No. PCH-HB(1)4/2016-P.Secy. 49613-733.—Whereas the draft Himachal Pradesh Panchayati Raj (Appointment and Conditions of Service of Panchayat Secretary in Zila Parishads) 131-राजपत्र/2019-18-09-2019 (5937)5938 राजपत्र, हिमाचल प्रदेश, 18 सितम्बर, 2019/27 भाद्रपद, 1941 Rules, 2019 were published in the Rajpatra, Himachal Pradesh dated 25th June, 2019 for inviting objections and suggestions from the general public, vide this department notification of even number dated 14th June, 2019 as required under section 186 of the Himachal Pradesh Panchayati Raj Act, 1994 (Act No. 4 of 1994);

And whereas, the objection(s)/suggestion(s) received during the stipulated period have been duly considered by the State Government.

Now, therefore, in exercise of the powers conferred by section 186 of the Himachal Pradesh Panchayati Raj Act, 1994 (Act No. 4 of 1994), the Governor of Himachal Pradesh is pleased to make the following rules, namely:—

1. Short title.—These rules may be called the Himachal Pradesh Panchayati Raj (Appointment and Conditions of Service of Panchayat Secretary in Zila Parishads) Rules, 2019.

2. Definitions.—(1) In these rules, unless the context otherwise requires,—

(a) "Act" means the Himachal Pradesh Panchayati Raj Act, 1994; and

(b) "Director" means the Director of Panchayati Raj, Himachal Pradesh ;

(c) "Form" means a Form appended to these Rules.

(2) The words and expressions used but not defined in these Rules shall have the same meaning as respectively assigned to them in the Act.

3. Number of Posts.—There shall be such number of posts of Panchayat Secretary as sanctioned and may be sanctioned by the State Government from time to time in the respective Zila Parishads.

4. Scale of Pay.—The scale of pay for the post of Panchayat Secretary shall be as under:—

(a) Pay band for regular appointees.—PB-Rs. 5910—20200 + 1900 Grade Pay; and after two years 10300—34800+3200 grade pay.

(b) Emoluments for contractual appointees.—5910+1900 GP =7810/- per month.

5. Type of post (whether selection or non- selection post.).—Not applicable 6. Age for direct appointment.—A person to be appointed as Panchayat Secretary shall be eligible if he is having the age between 18 and 45 years:

Provided that the upper age limit for direct recruits will not be applicable to the candidates already in service of the Government including those who have been appointed on adhoc or on contract basis;

Provided further that if a candidate appointed on adhoc basis had become overage on the date when he was appointed as such he shall not be eligible for any relaxation in the prescribed age limit by virtue of his such adhoc or contract appointment:

Provided further that upper age limit is relaxable for Scheduled Castes/Scheduled Tribes/5939 राजपत्र, हिमाचल प्रदेश, 18 सितम्बर, 2019/27 भाद्रपद, 1941 Other Categories of persons to the extent permissible under the General or Special Order (s) of the State Government:

Provided further that the employees of all the Public Sector Corporations and Autonomous Bodies who happened to be Government Servant before absorption in Public Sector Corporations/Autonomous Bodies at the time of initial constitution of such corporations/ Autonomous Bodies shall be allowed age concession in direct recruitment as admissible to Government servants. This concession will not, however, be admissible to such staff of the Public Sector Corporations/Autonomous Bodies who were/are subsequently appointed by such Corporation/Autonomous Bodies and who are/were finally absorbed in the service of such Corporations/Autonomous Bodies after initial constitution of the Public Sector Corporations/Autonomous Bodies.

(1) Age limit for direct recruitment will be reckoned on the first day of the year in which the Post(s) is/are advertised for inviting applications or notified to the Employment Exchanges, as the case may be.

(2) Age and experience, in the case of direct appointment, are relaxable at the discretion of the State Government in case the candidate is otherwise well qualified.

7. Minimum educational qualifications required for direct appointment.—1. (i) Bachelor's Degree or its equivalent, from any recognized Institution approved by the H.P. Government/University/Board, the candidate(s) should possess a minimum speed of 30 words per minute in English Type-writing or 25 words per minute in Hindi Type-writing on Computer.

(ii) MBA in Rural Development from H. P. University, the candidate(s) should possess a minimum speed of 30 words per minute in English Type-writing or 25 words per minute in Hindi Type-writing on Computer. In case of non-qualifying of the required no. of candidates under this clause, the post will be filled up from general category.

(iii) Should have the knowledge of "Word Processing" in Computer as prescribed by the Recruiting Authority.

(2) Preference shall be given to those candidates who have knowledge of customs, manners and dialect of Himachal Pradesh and suitability for appointment in the peculiar condition prevailing in the Pradesh.

8. Whether age and educational Qualifications prescribed for direct recruits will

apply in the case of other appointee(s).—Age.—Not Applicable

Educational Qualification.—Not applicable.

9. Period of Probation.—The regular appointee shall remain under probation for a period of two years subject to such further extension for a period not exceeding one year, as may be ordered by the Secretary Zila Parishad in special circumstances and reasons thereof to be recorded in writing.

10. Method(s) of appointment and percentage of post(s) to be filled in by various method(s).—(i) 77% by way of direct recruitment on regular basis or on contract basis, as the case may be.

(ii) 03% by way of direct recruitment on regular basis or on contract basis, as the case may be, from amongst the M.B.A in Rural Development from Himachal Pradesh University.

11. Essential requirement for direct/contract appointment.—The candidate to be appointed as Panchayat Secretary should be bonafide resident of Himachal Pradesh.

12. In case of recruitment by lateral entry(ies).—20% Tailoring Teacher appointed in Gram Panchayats having 10 years service, passed minimum 10+2 examination from a recognized Board approved by the Himachal Pradesh Government and should have knowledge of word processing and working on various software being implemented at GP level. Due to dying cadre of Tailoring Teacher their recruitment will be done on the basis of minimum required qualification and then 20% quota reserved for them will be given to direct recruitment on regular basis or on contract basis, as the case may be.

13. Selection for appointment.—The selection to the post in case of direct or contractual appointment, as the case may be, shall be made on the basis of criteria fixed by Government from time to time or Himachal Pradesh Staff Selection Commission Hamirpur or other recruiting Authority, as the case may be, so consider necessary or expedient by a written test or practical test, the standard/syllabus etc. of which, will be determined by the Commission/other recruiting authority or by the State Government, as the case may be.

14. National Pension Scheme.—The regular Panchayat Secretary under the Zila Parishad Cadre shall be entitled for availing the facility of National Pension Scheme (NPS) as may be notified by the State Government.

15. Conditions of Service for regular appointees.—The other conditions of service in the case of regular appointees shall apply mutatis mutandis as are applicable in the case of State Government employee equivalent to the category.

16. Selection for appointment to the post by Contract Appointment.—Notwithstanding anything contained in these rules, contract appointments to the post will be made subject to the Terms and Conditions given below:—

(I) CONCEPT.—(a) Under this policy the Panchayat Secretary in Zila Parishad will be engaged on contract basis initially for one year, which may be extendable on year to year basis:

Provided that for extension/renewal of contract period on year to year basis, the Chief Executive Officer Panchayat Samiti shall issue a certificate that the service and conduct of the contract appointee is satisfactory during the year and only then his period of contract is to be renewed/ extended by appointing authority.

(II) POST SHALL BE IN THE PURVIEW OF HPSSC, HAMIRPUR AND OTHER RECRUITING AGENCY TO BE DECIDED BY THE GOVERNMENT.—The Secretary Zila Parishad after obtaining the approval of the Government to fill up the vacant posts on contract basis shall send requisition to the Himachal Pradesh Staff Selection Commission Hamirpur or any other recruiting agency, as the case may be, to be decided by the Govt. for appointment/selection.

(c) The selection shall be made in accordance with the eligibility conditions specified in these rules.

(III) CONTRACTUAL EMOLUMENTS.—The Panchayat Secretary appointed on contract basis will be paid consolidated fixed contractual amount @ 7810/- P.M. (which shall be5941 राजपत्र, हिमाचल प्रदेश, 18 सितम्बर, 2019/27 भाद्रपद, 1941 equal to minimum of the pay band+ Grade pay). 3% of the minimum of pay band + grade pay of the post as annual increase in contractual emoluments for the subsequent years(s) will be allowed if contract is extended beyond one year.

(IV) APPOINTING/DISCIPLINARY AUTHORITY.—The Chief Executive Officer of the concerned Zila Parishad will be the appointing and disciplinary authority but for day to day control i.e with respect to attendance, tour programme, sanction of leave up to 15 days, work and conduct in respect of contractual and Reviewing Authority of ACR in respect of regular Panchayat Secretary of Zila Parishad Cadre, shall be Chief Executive Officer Panchayat Samiti and the Panchayat Secretary shall also work under the overall supervision of Chief Executive Officers of Panchayat Samiti. Secretary ZP shall be head of office for Panchayat Secretary.

(V) SELECTION PROCESS:—Selection for appointment to the post in the case of Contract Appointment will be made by the Himachal Pradesh Staff Selection Commission, Hamirpur or other recruiting agency, as the case may be, on the basis of criteria fixed by Government or if so considered necessary or expedient by a written test or practical test the standard/syllabus etc. of which will be determined by the Commission or by the State Government, as the case may be.

(VI) APPOINTMENT AND AGREEMENT.—After appointment of a candidate, he/she shall sign an Agreement as per Form-II appended to these rules.

(VII) TERMS AND CONDITIONS.—(a) The contractual appointee will be paid fixed contractual amount @ Rs. 7810/- P.M. (which shall be equal to minimum of the pay band+ grade pay). The contractual appointee will be entitled for increase in contractual amount i.e. 3% of minimum of the pay band+ grade pay of the post for further extended year(s) and no other allied benefits such as senior/selection scales etc. will be given.

(b) The service of the Contract Appointee will be purely on temporary basis. The appointment is liable to be terminated in case the performance/conduct of the contract appointee is not found satisfactory.

(c) Contract Appointee will be entitled for one day causal leave after putting one month service. This leave can be accumulated up to one year. No leave of any other kind is admissible to the contract appointee. He/She shall not be entitled for Medial Re-imbursement and LTC etc., only maternity leave will be given as per rules.

(d) Unauthorized absence from the duty without the approval of the Chief Executive Officer Panchayat Samiti or appointing authority as the case may be, shall automatically lead to the termination of the contract. Contract Appointee shall not be entitled for contractual amount for the period of absence from duty.

(e) An official appointed on contract basis who has completed three years tenure at one place of positing will be eligible for transfer on need basis within the respective Zila Parishad on administrative ground.

(f) Selected candidate will have to submit a certificate of his/her fitness from a Government/Registered Medical Practitioner. Woman candidate pregnant beyond 12 weeks will stand temporarily unfit till the confinement is over. The woman candidate will be re-examined for the fitness from an authorized Medical Officer/Practitioner.

(g) Contract Appointee will be entitled to TA/DA if required to go on tour in connection5942 राजपत्र, हिमाचल प्रदेश, 18 सितम्बर, 2019/27 भाद्रपद, 1941 with his/her official duties at the same rate as applicable to regular counter-part official at the minimum of pay scale.

(h) Provisions of service rules like FR/SR Leave Rules, GPF Rules, Pension Rules and Conduct rules etc. as are applicable in case of regular employees will not be applicable in case of contract appointees. They will be entitled for emoluments etc. as detailed in this Column.

17. Appointing Authority and allocation of Panchayats.—The Chief Executive Officer of concerned Zila Prishad shall be the appointing authority and letter of appointment shall be issued by the Chief Executive Officer Zila Parishad, who shall depute the Panchayat Secretary in a Panchayat Samiti within the district and also allocate the Gram Panchayats to a Panchayat Secretary.

18. Seniority of Panchayat Secretary.—The seniority of the regular Panchayat Secretary shall be determined from the date of joining prepared at district level and consolidated and maintained at Directorate Level for the Panchayat Secretary who had initially been appointed as Panchayat Sahayak. Director may frame other rational guidelines for determining the seniority. However, the seniority of candidates appointed through Board/Commission shall be maintained on the basis of merit, so devised by the Board/Commission.

19. Reservation.—The appointment to the service shall be subject to orders regarding reservation in the service for Scheduled Castes/Scheduled Tribes/Backward Classes/Other Categories of persons issued by the Himachal Pradesh Government from time to time.

20. Job Chart.—The job chart for the Panchayat Secretary shall be such as may be specified by the Director from time to time.

21. Training and Examination.—The members of the service shall have to qualify examination or to undergo such courses for training to be specified by the Director, from time to time:

Provided that three chances shall be provided to qualify such examination within five years and in the event of not qualifying the examination by the concerned employee, the increment of such employee shall be liable to be stopped without cumulative effect.

22. Power to relax.—Where the State Government is of the opinion that it is necessary or expedient to do so, it may, by order for reasons to be recorded in writing, relax any of the provisions(s) of these rules with respect to any class or category of person (s) or post (s). 23. Repeal and Savings.—(1) On and from the date of commencement of these rules, the Himachal Pradesh Panchayati Raj (Appointment and Conditions of Service of Panchayat Sahayaks in Zila Parishads) Rules, 2014 published vide notification No. PCH-HA(1)11/2010-I-6674-6815, dated 16-07-2014 shall stand repealed.

(2) Notwithstanding such repeal, any appointment made or anything done or any action taken, under the rules so repealed, shall be deemed to have been validly made, done or taken under these rules.

5. That the antecedent verification certificate to the satisfaction of the Panchayat from the Executive Magistrate or two Gazetted Officers known to him at least for the last three years shall be given by him at the time of submission of joining report;

6. That the appointment shall be subject to the production of Certificate of Medical Fitness issued by the Chief Medical Officer of the concerned district before joining to the post; and

7. That the attested copies of original certificates in respect of educational qualifications, caste, bonafide resident, physically handicapped, member belonging to below poverty line or past experience, as the case may be, shall be submitted along with joining report.

In case, the above terms and conditions are acceptable to him, he/she may report for execution of the contract agreement as well as for joining duty in the office of undersigned immediately but not later than fifteen days from the date of issue of this appointment letter.

AGREEMENT

Form of contract/agreement to be executed between the Panchayat Secretary and

Chief Executive Officer Zila Parishad _______________________________ (Designation of

This agreement is made on this ____________________ day of ______________________ in the year______________________________ between Sh./Smt. __________________________ s/o/d/o/w/o Shri__________________________________________________________________, r/o ___________________________________________________________ Contract appointee (hereinafter called the FIRST PARY), AND the Zila Parishad __________________ through its Secretary Zila Parishad (hereinafter referred to as the SECOND PARTY).

Whereas, the SECOND PARTY has engaged the aforesaid FIRST PARTY and the FIRST PARTY has agreed to serve as a Panchayat Secretary on contract basis on the following terms and conditions:—

1. That the FIRST PARTY shall remain in the service of the SECOND PARTY as a Panchayat Secretary for a period of 1 (one) year commencing on day of___________ and ending on the day of_________________________ It is specifically mentioned and agreed upon by both the parties that the contract of the FIRST PARTY with SECOND PARTY shall ipso-facto stand terminated on the last working day i.e. on__________________and information notice shall not be necessary:

Provided that for further extension/renewal of contract period the Chief Executive Officer Panchayat Samiti shall issue a certificate that the service and conduct of the contract appointee was satisfactory during the year and only then the period of contract is to be renewed/extended.

2. The contractual amount of the FIRST PARTY will be Rs.7810/- per month.

3. The service of FIRST PARTY will be purely on temporary basis. The appointment is liable to be terminated in case the performance/conduct of the contract appointee is not found good or if a regular incumbent is appointed/posted against the vacancy for which the FIRST PARTY was engaged on contract.

4. Contractual Panchayat Secretary will be entitled for one day casual leave after putting in one month service. This leave can be accumulated upto one year. No leave of any kind is admissible to the contractual Panchayat Secretary. He will not be entitled for Medical Reimbursement and LTC etc. Only Maternity Leave will be given as per rules.

5. Unauthorized absence from the duty without the approval of the Controlling Officer shall automatically lead to the termination of the contract. A contractual Panchayat Secretary Zila Parishad will not be entitled for contractual amount for the period of absence from duty.

6. An official appointed on contract basis who has completed three years tenure at one place of posting shall be eligible for transfer on need based basis within the concerned Zila Prishad on administrative grounds.

7. Selected candidate will have to submit a certificate of his/her fitness from a Government/Registered Medical Practitioner. In case of women candidates pregnant beyond twelve weeks will render her temporarily unfit till the confinement is over. The5945 राजपत्र, हिमाचल प्रदेश, 18 सितम्बर, 2019/27 भाद्रपद, 1941 woman candidate shall be re-examined for fitness from an authorized Medical Officer/ Practitioner.

8. Contract appointee shall be entitled to TA/DA if required to go on tour in connection with his/her official duties at the same rate as applicable to regular counter-part official at the minimum of pay scale.

संख्या एएचबाई-ए(3)8/2010.--हिमाचल प्रदेश के राज्यपाल, भारत के संविधान के अनुच्छेद 309 के परंतुक द्वारा प्रदा शक्तियों का प्रयोग करते हुए, हिमाचल प्रदेश लोक सेवा आयोग के परामर्श से, हिमाचल प्रदेश पशुपालन विभाग में मुख्य पशु औषधियोजक, वर्ग-III (अराजपत्रित) के पद के लिए इस अधिसूचना से संलग्न उपाबन्ध-'क' के अनुसार भर्ती और प्रोन्नति नियम बनाते हैं, अर्थात.--

1. संक्षिप्त नाम और प्रारंभ.--(1) इन नियमों का संक्षिपत नाम हिमाचल प्रदेश पशुपालन विभाग, मुख्य पशु औषधियोजक, वर्ग-III (अराजपत्रित) भर्ती और प्रोन्नति नियम, 2019 है।

(2) यह नियम राजपत्र (ई-गजट), हिमाचल प्रदेश में प्रकाशन की तारीख से प्रवृा होंगे। 2. निरसन और व्यवृाियां.-- (1) इस विभाग की अधिसूचना संख्याः एएचवाई-ए(3)8/2010 तारीख 19-08-2010 द्वारा अधिसूचित हिमाचल प्रदेश, पशुपालन विभाग, मुख्य पशु औषधियोजक वर्ग-III (अराजपत्रित), भर्ती और प्रोन्नति नियम, 2010 का एतदद्वारा निरसन किया जाता है।

परन्तु यह और कि दूरस्थ/ग्रामीण क्षेत्रों में तैनाती/स्थानान्तरण के सिवाए उपर्युक्त परंतुक (I) उन कर्मचारियों के मामले में लागू नहीं होगा, जिनकी अधिवर्षिता के लिए पांच वर्ष या उससे कम की सेवा शेष रही हो। तथापि पांच वर्ष की यह शर्त प्रोन्नति के मामलों में लागू नहीं होगी :

परन्तु यह और भी कि उन अधिकारियों/कर्मचारियों को, जिन्होंने जनजातीय/कठिन/दुर्गम क्षेत्रों और दूरस्थ/ग्रामीण क्षेत्रों में कम से कम एक कार्यकाल तक सेवा नहीं की है, ऐसे क्षेत्र में उसके अपने संवर्ग (काडर) में सर्वथा वरिष्टमा के अनुसार स्थानान्तरण किया जाएगा।

स्पष्टीकरण I.--उपर्युक्त परंतुक (I) के प्रयोजन के लिए जानजातीय/कठिन/दुर्गम क्षेत्रों/दूरस्थ/ग्रामीण क्षेत्रों में ''कार्यकाल'' से साधारणतया तीन वर्ष कि अवधि या प्रशासनिक अत्यावश्यकताओं/सुविधा को ध्यान में रखते हुए, ऐसे क्षेत्रों में तैनाती की इससे कम अवधि अभिप्रेत होगी।

स्पष्टीकरण II.--उपर्युक्त परंतुक (I) के प्रयोजन के लिए जनजातीय/कठिन/दुर्गम/दूरस्थ/ग्रामीण क्षेत्र निम्न प्रकार से होंगे :-

1. जिला लाहौल एवं स्पिति 2. चंबा जिला का पांगी और भरमौर उप-मंडल 5948 राजपत्र, हिमाचल प्रदेश, 18 सितम्बर, 2019/27 भाद्रपद, 1941 3. रोहड़ू उप-मंडल का डोडरा क्वार क्षेत्र 4. जिला शिमला की रामपुर तहसील का पंद्रह बीस परगना, मुनीश, दरकाली और ग्राम पंचायत काशापाट।

5. कुल्लू जिला का प्रद्रह बीस परगना 6. कांगड़ा जिला के बैजनाथ उप-मंडल का बड़ा भंगाल क्षेत्र 7. जिला किन्नौर 8. सिरमौर जिला में उप-तहसील कमरउ के काठवाड़ और कोरगा पटवार वृा, रेणुकाजी तहसील के भलाड़-भलौना और सांगना पटवार वृा और शिलाई तहसील का कोटा पाब पटवार वृा। 9. मंडी जिला में करसोग तहसील का खान्योल-बगड़ा पटवार वृा, बाली चौकी उप-तहसील के गाड़ा गुसैणी, मठियानी, घनयाड, थाची, बागी, सोमगड और खोलानाल पटवार वृा पधर, तहसील के झारवाड, कुटगढ़, ग्रामन, देवगढ़, ट्राईला, रोपा, कथोग, सिलह भडवानी, हस्तपुर, घमरेहर और भटेड़ पटवार वृा, थुनाग तहसील में चिउणी, कालीपर, मानगढ़, थाच-बागड़ा, उारी मगरू और दक्षिणी मगरू पटवार वृा और सुंदरनगर, तहसील का बटवाडा पटवार वृा।

स्पष्टीकरण III.--उपर्युक्त परंतुक (I) के प्रयोजन के लिए दूरस्थ/ग्रामीण क्षेत्र निम्न प्रकार से होंगे :-

(I) उप मण्डल/तहसील मुख्यालय से 20 किलोमीटर की परिधि से परे के समस्त स्थान (II) राज्य मुख्यालय और जिला मुख्यालय से 15 किलोमीटर की परिधि से परे के समस्त स्थान जहां के लिए बस सेवा उपलब्ध नहीं है और 3 (तीन) किलोमीटर से अधिक की पैदल यात्रा करनी पड़ती है।

(III) कर्मचारी का, उसके प्रवर्ग को ध्यान में लाये बिना, अपने गृहनगर या गृह नगर क्षेत्र के साथ लगता 20 किलोमीटर की परिधि के भीतर का क्षेत्र।

(II) स्थानन के सभी मामलों में पद पर नियमित नियुक्ति से पूर्व सम्भारक (पोषक) पद पर की गयी लगातार तदर्थ सेवा, यदि कोई हो, इन नियमों में यथाविहित सेवाकाल के लिए, इस शर्त के अध्यधीन स्थानन के लिए गणना में ली जाएगी, कि सम्भरक (पोषक) प्रवर्ग में तदर्थ नियुक्ति/स्थानन भर्ती और प्रोन्नति नियमों के उपबन्धों के अनुसार चयन की उचित स्वीकार्य प्रक्रिया को अपनाने के पश्चात्‌ की गयी थी;

(I) परन्तु उन सभी मामलों में जिनमें कोई कनिष्ठ व्यक्ति सम्भरक (पोषक) पद में अपने कुल सेवाकाल (तदर्थ आधार पर की गयी सेवा सहित, जो नियमित सेवा/नियुक्ति के अनुसरण में हो) के आधार पर उपर्युक्त निर्दिष्ट उपबन्धों के कारण विचार किये जाने का पात्र हो जाता है, वहां उससे वरिष्ठ सभी व्यक्ति अपने-अपने प्रवर्ग/पद/काडर में विचार किये जाने के पात्र समझे जायेंगे और विचार करते समय कन्ष्ठि व्यक्ति से ऊपर रखे जायेंगे;

परन्तु यह और कि उन सभी पदधारियों की, जिन पर स्थानन के लिए विचार किया जाना है, की कम से कम तीन वर्ष की न्यूनतम अहर्ता सेवा या पद के भर्ती और प्रोन्नति नियमों में विहित सेवा, जो भी कम हो, होगी :

परन्तु यह और भी कि जहां कोई व्यक्ति पूर्वगामी परंतुक कि अपेक्षाओं के कारण स्थानन किये जाने सम्बन्धी विचार के लिए अपात्र हो जाता है, वहां उससे कनिष्ठ व्यक्ति भी ऐसे स्थानन के विचार के लिए अपात्र समझा जाएगा/समझे जायेंगे।

स्पष्टीकरण.--अन्तिम परन्तुक के अन्तर्गत कनिष्ठ पदधारी स्थानन के लिए अपात्र नहीं समझा जाएगा यदि वरिष्ठ अपात्र व्यक्ति भूतपूर्व सैनिक है, जो आपातकाल अवधि के दौरान सशस्त्र बल में शामिल हुए हैं और जिसे डिमोबिलाइज़ड आर्मड फोर्सिस परसोनल (रिजर्वेशन ऑफ वेकेन्सीज इन हिमाचल स्टेट नॉन टैक्नीकल सर्विसीज) रुल्ज, 1972 के नियम 3 के उपबन्धों के अन्तर्गत भर्ती किया गया है और तद्‌धीन इनके अंतर्गत वरीयता लाभ दिए गए हों या जिसे5949 राजपत्र, हिमाचल प्रदेश, 18 सितम्बर, 2019/27 भाद्रपद, 1941 एक्स सर्विसमैन (रिजर्वेशन ऑफ वेकेन्सीज इन दी हिमाचल प्रदेश टैक्नीकल सर्विसीज) रुल्ज, 1985 के नियम 3 के उपबन्धों के अंतर्गत भर्ती किया गया हो और तद्‌धीन वरीयता लाभ दिए गए हों।

(II) इसी प्रकार स्थायीकरण के सभी मामलाें में ऐसेे पद पर नियमित नियुक्ति/स्थानन से पूर्व सम्भरक (पोषक) पद पर की गई लगातार तदर्थ सेवा, यदि कोई हो, सेवाकाल के लिए गणना मे ली जाएगी, यदि तदर्थ नियुक्ति/स्थानन उचित चयन के पश्चात्‌ और भर्ती और प्रोन्नति नियमों के उपबन्धों के अनुसार की गई थीः

परन्तु की गई उपर्युक्त निर्दिष्ट तदर्थ सेवा को गणना मे लेने के पश्चात्‌ जो स्थायीकरण होगा उसके फलस्वरूप पारस्परिक वरीयता अपरिवर्तित रहेगी।

12. यदि विभागीय प्रोन्नति/स्थायीकरण समिति विद्यमान हो तो उसकी संरचना.--जैसी सरकार द्वारा समय-समय पर गठित की जाए।

13. भर्ती करने में जिन परिस्थितियों में हिमाचल प्रदेश लोक सेवा आयोग से परामर्श किया जाएगा.--जैसा विधि द्वारा अपेक्षित हो ।

14. सीधी भर्ती के लिए अनिवार्य अपेक्षा.--किसी सेवा या पद पर नियुक्ति के लिए अभ्यर्थी का भारत का नागरिक होना अनिवार्य है।

15. सीधी भर्ती द्वारा पद पर नियुक्ति के लिए चयन.--लागू नहीं।

16. आरक्षण.--सेवा में नियुक्ति, हिमाचल प्रदेश सरकार द्वारा, समय-समय पर अनुसूचित जातियों/अनुसूचित जनजातियों/अन्य पिछड़े वर्गों और व्यक्तियाें के अन्य प्रवर्गाें के लिए सेवा में आरक्षण की बाबत जारी किए गए आदेशाें के अधीन होगी।

17. विभागीय परीक्षा.--लागू नहीं।

18. शिथिल करने की शक्ति.--जहां राज्य सरकार की यह राय हो कि ऐसा करना आवश्यक या समीचीन है, वहां वह, कारणाें को लिखित में अभिलिखित करके और हिमाचल प्रदेश लोक सेवा आयोग के परामर्श से, आदेश द्वारा, इन नियमों के किसी/किन्हीं उपबन्ध (उपबन्धों) को किसी वर्ग या व्यक्ति (व्यक्तियों) के प्रवर्ग या पद (पदोंं) की बाबत, शिथिल कर सकेगी।

Shimla-2, the 5th September, 2019

No. AHY- A(3)08/2010.—In exercise of the powers conferred by proviso to Article 309 of the Constitution of India, the Governor, Himachal Pradesh, in consultation with the Himachal Pradesh Public Service Commission, is pleased to make the Recruitment and Promotion Rules for5950 राजपत्र, हिमाचल प्रदेश, 18 सितम्बर, 2019/27 भाद्रपद, 1941 the post of Chief Veterinary Pharmacist, Class-III (Non-Gazetted), in the Department of Animal Husbandry, Himachal Pradesh, as per Annexure-"A" attached to this notification, namely:-—

1. Short title and commencement.—(1) These rules may be called the Himachal Pradesh Animal Husbandry Department, Chief Veterinary Pharmacist, Class-III (Non-Gazetted), Recruitment and Promotion Rules, 2019.

(2) These rules shall come into force from the date of publication in the Rajpatra (e-Gazette), Himachal Pradesh.

2. Repeal & savings.—(1) The Himachal Pradesh Animal Husbandry Department, Chief Veterinary Pharmacist, Class-III (Non-Gazetted) Recruitment and Promotion Rules, 2010 notified vide this Department Notification No. AHY-A(3)08/2010 dated 19-08-2010 are hereby repealed.

(2) Notwithstanding such repeal, any appointment made or anything done or any action taken under the relevant rules so repealed under sub-rule (1) supra shall deemed to have been validly made, done or taken under these Rules.

Provided further that the proviso (I) supra shall not be applicable in the case of those employees who have five years or less service, left for superannuation, except posting/transfer in remote/rural area. However, this condition of five years shall not be applicable in cases of promotion:

Provided further that Officers/Officials who have not served atleast one tenure inm Tribal/Difficult/Hard areas and remote/rural areas shall be transferred to such area strictly in accordance with his/her seniority in the respective cadre.

Explanation-I.—For the purpose of proviso (I) supra the "term" in Tribal/Difficult/Hard areas/remote/ rural areas shall mean normally three years or less period of posting in such areas keeping in view the administrative exigencies/convenience.

Explanation-II.—For the purpose of proviso (I) supra the Tribal/Difficult Areas shall be as under:—

Explanation III.—For the purpose of proviso (I) supra the Remote/Rural Areas shall be as under:

1. All Stations beyond the radius of 20 kms. from Sub-Division/ Tehsil Headquarter.

2. All stations beyond the radius of 15 kms. from State Headquarter and District Head- quarters where bus service is not available and on foot journey is more than 3 (three) kms.

3. Home town or area adjoining to area of home town within the radius of 20 kms. of the employee regardless of its category.

(II) In all cases of placement, the continuous adhoc service rendered in the feeder post if any, prior to regular appointment to the post shall be taken into account towards the length of service as prescribed in these rules for placement subject to the conditions that the adhoc appointment /placement in the feeder category has been made after following proper acceptable process of selection in accordance with the provisions of R&P Rules:

(i) Provided that in all cases where a junior person becomes eligible for consideration by virtue of his total length of service (including the service rendered on adhoc basis followed by regular service/appointment) in the feeder post in view of the provision referred to above, all persons senior to him in the respective category/post/ cadre shall be deemed to be eligible for consideration and placed above the junior person in the field of consideration :

Provided further that all incumbents to be considered for placement shall possess the minimum qualifying service of at least 3 years or that prescribed in the R & P Rules for the post whichever is less:

Provided further that where a person becomes ineligible to be considered for placement on account of the requirements of the preceding proviso, the person(s) junior to him shall also be deemed to be ineligible for consideration for such placement.

Explanation.—The last proviso shall not render the junior incumbents ineligible for consideration for placement if the senior ineligible person happened to be Exservicemen who have joined Armed Forces during the period of emergency and recruited under the provisions of rule-3 of Demobilized Armed Forces Personnel (Reservation of Vacancies in Himachal Pradesh State Non-Technical Services) Rules, 1972 and having been given the benefit of seniority thereunder or recruited under the provisions of rule-3 of Ex-servicemen (Reservation of Vacancies in Himachal Pradesh State Technical Services) Rules, 1985 and having been given the benefit of seniority thereunder.

(ii) Similarly, in all the cases of confirmation, continuous adhoc service rendered on feeder post, if any, prior to the regular appointment against such post shall be taken into account towards the length of service, if any adhoc appointment/placement had been made after proper selection in accordance with the provision of the Recruitment & Promotion Rules:

Provided that inter-se-seniority as a result of confirmation after taking into account, adhoc service rendered as referred to above shall remain unchanged.

12. If a Departmental Promotion/Confirmation Committee exists, what is its composition.—As may be constituted by the Government from time to time.

13. Circumstances under which the Himachal Pradesh Public Service Commission (HPPSC) is to be consulted in making recruitment.—As required under the Law.

14. Essential requirement for a direct recruitment.—A candidate for appointment to any service or post must be a citizen of India.

15. Selection for appointment to the post by direct recruitment.—Not applicable.

16. Reservation.—The appointment to the service shall be subject to orders regarding reservation in the service for Scheduled Castes/Scheduled Tribes/Other Backward Classes/other categories of persons issued by the Himachal Pradesh Government from time to time.

17. Departmental Examination.—Not applicable.

18. Power to Relax.—Where the State Government is of the opinion that it is necessary or expedient to do so, it may, by order for reasons to be recorded in writing and in consultation with the Himachal Pradesh Public Service Commission relax any of the provision(s) of these Rules with respect to any class or category of person(s) or post(s).

MEDICAL EDUCATION & RESEARCH DEPARTMENT

File No.: HFW-B(F)4-9/2017-Part-III.—The Governor, Himachal Pradesh is pleased to constitute a standing committee at the level of Government Medical/Dental College comprising of Principal and all the Head of Departments for each Government Medical/Dental College in the State. This standing committee shall convene a meeting in the month of October every year. The committee shall deliberate upon the following issues:—

1. Requirement of Specialty/Super-specialty Departments in upcoming years in the institutions.

2. Decision as to whether a separate Department is to be created or a Cell within the parent department is to be created.

3. Any other matter which the committee deems fit. The standing committee shall take into account a realistic requirement based upon the OPD/IPD figures, any area specific disease, potential for expansion in terms of space and equipments.

The Director, Medical Education & Research, Himachal Pradesh shall then hold a meeting with all the Principals of Government Medical/Dental Colleges of the State in the month of November every year and collate the requirement college-wise besides rationalizing them. Superspecialty departments/cells shall be established in IGMC, Shimla and Dr. RPGMC, Tanda as per requirements. In other Government Medical Colleges rationalization of these departments will be done as per work load/ geographical distance.

The Governor, Himachal Pradesh is further pleased to constitute a State Level Committee comprising of Director, Medical Education & Research, Himachal Pradesh and Director, Health Services, Himachal Pradesh under the Chairmanship of Administrative Secretary(Health). This committee shall work out the requirement on a State wide basis and shall recommend selective sponsorship of GDOs for the purpose of sponsorship.
