सं(cid:201)या-07/हो०गा०((cid:232)था०)-05/2013 (ख(cid:214)ड)-5437--माननीय झारख(cid:214)ड उ(cid:205)च (cid:219)यायालय, (cid:622)वारा W.P. (S) No.-582/2017, (cid:465)दनांक-25.08.2017 म(cid:581) पा(cid:464)रत (cid:219)यायादेश का काय(cid:91)कार(cid:547) अंश (cid:467)न(cid:224)नवत ् है :-
"Be that as it may, having gone through the rival submissions of the parties,
this Court is of the considered view that the respondents have not considered the cases of
the petitioners in right perspective. The order and directions of the Hon'ble Apex Court has
not been considered in its true spirit. There was an specific directions of the Hon'ble Apex
Court that while taking into consideration the fact, that the services of the Home Guards are
used during an emergency and for other purposes and at the time of their duty, they are
empowered with the power of police personnel and hence, they are entitled for minimum of
'minimum of the pay' used in paragraph 22 of the judgment and order dated 11th March,
2015 means the basic pay+grade pay+ dearness allowance washing allowance.
2 झारख(cid:214)ड गजट (असाधारण) शु(cid:272)वार, 27 (cid:871)सत(cid:224)बर, 2024In my view, the petitioners are entitled for the same benefits what has been
held by the Hon'ble Apex Court. Accordingly, I hereby direct the respondents- State to
reconsider the cases of the petitioners and other Home Guards of the State for giving them
the benefits, in view of the order of the Hon'ble Apex Court passed in Cont. Petition (C) No.
699-700 of 2015 arising out of Civil Appeal No.2782-2783 of 2015. The matter is remanded
back before the respondents-State to take a fresh decision in accordance with law."
माननीय झारख(cid:214)ड उ(cid:205)च (cid:219)यायालय, राँची के (cid:622)वारा गृ ह र(cid:162)क(cid:585) के मामले म(cid:581) उ(cid:200)त वाद म(cid:581) माननीय सव(cid:574)(cid:205)च (cid:219)यायालय, नई (cid:465)द(cid:227)ल(cid:547) (cid:622)वारा अ(cid:219)य वाद म(cid:581) पा(cid:464)रत (cid:219)यायादेश का उ(cid:227)लेख करते हु ए Basic Pay+Grade Pay+Dearness Allowance+Washing Allowance का लाभ के हकदार होने के (cid:466)ब(cid:219)दु पर (cid:292)(cid:467)तवाद(cid:547) रा(cid:207)य को (cid:874)व(cid:876)ध अनुकू ल (cid:467)नण(cid:91)य लेने का आदेश (cid:465)दया है ।
2. उपरो(cid:200)त (cid:292)ासं(cid:876)गक W.P. (S) No-582/2017 के आदेश के (cid:874)व(cid:510)(cid:622)ध माननीय झारख(cid:214)ड उ(cid:205)च (cid:219)यायालय म(cid:581) LPA No.-272/2018 दायर (cid:873)कया गया। उ(cid:200)त LPA म(cid:581) पा(cid:464)रत (cid:219)यायादेश (cid:465)दनांक-12.01.2023 के काय(cid:91)कार(cid:547) अंश कं (cid:875)डका 6 एवं कं (cid:875)डका-7 (cid:467)न(cid:224)नवत हैः-
Para 6- "This Court, having heard the learned counsel for the parties and
considering the facts of the given case as also the order passed by the learned Single Judge
which is squarely based upon the order passed by the Hon'ble Apex Court in Civil Appeal
No- 2782&2783 of 2015 wherein the Hon'ble Apex Court has been pleased to direct to
make payment in favour of the Home Guards the minimum of pay scale which will include
basic pay grade pay- dearness allowance washing allowance.
Para 7- The position of law is well settled that once the order has been passed
by the Hon'ble Apex Court, under the provision of Article 141 of the Constitution of India, it
becomes the rule of land and, as such, in that view of the matter, the State cannot oppose
the order passed by the learned Single Judge since the order impugned is squarely based
upon the order passed by the Hon'ble Apex Court in Civil Appeal No-2782 & 2783 of 2015,
wherein at paragraph 22 following direction has been passed:-
"22- In view of the discussion made above, no relief can be granted to the
appellants either regularization of services or grant of regular appointments hence no
interference is called for against the judgments passed by the Himachal Pradesh, Punjab
and Delhi High Courts. However, taking into consideration the fact that Home Guards are
used during the emergency and for other purposes and at the time of their duty they
are empowered with the power of police personnel, we are of the view that the State
Government should pay them the duty allowance at such rates total of which 30 days

aforesaid observation on an early date preferably within three months."
3. (cid:292)संगाधीन मामले म(cid:581) SLP (Civil) 25654/2023 The State of Jharkhand-Vs- Ajay Prasad and others दायर (cid:873)कया गया था, िजसम(cid:581) माननीय उ(cid:205)चतम (cid:219)यायालय (cid:622)वारा उ(cid:200)त SLP को (cid:467)नर(cid:232)त कर (cid:465)दया गया। माननीय उ(cid:205)चतम (cid:219)यायालय (cid:622)वारा SLP म(cid:581) (cid:465)दनांक-22.09.2023 को पा(cid:464)रत आदेश (cid:467)न(cid:224)नवत ् हैः-
"Delay condoned.
In view of the order passed by this Court in Contempt Petition (C)No. 699- 700/2015 in Civil Appeal No.- 2782-2783/2015 etc. dated 04.05.2016, we are not inclined to interfere in the order passed by the High Court. The special leave petition is dismissed.
Pending applications stand disposed of."
उपरो(cid:200)त माननीय उ(cid:205)चतम (cid:219)यायालय एवं माननीय झारख(cid:214)ड उ(cid:205)च (cid:219)यायालय के आदेश(cid:585) से (cid:232)प(cid:231)ट ह(cid:583) (cid:873)क भारत का सं(cid:874)वधान के अनु(cid:205)छेद-141 के अ(cid:219)तग(cid:91)त माननीय उ(cid:205)चतम (cid:219)यायालय (cid:622)वारा पा(cid:464)रत आदेश बा(cid:218)यकार(cid:547) (cid:292)भाव रखता है। (cid:292)ासं(cid:876)गक गृ ह र(cid:162)क(cid:585) के मामले म(cid:581) रा(cid:207)य के पु(cid:871)लस बल के समान 30 (cid:465)दन(cid:585) ((cid:292)(cid:467)तमाह) का (cid:219)यूनतम Basic Pay + Grade Pay + Dearness Allowance + Washing Allowance (cid:465)दया जाना (cid:874)व(cid:876)धसंगत है ।
4. गृ ह मं(cid:287)ालय, भारत सरकार के अ(cid:622)(cid:91)ध सरकार(cid:547) प(cid:287) सं०-1-27021/2/2022-Ad (CD), (cid:465)दनांक-24.01.2024 के (cid:622)वारा (cid:292)(cid:467)तवे(cid:465)दत (cid:873)कया गया (cid:873)क होमगाड(cid:91) के क(cid:419)(cid:91)(cid:229)य/िज(cid:224)मेदार(cid:547) क(cid:551) तुलना पु(cid:871)लस क(cid:871)म(cid:91)य(cid:585) से नह(cid:547)ं क(cid:551) जा सकती है। समी(cid:162)(cid:585)परांत SLP (Civil) Diary No.- 25654/2023 The State of Jharkhand & Ors. V/s Ajay Prasad मामल(cid:581) म(cid:581) माननीय सव(cid:574)(cid:205)च (cid:219)यायालय (cid:622)वारा (cid:465)दनांक 18.07.2024 को पा(cid:464)रत आदेश (cid:467)न(cid:224)नवत ् है :-
"Delay condoned.
We have carefully persued the Review Petition as also the grounds in support
thereof. In our opinion, no case for review of order dated 22.09.2023 is made out.
The Review Petition is, accordingly, dismissed. Pending application(s), if any,

(S) No.-4 झारख(cid:214)ड गजट (असाधारण) शु(cid:272)वार, 27 (cid:871)सत(cid:224)बर, 2024 582/2017 अजय (cid:292)साद एवं अ(cid:219)य बनाम झारख(cid:214)ड रा(cid:207)य एवं अ(cid:219)य म(cid:581) (cid:465)दनांक-25.08.2017 को पा(cid:464)रत (cid:219)यायादेश के अनुपालन म(cid:581) सभी (cid:292)(cid:873)(cid:272)याओं का पालन कर गृ ह र(cid:162)क(cid:585) ((cid:232)वयंसेवक(cid:585)) को पु(cid:871)लसक(cid:871)म(cid:91)य(cid:585) के समक(cid:162) दै(cid:467)नक पा(cid:464)र(cid:302)(cid:871)मक (cid:465)दये जाने के संबंध म(cid:581) संक(cid:227)प (cid:467)नग(cid:91)त (cid:873)कया गया है । 5. उ(cid:227)लेखनीय है (cid:873)क स(cid:506)(cid:230)य अवमननावाद Cont. Case (Civil) No.-354/2021 (Grih Raksha Vahini Swam Sewak Sangh V/s The State of Jharkhand & Ors.) म(cid:581) (cid:465)दनांक 16.08.2024 को (cid:467)न(cid:224)नवत ् आदेश पा(cid:464)रत (cid:873)कया गया है-
"In view of the said order brought on record, it transpires that is a substantial
compliance of the Court's order, as such, the contempt proceeding is dropped and the
contempt petition is disposed of.
Personal appearance of the aforesaid officers are, hereby, dispensed with."
उ(cid:200)त (cid:219)याय(cid:467)नण(cid:91)य के आलोक म(cid:581) (cid:874)वभागीय संक(cid:227)प सं(cid:201)या-4596, (cid:465)दनांक-10.08.2024 (cid:467)नग(cid:91)तोपरांत उ(cid:200)त अवमाननावाद को (cid:467)न(cid:231)पा(cid:465)दत कर (cid:465)दया गया है ।
6. वत(cid:91)मान म(cid:581) Cont. Case (C) No.-98/2018 (Ajay Prasad V/s The State of Jharkhand & Ors.) With Cont. Case (Civil) No.-500/2020 (Rajesh Ram & Ors. V/s The State of Jharkhand & Anr.) म(cid:581) (cid:465)दनांक-23.08.2024 को माननीय झारख(cid:214)ड उ(cid:205)च (cid:219)यायालय, राँची (cid:622)वारा पा(cid:464)रत (cid:219)यायादेश का अंश (cid:467)न(cid:224)नवत ् है :-
"2. The petitioners working as Home Guard have been dragged up to the
Hon'ble Apex Court and thereafter also review petition was filed. The State has lost before
each and every forum. Instead of complying the order from the date this Court passed order
in W.P.(S) 582 of 2017 i.e. 25.08.2017, they have complied the same seven years after the
order passed by this Court i.e. from 10.08.2024. The stand of the State is not praiseworthy.
The Hon'ble Apex Court on 04.05.2016, has granted one more opportunity to State to
comply the order in true letter and spirit. The arrears has been calculated and paid to the
persons w.e.f. 10.08.2024 who were actually are entitled for the said benefits from
25.08.2017.
3. Let the State take informed decision in view of discussion made above,
within a period of four weeks.

उ(cid:200)त के आलोक म(cid:581) (cid:465)दनांक-25.08.2017 से बकाया पा(cid:464)र(cid:302)(cid:871)मक भुगतान के संबंध म(cid:581) (cid:874)व(cid:419) (cid:874)वभाग का परामश(cid:91) (cid:292)ा(cid:220)त (cid:873)कया गया है। परामश(cid:91) के (cid:272)म म(cid:581) (cid:874)व(cid:419) (cid:874)वभाग (cid:622)वारा (cid:874)व(cid:419)ीय (cid:467)नयमावल(cid:547) के (cid:467)नयम-73 एवं 74 का उ(cid:227)लेख (cid:873)कया गया है, जो (cid:467)न(cid:224)नवत ् है :-

के काय(cid:91)पालक आदेश मंजूर(cid:547) सू(cid:876)चत करनेवाले अ(cid:871)भलेख, प(cid:287) या तार के (cid:467)नग(cid:91)म क(cid:551) तार(cid:547)ख से (cid:292)भावी
ह(cid:585)गे और प(cid:464)र(cid:467)नयत (cid:467)नयम उस तार(cid:547)ख से िजस तार(cid:547)ख को ये पा(cid:464)रत हुए थे। इसी तरह अधीन
(cid:292)ा(cid:876)धका(cid:464)रय(cid:585) क(cid:551) मंजूर(cid:547) उस तार(cid:547)ख से (cid:292)भावी िजस तार(cid:547)ख को आदेश सू(cid:876)चत (cid:873)कये जाय(cid:581) ।
ऐसे सभी मामल(cid:585) म(cid:581) सामा(cid:219)य (cid:871)स(cid:622)धा(cid:219)त (cid:467)न(cid:224)न होना चा(cid:465)हए-
(cid:873)कसी (cid:874)वशेष खच(cid:91) को मंजूर(cid:547) (cid:215)योह(cid:547) (cid:292)व(cid:467)त(cid:91)त होगी, (cid:207)य(cid:585)ह(cid:547) खच(cid:91) क(cid:551) पू(cid:467)त(cid:91) के (cid:871)लए (cid:467)न(cid:876)ध
(cid:874)व(cid:467)नयोिजत हो जाय, और यह तब तक (cid:292)व(cid:467)त(cid:91)त न होगी जब तक (cid:873)क (cid:467)न(cid:876)ध इसके (cid:871)लए (cid:874)व(cid:467)नयोिजत
न हो जाय। (cid:874)व(cid:467)न(cid:465)द(cid:91)(cid:231)ट वषा(cid:91)व(cid:876)ध के (cid:871)लए आवशक खच(cid:91) क(cid:551) मंजूर(cid:547) तब (cid:292)व(cid:467)त(cid:91)त होती है जब (cid:292)थम वष(cid:91)
के खच(cid:91) क(cid:551) न पू(cid:467)त(cid:91) के (cid:871)लए, (cid:467)न(cid:876)ध (cid:874)व(cid:467)नयोिजत हो जाय और (cid:874)व(cid:467)न(cid:465)द(cid:91)(cid:231)ट अव(cid:876)ध म(cid:581) (cid:292)(cid:467)त वष(cid:91) (cid:292)व(cid:467)त(cid:91)त
रहेगी, य(cid:465)द उस वष(cid:91) (cid:467)न(cid:876)ध (cid:874)व(cid:467)नयोिजत हो जाय ।
74. वेतन-पुनर(cid:547)(cid:162)ण या सरकार(cid:547) सेवक(cid:585) को (cid:464)रयायत(cid:581) मंजूर करने म(cid:581) स(cid:162)म सभी
(cid:292)ा(cid:876)धका(cid:464)रय(cid:585) को इस बात का (cid:218)यान रखना चा(cid:465)हए (cid:873)क जब तक खास प(cid:464)रि(cid:232)थ(cid:467)त न हो तब तक
सरकार के (cid:874)वशेष अनुमोदन के (cid:466)बना (cid:874)व(cid:419)ीय मंजूर(cid:547) को भूतल(cid:162)ी (cid:292)भाव न (cid:465)दया जाय ।"
(cid:874)व(cid:465)दत है (cid:873)क गृ ह र(cid:162)क सरकार(cid:547) सेवक न होकर (cid:232)वंय सेवक है ।
7. व(cid:872)ण(cid:91)त उपरो(cid:200)त माननीय सव(cid:574)(cid:205)च (cid:219)यायालय, नई (cid:465)द(cid:227)ल(cid:547) तथा माननीय उ(cid:205)च (cid:219)यायालय, झारख(cid:214)ड, राँची के (cid:219)याय (cid:467)नण(cid:91)य का सरकार (cid:232)तर से अ(cid:162)रशः पालन (cid:873)कया गया है। बकाया रा(cid:871)श भुगतान करने के संबंध म(cid:581) उपरो(cid:200)त पा(cid:464)रत (cid:219)याय(cid:467)नण(cid:91)य(cid:585) म(cid:581) (cid:873)कसी भी (cid:292)कार का उ(cid:227)लेख नह(cid:547)ं (cid:873)कया गया है। सद(cid:230)य अवमाननावाद (Cont. Case (Civil) No.-354/2021 Grih Raksha Vahini Swam Sewak Sangh V/s The State of Jharkhand & Ors.) म(cid:581) पा(cid:464)रत (cid:219)याय(cid:467)नण(cid:91)य के अनुपालन म(cid:581) (cid:874)वभागीय संक(cid:227)प सं(cid:201)या-4596, (cid:465)दनांक-10.08.2024 के (cid:467)नग(cid:91)तोपरांत वाद क(cid:551) काय(cid:91)वाह(cid:547) को समा(cid:220)त कर (cid:465)दया गया है। बकाया रा(cid:871)श का भुगतान (cid:873)कया जाना Judicious ((cid:874)व(cid:876)धस(cid:224)मत) नह(cid:547)ं है ।
अतएव व(cid:872)ण(cid:91)त प(cid:464)रि(cid:232)थ(cid:467)त म(cid:581) (cid:465)दनांक-25.08.2017 के (cid:292)भाव से गृ ह र(cid:162)क(cid:585) को पु(cid:871)लसक(cid:871)म(cid:91)य(cid:585) के समक(cid:162) दै(cid:467)नक पा(cid:464)र(cid:302)(cid:871)मक (cid:465)दया जाना (cid:219)यायो(cid:876)चत (cid:292)तीत नह(cid:547)ं होता है ।
