laws.

State Level Special Task Force

The State Level Special Task Force shall comprise of the following officers:

1. Chief Secretary to the Government of Himachal Pradesh

2. Addl. Chief Secretary (Environment, Sci. & Technology) Govt. of H.P.

3. Addl. Chief Secretary (Urban Development) Govt. of H.P.

4. Member Secretary, H.P. State Pollution Control Board. (He will be the Member Secretary of this State Level Special Task Force).

District Level Special Task Force

The District Level Special Task Force for Solan and Sirmoaur Districts shall comprise of the following officers:

1. The concerned Deputy Commissioner

2. Nominee of the concerned District & Sessions, Judge

3. The concerned Superintendent of Police

4. The Executive Officer of the Local bodies of concerned District

5. The Regional Officer, H. P. State Pollution Control Board of concerned District. (He will be the Member Secretary of the District Level Task Force).

The terms of reference of Special Task Forces shall be as under:—

The District Level Special Task Forces shall identify the persons responsible for discharging of industrial and municipal effluents causing water pollution in River Ghaggar and its tributaries and will submit a monthly Action Taken Report to the State Level Special Task Force. The State Level Special Task Force will furnish quarterly report or the Action Taken Report to the Central Pollution Control Board. Such reports shall also be uploaded on the websites of the State Pollution Control Board as well as the Department of Environment, Science & Technology.

No. 11-2/86(Lab)ID/2018/Bilaspur.—It appears to the undersigned that an industrial dispute exists between Shri Ranjeet Singh s/o Shri Amar Nath, r/o Village Kotlu, P. O. Jukhala, Tehsil Sadar, District Bilaspur, H. P. and Shri Durga Singh Thakur, Secretary, Kohinoor Sarv Hitkari Parivahan Sabha Samiti, V.P.O. Rani Kotla, Tehsil Sadar, District Mandi, H. P. on the issue of alleged termination of his services during March, 2017.

As per the report under section 12(4) of the Industrial Disputes Act, 1947 submitted by the Conciliation Officer, Bilaspur he tried his level best to settle the dispute during conciliation proceedings but could not succeed. The report so received has been considered by the undersigned and as per power vested under sub-section 5 of Section 12 of the Act ibid, the undersigned has formed an opinion and decided that this dispute is required to be legally adjudicated by the Labour Court/Industrial Tribunal.

Therefore, the undersigned while exercising the powers of appropriate Government vested in me vide Himachal Pradesh Government Notification No. Shram (A) 4-9/2006-IV-Loose, dated 15th February, 2014 and as per power vested under sub-section 1 of Section 10 of the Industrial Disputes Act, 1947 (14 of 1947) this industrial dispute is referred to the Labour Court/Industrial Tribunal Dharamshala, constituted under section 7 of Act ibid, on the following issue/issues for legal adjudication :—

"Whether termination of the services of Shri Ranjeet Singh s/o Shri Amar Nath, r/o Village Kotlu, P. O. Jukhala, Tehsil Sadar, District Bilaspur, H.
