जल ((cid:366)दू षण निवारण एवं नियं(cid:361)ण) अधिनियम 1974 के (cid:554)ारा (cid:366)दू षण की रोकथाम तथा नियं(cid:361)ण हेतु किए गए (cid:366)ावधानों के (िcid:354)या(cid:587)यन के लिए धारा-4(1) के तहत झारख(cid:503) रा(cid:475) (cid:366)दू षण नियं(cid:361)ण पष(cid:330)द का गठन किया गया है । माननीय NGT नई दि(cid:671)ी म(cid:336) दायर O.A.No-318/2013राजे(cid:574) सिंह भ(cid:503)ारी बनाम उतराख(cid:503) रा(cid:475) एवं अ(cid:586) मामले म(cid:336) दिनांक-24.08.2016 को पा(cid:303)रत आदे श के वि(cid:349)(cid:544) माननीय सव(cid:342)(cid:452) (cid:586)ायालय, नई दि(cid:671)ी म(cid:336) दायर Civil Appeal No-1359/2017म(cid:336) दिनांक-22.09.2017 को (cid:586)ायादे श पा(cid:303)रत किया गया है एवं अ(cid:559)(cid:407)/सद(cid:735) सचिव के पद पर नियु(cid:304)(cid:389) हेतु उपयु(cid:389) माग(cid:330) निद(cid:337)शिका संसूचित करने का निद(cid:337) श दिया गया है, जिसके अनुपालन म(cid:336) वन, पया(cid:330)वरण एवं जलवायु प(cid:303)रवत(cid:330)न विभाग की अधिसूचना सं(cid:421)ा-2230 दिनांक-05.08.2021 (cid:554)ारा ''झारख(cid:503) रा(cid:475) (cid:366)दू षण कनयं(cid:361)ण पष(cid:330)द ेि अ(cid:559)(cid:407) ीि कनयु(cid:304)(cid:389) एवं सेवा(cid:517)(cid:330) कनयमावली, 2021"अधिसूचित है एवं अधिसूचना सं0-2231 दिनांक- 05.08.2021 (cid:554)ारा ''झारख(cid:503) रा(cid:475) (cid:366)दू षण कनयं(cid:361)ण पष(cid:330)द ेि सद(cid:735) सकचव ीि कनयु(cid:304)(cid:389) एवं सेवा(cid:517)(cid:330) कनयमावली, 2021"अधिसूचित है।2 झारख(cid:214)ड गजट (असाधारण) मंगलवार, 17 फ़रवर(cid:547), 2026 पुनः वन, पया(cid:330)वरण एवं जलवायु प(cid:303)रवत(cid:330)न विभाग की अधिसूचना सं(cid:421)ा-1005 दिनांक-16.03.2024 (cid:554)ारा झारख(cid:503) रा(cid:475) (cid:366)दू षण नियं(cid:361)ण पष(cid:330)द के अ(cid:559)(cid:407) की नियु(cid:304)(cid:389) एवं सेवाश(cid:517)(cid:330) नियमावली, 2021 के कं डिका-8 एवं 9 (घ) एवं (च) म(cid:336) संशोधित कर "झारख(cid:503) रा(cid:475) (cid:366)दू षण कनयं(cid:361)ण पष(cid:330)द ेि अ(cid:559)(cid:407) ीि कनयु(cid:304)(cid:389) एवं सेवा(cid:517)(cid:330) (र्संोधन) कनयमावली, 2024"अधिसूचित है।

माननीय सव(cid:342)(cid:452) (cid:586)ायालय, नई दि(cid:671)ी के आदे श के अनुपालन म(cid:336) अ(cid:559)(cid:407)/सद(cid:735) सचिव की नियु(cid:304)(cid:389) एवं सेवाश(cid:517)(cid:330) नियमावली म(cid:336) स(िcid:580)हित सेवा शत(cid:344) को वत(cid:330)मान प(cid:303)र(cid:366)े(cid:409) म(cid:336) स(cid:644)क् विचारोपरांत संशोधित एवं दोनों नियमावली को compile किया जाना आव(cid:692)क (cid:366)तीत होता है।

भारत का संविधानʼ के अनु(cid:453)े द-309 के पर(cid:566)ुक (cid:554)ारा (cid:366)द(cid:517) श(cid:304)(cid:389)यों का (cid:366)योग करते (cid:352)ए जल ((cid:366)दू षण निवारण एवं नियं(cid:361)ण) अधिनियम (1974 का 6वां) की धारा 64, उपधारा-2 खंड-ʼʼईʼʼ म(cid:336) निहित (cid:366)ावधानों के तहत रा(cid:475) सरकार (cid:554)ारा झारख(cid:503) रा(cid:475) (cid:366)दू षण नियं(cid:361)ण पष(cid:330)द के अ(cid:559)(cid:407) एवं सद(cid:735) सचिव की नियु(cid:304)(cid:389) एवं सेवाश(cid:517)(cid:330) नियमावली, 2026 नि(cid:635)वत् बनायी जाती है:-

भाग-1

1. संक(cid:407)(cid:593) नाम एवं (cid:366)ार(cid:641):-

(i) इन नियमों को झारख(cid:503) रा(cid:475) (cid:366)दू षण कनयं(cid:361)ण पष(cid:330)द अ(cid:559)(cid:407) एवं सद(cid:735) सकचव कनयु(cid:304)(cid:389) एवं सेवा(cid:517)(cid:330) कनयमावली, 2026 कहा जायेगा।

(ii) यह अधिसूचना निग(cid:330)त होने की तिथि से (cid:366)भावी होगी।

2. प(cid:303)रभाषाएं :-

इन नियमों म(cid:336), जब तक कि संदभ(cid:330) से अ(cid:586)था अपे(िcid:407)त न हो,-

(क) "अकधकनयम" से अभि(cid:366)ेत है जल ((cid:366)दू षण निवारण और नियं(cid:361)ण) अधिनियम, 1974 (1974 का 6) (ख) "विभाग" से अभि(cid:366)ेत है वन, पया(cid:330)वरण एवं जलवायु प(cid:303)रवत(cid:330)न विभाग, झारख(cid:503);

(ग) "पष(cid:330)द" से अभि(cid:366)ेत है झारख(cid:503) रा(cid:475) (cid:366)दू षण नियं(cid:361)ण पष(cid:330)द;

(घ) "कनयु(cid:304)(cid:389) (cid:366)ाकधािर" से अभि(cid:366)त है झारख(cid:503) सरकार;

(ड़) "अ(cid:559)(cid:407)" से अभि(cid:366)ेत है झारख(cid:503) रा(cid:475) (cid:366)दू षण नियं(cid:361)ण पष(cid:330)द के अ(cid:559)(cid:407);

(च) "सद(cid:735) सकचव" से अभि(cid:366)ेत है झारख(cid:503) रा(cid:475) (cid:366)दू षण नियं(cid:361)ण पष(cid:330)द के सद(cid:735) सचिव

3. पदं ीि सं(cid:421)ा-

(क) अ(cid:559)(cid:407), झारख(cid:503) रा(cid:475) (cid:366)दू षण नियं(cid:361)ण पष(cid:330)द-01 (एक)।

(ख) सद(cid:735) सचिव, झारख(cid:503) रा(cid:475) (cid:366)दू षण नियं(cid:361)ण पष(cid:330)द-01 (एक)।

4. कनयु(cid:304)(cid:389) ीि कवकध-(cid:366)तिनियु(cid:304)(cid:389)/संविदा के आधार पर/सीधी नियु(cid:304)(cid:389)।3 झारख(cid:214)ड गजट (असाधारण) मंगलवार, 17 फ़रवर(cid:547), 2026

भाग-2

5. अ(cid:559)(cid:407) ेि (cid:349)प म(cid:336) कनयु(cid:304)(cid:389) ेि कलए कनयम और त(cid:338)-

i. वेतनमान-स(cid:593)म वेतनमान के अनु(cid:349)प Level-15 in the pay matrix अ(cid:586) भ(cid:517)े (महँगाई भ(cid:517)ा, चिकि(cid:534)ा भ(cid:517)ा, या(cid:361)ा भ(cid:517)ा) एवं वाषि(cid:330)क वेतनवृ(cid:304)(cid:544) भारत सरकार/रा(cid:475) सरकार के (cid:366)ासंगिक नियमों के अनुसरण म(cid:336) संदे य होगा। वेतन का निधा(cid:330)रण रा(cid:475) सरकार के वि(cid:517) विभाग के एतदसंबंधी प(cid:361)/प(cid:303)रप(cid:361) आदि से आ(cid:453)ादित होगा। ii. आयु सीमा- नियु(cid:304)(cid:389) के लिए आवेदन (cid:366)ा(cid:304)(cid:593) की अंतिम तिथि को अधिकतम आयु सीमा 62 वष(cid:330) होगी। iii. ािय(cid:330)ािल- अ(cid:559)(cid:407), झारख(cid:503) रा(cid:475) (cid:366)दू षण नियं(cid:361)ण पष(cid:330)द का पूण(cid:330) काय(cid:330)काल 3 वष(cid:344) की एकल काया(cid:330)वधि का होगा, जिसका वि(cid:721)ार नहीं किया जायेगा।

iv. सेवा(cid:517)(cid:330):-

(क) पष(cid:330)द के अ(cid:559)(cid:407) के भ(cid:517)ा, योगदान का समय, वेतन, भवि(cid:712) निधि/National Pension Scheme/Employee Provident Fund Organization,सेवानिवृति आयु, चिकि(cid:534)ा सुविधा एवं अ(cid:586) सेवाश(cid:517)(cid:333) रा(cid:475) सरकार/के (cid:574) सरकार के अधीन समान वेतनमान का पद धारण करने वाले पदाधिकारी के संबंध म(cid:336) लागू नियम एवं आदे श (cid:554)ारा विनियमित होगी।

(ख) रा(cid:475) सरकार एवं के (cid:574) सरकार म(cid:336) सेवारत अ(cid:631)थ(cid:334)/आवेदकों/पदाधिका(cid:303)रयों की अ(cid:559)(cid:407), झारख(cid:503) रा(cid:475) (cid:366)दू षण नियं(cid:361)ण पष(cid:330)द के पद पर नियु(cid:304)(cid:389) होने की (cid:304)(cid:830)थति म(cid:336) उनकी सेवा बा(cid:744) सेवा कहलायगी तथा बा(cid:744) सेवा के लिए रा(cid:475) सरकार/के (cid:574) सरकार के (cid:366)ावधान लागू होंगे।

v. ै(cid:407)कण िर्यो(cid:438)ता एवं अनुभव- के (cid:574) सरकार/ रा(cid:475) सरकारों/ साव(cid:330)जनिक उप(cid:354)मों/ वि(cid:695)वि(cid:552)ालयों मा(cid:586)ता (cid:366)ा(cid:593) शोध सं(cid:830)थानों/ (cid:738)ाय(cid:517)या अ(cid:544)(cid:330) सरकारी या वैधानिक या निजी सं(cid:830)थानों के (cid:681)(cid:304)(cid:389)/सेवानिवृ(cid:517) (cid:681)(cid:304)(cid:389), जो नि(cid:635) अह(cid:517)ा(cid:330) रखते हों:-

(i) किसी मा(cid:586)ता (cid:366)ा(cid:593) वि(cid:695)वि(cid:552)ालय या सं(cid:830)थान से पया(cid:330)वरण से संबंधित वि(cid:466)ान म(cid:336) (cid:728)ातको(cid:517)र या पया(cid:330)वरण से संबंधित (cid:366)बंधन म(cid:336) इंजीनिय(cid:303)रं ग म(cid:336) (cid:728)ातक डि(cid:356)ी धा(cid:303)रत करता हो। पया(cid:330)वरण संर(cid:407)ण का (cid:681)ावहा(cid:303)रक अनुभव एवं विशेष (cid:466)ान रखता है, जिसम(cid:336) औ(cid:552)ोगिक (cid:366)दू षण शमन, जल उपचार या वायु (cid:366)दू षण नियं(cid:361)ण उपकरण शामिल ह(cid:339)।

(ii) पया(cid:330)वरण संर(cid:407)ण और (cid:366)दू षण नियं(cid:361)ण के (cid:407)े(cid:361) म(cid:336) कम से कम 10 साल के (cid:681)ावहा(cid:303)रक अनुभव के साथ के (cid:574) सरकार/रा(cid:475) सरकार/ साव(cid:330)जनिक (cid:407)े(cid:361) के उप(cid:354)म/ वि(cid:695)वि(cid:552)ालय/मा(cid:586)ता (cid:366)ा(cid:593) अनुसंधान सं(cid:830)थान/(cid:738)ाय(cid:517) या अ(cid:544)(cid:330) सरकारी या वैधानिक या निजी सं(cid:830)थानों म(cid:336) (cid:366)शासनिक या (cid:366)बंधन के (cid:721)र पर 10 साल का अनुभव एवं स(cid:593)म वेतनमान के अनु(cid:349)प Level-13A in the pay matrixया ष(cid:700)म वेतनमान (cid:349)0-37400- 67000, (cid:356)ेड पे-8900 के वेतनमान वाले पदों पर पांच वष(cid:344) की नियमित सेवा अथवा समक(cid:407)।

या,

अ(cid:304)खल भारतीय सेवाय(cid:336) के भारतीय (cid:366)शासनिक सेवा/भारतीय वन सेवा के पदाधिकारी जो रा(cid:475) सरकार म(cid:336) 'कम से कमʼ सचिव या उनके समक(cid:407) पद धारक या पद धा(cid:303)रत किये हो एवं समान काय(cid:330)(cid:407)े(cid:361)ों म(cid:336) (cid:366)शासनिक अनुभव रखते हों।4 झारख(cid:214)ड गजट (असाधारण) मंगलवार, 17 फ़रवर(cid:547), 2026

6. सद(cid:735) सकचव ेि (cid:349)प म(cid:336) कनयु(cid:304)(cid:389) ेि कलए कनयम और त(cid:338)-

i. वेतनमान-स(cid:593)म वेतनमान के अनु(cid:349)प Level-13A in the pay matrix.अ(cid:586) भ(cid:517)े (महँगाई भ(cid:517)ा, चिकि(cid:534)ा भ(cid:517)ा, या(cid:361)ा भ(cid:517)ा) एवं वाषि(cid:330)क वेतन वृ(cid:304)(cid:544) भारत सरकार/रा(cid:475) सरकार के (cid:366)ासंगिक नियमों के अनुसरण म(cid:336) संदे य होगा। वेतन का निधा(cid:330)रण रा(cid:475) सरकार के वि(cid:517) विभाग के एतद् संबंधी प(cid:361)/प(cid:303)रप(cid:361) आदि से आ(cid:453)ादित होगा।

ii. आयु सीमा- नियु(cid:304)(cid:389) के लिए आवेदन (cid:366)ा(cid:304)(cid:593) की अंतिम तिथि को अधिकतम आयु सीमा 60 वष(cid:330) होगी। iii. ािय(cid:330)ािल-सद(cid:735) सचिव, झारख(cid:503) रा(cid:475) (cid:366)दू षण नियं(cid:361)ण पष(cid:330)द का पूण(cid:330) काय(cid:330)काल 3 वष(cid:344) की एकल काया(cid:330)वधि का होगा, जिसका वि(cid:721)ार नहीं किया जायेगा।

iv. सेवा(cid:517)(cid:330):-

(क) पष(cid:330)द के सद(cid:735) सचिव के भ(cid:517)ा, योगदान का समय, वेतन, भवि(cid:712) निधि/National Pension Scheme/Employee Provident Fund Organization, उपदान, सेवानिवृति आयु, चिकि(cid:534)ा सुविधा एवं अ(cid:586) सेवाश(cid:517)(cid:333) रा(cid:475) सरकार/के (cid:574) सरकार के अधीन समान वेतनमान का पद धारण करने वाले पदाधिकारी के संबंध म(cid:336) लागू नियम एवं आदे श (cid:554)ारा विनियमित होगी।

(ख) रा(cid:475) सरकार एवं के (cid:574) सरकार म(cid:336) सेवारत अ(cid:631)थ(cid:334)/आवेदकों/पदाधिका(cid:303)रयों की सद(cid:735) सचिव, झारख(cid:503) रा(cid:475) (cid:366)दू षण नियं(cid:361)ण पष(cid:330)द के पद पर नियु(cid:304)(cid:389) होने की (cid:304)(cid:830)थति म(cid:336) उनकी सेवा बा(cid:744) सेवा कहलायगी तथा बा(cid:744) सेवा के लिए रा(cid:475) सरकार/के (cid:574) सरकार के (cid:366)ावधान लागू होंगे।

v. ै(cid:407)कण िर्यो(cid:438)ता एवं अनुभव- के (cid:574) सरकार/रा(cid:475) सरकारों/ साव(cid:330)जनिक उप(cid:354)मों/ वि(cid:695)वि(cid:552)ालयों/मा(cid:586)ता (cid:366)ा(cid:593) शोध सं(cid:830)थानों/(cid:738)ाय(cid:517)या अ(cid:544)(cid:330) सरकारी या वैधानिक या निजी सं(cid:830)थानों के (cid:681)(cid:304)(cid:389), जो नि(cid:635) अह(cid:517)ा(cid:330) रखते हों:-

(i) पया(cid:330)वरण से संबंधित विषय पर अभियं(cid:361)ण/(cid:366)ौ(cid:552)ोगिकी म(cid:336) (cid:728)ातक अथवा किसी मा(cid:586)ता (cid:366)ा(cid:593) वि(cid:695)वि(cid:552)ालय या सं(cid:830)थान से वि(cid:466)ान म(cid:336) (cid:728)ातको(cid:517)र। पया(cid:330)वरण संर(cid:407)ण एवं (cid:366)दू षण नियं(cid:361)ण (cid:366)बंधन के (cid:407)े(cid:361) म(cid:336) स(cid:407)म, यो(cid:438), वांछनीय (cid:466)ान एवं (cid:681)ावहा(cid:303)रक अनुभव।

(ii) पया(cid:330)वरण संर(cid:407)ण और (cid:366)दू षण नियं(cid:361)ण के (cid:407)े(cid:361) म(cid:336) कम से कम 10 साल के (cid:681)ावहा(cid:303)रक अनुभव के साथ के (cid:574) सरकार/रा(cid:475) सरकार/साव(cid:330)जनिक (cid:407)े(cid:361) के उप(cid:354)म/ वि(cid:695)वि(cid:552)ालय/मा(cid:586)ता (cid:366)ा(cid:593) अनुसंधान सं(cid:830)थान/(cid:738)ाय(cid:517) या अ(cid:544)(cid:330) सरकारी या वैधानिक या निजी सं(cid:830)थानों म(cid:336) (cid:366)शासनिक या (cid:366)बंधन का अनुभव एवं स(cid:593)म वेतनमान के अनु(cid:349)प Level-12 in the Pay Matrix या ष(cid:700)म वेतनमान (cid:349)0 15,600-39,100 (cid:356)ेड पे-7600 के वेतनमान वाले पदों पर पांच वष(cid:344) की नियमित सेवा अथवा समक(cid:407)।

या,

अ(cid:304)खल भारतीय सेवाय(cid:336) के भारतीय (cid:366)शासनिक सेवा/भारतीय वन सेवा के पदाधिकारी जो रा(cid:475) सरकार म(cid:336) विशेष सचिव या उनके समक(cid:407) पद धारक या पद धा(cid:303)रत किये हो एवं के (cid:574)ीय सरकार/रा(cid:475) सरकार/लोक उप(cid:354)मों के सं(cid:830)थानों या विभागों म(cid:336) पया(cid:330)वरण संर(cid:407)ण एवं (cid:366)दू षण नियं(cid:361)ण (cid:366)बंधन का (cid:466)ान एवं अनुभव।5 झारख(cid:214)ड गजट (असाधारण) मंगलवार, 17 फ़रवर(cid:547), 2026

7. कनयु(cid:304)(cid:389) ीि (cid:366)क(cid:354)या-

(क) झारख(cid:503) रा(cid:475) (cid:366)दू षण नियं(cid:361)ण पष(cid:330)द् के अ(cid:559)(cid:407)/सद(cid:735) सचिव की नियु(cid:304)(cid:389) Search-cum-Selection Committee की अनुशंसाओं के आधार पर की जायेगी जिसकी संरचना नि(cid:635)वत् होगी-

(ख) (cid:303)र(cid:304)(cid:389) के वि(cid:349)(cid:544) Search-cum-Selection Committeeसद(cid:735) सचिव/अ(cid:559)(cid:407) के चयन की (cid:366)(िcid:354)या तीन माह के भीतर पूण(cid:330) करेगी।

(ग) (cid:366)तिनियु(cid:304)(cid:389)/संविदा/सीधी भत(cid:334) के मामले म(cid:336) वि(cid:466)ापन के आधार पर (cid:366)ा(cid:593) आवेदनों की जाँच Search-cum- Selection Committee (cid:554)ारा की जाएगी एवं (cid:303)र(cid:389) पदो के लिए नामों के पैनल की अनुशंसा करे गी। रा(cid:475) सरकार चयन समिति के अनुशंसित पैनल से अ(cid:559)(cid:407)/सद(cid:735) सचिव की नियु(cid:304)(cid:389) करे गी।

(घ) किसी (cid:681)(cid:304)(cid:389) को अ(cid:559)(cid:407)/सद(cid:735) सचिव के (cid:349)प म(cid:336) नियु(cid:389) करने की अनुशंसा करने से पूव(cid:330),Search-cum- Selection Committee आ(cid:695)(cid:721) हो लेगी कि ऐसे (cid:681)(cid:304)(cid:389) का कोई ऐसा आथि(cid:330)क या अ(cid:586) हित न हो, जो अ(cid:559)(cid:407)/सद(cid:735) सचिव के (cid:349)प म(cid:336) अपने क(cid:517)(cid:330)(cid:681)ों को पूवा(cid:330)(cid:356)ह से (cid:366)े(cid:303)रत होकर (cid:366)भावित कर सकता है। (अ(cid:631)थ(cid:334) की (cid:738)-घोषणा)

(ड़) चयन समिति (cid:554)ारा की गई नामों की अनुशंसा म(cid:336) से अ(cid:559)(cid:407)/सद(cid:735) सचिव के पद पर नियु(cid:304)(cid:389), नियु(cid:304)(cid:389) (cid:366)ाधिकार के अनुमोदन के प(cid:686)ात् की जायेगी।

(च) अ(cid:559)(cid:407) पूण(cid:330)कालिक (Full-time) या अंशकालिक (Part-time) दोनों म(cid:336) से कोई भी हो सकता है, जैसा कि रा(cid:475) सरकार उपयु(cid:389) समझे। सद(cid:735) सचिव पूण(cid:330)कालिक होंगे।

(छ) अंशकालिक अ(cid:559)(cid:407)/सद(cid:735) सचिव के मामले म(cid:336), विभाग यो(cid:438) अ(cid:631)थ(cid:334) का नाम माननीय मु(cid:421)मं(cid:361)ी को (cid:366)(cid:721)ावित कर सकता है, जो नियमित पूण(cid:330)कालिक अ(cid:559)(cid:407)/सद(cid:735) सचिव की नियु(cid:304)(cid:389) होने तक अधिकतम एक वष(cid:330) की अवधि के लिए अंशकालिक अ(cid:559)(cid:407)/सद(cid:735) सचिव नामित कर(cid:336) गे।

File No-3/Env.Poll.(Misc.)-22/2007 (Shadow File-B)-100 VaPa, --The Jharkhand State Pollution Control Board has been constituted under Section 4 (1) to implement the provisions made for the prevention and control of pollution under the Water (Prevention and Control of Pollution) Act 1974. Whereas an order has been passed by the Hon'ble Supreme Court, New Delhi on 22.09.2017 in Civil Appeal No.-1359/2017 against the order passed on 24.08.2016 by Hon'ble NGT, New Delhi in the matter of O.A. No.- 318/2013 Rajendra Singh Bhandari Versus State of Uttarakhand and ors. and directed to notify the appropriate guidelines for the appointment to the post of Chairman. In compliance of the said order, Jharkhand State Pollution Control Board Chairman Appointment and Service Rules, 2021 was notified, vide Notification No.-2230 dated- 05.08.2021 and Jharkhand State Pollution Control Board Member Secretary Appointment and Service Rules, 2021 was notified, vide Notification No.-2231 dated-05.08.2021

In compliance to the order of the Hon'ble Supreme Court, New Delhi, the terms of service contained in both notifications seem to be necessary to be revised and compiled in one single notification after due consideration in the present context.

Whereas in exercise of the powers conferred by the proviso to Article-309 of the Constitution of India and under the provisions contained in Section 64, Sub-Section-2 Clause - "e" of the Water (Prevention and Control of Pollution) Act (6th of 1974), the appointment of the Chairman and Member Secretary of the Jharkhand State Pollution Control Board and Service Rules, 2026 is constituted by the State Government: -

PART-I

1. Short Name and Commencement: -

(i) These rules will be called Jharkhand State Pollution Control Board Chairman and Member Secretary Appointment and Service Rules, 2026.

(ii) These notifications will come into effect from the date of issue.

2. Definitions :-

In these rules, unless the context otherwise requires,-

(a) "Act" means the Water (Prevention and Control of Pollution) Act, 1974 (6 of 1974);

(b) "Department" means the Department of Forest, Environment and Climate Change.

Jharkhand;

(c) " Board" means the Jharkhand State Pollution Control Board;

(d) "Appointing Authority" means the Government of Jharkhand;

(e) "Chairman" means the Chairman of Jharkhand State Pollution Control Board;

(f) "Member Secretary" means the Member Secretary of Jharkhand State Pollution Control Board;

3. Number of posts –

(a) Chairman, Jharkhand State Pollution Control Board-01 (one)

(b) Member Secretary, Jharkhand State Pollution Control Board-01 (one)

4. Method of appointment - Deputation/on contract/direct recruitment.

PART-II

5. Terms and Conditions for the post of Chairman-

i. Pay Scale- According to the Seventh Pay Commission Pay Scale Level-15 in the pay matrix. Other allowances (dearness allowance, medical allowance, travel allowance) and annual increment will be payable in accordance with relevant rules of Government of India / State Government. The determination of salary will be covered by the related letter / circular etc. of the Finance Department of the State Government.

ii. Age Limit- Maximum age limit will be 62 years on the last date of receipt of application.

iii. Tenure - The full term of the Chairman, Jharkhand State Pollution Control Board will be a single term of 3 years, which will not be extended.

iv. Service rule: -

(A) Allowance of the Chairman of the Board, time of joining, salary, provident fund/ National Pension Scheme/Employee Provident Fund, gratuity, retirement age, medical facility and other services shall be regulated with the applicable rules and orders as holding the post of equal pay scale of the officer of State Government/ Central Government.

(B) In case of those candidates currently working in State Government / Central Government, on appointment to the post of Chairman, Jharkhand State Pollution Control Board, the service will be called Foreign Services and the provisions of State Government / Central Government for Foreign Service will be applicable.

v. Educational qualification and experience- Persons from Central Government/State Governments/Public Sector Undertakings/Universities/Recognized Research Institutes /Autonomous or Semi-Governmental or Statutory or Private Institutions or Retired person having qualification mentioned below can apply.

(i) Bachelor's Degree in Engineering/Technology discipline relating to Environment or Master's Degree in Science preferably relating to Environment from a recognized University or Institute. Having special knowledge and practical experience relating to the environmental protection, including industrial pollution mitigation, water treatment or air pollution control devices.

(ii) A minimum of 10 years of practical experience in the field of environmental protection

and pollution control, along with 10 years of administrative or managerial experience

in the Central Government/ State Government/ Public Sector Undertakings/

Universities/ recognized research institutions/ autonomous, semi-government,

statutory or private institutions.Additionally, at least five years of regular service in a

post corresponding to Level-13 of the Seventh Pay Commission or in a post with the

pay scale of ₹37,400–67,000 with Grade Pay ₹8,900 under the Sixth Pay Commission,

or an equivalent position.

Or

Officers of the All India Services belonging to the Indian Administrative Service (IAS) or the Indian Forest Service (IFS), who are holding or have held the post of Secretary or an equivalent position in the State Government, and possess administrative experience in similar areas.

PART-III

6. Terms and Conditions for the post of Member Secretary-

i. Pay Scale-According to the Seventh Pay Commission Pay Scale Level-13A in the pay matrix. Other allowances (dearness allowance, medical allowance, travel allowance) and annual increment will be payable in accordance with relevant rules of Government of India/State Government.The determination of salary will be covered by the related letter/circular etc. of the Finance Department of the State Government.

ii. Age Limit- Maximum age limit will be 60 years on the last date of receipt of application.

iii. Tenure- The full term of the Member Secretary, Jharkhand State Pollution Control Board will be a single term of 3 years, which will be not extended.

iv. Service Rule: -

(A) Allowance of the Member Secretary of the Board, time of joining, salary, provident fund/ National Pension Scheme/Employee Provident Fund, gratuity, retirement age, medical facility and other services shall be regulated with the applicable rules and ordersas the holding the post of equal pay scale of the officer of State Government/ Central Government. (B) In case of those candidates currently working in State Government / Central Government, on appointment to the post of Member Secretary, Jharkhand State Pollution Control Board, the service will be called External Services and the provisions of State Government / Central Government for external service will be applicable.

v. Educational qualification and experience- Persons from Central Government/State Governments/Public Sector Undertakings/Universities/Recognized Research Institutes/Autonomous or Semi-Governmental or Statutory or Private Institutions having the qualification mentioned below can apply.

(i) Bachelor's Degree in Engineering/Technology discipline relating to Environment or Master's Degree in Science preferably relating to Environment from a recognized University or Institute.Competent, qualified, desirable knowledge in the field of environmental protection and pollution control management and having practical experience.

(ii) A minimum of 10 years of practical experience in the field of environmental protection and pollution control, along with administrative or managerial experience in the Central Government/ State Government/ Public Sector Undertakings/ Universities/ recognized research institutions/ autonomous, semi-government, statutory or private institutions.

In addition, at least five years of regular service in a post corresponding to Level-12 of the Seventh Pay Commission or in a post with the pay scale of ₹15,600–39,100 with Grade Pay ₹7,600 under the Sixth Pay Commission, or an equivalent position.

Or

Officers of the All India Services belonging to the Indian Administrative Service (IAS) or the Indian Forest Service (IFS), who are holding or have held the post of Special Secretary or an equivalent position in the State Government, and possesses knowledge and experience in environmental protection and pollution control management in the institutions or Departments of the Central Government/ State Government/ Public Sector Undertakings.

PART IV

7. Appointment Process: -

(A) The appointment of the Chairman/Member Secretary of the Jharkhand State Pollution Control Board shall be made by the appointing authority on the recommendations of the Search-cum-Selection Committee, the composition of which shall be as follows-

(B) The Search-cum-selection committee will complete the process of selection of the Chairman/Member Secretary within three months against the vacancy.

(C) In case of deputation/on contract/direct recruitment, on the basis of advertisement, received applications will be scrutinized by the Search-cum-selection committee and the State Government will appoint the Chairman/Member Secretary from the recommended panel of the Selection Committee.

(D) Before recommending a person to be appointed as the Chairman/Member Secretary the Selection Committee shall be assured that such person does not have any economic or other interest which may be prejudicially influenced by his duties as Chairman/Member Secretary (self-declaration of the candidate)

(E) The appointment of the Chairman/Member Secretary from the names recommended by the Selection Committee will be done after the approval of the Appointing Authority.

(F) The Chairman may be either full-time or part-time as the State Government may think fit.

The Member Secretary will be full-time.

(G) In case of part time Chairman/Member Secretary, the Department may suggest eligible candidate to the Hon'ble Chief Minister who shall nominate the part–time Chairman/Member Secretary till the regular appointment of full-time Chairman/Member Secretary is completed for a maximum period of one year.

8. Removal: - The Chairman/Member Secretary, Jharkhand State Pollution Control Board can be removed after giving two months notice by the State Government before the completion of the term under the provision of Sub-Section 3 of Section 5 of the Water (Prevention and Control of Pollution,) Act 1974.

9. Other: - Submission of Property Return and Annual Confidential Report is necessary for the Chairman/Member Secretary, Jharkhand State Pollution Control Board.

If, for any reason, regular appointment against a permanent post cannot be made or the post falls vacant then in such a situation, under an interim arrangement, Officers of the All India Services belonging to the Indian Administrative Service (IAS) or the Indian Forest Service (IFS)possessing the required eligibility for the said posts may be authorized by the competent authority (the State Government).

11. Power to relax – Where the State Government is of opinion that it is necessary or expedient so to do, it may, by order, for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons.

12. The State Government shall be able to amend the recruitment rule as per necessity and in case of any difficulty arising in the implementation of the rules.

13. Jharkhand State Pollution Control Board Chairman Appointment and Service Rules, 2021 vide Notification No.-2230 dated-05.08.2021 and Jharkhand State Pollution Control Board Chairman Appointment and Service Rules(Amendment), 2024 vide Notification No.-1005 dated-16.03.2024 and Jharkhand State Pollution Control Board Member Secretary Appointment and Service Rules, 2021 was notified, vide Notification No.-2231 dated- 05.08.2021 is abrogated.
