(2) उ(cid:227)लेखनीय है (cid:873)क झारख(cid:214)ड अ(cid:871)भयं(cid:287)ण सेवा (cid:467)नयुि(cid:200)त (cid:467)नयमावल(cid:547), 2016 पथ (cid:467)नमा(cid:91)ण (cid:874)वभागीय अ(cid:876)धसूचना सं(cid:201)या: 2376 (s) (cid:465)दनांक 12 अ(cid:292)ैल, 2016 से अ(cid:876)धसू(cid:876)चत होने के प(cid:230)चात ् झारख(cid:214)ड सरकार के गजट म(cid:581) (cid:465)दनांक 03 मई, 2016 को (cid:292)का(cid:871)शत क(cid:551) गई एवं उ(cid:200)त (cid:467)त(cid:876)थ के (cid:292)भाव से (cid:466)बहार अ(cid:871)भयं(cid:287)ण सेवा (cid:467)नयमावल(cid:547), 1939 को (cid:467)नर(cid:871)सत (Repeal) कर (cid:465)दया गया। नई (cid:467)नयमावल(cid:547), 2016 म(cid:581) काय(cid:91)पालक अ(cid:871)भयंता के पद पर (cid:292)ो(cid:219)न(cid:467)त हेतु अ(cid:871)भयं(cid:287)ण (cid:302)ेणी म(cid:581) (cid:875)ड(cid:274)ी का होना अ(cid:467)नवाय(cid:91) कर (cid:465)दया गया। माननीय झारख(cid:214)ड उ(cid:205)च (cid:219)यायालय म(cid:581) नई (cid:467)नयमावल(cid:547), 2016 के (cid:292)ावधान(cid:585) को चुनौती देनेवाले या(cid:876)चका ड(cid:222)लू० पी० (एस) सं०- 3027 / 2016 एवं अ(cid:219)य सम(cid:510)प वाद(cid:585) म(cid:581) (cid:465)दनांक 17.08.2017 को पा(cid:464)रत अ(cid:219)त(cid:464)रम आदेश से संबं(cid:876)धत वाद(cid:585) के अं(cid:467)तम फलाफल क(cid:551) शत(cid:91) पर सहायक अ(cid:871)भयंता से काय(cid:91)पालक अ(cid:871)भयंता के पद पर (cid:292)ो(cid:219)न(cid:467)त म(cid:581) (cid:466)बहार अ(cid:871)भयं(cid:287)ण सेवा वग(cid:91)-1 (cid:467)नयमावल(cid:547), 1939 के (cid:292)ावधान(cid:585) का पालन करने का (cid:467)नद(cid:566)श (cid:465)दया गया ।

(3) (cid:302)ी घोष, के (cid:622)वारा उ(cid:205)चतर पद पर (cid:292)ो(cid:219)न(cid:467)त के (cid:467)न(cid:871)मत (cid:465)दये गये अ(cid:223)यावेदन(cid:585) पर पथ (cid:467)नमा(cid:91)ण (cid:874)वभाग (cid:622)वारा का(cid:871)म(cid:91)क, (cid:292)शास(cid:467)नक सुधार एवं राजभाषा (cid:874)वभाग से परामश(cid:91) क(cid:551) अपे(cid:162)ा करते हु ए संबं(cid:876)धत सं(cid:876)चका (cid:465)दनांक 19.02.2018 को का(cid:871)म(cid:91)क (cid:874)वभाग को पृ (cid:231)ठां(cid:873)कत क(cid:551) गई थी, (cid:200)य(cid:585)(cid:873)क का(cid:871)म(cid:91)क, (cid:292)शास(cid:467)नक सुधार एवं राजभाषा (cid:874)वभाग के प(cid:287)ांकः 743 (cid:465)दनांक 25.01.2018 से रा(cid:207)य सरकार के अधीन सभी (cid:292)ो(cid:219)न(cid:467)तय(cid:585) को बा(cid:876)धत रहने का (cid:467)नण(cid:91)य (cid:871)लया गया था। त(cid:215)समय का(cid:871)म(cid:91)क (cid:874)वभाग से (cid:467)न(cid:224)न परामश(cid:91) (cid:465)दनांक: 22.02.2018 को (cid:292)ा(cid:220)त हुआ :-

" व(cid:872)ण(cid:91)त प(cid:464)रि(cid:232)थ(cid:467)त म(cid:581) (cid:292)ो(cid:219)न(cid:467)त के (cid:874)ववेचनाधीन मामले म(cid:581) (cid:292)शासी (cid:874)वभाग अपने (cid:232)तर से (cid:467)नण(cid:91)य ले सकता है ।"

(4) पथ (cid:467)नमा(cid:91)ण (cid:874)वभाग (cid:622)वारा उपरो(cid:200)त परामश(cid:91) को वाद सं0 W.P. ( S)-3027 / 2016 म(cid:581) (cid:465)दनांक 17.08.2017 को पा(cid:464)रत अंत(cid:464)रम आदेश, (cid:874)व(cid:622)वान महा(cid:876)धव(cid:200)ता के परामश(cid:91) एवं का(cid:871)म(cid:91)क, (cid:292)शास(cid:467)नक सुधार एवं राजभाषा (cid:874)वभाग के प(cid:287)ांकः 743 (cid:465)दनांक 25.01.2018 के आलोक म(cid:581) (cid:232)प(cid:231)ट मंत(cid:229)य देने हेतु पुनः (cid:465)दनांक 23.02.2018 को उ(cid:200)त सं(cid:876)चका का(cid:871)म(cid:91)क (cid:874)वभाग को पृ (cid:231)ठां(cid:873)कत क(cid:551) गई।

(5) इस बीच रा(cid:207)य सेवाओं म(cid:581) (cid:292)ो(cid:219)न(cid:467)त (cid:292)दान करने पर का(cid:871)म(cid:91)क (cid:874)वभागीय प(cid:287)ांकः 743 (cid:465)दनांक 25.01.2018 से लगे रोक क(cid:551) अव(cid:876)ध म(cid:581) ह(cid:547) (cid:302)ी घोष, सहायक अ(cid:871)भयंता, रा(cid:231)(cid:282)(cid:547)य उ(cid:205)च पथ उपभाग, झारख(cid:214)ड, राँची म(cid:581) पद(cid:232)था(cid:874)पत रहते हु ए (cid:465)दनांक 28.02.2018 को सेवा(cid:467)नवृ त हो गये। (6) पथ (cid:467)नमा(cid:91)ण (cid:874)वभाग से पूव(cid:91) पृ (cid:231)ठां(cid:873)कत सं(cid:876)चका म(cid:581) का(cid:871)म(cid:91)क, (cid:292)शास(cid:467)नक सुधार एवं राजभाषा (cid:874)वभाग का परामश(cid:91) (cid:465)दनांक: 21.08.2018 को (cid:292)ा(cid:220)त हु आ, िजसका काय(cid:91)कार(cid:547) अंश (cid:467)न(cid:224)नवत है:-

"6. (cid:302)ी घोष के (cid:622)वारा सम(cid:874)प(cid:91)त अ(cid:223)यावेदन के साथ संल(cid:202)न अनुसूची 4 ( Status of the Quota posts after last promotion order dated 13th July, 2015) म(cid:581) माननीय उ(cid:205)च (cid:219)यायालय (cid:622)वारा L.P.A. No. 106/2015 म(cid:581) (cid:465)दनांक 28.09.2015 को पा(cid:464)रत अ(cid:219)त(cid:464)रम आदेश एवंझारख(cid:214)ड गजट (असाधारण) सोमवार, 23 (cid:465)दस(cid:224)बर, 2024 3 माननीय सव(cid:574)(cid:205)च (cid:219)यायालय का (cid:219)याय (cid:467)नण(cid:91)य (1990) 2 SCC-715 से संसू(cid:876)चत (cid:467)नण(cid:91)य के आलोक म(cid:581) अ(cid:871)भयं(cid:287)ण संवग(cid:91) के काय(cid:91)पालक अ(cid:871)भयंता के पद पर (cid:874)व(cid:871)भ(cid:219)न को(cid:465)ट के पदधारक(cid:585) क(cid:551) अनुमा(cid:219)यता एवं वा(cid:232)त(cid:874)वक ि(cid:232)थ(cid:467)त क(cid:551) गणना क(cid:551) गयी है। उ(cid:200)त के अनुसार काय(cid:91)पालक अ(cid:871)भयंता के 28% पद, िज(cid:219)ह(cid:581) (cid:875)ड(cid:220)लोमाधार(cid:547) कनीय अ(cid:871)भयंताओं से भरा जाना है, म(cid:581) आर(cid:879)(cid:162)त को(cid:465)ट के (cid:871)लए (cid:467)नधा(cid:91)(cid:464)रत कोटा से अ(cid:876)धक (cid:292)ो(cid:219)न(cid:467)त द(cid:547) गई, जब(cid:873)क सामा(cid:219)य वग(cid:91) के पदधारक(cid:585) को (cid:292)ो(cid:219)न(cid:467)त नह(cid:547)ं (cid:292)दान क(cid:551) गई है। (cid:292)थम (cid:506)(cid:231)(cid:618)या यह ि(cid:232)थ(cid:467)त का(cid:871)म(cid:91)क (cid:292)बंधन क(cid:551) (cid:506)ि(cid:231)ट से (cid:467)नयम(cid:874)व(cid:510)(cid:622)ध (cid:292)तीत है, हालां(cid:873)क यह (cid:292)शासी (cid:874)वभाग के (cid:622)वारा समी(cid:162)ा (cid:873)कये जाने का (cid:874)वषय व(cid:232)तु है ।

7. (cid:874)वषयगत मामले म(cid:581) माननीय झारख(cid:214)ड उ(cid:205)च (cid:219)यायालय (cid:622)वारा L.P.A. No.- 106/2015 म(cid:581) (cid:465)दनांक 28.09.2015 को पा(cid:464)रत अ(cid:219)त(cid:464)रम आदेश माननीय सव(cid:574)(cid:205)च (cid:219)यायालय का (cid:219)याय (cid:467)नण(cid:91)य (2015 ) SCC-292 का पारा(cid:274)ाफ 36 तथा (1990) 2sCc 715 का पारा(cid:274)ाफ 44 (C) एवं (G) (cid:292)ासं(cid:876)गक (cid:292)तीत होता है ।

माननीय झारख(cid:214)ड उ(cid:205)च (cid:219)यायालय के L.P.A. No. - 106 / 2015 म(cid:581) (cid:465)दनांक 28.09.2015 को पा(cid:464)रत (cid:219)यायादेश काय(cid:91)कार(cid:547) अंश-

"3. If the public service commission is taking examination of 200 candidates, at a time, then the Government will arrange those 200 candidates in a seriatim number for the post of Assistant Engineers. This is not permissible because first 28 will be diploma holders, from 29 to 90 there will be degree holders in Engineering (Direct recruits) and from 91 to 100 there will be the candidates who are from Junior Engineer and who have cleared A.M.LE. examination. Perhaps, this aspect of the matter is lost sight off by the respondents-State Government and unnecessarily more than 62 percent direct recruits have been arranged at a time, in a seniority list, which is not permissible.

4. At a time, there cannot be more than 28 candidates in as seriatim number who are diploma in engineering as well as there cannot be more than 62 candidates who are direct recruits degree holders in engineering in every 100 seats."

माननीय सव(cid:574)(cid:205)च (cid:219)यायालय का (cid:219)याय (cid:467)नण(cid:91)य (2015 ) SCC 292 का पारा(cid:274)ाफ 36

"In the absence of any provision for consequential seniority in the rules, the "catch-up rule" will be applicable and the roster point reserved category promoties cannot count their seniority in the promoted category from the date of their promotions and the senior general candidates, if further reach the promotional level, general candidates will regain their seniority. The Division Bench appears to have proceeded on an erroneous footing that Article 16 (44) of the Constitution of India automatically gives the consequential seniority in4 झारख(cid:214)ड गजट (असाधारण) सोमवार, 23 (cid:465)दस(cid:224)बर, 2024 addition to accelerated promotion to the roster point promoties and the judgment of the Division Bench cannot be sustained."

माननीय सव(cid:574)(cid:205)च (cid:219)यायालय का (cid:219)याय (cid:467)नण(cid:91)य (1990) 2 SCC715 का पारा(cid:274)ाफ 44 (C) एवं (G) - (c) "When appointments are made from more than one source, it is permissible to fix the ratio for recruitment from the different sources, and if rules are framed in this regard they must ordinarily be followed strictly.

(G) The quota for the recruitment from the different sources may be prescribed by executive instructions, if the rules are silent on the subject."

8. संदभा(cid:91)धीन अंकणीय है (cid:873)क (cid:874)व(cid:419) (cid:874)वभागीय प(cid:287)ांकः 2074 (cid:465)दनांक 04.04.1985 के (cid:622)वारा संवग(cid:91) के सद(cid:232)य को उनसे कनीय पदा(cid:876)धकार(cid:547) को उ(cid:205)चतर पद पर (cid:292)दान क(cid:551) गई (cid:292)ो(cid:219)न(cid:467)त क(cid:551) (cid:467)त(cid:876)थ से भूतल(cid:162)ी (cid:292)भाव से (cid:292)ो(cid:219)न(cid:467)त (cid:292)दान करने के संबंध म(cid:581) (cid:465)दशा-(cid:467)नद(cid:566)श (cid:467)नग(cid:91)त है ।

9. व(cid:872)ण(cid:91)त प(cid:464)र(cid:292)े(cid:234)य म(cid:581) उपयु (cid:91)(cid:200)त कं (cid:875)डका-6 एवं 7 म(cid:581) अं(cid:873)कत त(cid:216)य(cid:585) के आलोक म(cid:581) (cid:874)वषयगत मामले म(cid:581) य(cid:465)द कनीय पदधारक(cid:585) को नयी अ(cid:871)भयं(cid:287)ण सेवा(cid:467)नयमावल(cid:547), 2016 के (cid:292)वृ त होने के पूव(cid:91) (cid:292)ो(cid:219)न(cid:467)त (cid:292)दान क(cid:551) गई ह(cid:583), तो उपयु (cid:91)(cid:200)त कं (cid:875)डका-8 म(cid:581) व(cid:872)ण(cid:91)त (cid:874)व(cid:419) (cid:874)वभागीय प(cid:287) के (cid:292)ावधान(cid:585) के आलोक म(cid:581) (cid:292)ो(cid:219)न(cid:467)त के यो(cid:202)य संबं(cid:876)धत क(cid:871)म(cid:91)य(cid:585) (वर(cid:547)य (cid:873)क(cid:219)तु (cid:292)ो(cid:219)न(cid:467)त से वं(cid:876)चत क(cid:871)म(cid:91)य(cid:585)) को भूतल(cid:162)ी (cid:292)भाव से (cid:292)ो(cid:219)न(cid:467)त (cid:292)दान करने हेतु समु(cid:876)चत कार(cid:91)वाई करने का परामश(cid:91) (cid:292)शासी शाम को (cid:465)दया जा सकता है।" (7) का(cid:871)म(cid:91)क (cid:874)वभाग के उपरो(cid:200)त (cid:465)ट(cid:220)पणी को (cid:302)ी स(cid:215)यदेव मोहन घोष, सेवा(cid:467)नवृ (cid:419) सहायक अ(cid:871)भयंता से (cid:292)ा(cid:220)त अ(cid:223)यावेदन ((cid:465)दनांक 13.08.2018) पथ (cid:467)नमा(cid:91)ण (cid:874)वभाग के (cid:467)नयं(cid:287)णाधीन सहायक अ(cid:871)भयंता ((cid:292)ो(cid:219)न(cid:467)त से (cid:467)नयु(cid:200)त) से काय(cid:91)पालक अ(cid:871)भयंता के उ(cid:205)चतर पद(cid:585) पर कनीय को (cid:292)द(cid:419) (cid:292)ो(cid:219)न(cid:467)त क(cid:551) (cid:467)त(cid:876)थ से भूतल(cid:162)ी (cid:292)भाव से (cid:292)ो(cid:219)न(cid:467)त (cid:873)कये जाने से संबं(cid:876)धत म(cid:581) (cid:465)ट(cid:220)पणी क(cid:551) कं (cid:875)डका-06, 07 एवं 08 म(cid:581) अं(cid:873)कत त(cid:216)य(cid:585) के आलोक म(cid:581) कं (cid:875)डका-09 म(cid:581) (cid:467)न(cid:465)हत परामश(cid:91) (cid:465)दनांक 21.08.2018 को पथ (cid:467)नमा(cid:91)ण (cid:874)वभाग को (cid:465)दया गया।

(8) उपरो(cid:200)त आधार पर (cid:292)शासी (cid:874)वभाग (cid:622)वारा समी(cid:162)ोपरा(cid:219)त (cid:465)दनांक 12.10.2018 को मंत(cid:229)य ग(cid:465)ठत हु आ (cid:873)क झारख(cid:214)ड अ(cid:871)भयं(cid:287)ण सेवा(cid:467)नयुि(cid:200)त (cid:467)नयमावल(cid:547), 2016 म(cid:581) क(cid:467)तपय संशोधन क(cid:551) कार(cid:91)वाई (cid:292)(cid:873)(cid:272)याधीन है, िजसके (cid:467)न(cid:231)कष(cid:91) के आधार पर ह(cid:547) काय(cid:91)पालक अ(cid:871)भयंता के पद पर (cid:302)ी घोष एवं अ(cid:219)य के (cid:292)ो(cid:219)न(cid:467)त हेतु (cid:874)वचार (cid:873)कया जाना (cid:302)ेय(cid:232)कर होगा।

(9) इस बीच (cid:302)ी घोष (cid:622)वारा माननीय झारख(cid:214)ड उ(cid:205)च (cid:219)यायालय म(cid:581) वाद सं0: ड(cid:222)लू० पी० (एस) सं0- 654 / 2018 म(cid:581) दायर आई० ए० सं0-6171 / 2018 म(cid:581) (cid:465)दनांक 04.09.2018 को माननीय ख(cid:214)डपीठ (cid:622)वारा अंत(cid:464)रम आदेश (cid:465)दया गया, जो (cid:467)न(cid:224)नवत है:-

"Order No. 05/Dated 4th September, 2018

IA. No. 6171 of 2018

"The main point involved in this writ petition is as to whether Jharkhand Engineering Service Recruitment Rules, 2016 shall prevail over Bihar Engineering Service Rules, 1939 or not. Under the latter Rules, Assistant Engineers coming from both Graduate and Diploma streams are eligible for promotion to the post of Executive Engineer. Under the former ie. 2016 Rules, only those Assistant Engineers who possess degree in engineering are eligible for promotion. In the batch of the writ petitions which are being heard along with W.P. (S) No.-3027 of 2016, operation of 2016 Rules has been stayed by an order passed on 17th August, 2017.

The applicant in the present writ petition comes from the diploma. category and has already superannuated. His complaint is that in spite of there being restraint order upon implementation of 2016 Rules, the authorities are not considering the implementation of 1939 Rules for the purpose of promotion. As the applicant has already superannuated during pendency of the said batch of writ petitions, no substantive relief can be given. However, the authorities may consider his entitlement for promotion applying the 1939 Rules and should bring to our notice his position on the next date of hearing.

For the reasons already indicated, we are not passing of any further order on implementation of 1939 Rules, The subsisting order already covers that field.

Matter to be listed on 13rd December, 2018.

The instant I.A. shall stand disposed of in the above terms."

(11) पथ (cid:467)नमा(cid:91)ण (cid:874)वभाग म(cid:581) (cid:874)व(cid:871)भ(cid:219)न (cid:232)तर(cid:585) पर कृ त समी(cid:162)ा म(cid:581) (cid:302)ी घोष (cid:622)वारा सम(cid:874)प(cid:91)त अ(cid:223)यावेदन मूलतः तदथ(cid:91) (cid:510)प से (cid:467)नयु(cid:200)त एवं काला(cid:219)तर म(cid:581) सेवा (cid:467)नय(cid:871)मत (cid:873)कए गये अ(cid:871)भयंताओं के वर(cid:547)यता (cid:467)नधा(cid:91)रण और तदनुसार उ(cid:219)ह(cid:581) (cid:874)वभाग के (cid:622)वारा द(cid:547) गई (cid:292)ो(cid:219)न(cid:467)त के अनु(cid:510)प (cid:465)दए जानेवाले सेवा लाभ से संबं(cid:876)धत पाया गया। (cid:302)ी घोष के अ(cid:223)यावेदन म(cid:581) कु ल 13 तदथ(cid:91) (cid:510)प से (cid:467)नयु(cid:200)त अ(cid:871)भयंताओं (काला(cid:219)तर म(cid:581) सेवा (cid:467)नय(cid:871)मत) क(cid:551) सूची संल(cid:202)न क(cid:551) गयी थी, िजसके (cid:272)म सं0-1 म(cid:581) (cid:302)ी राजदेव (cid:871)संह का6 झारख(cid:214)ड गजट (असाधारण) सोमवार, 23 (cid:465)दस(cid:224)बर, 2024 नाम अं(cid:873)कत है, िजनके संदभ(cid:91) म(cid:581) (cid:302)ी घोष के (cid:622)वारा उ(cid:227)लेख (cid:873)कया गया है (cid:873)क उनक(cid:551) (cid:467)नयुि(cid:200)त दै(cid:467)नक पा(cid:464)र(cid:302)(cid:871)मक पर कनीय अ(cid:871)भयंता के पद पर होने के कारण (cid:465)दनांक 23.07.1985 को (cid:292)थम योगदान (cid:465)दये तथा इनके नीचे (cid:272)म सं0 :- 2 से 13 भी दै(cid:467)नक पा(cid:464)र(cid:302)(cid:871)मक पर कनीय अ(cid:871)भयंता के (cid:510)प म(cid:581) (cid:465)दनांक 11.09.1985 एवं अ(cid:219)य (cid:871)भ(cid:219)न (cid:467)त(cid:876)थय(cid:585) को (cid:467)नयु(cid:200)त होकर (cid:292)थम योगदान (cid:465)दये। इनलोग(cid:585) को कनीय अ(cid:871)भयंता से सहायक अ(cid:871)भयंता के पद पर (cid:467)नधा(cid:91)(cid:464)रत कालाव(cid:876)ध 8 वष(cid:607) के (cid:232)थान पर मा(cid:287) 02 वष(cid:91) म(cid:581) ह(cid:547) सहायक अ(cid:871)भयंता के पद पर (cid:465)दनांक 27.06.1987 को (cid:292)ो(cid:219)नत मानकर सहायक अ(cid:871)भयंता क(cid:551) वर(cid:547)यता सूची म(cid:581) (cid:232)थान (cid:467)नधा(cid:91)(cid:464)रत (cid:873)कया गया और इसी आधार पर उ(cid:205)चतर पद(cid:585) पर यथा काय(cid:91)पालक अ(cid:871)भयंता के पद पर (cid:465)दनांक 23.11.2009 के (cid:292)भाव से तथा अधी(cid:162)ण अ(cid:871)भयंता के पद पर (cid:465)दनांक 03.02.2016 के (cid:292)भाव से (cid:467)नय(cid:871)मत (cid:292)ो(cid:219)न(cid:467)त (cid:292)दान क(cid:551) गई है ।

उ(cid:200)त के (cid:272)म म(cid:581) (cid:302)ी घोष के (cid:622)वारा यह भी उ(cid:227)लेख (cid:873)कया गया है (cid:873)क अ(cid:874)वभािजत (cid:466)बहार रा(cid:207)य म(cid:581) कनीय अ(cid:871)भयंता के पद पर रहते हु ए ह(cid:547) उ(cid:205)च (cid:871)श(cid:162)ा अथा(cid:91)त ् अ(cid:871)भयं(cid:287)ण (cid:875)ड(cid:274)ी (cid:292)ा(cid:220)त करनेवाले को के वल (cid:292)ो(cid:215)साहन के (cid:510)प म(cid:581) उनके (cid:871)लए 5 वष(cid:91) क(cid:551) कालाव(cid:876)ध पूण(cid:91) होने पर 3 (cid:292)(cid:467)तशत का (cid:874)वशेष कोटा सहायक अ(cid:871)भयंता के पद पर (cid:292)ो(cid:219)न(cid:467)त हेतु उपल(cid:222)ध था तथा उपयु (cid:91)(cid:200)त संल(cid:202)न सूची के सभी 13 कनीय अ(cid:871)भयंता सेवा म(cid:581) मूल (cid:292)वेश से पूव(cid:91) ह(cid:547) अ(cid:871)भयं(cid:287)ण (cid:875)ड(cid:274)ी क(cid:551) यो(cid:202)यता रखते थे। इस(cid:871)लए ये ए० एम० आई० ई० अह(cid:91)ता (cid:292)ा(cid:220)त के (cid:871)लए (cid:467)नधा(cid:91)(cid:464)रत 3 (cid:292)(cid:467)तशत (cid:874)वशेष कोटा के (cid:874)व(cid:510)(cid:622)ध (cid:292)ो(cid:219)न(cid:467)त के हकदार नह(cid:547)ं थे। (cid:302)ी घोष के अ(cid:223)यावेदन के साथ ((cid:464)रट या(cid:876)चका के Annexure-17 ) संल(cid:202)न सूची के अंश 'A' म(cid:581) उपरो(cid:200)त व(cid:872)ण(cid:91)त 13 दै(cid:467)नक पा(cid:464)र(cid:302)(cid:871)मक पर (cid:467)नयु(cid:200)त कनीय अ(cid:871)भयंता का नाम (cid:465)दया गया, जो (cid:302)ी घोष के कनीय अ(cid:871)भयंता के मूल (cid:292)वेश पद पर (cid:467)नयुि(cid:200)त (cid:467)त(cid:876)थ (09.12.1982 ) के बाद के वष(cid:607) म(cid:581) अथा(cid:91)त ् (cid:465)दनांक 23.07.1985 को एवं अ(cid:219)य (cid:871)भ(cid:219)न-(cid:871)भ(cid:219)न (cid:467)त(cid:876)थय(cid:585) म(cid:581) दै(cid:467)नक पा(cid:464)र(cid:302)(cid:871)मक पर (cid:467)नयु(cid:200)त हो कर स(cid:224)(cid:292)(cid:467)त वाद म(cid:581) माननीय सव(cid:574)(cid:205)च (cid:219)यायालय के आदेश (cid:465)दनांक 09.04.2015 के आलोक म(cid:581) सेवा (cid:467)नय(cid:871)मत (cid:873)कये गये कनीय अ(cid:871)भयंता ह(cid:583)।

उ(cid:200)त अ(cid:223)यावेदन को मु(cid:201)य स(cid:876)चव (cid:622)वारा सं(cid:163)ान म(cid:581) लेकर अपने ग(cid:583)० स० (cid:292)े० सं०: 5593 (cid:465)दनांक 05.11.2019 से पथ (cid:467)नमा(cid:91)ण (cid:874)वभाग को भेजते हु ए वृ (cid:419)ादेष अं(cid:873)कत (cid:873)कया गया (cid:873)क "आवेदक को बुलाकर उनके सम(cid:162) इस मामले क(cid:551) (cid:466)ब(cid:219)दुवार समी(cid:162)ा क(cid:551) जाय। कृ० मुझे भी अवगत कराव(cid:581)।" पथ (cid:467)नमा(cid:91)ण (cid:874)वभागीय प(cid:287)ांक : 5450 (S) (cid:465)दनांक 08:11:2019 से मु(cid:201)य स(cid:876)चव, झारख(cid:214)ड को व(cid:232)तुि(cid:232)थ(cid:467)त से अवगत कराते हु ए आदेश (cid:465)दनांक 31.10.2019 क(cid:551) (cid:292)(cid:467)त भेजी गई ।

( 14 ) पथ (cid:467)नमा(cid:91)ण (cid:874)वभाग के उपरो(cid:200)त आदेश (cid:465)दनांक 31.10.2019 के (cid:874)व(cid:510)(cid:622)ध (cid:302)ी घोष (cid:622)वारा एक (cid:874)व(cid:232)तृ त अ(cid:223)यावेदन (cid:465)दनांक 25.11.2019 पुनः मु(cid:201)य स(cid:876)चव झारख(cid:214)ड को देते हु ए (cid:467)नयम- 27 (4) (a) के तहत मामले म(cid:581) ह(cid:232)त(cid:162)ेप कर झारख(cid:214)ड काय(cid:91)पा(cid:871)लका (cid:467)नयमावल(cid:547) उनके (cid:232)तर से समी(cid:162)ा / अनु(cid:302)वण का अनुरोध (cid:873)कया गया। उ(cid:200)त अ(cid:223)यावेदन पर मु(cid:201)य स(cid:876)चव, झारख(cid:214)ड (cid:622)वारा पुनः सं(cid:163)ान लेकर उनके काया(cid:91)लय (cid:292)ेषण सं(cid:201)या: 6081 (cid:465)दनांक 27.11.2019 से स(cid:876)चव, पथ (cid:467)नमा(cid:91)ण (cid:874)वभाग को सं(cid:876)चका म(cid:581) अ(cid:274)ेतर कार(cid:91)वाई क(cid:551) (cid:292)(cid:873)(cid:272)या अपनाने का वृ (cid:419)ादेष (cid:465)दया गया ।

उ(cid:200)त अ(cid:223)यावेदन पर अ(cid:274)ेतर कार(cid:91)वाई हेतु मु(cid:201)य स(cid:876)चव के सम(cid:162) मामले उप(cid:232)था(cid:874)पत नह(cid:547)ं (cid:873)कया जा सका और न ह(cid:547) संबं(cid:876)धत (cid:874)वभागीय Speaking Order को उ(cid:876)चत मा(cid:218)यम से माननीय (cid:219)यायालय म(cid:581) दायर (cid:873)कया गया ।

(15) (cid:302)ी घोष सेवा(cid:467)नवृ त सहायक अ(cid:871)भयंता (cid:622)वारा इस मामले म(cid:581) माननीय मु(cid:201)यमं(cid:287)ी को संबो(cid:876)धत अ(cid:223)यावेदन (cid:465)दनांक 15.06.2020 से (cid:218)यानाकृ (cid:231)ट (cid:873)कया गया, िजसके (cid:292)संग म(cid:581) मु(cid:201)यमं(cid:287)ी स(cid:876)चवालय के चया(cid:91)-(cid:465)ट(cid:220)पणी सं0: 3800723 (cid:465)दनांक 03.09.2020 से मामले क(cid:551) समी(cid:162)ा इनके अ(cid:223)यावेदन (cid:465)दनांक 25.11.2019 के साथ 05.11.2019 के आलोक म(cid:581) करने एवं सं(cid:876)चका उप(cid:232)था(cid:874)पत करने का (cid:467)नद(cid:566)श (cid:874)वभाग को (cid:292)ा(cid:220)त हु आ ।

(cid:302)ी घोष के अ(cid:223)यावेदन (cid:465)दनांक 25.11.2019 म(cid:581) व(cid:872)ण(cid:91)त त(cid:216)य(cid:585) क(cid:551) (cid:466)ब(cid:219)दुवार एवं (cid:874)व(cid:232)तृ त समी(cid:162)ा (cid:874)वभागीय (cid:232)तर पर क(cid:551) गई िजसम(cid:581) मु(cid:201)यतः (cid:467)न(cid:224)न मंत(cid:229)य ग(cid:465)ठत हु आ:-

(क) आलो(cid:205)य (cid:292)करण म(cid:581) (cid:874)वभागीय आदेश सं०: 5359 (cid:465)दनांक 31.10.2019 के (cid:622)वारा (cid:302)ी घोष के दावे को अ(cid:232)वीकृ त (cid:873)कया गया। माननीय (cid:219)यायालय के उ(cid:200)त आदेश (cid:465)दनांक 04.09.2018 के (cid:874)व(cid:510)(cid:622)ध कोई अपील दायर नह(cid:547)ं (cid:873)कया गया और न ह(cid:547) अनुपालन (cid:292)(cid:467)तवेदन माननीय उ(cid:205)च (cid:219)यायालय के सम(cid:162) Affidavit के मा(cid:218)यम से रखा जा सका ।8 झारख(cid:214)ड गजट (असाधारण) सोमवार, 23 (cid:465)दस(cid:224)बर, 2024 (ख) सकारण आदेश के (cid:874)व(cid:510)(cid:622)ध (cid:302)ी घोष के (cid:622)वारा मु(cid:201)य स(cid:876)चव, झारख(cid:214)ड को संबो(cid:876)धत कर (cid:465)दये गये (cid:874)व(cid:232)तृ त अ(cid:223)यावेदन (cid:465)दनांक 25.11.2019 पर मु(cid:201)य स(cid:876)चव के वृ (cid:419)ादेष के अनुपालन म(cid:581) सं(cid:876)चका उनके सम(cid:162) उप(cid:232)था(cid:874)पत नह(cid:547)ं क(cid:551) जा सक(cid:551) थी ।

(ग) आलो(cid:205)य (cid:292)करण म(cid:581) संबं(cid:876)धत 39 तदथ(cid:91) सहायक अ(cid:871)भयंता एवं (cid:302)ी घोष का मामला (cid:871)भ(cid:219)न रहने का वजह यह रहा (cid:873)क (cid:302)ी घोष से बाद म(cid:581) (cid:467)नयु(cid:200)त कनीय अ(cid:871)भयंताओं को उनसे पूव(cid:91) सहायक अ(cid:871)भयंता के पद पर (cid:292)ो(cid:219)न(cid:467)त के समय (cid:302)ी घोष का वर(cid:547)यता सूची म(cid:581) (cid:232)थान पर य(cid:465)द (cid:218)यान रखा गया होता तो इ(cid:219)ह(cid:581) सहायक अ(cid:871)भयंता के पद पर (cid:292)ो(cid:219)न(cid:467)त संबं(cid:876)धत क(cid:871)म(cid:91)य(cid:585) के पूव(cid:91) ह(cid:547) (cid:871)मल जाती। ऐसी ि(cid:232)थ(cid:467)त म(cid:581) (cid:302)ी घोष का दावा (cid:874)वचारणीय (cid:292)तीत होता है ।

(घ) व(cid:872)ण(cid:91)त प(cid:464)रि(cid:232)थ(cid:467)त म(cid:581) (cid:302)ी घोष को सहायक अ(cid:871)भयंता के पद पर (cid:292)ो(cid:219)न(cid:467)त क(cid:551) (cid:467)त(cid:876)थ को समान धरातल पर लाते हु ए उ(cid:205)च पद(cid:585) पर (cid:292)ो(cid:219)न(cid:467)त क(cid:551) कार(cid:91)वाई माननीय उ(cid:205)च (cid:219)यायालय (cid:622)वारा (cid:465)दनांक 04.09.2018 को पा(cid:464)रत (cid:219)यायादेश के आलोक म(cid:581) (cid:873)कये जाने के (cid:467)न(cid:871)मत (cid:874)वभागीय आदेश सं0: 5359 (cid:465)दनांक 31.10.2019 पर पुन(cid:874)व(cid:91)चार (cid:873)कये जाने के (cid:466)ब(cid:219)दु पर उ(cid:205)च(cid:232)तर(cid:547)य (cid:467)नण(cid:91)य अपे(cid:879)(cid:162)त है ।

(ड.) (cid:302)ी घोष के अलावे भी और दो मामले एक (cid:230)यामदास (cid:871)संह, तदेन सहायक अ(cid:871)भयंता एवं दूसरा (cid:302)ी सनत कु मार, तदेन सहायक अ(cid:871)भयंता [स(cid:224)(cid:292)(cid:467)त दोन(cid:585) ह(cid:547) सेवा(cid:467)नवृ त पदा(cid:876)धकार(cid:547)] (cid:622)वारा भी माननीय झारख(cid:214)ड उ(cid:205)च (cid:219)यायालय म(cid:581) (cid:272)मश: W.P. (S) No.- 2189/2018 एवं W.P. (S) No.-5726/2017 अलग-अलग दायर है। य(cid:465)द (cid:302)ी घोष को उ(cid:205)चतर पद पर वैचा(cid:464)रक (cid:510)प से सरकार (cid:292)ो(cid:219)न(cid:467)त (cid:292)दान करती है तो इन दोन(cid:585) पदा(cid:876)धका(cid:464)रय(cid:585) को भी (cid:292)ो(cid:219)न(cid:467)त (cid:292)दान करना होगा और इसके (cid:871)लए इनक(cid:551) वर(cid:547)यता सूची म(cid:581) भी संशोधन आव(cid:230)यक होगा । पूव(cid:91) म(cid:581) कनीय अ(cid:871)भयंताओं के वर(cid:547)यता संबंधी एक मामले म(cid:581) (cid:874)वभागीय सं(cid:876)चका सं०:-02 / (cid:232)था० ((cid:874)व०)-315 / 2005 (भाग) म(cid:581) (cid:874)व(cid:622)वान महा(cid:876)धव(cid:200)ता (cid:622)वारा माननीय सव(cid:574)(cid:205)च (cid:219)यायालय के (cid:219)यायादेश का हवाला देकर पराम(cid:871)श(cid:91)त (cid:873)कया गया है (cid:873)क अपने अ(cid:876)धकार(cid:585) के (cid:292)(cid:467)त सजग दावेदार(cid:585) को उनका अ(cid:876)धकार (cid:292)दान (cid:873)कया जा सकता है ।

( 17 ) माननीय मु(cid:201)यमं(cid:287)ी महोदय के उपरो(cid:200)त आदेश के आलोक म(cid:581) सव(cid:91)(cid:292)थम (cid:874)व(cid:876)ध (cid:874)वभाग से मंत(cid:229)य माँगा गया। (cid:874)व(cid:876)ध (cid:874)वभाग से (cid:465)दनांक 01.10.2020 को (cid:292)ा(cid:220)त मंत(cid:229)य का सारांश (cid:467)न(cid:224)नवत

" ...................... The representationist are all appointed as Junior Engineer on 9.12.1982

and they are claiming seniority and promotion to the post of Assistant Engineers claiming

parity on account of being senior in the cadre of the Junior Engineers-vis-à-vis Rajdeo

Singh and 12 others. Under Rule- 11 of the Bihar Engineer Service Class- II Rules, 1939

mandates that when the case of junior is considered for promotion the case of seniors will

necessarily be considered.

Similarly Rule 17 of the Bihar Engineering Service Class-II Rules, 1939 also mandates that the claim

of the seniority for promotion would also arise from the date his junior is promoted.

Although the said Satyadeo Mohan Ghosh, Shyam Das Singh and Sanath Kumar have

been claiming seniority and their consequential promotion to the post of Executive

Engineers and onwards in a group of litigations on behalf of the association but after

issuance of the order in 2015 for 39/40 ad-hoc engineers who came to be

regularized/promoted as Assistant Engineers, Superintending Engineers and Executive

Engineers they preferred the writ application being W.P.S. No.-654/18, 2189/18 and

5726/17 claiming shifting of the date of promotion and seniority. All these persons have

since retired and are claiming notional promotion. At this stage their notional promotion and

grant of seniority would not be treated to be a precedence vis-à-vis those who have not

moved for promotion before the Hon'ble High Court and it would not adversely affect the

current incumbents holding the posts in the cadre.

In the case of representationist an order was passed on 4th September, 2018 by the Hon'ble Division Bench consisting of Hon'ble the Chief Justice and Hon'ble Mr. Justice Aparesh Kumar Singh which is as follows:-

Unquote10 झारख(cid:214)ड गजट (असाधारण) सोमवार, 23 (cid:465)दस(cid:224)बर, 2024 It is a trite law that right of senior for promotion matures the moment his junior is promoted. In this regard reference can be made to the judgment reported in 1994(5) SCC 450. The Hon'ble Apex Court noted that the right matures to be considered from the date their junior is promoted even though they were not eligible for promotion but since their juniors were promoted, their claim had matured.

Similarly in judgment reported in 2008(1) SCC720 the Hon'ble Supreme Court relied upon judgment (R. Prabha Devi Vs Union of India and others reported in 1988 (2) SCC 233) stating that where the juniors have completed the eligibility criteria for promotion then their seniors would also be considered even if they have not completed eligibility criteria for promotion, thus if the junior to the representationist claiming to be regularized on promotion as Assistant Engineers in 1987 and the department granted them the status of Assistant Engineers by treating them promoted from the post of Junior Engineer although in less than 2 years time since some of them have been appointed as Junior Engineers in 1985 is an act of State which gives the right to the representationist to claim same benefits because admittedly 13 persons out of 39 ad-hoc engineers are junior to the representationist and therefore in this light Hon'ble High Court has given direction to consider their case.

In absence of any rules, the seniority is to be reckoned from the inter-se-seniority in

the lower basic cadre (reference 2004(3) SCC 723).

It is also well settled principle that the fruits of litigation is always given to the persons who assert their right in the Court of law and not to person who merely sits on the fence and observes the litigation from outside. The person who does not approach the Court would not get benefits and therefore, in my opinion these representationist alone should

be granted their seniority and promotion (reference in this regard can be made to judgment reported in 2015 (1) SCC 347).

It is also settled law that an employee is entitled for retrospective benefits with consequential benefits even after retirement if he was not promoted due to laches of the employer and if his juniors are promoted (2013 (4) AJR 93 and AIR 2015 SC 2094).

Seen from the above perspective, the claim of Satyadev Mohan Ghosh, Shyam Das Singh and Sanat Kumar can be said to be a genuine claim and as has been noted in the note-sheet at Page-100/N they would be entitled to be promoted as Assistant Engineer w.e.f. 27.6.1987 (when Rajdeo Singh and others were considered promoted as Assistant Engineers) vide resolution No.-6977 dated 15.09.2014 and they are also further entitled for promotion as Executive Engineers w.e.f. 23.11.2009 (Rajdeo Singh given promotion as Executive Engineer vide Notification No.- 8433 dated 1.12.2014) and consequently to the post of Superintending Engineer vide Notification No. 743 (S) dated 3.2.2016.

The representationist can also be given their consequential fixation of pay and

differential arrears of salary and the exercise can be confined to these three persons since

they have approached this Court and others have not. Consequential material benefits also

has to naturally accrue. Reference in this regard can be had to the decision reported in

1990(2) PLJR-248. Provisions of rule-58 or 74 of the Financial Rules would also not come

in the way as those rules do not deal with cases of retrospective promotions given

retrospectively when the promotions had become due but were not given due to latches,

( 20 ) उपरो(cid:200)त कं (cid:875)डका-19 म(cid:581) (cid:467)न(cid:465)हत (cid:292)(cid:232)ताव पर माननीय (cid:874)वभागीय (मु(cid:201)य) मं(cid:287)ी जी (cid:622)वारा (cid:465)दनांक 15.01.2021 को अनुमोदन (cid:292)दान (cid:873)कया गया ।झारख(cid:214)ड गजट (असाधारण) सोमवार, 23 (cid:465)दस(cid:224)बर, 2024 13 ( 21 ) इस बीच का(cid:871)म(cid:91)क, (cid:292)शास(cid:467)नक सुधार एवं राजभाषा (cid:874)वभाग प(cid:287)ांक 6752 (cid:465)दनांक 24.12.2020 से रा(cid:207)य सेवाओं के पद(cid:585) पर (cid:292)ो(cid:219)न(cid:467)त म(cid:581) रोक लगा द(cid:547) गई, िजसके आलोक म(cid:581) (cid:292)(cid:230)नगत मामले म(cid:581) (cid:874)व(cid:876)ध (cid:874)वभाग से परामश(cid:91) क(cid:551) मांग क(cid:551) गई (cid:874)व(cid:876)ध (cid:874)वभाग (cid:622)वारा (cid:465)दनांक 28.01.2021 को परामश(cid:91) (cid:465)दया गया (cid:873)क

"In my opinion steps initiated for granting promotion from retrospective date is being initiated in view of the order dated 4.09.2018 in W.P.S. No.- 654 / 18. The decision for promotion is taken in respect of compliance of the order dated 4.09.2018 passed in W.P. (S) No.-654/2018 and would thus would not be affected by the letter no.-6752 dated 24.12.2020. The promotions as contemplated can thus be given."

(S) No. 654 of 2018 (reproduced in my earlier opinion dated 30.9.2020 [at] Page 110-117-Nates of present file)

The said order also stipulates to consider the entitlement for promotion applying the 1939 Rules (ie, the Bihar Engineering Service Rules, 1939). Therefore notional promotions are to be granted retrospectively to the retired persons furit petitions) in compliance to the said order dated 4 September, 2018, if the retired person is found 'fit' by the DPC as the persons juniors to the above retired employees have been promoted on the date when the said retired persons were in service. Such retired persons have been agitating their grievances of promotion though representations and in twrit petitions. In light of the above order dated 4th September, 2018, these writ petitioners (whose date of promotion and inter- se-seniority in the Assistant Engineer's Cadre have already been corrected vide Govt. Notification No.-348 (S) and 356 (S) dated 1.2.2021 respectively (Page-956- 953 / C of file) would be entitled to promotions retrospectively on notional basis along with all consequential benefits in terms of settled law reported in 2013 (4) AJR 93and (2015) 14 SCC 335 as well as that reported in 1990 (2) PLJR 248. The persons / petitioners have been denied promotion with all consequential benefits. Their juniors who were promoted were also similarly promoted retrospectively by granting them all consequential benefits.

Since the promotions are now to be given to retired person on notional basis, therefore requirement of actual vacancy as on date of promotion would not require. In the even these retired persons would have been remain in service as on date, then only creation of supernumerary posts in the promotional grades would have become necessary which is not a case in hand.

In view of the above and previous opinion dated 1.10.2020 (Page- 118/Notes of present file), the promotions under consideration are to be granted to the post of Executive Engineer w.e.f. 23.11.2009 and to the post of Superintendent Engineer w.e.f. 3.2.2016 which are prior to the coming into force of the new Rules, 2016 on 3.5.2016, therefore they are to be granted not under the new Rule but under the old Rules i.e. Bihar Engineering Service Class-1 Rules, 1939,

7. Based on the order dated 4th September, 2018 passed in W.P. (27) (cid:874)वभागीय (cid:292)ो(cid:219)न(cid:467)त स(cid:871)म(cid:467)त क(cid:551) बैठक (cid:465)दनांक 06.07.2021 म(cid:581) कृ त अनुशंसा से संबं(cid:876)धत काय(cid:91)वाह(cid:547) पर माननीय (cid:874)वभागीय (मु(cid:201)य) मं(cid:287)ी (cid:622)वारा पृ (cid:231)ठ-156 / (cid:465)ट० पर (cid:876)चि(cid:219)हत अंश 'क' के साथ (cid:292)(cid:232)ताव (cid:465)दनांक 29.07.2021 को अनुमो(cid:465)दत (cid:873)कया गया ।

उ(cid:200)त (cid:272)म म(cid:581) अंकनीय है (cid:873)क पृ0-156 / (cid:465)ट0 पर (cid:876)चि(cid:219)हत अंश क म(cid:581) (cid:874)व(cid:622)वान महा(cid:876)धव(cid:200)ता (cid:622)वारा (cid:292)द(cid:419) (cid:874)व(cid:876)धक राय (cid:465)दनांक 14.06.2021 (कं (cid:875)डका-7) (cid:467)न(cid:224)न ह(cid:583):-

(29) झारख(cid:214)ड काय(cid:91)पा(cid:871)लका (cid:467)नयमावल(cid:547) के भाग-3, (cid:467)नयम-32 (क) (ix) (ii) से (cid:874)वचाराधीन (cid:292)ो(cid:219)न(cid:467)त मामला आ(cid:205)छा(cid:465)दत रहने के कारण माननीय (cid:874)वभागीय (मु(cid:201)य) मं(cid:287)ी से उपरो(cid:200)त (cid:874)वचा(cid:464)रत (cid:292)(cid:232)ताव से संबं(cid:876)धत आदेश (cid:467)नकालने से पूव(cid:91) (cid:292)(cid:232)ताव पर मु(cid:201)य स(cid:876)चव के मा(cid:218)यम से माननीय मु(cid:201)यमं(cid:287)ी महोदय से सहम(cid:467)त (cid:292)ा(cid:220)त करने (cid:272)म म(cid:581) तदेन मु(cid:201)य स(cid:876)चव (cid:622)वारा मामले को थोड़ा ज(cid:465)टल (cid:292)तीत होना बताकर (cid:292)शासी (cid:874)वभाग के स(cid:876)चव से वाता(cid:91) क(cid:551) अपे(cid:162)ा करते हु ए (cid:465)दनांक 09.09.2021 को सं(cid:876)चका वापस लौटा द(cid:547) गई ।16 झारख(cid:214)ड गजट (असाधारण) सोमवार, 23 (cid:465)दस(cid:224)बर, 2024 ( 30 ) त(cid:215)प(cid:230)चात ् (cid:292)(cid:230)नगत मामले म(cid:581) वाता(cid:91) उपरांत (cid:465)दनांक 14.01.2023 को सं(cid:876)चका म(cid:581) तदेन मु(cid:201)य स(cid:876)चव (cid:622)वारा क(cid:467)तपय आप(cid:874)(cid:419)य(cid:585) को सं(cid:876)चका म(cid:581) अं(cid:873)कत करते हु ए (cid:292)(cid:232)ताव अ(cid:232)वीकृ (cid:467)त क(cid:551) अनुशंसा माननीय मु(cid:201)यमं(cid:287)ी से क(cid:551) गई। तदेन मु(cid:201)य स(cid:876)चव (cid:622)वारा (cid:873)कये गये (cid:874)ववेचना म(cid:581) मु(cid:201)यतः (cid:467)न(cid:224)न तीन बात(cid:585) को बताया गया:-

" (क) िजन ad hoc Engineers से समतु(cid:227)यता क(cid:551) बात (cid:302)ी घोष कर रहे ह(cid:583), वे कभी भी ad hoc basis पर पथ (cid:467)नमा(cid:91)ण (cid:874)वभाग म(cid:581) (cid:467)नयु(cid:200)त नह(cid:547)ं (cid:873)कये गये ।

(ख) िजन ad hoc Engineers से समतु(cid:227)यता क(cid:551) बात (cid:302)ी घोष कर रहे ह(cid:583), वे कभी भी तदथ(cid:91) कनीय अ(cid:871)भयंता के (cid:510)प म(cid:581) पथ (cid:467)नमा(cid:91)ण (cid:874)वभाग म(cid:581) काय(cid:91)रत भी नह(cid:547)ं रहे ।

(ग) माननीय सव(cid:574)(cid:205)च (cid:219)यायालय के आदेश के फल(cid:232)व(cid:510)प इन ad hoc Engineers, िजनसे समतु(cid:227)यता बात (cid:302)ी घोष कर रहे ह(cid:583), को कनीय अ(cid:871)भयंता के पद पर समायोजन (cid:622)वारा (cid:467)नयु(cid:200)त भी नह(cid:547)ं (cid:873)कया गया है ।

अतः (cid:232)प(cid:231)ट है (cid:873)क (cid:302)ी घोष का भूतल(cid:162)ी (cid:292)भाव से (cid:292)ो(cid:219)न(cid:467)त का दावा तथा त(cid:215)संबं(cid:876)धत (cid:292)शासी (cid:874)वभाग का (cid:292)(cid:232)ताव त(cid:216)या(cid:215)मक (cid:510)प से गलत, (cid:295)ामक तथा आधारह(cid:547)न है। जहाँ तक AE के (cid:510)प म(cid:581) समतु(cid:227)यता का (cid:292)(cid:230)न है, यह (cid:232)प(cid:231)ट है (cid:873)क (cid:302)ी घोष 2013 म(cid:581) सहायक अ(cid:871)भयंता बने जब(cid:873)क Ad-hoc Engineers को 1987 के (cid:292)भाव से सहायक अ(cid:871)भयंता के पद पर समायोजन (cid:622)वारा (cid:467)नयु(cid:200)त (cid:873)कया गया है। अतः (cid:302)ी घोष इनसे कनीय ह(cid:583), अतः इस आधार पर भी भूतल(cid:162)ी (cid:292)भाव से (cid:292)ो(cid:219)न(cid:467)त का दावा नह(cid:547)ं बनता है ।"

( 31 ) माननीय मु(cid:201)यमं(cid:287)ी महोदय (cid:622)वारा तदेन मु(cid:201)य स(cid:876)चव (cid:622)वारा अं(cid:873)कत (cid:465)ट(cid:220)पणी / मंत(cid:229)य एवं उनके अ(cid:232)वीकृ (cid:467)त के (cid:292)(cid:232)ताव से असहमत होते हु ए इन (cid:466)ब(cid:219)दुओं पर (cid:874)व(cid:622)वान महा(cid:876)धव(cid:200)ता का परामश(cid:91) (cid:292)ा(cid:220)त कर सं(cid:876)चका उप(cid:232)था(cid:874)पत करने का आदेश (cid:465)दनांक 02.03.2023 को अं(cid:873)कत करते हु ए सं(cid:876)चका लौटा द(cid:547) गयी ।

( 32 ) माननीय मु(cid:201)यमं(cid:287)ी महोदय के आदेशानुसार तदेन मु(cid:201)य स(cid:876)चव के (cid:622)वारा उठाये गये क(cid:467)तपय (cid:466)ब(cid:219)दुओं पर परामश(cid:91) देने हेतु सं(cid:876)चका (cid:874)व(cid:622)वान महा(cid:876)धव(cid:200)ता, झारख(cid:214)ड को पृ (cid:231)ठां(cid:873)कत कर भेजी गई। (cid:874)व(cid:622)वान महा(cid:876)धव(cid:200)ता (cid:622)वारा उनके काया(cid:91)लय प(cid:287)ांक : 5495 (cid:465)दनांक 28.04.2023 (cid:467)न(cid:224)नां(cid:873)कत अ(cid:871)भलेख(cid:585) क(cid:551) माँग क(cid:551) गई:-

No.-28 (cid:465)दनांक 05.01.2024 से (cid:292)ा(cid:220)त हु आ, जो उनके पूव(cid:91) (cid:874)व(cid:876)धक परामश(cid:91) (cid:465)दनांक 14.06.2021 के (cid:272)म म(cid:581) है, का मु(cid:201)य-मु(cid:201)य अंश (cid:467)न(cid:224)न (cid:510)प म(cid:581) है:-

"The documents were sent to my office vide letter no. 1558 dated 28.4.2023 vide the letter of the Joint Secretary of the Department.

The documents were examined and verified by me in detail.

In the above context facts which emerge from various Notifications, Resolutions and

Orders of Road Construction Department, Jharkhand and judgments of the Hon'ble

Jharkhand High Court and Hon'ble Supreme Court are as follows:-

Analysis

1. Thus, the petitioner's claim for promotion is to be considered in light of Order No. 5/dated 4th September, 2018 passed in LA. No.-6171/2018 in W.P. (S) No.- 654/2018, whereby the Hon'ble Division Bench of Jharkhand High Court has observed that the main point involved in this writ petition is as to whether Jharkhand Engineering Service Rules, 2016 shall prevail over Bihar Engineering Service Rules, 1939 or not. Under the latter Rules, Assistant Engineers coming from both Graduate and Diploma streams are eligible for promotion to the post of Executive Engineer and under the former Le. 2016 Rules, only those Assistant Engineers, who possess degree in engineering are eligible for promotion.

2. The Hon'ble Division Bench has also directed that the State Authorities may consider entitlement for promotion by applying 1939 Rules and to bring to the notice of the Hon'ble Division Bench, the position of the petitioner on the next date of hearing and matter to be listed on 13th December, 2018. Thus, considering said judicial order dated 4 September, 2018 passed by Hon'ble Division Bench, subject to fitness for promotion, the petitioners are entitled to be considered for shift back of date of promotion in grade of Assistant Engineer and higher promotion to Class-1 posts under 1939 Rules at par with their admitted juniors. It appears that no affidavit18 झारख(cid:214)ड गजट (असाधारण) सोमवार, 23 (cid:465)दस(cid:224)बर, 2024 on behalf of the State of Jharkhand in compliance to said order dated 4th September, 2018 has been filed.

3. After perusal of records of the file and specially looking into apprehensions of the petitioner as who brought to the then Chief Secretary vide his representation dated 5.11.2019 and 25.11.2019, reveals that in view of the facts recorded therein, the Chief Secretary issued a specific direction to the Secretary, Road Construction Department to have the matter examined point-wise and reviewed in presence of the petitioner and facts be intimated to the Chief Secretary.

4. The earlier order dated 31.10.2019 was also not in consonance with the above order dated 4th September, 2018, passed by the Division Bench of the Jharkhand High Court in W.P. (S) No.-654/2018 for the reason that the Hon'ble Court was pleased to direct to consider petitioner's case for promotion as per 1939 Rules and not to examine, firstly whether this case is similarly situated to above Ad-hoc Assistant Engineersand secondly, if found similar then to consider petitioner's case else not to consider this case as was done by the said order dated 31.10.2019.

It is evident from the records of present file at Page-125-129/N that in terms of considered view of the Administrative Department of Personnel, Administrative Reforms &Rajbhasha, Department of Finance and Department of Law in light of order dated 4th September, 2018, the proposal initiated was accorded approval by the Competent Authority for () shifting back the date of promotion of the writ petitioners (Satyadeo Mohan Ghosh, Shyam Das Singh and Sanat Kumar) in Assistant Engineer Cadre from 3.5.2013 to 27.6.1987 with all consequential (financial) benefits. (u) Accordingly corrections be done in inter-se-seniority position of the above petitioners in seniority list dated 5.5.2015 of Assistant Engineer grade of RCD Cadre, (ii) Thereafter, to place the proposal before Departmental Promotion Committee to consider suitability for promotions of these petitioners to the higher rank of Executive Engineer w.e.f. 23.11.2009 and Superintending Engineer w.e.f. 3.2.2016 i.e. the dates on which admitted juniors to the above mentioned petitioner were granted promotions.

6. Accordingly, order for shifting back the date of promotion in Assistant Engineer

grade and correction/revision of inter-se-seniority position in Assistant Engineer

grade in respect of above mentioned three writ petitioners were notified vide

Notification No.-348 (S) read with Memo No.- 349 (S) dated 1.2.2021 and Notification

No.-356 (S) read with Memo No.- 357 (S) dated 1.2.2021 respectively with the

remarks therein that revision of seniority (due to promotion on notional basis) would

not affect the seniority position of any other members of Engineering Services under

Class-II or Class-L

7. The Administrative Department after finding the case of the petitioners to be well founded for consideration, a final meeting of the Departmental Promotion Committee was held on 8th July, 2021 wherein upon adjudging. the suitability of the candidates, out of total three persons (under consideration), only two were found fit for promotion and in light of comment/legal advice rendered in present file by the Department of Law, the DPC recommended the above two names (namely Satyadeo Mohan Ghosh and Shyam Das Singh) as fit to be granted promotion on notional basis with retrospective effect to higher rank of Executive Engineer w.e.f. 23.11.2009 and Superintending Engineer w.e.f. 3.2.2016. Thereafter under provisions of the Rule-32 (Ka) (ix) (ii) of the Rules of Executive Business of Jharkhand, the file containing said proposal and recommendations of DPC was accepted/approved with all consequential benefits by Hon'ble Chief Minister himself though in capacity of Departmental Minister on 29th July, 2021 (Page-164-167/N of file).

8. Thereafter, process for obtaining formal concurrence to the said proposal (which has earlier been accepted/approved by Hon'ble Minister-in-charge) from the Hon'ble Chief Minister through the Chief Secretary under Rule-32 (Ka) (ix) (ii) of the Rules of Executive Business of Jharkhand was initiated. 9. The undisputed facts which emerge from Resolution dated 15.9.2014, Resolution dated 29.4.2015, Order dated 30.4.2015 and Notification dated 5.5.2015 as also from Orders dated 23.4.2014 and 9.4.2015 of the Hon'ble Supreme Court passed in Civil Appeals and Contempt Petitions respectively are as follows:-

'A'. The above Ad-hoc Engineers though were initially engaged on daily wages as Junior Engineer under REO/NRFP of the Rural Development Department, Bihar but thereafter they were regularized as Junior Engineers in the Road Construction Department, Jharkhand from their respective dates of joining as daily wages Junior Engineer and their service were confirmed after one year on the post of Junior Engineer in Road Construction Department Cadre so much so that the arrears of salary Le. difference of pay on daily wages and as regular Junior Engineer was also paid to them and placed before Hon'ble Supreme Court in 8h affidavit filed by the State before it. Thus, on regularization from dates of initial joining as Junior Engineer as well as or confirmation of service these Ad- hoc Engineers in terms of provisions under Bihar Subordinate Engineering Service Rules of 1939 became employees of Road Construction Department holding the post of Junior Engineer on substantive basis from the dates of their initial joining itself. As a government servant can hold only one post on substantive basis, therefore with these Ad-hoc Engineers holding post of Junior Engineer on substantive basis of Road Construction Department they no longer can be said to have held the post of Junior Engineer in REO/NRFP of Rural Development Department in view of the above decisions vide Resolution dated 29.4.2015 and Order dated 30.4.2015 of the Road Construction Department,20 झारख(cid:214)ड गजट (असाधारण) सोमवार, 23 (cid:465)दस(cid:224)बर, 2024 Jharkhand. As the above position that the Ad-hoc Engineers stood appointed on post of Junior Engineer in Road Construction Department was placed before the Hon'ble Supreme Court in affidavit filed on 9.2.2016 by the State and considering the same it closed the contempt proceedings by order dated 24.10.2016, it has now attained.

finality and now cannot be questioned on any count. Thus, the distinction and basis of the Chief Secretary in the Noting under Reference are to the effect that no parallel claim of seniority can be drawn regarding 2 different Cadres of 2 different Departments of the Government is factually not correct.

'B'. Even the Chief Secretary in his Noting at paragraph-6 admits that had the

appointment of Ad-hoc Engineers been made in the Road Construction

Department, then the position would have been entirely different.

'C'. Though the above Ad-hoc Engineers were earlier regularized vide Resolution dated 15.9.2014 as Assistant Engineer and thereafter were appointed by way of absorption on the post of Assistant Engineer vide Resolution dated 29.4.2015 but these, keeping in view that they had been made permanent. Junior Engineer from date of their joining in Road Construction Department vide Resolution dated 29.4.2015 and confirmed also as Junior Engineer after one year by Order dated 30.4.2015 the same was in effect a promotion from the cadre of Junior Engineer to Assistant Engineer in the Road Construction Department because (a) appointment to Bihar Engineering Service Class-II Rules, 1939 on the post of Assistant Engineers is only to be through three modes i.e. direct recruitment, transfer from other Department of permanent or temporary government servants and promotion from the feeder cadre of Junior Engineer and as these Ad- hoc Engineers had admittedly failed in examination and thus were not successful in selection process for direct recruitment to post of Assistant Engineer and as they were neither permanent nor temporary government servant in any Department under Government of Bihar/Jharkhand, including Rural Development Department, they could not have been appointed/regularized directly in Class-II service on the post of Assistant Engineer by way of the two modes of direct recruitment or by transfer and thus as per the said Rule the sole remaining made by which they could have been appointment was the third mode of promotion ie. promotion from the feeder cadre of Junior Engineer where they were appointed by way of regularizing their service by Resolution dated 29.4.2015 on the post of Junior Engineer and made permanent by confirming their service by Order dated 30.4.2015 and (b) accordingly in view of this position of the Rules because they were clearly assigned seniority as promotes of the year 1987 above direct recruits of 1987 (on the principle that promotes wouldझारख(cid:214)ड गजट (असाधारण) सोमवार, 23 (cid:465)दस(cid:224)बर, 2024 21 rank senior to direct recruits) in the Cadre of Assistant Engineer from the cadre of Junior Engineer in the amended final seniority list dated 5.5.2015 of the Road Construction Department. As the above position of these Junior Engineers having been allotted due seniority position as promotes in the cadre of Assistant Engineers vide above seniority list dated 5.5.2015 was placed before the Hon'ble Supreme Court in affidavit filed on 9.2.2016 by the State and considering the same it closed the contempt proceedings by order dated 24.10.2016 it has now attained finality and now cannot be questioned on any count.

'D'. Shri S.M. Ghosh and Shri S.D. Singh were appointed in the cadre of Junior Engineer of the Road Construction Department by way of direct recruitment on 9.12.1982 and their services were regularized from the said date and confirmed in that grade prior to the appointment of daily wager Junior Engineer and their regularization/confirmation in Junior Engineer under Road Construction Department Cadre. To the contrary as per the settled position, as explained above, the date of appointments and confirmation of some of the Ad-hoc Engineers as Junior Engineers in the cadre of Road Construction Department stands subsequent to the dates of appointment and confirmation of Sri S.M. Ghosh and Sri S.D. Singh. For Example is the case of Sri Rajdeo Singh who stood appointed on the post of Junior Engineer on 23.7.1985 and was confirmed as such on 23.7.1986. Therefore Sri S.M. Ghosh and Sri S.D. Singh as per dates of their initial appointment stand senior to these Ad-hoc Engineers on the basis of length of service of each of them counted from the date of entry into Government service in the cadre of Junior Engineer in Road Construction Department including that to Sri Rajdeo Singh also.

'E'. When claim for promotion on post of Assistant Engineer was raised by Sri S.M. Ghosh and Sri S.D. Singh on the ground that their above said Ad- hoc Engineers who were junior to them in the cadre of Junior Engineer in the Road Construction Department had been granted promotion to this post then it is the seniority of the feeder post of Junior Engineer, which is to be considered and not the seniority of the promotional post of Assistant Engineer itself.

F. Cumulatively on the basis of above the claim of Sri S.M. Ghosh and Sri S.D. Singh and the proposal by Road Construction Department on its basis. that they were senior to the above Ad-hoc Engineers on the post of Junior Engineer in the Road Construction Department being a fall out of the decisions of the State Government itself all taken in compliance of Orders of the Hon'ble Jharkhand High Court and Hon'ble Supreme Court of India which have attained finality.

'G'. In view of the aforesaid facts and circumstances as discussed and analysed above, I am of the view that the factual premise contained in the Noting of the Chief22 झारख(cid:214)ड गजट (असाधारण) सोमवार, 23 (cid:465)दस(cid:224)बर, 2024 Secretary and the recommendation made by the Chief Secretary is not based on correct appreciation of factual matrix, specially the effect of judgments dated 8.11.2011 and 23.4.2014 and Order dated 9.4.2015 of the two Hon'ble Courts and Resolution dated 29.4.2015 read with Order dated 30.4.2015 and Notification dated 5.5.2015 of Road Construction Department, Jharkhand apart from failure to notice Paragraph-13, sub-para-(Ka) and (Kha) of Resolution dated 29.4.2015 while quoting sub-para-(Ga) thereof.

'H'. All the above facts as discussed by me hereinabove be verified by the Concerned department ie. the Road Construction department.

(i) In thus view of the matter and subject to the verification by RCD department of the facts

noted hereinabove, I render my opinion as follows:- (4) Recommendations of the

Departmental Promotion Committee as contained in its minutes of meeting held on 8th July,

2021 (Page-971- 968/C) duly approved with all consequential benefits by the Minister in

charge on 29th July, 2021 (Page 167/ N ) should be concurred for issuing order of

promotions to the recommended persons.

(ii) In light of my earlier opinion dated 30.9.2020 (Page-117/N) for which approval was

accorded on 15.1.2021 by Hon'ble Minister in Charge of the Department (Page-127-129/N of

file), after the decision is taken and notified, an appropriate affidavit containing action taken

should also be filed before Hon'ble Division Bench in the matter of W.P. (S) No.-654/2018

W.P. (S) No.-2189/2018 and W.P. (S) No. with other linked cases 5726/2017 as per direction

dated 4.9.2018 of the Hon'ble Court passed on LA. No.-6171/2018 filed therein so that the

litigations can be given a quietus.*

(34) (cid:874)व(cid:622)वान महा(cid:876)धव(cid:200)ता के उपरो(cid:200)त मंत(cid:229)य / परामश(cid:91) के आधार पर (cid:874)वचाराधीन मामले म(cid:581) मं(cid:466)(cid:287)प(cid:464)रषद क(cid:551) सहम(cid:467)त (cid:292)ा(cid:220)त करने हेतु मु(cid:201)य स(cid:876)चव के मा(cid:218)यम से माननीय मु(cid:201)यमं(cid:287)ी महोदय को उप(cid:232)था(cid:874)पत सं(cid:876)चका म(cid:581) (cid:467)न(cid:224)न आदेश (cid:292)ा(cid:220)त हु आ :-

*(1) (cid:874)वभाग गुण-दोष के आधार पर मं(cid:466)(cid:287)प(cid:464)रष(cid:622) म(cid:581) (cid:292)(cid:232)ताव लाने पर (cid:874)वचार करे ।

(2) मं(cid:466)(cid:287)प(cid:464)रषद म(cid:581) (cid:292)(cid:232)ताव लाने हेतु (cid:874)वभागीय मं(cid:287)ी क(cid:551) सहम(cid:467)त व अ(cid:219)य संबं(cid:876)धत (cid:874)वभाग क(cid:551) सहम(cid:467)त आव(cid:230)यक है ।

(3) य(cid:465)द (cid:874)वभाग मं(cid:466)(cid:287)प(cid:464)रष(cid:622) म(cid:581) (cid:292)(cid:232)ताव लाना चाहता है तो:-

(i) त(cid:215)काल(cid:547)न मु(cid:201)य स(cid:876)चव क(cid:551) (cid:465)ट(cid:220)पणी म(cid:581) उ(cid:622)ध(cid:464)रत त(cid:216)य(cid:585) को भी संलेख म(cid:581) उ(cid:622)ध(cid:464)रत कर(cid:581) तथा (cid:874)वभागीय सहम(cid:467)त असहम(cid:467)त कारण के साथ अं(cid:873)कत कर(cid:581) ।झारख(cid:214)ड गजट (असाधारण) सोमवार, 23 (cid:465)दस(cid:224)बर, 2024 23 (ii) पृ (cid:231)ठ 203 / (cid:465)ट० अंश 'क' के त(cid:216)य व उसके दूरगामी प(cid:464)रणाम पर भी संलेख म(cid:581) (cid:229)या(cid:201)या कर(cid:581) ।"

(35) उपरो(cid:200)त आलोक म(cid:581) पथ (cid:467)नमा(cid:91)ण (cid:874)वभाग (cid:622)वारा गुण-दोष के आधार पर मं(cid:466)(cid:287)प(cid:464)रषद म(cid:581) (cid:292)(cid:232)ताव लाने पर (cid:874)वचार करते हु ए सं(cid:876)चका (cid:874)वभागीय मं(cid:287)ी के आदेशाथ(cid:91) उप(cid:232)था(cid:874)पत क(cid:551) गई तथा (cid:874)वभागीय मं(cid:287)ी क(cid:551) सहम(cid:467)त (cid:292)ा(cid:220)त है ।

( 36 ) (cid:874)वभाग (cid:622)वारा (cid:292)(cid:232)ताव से संबं(cid:876)धत गुण-दोष क(cid:551) समी(cid:162)ा पूव(cid:91) म(cid:581) क(cid:551) गई है तथा (cid:874)व(cid:876)ध (cid:874)वभाग का परामश(cid:91) भी सं(cid:876)चका म(cid:581) (cid:292)ा(cid:220)त है (cid:873)क-

"It is well settled principle that the fruits of litigation is always given to the persons who assert their right in the Court of law and not to person who merely sits on the fence and observes the litigation from outside. The person who do not approach the Court would not get benefits and therefore, in my opinion these representationist alone should be granted their seniority and promotion [reference in this regard can be made to judgment reported in 2015 (1) SCC 347)."

पुन: (cid:874)व(cid:876)ध (cid:874)वभाग (cid:622)वारा (cid:292)द(cid:419) परामश(cid:91)/मंत(cid:229)य म(cid:581) अं(cid:873)कत है (cid:873)क (cid:874)वचाराधीन सेवा(cid:467)नवृ त सेवारत अव(cid:876)ध म(cid:581) ह(cid:547) व(cid:464)र(cid:231)ठता म(cid:581) कनीय पदधारक(cid:585) को उ(cid:205)चतर पद(cid:585) पर भूतल(cid:162)ी (cid:292)भाव से सभी अनुवत(cid:568) लाभ के साथ (cid:292)ो(cid:219)न(cid:467)त (cid:292)दान क(cid:551) गई है तथा (cid:874)वचाराधीन सहायक अ(cid:871)भयंता (तदेन) (cid:622)वारा सेवा अव(cid:876)ध म(cid:581) कई अ(cid:223)यावेदन (cid:874)वभाग म(cid:581) एवं उ(cid:205)च (cid:292)ा(cid:876)धकार को (cid:465)दया गया था एवं सेवारत अव(cid:876)ध के दर(cid:224)यान इनके (cid:622)वारा अपने अ(cid:876)धकार(cid:585) के (cid:292)(cid:467)त सजग रह कर माननीय झारख(cid:214)ड उ(cid:205)च (cid:219)यायालय म(cid:581) (cid:464)रट या(cid:876)चका भी (cid:292)ो(cid:219)न(cid:467)त हेतु दायर (cid:873)कया गया था, इस(cid:871)लए इनके (cid:292)ो(cid:219)न(cid:467)त संबंधी दावे को (cid:874)व(cid:876)ध स(cid:224)मत बताया गया है। इस (cid:292)कार (cid:292)(cid:232)ताव म(cid:581) Merits (गुण) (cid:207)यादा है तथा (cid:874)व(cid:876)ध (cid:874)वभाग के (cid:622)वारा (cid:874)व(cid:871)भ(cid:219)न अवसर(cid:585) पर (cid:292)द(cid:419) (cid:874)व(cid:876)धक राय के आलोक म(cid:581) De-merits (अवगुण) नह(cid:547)ं है, (cid:200)य(cid:585)(cid:873)क (cid:292)(cid:230)नगत मामला माननीय झारख(cid:214)ड उ(cid:205)च (cid:219)यायालय के ख(cid:214)ड-पीठ (cid:622)वारा पा(cid:464)रत आदेश (cid:465)दनांक 4 (cid:871)सत(cid:224)बर, 2018 से आ(cid:205)छा(cid:465)दत है, साथ ह(cid:547) (cid:874)व(cid:622)वान महा(cid:876)धव(cid:200)ता से भी पराम(cid:871)श(cid:91)त है। चू ं(cid:873)क (cid:292)(cid:230)नगत तीन(cid:585) सेवा(cid:467)नवृ (cid:419) सहायक अ(cid:871)भयंता के अलावे अ(cid:219)य (cid:873)कसी के (cid:622)वारा भी माननीय (cid:219)यायालय म(cid:581) Approach नह(cid:547)ं (cid:873)कया गया है, इस(cid:871)लए अब नये (cid:871)सरे से भ(cid:874)व(cid:231)य म(cid:581) (cid:873)कसी भी सेवा(cid:467)नवृ त अ(cid:871)भयंता, जो अपने सेवाकाल म(cid:581) कनीय को (cid:292)द(cid:419) (cid:292)ो(cid:219)न(cid:467)त के आधार पर देय (cid:292)ो(cid:219)न(cid:467)त का दावा नह(cid:547)ं (cid:873)कये ह(cid:583)। के (cid:622)वारा (cid:292)ो(cid:219)न(cid:467)त का दावा (cid:874)व(cid:876)ध मा(cid:219)य नह(cid:547) होगा ।

(37) अतः उपरो(cid:200)त आलोक म(cid:581) तथा माननीय (cid:219)यायालय आदेश के अनुपालन के (cid:272)म म(cid:581) (cid:467)न(cid:224)न (cid:292)(cid:232)ताव रा(cid:207)य सरकार के (cid:232)तर पर (cid:874)वचाराधीन था:-

( 38 ) (cid:292)(cid:232)ताव एवं संलेख (cid:292)ा(cid:510)प पर (cid:874)व(cid:419) (cid:874)वभाग क(cid:551) सहम(cid:467)त (cid:292)ा(cid:220)त ह(cid:583) ।

( 39 ) (cid:292)(cid:232)ताव एवं संलेख (cid:292)ा(cid:510)प पर का(cid:871)म(cid:91)क, (cid:292)शास(cid:467)नक सुधार तथा राजभाषा (cid:874)वभाग का परामश(cid:91) (cid:292)ा(cid:220)त है ।

( 40 ) (cid:292)(cid:232)ताव पर माननीय (cid:874)वभागीय मं(cid:287)ी का अनुमोदन (cid:292)ा(cid:220)त है ।

( 41 ) (cid:292)(cid:232)ताव पर (cid:874)व(cid:876)ध (cid:874)वभाग से (cid:874)व(cid:876)धक राय (cid:292)ा(cid:220)त है ।

( 42 ) अतः स(cid:224)यक (cid:874)वचारोपरांत संल(cid:202)न सूची (प(cid:464)र(cid:871)श(cid:231)ट- क) के अनुसार उपयु (cid:91)(cid:200)त कं (cid:875)डका-37 म(cid:581) व(cid:872)ण(cid:91)त दोन(cid:585) सेवा(cid:467)नवृ (cid:419) सहायक अ(cid:871)भयंताओं यथा- सव(cid:91)(cid:302)ी स(cid:215)यदेव मोहन घोष एवं (cid:230)यामदास (cid:871)संह को काय(cid:91)पालक अ(cid:871)भयंता एवं अधी(cid:162)ण अ(cid:871)भयंता के पद पर भूतल(cid:162)ी (cid:292)भाव से वैचा(cid:464)रक (cid:292)ो(cid:219)न(cid:467)त (cid:292)दान क(cid:551) जाती है। इसे पूवा(cid:91)(cid:622)धारण नह(cid:547)ं समझा जाएगा ।
