सं0ः इर््र0 डी0एन0-ए-क(3)-1/2019.--हिमाचल प्रदेश के राज्यपाल, सरदार वल्लभभाई पटेल क्लस्टर विश्वविद्यालय, मण्डी, हिमाचल प्रदेश (स्थापना और विनियमन) अधिनियम, 2018 (2018 अधिनियम 212-राजपत्र/2021-05-02-2021 (7141) 7142 राजपत्र, हिमाचल प्रदेश, 05 फरवरी, 2021/16 माघ, 1942 संख्यांक 6) की धारा 38 की उपधारा (2) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, सरदार वल्लभभाई पटेल क्लस्टर विश्वविद्यालय, मण्डी, हिमाचल प्रदेश के निम्नलिखित प्रथम परिनियम बनाते हैं, अर्थात्‌ः-

सरदार वल्लभभाई पटेल क्लस्टर विश्वविद्यालय, मण्डी, हिमाचल प्रदेश के प्रथम परिनियम 1. संक्षिप्त नाम और प्रारम्भ.--(1) इन परिनियमों का संक्षिप्त नाम सरदार वल्लभभाई पटेल क्लस्टर विश्वविद्यालय, मण्डी, हिमाचल प्रदेश के प्रथम परिनियम, 2021 है।

(2) ये परिनियम, राजपत्र (ई-गजट) हिमाचल प्रदेश (ई-गजट) में इनके प्रकाशन की तारीख से प्रवृत्त होंगे।

2. परिभाषाएं.--(1) इन परिनियमाें में जब तक कि कोई बात, विषय या संदर्भ के विरुद्ध न हो,- (क) "अधिनियम" से, सरदार वल्लभभाई पटेल क्लस्टर विश्वविद्यालय, मण्डी, हिमाचल प्रदेश (स्थापना और विनियमन) अधिनियम, 2018 (2018 का अधिनियम संख्यांक 6) अभिप्रेत है;

(ख) "प्राधिकरण" से, विश्वविद्यालय का कोई प्राधिकरण अभिप्रेत है;

(ग) "कर्मचारी" से, विश्वविद्यालय के समस्त कर्मचारी अभिप्रेत हैं चाहे वे अध्यापन या अध्यापनेतर हों; और

(घ) "अधिकारी" से, विश्वविद्यालय का अधिकारी अभिप्रेत है;

(2) समस्त शब्दों और पदों के, जो इन परिनियमों में प्रयुक्त हैं किन्तु परिभाषित नहीं हैं, वही अर्थ हाेंगे, जा अधिनियम में क्रमशः उनके हैं।

3. कुलपति की सेवा के निबन्धन और शर्तें तथा शक्तियां और —त्य.--(1) कुलपति पूर्णकालिक वैतनिक अधिकारी होगा।

(2) कुलपति को किरायामुक्त आवास उपलब्ध करवाया जाएगा और उसका पूर्ण रख-रखाव किया जाएगा।

(3) यदि कुलपति का पद त्यागपत्र के कारण या अन्यथा रिक्त हो जाता है, तो कुलाधिपति राज्य सरकार के परामर्श से किसी भी अधिकारी को नियुक्त कर सकेगा, जो कुलपति के कत्र्तव्यों का निर्वहन, तब तक करेगा जब तक, यथास्थिति, नियमित आधार पर रिक्ति भरी नहीं जाती है या जब तक कुलपति अपने कत्र्तव्यों को फिर से सम्भाल नहीं लेता, और इस प्रकार नियुक्त अधिकारी को कुलपति की समस्त शक्तियां होंगी तथा वह कुलपति के विशेषाधिकारों और सुख-सुविधाओं का हकदार होगाः

परन्तु ऐसी अन्तरिम व्यवस्था, ऐसी व्यवस्था के किए जाने की तारीख से एक वर्ष की अवधि से अधिक के लिए नहीं होगी।

(4) कुलपति, अधिनियम की धारा 16 के अधीन उसे प्रदत्त शक्तियों के अतिरिक्त, निम्नलिखित शक्तियों का प्रयोग और कृत्यों का पालन करेगा, अर्थात्‌ः-

(क) वह किसी भी प्राधिकरण की, किसी भी बैठक में उपस्थित होने और उसको सम्बोधित करने का हकदार होगा;

(ख) वह विश्वविद्यालय के क्रियाकलापों पर नियन्त्रण रखेगा और समस्त प्राधिकरणों के विनिश्चयों को अक्षरशः प्रभाव देगा तथा यह सुनिश्चित करेगा कि वे प्रकृति और व्यवहार में विरोधात्मक न हों;

(ग) उसके पास समस्त शक्तियां होंगी, जो विश्वविद्यालय में समुचित अनुशासन को बनाए रखने के लिए आवश्यक हों और वह ऐसी किन्हीं शक्तियों को, ऐसे किसी अधिकारी या अधिकारियों, जिन्हें उचित समझे, को प्रत्यायोजित कर सकेगा;

(घ) वह, अधिष्ठाताओं (डीन्ज), प्राचार्योें, आचार्यों, सह-आचार्यों, उपाचार्यों (रीडरों), प्राध्यापकों, पुस्तकालयाध्यक्ष, अन्य शिक्षकों और विश्वविद्यालय द्वारा स्थापित विद्या इकाई के ऐसे शैक्षणिक कर्मचारिवृन्द की जैसे अधिनियम की धारा 25 के उपबन्धों के अध्यधीन आवश्यक हो, नियुक्तियां कर सकेगाः

परन्तु, वह ऐसे अधिकारियों, जिन्हें वह विश्वविद्यालय के कृत्यकारों के लिए आवश्यक समझे, की छह मास से अनधिक अवधि के लिए लघु अवधि की नियुक्तियां कर सकेगा;

(ङ) वह, विश्वविद्यालय के किसी भी अधिकारी के अनुपस्थित रहने पर छुट्‌टी प्रदान करेगा और उसकी अनुपस्थिति की अवधि के दौरान, ऐसे अधिकारी के कृत्यों के निर्वहन के लिए आवश्यक व्यवस्था करेगा;

(च) वह, किसी कर्मचारी के अनुपस्थित रहने पर छुट्‌टी प्रदान करेगा और यदि वह ऐसा विनिश्चय करता है, तो वह ऐसी शक्तियों को किसी अन्य अधिकारी या अधिकारियों को प्रत्यायोजित कर सकेगा;

(छ) उसके पास किसी भी कर्मचारी के विरुद्ध, किसी लोप या कार्य, कत्र्तव्य की अवहेलना आदि, के लिए अनुशासनात्मक कार्रवाई करने का प्राधिकार होगा, जैसा पश्चात्‌वर्ती परिनियमों द्वारा विनिर्दिष्ट किया जाएः

परन्तु यदि उसकी रिपोर्ट पर, किसी प्राधिकरण द्वारा लिया गया विनिश्चय, विश्वविद्यालय की सेवा में रत किसी व्यक्ति पर प्रतिकूल प्रभाव डालता है, तो उक्त व्यक्ति उस तारीख, जिसको उसे ऐसा विनिश्चय संसूचित किया गया है, से तीस दिन के भीतर, कुलाधिपति को अपील कर सकेगा और ऐसी अपील पर कुलाधिपति का विनिश्चय अन्तिम होगा;

(ज) उसे शासी निकाय को छोड़कर, विभिन्न प्राधिकरणों की बैठकें बुलाने या बुलाए जाने की शक्ति होगी;

(झ) यदि उसकी राय में किसी ऐसे मामले में, जिसके लिए शक्तियां इस अधिनियम के अधीन किसी अन्य प्राधिकरण को प्रदत्त की गई हैं, तुरन्त कार्रवाई करना आवश्यक हो, तो वह ऐसी कार्रवाई कर सकेगा, जैसी वह आवश्यक समझे और तत्पश्चात्‌ अपनी कार्रवाई की रिपोर्ट, यथासंभव शीघ्र अवसर पर ऐसे अधिकारी या प्राधिकरण को करेगा, जिसने सामान्य अनुक्रम में मामले को निपटाया होताः

परन्तु यदि सम्बन्धित अधिकारी या प्राधिकरण की राय में उसके द्वारा ऐसी कार्रवाई नहीं की जानी थी, तब ऐसा मामला कुलाधिपति को निर्दिष्ट किया जाएगा, जिस पर उसका विनिश्चय अन्तिम होगा;

(ञ) वह, यथास्थिति, विश्वविद्यालय अनुदान आयोग या अखिल भारतीय तकनीकी शिक्षा परिषद्‌ या राष्ट्रीय परिषद्‌ या फार्मेसी परिषद्‌ या एन0ए0ए0सी0 या एन0बी0ए, अन्य राष्ट्रीय और अन्तर्राष्ट्रीय अभिकरणों तथा अन्य विनियामक प्राधिकरणों के साथ एक महत्वपूर्ण कड़ी के रूप में कार्य करेगा;

(ट) वह संस्था या विभागों के लिए एन0ए0ए0सी0 या एन0 बी0ए0 प्रत्यायन प्राप्त करने, संस्था द्वारा उच्चतम संभव ग्रेड प्राप्त करने के लिए मार्गदर्शन करने और संचार-तन्त्र उपलब्ध करवाने के लिए तथा यू0जी0सी0 या ए0आई0सी0टी0ई0, राज्य और केन्द्रीय सरकारों सहित विभिन्न निधिकरण अभिकरणों से वित्तीय अनुदान की अधिकतम रकम प्राप्त करने के लिए विभागों और संस्था को सहायता प्रदान करने हेतु पग उठाएगा;

(ठ) वह राज्य सरकार और केन्द्रीय सरकार दोनों की नवीनतम शैक्षिक नीतियों के साथ और विभिन्न विषयों (अनुशासनों) में समग्र ज्ञान तथा सामान्य प्रवृति से भी अपने को अवगत रखने हेतु पग उठाएगा और उनके बारे में विभागों या संस्था को भी अवगत करवाएगा तथा उचित कार्यान्वयन में उसका मार्गदर्शन करेगा;

7144 राजपत्र, हिमाचल प्रदेश, 05 फरवरी, 2021/16 माघ, 1942 (ड) वह, प्रत्येक शैक्षिणिक वर्ष की समाप्ति पर, पश्चात्‌वर्ती परिनियमों या अध्यादेशों में विनिर्दिष्ट रीति में, संकाय के सदस्यों द्वारा किए गए अध्यापन तथा अनुसंधान कार्य का निर्धारण और मूल्यांकन करेगा, यदि वह आवश्यक समझे तो वह इस प्रयोजन के लिए विशेषज्ञों की समिति नियुक्त कर सकेगा। ऐसे निर्धारण या मूल्यांकन पर, यदि उसकी राय है कि संकाय के किसी सदस्य का कार्य और आचरण संतोषजनक नहीं है, तो वह पश्चात्‌वर्ती परिनियमों या अध्यादेशों में यथा अधिकथित रीति में, ऐसे सदस्य के विरुद्ध कार्रवाई प्रारम्भ कर सकेगा या करवा सकेगा;

(ढ) वह ऐसी अन्य शक्तियों का प्रयोग करेगा, जो पश्चात्‌वर्ती परिनियमों में विनिर्दिष्ट की जाएं; और (ण) वह यह सुनिश्चित करेगा कि अधिनियम, परिनियमों, अध्यादेशों और विनियमों के उपबन्धों का सम्यक्‌ रूप से अनुपालन और कार्यान्वयन किया जा रहा है तथा वह इस सम्बन्ध में समस्त आवश्यक पग उठाएगा।

5. कुलपति के सेवा के अन्य निबन्धन और शर्तें ऐसी होंगी, जो पश्चात्‌वर्ती परिनियमों में विनिर्दिष्ट की जाएं।

4. रजिस्ट्रार की नियुक्ति, सेवा के निबन्धन और शर्तें तथा उसकी शक्तियां और —त्य.--(1) रजिस्ट्रार को प्रबन्ध बोर्ड द्वारा ऐसी रीति में, जो पश्चात्‌वर्ती परिनियमों में विनिर्दिष्ट की जाए, नियुक्त किया जाएगा।

(2) जब रजिस्ट्रार का पद रिक्त है या रजिस्ट्रार बीमारी के कारण या किसी अन्य कारण से अनुपस्थिति के कारण अपने शासकीय कत्र्तव्यों का पालन करने में असमर्थ है, तो उसके कत्र्तव्यों का पालन ऐसे अधिकारी द्वारा किया जाएगा, जिसे कुलपति, कुलाधिपति के अनुमोदन के अध्यधीन, नियुक्त करे। (3) रजिस्ट्रार पूर्णकालिक वैतनिक अधिकारी होगा और कुलपति के नियन्त्रणाधीन कार्य करेगा। (4) रजिस्ट्रार.--

(क) विश्वविद्यालय के अभिलेख, सामान्य मुद्रा और ऐसी अन्य सम्पत्तियाें, जिन्हें प्रबन्ध बोर्ड उसके भारसाधन में सौंपे, का अभिरक्षक होगा; (ख) शासी निकाय, प्रबन्ध बोर्ड और विद्या परिषद्‌ के शासकीय पत्राचार का संचालन करेगा;

(ग) विश्वविद्यालय के प्राधिकरणों की बैठकों की कार्यसूची की प्रतियां, जैसे ही वे जारी की जाएं और प्रधिकरणों की ऐसी बैठकों के कार्यवृत, साधारणतया ऐसी बैठकों को आयोजित करने के एक मास के भीतर कुलाधिपति को देगा;

(घ) विश्वविद्यालय द्वारा या उसके विरुद्ध वादों में या कार्यवाहियों में विश्वविद्यालय का प्रतिनिधित्व करेगा, मुख्तारनामे पर हस्ताक्षर करेगा, अभिवचनों को सत्यापित करेगा और इस प्रयोजन के लिए अपने प्रतिनिधि को नियुक्त करेगा;

(ड.) विश्वविद्यालय के लिए और उसकी ओर से करार या संविदाएं करेगा और उनमें परिवर्तन करेगा, उन्हें वापस लेगा या उन्हें रद्‌द करेगा;

(च) विश्वविद्यालय के लिए और उसकी ओर से कोई न्यास, वसीयत, दान स्वीकार करेगा या किसी चल या अचल सम्पत्ति का अन्तरण करेगा;

(छ) ऐसी अन्य शक्तियों का प्रयोग करेगा और ऐसे अन्य कत्र्तव्यों का पालन करेगा जो इन परिनियमों में विनिर्दिष्ट किए जाएं या अध्यादेशों या विनियमों में विहित किए जाएं या जो प्रबन्ध बोर्ड या कुलपति द्वारा समय-समय पर यथाअपेक्षित किए जाएं।7145 राजपत्र, हिमाचल प्रदेश, 05 फरवरी, 2021/16 माघ, 1942 5 (क) रजिस्ट्रार को अनुभाग अधिकारी की पंक्ति से नीचे के कर्मचारियों या इनके समतुल्य कर्मचारियों के विरुद्ध अनुशासनिक कार्रवाई करने और लम्बित जांच की दशा में उन्हें निलम्बित रखने, उन्हें चेतावनी देने या उन पर परिनिन्दा की शास्ति अधिरोपित करने या वेतनवृद्धि को रोकने की शक्ति होगीः परन्तु ऐसी कोई शास्ति तब तक अधिरोपित नहीं की जाएगी जब तक कि सम्बद्ध व्यक्ति को उसके विरुद्ध की जाने वाली प्रस्तावित कार्रवाई के विरुद्ध कारण बताने का युक्तियुक्त अवसर नहीं दिया गया हो।

(ख) रजिस्ट्रार के, वेतनवृद्वि को रोकने की अधिरोपित शास्ति के किसी आदेश के विरुद्ध अपील कुलपति को की जाएगी।

(ग) किसी ऐसे मामले में जहां जांच से यह प्रकट होता है कि रजिस्ट्रार की शक्तियों से परे दण्ड अपेक्षित है, वहाँ रजिस्ट्रार जांच की समाप्ति पर ऐसी कार्रवाई जैसी कुलपति उचित समझे, के लिए अपनी सिफारिशों सहित कुलपति को रिपोर्ट करेगाः

परन्तु कुलपति के पदच्युति की शास्ति अधिरोपित करने वाले आदेश के विरुद्ध अपील प्रबन्ध बोर्ड को की जाएगी।

5. विा अधिकारी की शक्तियां और —त्य.--(1) वित्त अधिकारी सरदार वल्लभभाई पटेल कलस्टर विश्वविद्यालय का पूर्ण कालिक वैतनिक अधिकारी होगा और उसे राज्य सरकार द्वारा कुलाधिपति के परामर्श से नियुक्त किया जाएगा।

(2) जब वित्त अधिकारी का पद रिक्त या जब वित्त अधिकारी बीमारी के कारण या किसी अन्य कारण से अनुपस्थिति के कारण अपने पद के कत्र्तव्यों का अनुपालन करने में असमर्थ है तो उसके कत्र्तव्यों की अनुपालना ऐसे व्यक्ति द्वारा की जाएगी जिसे कुलपति इस प्रयोजन के लिए नियुक्त करे।

(3) वित्त अधिकारी.-

(क) विश्वविद्यालय की निधियों का साधारण पर्यवेक्षण करेगा और इसे इसकी वित्तीय पॉलिसियों के सम्बन्ध में परामर्श देगा;

(ख) विश्वविद्यालय के लेखों के समुचित अनुरक्षण के लिए उत्तरदायी होगा; और

(ग) ऐसे अन्य वित्तीय कृत्यों का अनुपालन करेगा जैसे इसे प्रबन्ध बोर्ड द्वारा समनुदेशित किए जाएं या जैसे पश्चात्‌वर्ती परिनियमों या अध्यादेशों द्वारा विहित किए जाएंः

परन्तु वित्त अधिकारी प्रबन्ध बोर्ड के पूर्वानुमोदन के बिना पचास हजार रुपये से अधिक की कोई व्यय या कोई विनिधान उपगत नहीं करेगा।

(4) प्रबन्ध बोर्ड के नियन्त्रण के अध्यधीन, वित्त अधिकारी.-

(क) विश्वविद्यालय के किन्हींं उद्‌देश्यों को अग्रसर करने के लिए न्यास और पूर्त सम्पत्ति सहित सम्पत्ति धारण करेगा और विनिधानों की व्यवस्था करेगा;

(ख) नियन्त्रण रखेगा कि एक वर्ष के लिए आवर्ती और अनावर्ती व्यय के लिए विा समिति द्वारा नियत सीमाओं से अधिक न हो जाएं और समस्त निधियों का, उपयोजन उन्हीं प्रयोजनों के लिए किया जा रहा है, जिनके लिए वे प्रदान की गई हैं या अनुज्ञात की गई है;

(ग) वित्तीय वर्ष के लिए विश्वविद्यालय के वार्षिक लेखे और बजट तैयार करने और उसे प्रबन्ध बोर्ड को प्रस्तुत करने के लिए उत्तरदायी होगा;

7146 राजपत्र, हिमाचल प्रदेश, 05 फरवरी, 2021/16 माघ, 1942 (घ) नकदी के प्रवाह और बैंक ंअतिशेष का अनुश्रवण (मॉनिटर) करेगा और राज्य विनिधानों पर नियन्त्रण रखेगा;

(ङ) राजस्व के संग्रहण की अभिवृद्धि का अनुश्रवण (मॉनिटर) करेगा और नियोजित संग्रहण की पद्धति पर परामर्श देगा;

(च) निगरानी रखेगा कि भवन, भूमि, फर्नीचर और उपस्करों के रजिस्टर अद्यतन अनुरक्षित किए गए हैं कि और यह कि समस्त कार्यालयों, अध्यापन विभागों महाविद्यालयों और विश्वविद्यालय द्वारा व्यवस्थित संस्थानों में उपस्कर और अन्य उपभोग्य सामग्री के स्टॉक की जांच नियमित अन्तरालों, या जैसा समय-समय पर अपेक्षित हो, पर संचालित की जा रही है; और

(छ) विश्वविद्यालय के अधीन किसी कार्यालय या विभाग या महाविद्यालय या संस्थान से कोई सूचना या विवरणियां, जिन्हें वह अपने वित्तीय दायित्वों के निवर्हन के लिए आवश्यक समझे, मांग सकेगा। 5. विश्वविद्यालय के संदेय किसी रकम के लिए वित्त अधिकारी या इस निमित्त प्रबन्ध बोर्ड द्वारा सम्यक्‌ रूप से प्राधिकृत किसी व्यक्ति या व्यक्तियों की रसीद इसके निर्वहन के लिए पर्याप्त होगी। 6. परीक्षा नियन्त्रक.--परीक्षा नियन्त्रक क्लस्टर विश्वविद्यालय का पूर्ण कालिक वैतनिक अधिकारी होगा और वह इस प्रयोजन के लिए गठित चयन समिति की सिफारिशों पर प्रबन्ध बोर्ड द्वारा नियुक्त किया जाएगा।

7. संकायाध्यक्ष.--(1) प्रत्येक संकाय का एक अध्यक्ष होगा जिसे कुलपति द्वारा नियुक्त किया जाएगा। संकायाध्यक्षों को, विभिन्न विभागों या संस्थान (संस्थानों) स्कूल (स्कूलों) या केन्द्र (केन्द्रों) या संकाय में समाविष्ट घटक महाविद्यालयों के समस्त आचार्यों में से वरिष्ठता द्वारा दो वर्ष की अवधि के लिए चक्रानुक्रम में नियुक्त किया जाएगाः

परन्तु यदि किसी संकाय में कोई आचार्य नहीं है तो विभिन्न विभागों या संस्थान (संस्थानाें) या स्कलू (स्कूलों) या केन्द्र (केन्द्रों) का वरिष्ठतम सह आचार्य के रूप में कार्य करेगा और यदि कोई सह आचार्य नहीं है तो कुलपति संकायाध्यक्ष की नियुक्ति के लिए कोई और व्यवस्था करेगाः

परन्तु यह और कि यदि संकायाध्यक्ष दो मास से अन्यून अवधि की छुट्‌टी पर है तो कुलपति, नियमित संकायाध्यक्ष के छुट्‌टी पर होने की अनुपस्थिति की अवधि के दौरान, सम्बद्ध संकायाध्यक्ष बनने वाले अगले पात्र व्यक्ति को संकाययाध्यक्ष के रूप में कार्य करने के लिए नियुक्त कर सकेगा।

8. छात्र कल्याण संकायाध्यक्ष.--(1) छात्र कल्याण संकायाध्यक्ष की नियुक्ति कुलपति द्वारा प्रबंध बोर्ड की सिफारिशों पर जो कलस्टर विश्वविद्यालय के कर्मचारियों, या घटक महाविद्यालयों का अध्यापक है या रहा हो और जो आचार्य या सह- आचार्य की पंक्ति से नीचे का न हो, में से की जाएगी।

(2) छात्र कल्याण संकायाध्यक्ष क्लस्टर विश्वविद्यालय या घटक महाविद्यालय का नियमित कर्मचारी होगा और वह दो वर्ष की अवधि के लिए पद धारण करेगा।

(3) जब छात्र कल्याण संकायाध्यक्ष का पद रिक्त हो या जब छात्र कल्याण संकायाध्यक्ष बीमारी के कारण या किसी अन्य कारण कत्र्तव्य से अनुपस्थिति के कारण अपने पद के कत्र्तव्यों का अनुपालन करने में असमर्थ है तो उसके कत्र्तव्यों की अनुपालना ऐसे व्यक्ति द्वारा की जाएगी जिसे कुलपति इस प्रयोजन के लिए नियुक्त करे।

(4) छात्र कल्याण संकायाध्यक्ष की सेवा के निबंधन और शर्तें और कत्र्तव्य तथा शक्तियां अध्यादेशों द्वारा विनियमित की जाएंगी।

9. विश्वविद्यालय के अन्य अधिकारी.--क्लस्टर विश्वविद्यालय के अन्य अधिकारियों की नियुक्ति की रीति और उनकी शक्तियां और कृत्य ऐसे होंगे, जैसे परिनियमों द्वारा विहित किए जाएं।7147 राजपत्र, हिमाचल प्रदेश, 05 फरवरी, 2021/16 माघ, 1942 (क) शैक्षणिक कार्य-कलाप संकायाध्यक्ष; (ख) महाविद्यालय संकायाध्यक्ष एवं निदेशक, महाविद्यालय विकास परिषद; (ग) मुख्य (चीफ) वार्डन; और (घ) पुस्तकालयाध्यक्ष।

(क) शैक्षणिक कार्यकलाप संकायाध्यक्ष.--(i) शैक्षणिक कार्यकलाप संकायाध्यक्ष को कुलपति द्वारा प्रबन्ध बोर्ड की सिफारिशों पर क्लस्टर विश्वविद्यालय या घटक महाविद्यालयों के कर्मचारियों, जो विश्वविद्यालय के अध्यापक हैं या रहे है ं और जो आचार्य की पंक्ति से नीचे के न हों, में से नियुक्त किया जाएगा। (ii) शैक्षणिक कार्यकलाप संकायाध्यक्ष विश्वविद्यालय का नियमित कर्मचारी होगा और वह दो वर्ष की अवधि के लिए पद धारण करेगा।

(iii) जब शैक्षणिक कार्यकलाप संकायाध्यक्ष का पद रिक्त हो या जब शैक्षणिक कार्यकलाप संकायाध्यक्ष बीमारी के कारण या किसी अन्य कारण से कत्र्तव्य से अनुपस्थिति के कारण अपने पद के कत्र्तव्यों का अनुपालन करने में असमर्थ है तो उसके कत्र्तव्यों की अनुपालना ऐसे व्यक्ति द्वारा की जाएगी जिसे कुलपति इस प्रयोजन के लिए नियुक्त करे।

(iv) शैक्षणिक कार्यकलाप संकायाध्यक्ष की सेवा के निबंधन और शर्तें और कत्र्तव्य तथा शक्तियां अध्यादेशों द्वारा विनियमित की जाएंगी।

(ख) महाविद्यालय संकायाध्यक्ष-एवं-निदेशक, महाविद्यालय विकास परिषद्‌.--(i) महाविद्यालय संकायाध्यक्ष-एवम्‌-निदेशक, महाविद्यालय विकास परिषद्‌ की नियुक्ति कुलपति द्वारा, प्रयोजन के लिए गठित प्रबन्ध बोर्ड की सिफारिशों पर की जाएगी और वह विश्वविद्यालय का पूर्णकालिक वैतनिक अधिकारी होगा। (ii) महाविद्यालय संकायाध्यक्ष-एवं-निदेशक, महाविद्यालय विकास परिषद्‌ विश्वविद्यालय का नियमित कर्मचारी होगा और वह दो वर्ष की अवधि के लिए पद धारण करेगा।

(iii) जब महाविद्यालय संकायाध्यक्ष एवं निदेशक, महाविद्यालय विकास परिषद्‌ का पद रिक्त हो या जब महाविद्यालय संकायाध्यक्ष एवं निदेशक, महाविद्यालय विकास परिषद बीमारी के कारण या किसी अन्य कारण से कत्र्तव्य से अनुपस्थिति के कारण अपने पद के कत्र्तव्यों का अनुपालन करने में असमर्थ है तो उसके कत्र्तव्यों की अनुपालना ऐसे व्यक्ति द्वारा की जाएगी जिसे कुलपति इस प्रयोजन के लिए नियुक्त करे। (iv) महाविद्यालय संकायाध्यक्ष-एवं-निदेशक, महाविद्यालय विकास परिषद्‌ की सेवा के निबंधन और शर्तें और कत्र्तव्य तथा शक्तियां अध्यादेशों द्वारा विनियमित की जाएंगी।

(ग) मुख्य (चीफ) वार्डन.-(i) मुख्य (चीफ) वार्डन को कुलपति द्वारा, विश्वविद्यालय के कर्मचारियों में से जो क्लस्टर विश्वविद्यालय या घटक महाविद्यालयों के अध्यापक हैं या रहे हैं, और जो आचार्य या सह-आचार्य की पंक्ति से नीचे के न हों, नियुक्त किया जाएगा।

(ii) मुख्य (चीफ) वार्डन क्लस्टर विश्वविद्यालय या घटक महाविद्यालय का नियमित कर्मचारी होगा और वह दो वर्ष की अवधि के लिए पद धारण करेगा।

(iii) जब मुख्य (चीफ) वार्डन का पद रिक्त हो या जब मुख्य (चीफ) वार्डन बीमारी के कारण या किसी अन्य कारण से कत्र्तव्य से अनुपस्थिति के कारण अपने पद के कत्र्तव्यों का अनुपालन करने में असमर्थ है तो उसके कत्र्तव्यों की अनुपालना ऐसे व्यक्ति द्वारा की जाएगी जिसे कुलपति इस प्रयोजन के लिए नियुक्त करे।

(iv) मुख्य (चीफ) वार्डन की सेवा के निबंधन और शर्तें और कत्र्तव्य तथा शक्तियां अध्यादेशों द्वारा विनियमित की जाएंगी। 7148 राजपत्र, हिमाचल प्रदेश, 05 फरवरी, 2021/16 माघ, 1942 (घ) पुस्तकालयाध्यक्ष.-(i) पुस्तकालयाध्यक्ष को कुलपति द्वारा, प्रयोजन के लिए गठित चयन समिति की सिफारिशों पर, नियुक्त किया जाएगा और वह विश्वविद्यालय का पूर्णकालिक वैतनिक अधिकारी होगा। (ii) जब पुस्तकालयाध्यक्ष का पद रिक्त हो या जब पुस्तकालयाध्यक्ष बीमारी के कारण या किसी अन्य कारण से कत्र्तव्य से अनुपस्थिति के कारण अपने पद के कत्र्तव्यों का अनुपालन करने में असमर्थ है तो उसके कत्र्तव्यों की अनुपालना ऐसे व्यक्ति द्वारा की जाएगी जिसे कुलपति इस प्रयोजन के लिए नियुक्त करे। (iii) पुस्तकालयाध्यक्ष की सेवा के निबन्धन और शर्तेें और कत्र्तव्य तथा शक्तियां अध्यादेशों द्वारा विनियमित की जाएंगी।

10. संकाय.--(1) क्लस्टर विश्वविद्यालय के संकाय ऐसे होंगे जो पश्चात्‌वर्ती विनियमों द्वारा विनिर्दिष्ट किए जाएं।

(2) प्रत्येक संकाय, ऐसी शैक्षणिक इकाइयों, जैसी अध्यादेशों द्वारा विनिर्दिष्ट की जाएं, से गठित होगा।

(3) कोई भी विभाग, ऐसे उपबन्ध, जैसे पश्चात्‌वर्ती परिनियमों में विनिर्दिष्ट किए जाएं के अनुसार के सिवाय, स्थापित या समाप्त नहीं किया जाएगा।

11. भवन और संकर्म समिति.--भवन और संकर्म समिति निम्नलिखित सदस्यों शस्ति होगी, अर्थात्‌ः-

12. विश्वविद्यालय की सहबद्धता/सहबद्धता विशेषाधिकार की शर्त.--(1) क्लस्टर विश्वविद्यालय, मण्डी, हिमाचल प्रदेश की सीमाओं के भीतर महाविद्यालय और अन्य संस्थानों को विश्वविद्यालय के ऐसे विशेषाधिकारों में स्वीकृत किया जा सकेगा जैसे प्रबन्ध बोर्ड नीचे दी गई शर्तों के अनुसार विनिश्चित करें, अर्थात्‌ :-

(i) सहबद्धता या संगम के विशेषाधिकार चाहने वाला प्रत्येक महाविद्यालय का बीस से अनधिक्‌ व्यक्तियों से मिलकर बनने वाला संस्थान नियमित रूप से गठित प्रबन्धन होगा, जिसकी संरचना क्लस्टर विश्वविद्यालय, मण्डी, हिमाचल प्रदेश के अध्यादेशों में यथा उपबन्धित होगी। महाविद्यालय या संस्थान के कार्यकरण और प्रबन्धन से सम्बद्ध समस्त मामलों से सम्बन्धित नियम और प्रबन्धन के कार्मिकों से सम्बन्धित नियम विश्वविद्यालय के परिनियमों और अध्यादेशों के अनुरूप होंगे और सरकारी अनुदान की शर्तों के भी अनुरूप होंगे। ऐसे नियमों और कार्मिकों को प्रबंध-बोर्ड का अनुमोदन अपेक्षित होगाः

परन्तु उक्त शर्त सरकार द्वारा अनुरक्षित महाविद्यालयों और संस्थानों के मामले में लागू नहीं होगी। तथापि, ऐसे महाविद्यालयों और संस्थानों की एक सलाहकार समिति होगी, जो अन्य के साथ-साथ, महाविद्यालय या संस्थान के प्रधानाचार्य सहित कम से कम तीन शिक्षक और विश्वविद्यालय के दो प्रतिनिधियों से गठित होगी।7149 राजपत्र, हिमाचल प्रदेश, 05 फरवरी, 2021/16 माघ, 1942 (ii) सहबद्धता और संगम की शर्त के रूप में और ऐसे सहबद्धता और संगम के जारी रहने पर, प्रत्येक ऐसे महाविद्यालय या संस्थान का प्रबन्धन निम्नलिखित बिन्दुओं पर प्रबन्ध बोर्ड का समाधान करेगा, अर्थात्‌ :-

(क) कि महाविद्यालय या संस्थान को स्थाई और ठोस आधार पर स्थापित किया गया है;

(ख) कि इसके पास अपेक्षित भूमि और भवन है या इन्हें अर्जित करने या इनका विनिर्माण करने के लिए आवश्यक निधियां हैं;

(ग) कि इसके पास अध्यापन के लिए उपस्करों की पर्याप्तता है;

(घ) कि इसके पास अध्यापन कर्मचारीवृन्द उनकी अर्हताएं और सेवा की शर्ताें की पर्याप्तता है;

(ङ) कि इसके पास छात्रों के निवास स्थानों, कल्याण, अनुशासन और पर्यवेक्षण की व्यवस्था है;

(च) इसके दक्ष अनुरक्षण और कार्यकरण के लिए किसी विन्यास के रूप में या राज्य सरकार या दोनों से सहायता अनुदान के वचन के रूप में पर्याप्त वित्तीय व्यवस्था उपलब्ध है; और

(छ) ऐसे अन्य मामले जो विश्वविद्यालय के शिक्षा मानकों को बनाए रखने के लिए अनिवार्य है। (iii) किसी महाविद्यालय या संस्थान को निरीक्षण समिति की ऐसी सिफारिशों, जैसी अध्यादेशों में उपबन्धित की जाए के सिवाय विश्वविद्यालय के विशेषाधिकारों में स्वीकृत नहीं किया जाएगा।

(iv) विश्वविद्यालय के किन्हीं विशेषाधिकारों की स्वीकृति की वांछा रखने वाले संगठनों, महाविद्यालयों और संस्थानों को ऐसा करने के अपने आशय की सूचना लिखित में करनी अपेक्षित होगी ताकि वह रजिस्ट्रार के पास ऐसी तारीख, जैसी अध्यादेशों में उपबंधित की जाए, के अपश्चात्‌ पहुंच जाए।

(v) कोई महाविद्यालय, प्रबन्ध बोर्ड की अनुमति के बिना, किसी विषय या अध्ययन के पाठ्‌यक्रम, जो विश्वविद्यालय की पाठ्‌यचर्या में है, में अनुदेशों को निलंबित नहीं कर सकेगा।

(vi) विश्वविद्यालय किसी निजी महाविद्यालय या संस्थान के अनुरोध पर सहबद्धता और साहचर्य प्रदान करने के लिए आवेदन के साथ केवल सरकार की सहमति प्राप्त होने के पश्चात्‌ विचार करेगा। (2) ऐसे महाविद्यालय और संस्थान के अध्यापन कर्मचारिवृंद की नियुक्तियां चयन समिति की ऐसी सिफारिशों, जैसी अध्यादेशों में उपबन्धित की जाएं, पर की जाएगीः

परन्तु इस खण्ड के उपबन्ध सरकार द्वारा अनुरक्षित महाविद्यालयों और संस्थानों के मामलों में लागू नहीं होंगे। (3) प्रत्येक ऐसे महाविद्यालय और संस्थान का, सहबद्धता और साहचर्य का विशेषाधिकार प्रदान करने के अनुसरण में पहले तीन वर्षों के लिए प्रत्येक वर्ष में एक बार और तत्पश्चात्‌ कुलाधिपति के नामनिर्देशिति, जोकि उसका अध्यक्ष भी होगा, सम्बन्धित संकायाध्यक्ष तथा कुलपति के नामर्निदेशिति से गठित समिति द्वारा प्रत्येक दो वर्ष में कम से कम एक बार निरीक्षण किया जाएगा। समिति की रिपोर्ट कुलपति को प्रस्तुत की जाएगी जो उसे किन्ही ं संप्रेक्षणों और सिफारिशों, जैसी वह ठीक समझे के साथ प्रबन्ध बोर्ड को प्रेषित करेगा। प्रबन्ध बोर्ड, कुलपति के संप्रेक्षणों और सिफारिशों पर विचार करने के पश्चात्‌ समिति की रिपोर्ट की प्रति को संस्थान और महाविद्यालय के प्रबन्धन को ऐसी कार्रवाई, जैसी निर्दिष्ट की जा सके, करने हेतु अग्रेषित करेगा। (4) प्रबंध बोर्ड किसी भी महाविद्यालय या संस्थान को प्रदान किए गए विशेषाधिकार को वापस ले सकेगा, यदि किसी भी समय वह समझता है कि महाविद्यालय या संस्थान अपेक्षित शर्तों को परिपूर्ण नहीं कर रहा हैः

परन्तु किसी विशेषाधिकार को प्रत्याहृत करने से पूर्व प्रबन्धन को प्रबंध बोर्ड को व्यपदेशन करने का अवसर दिया जाएगा कि उसके विरुद्ध क्यों नहीं ऐसी कारवाई की जाए। 7150 राजपत्र, हिमाचल प्रदेश, 05 फरवरी, 2021/16 माघ, 1942 (5) उपरोक्त दी गई शर्तों के अध्यधीन, अध्यादेशों में ऐसी अन्य शर्तें, जैसी आवश्यक समझी जाएं, विहित की जा सकेंगी और विश्वविद्यालय के विशेषाधिकारों में महाविद्यालयों और संस्थानों में प्रवेश के लिए और इन विशेषाधिकारों को वापस लेने की प्रक्रिया भी विहित की जा सकेगी।

13. चयन समिति.--(1) आचार्यों, सह-आचार्यों, सहायक आचार्यों, रजिस्ट्रार, परीक्षा नियन्त्रक, विा अधिकारी, पुस्तकालयाध्यक्ष, महाविद्यालय संकायाध्यक्ष एवं निदेशक महाविद्यालय विकास परिषद्‌ और निदेशक, शारीरिक शिक्षा एवं युवा कार्यक्रम के पदों पर नियुक्तियों के लिए प्रबन्ध बोर्ड को सिफारिशें करने हेतु चयन समिति होगी।

(2) चयन समिति, कुलपति से गठित होगी जो इसका अध्यक्ष भी होगा और इसके अतिरिक्त चयन समितियों के निम्न सारिणी के स्तंभ (1) में विनिर्दिष्ट पद पर नियुक्ति के लिए सिफारिशें करने हेतु उक्त सारिणी के स्तंभ (2) की तत्स्थानी प्रविष्टि में विनिर्दिष्ट व्यक्ति भी इसके सदस्य हाेंगे।

(3) अध्यक्ष सहित चयन समिति के तीन सदस्यों से गणपूर्ति होगी किन्तु उनमें से एक कुलाधिपति का नामनिर्देशिती अवश्य हो।

(4) चयन समिति द्वारा सिफारिशें करने में अपनाई जाने वाली प्रक्रिया अध्यादेशों में अधिकथित की जाएगी।7151 राजपत्र, हिमाचल प्रदेश, 05 फरवरी, 2021/16 माघ, 1942 (5) इन परिनियमों और अध्यादेशों में उपबंधित के सिवाय यदि प्रबन्ध बोर्ड चयन समिति द्वारा की गई किसी सिफारिश को स्वीकार करने में असमर्थ हैं तो वह उसे पुनर्विचार के लिए चयन समिति को भेज सकेगा और यदि मतभेद का समाधान नहीं होता है तो प्रबन्ध बोर्ड इसके कारणों को अभिलिखित करेगा और मामले को अंतिम आदेशों के लिए कुलाधिपति को प्रस्तुत करेगा।

(6) नियुक्ति की विशेष रीति-इन परिनियमों में अन्तर्विष्ट किसी बात के होते हुए भी.-

(क) प्रबन्ध बोर्ड, उच्च विद्या सम्बन्धी विशेष उपाधि और वृतिक योग्यता वाले किसी व्यक्ति को, ऐसे निबन्धनों और शर्तों पर, जैसी वह उचित समझे, विश्वविद्यालय में, यथास्थिति, आचार्य या सह-आचार्य का पद स्वीकार करने के लिए आमन्त्रित कर सकेगा और व्यक्ति के ऐसा करने की सहमति पर उसे पद पर नियुक्त कर सकेगाः

परन्तु कुलपति विश्वविद्यालय या सहबद्ध महाविद्यालयों या विश्वविद्यालय महाविद्यालयों में कार्यरत वरिष्ठ सहायक आचार्यों या कनिष्ठ सहायक आचार्यों में से उपयुक्त व्यक्ति को विश्वविद्यालय में तीन वर्ष से अनधिक अवधि के लिए सहायक आचार्य के रूप में कार्य करने के लिए आमन्त्रित कर सकेगा;

(ख) प्रबन्ध बोर्ड के पास उप-खण्ड (2) और (3) में अधिकथित प्रक्रिया के अनुसार चयनित व्यक्तियों को, नियत अवधि के लिए ऐसी शर्तों पर, जैसी वह अधिरोपित करना उचित समझे, शिक्षक के रूप में नियुक्त करने की शक्ति होगी ।

14. मानद उपाधियां.--मानद उपाधियों को प्रदान करने के समस्त प्रस्ताव विद्यापरिषद्‌ द्वारा प्रबन्ध बोर्ड को किए जाएंगे और इन्हें कुलाधिपति को पुष्टिकरण के लिए प्रस्तुत करने से पूर्व शासी निकाय की अनुमति अपेक्षित होगीः

परन्तु अत्यावश्यकता की दशाओं में कुलाधिपति केवल कुलपति की सिफारिशों पर ही कार्य कर सकेगा।

(2) विश्वविद्यालय द्वारा प्रदान की गई कोई मानद उपाधि शासी निकाय के दो-तिहाई सदस्यों के पूर्व अनुमोदन और कुलाधिपति की मंजूरी से प्रबन्ध बोर्ड द्वारा वापस ली जा सकेगी।

15. शिक्षकों को हटाया जाना.--(1) जहां किसी शिक्षक के विरुद्ध अवचार का आरोप है, वहां कुलपति, यदि वह उचित समझे, लिखित आदेश द्वारा शिक्षक को निलम्बित कर सकेगा और तत्काल प्रबन्ध बोर्ड को, उन परिस्थितियों, जिनके अधीन आदेश किया गया था, की रिपोर्ट देगाः

परन्तु यदि प्रबन्ध बोर्ड की राय है कि मामले की परिस्थितियां शिक्षक के निलम्बन का समर्थन नहीं करती हैं, तो वह उस आदेश को प्रतिसंहृत कर सकेगा।

(2) उनकी संविदा या सेवा या नियुक्ति के निबन्धनों में अंतर्विष्ट किसी बात के होते हुए भी, प्रबन्ध बोर्ड अवचार के आधारों पर किसी शिक्षक को हटाने का हकदार होगा।

(3) यथापूर्वोक्त के सिवाय, प्रबन्ध बोर्ड, उचित और पर्याप्त कारण के, यदि शिक्षक स्थायी है तो लिखित में तीन मास का नोटिस देने के पश्चात्‌ या नोटिस के बदले तीन मास का वेतन संदाय करने और यदि वह अस्थायी है तो एक मास का वेतन संदाय करने के सिवाय, किसी शिक्षक को हटाने का हकदार नहीं होगा।

(4) किसी भी शिक्षक को खण्ड (2) या खण्ड (3) के अधीन तब तक नहीं हटाया जाएगा, जब तक कि उसे इस बाबत की जाने वाली कार्रवाई के विरुद्ध, उसे कारण बताने का युक्तियुक्त अवसर न दे दिया गया हो।

(5) शिक्षक को हटाने के लिए प्रबन्ध बोर्ड के उपस्थित और मतदान करने वाले सदस्यों का दो-तिहाई बहुमत अपेक्षित होगा। 7152 राजपत्र, हिमाचल प्रदेश, 05 फरवरी, 2021/16 माघ, 1942 (6) शिक्षक का हटाया जाना उस तारीख से प्रभावी होगा, जिसको हटाए जाने का आदेश किया गया हैः

परन्तु जहां कोई शिक्षक उसके हटाए जाने के समय निलम्बित है, तो उसका हटाया जाना उस तारीख से प्रभावी होगा, जिसको उसे निलम्बित किया गया था। (7) इन परिनियमों में किसी बात के अंतर्विष्ट होते हुए भी, शिक्षक, प्रबन्ध बोर्ड को, यदि वह स्थायी है तो तीन मास और यदि स्थायी नहीं है तो एक मास, का नोटिस देकर, त्यागपत्र देने का हकदार होगाः परन्तु नियुक्ति प्राधिकारी प्रशासनिक सुविधा को ध्यान में रखते हुए स्वविवेकानुसार किसी भी मामले में नोटिस की अवधि को शिथिल या माफ कर सकेगा।

(8) नियमों, विनियमों, परिनियमों, अध्यादेशों में किसी अन्य बात के अंतर्विष्ट होते हुए भी कोई पदधारी जिस पर प्रबन्ध बोर्ड द्वारा बड़ी शास्ति अधिरोपित की गई है आदेश की उसे संसूचना प्राप्त होने के तीन मास के भीतर, ऐसे आदेश के विरुद्ध कुलाधिपति को अपील कर सकेगा।

स्पष्टीकरण.--नियमों, विनियमों, परिनियमों, अध्यादेशों के प्रयोजन के लिए कोई भी निम्नलिखित शास्ति बड़ी शास्ति मानी जाएगीः-

(i) संचयी प्रभाव के साथ वेतनवृद्धि(यां) रोकना,

(ii) निम्नतर पद या समय-वेतनमान या समय-वेतनमान में निम्नतर प्रक्रम पर अवनति;

(iii) अनिवार्य सेवानिवृाि;

(iv) सेवा से हटाया जाना;

(v) पदच्युति।

16. शिक्षकों से अन्यथा कर्मचारियों का हटाया जाना.--(1) शिक्षक से अन्यथा विश्वविद्यालय के किसी कर्मचारी को, उसकी सेवा की संविदा या उसकी नियुक्ति के निबन्धनों में अंतर्विष्ट किसी बात के होते हुए भी, प्राधिकारी, जो उस कर्मचारी को नियुक्त करने में सक्षम है, द्वारा हटाया जा सकेगाः-

(क) यदि वह विकृतचिा है और सक्षम प्राधिकारी द्वारा ऐसा घोषित किया गया है;

(ख) यदि वह अनुन्मोचित दिवालिया है;

(ग) यदि वह नैतिक अधमता से अन्तर्वलित किसी अपराध के लिए न्यायालय द्वारा सिद्धदोष ठहराया गया है; और उस बाबत दण्डादिष्ट किया गया है;

(घ) यदि वह अन्यथा अवचार का दोषी है।

(2) किसी भी ऐसे कर्मचारी को खण्ड (1) के अधीन तब तक नहीं हटाया जाएगा, जब तक कि उसे इस बाबत की जाने वाली प्रस्तावित कार्रवाई के विरुद्ध उसे कारण बताने का युक्तियुक्त अवसर न दे दिया गया हो।

(3) जहां ऐसे कर्मचारी का सेवा से हटाया जाना खण्ड (1) के उप-खण्ड (ग) या उप-खण्ड (घ) में विनिर्दिष्ट से अन्यथा कारण से है तो वहां उसे लिखित में तीन मास का नोटिस दिया जाएगा या नोटिस के बदले तीन मास का वेतन संदा किया जाएगा।

(4) इन परिनियमों में अंतर्विष्ट किसी बात के होते हुए भी विश्वविद्यालय का कोई कर्मचारी, जो शिक्षक नहीं है, त्यागपत्र देने का हकदार होगा;

(i) स्थायी कर्मचारी की दशा में नियुक्ति प्राधिकारी को लिखित में तीन मास का नोटिस देने या नोटिस के बदले विश्वविद्यालय को तीन मास का वेतन संदा करने के पश्चात;

(ii) किसी अन्य दशा में नियुक्ति प्राधिकारी को लिखित में एक मास का नोटिस देने या नोटिस के बदले विश्वविद्यालय को एक मास का वेतन संदा करने के पश्चातः

परन्तु प्रशासनिक सुविधा को ध्यान में रखते हुए नियुक्ति प्राधिकारी स्वविवेकानुसार किसी भी मामले में नोटिस की अवधि को शिथिल/माफ कर सकेगा।

(5) नियमों/विनियमों/परिनियमों/अध्यादेशों में किसी अन्य बात के अंतर्विष्ट होते हुए भी कोई पदधारी जिस पर कार्यकारी परिषद्‌ द्वारा बड़ी शास्ति अधिरोपित की गई है, उसे आदेश की संसूचना के तीन मास के भीतर, ऐसे आदेश के विरुद्ध कुलाधिपति को अपील कर सकेगा।

स्पष्टीकरण.-नियमों/विनियमों/परिनियमों/अध्यादेशों के प्रयोजन के लिए निम्नलिखित कोई भी शास्ति बड़ी शास्ति मानी जाएगीः

(i) संचयी प्रभाव के साथ वेतनवृद्धि (यां) रोकना;

(ii) निम्नतर पद, समय-वेतनमान या समय-वेतनमान में निम्नतर प्रक्रम पर अवनति;

(iii) अनिवार्य सेवानिवृाि;

(iv) सेवा से हटाया जाना;

(v) पदच्युति।

17. विश्वविद्यालय के छात्रों में अनुशासन बनाए रखना.--(1) अनुशासन और अनुशासनिक कार्रवाई से सम्बधित समस्त शक्तियां कुलपति में निहित होंगी।

(2) कुलपति, अपनी समस्त या ऐसी शक्तियाें को, जिन्हें वह उचित समझे, ऐसे अन्य व्यक्तियों, जिन्हें वह इस निमिा विनिर्दिष्ट करे, प्रत्यायोजित कर सकेगा।

(3) इन परिनियमों के अधीन अनुशासन प्रवर्तित करने की शक्तियों की व्यापकता पर प्रतिकूल प्रभाव डाले बिना, निम्नलिखित को घोर अनुशासनहीनता का कृत्य समझा जाएगा.-

(क) सरदार वल्लभभाई पटेल क्लस्टर विश्वविद्यालय के भीतर किसी संस्थान, विभाग के अध्यापन और अध्यापनेतर कर्मचारिवृन्द के किसी सदस्य के विरुद्ध या किसी छात्र के विरुद्ध शारीरिक हमला करना या शारीरिक बल के प्रयोग की धमकी देना;

(ख) किसी हथियार को ले जाना या प्रयोग करना या प्रयोग करने की धमकी देना;

(ग) सिविल अधिकार संरक्षण अधिनियम, 1976 के उपबन्धों का कोई अतिक्रमण करना;

(घ) अनुसूचित जाति और अनुसूचित जनजाति से सम्बन्धित छात्रों की प्रास्थिति, गरिमा और सम्मान का अतिक्रमण करना,

(ङ) महिलाओं के प्रति कोई अनादरसूचक व्यवहार, चाहे मौखिक हो या अन्यथा, करना;

(च) किसी भी रीति में घूस लेने-देने या भ्रष्टाचार का प्रयत्न करना;

(ज) धार्मिक या साम्प्रदायिक आधार पर वैमनस्य या असहिष्णुता पैदा करना;

(झ) विश्वविद्यालय तन्त्र के शैक्षणिक कृत्यों में किसी भी रीति में, अव्यवस्था पैदा करना;

(ञ) रैगिंग करना।

(4) कुलपति, अनुशासन बनाए रखने और अनुशासन बनाए रखने के हित में ऐसी कार्रवाई, जैसी उसे उचित प्रतीत होती हो, करने से सम्बन्धित अपनी शक्तियों की व्यापकता पर प्रतिकूल प्रभाव डाले बिना, उपयुक्त अपनी शक्तियों का प्रयोग करते हुए आदेश या निर्देश दे सकेगा किः-

(क) किसी छात्र या छात्रों को निष्कासित किया जाए; या

(ख) किसी छात्र या छात्रों का किसी कथित अवधि के लिए निष्कासित किया जाए; या

(ग) किसी छात्र को विश्वविद्यालय के किसी महाविद्यालय, विभाग या संस्थान में अध्ययन के पाठ्‌यक्रम या पाठ्‌यक्रमों में किसी विनिर्दिष्ट अवधि के लिए प्रवेश नहीं दिया जाए; या

(घ) ऐसे रुपयों की रकम, जैसी विनिर्दिष्ट की जाए, का जुर्माना किया जाए; या

(ङ) एक या एक से अधिक वर्षों के लिए किसी विश्वविद्यालय या महाविद्यालय में प्रवेश लेने या विभागीय परीक्षा या परीक्षाएं देने से विवर्जित कर दिया जाए; या

(च) सम्बद्ध छात्र या छात्रों का उन परीक्षा या परीक्षाओं, जिनमें वे शामिल हुए हैं, का परिणाम रद्द कर दिया जाए।

(5) महाविद्यालयों के प्राचार्यों, हालों के अध्यक्षों, संकायाध्यक्षों, विश्वविद्यालय के शिक्षण विभागों के प्रमुखों और पुस्तकालयाध्यक्ष, छात्र कल्याण संकायाध्यक्ष, शैक्षणिक कार्यकलापों के संकायाध्यक्ष, मुख्य वार्डन और होस्टलों के वार्डन के पास, कलस्टर विश्वविद्यालय के परिसर के भीतर उनके अपने-अपने महाविद्यालयों, संकायों और अध्यापन विभागों, अध्ययन कक्षों (क्लास रूम), प्रयोगशालाओं, पुस्तकालयों, सरदार वल्लभभाई पटेल कलस्टर विश्वविद्यालय के नियन्त्रण के भीतर घटक महाविद्यालयों, महाविद्यालयों के छात्रों पर समस्त ऐसी अनुशासनात्मक शक्तियों का प्रयोग करने का प्राधिकार होगा, जैसी सम्बद्ध विभागों में संस्थान, हाल और शिक्षण के समुचित संचालन (आचरण) के लिए आवश्यक हों। वे उनके महाविद्यालयों, संस्थाओं या विभागों में ऐसे अध्यापकों की समिति को ऐसे प्राधिकार प्रत्यायोजित कर सकेंगे, जैसे वे इन प्रयोजनों के लिए विनिर्दिष्ट करे।

(6) कुलपति और ऐसे व्यक्ति जिसे परिनियम 18 के खण्ड (2) के अधीन शक्तियां प्रत्यायोजित की गई हैं, की शक्तियों पर प्रतिकूल प्रभाव डाले बिना अनुशासन और समुचित आचरण के विस्तृत (ब्योरेवार) नियम बनाए जाएंगे। ये नियम महाविद्यालयों के प्राचार्यों, हालों के प्रमुखोें, संकायाध्यक्षों और इस विश्वविद्यालय में शिक्षण विभागों के प्रमुखों द्वारा, जहां आवश्यक हों, अनुपूरित किए जा सकेंगे। प्रत्येक छात्र को एक घोषणा पर हस्ताक्षर करना अपेक्षित होगा कि प्रवेश के समय वे कुलपति और विश्वविद्यालय के विभिन्न प्राधिकारियों के अनुशासनात्मक अधिकारिता में स्वयं को प्रस्तुत करते हैं जिनमें अधिनियम, परिनियमाें, विनियमाें और नियमाें, जो विश्वविद्यालय द्वारा तद्‌धीन बनाए गए हैं या बनाए जा सकेंगे, के अधीन अनुशासन बनाए रखने का प्राधिकार निहित होगा।

18. रैगिंग का प्रतिषेध और रैगिंग के लिए दण्ड.--(1) सरदार वल्लभभाई पटेल कलस्टर विश्वविद्यालय के किसी होस्टल, महाविद्यालय, विभाग या संस्थान और उसके तंत्र के किसी भाग के परिसरों के भीतर या बाहर के साथ-साथ इसके आस-पास किसी सार्वजनिक स्थान पर या परिवहन में किसी भी रूप में रैगिंग सर्वथा प्रतिषिध होगी।7155 राजपत्र, हिमाचल प्रदेश, 05 फरवरी, 2021/16 माघ, 1942 (2) रैगिंग का वैयक्तिक या सामूहिक कृत्य या व्यवहार घोर अनुशासन होगा और इस पर परिनियम के अधीन विचार किया जाएगा।

(3) इस परिनियम के प्रयोजनों के लिए रैगिंग से सामान्यतः ऐसा कोई कार्य, आचरण या व्यवहार अभिप्रेत है जिसके द्वारा वरिष्ठ छात्रों की प्रभुतापूर्ण शक्ति या प्रास्थिति को नए भर्ती (प्रविष्ट) किए गए छात्रों या उन छात्रों पर, जिन्हें अन्य छात्रों द्वारा किसी प्रकार से कनिष्ठ या हीन समझा जाता है, उपस्थापित किया जाए और इसके अन्तर्गत ऐसे वैयक्तिक या सामूहिक कार्य या व्यवहार है, जिनमेंः-

(क) शारीरिक हमला या धमकी अथवा बल का प्रयोग अन्तर्वलित हो;

(ख) महिला छात्रों की प्रास्थिति, गरिमा और सम्मान की उपेक्षा करते हों;

(ग) अनुसूचित जाति और जनजाति से सम्बन्धित छात्रों की प्रास्थिति, गरिमा और सम्मान की उपेक्षा करते हों;

(घ) छात्रों का उपहास और तिरस्कार करते हों तथा जिनसे उनका स्वाभिमान प्रभावित होता हो; और (ङ) मौखिक गाली और छेड़छाड़ (अग्रेशन), अशिष्ट इशारे और अश्लील व्यवहार का समावेश हो। (4) महाविद्यालय का प्राचार्य, विभाग या संस्थान का अध्यक्ष, महाविद्यालय या विश्वविद्यालय के होस्टल या आवासीय हाल के प्राधिकारी रैगिंग की घटना की किसी सूचना पर तत्काल कार्रवाई करेंगे। (5) खण्ड (4) में अन्तर्विष्ट किसी बात के होते हुए भी, कोई व्यक्ति, जिसे परिनियम 18 के खण्ड (2) के अधीन शक्तियां प्रत्यायोजित की गई हैं, रैगिंग की किसी घटना की जांच भी कर सकेगा और उन व्यक्तियों, जो रैगिंग में संलिप्त है की पहचान और घटना की प्रवृत्ति की कुलपति को रिपोर्ट करेगा। (6) वह व्यक्ति जिसे परिनियम 18 के खण्ड (2) के अधीन शक्तियां प्रत्यायोजित की गई हैं, रैगिंग के अपराधियाें की पहचान सिद्ध करते हुए और रैगिंग की घटना की प्रवृत्ति की आरम्भिक रिपार्ट प्रस्तुत करेगा। (7) यदि महाविद्यालय के प्राचार्य या विभाग अथवा संस्थान के अध्यक्ष या उस व्यक्ति, जिसे परिनियम 18 के खण्ड (2) के अधीन शक्तियां प्रत्यायोजित की गई हैं, का कुछ कारणों को लिखित में अभिलिखित करके समाधान हो जाता है कि उसके लिए ऐसी जांच करना युक्तियुक्त रूप से व्यवहार्य नहीं है तो वे तद्‌नुसार कुलपति को ऐसा परामर्श दे सकेंगे।

(8) जब कुलपति का समाधान हो जाता है कि ऐसी जांच करना समीचीन नहीं है तो उनका विनिश्चय अन्तिम होगा।

(9) खण्ड (5) या (6) के अधीन रिपोर्ट की प्राप्ति पर या खण्ड(3) के उप-खण्ड (क), (ख) और (ग) में वर्णित रैगिंग की घटना का प्रकटीकरण होने पर खण्ड (7) के अधीन सुसंगत प्राधिकारी द्वारा निर्धारण पर कुलपति, किसी छात्र या छात्रों का विनिर्दिष्ट वर्षों के लिए निष्कासन का निर्देश देगा या आदेश करेगा। (10) कुलपति रैगिंग के अन्य मामलाें में किसी छात्र या छात्रों का निष्कासन किए जाने या महाविद्यालय में किसी अध्ययन पाठ्‌यक्रम में किसी विनिर्दिष्ट अवधि के लिए या विभागीय परीक्षा में एक या एक से अधिक वर्षों के लिए प्रवेश न देने का या परीक्षाओं में छात्र या छात्रों, जिनमें वे शामिल हुए हैं, का परिणाम रद्द करने का आदेश कर सकेगा या निदेश दे सकेगा।

(11) इस परिनियम के अधीन दोषी पाए गए उन छात्रों की दशा में जिन्हाेंने विश्वविद्यालय से उपाधियां या डिप्लोमे अभिप्राप्त कर लिए हैं, अधिनियम की धारा 7(घ) के अधीन विश्वविद्यालय द्वारा प्रदान की गई उपाधियों या डिप्लोमा के प्रत्याहरण के लिए समुचित कार्रवाई की जाएगी। 7156 राजपत्र, हिमाचल प्रदेश, 05 फरवरी, 2021/16 माघ, 1942 (12) इस परिनियम के प्रयोजन के लिए रैगिंग के लिए उकसाना भी रैगिंग करना होगा। (13) विश्वविद्यालय के भीतर समस्त संस्थान इस परिनियम के अधीन जारी अनुदेशों, निर्देशों को कार्यान्वित करेंगे और परिनियम के प्रभावी कार्यान्वयन की पूर्ति हेतु कुलपति की सहायता करेंगे और सहयोग देंगे।

(14) कुलपति का यह कत्र्तव्य होगा कि वह विश्वविद्यालय के प्रबन्ध बोर्ड को विश्वविद्यालय में रैगिंग की बुराई को नियन्त्रित और दूर करने हेतु उसके द्वारा उठाए गए कदमों से सम्बन्धित रिपोर्ट प्रतिवर्ष प्रस्तुत करें और जहां रैगिंग की घटना रिपोर्ट की गई है और कोई उदार दृष्टिकोण अपनाया गया है तो वह ऐसे उदार दृष्टिकोण अपनाने के कारणों को स्पष्ट करते हुए ज्ञापन के साथ-साथ उसके ब्योरे विश्वविद्यालय के प्रबन्ध बोर्ड के समक्ष रखवाएगा। कुलपति यह भी सुनिश्चित करेगा कि इस खण्ड के अधीन प्रबन्ध बोर्ड को प्रस्तुत की गई रिपोर्ट को अधिनियम की धारा 50 के अधीन तैयार की जाने वाली वार्षिक रिपोर्ट में भी सम्मिलित किया जाएगा।

19. विश्वविद्यालय निकायों की सदस्यता के लिए वरिष्ठता, पात्रता.--(1) इन परिनियमों और अध्यादेश में अन्यथा विनिर्दिष्ट उपबन्धित के सिवाय, इन परिनियमों के अनुसार जब कभी कोई व्यक्ति कोई पद धारित करता है या वरिष्ठता के अनुसार चक्रानुक्रम में विश्वविद्यालय के किसी प्राधिकरण का सदस्य बनता है, तो ऐसी वरिष्ठता से, यथास्थिति, विश्वविद्यालय द्वारा या सरकार द्वारा यथा अवधारित परस्पर वरिष्ठता अभिप्रेत होगीः

परन्तु अंशकालिक आधार पर [चाहे मानद(आनरेरी) या अन्यथा] नियुक्त अध्यापक (शिक्षक) विश्वविद्यालय के किसी प्राधिकरण या निकाय का सदस्य बनने का पात्र नहीं होगा। तथापि, मानद हैसियत से या विशेष निबन्धनों पर नियुक्त और पूर्णकालिक आधार पर कार्यरत अध्यापक (शिक्षक) भी पात्र होंगे।

(2) रजिस्ट्रार का यह कत्र्तव्य होगा कि वह व्यक्तियों के ऐसे वर्ग, जिन पर इस परिनियम के उपबन्ध लागू होते हैं, की बाबत पूर्वगामी खण्ड के उपबन्धों के अनुसार एक सम्पूर्ण और अद्यतन वरिष्ठता सूची तैयार करे और अनुरक्षित करे।

(3) यदि दो या दो से अधिक व्यक्तियों की किसी विशिष्ट पद पर लगातार सेवा की समान अवधि हो या किसी व्यक्ति या व्यक्तियों की सापेक्ष वरिष्ठता अन्यथा संदेहास्पद हो तो रजिस्ट्रार, स्वप्रेरणा से और ऐसे किसी व्यक्ति के अनुरोध पर मामले को, प्रबन्ध बोर्ड को प्रस्तुत करेगा, जिसका उस पर विनिश्चय अंतिम होगा।

(4) इन परिनियमों में किसी बात के होते हुए भी कोई व्यक्ति, जो साधारणतया भारत का निवासी नहीं है, विश्वविद्यालय का अधिकारी या विश्वविद्यालय के किसी प्राधिकरण का सदस्य बनने के लिए पात्र नहीें होगा।

20. समितियां.--शासी निकाय या प्रबन्ध बोर्ड या शैक्षणिक परिषद या विश्वविद्यालय का कोई अन्य प्राधिकरण बोर्ड या समितियां या प्राधिकरण के सदस्य और ऐसे अन्य व्यक्ति (यदि कोई हो) नियुक्त कर सकेंगे, जिन्हें प्राधिकरण ऐसे प्रत्येक मामले में नियुक्त करना उचित समझे और ऐसा कोई बोर्ड या समिति, प्राधिकरण, जिसने इसे नियुक्त किया है, की पश्चात्‌वर्ती सहमति के अध्यधीन, इसे समनुदेशित किसी विषय का निपटारा कर सकेगी।

21. निर्वाचित अध्यक्ष द्वारा अध्यक्षता करना जहां परिनियमों में कोई उपबन्ध न किया गया हो.--जहां अधिनियमों, परिनियमों या अध्यादेशों में अध्यक्ष द्वारा किसी विश्वविद्यालय, बोर्ड या समिति की बैठक की अध्यक्षता करने का कोई उपबन्ध नहीं किया गया है या जहां इस प्रकार प्राधिकृत अध्यक्ष अनुपस्थित हो तो उपस्थित सदस्यों द्वारा अपने में से ही बैठक की अध्यक्षता करने हेतु अध्यक्ष निर्वाचित किया जाएगा। 22. त्यागपत्र.--(1) प्रबन्ध बोर्ड, शैक्षणिक परिषद्‌ या विश्वविद्यालय या समिति के किसी अन्य प्राधिकरण के पदेन सदस्य से अन्यथा कोई भी सदस्य रजिस्ट्रार को सम्बोधित पत्र द्वारा त्यागपत्र दे सकेगा7157 राजपत्र, हिमाचल प्रदेश, 05 फरवरी, 2021/16 माघ, 1942 और ऐसा त्यागपत्र रजिस्ट्रार या रिक्ति को भरने हेतु सक्षम प्राधिकारी द्वारा पत्र की प्राप्ति पर यथाशीघ्र प्रभावी हो जाएगा।

(2) विश्वविद्यालय का कोई अधिकारी (चाहे वेतनधारी हो या अन्यथा) रजिस्ट्रार को सम्बोधित पत्र द्वारा अपने पद का त्याग कर सकेगाः परन्तु ऐसा त्यागपत्र केवल उस तारीख से प्रभावी होगा जिससे रिक्ति को भरने हेतु सक्षम प्राधिकारी द्वारा उसे स्वीकार किया गया है।

(3) विश्वविद्यालय के किसी प्राधिकरण का कोई सदस्य यदि उस निकाय, जिसके लिए वह निर्वाचित या नामनिर्दिष्ट अथवा नियुक्त हुआ है, का सदस्य नहीं रहता है तो वह उस प्राधिकरण का भी सदस्य नहीं रहेगा।

23. माध्यस्थम्‌ के लिए प्रक्रिया.--(1) विश्वविद्यालय और क्लस्टर विश्वविद्यालय के किसी कर्मचारी के बीच उत्पन्न होने वाला कोई भी विवाद, और जो एक वर्ष से अधिक अवधि के लिए अविनिश्चित रहता है तो उसे किसी भी पक्षकार के अनुरोध पर निम्नलिखित से गठित माध्यस्थम्‌ अधिकरण को विनिश्चय के लिए निर्दिष्ट किया जाएगाः-

(i) कुलाधिपति द्वारा नामनिर्दिष्ट अध्यक्ष;

(ii) प्रबन्ध बोर्ड द्वारा नामनिर्दिष्ट एक व्यक्ति; और

(iii) सम्बद्ध कर्मचारी द्वारा नामनिर्दिष्ट एक व्यक्ति।

(2) विश्वविद्यालय, माध्यस्थम्‌ अधिकरण द्वारा इसके कृत्यों के दक्षतापूर्ण रीति में निर्वहन में मंगवाए गए किसी अभिलेख, रिपोर्ट या कोई अन्य सूचना को उसे प्रस्तुत करेगा।

(3) माध्यस्थम्‌ अधिकरण का विनिश्चय अंतिम होगा और उस द्वारा विनिश्चित मामले की बाबत किसी सिविल न्यायालय में कोई वाद नहीं होगा।

(4) परीक्षा के लिए कोई भी छात्र या अभ्यर्थी, जिसका नाम विश्वविद्यालय की नामावली (रोल) से, यथास्थिति, कुलपति, अनुशासन समिति या परीक्षण समिति के आदेशों या संकल्प द्वारा हटाया गया है, और जिसे एक से अधिक वर्ष के लिए विश्वविद्यालय की परीक्षा देने से विवर्जित किया गया है, उस द्वारा ऐसे आदेश या संकल्प की प्रति की प्राप्ति की तारीख से दस दिन के भीतर, कुलाधिपति को अपील कर सकेगा तथा यथास्थिति, कुलाधिपति, कुलपति या समिति के विनिश्चय को पुष्ट कर सकेगा, उसे उपान्तरित कर सकेगा या उसे उलट सकेगा और छात्र के विरुद्ध विश्वविद्यालय द्वारा की गई किसी अनुशासनिक कार्रवाई से उत्पन्न होने वाला कोई भी विवाद, ऐसे छात्र के अनुरोध पर, ऐसी रीति में, जैसी अध्यादेशों/विनियमों में विनिर्दिष्ट की जाए, माध्यस्थम्‌ अधिकरण को निर्दिष्ट किया जाएगा।

(5) विश्वविद्यालय के प्रत्येक कर्मचारी या छात्र या किसी विद्या इकाई को अधिनियम में अन्तर्विष्ट किसी बात के होते हुए भी, यथास्थिति, किसी अधिकारी या प्राधिकरण (अथॉरिटी) के विनिश्चय के विरुद्ध, ऐसे समय के भीतर, जैसा पश्चात्‌वर्ती परिनियमों द्वारा विनिर्दिष्ट किया जाए, कुलाधिपति को अपील करने का अधिकार होगा और तदुपरि कुलाधिपति उस विनिश्चय, जिसके विरुद्ध अपील की गई है, की पुष्टि कर सकेगा, उपान्तरित कर सकेगा या उलट सकेगा।

(6) समस्त विवाद सिविल न्यायालय, मण्डी, जिला मण्डी, हिमाचल प्रदेश की अधिकारिता के अध्यधीन होंगे।

(7) पूर्वोक्त अधिनियम या उक्त अधिनियम के अधीन बनाए गए इन परिनियमों या अध्यादेशों के किन्हीं उपबन्धों के अनुसरण में सद्‌भावपूर्वक की गई कोई बात या की जाने के लिए आशयित किसी बात के लिए, कोई भी वाद या अन्य विधिक कार्यवाहियां विश्वविद्यालय के किसी भी अधिकारी या कर्मचारी के विरुद्ध नहीं की जाएगी। 7158 राजपत्र, हिमाचल प्रदेश, 05 फरवरी, 2021/16 माघ, 1942 24. छात्रों से प्रभारित की जाने वाली फीस की बाबत उपबन्ध.--(1) विश्वविद्यालय की फीस संरचना अधिनियम की धारा 43 के उपबन्धों के अनुसार निश्चित की जाएगी।

(2) फीस समेस्टर/वार्षिक आधार पर प्रभारित की जाएगी और फीस के संग्रहण के लिए समय अनुसूची विवरणिका (प्रॉस्पेक्टस) में अधिसूचित की जाएगी।

25. विभिन्न पाठ्‌यक्रमों में स्थानों (सीटों) की कुल संख्या की बाबत उपबन्ध.--(1) विभिन्न पाठ्‌यक्रमों में स्थानों (सीटों) की कुल संख्या विद्या परिषद्‌ द्वारा विनिश्चित की जाएगी तथा कुलाधिपति द्वारा अनुमोदित की जाएगी। तथापि, प्रत्येक पाठ्‌यक्रम में विभिन्न प्रवर्गों के लिए स्थानाें (सीटों) का आरक्षण सरकार के प्रचलित नियमों के अनुसार रखा जाएगा और विभिन्न प्रवर्गों में रिक्तियां खुले प्रवर्ग के अभ्यर्थियों द्वारा भरी जा सकेंगी।

(2) विभिन्न पाठ्‌यक्रमों में स्थानों (सीटों) की संख्या, कुलपति के अनुमोदन के अध्यधीन विद्या परिषद्‌ के विवेकानुसार बढ़ायी या घटाई जा सकेगी।

(3) विभिन्न पाठ्‌यक्रमों में स्थानों (सीटों) का आबंटन, कुलाधिपति के अनुमोदन से विद्या परिषद्‌ द्वारा विनिश्चित किया जाएगा।

26. प्रवेश और आरक्षण.--(1) अध्ययन के समस्त पाठ्‌यक्रमों में प्रवेश का आधार एक प्रतियोगी परीक्षा द्वारा अवधारित की जाने वाली गुणागुण(मेरिट) या विश्वविद्यालय प्रबंध बोर्ड (बी.ओ.एम.) द्वारा इस संबंध में विरचित नियमों के अनुसार अर्हता परीक्षा के आधार पर होगा।

(2) अध्ययन के विभिन्न पाठ्‌यक्रमों में प्रवेश मूलवंश, पंथ, जाति या वर्ग को विचार में लाए बिना निम्नलिखित शर्तों के अध्यधीन सभी व्यक्तियों के लिए खुला होगा, अर्थात्‌ः-

(क) कुल सीटों का क्रमशः 15% और 7.5% स्थान (सीटें) हिमाचल के वास्तविक अनुसूचित जातियों और अनुसूचित जनजातियों के अभ्यर्थियों के लिए आरक्षित होगा जिन्होंने अपनी अर्हता परीक्षा हिमाचल प्रदेश विश्वविद्यालय, सरदार वल्लभभाई पटेल क्लस्टर विश्वविद्यालय या चौधरी सरवन कुमार हिमाचल प्रदेश कृषि विश्वविद्यालय (Chaudhary Sarwan Kumar Himachal Pradesh Krishi Vishvavidyalaya), डॉ॰ यशवन्त सिंह परमार औद्योनिकी और वानिकी विश्वविद्यालय या विधि द्वारा स्थापित किसी अन्य विश्वविद्यालय जो सरदार वल्लभभाई पटेल क्लस्टर विश्वविद्यालय की समतुल्य अर्हता परीक्षा हो, से उत्तीर्ण की हो।

(ख) शेष 77.5% स्थान (सीटें) निम्नलिखित प्रकार से भरी जाएंगी :-

(i) स्थानों (सीटों) का 2.5 %, संस्थान जहां से उन्होंने अपनी अर्हता परीक्षा, उत्तीर्ण की है को विचार में लाए बिना, समस्त अभ्यर्थियों के लिए खुली होंगी।

(ii) 75% सीटें उन अभ्यर्थियाें में से जिन्हाेंने हिमाचल प्रदेश विश्वविद्यालय, सरदार वल्लभभाई पटेल क्लस्टर विश्वविद्यालय या चौधरी सरवन कुमार हिमाचल प्रदेश कृषि विश्वविद्यालय (Chaudhary Sarwan Kumar Himachal Pradesh Krishi Vishvavidyalaya), या डॉ0 यशवन्त सिंह परमार औद्योनिकी और वानिकी विश्वविद्यालय, हिमाचल प्रदेश तकनीकी विश्वविद्यालय, केन्द्रीय विश्वविद्यालय हिमाचल प्रदेश और हिमाचल प्रदेश में अवस्थित किसी अन्य विश्वविद्यालय या वे अभ्यर्थी, जो हिमाचल प्रदेश के स्थायी निवासी हैं, जिन्होंने भारत में विधि द्वारा स्थापित किसी अन्य विश्वविद्यालय से अर्हता परीक्षा उाीर्ण की है, को विचार में लाए बिना और जो सरदार वल्लभभाई पटेल क्लस्टर विश्वविद्यालय की अर्हता परीक्षा के समतुल्य हों, में से निम्नलिखित आरक्षणों के अध्यधीन, भरी जाएंगीः-

(क) पांच प्रतिशत स्थान (सीटें) उत्कृष्ट खिलाड़ियों के लिए आरक्षित होंगे

(ख) पांच प्रतिशत स्थान (सीटें) उत्कृष्ट सांस्कृतिक संक्रियता वादियों के लिए आरक्षित होंगे; और7159 राजपत्र, हिमाचल प्रदेश, 05 फरवरी, 2021/16 माघ, 1942 (ग) तीन प्रतिशत स्थान (सीटें), शारीरिक शिक्षा विभाग के सिवाय, दिव्यांगजनों के लिए आरक्षित होंगे।

(3) अनुसूचित जाति और अनुसूचित जनजाति प्रवर्ग से सम्बन्धित अभ्यर्थियों की दशा में किसी पाठ्‌यक्रम में प्रवेश के लिए न्यूनतम अर्हता अधिकतम अंकों के पांच प्रतिशत तक शिथिल की जाएगी। उपरोक्त खण्ड (ख) के पैरा (ii) (क), (ख) और (ग) में यथाकथित आरक्षित स्थानों (सीटों) के लिए प्रवेश प्रबन्ध बोर्ड द्वारा समय-समय पर अनुमोदित प्रक्रिया/नियमों के अनुसार दिया जाएगा।

27. छात्रों को ट्‌यूशन फीस के संदाय से छूट और छात्रवृाियां तथा अध्येयतावृाियां प्रदान करना--(1) फीस माफी और फीस के संदाय से छूटः-

(क) गरीबी के आधार पर ट्‌यूशन फीस में फीसमाफी कक्षा/पाठ्‌यक्रम की कुल संख्या के दस प्रतिशत तक सम्पूर्ण फीस माफी और पन्द्रह प्रतिशत तक आधी फीस माफी प्रदान की जाएगी;

(ख) भाई-बहन फीस माफी.--आयु में कनिष्ठ (युवतर) छात्र को आधी फीस माफी की जाएगी यदि उसका बड़ा भाई या बड़ी बहन भी विश्वविद्यालय में अध्ययन कर रहा हो/कर रही हो और वे पूर्ण फीस का संदाय कर रहा हो/रही हो।

(ग) छात्राआें के लिए ट्‌यूशन फीस में छूट समस्त छात्राओं को, अन्तस्र्नातक और स्नातकोार दोनों पाठ्‌यक्रमों में, इस बाबत समय-समय पर हिमाचल प्रदेश सरकार की अधिसूचना के अनुसार ट्‌यूशन फीस में छूट दी जाएगी।

(2) छात्रवृत्तियां और अध्येयतावृत्तियां.--किसी विशिष्ट प्रवर्ग के लिए विनिर्दिष्ट रूप से उद्‌दिष्ट सहित अध्येयतावृाियों, छात्रवृाियों, पदकों और पुरस्कारों के समस्त पुरस्कार अध्यादेशों में अधिकथित नियमों के अधीन अवधारित गुणागुण के आधार पर दिए जाएंगे तथापि, फीस माफी और वृत्तिकाएं गरीबी एवं गुणागुण के आधार पर प्रदान की जाएंगी।

अध्येयतावृाियां निम्नलिखित प्रवर्गों में विभाजित की जा सकेंगी :-

(क) सरदार वल्लभभाई पटेल क्लस्टर विश्वविद्यालय वरिष्ठ अध्येयतावृत्ति डॉक्टोरल के पश्चात्‌ दो वर्ष तक शोध के लिए तथापि, यदि अभ्यर्थी ऐसा चाहे तो इसे दो वर्ष से कम अवधि के लिए प्रदान किया जा सकेगा।

(ख) सरदार वल्लभभाई पटेल क्लस्टर विश्वविद्यालय कनिष्ठ शोध अध्येयतावृत्तियाँ पी0 एच0 डी0 (जुनियर-रिसर्च फैलोशिप) (पी0 एच0 डी0 पाठ्‌यक्रम और एल0 एल0 एम0)।

(3) स्नातकोार छात्रों के लिए गुणागुण वार (मेरिट वाइज) खेल और सांस्कृतिक छात्रवृाियांः- विश्वविद्यालय स्नातकोार छात्रों के लिए विषय-वार गुणागुण, समहू -वार गुणागुण छात्रवृाियां, खेल छात्रवृाियां और सांस्कृतिक सक्रियता वादी छात्रवृाियों पर आधारित स्नातकोार केन्द्र छात्रवृाियां प्रदान करेगा।

(4) छात्रवृत्ति की रकम ऐसी होगी जैसी प्रबन्ध बोर्ड और वित्त समिति द्वारा समय-समय पर अनुमोदित की जाए।

NOTIFICATION

Shimla-02, the 1st February 2021

No. EDN-A-ka(3)-1/2019.—In exercise of the powers conferred by sub-section (2) of section 38 of the Sardar Vallabhbhai Patel Cluster University, Mandi, Himachal Pradesh (Establishment and Regulation) Act, 2018 (Act No. 6 of 2018), the Governor, Himachal Pradesh, is pleased to make the following First Statutes of the Sardar Vallabhbhai Patel Cluster University, Mandi Himachal Pradesh, namely:—

The First Statutes of Sardar Vallabhabhai Patel cluster University, Mandi, Himachal Pradesh.

1. Short title and commencement.—(1) These statutes may be called the first Statutes of the Sardar Vallabhbhai Patel Cluster University, Mandi, Himachal Pradesh.

(2) They shall come into force from the date of their publication in the Rajpatra (e-Gazette), Himachal Pradesh.

2. Definitions.— (1) In these Statutes unless there is anything repugnant to the subject or context:

(a) "Act" means the Sardar Vallabhbhai Patel Cluster University, Mandi, Himachal Pradesh (Establishment & Regulation) Act, 2018 (Act No. 6 of 2018);

(b) "Authority" means any of the authority of the University;

(c) "employee" means all the employees whether teaching or non-teaching of the university; and

(d) "Officer" means Officer of the University.

(2) All word and expressions used in these statutes but not defined shall have the same meanings respectively as assigned to them in the Act.

3. Terms and conditions of service and powers and functions of the Vice- Chancellor.— (1) The Vice-Chancellor shall be a whole time salaried officer.

(2) The Vice-Chancellor shall be provided a rent free residence and full maintenance thereof.

(3) If the office of the Vice Chancellor falls vacant due to resignation or otherwise, the Chancellor may appoint any officer in consultation with the State Government who shall perform the duties of the Vice-Chancellor, until the vacancy is filled up on regular basis or until the Vice- Chancellor resumes his duties, as the case may be, and the officer so appointed shall have all the powers of the Vice-Chancellor and shall be entitled to the privileges and amenities of the Vice- Chancellor:

Provided that such interim arrangement shall not exceed a period of one year from the date on which such an arrangement is made.

(4) In addition to the powers conferred upon him under section 16 of the Act, the Vice- Chancellor shall exercise and perform the following powers and functions, namely:—

(a) he shall be entitled to be present at, and to address any meeting of any Authority;

(b) he shall exercise control over the affairs of the University and shall give effect to the decisions of all the authorities in letter and spirit and ensure that they are not contradictory in nature and practice;

(c) he shall have all the powers necessary for the proper maintenance of discipline in the University and he may delegate any such powers to such officer or officers as he may deem fit;

(d) he shall make appointments of the Deans, Principals, Professors, Associate Professors, Readers, Lecturers, Librarian, other teachers and such academic staff of Academic Unit established by the University, as may be necessary subject to the provisions of section 25 of the Act:

Provided that he may make short-term appointments, for a period of not exceeding six months, of such officers as he may consider necessary for the functioning of the University;

(e) He shall grant leave of absence to any officer of the University and make necessary arrangements for the discharge of the functions of such an officer during the period of his absence.

(f) he shall grant leave of absence to any employee and if he so decides may delegate such powers to any other officer or officers;

(g) he shall have the authority to take disciplinary action against any employee for any omissions and commissions, dereliction of duty etc. As may be specified by the subsequent statutes:

Provided that if the decision taken by any authority on his report affects any person in the service of the University, the said person may appeal to the Chancellor within thirty days from the date on which such a decision was communicated to him and the decision of the Chancellor on such appeal shall be final;

(h) he shall have the power to convene or cause to be convened meetings of the various authorities, except that of the Governing Body;

(i) if in his opinion it is necessary to take immediate action on any matter for which powers are conferred on any other authority under the Act, he may take such action as he deems necessary and shall, at the earliest opportunity thereafter, report his action to such officer or authority as would have in the ordinary course dealt with the matter:

Provided that if in the opinion of the concerned officer or authority such action should not have been taken by him, then such case shall be referred to the Chancellor, whose decision thereon shall be final;

(j) he shall act as a vital link with the University Grants Commission or All India Council of Technical Education or Nation or Pharmacy Council or NAAC or NBA, other National and International agencies and other regulatory authorities, as the case may be;

(k) he shall take steps and bring about NAAC or NBA accreditation for Institutions or Departments, to provide guidance and logistic support for getting the highest possible grade to the institution and to help the Departments and Institution to get maximum amounts of financial grants from various funding agencies including UGC or AICTE, State and Central Governments;

(l) he shall take steps to keep abreast with the latest Educational policies of both the State and Central Governments and also the corpus of knowledge and trends in various disciplines and to apprise the Departments or Institution about the same and to guide in their proper implementation;

(m) he shall, at the close of each academic year, in the manner specified in the subsequent statutes or ordinances, assess and evaluate the teaching and research works done by the members of the Faculty, if he deems necessary, he may appoint a committee of experts for the purpose. On such assessment or evaluation, if he is of the opinion that the work and conduct of any member of the faculty is not satisfactory, he may, in the manner as laid down in the subsequent statutes or ordinances, initiate or cause to be initiate action against such a member;

(n) he shall exercise such other powers as may be specified in the subsequent statutes; and (o) he shall ensure that the provisions of the Act, statutes, ordinances and the regulations are duly observed and implemented and he shall take all necessary steps in this regard.

(5) Other terms and conditions of service of the Vice-Chancellor shall be such as may be specified in the subsequent statutes.

4. Appointment, terms and conditions of service of the Registrar and his powers and functions.—(1) The Registrar shall be appointed by the Board of Management in the manner as specified in the subsequent statutes.

(2) When the office of the Registrar, is vacant or when the Registrar by reason of illness or absence for any other cause is unable to perform his official duties, his duties shall be performed by such officer as the Vice-Chancellor may appoint subject to the approval of the Chancellor.

(3) The Registrar shall be a whole time salaried officer and work under the control of the Vice-Chancellor.

(4) The Registrar shall:—

(a) be the custodian of the records, the common seal and such other properties of the University as the Board of Management shall commit to their charge;

(b) conduct the official correspondence of the Governing Body, the Board of Management and the Academic Council;

(c) supply to the Chancellor copies of the agenda of meetings of the authorities of the7163 राजपत्र, हिमाचल प्रदेश, 05 फरवरी, 2021/16 माघ, 1942 University, as soon as they are issued and the minutes of the meetings of the authorities ordinarily within a month of the holding of the meetings;

(d) represent the University in suits or proceedings by or against the University, sign power of attorney and verify pleadings or depute its representatives for the purpose;

(e) enter into agreements or contracts, and change, revoke or cancel them for and on behalf of the University;

(f) accept for and on behalf of the University any trust, bequest, donation or transfer of any movable or immovable property; and

(g) exercise such other powers and perform such other duties as may be specified in these Statutes or prescribed by the Ordinances or the Regulations or as may be required, from time to time, by the Board of Management or the Vice-Chancellor.

(5) (a) The Registrar shall have power to take disciplinary action against the employees below the rank of Section Officer or its equivalent and to suspend them pending inquiry, to administer warnings to them or to impose on them the penalty of censure or the withholding of increment:

Provided that no such penalty shall be imposed unless the person concerned has been given a reasonable opportunity of showing cause against the action proposed to be taken against him.

(b) An appeal shall lie to the Vice-Chancellor against any order of the Registrar imposing the penalty of the withholding of the increment.

(c) In a case where the inquiry discloses that a punishment beyond the power of the Registrar is called for, the Registrar shall upon conclusion of the inquiry, make a report to the Vice-Chancellor along with his/her recommendations, for such action as the Vice-Chancellor deems fit:

Provided that an appeal shall lie to the Board of Management against the order of the Vice- Chancellor imposing the penalty of dismissal.

5. Powers and functions of Finance Officer.—(1) The Finance officer shall be whole time salaried officer of the Sardar Vallabhbhai Patel Cluster University and shall be appointed by the State Government in consultation with the Chancellor.

(2) When the office of the Finance Officer is vacant or when the Finance Officer is unable to perform the duties of his office by reason of illness or, is absent from duty for any other cause the same shall be performed by such person as the Vice- Chancellor may appoint for the purpose.

(3) The Finance Officer shall.—

(a) exercise general supervision over the funds of the University and shall advise it as regards its financial policy;

(b) be responsible for the proper maintenance of the accounts of the University; and (c) perform such other financial functions as may be assigned by the Board of Management or as may be prescribed by subsequent Statutes or the Ordinances:

Provided that the Finance Officer shall not incur any expenditure or make any investment exceeding Rs. Fifty thousand/- without the prior approval of the Board of Management.

(4) Subject to the control of the Board of Management, the Finance Officer shall.—

(a) hold and manage the property and investments, including trust and endowed property, for furthering any of the objects of the University;

(b) check that the limits fixed by the Finance Committee for recurring and non- recurring expenditure for one year are not exceeded and that all funds are utilised for the purposes for which they are granted or allowed;

(c) be responsible for the preparation of annual accounts and the budget of the University for the financial year and for presentation of the same to the Board of Management;

(d) monitor the flow of the cash and bank balance and keep a check on state investments;

(e) monitor the progress of collection of revenue and advise on the methods of collection employed;

(f) keep a vigil that the registers of building, land, furniture and equipment are maintained up-to-date and that the stock checking of equipment and other consumable material in all offices, teaching departments, colleges and institutions maintained by the University is conducted at regular intervals, or as may be required from time to time;

(g) call for any information or returns from any office or department or college or institution under the University as he may consider necessary to discharge his financial responsibilities.

(5) The receipt of the Finance Officer or of the person or persons duly authorized in this behalf by the Board of Management for any money payable to the University shall be sufficient discharge for the same.

6. Controller of Examinations.—The Controller of Examinations shall be a whole time salaried officer of the Cluster University and he shall be appointed by the Board of Management on the recommendations of Selection Committee constituted for the purpose.

7. Dean of Faculties.—(1) There shall be a Dean of each Faculty who shall be appointed by the Vice-Chancellor. The Deans shall be appointed in rotation, by seniority amongst all the Professors of the different departments or Institute(s)/School(s) or Centre(s) or Constituent Colleges comprising the Faculty for period of two years:

Provided that if in any faculty there is no Professor, the senior most Associate Professor of the different departments or Institute(s) or school(s)-centre(s) comprising the faculty shall act as the Dean of faculty and if there is no Associate Professor, the Vice-Chancellor shall make arrangements for the appointment of the Dean of Faculty:

Provided further, that if a Dean is on leave for a period of not less than two months, the Vice- Chancellor may appoint the next person eligible to become Dean of the Faculty concerned to act as Dean during the period of absence on leave of the regular Dean.

8. Dean of Students Welfare.—(1) The Dean of Students Welfare shall be appointed from amongst the employees of the Cluster University, who is or has been a teacher of the Cluster University or Constituent College, not below the rank of Professor or Associate Professor, by the Vice-Chancellor on the recommendations of Board of Management.

(2) The Dean of Students Welfare shall be regular employee of the Cluster University or Constituent College and shall hold office for a period of two years.

(3) When the office of the Dean of Students Welfare is vacant or when the Dean of Students Welfare is unable to perform the duties of his office by reason of illness, or is absent from duty for any other cause, the same shall be performed by such person as the Vice-Chancellor may appoint for the purpose.

(4) The terms and conditions of service and duties and powers of the Dean of Students Welfare shall be regulated by the Ordinances.

9. Other Officers of the University.—The manner of appointment of other officers of the Cluster University and their powers and functions shall be such as may be prescribed by the Statutes:

(a) Dean of Academic Affairs; (b) Dean of Colleges-cum-Director, College Development Council; (c) Chief Warden; and (d) Librarian

(a) Dean of Academic Affairs.—(i) The Dean Academic Affairs shall be appointed from amongst the employees of the Cluster University or Constituent Colleges, who are or have been teachers of the University, not below the rank of Professor by the Vice- Chancellor on the recommendation of the Board of Management.

(ii) The Dean, Academic Affairs shall be regular employee of the University and shall hold office for a period of two years.

(iii) When the office of the Dean, Academic Affairs is vacant or when the Dean, Academic Affairs is unable to perform the duties of his office by reason of illness or is absent from duty for any other cause the same shall be performed by such person as the Vice-Chancellor may appoint for the purpose.

(iv) The terms and conditions of service and duties and the powers of the Dean, Academic Affairs shall be regulated by the Ordinances.

(b) Dean of Colleges-cum-Director, College Development Council.—(i) The Dean of Colleges-cum-Director, College Development Council shall be appointed by the Vice Chancellor on the recommendation of the Vice-Chancellor on the recommendation of the Board of Management constituted for the purpose and shall be a whole time salaried officer of the University.

(ii) The Dean of Colleges-cum-Director, College Development Council shall be regular employee of the University and shall hold office for a period of two years.

(iii) When the office of the Dean of Colleges-cum-Director, College Development Council is vacant or when the Dean of Colleges-cum-Director, College Development Council is unable to7166 राजपत्र, हिमाचल प्रदेश, 05 फरवरी, 2021/16 माघ, 1942 perform the duties of his office by reason of illness or is absent from duty for any other cause, the same shall be performed by such person as the Vice- Chancellor may appoint for the purpose.

(iv) The terms and conditions of service and the duties and powers of the Dean of Colleges-cum-Director, College Development Council shall be regulated by the Ordinances.

(c) Chief Warden.—(i) The Chief Warden shall be appointed by the Vice- Chancellor from amongst the employees of the University, who are or have been teachers of the Cluster University or Constituent Colleges not below the rank of Professor or Associate Professor.

(ii) The Chief Warden shall be regular employee of the Cluster University or Constituent College and shall hold office for a period of two years.

(iii) When the office of the Chief Warden is vacant or when the Chief Warden, is unable to perform the duties of his office by reason of illness or is absent from duty for any other cause, the same shall be performed by such person as the Vice-Chancellor may appoint for the purpose.

(iv) The terms and condition of service and duties and powers of the Chief warden shall be regulated by the Ordinances.

(d) Librarian.—(i) The Librarian shall be appointed by the Vice Chancellor on the recommendation of the Selection Committee constituted for the purpose and shall be a whole-time salaried officer of the University.

(ii) When the office of the Librarian is vacant or when the Librarian is unable to perform the duties of his office by reason of illness or is absent from duty for any other cause, the same shall be performed by such person as the Vice-Chancellor may appoint for the purpose.

(iii) The terms and conditions of service and the duties and powers of the librarian shall be regulated by the Ordinances.

10. The Faculties.—(1) The Cluster University shall have such Faculties as may be specified by the subsequent statues.

(2) Each Faculty shall consist of such Academic Units as may be specified in the ordinances.

(3) No department shall be established or abolished except in accordance with the provisions as may be specified in the subsequent statutes.

11. Building and Works Committee.—The Building & Works' Committee shall consist of the following members, namely:—

Chairperson;

Vice-Chancellor Deputy Commissioner Mandi, District Mandi Member; Chief Engineer, H.P. Public Works Department, Mandi Member; Two Deans by way of rotation Members; Registrar Member; Finance Officer Member; Dean of Students Welfare Member; Executive Engineer, H.P. Public Works Department B & R Division Member; Mandi Cluster University. Deputy Registrar (Estate) Member-Secretary7167 राजपत्र, हिमाचल प्रदेश, 05 फरवरी, 2021/16 माघ, 1942 12. Condition for Affiliation/ Affiliation Privileges of the University.—(1) College and other institutions within the limits of the Cluster University, Mandi, Himachal Pradesh may be admitted to such privileges of the University as the Board of Management may decide on the following conditions, namely:—

(i) Every college or institution seeking privilege of affiliation or association shall have regularly constituted management, consisting of not more than twenty persons of which the composition shall be as provided in the Cluster University, Mandi, Himachal Pradesh Ordinances. The rules pertaining to all matters concerning the working and the management of the college or institution and those relating to the personnel of the management shall conform to the Statutes and the Ordinances of the University and also to the conditions of the Government grants. Such rules and personnel will require the approval of the Board of Management:

Provided that the said condition shall not apply in the case of colleges and institutions maintained by the Government. However, such colleges and institutions shall have an Advisory Committee which shall consist of, among others, at least three teachers including the Principal of the college or institution, and two representatives of the University.

(ii) As a condition of affiliation and association and continuation of such affiliation and association, management of every such college or institution shall satisfy the Board of Management on the following points, namely :—

(a) that the college or institution is established on a permanent and sound footing; (b) that it has the requisite land and buildings or funds necessary to acquire or construct the same;

(c) that it has adequacy of equipment for teaching; (d) that it has adequacy of teaching staff, its qualifications and conditions of service; (e) that it has arrangements for the residences, welfare, discipline and supervision of students;

(f) that an adequate financial provision is available for its efficient maintenance and functioning in the form of an endowment or a promise of grant-in-aid from the State Government or both; and

(g) such other matters as are essential for the maintenance of the standards of University education.

(iii) No college or institution shall be admitted to any privileges of the University except on the recommendations of a Committee of Inspection as may be provided in the Ordinances.

(iv) Organizations, colleges and institutions desirous of admission to any privileges of the University shall be required to intimate their intention to do so in writing so as to reach the Registrar not later than the date, as may be provided in the Ordinances.

(v) A college may not, without the permission of the Board of Management, suspend instructions in any subject or course of study which are in the curriculum of the University.

(vi) The University will consider the request of any private college or Institution only after the concurrence of Government is received along with the application for grant of affiliation and association.

(2) Appointments to the teaching staff of such college or institution shall be made on the recommendation of a Selection Committee as provided by the Ordinances :

Provided that the provisions of this clause shall not apply in the case of colleges and institutions maintained by the Government.

(3) Every such college and institution shall be inspected once in every year for the first three years following the grant of privilege of affiliation and association and thereafter at least once in every two years by a committee consisting of a nominee of the Chancellor, who shall be the Chairman thereof, Dean(s) of Faculty (ies) concerned and a nominee of the Vice-Chancellor. The report of the Committee shall be submitted to the Vice-Chancellor who shall forward the same to the Board of Management with any observations and recommendations as may deem fit. The Board of Management, after considering the observations and recommendations of the Vice-Chancellor shall cause a copy of report of the Committee to be forwarded to the management of the institution or college for such action as it may be pleased to direct.

(4) The Board of Management may withdraw any privileges granted to a college or institution, if at any time it considers that the college or institution is not fulfilling the requisite conditions:

Provided that before any privileges are so withdrawn the management shall be given an opportunity to represent to the Board of Management why such action shall not be taken.

(5) Subject to the conditions set forth above, the Ordinances may prescribe such other conditions as may be considered necessary and also the procedure for the admission of the colleges and institutions to the privileges of the University and for the withdrawal of these privileges.

13. Selection Committee.—(1) There shall be selection Committee for making recommendations to the Board of Management for appointment to the posts of Professors, Associate Professors, Assistant Professors, Registrar, Controller of Examinations, Finance Officer, Librarian, Dean of Colleges-cum-Director College Development Council, and Director, Physical Education & Youth Programme.

(2) Selection Committee shall consist of the Vice-Chancellor who will be the Chairman thereof, and in addition, the Selection Committees for making recommendations for appointment to a post specified in column 1 of the Table below shall have as its members the persons specified in the corresponding entry in column 2 of the said Table:

(3) Three members of the Selection Committee including the Chairman shall form the quorum, provided that one of them must be nominee of the Chancellor.

(4) The procedure to be followed by a Selection Committee in making recommendations shall be laid down in the Ordinances.

(5) Save as otherwise provided in these Statutes and Ordinances, if the Board of Management is unable to accept any recommendation made by the Selection Committee, it may remit the same to the Selection Committee for re- consideration and if the difference is not resolved, the Board of Management shall record its reasons and submit the case to the Chancellor for the final orders.

(6) Special mode of appointment - Notwithstanding anything contained in these Statutes;

(a) the Board of Management may invite a person of high academic distinction and professional attainment to accept a post of Professor or Associate Professor in the University as the case may be, on such terms and conditions as it may deem fit and on the person agreeing to do so, appoint him to the post :

Provided that the Vice-Chancellor may invite suitable person from among the senior Assistant Professors or Assistant Professors or Junior Assistant Professors working in a University or affiliated colleges or the University colleges to work in the University in the capacity of an Assistant Professor for a period not exceeding three years;

(b) that Board of Management shall also have power to make appointment of persons selected in accordance with the procedure laid down in sub-clauses (2) and (3) as teacher for a fixed tenure on such conditions as it deems fit to impose.

14. Honorary Degrees.—(1) All proposals for the conferment of Honorary Degrees shall be made by the Academic Council to the Board of Management and shall require the assent of the Governing Body before submission to the Chancellor for confirmation:

Provided that, in cases of urgency, the Chancellor may act on the recommendations of the Vice- Chancellor only.

(2) Any Honorary Degree conferred by the University may with the prior approval of two third members of the Governing Body and the sanction of the Chancellor, be withdrawn by the Board of Management.

15. Removal of Teachers.—(1) Where there is allegation of misconduct against a teacher the Vice-Chancellor may, if he thinks it fit, by order in writing place the teacher under suspension and shall forthwith report to the Board of Management the circumstances in which the order was made:

Provided that the Board of Management may, if it is of the opinion that the circumstances of the case do not warrant the suspension of the teacher, revoke that order.

(2) Notwithstanding anything contained in the terms of their contract or service or of their appointment, the Board of Management shall be entitled to remove a teacher on grounds of misconduct.

(3) Save as aforesaid, the Board of Management shall not be entitled to remove a teacher except for good and sufficient cause and after giving three months' notice in writing or payment of three months' salary in lieu of notice if the teacher is confirmed and one months' salary if he is still temporary.

(4) No teacher shall be removed under clause (2) or under clause (3) until he has been given a reasonable opportunity of showing cause against the action to be taken in regard to him.

(5) The removal of a teacher shall require a two-third majority of the members of the Board of Management present and voting.

(6) The removal of a teacher shall take effect from the date on which the order of removal is made:

Provided that where a teacher is under suspension at the time of his removal, the removal shall take effect on the date on which he was placed under suspension.

(7) Notwithstanding anything contained in these Statutes, the teacher shall be entitled to resign by giving three months' notice to the Board of Management if he is confirmed and one months' notice if he is not:

Provided that appointing authority, in any case, may relax or condone the notice period, at its discretion keeping in view the administrative convenience.

(8) Notwithstanding anything else contained in these Rules, Regulation, Statutes, Ordinances, an official, on whom a major penalty has been imposed by the Board of Management, may appeal to the Chancellor against such order within three months of the communication of the order to him.

Explanation.—For the purpose of Rules, Regulation, Statute, Ordinance, any of the following penalties will be treated as a major penalty—

(i) Withholding of increment(s) with cumulative effect ;

(ii) Reduction to a lower post or time scale or to a lower stage in the time scale ;

(iii) Compulsory retirement ;

(iv) Removal from service ;

(v) Dismissal.

16. Removal of employees other than teachers.—(1)Notwithstanding anything contained in the terms of his contract of service or of his appointment, an employee of the university, other than a teacher, may be removed by the authority which is competent to appoint the employee—

(a) if he is of unsound mind and so declared by a Competent Authority;

(b) if he is un-discharged insolvent;

(c) if he has been convicted by a court of law for any offence involving moral turpitude and sentenced in respect thereof;

(d) if he is otherwise guilty of misconduct.

(2) No such employee shall be removed under clause (1) until he has been given a reasonable opportunity to show cause against the action proposed to be taken in regard to him.

(3) Where the removal of such employee is for a reason other than that specified in sub- clause (c) or sub-clause (d) of clause (1) he shall be given three months notice in writing or paid three months salary in lieu of notice.

(4) Notwithstanding anything contained in these Statutes, an employee of the University not being a teacher shall be entitled to resign;

(i) in case of permanent employee after giving three months notice in writing to the appointing authority or paying to the University three months salary in lieu thereof;

(ii) in any other case, after giving one month's notice in writing to the appointing authority or paying to the University one month's salary in lieu thereof:

Provided that the appointing authority in any case, may relax/condone the notice period, at its discretion, keeping in view the administrative convenience.

(5) Notwithstanding anything else contained in Rules/Regulation/Statutes/ Ordinances, an official, on whom a major penalty has been imposed by the Executive Council, may appeal to the Chancellor against such order within three months' of the communication of the order to him.

Explanation.—For the purpose of Rules/Regulations/Statutes/Ordinances, any of the following penalties will be treated as a major penalty:

(i) Withholding of increment(s) with cumulative effect ;

(ii) Reduction to a lower post or time scale or to a lower stage in the time scale ;

(iii) Compulsory retirement ;

(iv) Removal from service ;

(v) Dismissal.

17. Maintenance of Discipline among students of the University.—(1) All powers relating to discipline and disciplinary action shall vest in the Vice-Chancellor.

(2) The Vice Chancellor may delegate all or such powers as he deems proper to such other persons as he may specify in this behalf.

(3) Without prejudice to the generality of power to enforce discipline under these Statute, the following will amount to act of gross indiscipline-

(a) Physical assault, or threat to use physical force, against any member of the teaching or non- teaching staff of any institution, department or against any student within the Sardar Vallabhbhai Patel Cluster University;

(b) carrying or use of, or threat of use of any weapon;

(c) any violation of the provisions of the Civil Rights Protection Act, 1976;

(d) violation of the status, dignity and honour of students belonging to the schedule castes and tribes;

(e) any practice whether verbal or otherwise derogatory of women;

(f) any attempt at bribing or corruption in any manner;

(g) willful destruction of institution and property;

(h) creating ill-will or intolerance on religious or communal grounds;

(i) causing disruption in any manner of the academic functioning of the University system;

(j) ragging.

(4) Without prejudice to the generality of his power relating to the maintenance of discipline and taking such action in the interest of maintaining discipline as may seem to him appropriate, the Vice-Chancellor, may in the exercise of his powers aforesaid order or direct- (a) that any student or students be expelled; or

(b) any student or students be, for a stated period, rusticated; or

(c) any student should not for a specific period, admitted to a course or courses of study in a college, department or institution of the University; or

(d) be fined with a sum of rupees that may be specified; or

(e) be debarred from taking a University or college or departmental examination or examinations for one or more years ; or

(f) that the result of the student or students concerned in the examination or examinations in which they have appeared be cancelled.

(5) The Principals of the colleges, Heads of halls, Deans of the faculties, Heads of teaching departments in the University and the Librarian, Dean Students Welfare, Dean of Academic Affairs, Chief Warden and Wardens of Hostels shall have the authority to exercise all such disciplinary powers over students in their respective colleges, faculties and teaching departments, class rooms, laboratories, Libraries within the premises of the Cluster University, Constituent Colleges, the Colleges within the control of the Sardar Vallabhbhai Patel Cluster7173 राजपत्र, हिमाचल प्रदेश, 05 फरवरी, 2021/16 माघ, 1942 University, as may be necessary for the proper conduct of institution, halls and teaching in the concerned departments. They may delegate authority to, such of the teachers or a Committee of the teachers, in their colleges, institutions or departments as they may specify for these purposes.

(6) Without prejudice to the powers of the Vice-Chancellor and the person to whom powers are delegated under Clause (2) of Rule 18 detailed rules of discipline and proper conduct shall be framed. These rules may be supplemented, where necessary, by the Principals of colleges, Heads of halls, Deans of faculties and Heads of teaching departments in this University. Every student shall be required to sign a declaration that on admission they submit themselves to the disciplinary jurisdiction of the Vice- Chancellor and the several authorities of the University who may be vested with the authority to exercise discipline under the Act, the Statutes, the regulations and the rules that have been or may be framed here under by the University.

18. Prohibition of and Punishment for Ragging.—(1) Ragging in any form is strictly prohibited, within or outside the premises of a hostel, college, department or institution and any part of the Sardar Vallabhbhai Patel Cluster University system as well as on a public place or transport in its vicinity.

(2) Any individual or collective act or practice of ragging constitutes gross indiscipline and shall be dealt with under the Statute.

(3) Ragging for the purposes of this Statute, ordinarily means any act, conduct or practice by which dominant power or status of senior students is brought to bear on students freshly enrolled or students who are in any way considered junior or inferior by other students and includes individual or collective acts or practices which :

(a) involve physical assault or threat or use of physical force; (b) violate the status, dignity and honour of women students; (c) violate the status, dignity and honour of students belonging to the scheduled castes and tribes;

(d) expose students to ridicule and contempt and affect their self-esteem; (e) entail verbal abuse and aggression, indecent gestures and obscene behaviour.

(4) The Principal of college, the Head of the department or institution, the authorities of college, or the University Hostel or Halls of residence shall take immediate action on any information of the occurrence of ragging.

(5) Notwithstanding anything contained in clause (4), the person to whom powers are delegated under Clause 2 of Rule 18 may also suo moto enquire into any incident of ragging and make a report to the Vice- Chancellor of the identity of those who have engaged in ragging and the nature of the incident.

(6) The person to whom powers are delegated under Clause 2 of Rule 18 may also submit an initial report establishing the identity of the perpetrators of ragging and the nature of ragging incident.

(7) If the Principal of a college or Head of the department or institution or person to whom powers are delegated under Clause 2 of Rule 18 is satisfied for some reasons to be recorded in writing, that it is not reasonably practical to hold such an enquiry, they may so advise the Vice- Chancellor accordingly.

(8) When Vice-Chancellor is satisfied that it is not expedient to hold such an enquiry his decision shall be final.

(9) On the receipt of a report under Clause(5) or (6) or on determination by the relevant authority under clause (7) disclosing the occurrence of ragging incidents described in sub-clause (a), (b) and (c) of clause (3), the Vice-Chancellor shall direct or order rustication of a student or students for a specific number of years.

(10) The Vice-Chancellor may in other cases of ragging order or direct any student or students to be expelled or to be not admitted for a specific period to a course of study in college, departmental examination for one or more years or that the results of the student or students in the examinations in which they appeared be cancelled.

(11) In case where students who have obtained degrees or diplomas of the University are found guilty under this Statute, appropriate action will be taken under section 7(d) of the Act for withdrawal of degrees or diplomas conferred by the University.

(12) For the purpose of this Statute, abetment to ragging will also amount to ragging.

(13) All institutions, within the University, shall carry out instructions, directions issued under this Statute, and to give aid and assistance to the Vice-Chancellor to achieve the effective implementation of the Statute.

(14) It shall be the duty of the Vice-Chancellor to present annually to the Board of Management of the University, a report as to the steps taken by him to control and curb the evil of ragging in the University, and where incident of ragging has been reported and any lenient view has been taken, he shall cause the details thereof, together with a memorandum explaining the reasons for taking such lenient view, to be laid down before the Board of Management of the University. The Vice- Chancellor shall also ensure that the report submitted to the Board of Management under this clause shall be included in the annual report to be prepared under section 50 of the Act. 19. Seniority, Eligibility for the Membership of University Bodies.—(1) Save as otherwise specifically provided in these Statutes and Ordinance, whenever, in accordance with these Statutes, any person is to hold an office or be a member of any authority of the University by rotation, according to seniority, such seniority shall mean the inter-se-seniority as determined by the University or by the Government as the case may be:

Provided that the teachers appointed on part time basis (whether honorary or otherwise) shall not be eligible to be members of any authority or body of the University. However, teachers appointed in an honorary capacity or on special terms and working on full time basis shall be eligible.

(2) It shall be the duty of the Registrar to prepare and maintain, in respect of such class of persons to whom the provisions of this Statute apply, a complete and up-to-date seniority list in accordance with the provisions of the foregoing clause.

(3) If two or more persons have equal length of continuous service in a particular post, or the relative seniority of any person or persons is otherwise in doubt, the Registrar may on his own motion, and shall, at the request of any such person, submit the matter to the Board of Management whose decision thereon shall be final.

(4) Notwithstanding anything contained in these Statutes no person who is not ordinarily resident in India shall be eligible to be an officer of the University or a member of any Authority of the University.

20. Committees.—The Governing Body or Board of Management or Academic Council and any other authority of the University may appoint boards or committees or members of the7175 राजपत्र, हिमाचल प्रदेश, 05 फरवरी, 2021/16 माघ, 1942 authority making such appointment and such other persons (if any) as that authority in each case may think fit; and any such board or committee may deal with any subject assigned to it, subject to subsequent confirmation by the authority which appointed it.

21. Elected Chairman to preside where no provision is made in Statutes.—Where, by the Act, the Statutes, or the Ordinances, no provision is made for a Chairman to preside over a meeting of any University, Board or Committee, or where the Chairman so authorized is absent the members present shall elect the Chairman from among themselves to preside at the meeting.

22. Resignation.—(1) Any member, other than an ex-officio member, of the Board of Management, the academic Council or any other Authority of the University or Committee may resign by letter addressed to the Registrar and the resignation shall take effect as soon as letter is received by the Registrar or the authority competent to fill the vacancy.

(2) Any officer of the University (whether salaried or otherwise) may resign their office by letter addressed to the Registrar:

Provided that such resignation shall take effect only on the date from which the same is accepted by the authority competent to fill the vacancy.

(3) If any member of any authority of the University ceases to be a member of the body to which he has been elected or nominated or appointed, he shall cease to be the member of that authority.

23. The procedure for arbitration.—(1) Any dispute arising between the University and an employee of the Cluster University and the same not being decided for a period more than one year, shall, on the request of either party be referred to an Arbitral Tribunal for decision, which shall consist of the following:—

(i) a Chairperson nominated by the Chancellor;

(ii) one person nominated by the Board of Management; and

(iii) one person nominated by the employee concerned.

(2) The University shall furnish any record, report or other information called for by the Arbitral Tribunal to discharge its function in an efficient manner.

(3) The decision of the Arbitral Tribunal shall be final and no suit shall lie in any civil court in respect of the matter decided by it.

(4) Any student or candidate for an examination whose name has been removed from the rolls of the University by the orders or resolution of the Vice-Chancellor, Discipline Committee or Examination Committee, as the case may be, and who has been debarred from appearing at the examination of the University for more than one year, may, within ten days of the date of receipt of such orders or copy of such resolution by him, appeal to the Chancellor and the Chancellor may confirm, modify or reverse the decision of the Vice Chancellor or the Committee, as the case may be, and any dispute arising out of any disciplinary action taken by the University against a student shall, at the request of such student, be referred to the Arbitral Tribunal in the manner as may be specified in the ordinances/regulations.

(5) Every employee or students of the University or any Academic Unit shall, notwithstanding anything contained in the Act, have a right to appeal within such time as may be7176 राजपत्र, हिमाचल प्रदेश, 05 फरवरी, 2021/16 माघ, 1942 specified by the subsequent statutes, to the Chancellor against the decision of any officer or authority, as the case may be, and thereupon, the Chancellor may confirm, modify or reverse the decision appealed against.

(6) All disputes shall be subject to jurisdiction of the Civil Courts Mandi, District Mandi, Himachal Pradesh.

(7) No suit or other legal proceedings shall lie against any officer or employee of the University for anything which is in good faith done or intended to be done in pursuance of any of the provisions of the Act ibid or these statutes or the ordinances made under the said Act. 24. Provisions regarding fee to be charged from the students.—(1) The fee structure of the University shall be decided as per the provisions of Section 43 of the Act.

(2) The fee shall be charged on semester/ annual basis and time schedule for collecting the fee shall be notified in the prospectus.

25. Provisions regarding number of seats in different courses.—(1) Total number of seats in different courses shall be decided by the Academic Council and approved by the Chancellor. However, reservation of seats for different categories in each course shall be kept as per prevalent Government rules and vacancies in different categories may be filled by open category candidates.

(2) Number of seats in different courses may be increased or decreased at the discretion of the Academic Council subject to approval of the Vice- Chancellor.

(3) The allocation of seats in different courses shall be decided by the Academic Council with the approval of the Chancellor.

26. Admission and reservation.—(1) The basis of admission in all courses of study shall be on merit to be determined by a competitive examination, or on the basis of the qualifying examination in accordance with the rules framed by the Board of Management (BOM) of the university in this regard.

(2) Admission to the various courses of study shall be open to all persons, irrespective of race, creed, caste or class subject to the following conditions, namely:—

(a) 15% and 7.5% of the seats of the total seats shall be reserved for bonafide Himachali Schedule Castes and Schedule Tribes candidates respectively who have passed their qualifying examination from H.P. University, Sardar Vallabhbhai Patel University or Krishi Vishvavidyalaya or Dr. Y.S. Parmar University of Horticulture and Forestry or from any other University established by law in India which is equivalent to the qualifying examination of Sardar Vallabhbhai Patel Cluster University.

(b) The remaining 77 ½% seats shall be filled as under:—

(i) 2.5% of seats shall be open to all the candidates irrespective of the institution from where they have passed their qualifying examination.

(ii) 75% of the seats shall be filled out of the candidates who have passed their qualifying examination from H.P. University, Sardar Vallabhbhai Patel Cluster University or Himachal Pradesh Krishi Vishvavidayalaya or Dr. Y.S. Parmar7177 राजपत्र, हिमाचल प्रदेश, 05 फरवरी, 2021/16 माघ, 1942 University of Horticulture and Forestry, Himachal Pradesh Technical University, Central University of Himachal Pradesh and any other University situated in Himachal Pradesh or the candidates who are Himachal Pradesh domicile irrespective of passing qualifying examination from any other University established by law in India which is equivalent to the qualifying examinations of Sardar Vallabhbhai Patel Cluster University, subject to the following reservations.

(a) 5% of the seats shall be reserved for outstanding sportsperson; (b) 5% of the seats shall be reserved for outstanding cultural activists; and (c) 3% seats shall be reserved for Persons with Disabilities except in the Department of Physical Education.

(3) The Minimum qualification for admission to a course in case of candidates belonging to scheduled castes & scheduled tribes categories shall be relaxed by 5% of the maximum marks. The admission to these reserved seats as stated at (a), (b) & (c) to para (ii) of clause (b) above shall be made as per procedure/rules approved by the Board of Management from time to time.

27. Exemption to Students from Payment of Tuition Fee and Award of Scholarships

and Fellowships:

1. Freeships and Exemptions From Payment of Fee.—

(a) Freeships in tuition fee shall be granted on the basis of poverty to the extent of 10 per cent full freeships and 15 per cent half freeships to the total strength of a class/course.

(b) Brother Sister Freeship: The student younger in age will be given half freeship if his or her elder brother or sister is also studying in the University and paying full fee.

(c) Tuition Fee Exemption for Girl Students: All girl students will be provided tuition fee exemption in both undergraduate and post-graduation courses as per notification of Government of Himachal Pradesh in this regards from time to time.

2. Scholarships and Fellowships.—All awards of Fellowships, Scholarships, Medals and Prizes including those specifically earmarked for a particular category shall be given on the basis of merit determined under the rules laid down in the Ordinances.

Freeships and stipends shall, however, be awarded on the basis of poverty cum-merit.

The fellowships may be divided into the following categories:

(a) Sardar Vallabhbhai Patel Cluster University Senior Fellowship- for two years for Post- Doctoral Research (it may, however, be awarded for a period of less than two years if the candidate so proposes).

(b) Sardar Vallabhbhai Patel University Junior Research fellowship Ph.D. (Ph.D.

course work and LL.M).

3. Merit Wise, Sports and Cultural Scholarships for Post Graduate Students.—The University shall provide post graduate centres scholarships based on subject-wise merit scholarships, group wise merit scholarships, sports scholarships and cultural activist scholarships for post graduate students.

4. The amount of scholarships shall be as approved by the Board of Management and Finance Committee from time to time.

प्रार्थिया श्रीमती कौशल्या देवी पुत्री श्री चौधरी, निवासी गांव वहल वागडू, डाकघर मझीण, तहसील खुण्डियां, जिला कांगड़ा, हिमाचल प्रदेश ने स्वयं उपस्थित होकर प्रार्थना-पत्र प्रस्तुत किया कि उसका जन्म दिनांक 01-01-1938 को गांव वहल वागडू, डाकघर मझीण, तहसील खुण्डियां में हुआ है का पंजीकरण कानून की जानकारी न होने के कारण ग्राम पंचायत मझीण के अभिलेख में दर्ज न हुआ है अतः जन्म तिथि का पंजीकरण ग्राम पंचायत मझीण के अभिलेख में दर्ज किया जायेे।

अतः सर्वसाधारण को सुनवाई हेतु बजरिया इश्तहार व मुस्त्री मुनादी द्वारा सूचित किया जाता है कि इस सम्बन्ध में किसी प्रकार का उजर/एतराज हो तो वह दिनांक 23-02-2021 को असालतन व वकालतन पेश होकर अपना एतराज दर्ज करवा सकता है। उसके उपरान्त कोई भी उजर/एतराज जेरे समायत न होगा तथा श्रीमती कौशल्या देवी पुत्री श्री चौधरी, निवासी गांव वहल वागडू, डाकघर मझीण, तहसील खुण्डियां की जन्म तिथि का पंजीकरण दिनांक 01-01-1938 जेरे धारा 13(3) जन्म एवं मृत्यु पंजीकरण अधिनियम, 1969 के तहत ग्राम पंचायत मझीण के अभिलेख में दर्ज करने के आदेश पारित कर दिये जायेंगे।

आज दिनांक 23-01-2021 को मेरे हस्ताक्षर व मोहर अदालत से जारी हुआ।

श्री अमनदीप जसवाल पुत्र श्री रोशन लाल, वासी गांव अठवां, तहसील अम्ब, जिला ऊना (हि0 प्र0) ने एक दरख्वास्त प्रस्तुत की है जिसमें उसने लिखा है कि उसकी शादी श्रीमती आँचल पुत्री श्री धरम पाल, वासी गांव अन्दौरा, तहसील अम्ब, जिला ऊना में दिनांक 24-09-2020 को मुताबिक हिन्दू रीति-रिवाज के साथ हुई है का पंजीकरण किया जाकर उसे शादी प्रमाण-पत्र दिया जावे।

अतः इस नोटिस के माध्यम से समस्त जनता तथा सम्बन्धित रिश्तेदारों को सूचित किया जाता है कि यदि किसी को शादी पंजीकरण बारे कोई एतराज/आपत्ति हो तो वह दिनांक 23-02-2021 को प्रातः 10.00 बजे या उससे पहले असालतन या वकालतन हाजिर अदालत होकर अपनी स्थिति/एतराज प्रस्तुत कर सकता है। निश्चित तिथि पर कोई एतराज प्राप्त न होने की सूरत में प्रार्थी की शादी पंजीकरण प्रमाण-पत्र जारी कर दिया जायेगा। अतः बाद में कोई उजर काबिले समायत न होगा।

आज दिनांक 28-01-2021 को मेरे हस्ताक्षर व मोहर अदालत द्वारा जारी हुआ है।
