No. 24-B(Trade License)/MCS/2021-1137.—In exercise of the powers conferred under Sections 125, 126, 127, 128 read with sections 202 and 214 of the Himachal Pradesh 82—राजपत्र/2021-17-08-2021 (2695)2696 राजपत्र, हिमाचल प्रदेश, 17 अगस्त, 2021/26 श्रावण, 1943 Municipal Act, 1994, I, Sanjay Kumar, Executive Officer, Municipal Council Sujanpur, Distt. Hamirpur, Himachal Pradesh hereby notify the following Bye-laws :—

1. Short title, extent and commencement.—(i) These Bye-Laws may be called the Himachal Pradesh Municipality, (Grant of License for Use of Premises and Storage of Articles in a Premises) Bye-Laws-2020.

(ii) These Bye Laws shall come into force from the date of their publication in the Official Gazette.

(iii) These Bye Laws shall apply to all shops/premises falling within the Municipal limits which may not be used without license for the purpose specified in Sections 125,126,127, 128 read with sections 202 and 214 of the Himachal Pradesh Municipal Act, 1994 as per Annexure I and Annexure II for storage of any Article within the municipal limits.

2. Definitions.—in these Bye-Laws, unless the context otherwise requires: —

(a) "Act" means the Himachal Pradesh Municipal Act.1994, (Act No. 12 of 1994).

(b) "Authorized Officer" means Executive Officer or any other Officer specifically authorized by the Executive Officer.

(c) "Inspector" means Sanitary Inspector or any other Official of the Municipal Council duly authorized by the Executive Officer.

(d) "License" means a written permission granted by the Executive Officer or any other official/Officer duly authorized by the Executive Officer in favour of the person, owner & occupier for sale/storage of articles specified in Annexure I & II of these Bye-Laws.

(e) "Licensing Officer" means Executive Officer or any other officer duly authorized by the Executive Officer to grant/renew License under the provisions of these Bye- Laws.

(f) "Premises", means any shop/store/place where the articles specified in Annexure I & II are kept for sale/storage in the godown/premises.

(g) "Small Scale Business/Trade" means premises covering maximum area of 100 sq.ft. "Medium Scale Business/Trade" means premises covering area of 100 Sq.ft. to 500 sq. ft. and "large Scale Business/Trade" means premises covering area of more than 500 Sq.ft.

(h) "Shopkeeper" means any person running and managing the affairs of the shop/premises/place including its owner/occupier.

(i) The words and expression not defined under these Bye-Laws shall have the samemeaning or sense as are defined in Himachal Pradesh Municipal Act, 1994.

3. Procedure for obtaining License.— (a) Any person who wants to operate/run any business/trade as specified in Annexure I and/or store any article as specified in Annexure II within the areas of the Municipal Council Sujanpur shall apply for license on prescribed Form A online to the Executive Officer Sujanpur.

(b) Period of License.—(1) The License shall be issued for a period maximum upto fifteen years at a time and the License shall automatically come to an end after completion of such period.

4. Renewal of License.—(i) The License shall be renewed automatically after expiry of the period of license on deposit of requisite/ prescribed license fee by the applicant. The license shall be renewed without any late fee and extra document within one month after expiry of license. The license shall be renewed with penalty of 50 % of license fee within next one month and after that period the license shall not be renewed. In that case a fresh Trade license shall be required to be issued.

(ii) No document is required to be submitted for renewal of License.

5. Transfer of License.—(i) The license issued under the Bye-Laws shall not be transferred in the name of any person except in case of the death of original licensee wherein it shall be made/transferred in the name of the legal heirs only for the validity period of license on production of supporting documents and shall be decided by the Executive Officer keeping in view the circumstances of the case.

(ii) The licensee shall provide online information to the Executive Officer for winding up of his business under such license.

6. License Fee.—(i) The license fee for grant of license shall be decided by the Executive Officer from time to time. However, the fee will be calculated on annual license fee rate multiplied by number of years the license is requested by the applicant. The fee shall be charged in the following manner:—

In the fairs, fee shall be charged on the following rates:—

(a) Small Shop Rs. 25/- P. Day (b) Medium Shop Rs. 50/- P. Day (c) Large Shop Rs. 100/- P. Day

Explanation.—(i) A shop covering an area upto 6 square meters shall be deemed to be a small shop.

7. Conditions for grant of license.—(i) The License shall not be valid for any other purpose, except for the items/articles for which it is granted under these Bye Laws.

(ii) The permission shall, unless specified otherwise in the license, be valid in the entire MC limits, subject to such conditions as may be imposed by the Executive Officer.

(iii) The owner /occupier of the premises shall have to produce the license before the Inspector or the licensing officer at any point of time as may be ordered by them.

(iv) The Executive Officer shall have a right to impose or alter any of conditions in the license as may be deemed fit by him/her under the provisions of Section 214 of the Himachal Pradesh Municipal Act, 1994.

(v) The applicant shall submit a self declaration regarding information submitted by him/ her about the premises to be used for business/ trade viz. type of business, area, approval of map and nature of property i.e. commercial and domestic etc. to be true to the best of his knowledge and belief.

(vi) The licensee shall maintain proper record of the articles kept for sale or storage in the premises as may be required by the Licensing Officer. Further the licensee shall comply with all the directions and instructions issued to him by the Executive Officer or the Licensing Officer from time to time.

(vii) The licensee will ensure timely payment of Municipal dues.

(viii) Time period for issue of License:-The license shall be issued as per the time lines notified/specified for this service under Public Service Guarantee Act,2011.

8. Denial of license.— (1) The license shall not be granted;

(a) to a person suffering from any loathsome infections or contagious diseases;

(b) to a person convicted for unlawful sale or storage of any articles mentioned in Sections 125,126,127, 128 read with sections 202 and 214 of the Himachal Pradesh Municipal Act, 1994.

(c) to a person who has been found to have habitually committed the breach of these Bye- Laws or the terms of the license.

(d) to a person not below the age of 18 years.

(2) (a) Subject to Bye-Laws 9 (1), license to any person, who applies online to the Executive Officer or Licensing Officer in this behalf and tenders the prescribed fee shall be granted by that officer, unless for reasons to be recorded in writing by him.

(b) The Licensee shall be liable to pay transfer charges @ 200/- per license at the time of effecting transfer of License.

(c) The licensee shall abide by the terms and conditions of the license and the license shall be displayed at the convenient/ conspicuous place/reception of the premises.

(d) The Inspector or inspecting staff concerned shall have a right to enter and inspect the premises and the licensee shall provide necessary assistance to the inspecting staff at the time of inspection of licensed premises.

(e) The licensee shall not make any encroachment/overhanging projection on public streets and Municipal drains in any manner.

9. Offences and penalties.—(i) In addition to the penalty as provided under Himachal Pradesh Municipal Act, 1994 any person in possession of the premises found violating any of the provisions of these Bye-Laws shall in the first instance be liable for suspension of license for a period of one week and for repetition of the same violation within two years be liable for penalty of Rs. 1000/- only.

(ii) If the information submitted by the applicant under self declaration is found to be false, he/she shall be liable for the penalty of ten times of the license fee and his/ her license will be cancelled.

(iii) In case of repeated violation, the concerned person, owner or occupier, as the case may be shall be liable for cancellation/withdrawal of License which can only be restored on receiving written undertaking accompanied by surety from the person violating these Bye-laws subject to the satisfaction of the Executive Office.

1. Banking. 2. Cinematograph films, shooting of. 3. Cinematograph film by any process whatsoever, Treating of. 4. Chillies or masala or r seeds, Grinding of by mechanical means. 5. Cloth, Yarn or leather in indigo or in other colours, Dyeing or printing of. 6. Cloth, or yarn Bleaching. 7. Keeping of an eating house or a catering establishment. 8. Grain, Parching. 9. Ground nut seeds, tamarind seeds or any other seeds, Parching. 10. Keeping of hair dressing saloon or a barber's shop. 11. Hides or skins, whether raw or dried Tanning, pressing or packing. 12. Keeping a laundry shop. 13. Leather goods, manufacturing or by mechanical means. 14. Keeping of a Litho Press. 15. Keeping of a lodging house. 16. Metal Casting. 17. Precious metals, Refining of or recovering of them from embroideries. 18. Keeping of a Printing Press. 19. Keeping a sweetmeats shop except in premises already licensed as an eating house. 20. Keeping a tailoring shop.

(i) Autocar or autocycle servicing or repairing. (ii) Blacksmithy. (iii) Coppersmithy.

(iv) Electroplating. (v) Glass bevelling. (vi) Glass cutting. (vii) Glass polishing. (viii Goldsmithy. (ix) Marble cutting, grinding, dressing or polishing (x) Metal (ferrous or non-ferrous or antimony but excluding precious metal ) cutting or treating metal by harmoring drilling, pressing, filling, polishing, heating or by any other process whatever or assembling parts of metal.

(xi) Photography-Studio. (xii) Radio (wireless receiving set ) selling, repairing, servicing or manufacturing. (xiii)Silversmithy. (xiv) Spinning or weaving cotton silk, art silk, or jute or wool with the aid of power. (xv) Stone grinding, cutting, dressing or polishing. (xvi Timber or wood sawing or cutting, by mechanical or electric power. (xvii)Tinsmithy. (xviii)Washerman's trade. (xix) Welding of metal by electric, gas or any process whatsoever.

22. Manufacturing, parching, packing, pressing, cleaning, cleansing, boiling, moulting, grinding or preparing by any process whatever any of the following articles —

(i) Aerated waters. (ii) Bakelite goods. (iii) Bidis (indigenous cigarettes) snuff, cigars or cigarettes. (iv) Bitumen. (v) Blasting powder. (vi) Bones. (vii) Bricks or tiles by hand power.

(viii) Bricks or tiles by mechanical power.

(ix) Brushes. (x) Candles. (xi) Catgut. (xii) Celluloid or celluloid goods.

(xiii) Cement concrete designs or models.

(xiv) Charcoal. (xv) Chemicals.

(xvi) Cinematograph films stripping in connection with any trade.

(xvii) Cosmetics or toilet goods. (xviii) Cotton, cotton refuse, cotton waste, cotton yarn, silk, silk yarn, silk inclusive of waste yarn, art silk, art silk waste, art silk yarn, wool or woolen refuse or waste.

संख्याः एच.एस.जी.-ए.(3)-4/2020 (रूल्ज़)ए.टी.पी.--हिमाचल प्रदेश के राज्यपाल, भू-संपदा (विनियमन और विकास) अधिनियम, 2016 (2016 का 16) की धारा 28 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, भू-संपदा विनियामक प्राधिकरण (रेरा) में सहायक नगर योजनाकार, वर्ग-I (राजपत्रित) के पद के लिए इस अधिसूचना से संलग्न उपाबन्ध-'क' के अनुसार भर्ती और प्रोन्नति नियम बनाते हैं,अर्थात्‌ :-

1. संक्षिप्त नाम और प्रारम्भ.--(1) इन नियमों का संक्षिप्त नाम हिमाचल प्रदेश भू-संपदा विनियामक प्राधिकरण (रेरा) सहायक नगर योजनाकार, वर्ग-I (राजपत्रित) भर्ती और प्रोन्नति नियम, 2021 है। (2)े ये नियम, राजपत्र (ई-गज़ट), हिमाचल प्रदेश में प्रकाशन की तारीख से प्रवृत्त होंगे।

1. पद का नाम.--सहायक नगर योजनाकार

4. वेतनमान.--(ंi) नियमित पदधारी (पदधारिया)ें के लिए पे बैण्ड : 15,600-39,100 रुपए जमा 5400/-रुपए ग्रेड पे।

(ंii) संविदा पर नियुक्त कर्मचारी (कर्मचारियों) के लिए उपलब्धियांः स्तम्भ संख्या : 15-क में दिए गए ब्यौरे के अनुसार 21,000/रुपए प्रतिमास।

परन्तु सीधे भर्ती किए जाने वाले व्यक्तियों के लिए ऊपरी आयु सीमा, तदर्थ या संविदा के आधार पर नियुक्त किए गए व्यक्तियों सहित, पहले से ही सरकार की सेवा में रत अभ्यर्थियों को लागू नहीं हाेंगी :

परन्तु यह और कि यदि तदर्थ या संविदा के आधार पर नियुक्त किया गया अभ्यर्थी इस रूप में नियुक्ति की तारीख को अधिक आयु का हो गया हो तो वह उसकी ऐसी तदर्थ या संविदा पर की गई नियुक्ति के कारण विहित आयु में शिथिलीकरण का पात्र नहीं होगा :

परन्तु यह और कि ऊपरी आयु सीमा में अनुसूचित जातियों/अनुसूचित जनजातियों/अन्य पिछड़ा वर्गों और व्यक्तियों के अन्य प्रवर्गोेंं के लिए, उस विस्तार तक शिथिलीकरण किया जाएगा जितना की हिमाचल प्रदेश सरकार के साधारण या विशेष आदेश (आदेशों) के अधीन अनुज्ञेय है :

परन्तु यह और भी कि समस्त पब्लिक सेक्टर, निगमों तथा स्वायत्त निकायों के कर्मचारियों को, जो ऐसे पब्लिक सेक्टर निगमों/स्वायत्त निकायों के प्रारम्भिक गठन के समय ऐसे पब्लिक सेक्टर, निगमों/स्वायत्त निकायाें में आमेलन से पूर्व सरकारी कर्मचारी थे, सीधी भर्ती के लिए आयु सीमा में ऐसी ही रियायत अनुज्ञात की जाएगी जैसी सरकारी कर्मचारियों को अनुज्ञेय है, ऐसी रियायत, तथापि पब्लिक सेक्टर, निगमों/स्वायत्त निकायों के ऐसे कर्मचारीवृन्द को अनुज्ञेय नहीं होगी जो तत्पश्चात्‌ ऐसे निगमों/स्वाया निकायों द्वारा नियुक्त किए गए थे/किए गए हैं और उन पब्लिक सेक्टर निगमों/स्वायत्त निकायाें के प्रारम्भिक गठन के पश्चात्‌ ऐसे निगमाें/स्वाया निकायों की सेवा में अन्तिम रूप से आमेलित किए गए हैं/किए गए थे ।

टिप्पण.--सीधी भर्ती के लिए आयु सीमा की गणना उस वर्ष के प्रथम दिवस से की जाएगी जिसमें कि पद (पदों) को आवेदन आमन्त्रित करने के लिए, यथास्थिति, विज्ञापित किया गया है या नियोजनालयों को अधिसूचित किया गया है।

7. सीधे भर्ती किए जाने वाले व्यक्ति (व्यक्तियों) के लिए अपेक्षित न्यूनतम शैक्षिक और अन्य अर्हताएं.-- (क) अनिवार्य अर्हता (एं) : (i) किसी मान्यता प्राप्त विश्वविद्यालय से या ऑल इण्डिया इंस्टीट्‌यूट ऑफ टाउन प्लानर्ज़ इण्डिया द्वारा सम्यक्‌ रूप से मान्यता प्राप्त किसी संस्थान से अर्बन प्लानिंग या, सिटी प्लानिंग या, टाउन प्लानिंग या, रीजनल प्लानिंग या, हॉउजिंग प्लानिंग या कन्ट्री प्लानिंग या, रूरल प्लानिंग या इन्फ्रास्ट्रक्चर प्लानिंग या ट्रांसपोर्ट प्लानिंग या रूरल एण्ड अर्बन प्लानिंग या एनवायरनमैण्टल प्लानिंग में मास्टर ऑफ प्लानिंग/एम. टैक़/स्नातकोत्तर उपाधि।

या

(ii) किसी मान्यता प्राप्त विश्वविद्यालय या ऑल इण्डिया इंस्टीट्‌यूट ऑफ टाउन प्लानर्ज़ द्वारा सम्यक्‌ रूप से मान्यता प्राप्त किसी संस्थान से प्लानिंग स्नातक या, प्लानिंग में टैक्नोलॉजी स्नातक।

और

(ख) प्लानिंग स्नातक या प्लानिंग में बी. टेक़ की उपाधि प्राप्त करने के पश्चात्‌ केन्द्रीय सरकार या राज्य सरकार के विभाग में अर्बन प्लानिंग या, सिटी प्लानिंग या, टॉउन प्लानिगं या, रीजनल प्लानिंग या, 2708 राजपत्र, हिमाचल प्रदेश, 17 अगस्त, 2021/26 श्रावण, 1943 हाउजिग प्लानिंग या, कन्ट्री प्लानिंग या, रूरल प्लानिंग या, इन्फ्रास्ट्रक्चर प्लानिंग या, ट्रांसपोर्ट प्लानिंग या, रूरल एण्ड अर्बन प्लानिंग या, एनवायरनमैण्टल प्लानिंग में कम से कम तीन वर्ष का अनुभव।

(ख) वांछनीय अर्हता (एं) : हिमाचल प्रदेश की रुढ़ियों, रीतियों और बोलियाें का ज्ञान और प्रदेश में विद्यमान विशिष्ट दशाओं में नियुक्ति के लिए उपयुक्तता।

8. सीधे भर्ती किए जाने वाले व्यक्ति (व्यक्तियों) के लिए विहित आयु और शैक्षिक अर्हता(एं) प्रोन्नत व्यक्ति (व्यक्तियों) की दशा में लागू होगी या नहीं.--आयु : लागू नहीं।

शैक्षिक अर्हता : लागू नहीं

9. परिवीक्षा की अवधि, यदि कोई हो.--(कं) सीधी भर्ती के लिए : (क) दो वर्ष, जिसका एक वर्ष से अनधिक ऐसी और अवधि के लिए विस्तार किया जा सकेगा, जैसा सक्षम प्राधिकारी विशेष परिस्थितियों में और कारणों को लिखित में अभिलिखित करके आदेश दे।

(ख) संविदा के आधार पर सेवाधृति के आधार पर नियुक्ति पर अधिवर्षिता के पश्चात पुनर्नियोजन पर तथा आमले न पर कोई परिवीक्षा नहीं होगी।

10. भर्ती की पद्धति ः भर्ती सीधी होगी या प्रोन्नति/सैकण्डमैण्ट/स्थानान्तरण द्वारा और विभिन्न पद्धतियाें द्वारा भरे जाने वाले पद(पदों) की प्रतिशतता.--शतप्रतिशत सीधी भर्ती द्वारा यथास्थिति, नियमित आधार पर या संविदा के आधार पर भर्ती द्वारा, ऐसा न होने पर सैकेण्डमैण्ट आधार पर।

11. प्रोन्नति/सैकण्डमैण्ट/स्थानान्तरण द्वारा भर्ती की दशा में वे श्रेणियां (ग्रेड) जिनसे प्रोन्नति/सैकण्डमैण्ट/स्थानान्तरण किया जाएगा.--स्तम्भ संख्या 7 में यथाविहित अनिवार्य/वांछनीय अर्हता(एं) परिपूर्ण करने के अध्यधीन सैकेण्डमैण्ट आधार पर।

12. यदि विभागीय प्रोन्नति समिति विद्यमान हो तो उसकी संरचना.--विभागीय प्रोन्नति/स्थायीकरण समिति : जैसी सरकार द्वारा समय-समय पर गठित की जाए।

13. भर्ती करने में जिन परिस्थितियों में हिमाचल प्रदेश लोक सेवा आयोग से परामर्श किया जाएगा.--जैसा विधि द्वारा अपेक्षित हो ।

14. सीधी भर्ती के लिए अनिवार्य अपेक्षा.--किसी सेवा या पद पर नियुक्ति के लिए अभ्यर्थी का भारत का नागरिक होना अनिवार्य है।

15. सीधी भर्ती द्वारा पद पर नियुक्ति के लिए चयन.--सीधी भर्ती के मामले में पद पर नियुक्ति के लिए चयन साक्षात्कार/व्यक्तित्व परीक्षा के अनुसार किया जाएगा या यदि, यथास्थिति, हिमाचल प्रदेश लोक सेवा आयोग या अन्य भर्ती अभिकरण/प्राधिकरण ऐसा करना आवश्यक या समीचीन समझे तो साक्षात्कार/ व्यक्तित्व परीक्षा से पूर्व में ली गई छंटनी परीक्षा (वस्तुनिष्ठ प्रकार की) या व्यवहारिक परीक्षा या दक्षता परीक्षा या शारीरिक परीक्षण के आधार पर किया जाएगा जिसका स्तर/पाठ्‌यक्रम आदि, यथास्थिति, हिमाचल प्रदेश लोक सेवा आयोग/अन्य भर्ती प्राधिकरण द्वारा अवधारित किया जाएगा ।

15-क. संविदा नियुक्ति द्वारा पद पर नियुक्ति के लिए चयन.--इन नियमों में किसी बात के होते हुए भी पद पर संविदा नियुक्तियां नीचे दिए गए निबन्धनों और शर्तों के अध्यधीन की जाएंगी :-

(I) संकल्पनाः

(क) इस पॉलिसी के अधीन हिमाचल प्रदेश भू-संपदा विनियामक प्राधिकरण में सहायक नगर योजनाकार को संविदा के आधार पर प्रारम्भ में एक वर्ष के लिए लगाया जाएगा, जिसे वर्षानुवर्ष आधार पर बढ़ाया जा सकेगा :

परन्तु संविदा अवधि में वर्षानुवर्ष आधार पर विस्तारण/नवीकरण के लिए सम्बद्ध विभागाध्यक्ष यह प्रमाण-पत्र जारी करेगा कि संविदा पर नियुक्त व्यक्ति की सेवा और आचरण वर्ष के दौरान संतोषजनक रहा है और केवल तभी उसकी संविदा की अवधि नवीकृत/विस्तारित की जाएगी। (ख) पद का हिमाचल प्रदेश लेक सेवा आयोग के कार्यक्षेत्र में आना ः प्रशासनिक सचिव (आवास़), हिमाचल प्रदेश सरकार रिक्त पदों को संविदा के आधार पर भरने के लिए सरकार का अनुमोदन प्राप्त करने के पश्चात्‌ अध्यपेक्षा को सम्बद्ध भर्ती अभिकरण अर्थात्‌ हिमाचल प्रदेश लोक सेवा आयोग के समक्ष रखेगा।

(ग) चयन इन नियमों में विहित पात्रता शर्तों के अनुसार किया जाएगा।

(II) संविदात्मक उपलब्धियां :

संविदा के आधार पर सहायक नगर योजनाकार को 21,000/-रुपए की दर से समेकित नियत संविदात्मक रकम (जो पे बैण्ड के न्यूनतम जमा ग्रेड पे के बराबर होगी) प्रतिमास संदत्त की जाएगी। यदि संविदा में एक वर्ष से अधिक की बढ़ौतरी की जाती है तो पश्चात्‌वर्ती वर्ष (वर्षाें) के लिए संविदात्मक उपलब्धियाें में 630/-रुपए की रकम (पद के पे बैण्ड के न्यूनतम जमा ग्रेड पे का तीन प्रतिशत) वार्षिक वृद्धि के रूप में अनुज्ञात की जाएगी।

(III) नियुक्ति/अनुशासन प्राधिकारी :

अध्यक्ष, हिमाचल प्रदेश भू-संपदा विनियामक प्राधिकरण नियुक्ति और अनुशासन प्राधिकारी होगा। (IV) चयन प्रक्रिया :

संविदा नियुक्ति के मामले में पद पर नियुक्ति के लिए चयन साक्षात्कार/व्यक्तित्व परीक्षा के अनुसार किया जाएगा या यदि, ऐसा करना आवश्यक समीचीन समझे तो साक्षात्कार/व्यक्तित्व परीक्षा से पूर्व में ली गई छंटनी परीक्षा (वस्तुनिष्ठ प्रकार की) या व्यवहारिक परीक्षा या दक्षता परीक्षा या शारीरिक परीक्षण के आधार पर किया जाएगा जिसका स्तर/पाठ्‌यक्रम आदि, सम्बद्ध भर्ती अभिकरण अर्थात्‌ हिमाचल प्रदेश लोक सेवा आयोग द्वारा अवधारित किया जाएगा।

(V) संविदात्मक नियुक्तियों के लिए चयन समिति :

जैसी सम्बद्ध भर्ती अभिकरण अर्थात्‌ हिमाचल प्रदेश लोक सेवा आयोग द्वारा समय-समय पर गठित की जाए ।

(VI) करार :

अभ्यर्थी को चयन के पश्चात्‌ इन नियमों से संलग्न उपाबन्ध-''ख'' के अनुसार करार हस्ताक्षरित करना होगा।

(VII) निबन्धन और शर्तें :

(क) संविदा के आधार पर नियुक्त व्यक्ति को 21,000/- रुपए की दर से नियत संविदात्मक रकम (जो पे बैण्ड के न्यूनतम जमा ग्रेड पे के बराबर होगी) प्रतिमास संदत्त की जाएगी । संविदा पर नियुक्त व्यक्ति आगे बढ़ाए गए वर्ष/वर्षाें के लिए संविदात्मक रकम में 630/- रुपए (पद के पे बैण्ड का न्यूनतम जमा गे्रड पे का तीन प्रतिशत) की रकम की वार्षिक वृद्धि का हकदार होगा और अन्य कोई सहबद्ध प्रसुविधाएं जैसे वरिष्ठ/चयन वेतनमान आदि नहीं दिया जाएगा। (ख) संविदा पर नियुक्त व्यक्ति की सेवा पूर्णतया अस्थायी आधार पर होगी। यदि संविदा पर नियुक्त व्यक्ति का कार्यपालन/आचरण ठीक नहीं पाया जाता है तो नियुक्ति पर्यवसित (समाप्त) किए2710 राजपत्र, हिमाचल प्रदेश, 17 अगस्त, 2021/26 श्रावण, 1943 जाने के लिए दायी होगी। यदि संविदा पर नियुक्त व्यक्ति नियुक्ति प्राधिकारी द्वारा जारी पर्यवसान (समापन) आदेश से संतुष्ट नहीं है तो वह उस तारीख, जिसको पर्यवसान (समापन) आदेश की प्रति उसे परिदत्त की गई है, से पैंतालीस दिन के भीतर अपील प्राधिकारी, जो नियुक्ति प्राधिकारी से उच्चतर पंक्ति का होगा, को अपील कर सकेगा/सकेगी।

(ग) संविदा पर नियुक्त व्यक्ति, एक कलैण्डर वर्ष में, एक मास की सेवा पूरी करने के पश्चात्‌ एक दिन के आकस्मिक अवकाश, दस दिन के चिकित्सा अवकाश और पांच दिन के विशेष अवकाश का हकदार होगा/होगी। संविदा पर नियुक्त महिला को दो जीवित बच्चों तक एक सौ अस्सी दिन का प्रसूति अवकाश दिया जा सकेगा। संविदा पर नियुक्त महिला कर्मचारी पूरी सेवा के दौरान, गर्भपात हो जाने सहित गर्भपात कराने की दशा में, प्राधिकृत सरकारी चिकित्सा अधिकारी द्वारा जारी चिकित्सा प्रमाण-पत्र प्रस्तुत करने पर पैंतालीस दिन से अनधिक प्रसूति अवकाश (जीवित बच्चों की संख्या का विचार किए बिना) के लिए भी हकदार होगी। संविदा पर नियुक्त कर्मचारी चिकित्सा प्रतिपूर्ति और एल0टी0सी0 आदि के लिए हकदार नहीं होगा/होगी। संविदा पर नियुक्त व्यक्ति को उपरोक्त के सिवाय किसी अन्य प्रकार का कोई अवकाश अनुज्ञात नहीं होगा :

अनुपभुक्त आकस्मिक अवकाश, चिकित्सा अवकाश और विशेष अवकाश एक कलैण्डर वर्ष तक संचित किया जा सकेगा और आगामी कलैण्डर वर्ष के लिए अग्रनीत नहीं किया जाएगा। (घ) नियन्त्रक अधिकारी के अनुमोदन के बिना कत्र्तव्य (ड्‌यूटी) से अनधिकृत अनुपस्थिति से स्वतः ही संविदा का पर्यवसान (समापन) हो जाएगा। तथापि आपवादिक मामलों में जहां पर चिकित्सा आधार पर कत्र्तव्य से अनधिकृत अनुपस्थिति के हालात संविदा पर नियुक्त व्यक्ति के नियन्त्रण से बाहर हाें तो उसके नियमितीकरण के मामले में विचार करते समय ऐसी अवधि अपवर्जित नहीं की जाएगी, किन्तु पदधारी को इस बाबत समय पर नियन्त्रक प्राधिकारी को सूचित करना होगा। तथापि संविदा पर नियुक्त व्यक्ति कत्र्तव्य से अनुपस्थिति की ऐसी अवधि के लिए संविदात्मक रकम का हकदार नहीं होगा :

परन्तु उसे सरकार के प्रचलित अनुदेशाें के अनुसार, चिकित्सा अधिकारी द्वारा जारी किए गए बीमारी/आरोग्य प्रमाण-पत्र को प्रस्तुत करना होगा।

(ङ) संविदा के आधार पर नियुक्त पदधारी जिसने तैनाती के एक स्थान पर तीन वर्ष का कार्यकाल पूर्ण कर लिया हो, आवश्यकता के आधार पर स्थानान्तरण हेतु पात्र होगा, जहां भी प्रशासनिक आधार पर ऐसा करना अपेक्षित हो।

(च) चयनित अभ्यर्थी को, राजपत्रित सरकारी कर्मचारी की दशा में, चिकित्सा बोर्ड द्वारा और अराजपत्रित सरकारी कर्मचारी की दशा में सरकारी चिकित्सा अधिकारी द्वारा जारी, अपना आरोग्य प्रमाण पत्र प्रस्तुत करना होगा। उन महिला अभ्यर्थियों की दशा में, जिन्हें परिसंकटमय स्वरूप के कर्त्तव्यों को कार्यान्वित करने वाले पदों के विरुद्ध नियुक्त किया जाना है और यदि उन्हें प्रशिक्षण की अवधि को सेवा-शर्त के रूप में पूर्ण करना है तो ऐसी महिला अभ्यर्थी, जो परीक्षण के परिणामस्वरूप बारह सप्ताह या इससे अधिक समय से गर्भवती पाई जाती है, को अस्थायी रूप से अनुपयुक्त घोषित किया जाएगा और उसकी नियुक्ति को तब तक आस्थगित रखा जाएगा जब तक कि प्रसवावस्था समाप्त नहीं हो जाती है। ऐसी महिला अभ्यर्थी का प्रसवावस्था की तारीख से छह सप्ताह के पश्चात्‌ चिकित्सा उपयुक्तता के लिए पुनः परीक्षण किया जाएगा, और यदि वह उपरोक्त यथा विनिर्दिष्ट प्राधिकारी से चिकित्सा आरोग्य प्रमाण-पत्र प्रस्तुत करने पर उपयुक्त पाई जाती है तो वह उसके लिए आरक्षित रखे गए पद पर नियुक्त की जा सकेगी।

(छ) संविदा पर नियुक्त व्यक्ति का, यदि अपने पदीय कत्र्तव्यों के सम्बन्ध में दौरे पर जाना अपेक्षित हो, तो वह उसी दर पर, जैसी कि नियमित प्रतिस्थानी पदधारी को वेतनमान के न्यूनतम पर लागू है, यात्रा भत्ते/दैनिक भत्ते का हकदार होगा/होगी।2711 राजपत्र, हिमाचल प्रदेश, 17 अगस्त, 2021/26 श्रावण, 1943 (ज) नियमित कर्मचारियों की दशा में यथा लागू सेवा नियमों जैसे एफ0 आर0-एस0 आर0, छुट्‌टी नियम, साधारण भविष्य निधि नियम, पेंशन नियम तथा आचरण नियम आदि के उपबन्ध संविदा पर नियुक्त व्यक्तियों की दशा में लागू नहीं होंगे। संविदा पर नियुक्त व्यक्ति (व्यक्तियों) को कर्मचारी सामूहिक बीमा स्कीम के साथ-साथ ई.पी.एफ./जी.पी.एफ. भी लागू नहीं होगा। 16. आरक्षण.--सेवा में नियुक्ति, हिमाचल प्रदेश सरकार द्वारा, समय-समय पर अनुसूचित जातियाें/अनुसूचित जनजातियाें/अन्य पिछड़े वर्गाें और व्यक्तियों के अन्य प्रवर्गों के लिए सेवा में आरक्षण की बाबत जारी किए गए आदेशों के अधीन होगी।

17. विभागीय परीक्षा.--सेवा में प्रत्येक सदस्य को समय-समय पर यथा संशोधित हिमाचल प्रदेश विभागीय परीक्षा नियम, 1997 में यथा विहित विभागीय परीक्षा उत्तीर्ण करनी होगी।

18. शिथिल करने की शक्ति.--जहां राज्य सरकार की यह राय हो कि ऐसा करना आवश्यक या समीचीन है, वहां वह, कारणों को लिखित में अभिलिखित करके और हिमाचल प्रदेश लोक सेवा आयोग के परामर्श से, आदेश द्वारा, इन नियमों के किसी/किन्हीं उपबन्ध (उपबन्धों) को किसी वर्ग या व्यक्ति (व्यक्तियाें) के प्रवर्ग या पद (पदाें) की बाबत, शिथिल कर सकेगी।

यह करार श्री/श्रीमती ...................................................... पुत्र/पुत्री श्री ..............................................................निवासी ......................................... ....................... संविदा पर नियुक्त व्यक्ति (जिसे इसमें इसके पश्चात्‌ प्रथम पक्षकार कहा गया है) और हिमाचल प्रदेश के राज्यपाल के मध्य अध्यक्ष, हिमाचल प्रदेश भू-संपदा विनियामक प्राधिकरण (जिसे इसमें इसके पश्चात्‌ द्वितीय पक्षकार कहा गया है) के माध्यम से आज तारीख ........................... को किया गया है।

द्वितीय पक्षकार ने उपरोक्त प्रथम पक्षकार को लगाया है और प्रथम पक्षकार ने . . . सहायक नगर योजनाकार के रूप में संविदा आधार पर निम्नलिखित निबन्धन और शर्तों पर सेवा करने के लिए सहमति दी हैः-

1. यह कि प्रथम पक्षकार ने सहायक नगर योजनाकार के रूप में ......... ...... से प्रारम्भ होने और ......

....... को समाप्त होने वाले दिन तक एक वर्ष की अवधि के लिए द्वितीय पक्षकार की सेवा में रहेगा। यह विनिर्दिष्ट रूप से उल्लिखित किया गया है और दोनों पक्षकारों द्वारा करार पाया गया है कि प्रथम पक्षकार की द्वितीय पक्षकार के साथ संविदा, आखिरी कार्य दिवस्‌ अर्थात्‌.......को स्वयंमेव ही पर्यवसित (समाप्त) हो जाएगी तथा सूचना नोटिस आवश्यक नहीं होगाः

परन्तु संविदा अवधि में वर्षानुवर्ष आधार पर विस्तारण/नवीकरण के लिए सम्बद्ध विभागाध्यक्ष यह प्रमाण-पत्र जारी करेगा कि संविदा पर नियुक्त व्यक्ति की सेवा और आचरण उस वर्ष के दौरान संतोषजनक रहा है और केवल तभी उसकी संविदा की अवधि नवीकृत/विस्तारित की जाएगी। 2. प्रथम पक्षकार की स्ांविदात्मक रकम 21,000/- प्रतिमास होगी।

3. संविदा पर नियुक्त व्यक्ति की सेवा पूर्णतया अस्थायी आधार पर होगी। यदि संविदा पर नियुक्त व्यक्ति का कार्यपालन/आचरण ठीक नहीं पाया जाता है तो नियुक्ति पर्यवसित (समाप्त) किए जाने के लिए दायी होगी। यदि संविदा पर नियुक्त व्यक्ति नियुक्ति प्राधिकारी द्वारा जारी पर्यवसान (समापन) आदेश से सन्तुष्ट नहीं है तो वह उस तारीख, जिसको पर्यवसान (समापन) आदेश की प्रति उसे परिदत्त की गई है, से पैंतालीस दिन के भीतर अपील प्राधिकारी, जो नियुक्ति प्राधिकारी से उच्चतर पंक्ति का होगा, को अपील कर सकेगा। 2712 राजपत्र, हिमाचल प्रदेश, 17 अगस्त, 2021/26 श्रावण, 1943 4. संविदा पर नियुक्त व्यक्ति एक कलैण्ड़र वर्ष में एक मास की सेवा पूरी करने के पश्चात्‌ एक दिन के आकस्मिक अवकाश, दस दिन के चिकित्सा अवकाश और पांच दिन के विशेष अवकाश का हकदार होगा/होगी। संविदा पर नियुक्त महिला को दो जीवित बच्चों तक एक सौ अस्सी दिन का प्रसूति अवकाश दिया जा सकेगा। स्ांविदा पर नियुक्त महिला कर्मचारी पूरी सेवा के दौरान, गर्भपात हो जाने सहित गर्भपात कराने की दशा में, प्राधिकृत चिकित्सा अधिकारी द्वारा जारी प्रमाण पत्र प्रस्तुत करने पर पैंतालीस दिन से अनधिक प्रसूति अवकाश (जीवित बच्चों की संख्या का विचार किए बिना) के लिए भी हकदार होगी। संविदा पर नियुक्त कर्मचारी चिकित्सा प्रतिपूर्ति और एल0टी0सी0 आदि के लिए हकदार नहीं होगा/होगी। संविदा पर नियुक्त व्यक्ति को उपरोक्त के सिवाय अन्य किसी प्रकार का कोई अवकाश अनुज्ञात नहीं होगाः

अनुपभुक्त आकस्मिक अवकाश, चिकित्सा अवकाश और विशेष अवकाश एक कलैण्डर वर्ष तक संचित किया जा सकेगा और आगामी कलैण्डर वर्ष के लिए अग्रनीत नहीं किया जाएगा।

5. नियन्त्रक प्राधिकारी के अनुमोदन के बिना र्काव्य (ड्‌यूटी) से अनधिकृत अनुपस्थिति से स्वतः ही संविदा का पर्यवसान (समापन) हो जाएगा। तथापि आपवादिक मामलाें में जहां पर चिकित्सा आधार पर कत्र्तव्य से अनधिकृत अनुपस्थिति के हालात संविदा पर नियुक्त व्यक्ति के नियन्त्रण से बाहर हों तो उसके नियमितीकरण के मामले में विचार करते समय ऐसी अवधि अपवर्जित नहीं की जाएगी, परन्तु पदधारी को इस बाबत समय पर नियन्त्रक प्राधिकारी को सूचित करना होगा। तथापि संविदा पर नियुक्त व्यक्ति कत्र्तव्य से अनुपस्थिति की ऐसी अवधि के लिए संविदात्मक रकम का हकदार नहीं होगाः

परन्तु उसे सरकार के प्रचलित अनुदेशों के अनुसार, चिकित्सा अधिकारी द्वारा जारी किए गए बीमारी/आरोग्य प्रमाण-पत्र को प्रस्तुत करना होगा।

6. संविदा के आधार पर नियुक्त अधिकारी जिसने तैनाती के स्थान पर तीन वर्ष का कार्यकाल पूर्ण कर लिया हो, आवश्यकता के आधार पर स्थानान्तरण हेतु पात्र होगा/होगी, जहां भी प्रशासनिक आधाराें पर अपेक्षित हो।

7. चयनित अभ्यर्थी को, राजपत्रित सरकारी कर्मचारी की दशा में, चिकित्सा बोर्ड द्वारा और अराजपत्रित सरकारी कर्मचारी की दशा में सरकारी चिकित्सा अधिकारी द्वारा जारी, अपना आरोग्य प्रमाण पत्र प्रस्तुत करना होगा। उन महिला अभ्यर्थियों की दशा में, जिन्हें परिसंकटमय स्वरूप के कर्त्तव्यों को कार्यान्वित करने वाले पदों के विरुद्ध नियुक्त किया जाना है और यदि उन्हें प्रशिक्षण की अवधि को सेवा-शर्त के रुप में पूर्ण करना है तो ऐसी महिला अभ्यर्थी, जो परीक्षण के परिणामस्वरूप बारह सप्ताह या इससे अधिक समय से गर्भवती पाई जाती है, को अस्थायी रूप से अनुपयुक्त घोषित किया जाएगा और उसकी नियुक्ति को तब तक आस्थगित रखा जाएगा जब तक कि प्रसवावस्था समाप्त नहीं हो जाती है। ऐसी महिला अभ्यर्थी का प्रसवावस्था की तारीख से छह सप्ताह के पश्चात्‌ चिकित्सा उपयुक्तता के लिए पुनः परीक्षण किया जाएगा, और यदि वह उपरोक्त यथा विनिर्दिष्ट प्राधिकारी से चिकित्सा आरोग्य प्रमाण-पत्र प्रस्तुत करने पर उपयुक्त पाई जाती है तो वह उसके लिए आरक्षित रखे गए पद पर नियुक्त की जा सकेगी।

8. संविदा पर नियुक्त व्यक्ति का यदि अपने पदीय कत्र्तव्याें के सम्बन्ध में दौरे पर जाना अपेक्षित हो, तो वह उसी दर पर, जैसी कि नियमित प्रतिस्थानी पदधारी को पद के वेतनमान के न्यूनतम पर लागू है, यात्रा भत्ते/दैनिक भत्ते का हकदार होगा/होगी।

9. संविदा पर नियुक्त व्यक्ति (व्यक्तियों) को कर्मचारी सामूहिक बीमा योजना के साथ-साथ ई0पी0एफ0/जी0पी0एफ0 भी लागू नहीं होगा।

No. HSG-A(3)-4/2020 (Rules) ATP.—In exercise of the powers conferred by section 28 of Real Estate (Regulation and Development) Act, 2016 (No. 16 of 2016), and in consultation with the H.P. Real Estate Regulatory Authority, the Governor of Himachal Pradesh is pleased to make the Recruitment and Promotion Rules for the post of Assistant Town Planner, Class-I (Gazetted) in the Real Estate Regulatory Authority (RERA), Himachal Pradesh as per Annexure "A" attached to this notification, namely:—

Short title and Commencement.— (1) These rules may be called the Himachal Pradesh, Real Estate Regulatory Authority, Assistant Town Planner, Class-I (Gazetted), Recruitment and Promotion Rules, 2021.

(2) These rules shall come into force from the date of publication in the Rajpatra (e-Gazette), Himachal Pradesh.

ANNEXURE-'A' RECRUITMENT AND PROMOTION RULES, FOR THE POST OF ASSISTANT TOWN PLANNER, CLASS-1, (GAZETTED) IN THE HIMAMCHAL PRADESH REAL ESTATE REGULATORY AUTHORITY

1. Name of the post.—Assistant Town Planner.

2. Number of post (s).—1(One).

4. Scale of pay.—(i) Pay Scale for regular incumbent(s) : Pay Band- ` 15600-39100+ ` 5400/-Grade Pay.

(ii) Emoluments for contract employee(s) : ` 21000/-PM as per details given in Column 15-A.

5. Whether "Selection" Post or Non-Selection" Post.—Selection.

6. Age for direct Recruitment.—18 to 45 years:

Provided that the upper age limit for direct recruits will not be applicable to the candidates already in service of the Government including those who have been appointed on adhoc or on contract basis:

Provided further that if a candidate appointed on adhoc basis or on contract basis had become over- age on the date he/she was appointed as such, he/she shall not be eligible for any relaxation in the prescribed age-limit by virtue of his/her such adhoc or contract appointment:

Provided further that upper age limit is relaxable for Scheduled Castes/Scheduled Tribes/Other Backward Classes and Other categories of persons to the extent permissible under the general or special order(s) of the Himachal Pradesh Government:

Provided further that the employees of all the Public Sector Corporations and Autonomous Bodies who happened to be Government Servants before absorption in Public Sector Corporations/ Autonomous Bodies at the time of initial constitutions of such Corporations/Autonomous Bodies shall be allowed age concession in direct recruitment as admissible to Government servants. This concession will not, however, be admissible to such staff of the Public Sector Corporations/ Autonomous Bodies who were/are subsequently appointed by such Corporations/Autonomous Bodies and who are/were finally absorbed in the service of such Corporation/Autonomous Bodies after initial constitution of the Public Sector Corporations/Autonomous Bodies.

Note.—Age limit for direct recruitment will be reckoned on the first day of the year in which the post(s) is/are advertised for inviting applications or notified to the Employment Exchange or as the case may be.

7. Minimum educational and other qualifications required for direct recruit (s).— (a) Essential Qualification(s) : (i) Should possess a Master of Planning /M.Tech./Post Graduate Degree in Urban Planning or, City Planning or, Town Planning or, Regional Planning or, Housing Planning or, Country Planning or, Rural Planning or, Infrastructure Planning or, Transport Planning or, Rural and Urban Planning or, Environmental Planning from a recognized University or an Institute duly recognized by the All India Institute of Town Planners, India.

Or

(ii) Bachelor of Planning or, Bachelor of Technology in Planning from a University or an Institute duly recognized by the All India Institute of Town Planners, India.

AND

(b) Minimum three years experience in Urban Planning or, City Planning or, Town Planning or,Regional Planning or, Housing Planning or, Country Planning or, Rural Planning or,2715 राजपत्र, हिमाचल प्रदेश, 17 अगस्त, 2021/26 श्रावण, 1943 Infrastructure Planning or, Transport Planning or, Rural and Urban Planning or, Environmental Planning in the Central Government or State Government department after acquiring the qualification of Bachelor of Planning or B.Tech. Degree in Planning.

(b) Desirable Qualification : Knowledge of customs, manners and dialects of Himachal Pradesh and suitability for appointment in the peculiar conditions prevailing in the Pradesh.

8. Whether age and educational qualification(s) prescribed for direct recruit(s) will

apply in the case of the promotee (s).—Age : Not applicable.

Educational : N.A.

9. Period of probation, if any.—Direct Recruitment : (a) Two years subject to such further extension for a period not exceeding one year as may be ordered by the competent authority in special circumstances and reasons to be recorded in writing.

(b) No probation in case of appointment on contract basis, tenure basis, re-employment after superannuation and absorption.

10. Method(s) of recruitment, whether by direct recruitment or by promotion/ secondment/transfer and the percentage of post(s) to be filled in by various methods.—100% by direct recruitment on a regular basis or by recruitment on contract basis, as the case may be, failing which on secondment basis.

11. In case of recruitment by promotion/secondment/transfer, grade (s) from which promotion/secondment/transfer is to be made.—On secondment basis, subject to fulfilment of essential/desirable qualification(s) as prescribed in Column No. 7.

12. If a Departmental Promotion Committee exists, what is its Composition.— Departmental Promotion/Confirmation Committee : As may be constituted by the Himachal Pradesh Real Estate Regulatory Authority from time to time.

13. Circumstances under which the Himachal Pradesh Public Service Commission (HPPSC) is to be consulted in making recruitment.—As required under the law.

14. Essential requirement for direct recruitment.—A candidate for appointment to any service or post must be a citizen of India.

15. Selection for appointment to the post by direct recruitment.—Selection for appointment to the post in the case of direct recruitment shall be made on the basis of interview/personality test or if the Himachal Pradesh Public service Commission or other recruiting agency/authority as the case may be, so consider necessary or expedient on the basis of interview/personality test preceded by a screening test (objective test)/written test or practical test or physical test, the standard/syllabus, etc. of which, will be determined by the Commission /other recruiting authority, as the case may be.

15-A. Selection for appointment to the post by contractrecruitment.— Notwithstanding anything contained in these rules, contract appointments to the post will be made subject to the terms and conditions given below:—

(a) Under this policy the Assistant Town Planner in the Himachal Pradesh Real Estate Regulatory Authority will be engaged on contract basis initially for one year, which may be extendable on year-to-year basis:

Provided that for extension/renewal of contract period on year to year basis the Chairperson, Himachal Pradesh Real Estate Regulatory Authority shall issue a Certificate that the service and conduct of the contract appointee is satisfactory during the year and only then his period of contract is to be renewed/extended.

(b) POST FALLS WITHIN THE PURVIEW OF HIMACHAL PRADESH PUBLIC SERVICE COMMISSION : The Administrative Secretary (Housing) to the Government of Himachal Pradesh after obtaining the approval of the State Government to fill up the vacant post(s) on contract basis will place the requisition with the concerned recruiting agency i.e. the Himachal Pradesh Public Service Commission.

(c) The selection will be made in accordance with the eligibility conditions prescribed in these Rules.

(II) CONTRACTUAL EMOLUMENTS :

The Assistant Town Planner appointed on contract basis will be paid consolidated fixed contractual amount @ ` 21000/- per month (which shall be equal to minimum of the Pay- Band+Grade Pay). An amount of ` 630/-( 3% of the minimum of the Pay Band + Grade Pay of the post) as annual increase in contractual emoluments for the subsequent year(s) will be allowed, if contract is extended beyond one year.

(III) APPOINTING/DISCIPLINARY AUTHORITY :

The Chairperson, Himachal Pradesh Real Estate Regulatory Authority will be the appointing and disciplinary authority.

(IV) SELECTION PROCESS :

Selection for appointment to the post in the case of Contract Appointment will be made on the basis of interview/personality test or if considered necessary or expedient on the basis of interview/personality test preceded by a screening test (objective type)/written test or practical test or physical test, the standard/syllabus etc. of which will be determined by the concerned recruiting agency i.e. the Himachal Pradesh Public Service Commission.

(V) COMMMITEE FOR SELECTION OF CONTRACTUAL APPOINTMENTS :

As may be constituted by concerned recruiting agency i.e. the Himachal Pradesh Public Service Commission from time to time.

(VI) AGREEMENT :

After selection of a candidate, he/she shall sign an agreement as per Annexure-"B" appended to these Rules.

(a) The Contractual Appointee will be paid fixed contractual amount @ ` 21000/- per month (which shall be equal to minimum of the Pay Band + Grade Pay). The contract appointee will be entitled for increase in contractual amount @ ` 630/-(3% of minimum of the Pay Band + Grade Pay of the post) for further extended years and no other allied benefits such as senior/selection scales etc. will be given.

(b) The service of the contract appointee will be purely on temporary basis. The appointment is liable to be terminated in case the performance/conduct of the contract appointee is not found satisfactory. In case the contract appointee is not satisfied with the termination orders issued by the Appointing Authority, he/she may prefer an appeal before the Appellate Authority who shall be higher in rank to the Appointing Authority, within a period of 45 days, from the date a copy of termination order is delivered to him/her.

(c) The contract appointee will be entitled for one day's casual leave after putting one month service, 10 days' medical leave and 5 days' special leave, in a Calendar year. A female contract appointee with less than two surviving children may be granted maternity leave for 180 days. A female contract appointee shall also be entitled for maternity leave not exceeding 45 days (irrespective of the number of surviving children) during the entire service, in case of miscarriage including abortion, on production of medical certificate issued by the authorized Government Medical Officer. A contract employee shall not be entitled for medical, re- imbursement and LTC etc. No leave of any other kind except above is admissible to the contract appointee:

Un-availed casual leave, medical leave and special leave can be accumulated upto the calendar year and will not be carried forward for the next calendar year.

(d) Unauthorized absence from the duties without the approval of the Controlling Officer shall automatically lead to the termination of the contract. However, in exceptional cases where the circumstances for un-authorized absence from duty were beyond his/her control on medical grounds, such period shall not be excluded while considering his/her case for regularization but the incumbent shall have to intimate the controlling authority in this regard well in time. However, the contract appointee shall not be entitled for contractual amount for this period of absence from duty:

Provided that he/she shall submit the certificate of illness/fitness issued by the Medical Officer, as per prevailing instructions of the State Government.

(e) An official appointed on contract basis who has completed three years tenure at one place of posting will be eligible for transfer on need based basis wherever required on administrative grounds.

(f) Selected candidate will have to submit a certificate of his/her fitness issued by a Medical Board in case of Gazetted Government servant and by Government Medical Officer in the case of Non-Gazetted servant. In case of women candidates who are to be appointed against posts carrying hazardous nature of duties, and in case they have to complete period of training as condition of service, such woman candidate, who as a result of tests is found to be pregnant of twelve weeks standing or more shall be declared temporarily unfit and her appointment shall be held in abeyance until the2718 राजपत्र, हिमाचल प्रदेश, 17 अगस्त, 2021/26 श्रावण, 1943 confinement is over. Such woman candidate be re-examined for medical fitness six weeks after the date of confinement, and if she is found fit on production of medical fitness certificate from the authority as specified above, she may be appointed to the post kept reserved for her.

(g) Contract Appointee will be entitled to TA/DA, if required to go on tour in connection with his/her official duties at the same rate as applicable to regular counterpart official at the minimum of pay scale.

(h) Provisions of service rules like FRSR, Leave Rules, GPF Rules, Pension Rules & Conduct Rules etc. as are applicable in case of regular employees will not be applicable in case of contract appointees. The Employees Group Insurance Scheme as well as EPF/GPF will also not be applicable to Contract Appointee(s).

16. Reservation.—The appointment to the service shall be subject to the orders regarding reservation in the service for Scheduled Castes/ Scheduled Tribes/Other Backwards Classes/ Other categories of persons issued by the Himachal Pradesh Government from time to time.

17. Departmental Examination.—Every member of the service shall pass a Departmental Examination as prescribed in the Himachal Pradesh Departmental Examination Rules, 1997, as amended from time to time.

18. Power to Relax.—Where the State Government is of the opinion that it is necessary or expedient to do so, it may, by order for reasons to be recorded in writing and in consultation with the Himachal Pradesh Public Service Commission, relax any of the provision(s) of these Rules with respect to any Class or Category of person(s) or post(s).

ANNEXURE-"B" Form of Contract Agreement to be executed between the Assistant Town Planner and the Government of Himachal Pradesh through Chairperson Himachal Pradesh Real Estate Regulatory Authority

This Agreement is made on this ___________________________ day of _____________ in the year ________________________ between Sh/Smt. ________________s/o/d/o Shri_______________________ r/o ___________________________, Contract Appointee (hereinafter called the FIRST PARTY) AND the Governor, Himachal Pradesh through Chairperson, Himachal Pradesh Real Estate Regulatory Authority (here-in-after called the SECOND PARTY).

Whereas, the SECOND PARTY has engaged the aforesaid FIRST PARTY and the FIRST PARTY has agreed to serve as an Assistant Town Planner on contract basis on the following terms and conditions:—

1. That the FIRST PARTY shall remain in the service of the SECOND PARTY as Assistant Town Planner on contract basis for a period of one year commencing on day of___________________ and ending on the day of ___________________.It is specifically mentioned and agreed upon by both the parties that the contract of the FIRST PARTY with SECOND PARTY shall ipso-facto stand terminated on the last2719 राजपत्र, हिमाचल प्रदेश, 17 अगस्त, 2021/26 श्रावण, 1943 working day i.e. on_________________________ and information notice shall not be necessary:

No. Home-C(A)3-2/2010.—Whereas the Private Security Agencies (Regulation) Act, 2005 (the Act) provides for the regulation of private security agencies in the Pradesh and grant of licences to such agencies is being made under the provisions of the said Act;

And whereas vide this Department notification No. Home- C(A)3-2/2010 dated 16-01-2020 Sh. Manoj Kumar Chauhan, HAS, Special Secretary (Home) to the Government of Himachal Pradesh was appointed the Controlling Authority under section 3 sub section (1) of the Act.

And whereas till date, the said Controlling Authority has issued 47 new licences or renewals of existing licences since 16th January, 2020. The District wise details of such licences given to the private security agencies is in the Annexure to this Notification.

And whereas under the provision of section 9 of the said Act, every private security agency has to ensure within six months of obtaining the licence, commencement of activities including imparting training and skills to its security guards, ensure the compliance of the provisions of section 10 (1) of the Act before engaging supervisor or security guards and also ensure compliance with other provisions of the Act, including sections 12, 15,17,18, 19 etc.

Now therefore, under the provisions of Section 19 of the Act, it is hereby ordered that the Superintendents of Police of the Districts in which such licences have been given, shall carry out the inspection of the premises of the security agencies whose names are given in the Annexure to this Notification to verify and check whether compliance has been made by these licensee security agencies with the provisions of the Act, in cases where a time period of six months has elapsed since the issue of the licence. In case, compliance has not been made with the provisions of the Act, by the licence agencies, appropriate action under the Act may be taken by the concerned SPs including making recommendations to the State Government through the Controlling Authority under provisions of section 13 of the Act, in case applicable.

The report of the Superintendents of Police of the Districts mentioned in the Annexure may be submitted to the Controlling Authority on or before 15th September, 2021.

श्रीमती दया देवी पत्नी श्री जगदीश चन्द, निवासी गांव पपरोला, तहसील बैजनाथ, जिला कांगड़ा (हि0 प्र0) ने इस अदालत में प्रार्थना-पत्र गुजारा है कि उसके ससुर श्री दीवाना राम की मृत्यु दिनांक 01-12-2002 को पपरोला में हुई थी जोकि सम्बन्धित पंचायत/नगर पंचायत के रिकार्ड में पंजीकृत न है। अतः इस नोटिस के माध्यम से सर्वसाधारण को सूचित किया जाता है कि यदि किसी व्यक्ति को उपरोक्त पंजीकरण के बारे में कोई उजर व एतराज हो तो वह दिनांक 17-09-2021 को सुबह 10.00 बजे इस न्यायालय में असालतन या वकालतन हाजिर आकर अपना उजर/एतराज पेश कर सकता है अन्यथा उपरोक्त मृत्यु का पंजीकरण करने के आदेश दे दिये जायेंगे। उसके उपरान्त कोई एतराज न सुना जायेगा। आज दिनांक 14-07-2021 को मेरे हस्ताक्षर व मोहर अदालत द्वारा जारी हुआ।

श्रीमती गुड्‌डी देवी पत्नी श्री प्रीतम चन्द, निवासी पन्तेहड़, तहसील बैजनाथ, जिला कांगड़ा (हि0 प्र0) ने इस अदालत में प्रार्थना-पत्र गुजारा है कि उसकी ननद की मृत्यु दिनांक 01-12-2002 को उस्तेहड़ में हुई थी जोकि सम्बन्धित पंचायत/नगर पंचायत के रिकार्ड में पंजीकृत न है।

श्री अर्जुन सिंह मैहता पुत्र श्री मस्त राम, निवासी गांव विकास नगर, डा0 महाकाल, तहसील बैजनाथ, जिला कांगड़ा (हि0 प्र0) ने इस अदालत में प्रार्थना-पत्र गुजारा है कि उसकी माता श्रीमती जानकी देवी की मृत्यु दिनांक 28-10-2000 को महाल विकास नगर में हुई थी परन्तु इस बारे पंचायत के रिकार्ड में पंजीकरण नहीं करवाया जा सका। अतः अब पंजीकरण के आदेश दिये जायें।

अतः इस नोटिस के माध्यम से सर्वसाधारण को सूचित किया जाता है कि यदि किसी व्यक्ति को उपरोक्त पंजीकरण के बारे में कोई उजर व एतराज हो तो वह दिनांक 17-08-2021 को सुबह 10.00 बजे 2734 राजपत्र, हिमाचल प्रदेश, 17 अगस्त, 2021/26 श्रावण, 1943 असालतन या वकालतन हाजिर आकर पेश कर सकता है अन्यथा उपरोक्त मृत्यु का पंजीकरण करने के आदेश दे दिये जायेंगे। उसके उपरान्त किसी भी प्रकार का कोई भी उजर/एतराज न सुना जायेगा। आज दिनांक 07-07-2021 को मेरे हस्ताक्षर व मोहर अदालत द्वारा जारी हुआ।
