संख्या गृह(ए)ए(3)-2/2020.-प्रारूप हिमाचल प्रदेश पुलिस विभाग (कांस्टेबल की भर्ती) नियम, 2021 को हिमाचल प्रदेश पुलिस अधिनियम, 2007 (2007 का अधिनियम संख्यांक 17) की धारा 23 के साथ पठित धारा 141 की उपधारा (1) के अधीन यथा अपेक्षानुसार तद्‌द्वारा सम्भाव्य प्रभावित होने वाले व्यक्ति (व्यक्तियों) 76—राजपत्र/2021-09-08-2021 (2415) 2416 राजपत्र, हिमाचल प्रदेश, 09 अगस्त, 2021/18 श्रावण, 1943 से आक्षेप(पों) और सुझाव(वों) को आमंत्रित करने के लिए, इस विभाग की समसंख्यक अधिसूचना, तारीख 05-05-2021 द्वारा राजपत्र (ई-गजट) हिमाचल प्रदेश में प्रकाशित किया गया था;

और राज्य सरकार को इस निमित्त नियत अवधि के भीतर आक्षेप और सुझाव प्राप्त हुए हैं और उन पर सम्यक रूप से विचार किया गया है;

अतः हिमाचल प्रदेश के राज्यपाल, हिमाचल प्रदेश पुलिस अधिनियम, 2007 (2007 का अधिनियम संख्यांक 17) की धारा 23 के साथ पठित धारा 141 की उप-धारा(1) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए निम्नलिखित नियम बनाते हैं, अर्थात्‌ :-

भाग-I

1. संक्षिप्त नाम और प्रारम्भ.-(1) इन नियमों का संि क्षप्त नाम हिमाचल प्रदेश पुलिस विभाग (कांस्टबेबल की भर्ती) नियम, 2021 ैं ।

(2) ये नियम राजपत्र (इर्- गजट), हिमाचल प्रदश्े ा में प्रकाशित किए जाने की तारीख से प्रवृत्त होंगे। 2. निरसन और व्यावृत्तियां.-(1) इस विभाग की अधिसूचना संख्या गृह (ए)ए(3)-1/2005-पार्ट, तारीख 11-माचर्- 2011 द्वारा अधिसूचित और तारीख 12 मार्च, 2011 को राजपत्र, हिमाचल प्रदेश में प्रकाशित पजं ाब पुलिस (हिमाचल प्रदश्े ा सश्ं ााध्े ान) नियम, 2011 का एतद्‌द्वारा निरसन किया जाता है। (2) ऐसे निरसन के होते हुए भी उपर्युक्त उप-नियम (1) के अधीन इस प्रकार निरसित नियमों के अधीन की गई काइे र् नियुक्ति, बात या कार्रवाई इन नियमों के अधीन विधिमान्य रूप में की गई समझी जाएगी।

भाग-II

3. कांस्टबे ल की भर्ती.-भर्ती वर्ष में एक बार या ऐसे अन्तराल जैसा रिक्तियों के आधार पर यथा अपेि क्षत सुनिश्चित (निर्धारित) किया जाए, शतप्रतिशत नियमित आधार पर की जाएगी।

4. पदों की सख्ं या और प्रभाजन.- (1) पदों की संख्या ऐसी होगी, जैसी सरकार द्वारा समय-समय पर अवधारित/सृजित की जाए।

(2) कांस्टबे ल के पद, जिले की जनसंख्या के अनुपात के आधार पर भरे जाएंग।े महिला अभ्यर्थियों को पच्चीस प्रतिशत (25%) क्षैतिज (हॉरिजॉनटल) आरक्षण प्रदान किया जाएगा और अन्य प्रवर्गों को उपलब्ध ऊध्र्वाधर आरक्षण सहित क्षैतिज आरक्षण के समस्त प्रवर्गों में पृथकतः भरा जाएगा।

5. नियुक्ति प्राधिकारी.-बटालियन के कमॉडटें नियुक्ति प्राधिकारी हागें ।े

6. वेतन और भत्ते.-कर्मचारी ऐसे वेतन और भत्ते आहरित करेगा जैसा राज्य सरकार द्वारा समय-समय पर इस निमित्त अवधारित किए जाएं।

7. आरक्षण.-(1) अनुसूचित जाति/अनुसूचित जनजाति/अन्य पिछड़ा वर्ग के मध्य ऊध्र्वाधर आरक्षण सरकार द्वारा समय-समय पर इस विषय पर जारी अनुदेशों के अनुसार किया जाएगा। इसके अतिरिक्त, आर्थिक रूप से कमजोर वर्ग (ई0 डब्लू0 एस0), जो अनुसूचित जातियों, अनुसूचित जनजातियों और अन्य पिछड़े वर्गों के लिए आरक्षण की स्कीम के अन्तर्गत नहीं आते हैं, को सीधी भर्ती में दस प्रतिशत ऊध्र्वाधर आरक्षण प्रदान किया जाएगा। महिलाओं, भूतपूर्व सैनिकों, स्वतन्त्रता सैनानियों के प्रतिपाल्यों (वार्डों), अन्तोदय,2417 राजपत्र, हिमाचल प्रदेश, 09 अगस्त, 2021/18 श्रावण, 1943 बीपीएल, विशिष्ट खिलाड़ियों और गृह रक्षकों के लिए विशेष क्षैतिज (हॉरिजन्टल) आरक्षण सरकार द्वारा समय-समय पर जारी अनुदशों के अनुसार प्रदान किया जाएगा।

(2) यदि ऊध्र्वाधर या क्षैतिज हॉरिजोनटल आरक्षण के अधीन आरक्षित पद को उस प्रवर्ग से नहीं भरा जाता है, तो उस पद को रिक्त रखा जाएगा और मामला जिला भर्ती समिति के अध्यक्ष द्वारा पुलिस महानिदेशक को अगे्रषित किया जाएगा, जो नियमों का और राज्य सरकार के कार्मिक विभाग द्वारा इस बाबत जारी अनुदेशों का अनुसरण करेंगे।

(3) भूतपूर्व सैनिकों की रिक्तियों के लिए अध्यपेक्षा को जिला भर्ती समिति के अध्यक्ष द्वारा सचिव, भूतपूर्व सैनिक सैल, हमीरपुर को नाम प्रेषित/प्रायोजित करने के लिए भेजा जाएगा। अध्यपेक्षा में प्रत्येक जिला के लिए पदों की संख्या विनिर्दिष्ट की जाएगी और नामों को तदनुसार प्रायोजित किया जाएगा।

(4) भूतपूर्व सैनिकों के लिए आरक्षित रिक्ति के विरूद्ध उपयुक्त/पात्र अभ्यर्थी की अनुपलब्धता की दशा में, रिक्ति को आगामी दो कलेंडर वर्षों के लिए अग्रनीत किया जाएगा और तृतीय वर्ष में उक्त रिक्ति को भूतपूर्व-सैनिकों के आश्रित पुत्रों/पुत्रियों और पत्नियों में से भरा जाएगा। यदि तृतीय वर्ष में पात्र/उपुयक्त अभ्यर्थी, जिनके लिए रिक्त पद आरक्षित हैं, उपलब्ध नहीं हो तो उसे संबंधित अवशिष्ट प्रवर्ग, जिसके हेतुक उस वर्ष बिन्दु स्वतः सम्बन्धित है, में से भरा जाएगा। जब यह स्पष्ट हो कि भूतपूर्व-सैनिक के पदों के किसी प्रवर्ग की नियुक्ति हेतु किसी भी कारण से उपलब्ध नहीं होगा तो भूतपूर्व-सैनिकों के लिए इस प्रकार आरक्षित पदों को भूतपूर्व-सैनिक सैल, हिमाचल प्रदेश की पूर्व सहमति से भूतपूर्व-सैनिकों के आश्रित पुत्रों, पुत्रियों और पत्नियों में से भरा जा सकेगा। यदि भरे जाने वाले प्राधिकृत पदों हेतु भूतपूर्व-सैनिकों के पुत्र, पुत्रियां और पत्नियां उपलब्ध न हों तो आरक्षण को आगामी दो कैलेण्डर वर्षों के लिए अग्रनीत किया जाएगा, जिसके पश्चात्‌ रिक्ति को संबंंिधत अवशिष्ट प्रवर्ग, जिसके हेतुक बिन्दु सम्बन्धित है, में से भरा जाएगा।

8. पात्रत.-(1) शैक्षिक और अन्य अर्हताएं तथा शारीरिक मानदण्ड निम्न प्रकार से होंगें :-

2418 राजपत्र, हिमाचल प्रदेश, 09 अगस्त, 2021/18 श्रावण, 1943 परंतु यह शर्त हिमाचल के वास्तविक निवासी को लागू नहीं होगी।

9. आवेदन आमन्त्रित करने के लिए प्रक्रिया.-(1) भर्ती अग्रणी दैनिक समाचार पत्रांें, जिनमें से कम-से-कम एक स्थानीय भाषा का होगा, में विज्ञापन के माध्यम से की जाएगी। आकाशवाणी के स्थानीय चैनलों के माध्यम से भी व्यापक प्रचार किया जाएगा। अभ्यर्थियों से ऑनलाइन आवेदन भी मंगवाए जाएंगंें जो शैक्षिक और अन्य अर्हताएं परिपूर्ण करते हों। केवल वही अभ्यर्थी आवेदन कर सकेंगेे जो समाचार पत्र में विज्ञापन के प्रकाशन की तारीख को हिमाचल के वास्तविक निवासी हैं। विज्ञापन में, प्रत्येक प्रवर्ग में पृथकतः पुरूष तथा महिला अभ्यर्थियों के लिए आरक्षित रिक्तियों सहित आयु, शैक्षिक और अन्य अर्हताएं तथा शारीरिक मानदण्ड और जिलावार रिक्तियों की संभाव्य संख्या विनिर्दिष्ट की जाएगी।

(2) सामान्य अभ्यर्थियों से ऐसा प्रसंस्करण शुल्क, जैसा पुलिस महानिदेशक द्वारा समय-समय पर अवधारित किया जाए, प्रभारित किया जाएगा और इस फीस (शुल्क) का एक-चौथाई भाग अनुसूचित जाति /अनुसूचित जनजाति, अन्य पिछड़ा वर्ग/महिला, बी0पी0एल0/अन्तोदया और आर्थिक रूप से कमजोर वर्गों (ई0डब्ल्य0ू एस0) से सम्बन्धित आवदेकोंं से प्रभारित किया जाएगा। अभ्यर्थियों से इस प्रकार एकत्रित की गई प्रसंस्करण फीस की रकम का उपयोग विभाग द्वारा भर्ती के संबंध में उपगत किए गए व्यय की पूर्ति के लिए किया जाएगा। इस प्रायोजन के लिए, हिमाचल प्रदेश पुलिस भर्ती बोर्ड द्वारा एक पृथक बैंक लेखा संचालित किया जाएगा। अतिरिक्त पुलिस महानिदेशक, सशस्त्र पुलिस और प्रशिक्षण इस बोर्ड का अध्यक्ष होगा। समस्त महानिरीक्षक/परिक्षेत्रों के उप-महानिरीक्षक और महानिरीक्षक (प्रशासन और कल्याण) इस बोर्ड के सदस्य हाेंगे। यह बोर्ड भर्ती प्रक्रिया के सम्पूर्ण पर्यवेक्षण हेतु उत्तरदायी होगा।

10. ऑनलाइन आवेदन प्रक्रिया.- 10 अभ्यर्थी, कांस्टेबल के पद के लिए ऑनलाइन भर्ती आवेदन (ओ0 आर0 ए0) भरने से पूर्व अनुदेशों को ध्यानपूर्वक पढें़गे जो पुलिस विभाग की वेबसाइट http://www.recruitment.hppolice.gov.in पर भी उपलब्ध हैं। अपेक्षित परीक्षा फीस, स्कैन्ड फोटोग्रॉफ और विहित आकार के स्कैन्ड हस्ताक्षरों के बिना प्रस्तुत किए गए अपूर्ण ऑनलाइन भर्ती आवेदन सीधे तौर पर अस्वीकृत किए जाएंगे। ऑनलाइन भर्ती आवेदन पर केवल उस जिला, जिसमें अभ्यर्थी द्वारा प्राप्त किए गए वास्तविक हिमाचली प्रमाणपत्र के अनुसार आवेदक साधारणतया निवासी है, की रिक्तियों के संबंध में ही विचार किया जाएगा। ऑनलाइन भर्ती आवेदन के साथ कोई भी प्रमाणपत्र या प्रमाण-पत्रों की प्रतियां संलग्न नहीं की जाएगी। इसके स्थान पर प्रत्येक अभ्यर्थी स्वयं यह कथन करेगा कि ऑनलाइन भर्ती आवेदन मे उसके द्वारा प्रस्तुत की गई सूचना सत्य और सही है। मूल प्रमाण पत्रों का वास्तविक सत्यापन केवल उन अभ्यर्थियों की बाबत ही किया जाएगा, जो 'मूल्यांकन' हेतु बुलाए जातेे हैं और कोई अभ्यर्थी जिसने गलत या मिथ्या घोषणा की है, उस स्तर पर स्वतः ही निरर्हित हो जाएगा। किसी अभ्यर्थी को केवल वास्तविक हिमाचली प्रमाण-पत्र में उसके निवास के रूप में दर्शाए जिला में रिक्ति के विरूद्ध ही विचारा जाएगा। आरक्षण का लाभ लेने हेतु किसी अभ्यर्थी के प्रवर्ग की घोषणा की अंतिम (कट ऑफ) तारीख भर्ती नोटिस/विज्ञापन में दर्शाई जाएगी और तत्पश्चात्‌ प्रवर्ग में किसी भी प्रकार का परिवर्तन अनुज्ञात नहीं किया जाएगा।

11. जिला भर्ती समिति.-(1) भर्ती, प्रत्येक जिला मुख्यालय में समिति द्वारा संचालित की जाएगी, जिसकी अध्यक्षता परिक्षेत्र महानिरीक्षक/उप-महानिरीक्षक द्वारा की जाएगी और इसके अन्य सदस्यों में पुलिस महानिदेशक द्वारा यथा नामनिर्दिष्ट राज्य पुलिस बटालियन का एक कमांडेंट, जिला पुलिस अधीक्षक और सम्बद्ध जिला के मुख्य चिकित्सा अधिकारी द्वारा नामनिर्दिष्ट किए जाने वाला एक चिकित्सा अधिकारी होगा। समिति, अनुसूचित जाति/अनुसूचित जनजाति, यदि इन प्रवर्गों का समिति मेंं कोई प्रतिनिधित्व नही है, से संबंधित किसी राजपत्रित अधिकारी को सहयोजित करेगी। समिति, भर्ती प्रक्रिया में इसकी सहायता हेतु राजपत्रित अधिकारियों/अराजपत्रित अधिकारियों की अपेक्षित संख्या को भी सहयोजित कर सकेगी। (2) समस्त प्राप्त हुए ऑनलाइन आवेदन जिला-वार क्रमबद्ध (क्रमांकित) रूप में जनित किए जाएंगे। 12. शारीरिक मानपरीक्षण.-(1) समिति अभ्यर्थियों की लम्बाई और पुरूष अभ्यर्थियों की दशा में छाती की चौड़ाई के लिए मापन करवाएगी। समस्त माप चिकित्सा अधिकारी द्वारा लिए जाएंगे, जिन्हें अभ्यर्थी की शीट में अभिलिखित किया जाएगा और चिकित्सा अधिकारी द्वारा हस्ताक्षरित किया जाएगा तथा समिति के2419 राजपत्र, हिमाचल प्रदेश, 09 अगस्त, 2021/18 श्रावण, 1943 सदस्य द्वारा प्रतिहस्ताक्षरित किया जाएगा। इस प्रक्रिया की वीडियोग्राफी की जाएगी। समिति निम्नलिखित सारणी के अनुसार केवल लम्बाई के लिए ही अंक प्रदान करेगीः-

(2) अभ्यर्थी, जो नियम 8 के उप नियम (1) मेें विनिर्दिष्ट मानदण्डों को पूरा नहीं करते हैं, को संक्षिप्ततः अनुपयुक्त घोषित कर दिया जाएगा और उन्हें तद्‌नुसार सूचित कर दिया जाएगा।

13. अभ्यर्थियों का शारीरिक दक्षता परीक्षण.-(1) अभ्यर्थी, जो शारीरिक मानदण्डों के अनुसार पात्र पाए गए हैं, की सूची, समिति द्वारा शारीरिक मानपरीक्षण के संपूर्ण होनेे के तत्काल पश्चात्‌ जिला पुलिस अधीक्षक कार्यालय के नोटिस बोर्ड पर लगाई जाएगी और अर्हित अभ्यर्थियों को शारीरिक दक्षता परीक्षण के लिए बुलाया जाएगा जो निम्नलिखित ब्योरों के अनुसार केवल अर्हक प्रकृति का होगाः-

(2) समिति अभ्यर्थी की शीट में शारीरिक दक्षता परीक्षण का समय और दूरी का अभिलेख प्रविष्ट करवाएगी जिसे समिति के प्रत्येक सदस्य द्वारा सम्यक्‌ रूप से हस्ताक्षरित किया जाएगा।

(3) अभ्यर्थी, जो किसी प्रतिस्पर्धा को अर्हित करने में असफल रहते हैं, को तत्काल (तुरंत) निरर्हित कर दिया जाएगा और वे शेष प्रतिस्पर्धाओं में भाग नहीं ले सकेंगे।

(4) पारदर्शिता बनाए रखने के लिए बाहरी शारीरिक दक्षता परीक्षण और लिखित परीक्षा की वीडियोग्राफी की जाएगी।

14. मूल सूची (आधारक).-अभ्यर्थी के नाम, आबंटित रजिस्ट्रीकरण संख्या और शारीरिक मान परीक्षण में प्राप्तांक सहित मूल सूची तैयार की जाएगी। सूची को ऑनलाइन प्रकाशित किया जाएगा और सम्बद्ध जिला पुलिस अधीक्षक के कार्यालय के नोटिस बोर्ड पर प्रदर्शित किया जाएगा तथा अर्हित अभ्यर्थियों को नियत तारीख, समय और स्थान पर लिखित परीक्षण के लिए रिपोर्ट करना होगा। 2420 राजपत्र, हिमाचल प्रदेश, 09 अगस्त, 2021/18 श्रावण, 1943 15. लिखित परीक्षा.-लिखित परीक्षा केवल जिला मुख्यालयों पर, अधिमानतः समस्त जिलों के लिए एक ही दिन आयोजित की जाएगी। लिखित परीक्षा 60 मिनट की अवधि के लिए वस्तुनिष्ठ प्रक्रार के 80 अंकों की होगी। जिसमें निम्नलिखित सम्मिलित होगाः-

(क) अंग्रेजी भाषा -16 प्रश्न

(ख) हिंदी भाषा -16 प्रश्न

(ग) सामान्य ज्ञान -16 प्रश्न

(घ) गणित और विज्ञान -16 प्रश्न

(ड.) तर्क कौशल (अभिक्षमता) -16 प्रश्न

उपर्युक्त लिखित परीक्षा के लिए पाठ्‌यक्रम गणित, जिसके लिए पाठ्‌यक्रम दसवीं के स्तर का होगा के सिवाए, 10+2 स्तर का होगा। सामान्य/अन्य पिछड़ा वर्ग से संबंंिधत अभ्यर्थियों की दशा में लिखित परीक्षा में कम से कम पचास प्रतिशत अंक प्राप्त करने वाले और अनुसूचित जाति और अनुसूचित जनजाति से संबंंिधत अभ्यर्थियों की दशा में लिखित परीक्षा में कम से कम चालीस प्रतिशत अंक प्राप्त करने वाले अभ्यर्थियों को ही अर्हित समझा जाएगा। लिखित परीक्षा का परिणाम ऑनलाइन प्रदर्शित किया जाएगा और उसे संबद्ध जिला के पुलिस अधीक्षक कार्यालय के नोटिस बोर्ड पर समस्त अभ्यर्थियों, जो लिखित परीक्षा में उपस्थित हुए हैं, द्वारा अभिप्राप्त अंकाें को दर्शाते हुए प्रदर्शित भी किया जाएगा।

16. मूल्यांकन.-कांस्टेबल वर्ग-III पदों के रैंक में कांस्टेबल के पद के लिए चयन लिखित परीक्षा के गुणागुण और विहित शैक्षिक अर्हता और निम्नलिखित मापदण्डों पर आधारित मूल्यांकन के आधार पर किया जाएगाः-

17. अन्तिम परिणाम का प्रकाशन.-(1) अन्तिम परिणाम, मूल सूची (नियम 14) और लिखित परीक्षा (नियम 15) और मूल्यांकन (नियम 16) में अभिप्राप्त कुल अंकों का योग होगा। अन्तिम परिणाम 100 में से तीनों स्तरों पर प्रत्येक में अभिप्राप्त अंकों को दर्शाते हुए और प्रत्येेक आरक्षित प्रवर्गों की प्रास्थिति सहित, ऑनलाइन प्रदर्शित किया जाएगा और उन समस्त अभ्यर्थियों की बावत जो मूल्यांकन के लिए उपस्थित हुए थ,े मूल्यांकन के सम्पूर्ण होनेे के तत्काल पश्चात्‌ जिला पुलिस अधीक्षक के कार्यालय के नोटिस बोर्ड पर भी प्रदर्शित किया जाएगा। अंतिम परिणाम शीट के टिप्पणी स्तम्भ में क्षैतिज (हॉरिजोन्टल) और ऊध्र्वाधर आरक्षण के दावों को भी दर्शाया जाएगा।

(2) प्रतीक्षा सूची को भी उसी समय और उसी रीति में तैयार किया जाएगा किन्तु उसे नोटिस बोर्ड पर प्रदर्शित नहीं किया जाएगा तथा यदि किसी अभ्यर्थी के या तो कार्यग्रहण करने में असफल रहने या नियुक्ति के लिए पश्चात्‌वर्ती उपयुक्त न पाए जाने की संभावित-परिस्थिति का ध्यान रखने के लिए सम्बद्ध पुलिस अधीक्षक के कार्यालय में रखा जाएगा।

18. चिकित्सा परीक्षण.-(1) चयनित अभ्यर्थियों को सुसंगत चिकित्सा बोर्ड से चिकित्सा परीक्षण करवाना होगा। चिकित्सा बोर्ड का गठन और इसके निबंधन और विनिर्देशन परिभाषित किए जाएंगे। मुख्य चिकित्सा अधिकारी के परामर्श से पुलिस अधीक्षक द्वारा चिकित्सा बोर्ड का गठन किया जाएगा। चिकित्सीय रूप से अनुपयुक्त अभ्यर्थियों को उनकी अभ्यर्थिता की अस्वीकृति के बारे में सूचित किया जाएगा। चिकित्सा परीक्षण का परिणाम सम्बद्ध जिला पुलिस अधीक्षक के नोटिस बोर्ड पर प्रदर्शित किया जाएगा।

चिकित्सा परीक्षण के समय गर्भवती पाई गई महिला अभ्यर्थी को अस्थायी रूप से अनुपयुक्त समझा जाएगा और वह प्रसव के ब्यालीस (42) दिन की प्रसवावस्था अवधि के बाद चिकित्सा परीक्षण के लिए पुनः उपस्थित होगीे।

(2) चिकित्सा रिपोर्ट के विरूद्ध अपील चिकित्सा परीक्षा परिणाम प्रदर्शित किए जाने के सात दिन के भीतर सम्बद्ध जिला पुलिस अधीक्षक के समक्ष की जा सकेगी। सम्बद्ध पुलिस अधीक्षक, सम्बद्ध जिला मुख्य चिकित्सा अधिकारी द्वारा बनाए जाने वाला पुनर्निरक्षण चिकित्सा बोर्ड गठित करेगा। यह बोर्ड तीस दिन के भीतर अपनी रिपोर्ट प्रस्तुत करेगा।

(3) प्रतीक्षा सूची से उपयुक्त अभ्यर्थी को उन अभ्यर्थियों, जिन्हें अंतिम रूप से चिकित्सीय रूप से अयोग्य घोषित कर दिया गया है, के स्थान पर रखा जाएगा ।

(4) कांस्टेबलों की भर्ती के दौरान शारीरिक दक्षता परीक्षण के आरम्भ में मादक पदार्थों के सेवन का पता लगाने हेतु डोप टेस्ट(परीक्षण) किया जाएगा। 2422 राजपत्र, हिमाचल प्रदेश, 09 अगस्त, 2021/18 श्रावण, 1943 19. चरित्र और पूर्ववृत्त.-(1) चयनित अभ्यर्थी जो अस्थायी रूप से चयनित किए गए हैं, के चरित्र और पूर्ववृत्तों का सत्यापन सम्बद्ध जिला पुलिस के माध्यम से किया जाएगा, किंतु ऐसे सत्यापन के लंबित होने के कारण नियुक्ति पत्रों के जारी किए जाने की प्रक्रिया को रोका नहीं जाएगा। नियुक्ति प्राधिकारी, अभ्यर्थी से सम्यक्‌ रूप से भरे गए और हस्ताक्षरित सत्यापित प्रपत्र अभिप्राप्त करने और स्व-घोषणा करने के पश्चात्‌ अस्थायी नियुक्ति पत्र जारी करेंगे। यदि कोई अभ्यर्थी किसी विधि के न्यायालय से दोषसिद्ध पाया जाता है तो ऐसे आवेदक/अभ्यर्थी को अपराध की प्रकृति और सजा की अवधि पर विचार किए बिना नियुक्ति प्रदान नहीं की जाएगी।

(2) किसी अभ्यर्थी की दशा में जिसके विरूद्ध अन्वेषण विचारण (ट्रायल) लंबित है, नियुक्ति का प्रस्ताव तब तक आस्थगित रखा जाएगा जब तक कि अभ्यर्थी/आवेदक अन्वेषण या विचारण के दौरान समाशोधन प्राप्त नहीं कर लेता है। ऐसा अभ्यर्थी केवल इस कारण से अधिक आयु का हुआ नहीं समझा जाएगा। (3) पद को प्रतीक्षा सूची से भरा जा सकेगा और अभ्यर्थी को पश्चात्‌वर्ती होने वाली रिक्ति के विरूद्ध नियुक्ति का प्रस्ताव दिया जाएगा।

20. नियुक्ति और परिवीक्षा.-चिकित्सा उपयुक्तता (फिटनेस) की घोषणा और चरित्र और पूर्ववृत्तों का सत्यापन के पश्चात अंतिम गुणागुण सूची में उपस्थित होनेे वाले अभ्यर्थियों को सम्बद्ध नियुक्ति प्राधिकारी द्वारा नियुक्ति पत्र जारी किया जाएगा। प्रारंभिक भर्ती पर समस्त पुलिस कांस्टेबलों को पुलिस महानिदेशक, हिमाचल प्रदेश द्वारा यथा अवधारित बैचों में प्रवेश प्रशिक्षण/भर्ती प्रशिक्षण कोर्स करना होगा। प्रशिक्षण की अवधि नौ मास की होगी और प्रशिक्षण का पाठ्‌यक्रम और उसकी अनुसूची ऐसी होगी जैसी पुलिस महानिदेशक द्वारा स्थायी आदेशों के माध्यम से अधिसूचित की जाए। समस्त कांस्टेबल ऐसे चक्रानुक्रम और 6 विशिष्ट प्रशिक्षण द्वारा वार्षिक पुनश्चर्या प्रशिक्षण कार्यक्रम करेंगे जैसे पुलिस महानिदेशक द्वारा अवधारित किए जाए।ं जिला सशस्त्र रिजर्व और राज्य सशस्त्र पुलिस बटालियन के अधिकारियों के लिए वार्षिक पुनश्चर्या/प्रशिक्षण कोर्स के साथ-साथ अन्य विशिष्ट कोर्सों की विषयवस्तु और कार्यप्रणाली ऐसी होगी जैसी राज्य सरकार द्वारा राज्य पुलिस बोर्ड के सामान्य निर्देशों के अध्यधीन पुलिस महानिदेशक की सिफारिशों पर अधिसूचित की जाए। यदि कोई भर्ती किए जाने वाला व्यक्ति प्रवेश प्रशिक्षण/भर्ती प्रशिक्षण कोर्स को उत्तीर्ण करने में असफल रहता है तो उसकी सेवा पर्यवसित किए जाने हेतु दायी होगी। भर्ती किए जाने वाले व्यक्तियों का भर्ती प्रशिक्षण कोर्स के सफलतापूर्वक पूर्ण होने और भर्ती प्रशिक्षण कोर्स सहित दो वर्ष की परिवीक्षा पूर्ण होनेे के पश्चात्‌ ही स्थायीकरण किया जाएगा।

21. रोस्टर और वरिष्ठता.-(1) कांस्टेबल के संवर्ग (काडर) की बाबत ऊध्र्वाधर और क्षैतिज आरक्षित रिक्तियों की संख्या को अवधारित करने हेतु जिलावार शतप्रतिशत बिन्दु रोस्टर, राज्य सरकार द्वारा समय-समय पर जारी नियमों और अनुदेशो,ं यदि लागू हैं, का अनुसरण किया जाएगा।

(2) चयनित कांस्टेबलों (अभ्यर्थियों) की वरिष्ठता सम्बन्धित नियुक्ति प्राधिकारी द्वारा इस विषय पर समय-समय पर राज्य सरकार द्वारा जारी नियमांें/अनुदेशों के अनुसार काडर (संवर्ग) के स्तरानुसार अनुरक्षित की जाएगी।

22. शिथिल करने की शक्ति.-जहां राज्य सरकार की यह राय हो कि ऐसा करना अनिवार्य या समीचीन है वहां वह कारणों को लिखित में अभिलिखित करके आदेशों द्वारा, इन नियमों के किसी/किन्हीं उपबन्ध (उपबन्धों) को शिथिल कर सकेगी।

No. Home (A) A (3)-2/2020.—Whereas, the draft Himachal Pradesh Police Department (Recruitment of Constables) Rules, 2021 were published in Rajpatra (e-Gazette), Himachal Pradesh vide this department's notification of even number dated 05-05-2021 for inviting objection(s) and suggestion(s) from the person(s) likely to be affected thereby, as required under sub-section(1) of Section 141 read with Section 23 of the Himachal Pradesh Police Act, 2007(Act No. 17 of 2007);

And whereas, objection(s) and suggestion(s) have been received within the stipulated period by the State Government in this behalf and the same have been duly considered;

Now, therefore, in exercise of the powers conferred by sub-section (1) of Section 141 read with Section 23 of the Himachal Pradesh Police Act, 2007(Act No. 17 of 2007), the Governor of Himachal Pradesh, is pleased to make the following rules, namely:—

PART-I

1. Short title and commencement.— (1) These rules may be called The Himachal Pradesh Police Department (Recruitment of Constables) Rules, 2021.

(2) These rules shall come into force from the date of publication in the Rajpatra (e- Gazette), Himachal Pradesh.

2. Repeal and savings.— (1) The Punjab Police (Himachal Pradesh Amendment) Rules, 2011 notified vide this Department Notification No. Home (A) A(3)-1/2005-Part, dated 11-03-2011 and published in Rajpatra, Himachal Pradesh dated 14th March, 2011 are hereby, repealed.

(2) Notwithstanding such repeal, any appointment made or anything done or any action taken under the rules so repealed under sub-rule (1) supra, shall be deemed to have been validly made or done or taken under these rules.

PART –II

3. Recruitment of constables.—Recruitment shall be done 100 percent on regular basis once a year or at such frequency as may be required based on vacancies as may be determined.

4. Number and apportionment of posts.—(1) The number of posts shall be such as determined/created by the Government, from time to time.

(2) Posts of constables will be filled on the basis of ratio of population of district. Women shall be provided Twenty five percent (25%) horizontal reservation and will be filled up in all the categories of vertical reservation separately alongwith horizontal reservation being available to other categories.

5. Appointing authority.— Commandants of Battalions shall be the appointing authority.

6. Pay and allowances.—The official shall draw such pay and allowances as may be determined by the State Government in this regard, from time to time.

7. Reservation.— (1) Vertical Reservation amongst SC/ST/OBC shall be as per Government instructions on the subject from time to time. Further, the persons belonging to Economically Weaker Sections (EWSs) who are not covered under the Scheme of reservation for SCs, STs and OBCs shall be provided 10% Vertical Reservation in direct recruitment. Special Horizontal reservation for women, ex-servicemen, wards of freedom fighters, Antodaya/BPL, distinguished sports person and Home Guards will be given as per Government instructions issued from time to time.

(2) In case a post reserved under vertical or horizontal reservation cannot be filled up from that category, the post shall be kept vacant and the matter shall be referred by the Chairman of the District Recruitment Committee to the DGP, who shall follow the rules and instructions issued in this behalf by the State Government in Department of Personnel.

(3) The requisition for vacancies of exservicemen shall be sent by the Chairman of the District Recruitment Committee to the Secretary, Ex-servicemen Cell, Hamirpur to sponsor names. The requisition shall specify the number of posts for each District and the names will be sponsored accordingly.

(4) In the event of non-availability of suitable/eligible candidate against the vacancy reserved for Ex-servicemen, the vacancy shall be carried forward for 2 calendar years and in the 3rd year the said vacancy shall be filled up from the dependent sons, daughters and wives of Ex- Servicemen. If in the 3rd year, the eligible/suitable candidate for whom the vacancy is reserved is not available, the same may be filled up from the respective residuary category to which the point belongs in that year itself. When it is obvious that Ex-servicemen would not at all be available for appointment to any category of posts, the posts so reserved for ex-servicemen may be filled-up by dependent sons, daughters and wives of ex-servicemen with the prior concurrence of the Exservicemen Cell, Himachal Pradesh. In case, sons, daughters and wives of Ex-servicemen for posts authorized to be filled are not available then reservation will be carried forward for 2 calendar years where after the vacancy shall be filled up from the respective residuary category to which the point belongs.

8. Eligibility.— (1) Education and other qualifications and physical standards will be as follows:—

(2) In case of Ex-serviceman minimum qualification shall be matriculation. However, whenever the vacancies go to the wards of Ex-serviceman the education qualification will be 10+2.

(3) A candidate shall be eligible for recruitment to the post of Constable, if he/she has passed Matriculation and 10+2 from any Institution/School/Board situated within Himachal Pradesh:

Provided that this condition shall not apply to Bonafide Himachalis.

9. Procedure for inviting application.—(1) Recruitment shall be done by way of advertisement in leading daily newspapers at least one of which will be in the local vernacular. Wide publicity will also be given through local channels of All India Radio. Online applications shall be called from the candidates who fulfill the educational and other qualifications. Only such candidates can apply who on the date of publication of the advertisement in the newspaper are Bonafide Himachali. The advertisement shall specify the age, educational and other qualifications and physical standards and the District-wise likely number of vacancies including reserved vacancies in each category separately for male and female candidates.

(2) A processing fee as may be determined by the Director General of Police from time to time shall be charged from the General Candidates and 1/4th of this fee shall be charged from applicants belonging to SC/ST/OBC, women, BPL/Antodaya and EWS. The amount of processing fee so collected from the candidates will be utilized to meet the expenditure to be incurred by the Department in connection with the recruitment. For this purpose a separate bank account will be operated by the Himachal Pradesh Police Recruitment Board. Addl. Director General of Police, Armed Police and Training will be the Chairman of this Board. All Inspectors General /Dy. Inspectors General of Ranges and Inspector General (Adm. and Welfare) shall be members of this Board. This Board shall be responsible for verall supervision of the recruitment process.

10. Online application procedure.—The candidates shall read the instructions carefully, which are also available on the website of the Police Department i.e. www. recruitment. hppolice. gov. in before filling up Online Recruitment Application (ORA) for the post of Constable. Incomplete ORA submitted without requisite examinations fee, scanned photograph and scanned signatures of prescribed size, will be rejected straightway. ORA will be considered only in respect of vacancies of the District in which the applicant is ordinarily resident according to the Bonafide Himachali Certificate obtained by the candidate. No certificate or copies of certificates will be attached with the ORA. Instead every applicant will give itself undertaking that the information furnished by him/her in the ORA is true and correct. The actual verification of original certificates will be done only in respect of candidates who are called for 'Evaluation' and any applicant having made an incorrect or false declaration shall stand disqualified automatically at that stage. A candidate shall only be considered against the district shown as his residence in the Bonafide Himachali Certificate. A cutoff date to declare one's category to avail reservation will be provided in the Recruitment Notice/Advertisement and after that no change of category will be entertained.

11. District recruitment committee.— (1) Recruitment shall be conducted in each district headquarters by a Committee, which shall be headed by the Range IG/DIG, other members being one commandant of the State Police Battalion as nominated by the Director General of Police, District S.P. and one Medical Officer to be nominated by the Chief Medical Officer of the2426 राजपत्र, हिमाचल प्रदेश, 09 अगस्त, 2021/18 श्रावण, 1943 concerned district. The Committee shall co-opt a Gazetted Officer belonging to the SC/ST in case these categories are unrepresented in the Committee. The Committee may co-opt requisite number of Gazetted Officers/Non- Gazetted Officers to assist it in the recruitment process.

(2) All ORA received shall be generated serially numbered District–wise.

12 . Physical standard test.— (1) The Committee shall cause the candidates to be measured for height and in the case of male candidates for chest expansion. All measurements will be taken by a Medical Officer which shall be recorded in the Candidate Sheet and signed by the Medical Officer and countersigned by a Member of the Committee. This process will be video graphed. The Committee shall award marks only for height as per the following table:—

(2) Candidates who do not meet the standards specified in sub-rule (1) of rule 8 shall be summarily declared unfit and informed accordingly.

13 . Physical efficiency test of candidates.— (1) List of candidates who are found eligible as per physical standards will be put up on the Notice Board in the District S.P. Office by the Committee immediately after completion of physical standards test and qualified candidates shall be called for Physical Efficiency Test which will be of qualifying nature alone as per the following details:—

(2) The Committee shall cause to be entered the record of timing and distance of the Physical Efficiency Test in the Candidate's Sheet which will be duly signed by each member of the Committee.

(3) Candidates who fail to qualify in any event will be disqualified forthwith and will not participate in the remaining events.

(4) Videography of the outdoor Physical Efficiency Test and Written Examination will be done for the sake of transparency.

14. Basic list.— A Basic List including candidate's name, allotted registration number and marks scored in the Physical Standard Test will be prepared. The list shall be published online and displayed on the Notice Board of the concerned District S.P. Office and qualified candidates shall report for the Written Examination on the appointed date, time and venue.

15. Written examination.—Written examination will be held at District Headquarters only, preferably on the same day for all districts. Written examination will be of 80 marks of objective type of 60 minutes duration. It will include the following:—

(a) English Language -16 questions (b) Hindi Language -16 questions (c) General Awareness -16 questions (d) Maths and Science -16 questions (e) Reasoning Aptitude -16 questions

The syllabus for the above written examination shall be of 10+2 standard except Mathematics for which syllabus shall be of Matriculation standard.

Only those candidate will be deemed to have qualified for evaluation who score 50% marks in the written test in case of the candidate belonging to General/OBC categories and 40% marks in the case of those belonging to Scheduled Castes and Scheduled Tribes categories. The result of the written examination shall be put up online and also displayed on the Notice Board of the concerned District. S.P. Office displaying marks secured by all the candidates who appeared in the written examination.

16. Evaluation.—The selection to the post of Constables in the rank of Constables Class-III posts shall be made on the basis of the merit of written examination and specified educational qualification followed by evaluation, based on the following parameters:—

17. Publication of final result.—(1) The final result will be the sum total of the marks obtained in the Basic List (rule 14), Written Test (Rule 15) and Evaluation (rule 16). The final result showing the marks obtained in each of the three attributes out of 100 marks and also including the position of respective reserved categories shall be put up online and displayed in respect of all the candidates who appeared for the Evaluation on the Notice Board of the District S.P. office immediately after completion of Evaluation. Claims to horizontal and or vertical reservation shall also be shown in the remarks Column in the final result Sheet.

(2) Waiting List shall also be prepared at the same time in similar manner which shall not be displayed and shall be kept in the office of S.P. concerned to take care of an eventuality when a suitable candidate either fails to join or is not found fit for appointment subsequently.

18. Medical examination.—(1) The selected candidates shall undergo a medical examination by the relevant Medical Board. Constitution of Medical Board and its terms and specification be defined. Medical Board shall be constituted by the Superintendent of Police with the consultation of Chief Medical Officer. Medically unfit candidates shall be informed of rejection of their candidature. The result of the Medical Examination shall be displayed on the Notice Board of District S.P. concerned.

The female candidate found pregnant at the time of Medical Examination shall be considered temporary unfit and shall reappear for Medical Examination after her postpartum period of forty two days after delivery.

(2) An appeal against the medical report may be filed before the concerned District Superintendent of Police within 7 days of the display of the result of medical examination. The Superintendent of Police concerned shall cause a Review Medical Board to be constituted by the Chief Medical Officer of the concerned district. This Board shall submit its report within 30 days.

(3) Suitable candidates from the waiting list shall be substituted in the place of the candidates who have been finally declared medically unfit.

(4) The dope test shall be carried out to detect narcotics opiates at the outset of Physical Efficiency Test during the recruitment of Constables.

19. Character and ancedents.—(1) The verification of character and antecedents of the selected candidate who have been selected provisionally will be carried out through concerned district police but the process for issuance of appointment letters will not be withheld due to pendency of such verification. The appointing authorities will issue provisional appointment letters after obtaining the filled and duly signed attestation form and self declaration from the candidate. In case, a candidate is found to have been convicted in a court of law, applicant/ candidate shall not be offered appointment irrespective of the nature of the offence and the period of sentence.

(2) In case of a candidate against whom investigation trial is pending the offer of appointment may be held in abeyance until candidate/applicant get clearance during investigation or trial. Such a candidate shall not be deemed to have become overage on this account alone.

(3) The post may be filled up from the waiting list and the candidate will be offered a subsequently occurring vacancy.

20. Appointment and probation.—The candidates appearing in the final merit list after declaration of Medical fitness and verification of character and antecedents shall be issued a letter of appointment by the concerned appointing authority. All Police Constables on initial recruitment shall undergo induction training/Recruits Training Course in batches as determined by the Director General of Police, H.P. The period of training shall be 9 months and the syllabus of training and the schedule thereof shall be as may be notified by the Director General of Police, through Standing Orders. All Constables shall undergo annual refresher training programmes by such rotation and specialized training as may be determined by the Director General of Police. The content and methodology of the annual/refresher training courses as well as the other specialized courses for the officers of the District Armed Reserve and State Armed Police Battalions shall be such as may be notified by the State Government on the recommendations of the Director-General of Police, subject to general directions of the State Police Board. In case a recruit is unable to pass the induction training/recruitment training course, his/her service shall be liable to be terminated. Recruits will be confirmed only after successful completion of RTC and probation of 2 years including RTC.

21. Roster and seniority.— (1) A district wise 100 point roster to determine the number of vertically and horizontally reserved vacancies in respect of Constable cadre shall be followed in terms of provisions of the rules and instructions issued by the State Government from time to time, if applicable.

(2) The seniority of the selected Constables shall be maintained by the respective Appointing Authority as per level of the cadre in accordance with the rules/instructions issued by the State Government on the subject from time to time.

22. Power to relax.— Where the State Government is of the opinion that it is necessary or expedient to do so, it may, by order for reasons to be recorded in writing relax any of the provision(s) of these rules.
