No. HFW-B(B)15-7/2023.—The matter with regard to delegation of powers to the Director, Medical Education & Research, Himachal Pradesh was engaging the attention of the Government for some time past.

After careful consideration of the matter and in supersession of all previous orders, issued in this regard, the Governor, Himachal Pradesh is pleased to order the delegation of following administrative powers/duties and responsibilities to the Director, Medical Education, Himachal Pradesh as under:—

1.	Appointment of Senior Resident/ Tutor Specialist in Government Medical/ Colleges and Superspecialty Hospital of the State and Lecturer in H.P. Government Dental College of the State on tenure basis strictly as per provisions of Policy/instructions issued by the Government from time to time as well as on the basis of recommendations of respective Selection/Counseling Committee after obtaining the approval of Government.
2.	F inalization/ publication of prospectus in respect of all courses running in Government/ Private Institutions in the State as per approved policy of the Government from time to time and recommendations of respective Prospectus Committee after obtaining the approval of Government.
3.	Finalization and issue of notification of admission procedure and incorporation of fees and admission procedure in the Prospectus respective courses in respect of all Government/ Private Institutions as per approved Policy of the Government from time to time and recommendations of respective Admission & Fee Committees after obtaining the approval of the Government.
4.	Admission and counseling of all Nursing and Paramedical Courses in consultation with the concerned University.
5.	Approval for migration of MBBS/ BDS students from one Government Medical/Dental College/institution to another, on the basis of NMC/DCI guidelines/norms/regulations as well as provisions of HP University Ordinance/Act/Rules after obtaining approval of the Government.
6.	Permission for purchase/sale of moveable/immovable properties by the faculty members as well as other staff under their control as required under provisions of CCS(Conduct) Rules strictly as per guidelines/instructions issued by the Government from time to time.
7.	Approval for purchase of Oxygen Concentrator, on the basis of recommendations of Committee constituted for this purpose and as per provisions of CS (Medical Attendance) Rules as well as instructions/ rules/ committee issued/constituted by the Government from time to time.
8.	NOC for new/renewal of Passport in respect of all the faculty members as well as other staff under their control.
9.	Permission for official tours/visit within the country by the faculty members as well as other staff under their control upto 15 days.
10.	Approval for short term seminars/ training/ conferences/ workshop/ fellowship/ seminars/ observership etc. within the country in favour of faculty members and other staff under their control above 15 days upto one month strictly as per the guidelines/rules/instructions issued/fixed by the Government from time to time.
11.	Permission to visit outside the country in favour of faculty members and other staff under their control proceeding on leave on personal visit upto one month strictly as per guidelines/instructions/rules issued/fixed by the Govt. from time to time.
12.	All types of leave cases of different categories except EOL and Study Leave in favour of faculty members. Provided further that Study Leave and EOL for the purpose of higher study within the country as well as abroad will be sanctioned by the Government on the recommendations of Screening Committee as well as the Director Medical Education, HP. Provided further that the respective Principal will forward the proposal to the Director Medical Education after examining all the aspects in this regard for approval of competent authorities.
13.	To file reply of court cases pertaining to their office before the Hon'ble Court well within stipulated time period.
14.	Permission and fixation of fees/security for undergoing various courses/ internship courses in Medical/ Dental Colleges/ Superspecialty Hospitals/ colleges/ institutions of the State strictly as per the provisions/rules/norms fixed by the NMC/ DCI/ other applicable bodies etc. (as the case may be) after obtaining the approval of Government.
15.	Time Barred claims in respect of Pay, DA, Medical Reimbursement etc. in favour of all the faculty members as well as other staff under their control strictly as per the rules/ instructions issued by the Government from time to time.
16.	Retaining of Government accommodation in respect of faculty members as well as other staff under their control, of their own departmental pool (this may be done strictly as per rules).
17.	Permission to hold health awareness/ free check up camps in the State strictly as per the norms/ guidelines fixed by NMC/ MoHFW, GoI/ Government of HP from time to time.
18.	Any other powers/duties/ responsibilities delegated/assigned by the Government from time to time.

Note:—

➢ All the faculty members/resident doctors/other staff under the establishment/control of

respective Principals shall forwarded their representation/request/complaint (as the case may be)

to the Government through the Principal Concerned as the large number of direct correspondence

is being received by the Government from faculties/ HODs/GDOs/other staff etc. on professional

and personal matters. Even correspondence is being made directly to the Government on issues

which falls in the domain/ which requires rederessal at respective Principal/DME level. This

vitiates the Government protocol and decorum and also lead to undue correspondence.

➢ All the Principals of Government Medical/Dental Colleges/institutions of the State shall

route the proposal to the Government through the Director, Medical Education & Research,

Himachal Pradesh.

➢ All the Principals of Government Medical/ Dental Colleges/ institutions of the State are

directed to forward the proposal/ service particulars to fill up vacant/ anticipated vacant posts of

faculty members prior to two and half months [the post(s) which is/are already vacant due to non-

availability of eligible candidate in the respective specialty & institution OR is/are to be fallen

vacant due to retirement of the incumbent(s) on attaining the age of superannuation, as the case

may be] to the Government through proper channel.

The above delegation will come into force with immediate effect. While exercising these powers, the concerned officers/officials will ensure that terms and conditions/guidelines/norms/ policy fixed/issued by the Government/ NMC/GoI from time to time with regard to above mentioned subjects/duties & responsibilities after fulfilling all the other codal formalities procedural in this regard well in advance.

After careful consideration of the matter and in supersession of all previous orders, issued in this regard, the Governor, Himachal Pradesh is pleased to assign the following duties and responsibilities to the officer(s)/official(s) of all the Government Medical Colleges of the State and AIMSS Chamiana (Shimla), in the public interest in order to ensure smooth and efficacious functioning of health services and academic education as under:—

Admission/Counseling/Academic courses:- • ( i) All correspondence with regard to NMC/MCI and Government of India in relation to academic courses and admissions.
		(ii) All matters related to admissions and collections of fees etc. including court cases arising out of the above. Others:— • ( iii) Proper organization of OPDs and diagnostic services. ( iv) Management of RKS and other societies of the hospitals. ( v) All matters related to Parliamentary and Assembly. ( vi) Grant of all kinds of leave except Study Leave/EOL in respect of Resident doctors and PG/DM/MCh students would be with the HOD concerned. The HOD will also sanction casual leave in case of consultants strictly as per guidelines/ rules/ instructions issued in this regard from time to time. ( vii) Grant of Study Leave/ EOL/Grant of Leave for participation in international workshop would rest with the State Government. ( viii) Approval for short term seminars/ training/conferences/ workshop/ fellowship/ seminars/ observership etc. within the country in favour of faculty members/consultant/resident doctors upto 14 days on the basis of guidelines/instructions fixed/ issued by the Government from time to time. ( ix) Permission for official tours/visit within the country by the faculty members/consultant/resident doctors. ( x) Any other duties/powers/responsibilities assigned by the Government from time to time.
2.	Joint/ Additional Director	All Financial powers:— • ( i) Utilization of budget and submission of utilization certificates thereof. ( ii) Processing of cases for administrative approval and expenditure sanction of all civil, construction, machinery, equipment and monitoring of the works. ( iii) For the purpose of budget utilization, he/she will exercise all powers of HOD and will go as per the delegation made vide notification No. HFW-B(A)1-1/2013, dated 28-09-2013 as amended from time to time by the Government. ( iv) Preparation of budget estimates/plan proposals and monitoring of all centrally sponsored schemes. ( v) Sanction of GPF advance and any other matter related to GPF accounts of all employees including consultants.
		(vi) All matters related to security and parking after constituting a Committee. Construction, Purchase and Land matters:— • ( i) All building construction work. ( ii) All types of purchase with regard to machinery equipments and any other materials. ( iii) All types of land matters. Estate Matters:— • ( iv) Allotment of Government accommodation/houses from concerned Medical College/AIMSS Chamiana's pool. ( v) All matters related to IPD services and Estate management including allocation of space. All kinds of Leave:— • ( i) Grant of all kinds of leave/vacation including casual leave of all Class-II to Class-IV employees including drivers. ( ii) All matters related to the posting, transfer, grant of pay scales, annual increment etc. in respect of all Class-II to Class-IV employees including drivers. Enquiry and Disciplinary proceedings:— • ( i) Enquiries and disciplinary proceedings related to Class-II to Class-IV categories including drivers. Others:— • ( i) All PAC and CAG matters in consultation with the Principal concerned. ( ii) All matters related to Associations and NGOs. ( iii) Sanitation and cleanliness of the hospital and college premises. ( iv) Grant of pay scales/annual increments to all consultants well as other staff under your establishment/ control strictly as per rules. ( v) Any other duties/ powers/ responsibilities assigned by the Government from time to time.
		Note:— ( i) Grant of LTC/Home LTC, grant of permission to attend national workshops/seminars in favour of Class-II to Class-IV employees including drivers strictly as per instructions issued by the Government from time to time in this regard. ( ii) Grant of Study Leave/ EOL/ Grant of Leave for participation in international workshop would rest with the State Government.
3.	Medical Superintendent	Hospital Management:— • ( i) Management of Registration and Diagnostic services ( ii) Management of hospital stores. ( iii) Diet for Indoor patients. ( iv) Management of Private wards. ( iv) All procurement related to material and supply of the hospital including medicines and lab consumables. ( v) Opening of new facilities related to stores and diagnostic services and allocation of space thereof. ( vi) Management of ambulances including 108 IFT. ( vii) All matters related to RKS of which the Medical Superintendent concerned is Member Secretary. ( viii) Disbursement of all Govt. schemes/subsidies including JSY, JSSK, RBSK, NCD, Ayushman Bharat, HIMCARE, Sahara schemes etc. ( ix) All matters related to running of Emergency services including control over Casualty Medical Officers (CMOs). ( x) Any other duties/powers/responsibilities assigned by the Government from time to time.
4.	Advisor of Student Welfare	(i) All matters related to administration of Student Fund and Welfare activities thereof. ( ii) Overall supervision of wardens assigned to various hostels. ( iii) Upkeep of all hostel facilities. ( iv) Liaison with RD Association and MBBS doctors. N ote:— ➢ Advisor of Student Welfare will be designated/nominated by the Principal concerned.
5.	Academic Coordinator	(i) Admission and counseling (including appointment of examiners) to MBBS, PG(MD/MS), DM/MCh, Diploma courses. ( ii) Admission and counseling of all para-medical courses. ( iii) Formulation of prospectus with respect to the above. ( iv) Creation of all categories of posts of consultants and medics. ( v) Future plans for the institution automation including HMIS. ( vi) Ethical approval. ( vii) Formulation and implementation of all research projects. N ote:- ➢ Academic Coordinator will be designated/nominated by the Principal concerned.

Note:—

1. All files related to each of the branches will normally end with the official mentioned

against that branch. The Principal will be kept informed of major decisions by other

Heads of Branches.

2. The ministerial and other supporting staff would be re-organized as per the branches

indicated and separate orders will be passed by the Additional Director within one

week of issue of these instructions.

3. For purposes of the above allocation regular contractual and RKS employees will be

deemed to comprise on single pool.

4. Any funds provided in the State Budget would be drawn and transferred to RKS for this

purpose.

5. Similarly, all funds provided by National Health Mission, GoI for medicines and

consumables will be deposited in RKS.

6. The Research Branch will open a separate bank account where all funds provided for

would be parked (in case, account is not opened).

No. STE-A(9)-5/2020 .—In compliance to the order passed by the Hon'ble National Green Tribunal, Principal Bench at Delhi in the matter of Mahinder Kumar & Ors. Vs. State of H.P. & Ors. in Execution Application No. 34/2021 in Original Application No. 186/2021 on 17-12-2021, the Governor, Himachal Pradesh is pleased to frame the following siting criteria, pollution control measures and procedure for establishment and operation of Hot Mix Plants in the State of Himachal Pradesh with immediate effect as under:—

2. Hot Mix Plants.—The Hot mix plants are used for the mixing of stone aggregates with bitumen for the construction of roads. A Hot Mix plant comprises of aggregate bin, feeder, weighing system, drying drum, bitumen and fuel storage tanks. These plants are installed near construction site and highways and operate for time till the work is completed. On the basis of the technology, the plants can be divided into categories as Batch Hot Mix Plant and Drum Hot Mix Plant.

(a) Proposed Norms for siting criteria for Hot Mix Plants:

Only those Hot Mix Plants can be established at the Right of Way who have been awarded tarring work of that particular road only for the period upto completion of tarring work. F or all other Hot Mix Plants, distance from Right of Way should be at least 10 meters.
5.	Minimum distance from Silence Zone (if notified)	1000
6.	Minimum distance from Strategic Defense Area/Military Cantonment area	1000

* All distances shall be measured crow fly from the chimney/stack of hot mix plant.

* Distances are relaxable in case of any natural barrier between the site of the unit and any of feature indicated in the guidelines.

(i) Aggregate of various sizes shall be stored properly and fine aggregate be given utmost precaution to control dust emission.

(ii) All aggregates stored within the premises shall not be stacked beyond height of 3 meters ground level.

(iii) Measures such an installation of water sprinklers at points of dust emission within premises should be provided. The internal roads, working platforms, loading and unloading areas should be paved or concreted and kept cleans all times.

(iv) Air pollution control measures such as cyclone/multi-cyclone and bag filter/wet scrubber are interlocked with the machinery properly and maintained to achieve standards prescribed under Rules.

(v) Aggregate loading into hopper bin area shall be closed on the three sides and the only approved fuel as per state fuel policy shall be used by the Hot Mix plants.

(vi) Dedicated energy meter shall be provided for the motor attached the dust control system.

(vii) There is no waste water generation from the process. However scrubbing water should be recycled.

(viii) Any process rejects or left over of Hot Mix plant should be recycled in the process.

(c) Procedure for the establishment and operation to be followed by the State Board:

(i) State Board shall issue conditional "Consent to Establish" to the unit after the unit/Hot mix plant submit a copy of NOC from PWD Department qualifying the siting norms.

(ii) The State Board shall issue "Consent to Operate" only if the unit has taken measures to comply with the conditions given in the "Consent to Establish".

(iii) Every unit shall get monitoring for air and noise conducted regularly and submit the reports to SPCB.

(iv) The State Board shall be the Authority to ensure the compliance of the Pollution Control measures given on these guidelines/directions and shall do the necessary monitoring of the unit as per schedule of monitoring approved by the State Board.

(v) Every unit shall follow any other direction(s) issued by the State Government from time to time.

यदि ग्राम सभा ''चुधरेड़'' का नाम बदलकर ''लोअर सुनहेत'' करने बारे उक्त प्रस्ताव के सम्बन्ध में, सम्बन्धित ग्राम सभा सदस्यों को कोई आपत्ति/सुझाव प्रस्तुत करना हो तो वे अपने आक्षेप या सुझाव इस अधिसूचना के प्रकाशन के दिनांक से 30 दिनों की अवधि के भीतर उपायुक्त कांगड़ा को प्रस्तुत कर सकेंगे। उपरोक्त नियत अवधि के अवसान के पश्चात्‌ आक्षेप या सुझाव, जो कोई भी हों, ग्रहण नहीं किए जाएंगे;

प्रार्थी जगशेरू राम पुत्र श्री शिवु, निवासी महाल बिलिंग, तहसील बैजनाथ, जिला कांगड़ा (हि0प्र0) ने इस कार्यालय में खाता नं0 33 का दावा भूमि तकसीम दायर कर रखा है जिसमें उपरोक्त वर्णित प्रतिवादी नं0 13 मंगत रात पुत्र चेतू पुत्र प्रकाशो, निवासी महाल बीड़, तहसील बैजनाथ, जिला कांगड़ा (हि0प्र0) की तामील बार-बार समन जारी करने पर नहीं हो पा रही है और न ही प्रार्थी को इनका सही पता मालूम है। प्रार्थी ने इनका सही पता न होने बारा अपनी असमर्थता जताई है। अतः न्यायालय की संतुष्टि व विश्वास हेतु यह सिद्ध हो गया है कि उक्त प्रतिवादी नं0 13 की तामील साधारण ढंग से नहीं हो सकती है। अतः उक्त वर्णित प्रतिवादी नं0 13 को इस इश्तहार राजपत्र व मुस्त्री मुनादी चस्पानगी द्वारा सूचित किया जाता है कि वह उक्त मुकद्दमा की पैरवी हेतु असालतन या वकालतन तारीख पेशी 12-05-2023 को हाजिर अदालत होकर पैरवी मुकद्दमा करें अन्यथा गैर-हाजिरी की सूरत में एकतरफा कार्यवाही अमल में लाई जाएगी तथा बाद गुजरने मयाद कोई भी उजर या एतराज काबिले समायत न होगा।
