(4041)4042 ರಾಜ್ಯಪತ್ರದಲ್ಲಿ ಇದರ ಪ್ರಕಟಣೆಯ ದಿನಾಂಕದಿಂದ 15 ದಿನಗಳೊಳಗಾಗಿ ಅದರಿಂದ ಬಾಧಿತರಾಗುವ ಸಂಭವವಿರುವ ಎಲ್ಲ ವ್ಯಕ್ತಿಗಳಿಂದ ಆಕ್ಷೇಪಣೆಗಳನ್ನು ಮತ್ತು ಸಲಹೆಗಳನ್ನು ಆಹ್ವಾನಿಸಿ ದಿನಾಂಕ: 07.07.2012ರ ಕರ್ನಾಟಕ ರಾಜ್ಯಪತ್ರದ ಭಾಗ-iv ಎ (ಸಂ: 462)ರಲ್ಲಿ ಕರ್ನಾಟಕ ರಾಜ್ಯ ಸಿವಿಲ್ ಸೇವೆಗಳ ಅಧಿನಿಯಮ, 1978 (1990ರ ಕರ್ನಾಟಕ ಅಧಿನಿಯಮ 14)ರ 3ನೇ ಪ್ರಕರಣದ (2) ನೇ ಉಪ ಪ್ರಕರಣದ (ಎ) ಖಂಡದ ಮೂಲಕ ಅಗತ್ಯಪಡಿಸಲಾದಂತೆ ಪ್ರಕಟಿಸಲಾಗಿರುವುದರಿಂದ;

ಸದರಿ ರಾಜ್ಯಪತ್ರವನ್ನು 07.07.2012 ರಂದು ಸಾರ್ವಜನಿಕರಿಗೆ ಲಭ್ಯವಾಗುವಂತೆ ಮಾಡಿರುವುದರಿಂದ;

ಮತ್ತು, ಸದರಿ ಕರಡಿನ ಬಗ್ಗೆ ಯಾವುದೇ ಆಕ್ಷೇಪಣೆ/ಸಲಹೆಗಳು ಸ್ವೀಕೃತವಾಗದಿರುವುದರಿಂದ;

ಈಗ ಕರ್ನಾಟಕ ರಾಜ್ಯ ಸಿವಿಲ್ ಸೇವೆಗಳ ಅಧಿನಿಯಮ, 1978 (1990ರ ಕರ್ನಾಟಕ ಅಧಿನಿಯಮ, 14)ರ 8ನೇ ಪ್ರಕರಣದೊಂದಿಗೆ ಓದಿಕೊಂಡ 3ನೇ ಪ್ರಕರಣದ (1)ನೇ ಉಪ ಪ್ರಕರಣದ ಮೂಲಕ ಪ್ರದತ್ತವಾದ ಅಧಿಕಾರಗಳನ್ನು ಚಲಾಯಿಸಿ, ಕರ್ನಾಟಕ ಸರ್ಕಾರವು ಈ ಮೂಲಕ ಈ ಕೆಳಕಂಡ ನಿಯಮಗಳನ್ನು ರಚಿಸುತ್ತದೆ, ಎಂದರೆ:-

ನಿಯಮಗಳು

1. ಶೀರ್ಷಿಕೆ ಮತ್ತು ಪ್ರಾರಂಭ:- (1) ಈ ನಿಯಮಗಳನ್ನು ಕರ್ನಾಟಕ ಸಿವಿಲ್ ಸೇವಾ (ಕಂಪ್ಯೂಟರ್ ಸಾಕ್ಷರತಾ ಪರೀಕ್ಷೆ) (ತಿದ್ದುಪಡಿ) ನಿಯಮಗಳು, 2012 ಎಂದು ಕರೆಯತಕ್ಕದ್ದು.

(2) ಈ ನಿಯಮಗಳು ದಿನಾಂಕ: 22.03.2012 ರಿಂದ (ಮುಖ್ಯ ನಿಯಮಗಳು ಜಾರಿಗೆ ಬಂದ ದಿನಾಂಕ) ಜಾರಿಗೆ ಬಂದಿವೆೆಯೆಂದು ಭಾವಿಸತಕ್ಕದ್ದು.

2. ನಿಯಮ 2ಕ್ಕೆ ತಿದ್ದುಪಡಿ:- ಕರ್ನಾಟಕ ಸಿವಿಲ್ ಸೇವಾ (ಕಂಪ್ಯೂಟರ್ ಸಾಕ್ಷರತಾ ಪರೀಕ್ಷೆ) ನಿಯಮಗಳು, 2012ರ ನಿಯಮ 2ರ ಬದಲು ಈ ಕೆಳಕಂಡದ್ದನ್ನು ಪ್ರತಿಸ್ಥಾಪಿಸತಕ್ಕದ್ದು, ಅಂದರೆ:-

"(2) ನೇರ ನೇಮಕಾತಿಯಾದ ಅಭ್ಯರ್ಥಿಗಳಿಗೆ ಅನ್ವಯಿಸುವಿಕೆ.-

ಕರ್ನಾಟಕ ಸಿವಿಲ್ ಸೇವಾ( ಸಾಮಾನ್ಯ ನೇಮಕಾತಿ) ನಿಯಮಗಳು, 1977 ಅಥವಾ ವಿಶೇಷವಾಗಿ ರಚಿಸಲಾದ ನೇಮಕಾತಿ ನಿಯಮಗಳು ಅಥವಾ ಕರ್ನಾಟಕ ರಾಜ್ಯ ಸಿವಿಲ್ ಸೇವಾ ಅಧಿನಿಯಮ, 1978 (1990ರ ಕರ್ನಾಟಕ ಅಧಿನಿಯಮ 14) ರಡಿಯಲ್ಲಿ ಯಾವುದೇ ಸೇವೆ ಅಥವಾ ಹುದ್ದೆಗೆ ಸಂಬಂಧಿಸಿದಂತೆ ರಚಿಸಲಾದ ನಿಯಮಗಳಲ್ಲಿ ಏನೇ ಒಳಗೊಂಡಿದ್ದರೂ, ಈ ನಿಯಮಗಳ ನಿಯಮ 1ರ ಉಪನಿಯಮ (3)ರಲ್ಲಿ ನಿರ್ದಿಷ್ಟಪಡಿಸಲಾಗಿರುವ ಹುದ್ದೆಗಳನ್ನು ಹೊರತುಪಡಿಸಿ, ರಾಜ್ಯ ಸಿವಿಲ್ ಸೇವೆಗಳಲ್ಲಿನ ಯಾವುದೇ ಹುದ್ದೆಗೆ ನೇರ ನೇಮಕಾತಿಯ ಮುಖಾಂತರ ನೇಮಕಾತಿ ಹೊಂದಿದ ನೌಕರನು/ಳು ಸರ್ಕಾರ ನಿಗದಿಪಡಿಸಬಹುದಾದ ಕಂಪ್ಯೂಟರ್ ಸಾಕ್ಷರತಾ ಪರೀಕ್ಷೆಯನ್ನು ಅವರ ಪರಿವೀಕ್ಷಣಾವಧಿಯಲ್ಲಿ ಪಾಸು ಮಾಡತಕ್ಕದ್ದು ಮತ್ತು ಆ ಪರೀಕ್ಷೆಯನ್ನು ಪಾಸು ಮಾಡದ ಹೊರತು ಅವರ ಪರಿವೀಕ್ಷಣಾವಧಿಯನ್ನು ಘೋಷಿಸತಕ್ಕದ್ದಲ್ಲ. ಈ ಪರೀಕ್ಷೆಯನ್ನು ಸರ್ಕಾರವು ಅಥವಾ ಸರ್ಕಾರದಿಂದ ಅನುಮೋದಿಸಲ್ಪಟ್ಟ ಸಂಸ್ಥೆಯು ನಡೆಸತಕ್ಕದ್ದು."

NOTIFICATION

No. DPAR 59 SCR 2012, Bangalore, Dated: 06.08.2012

Whereas the draft of the following rules further to amend the Karnataka Civil Services (Computer Literacy Test) Rules, 2012, was published as required by clause (a), sub-section (2) of section 3 of the Karnataka State Civil Services Act, 1978 (Karnataka Act 14 of 1990) in Notification No. DPAR 59 SCR 2012 dated 07.07.2012 in part IV A of the Karnataka Gazette dated 07.07.2012 inviting objections and suggestions from all persons likely to be affected thereby within fifteen days from the date of its publication in the Official Gazette.

Whereas, the said Gazette was made available to the public on 07.07.2012.

And Whereas, no objections and suggestions have been received in this behalf by the State Government. Now, therefore, in exercise of the powers conferred by sub-section (1) of section 3 read with section 8 of the Karnataka State Civil Services Act, 1978 (Karnataka Act 14 of 1990) the Government of Karnataka hereby makes the following rules, namely:-

RULES

1. Title and commencement:- (1) These rules may be called the Karnataka Civil Service (Computer Literacy Test) (Amendment) Rules, 2012.

(2) They shall be deemed to have come into force with effect from 22.03.2012(the date on which the main rules have come into effect).

2. Amendment of rule 2:- In the Karnataka Civil Service (Computer Literacy Test) Rules, 2012, for rule 2, the following shall be substituted, namely:-

"2. Applicability in respect of Direct Recruitees.- Notwithstanding anything contained in the Karnataka Civil Services (General Recruitment) Rules, 1977 or the rules of recruitment specially made or deemed to have been made under the Karnataka State Civil Services Act, 1978 (Karnataka Act 14 of 1990) in respect of any service or post, person appointed to any post by direct recruitment in any of the State Civil Services, except the posts specified in sub-rule(3) of rule 1, shall pass the Computer Literacy Test, as may be prescribed by the Government within the period of their probation and the period of probation shall not be declared until he or she passes the said test. The test shall be conducted by the Government or the agency approved by the Government.''

ದಿ ಕರ್ನಾಟಕ ಪೊಲೀಸ್ (ಅಮೆಂಡ್‌ಮೆಂಟ್) ಬಿಲ್, 2012ಕ್ಕೆ ಆಗಸ್ಟ್ ಎಂಟನೇ ದಿನಾಂಕದಂದು ರಾಜ್ಯಪಾಲರ ಒಪ್ಪಿಗೆ ದೊರೆತಿದ್ದು, ಸಾಮಾನ್ಯ ತಿಳುವಳಿಕೆಗಾಗಿ ಇದನ್ನು 2012ರ ಕರ್ನಾಟಕ ಅದಿನಿಯಮ ಸಂಖ್ಯೆ: 30 ಎಂಬುದಾಗಿ ಕರ್ನಾಟಕ ರಾಜ್ಯ ಪತ್ರದಲ್ಲಿ ಪ್ರಕಟಿಸಬೇಕೆಂದು ಆದೇಶಿಸಲಾಗಿದೆ.

KARNATAKA ACT NO 30 OF 2012

(First Published in the Karnataka Gazette Extra-ordinary on the Ninth day of August, 2012) THE KARNATAKA POLICE (AMENDMENT) ACT, 2012

(Received the assent of the Governor on the Eighth day of August, 2012)

An Act further to amend the Karnataka Police Act, 1963.

Whereas it is expedient further to amend the Karnataka Police Act, 1963 (Karnataka Act No. 4 of 1964) for the purposes hereinafter appearing;

Be it enacted by the Karnataka State Legislature in the sixty-third year of the Republic of India, as follows:-

1. Short title and commencement.- (1) This Act may be called the Karnataka Police (Amendment) Act, 2012.

(2) It shall be deemed to have come into force with effect from the 2nd day of June, 2012.

2. Substitution of section 6.- In the Karnataka Police Act, 1963 (Karnataka Act 4 of 1964) (hereinafter referred to as the principal Act), for section 6, the following shall be substituted, namely:-

"6. Director General and Inspector General of Police.- (1) For the direction, control and supervision of the Police service, the Government shall appoint a Director General and Inspector General of Police, who shall subject to the control of the Government, exercise such powers and perform such functions and duties and shall have such responsibilities and such authority as may be provided by or under this Act.

(2) The Director General and Inspector General of Police shall be selected by the State Government from amongst officers of the Indian Police Service in the rank of Director General of Police who have been empanelled for promotion to that rank on the basis of their length of service, very good history of service, professional knowledge and ability to lead Police Force in the State.

(3) The Director General and Inspector General of Police so appointed shall have a tenure of not less than two years subject to superannuation:

Provided that the Government may transfer the Director General and Inspector General of Police before completion of two years of his tenure, if he is,–

(a) convicted by a court of law in a criminal case or where charges have been framed against him by a court in a case involving corruption or offences which amounts to moral turpitude; or

(b) incapacitation by physical or mental illness or otherwise becoming unable to discharge his functions as the Director General and Inspector General of police; or

(c) appointed to another post with his consent; or

(d) imposed punishment of dismissal, removal, or compulsory retirement from service or of reduction to a lower post, awarded under the provisions of the All India Services (Discipline and Appeal) Rules, 1969 or any other relevant rule; or

(e) under suspension from service; or

(f) when a prima-facie case of misconduct or gross negligence is established after a preliminary enquiry.

(4) The Government, may by notification, delegate such powers or give such directions as it deems necessary to the Director General and Inspector General of Police who shall exercise the powers and discharge the functions so entrusted to him by or under this Act."

3. Insertion of new chapter IIA.- In the principal Act, after Chapter II and entries relating thereto, the following new chapter shall be inserted, namely:-

"CHAPTER IIA

ESTABLISHMENT OF STATE SECURITY COMMISSION, POLICE ESTABLISHMENT BOARD,

STATE POLICE COMPLAINT AUTHORITY AND DISTRICT POLICE COMPLAINT AUTHORITY

20A. The State Security Commission.- (1) The State Government may, by notification in the official Gazette, establish a Commission to be called the State Security Commission for the purpose of exercising such functions and discharging such duties as may be assigned to the Commission, by or under this Act.

(2) The State Security Commission shall consist of the following members, namely:-

(a) The Chief Minister

- Chairman

(b) The Home Minister

- Vice Chairman

(c) Leader of the Opposition in the Legislative Assembly - Member

(d) A Retired judge of the High Court nominated by the

Chief justice of Karnataka

- Member

(e) Chief Secretary to Government

- Member

(f) Additional Chief Secretary/ Principal Secretary, in charge of

Home Department

- Member

(g) Director General of Police

- Member Secretary and Inspector General of Police

(3) The terms and conditions of appointment and allowance payable thereof to the retired judge shall be such as may be prescribed.

(4) The functions of the Commission shall include,-

(a) laying down the broad policy guidelines for ensuring that the State Police always acts according to the laws of the land and the constitution of India;

(b) laying down the broad principles and giving directions for the performance of the preventive tasks and service oriented functions of the police;

(c) evaluation of the performance of the State Police and submission of report thereon to the Government for placing before the State Legislature; and

(d) any other functions as may be prescribed.

(5) The recommendations of the Commission shall be binding on the Government.

20B. Police Establishment Board.- (1) The State Government shall, by notification in the official Gazette, establish a Police Establishment Board with the Director General and Inspector General of Police as Chairman and three senior most police officers not below the rank of Additional Director General of Police working within the police department as members. Additional Director General of Police (Administration) shall be the convener.

(2) The functions of the Police Establishment Board shall be as follows, namely:-

(a) Subject to the provisions of section 20F, it shall decide on transfers, postings, promotions and other service related matters of officers of and below the rank of Deputy Superintendent of Police.

(b) It shall also make recommendation for promotion to the rank of Deputy Superintendents of Police after duly verifying reservation and quota prescribed for direct recruitment and promotion. For this purpose a separate register shall be maintained by Director General and Inspector General of Police, as per orders or guidelines prescribed by Government from time to time.

(c) It shall make appropriate recommendations to the Government regarding postings and transfers of officers of and above the rank of Additional Superintendent of Police.

(d) Generally review the functioning of the police force in the State.

(e) Perform such other functions as may be prescribed.

(3) Subject to its control and directions, the Police Establishment Board may authorize the Superintendent of Police to effect transfers of Group C and D officials within the district and the Inspector General of Police within the Range.

(4) The Government may modify the decision of the Police Establishment Board in exceptional cases only after recording its reasons for doing so. The Government shall give due weightage and shall normally accept the recommendations made by the Board, regarding postings and transfers of officers of and above the rank of Additional Superintendent of Police.

(5) The transfers decided and effected by the Police establishment Board shall be strictly in accordance with section 20F and the general transfer guidelines issued by Government from time to time.

(6) The cases pertaining to transfer of Police officers or personnel on complaints shall be considered by the Police Establishment Board and action taken in this regard shall be reported to Government.

(7) Copies of proceedings of the Police Establishment Board and the transfer orders issued thereon shall be sent to Government forthwith.

20C. State Police Complaints Authority.- (1) The State Government shall, by notification in the official Gazette, constitute the State Police Complaints Authority consisting of five persons, namely:-

(i) One shall be the Chairman selected from among the panel of three retired High Court Judges recommended by the Chief Justice of High Court of Karnataka.

(ii) one member shall be from among the retired Civil Service who shall be an officer not below the rank of Principal Secretary to Government;

(iii) one member shall be from Civil Society. The Civil Society member shall be chosen by the State Government from amongst the panel of three names recommended by the Search Committee consisting of three persons nominated by the State Government one each representing the Human Rights Commission, the Karnataka Public Service Commission and the Lokayukta. The State Government shall appoint one of the members as the Chairman of the Search Committee and an officer not below the rank of Deputy Secretary to Government, Home Department as the convener of the Search Committee. The persons in the panel shall be a person of repute who has rendered humanitarian service in the field of education, health, upliftment of the poor etc. and had not aligned himself with any political party or ideological group;

(iv) one women IPS Officer of not below the rank of Deputy Inspector General of Police; and

(v) the Additional General of Police (Grievance) nominated by the State Government as the Ex-officio member and member Secretary of the Authority.

(2) A person shall be disqualified for being appointed as member, if he,–

(a) has directly or indirectly associated himself with any Anti Social or Anti National group or body;

(b) has been convicted and sentenced to imprisonment for an offence which, in the opinion of the State Government, involves moral turpitude; or

(c) is an undischarged insolvent; or

(d) is of unsound mind and stands so declared by a competent court;

(e) has such other disqualifications as may be prescribed.

(3) Every non-official member of the State Police Complaints Authority shall hold office for a period of three years.

(4) The salary or honorarium and other allowances payable to, and the other terms and conditions of service of the non-official members of the State Police Complaints Authority shall be such as may be prescribed.

(5) The Government shall provide such number of staff as is necessary for assisting the functions of the State Police Complaints Authority.

(6) The State Police Complaints Authority shall look into complaints against officers of the rank of Superintendent of Police and above, including Additional Superintendent of Police, and take cognizance of allegations4047 of serious misconduct by the police officers which would include incidents involving death, grievous hurt or rape in police custody.

(7) The State Police Complaints Authority shall inquire into allegations of serious misconduct against police officers, after providing an opportunity of being heard to the alleged police officer either suo moto or on a complaint received from any of the following, namely:-

(a) a victim or any person on his behalf; or

(b) the National or the State Human Rights Commission; or

(c) the police; or

(d) any other source.

Explanation.- (1) "Serious misconduct" for the purpose of this Chapter, shall mean any act or omission of a police officer that leads to or amounts to,-

(a) death in police custody; or

(b) grievous hurt, as defined in section 320 of the Indian Penal Code, 1860 ; or

(c) rape or attempt to commit rape; or

(d) arrest or detention without due process of law.

(2) "Misconduct" in this context, shall mean any willful breach or neglect by a police officer of any law, rule, regulation applicable to the police that adversely affects the rights of any member of the public, excluding "serious misconduct" as defined in explanation (1).

(8) In the cases suo moto inquired by the State police Complaints Authority, it may, issue notice to Director General and Inspector General of Police and direct him to file his views on the complaint during the enquiry. The State Police Complaints Authority may take into account the views and facts furnished by the Director General and Inspector General of Police that may have a material bearing on the cases:

Provided that the State Police Complaints Authority shall not have jurisdiction on the complaint against police officer where a separate authority is created by any other Act for this purpose.

(9) On completion of the enquiry, if the allegations are proved partly or fully, the State Police Complaints Authority shall forward its report to the disciplinary authority for appropriate action against the accused officers.

(10) The State Police Complaints Authority shall also supervise, monitor and control the functioning of District Police Complaints Authorities. It shall compile Annual Report of the functioning of State Police Complaints Authority and District Police Complaints Authorities and submit to the Government. The annual report shall contain,- (a) the numbers and types of cases of "serious misconduct" and "misconduct" considered by the State Police Complaints Authority during the year;

(b) the number and types of cases of "serious misconduct" referred to it by the complainants upon being dissatisfied by the departmental inquiry into his complaint ;

(c) the number and types of cases referred to above in which advice or direction was issued by it to the police for further action;

(d) such other related Administrative and financial matters as may be prescribed.

20D. District Police Complaints Authority.- (1) The Government shall in consultation with State Police Complaints Authority, by notification in the official Gazette, constitute the District Police Complaints Authority under the chairmanship of the Regional Commissioner of the Region and three other members, namely:-

(i) one member of retired Civil Service shall be an officer not below the rank of Joint Secretary to Government;

(ii) one member shall be from the Civil Society. The Civil Society member shall be chosen by the State Government from amongst the panel of three names recommended by the Search Committee consisting of three persons one each representing the Human Rights Commission, Karnataka Public Service Commission and the Lokayukta. The State Government shall appoint one of the members as Chairman of the Search Committee and an officer not below the rank of Deputy Secretary to Government, Home Department as convener of the Committee. The persons in the panel shall be a person of repute who has rendered humanitarian service in the field of education, Health, upliftment of the poor etc. and had not aligned himself with any political party or ideological group; and

(iii) the Superintendent of Police in charge of the District shall be ex-officio member and member Secretary of the Authority.

(2) A person shall be disqualified for being appointed as member if he,–

(a) has directly or indirectly associated himself with any Anti Social or Anti National group or body;

(b) has been convicted and sentenced to imprisonment for an offence which, in the opinion of the State Government, involves moral turpitude; or

(c) is an undischarged insolvent; or

(d) is of unsound mind and stands so declared by a competent court; or

(e) has such other disqualifications as may be prescribed by the State Government.

(3) Every member of the District Police Complaints Authority other than the ex-officio member shall hold

office for a period of three years.

(4) The salary or honorarium and other allowances payable to, and the other terms and conditions of service of the non-official members of the District police Complaints Authority shall be such as may be prescribed.

(5) It shall be the duty of the district police complaints authority to ensure that all its members and their staff are regularly trained, interalia about,-

(a) technical and legal issues related to departmental inquiries;

(b) specific forms of human rights violation; and

(c) appropriate handling of victims of police abuse.

(6) Necessary staff required for the functioning of the District Police Complaints Authority shall be provided by Government.

(7) The District Police Complaints Authority shall look into complaints against police officers of and below the rank of Deputy Superintendent of Police and take cognizance of allegations of serious misconduct by the police officers, which would include incidents involving death, grievous hurt or rape in police custody.

(8) The District Police Complaints Authority shall,-

(a) have the power to enquire into misconduct or abuse of power by or against police officers of and below the rank of Deputy Superintendent of Police after giving an opportunity of being heard to him. The Authority shall have the power to investigate any case itself or ask any other agency to investigate and submit a report. The District Police Complaints Authorities shall submit its report to the competent disciplinary authority for appropriate action against the accused officers;

(b) if the complaint contains allegations against any police officer of or above the rank of Deputy Superintendent of Police the District Police Complaints Authority, shall forward the same to the State Complaints Authority, for further action;

(c) forward the complaints of "serious misconduct", received directly by it, to the State Police Complaints Authority for further action:

Provided that District Police Complaints Authority shall not have jurisdiction on the complaints against the police offices where a separate authority is created by any other Act for this purpose.

(9) Each District police Complaints Authority shall prepare and submit to the State police complaints Authority an annual report before the end of each calendar year, inter alia, containing,-

(a) the numbers and types of cases of "serious misconduct" and "misconduct" forwarded by it to the State Police Complaints Authority during the year;

(b) the number and types of cases of "misconduct" referred to it by the complainants upon being dissatisfied by the departmental inquiry into his complaint ;

(c) the number and types of cases referred to in clause (b) above in which advice or direction was issued by it to the police for further action;

(d) such other related administrative and financial matters as may be prescribed.

20E. Powers of the State Police Complaints Authority and District Police Complaints Authority.- The State

Police Complaints Authority and District Police Complaints Authority shall, while investigating any matter under this Act, have all the powers of a civil court in trying a suit and in particular, in respect of the following matters, namely:-

(a) summoning and enforcing the attendance of any person from any part of the State and examining him on oath;

(b) requiring the discovery and production of any document;

(c) receiving evidence on affidavits;

(d) requisitioning any public record or copy there of from any court or office;

(e) issuing Commissions for the examination of witnesses and documents; and

(f) any other matter which may be prescribed."

20F. Tenure of officers incharge of police stations, circle, sub-division, district and range - (1) Subject to superannuation, the officers who are in operational duties and incharge of Police station, Circle, Sub-division may have a minimum tenure of one year:

Provided that any such officer may be transferred by the Police Establishment Board or by the Government in consultation with the Police Establishment Board, from his post before the expiry of the above minimum tenure consequent upon,-

(a) promotion to a higher post; or

(b) on conviction, or charges having been framed by a court of Law in a criminal offence;

(c) imposition of punishment of dismissal, removal, discharge or compulsory retirement from service or of reduction to a lower rank awarded under the relevant discipline and Appeal Rules; or

(d) suspension from the Service in accordance with the provisions of the said rules; or

(e) incapacitation by physical or mental illness or otherwise becoming unable to discharge his functions and duties; or

(f) the need to fill up a vacancy caused by promotion, transfer or retirement; or

(g) on request of the officer concerned in writing:

Provided further that the Government may, after consultation with the Police Establishment Board, may transfer an officer before the expiry of his tenure on account of misconduct or gross negligence or an act of moral turpitude.

(2) Subject to superannuation, the Inspector General of Police in charge of Range or Superintendent of Police in charge of a District including Additional Superintendent of Police who are on operational duties in the field shall have a minimum tenure of one year:

Provided that the Government may transfer an officer of the above category within a period of one year for reasons of gross misconduct or negligence or an act of moral turpitude or under circumstances enumerated in the proviso to sub-section (1).

20G. Units in a Police station.- (1) The Police station shall be headed by a Station House officer not below the rank of an Inspector of Police or Sub-inspector of Police as the Government may by order determine.

(2) In each police station there shall be two units, namely:-

(a) one exclusively dealing with crime investigation consisting of such number of police officers as Director General of Police and Inspector General of Police may by order determine to deal with detection and investigation of crime; and

(b) another unit dealing with Law and Order consisting of such number of police officers as may be determined by the Director General of Police and Inspector General of Police by order, for the purpose of maintenance of Law and Order, traffic and prevention of crimes:

Provided that in any Police Station where the average annual number of crimes registered exceeds such number as prescribed, there shall be two Police Sub-Inspectors or Inspectors of Police, as the case may be one each for crime investigation and law and order units separately:

Provided further that the police personnel assigned to either of the unit shall not be deployed for any other purpose without the written permission of the Superintendent of Police of the District or the Commissioner of Police as the case may be."

4. Repeal and savings.- (1) The Karnataka Police (Amendment) Ordinance, 2012 (Karnataka Ordinance No. 2 of 2012) is hereby repealed.

(2) Notwithstanding such repeal anything done or any action taken under the principal Act as amended by the said Ordinance shall be deemed to have been done or taken under the principal Act as amended by this Act.

STANDARD OPERATING PROCEDURES (SOP) FOR APPROVAL AND MONITORING OF

RECOGNIZED MEDICAL INSTITUTIONS (RMI)

1. Introduction:

The Drugs Control Department of Karnataka State takes all efforts to make available Oral Morphine for pain relief, while taking precautions to prevent its abuse or diversion to illicit uses. We recognize that there should be procedures to encourage institutions to develop pain relief services as simple as possible and Medical Officers to prescribe Oral Morphine whenever necessary. This Standard Operating Procedures (SOP) intends to achieve the above object.

Any hospital or other institution providing pain relief and palliative care to patients can apply for recognition as RECOGNIZED MEDICAL INSTITUTION (RMI) for allotment of ORAL MORPHINE for stocking and dispensing. No individual shall be allowed as Recognized Medical Institution.

The possession, transport, availability etc of Oral Morphine Preparations is governed by Rules 28A, 28B, 28C, 28D, 28E, 28F, 28G and 28H and Form III-A, III-B, III-C, III-D, III-E and III-F of Narcotic Drugs and Psychotropic Substances ( Karnataka) Rules 1985.

2. Minimum Mandatory Requirements (MMR):

A Hospital or other institution applying for RMI status shall have following Minimum Mandatory Requirement (MMR)

a) A Medical Officer having a Minimum qualification of MBBS or equivalent qualification with at least one day of hands-on training in pain relief and palliative care. If there are more than one Medical Officer at the institution, one of them should be designated as Over-all in Charge,

b) Facilities for safe stocking of Morphine and

c) Proper documentation for dispensing of Morphine.

d) Conditions to be satisfied by RMIs:

i. The RMI shall ensure that the MMR and other relevant conditions are satisfied,

ii. The drugs shall be prescribed only by approved Medical Officers or under their supervision, iii. The over all in charge shall be responsible for the safe custody of Morphine,

iv. The drugs shall be purchased only from licensed authorized manufacturer / dealer, v. The expired stock of Morphine shall be reported to the Excise Commissioner, Bangalore and thereafter it shall be destroyed as per the provisions of Biomedical Waste (Management and Handling) Rules, 1996,

vi. The unused Morphine returned by the patients shall be considered as receipts,

vii. Morphine shall not be transferred, loaned or sold to other institutions,4053 viii. Morphine is dispensed only to patients registered with the RMI,

ix. All records and registers under the law shall be maintained and kept for a period of two years from the last entry made there in and made available for inspection by the officers empowered by the Government under Section 41 and 42 of the Narcotic Drugs and Psychotropic Substances Act, 1985.

x. If there is a change in the Over all in-charge, the details with date of change shall be intimated to the Drugs Controller along with the original RMI certificate and copies of the certificates immediately and the name got endorsed from the office of the Drugs Controller for the state of Karnataka,

xi. The RMI shall inform the Drugs Controller in writing in the event of any change in the constitution of the RMI operating under this approval. Where any change in the Constitution of the RMI takes place, the current approval shall be deemed to be valid for a maximum period of three months from the date on which such change takes place, unless, in the meantime a fresh approval has been taken from the Drugs Controller in the name of the Institution with the changed constitution,

xii. If the RMI ceases to exist, the matter shall be informed with details of balance stock of Morphine, if any, and the RMI certificate be surrendered to the Drugs Controller immediately.

The Drugs Controller shall issue orders for the disposal of the balance Morphine.

3. Expert Committee :-

a) Rule 28A of the Narcotic Drugs and Psychotropic Substances Rules (Karnataka) 1985, prescribes an Expert Committee. Accordingly, Drugs Controller for the State of Karnataka is the chairman of this committee. Excise Commissioner, Bangalore or his nominee not below the rank of Additional Commissioner and Director, Kidwai Memorial Institute of Oncology, B'lore or his nominee are the members of this committee.

b) Neither the Chairman nor the Members shall receive any remuneration, in this regard.

4. Procedure of application :-

a) Application for approval as RMI shall be submitted to the Drugs Controller for the state of Karnataka, Palace Road, Bangalore- 560 001. The application shall contain:

i) a covering letter addressed to the Drug Controller requesting to accord approval / renewal of RMI.

The covering letter should be signed by the owner, managing partner, managing director, managing trustee etc of the institution.

ii) application in Form IIIA duly filled and signed by the owner, managing partner, managing director, managing trustee etc. of the institution. The name of the Medical Officer shall be written in the application as shown in the Registration with Karnataka Medical Council.

iii) Form IIIC [Estimate of Annual requirement of Morphine preparations (other than parenteral use)], duly filled and signed by the by the owner, managing partner, managing director, managing trustee etc of the institution. The name of the Medical Officer shall be written in the application as shown in the Registration with Karnataka Medical Council.

iv) the name of the drug proposed to be procured with its strength (i.e Morphine Tablets 10 mg etc) and Quantity required.

v) attested copies of the following certificates of the medical officer in charge

a) MBBS or equivalent degree,4054 b) Registration with Karnataka Medical Council,

c) Training in palliative Care (Minimum of One day of hands on training) from Kidwai Institute Of Oncology, Bangalore,

d) Constitution details like partnership deed, Articles of Association and Memorandum of association of Companies and list of present directors with their residential addresses, bye- laws of Societies, trusts or other bodies, with list of present trustees and with their residential addresses etc.,

5. Procedure of Scrutiny and Approval of RMI

a) After receipt of the application, office of the Drugs Controller shall scrutinize the application. If the application is found correct in all respect the proposed hospital/ institution will be inspected by the Drugs Inspector. The Drugs Inspector shall inspect and forward his report with clear opinion whether to accord permission or reject the application with reasons.

b) In the meanwhile meeting notice shall be sent to the members of the committee.

c) During the meeting the inspection report submitted by the officer and other details like requirement of quota of Morphine shall be discussed.

d) If the committee is satisfied with recommendations of the Drugs Inspector, it shall recommend for grant of approval and Drugs Controller shall grant the approval as RMI with two years validity from the date of grant of approval. (There is no prescribed form in the above Rules in which approval has to be accorded.

However the department has prepared its own format.) He shall also issue Form IIID which is an authorization for transport of Morphine from the place of manufacturer / dealer to RMI. A copy of Form IIID shall be sent to the manufacturer / supplier, the Drugs Controller of the concerned State from where Supply takes place, Narcotic Commissioner, Gwalior, Excise Commissioner, Bangalore, Excise officer of the concerned district where the RMI is situated, Concerned officers of Drugs Control department like Deputy Drugs Controller / Asst Drugs Controller / Drugs Inspector where the RMI is situated.

e) If the Committee is not satisfied or if there are reasons to believe that the applicant is engaged in practices that violate safe and effective use of Morphine, the same shall be noted during the meeting and shall be communicated to the applicant.

6. Duties and responsibilities of Medical Officer in charge.

The Medical Officer in charge shall:

a ) endeavor to ensure that the stock of Morphine is adequate for patients' need;

b ) ensure that Morphine is kept under safe custody;

c ) maintain a record of all receipts and disbursements of Morphine in the format as specified in Form IIIB;

d ) ensure that estimates and other details are sent to the Drugs Controller in time;

e ) ensure adequate supervision over prescription of Morphine by other Medical Officers.

7. Application for Supplementary Quota of Morphine

If the allotted quota of Morphine for the year is inadequate, the institution shall apply for a supplementary quota along with the estimate to the Drugs Controller, for the State of Karnataka. The Drugs Controller shall consider it after verification and placing it before the committee if necessary and either approve, modify or reject the estimate and inform the applicant within one month from the date of receipt of such request.

8. Renewal of Annual Quota of Morphine

a) All RMIs shall submit the estimated annual requirement before 31st October every year even if they have not used any Morphine in the preceding year.

b) The Drugs Controller shall consider it and either approve, modify or reject the estimate and inform the applicant before 30th November . A copy of the communication shall be sent each to the manufacture, supplier and to the Drugs Controller of the State of supply.

9. Purchase and Transport of Morphine

a) The Recognized Medical Institution shall place orders for purchase of Morphine to a manufacturer /supplier enclosing the following:

i. Form IIIE duly filled and signed by the owner /

Managing Partner / Managing Director / Managing Trustee etc;

ii. the estimate approved by the Drugs Controller ;

iii. Copy of Form IIID,

iv. Copy of RMI certificate in case of first purchase.

b) A copy of the purchase order shall be sent to the Drugs Controller for the State of Karnataka and the Narcotics Commissioner, India.

c) The manufacturer / Supplier shall send required quantity of Morphine to the RMI only on the basis of the RMI Certificate and the estimates approved by the Drugs Controller for the State of Karnataka.

d) The manufacturer/supplier shall dispatch Morphine to the RMI along with a consignment note in quintuplicate in the format given in Form III-F.

e) The manufacturer/supplier shall send copies of the consignment note to the Drugs Controller of the state where the manufacturer/supplier is located, the Drugs Controller of the State in which RMI is located and the Narcotics Commissioner, India. The manufacturer shall also keep a copy of the consignment note.

f ) On receipt of the consignment, the RMI shall enter the quantity received with date in all the copies of the consignment note, retain the original consignment note, send the duplicate to the supplier, triplicate to the Drugs Controller, the quadruplicate to the Drugs Controller of State (in cases in which the consignment originated outside the State) in which the supplier is located and the quintuplicate to the Narcotic Commissioner, India.

10. Revoking the recognition:

If it comes to the notice of the Drugs Controller that Morphine obtained by the RMI was supplied for non- medical use or that any of the provisions of 28B, 28C, 28D, 28E, 28F, 28G and 28H of Narcotic Drugs and Psychotropic Substances (Karnataka) Rules 1985 is violated, for reasons to be recorded in writing and after hearing the party, he / she may revoke the recognition accorded under these Rules.

11. Appeal

Any person aggrieved by any decision or order passed by the Drugs Controller relating to recognition or revocation of recognition of RMI or allotment of estimates may appeal to the Secretary to Government of Karnataka, Health and Family Welfare Department, Bangalore within ninety days from the date of receipt of such decision or order.

Whereas the draft of the Karnataka Food, Civil Supplies and Consumer Affairs (Recruitment) Rules, 2012 was published as required by sub-section (2) of section 3 of the Karnataka Civil Services Act, 1978, (Karnataka Act 14 of 1990) in Notification No. FCS 153 EFT 2009, dated: 11.07.2012 in part-IV-A of the Karnataka Gazette (Extraordinary) dated 11.07.2012 inviting objections and suggestions from all persons likely to be affected thereby within 15 days from the date of publication in the official Gazette.

And whereas the said Gazette was made available to public on 11.07.2012.

And whereas the objections and suggestions that were received have been considered by the Government. Now therefore, in exercise of the powers conferred by sub-section (1) of section 3 read with section 8 of the Karnataka State Civil Services Act, 1978 (Karnataka Act-14 of 1990), the Government of Karnataka hereby makes the following rules, namely;

RULES

1. Title and commencement.- (1) These rules may be called the Karnataka Food, Civil Supplies and Consumer Affairs (Recruitment) Rules, 2012.

(2) They shall come into force from the date of their publication in the official Gazette.

2. Method of recruitment and minimum qualification etc.,- In respect of each category of posts and pay scale specified in column (1) and (2) of the schedule below, the number and nature of posts, the method of recruitment and minimum qualification, if any, shall be as specified in the corresponding entries in column (3), (4) and (5) thereof.

3. Repeal and Savings.- The Karnataka Food, Civil Supplies and Consumer Affairs (Recruitment) Rules, 2002 is hereby repealed.

Provided that such repeal shall not affect,-

(i) the previous operation of the said rules or anything duly done or any action taken thereunder: or (ii) any right, privilege, obligation or liability acquired, or incurred under the said rule.

(1) 1993 ರ ಕರ್ನಾಟಕ ಪಂಚಾಯತ್ ರಾಜ್ ಅಧಿನಿಯಮದ ಉಪಬಂಧಗಳ ಮೇರೆಗೆ ಕೋಲಾರ ಜಿಲ್ಲೆಗೆ ಸಂಬಂಧಿಸಿದಂತೆ, ಈ ಅಧಿಸೂಚನೆಗೆ ಲಗತ್ತಿಸಿರುವ ತ:ಖ್ತೆಯಲ್ಲಿ ನಮೂದಿಸಿರುವಂತೆ ಜಿಲ್ಲೆಯಲ್ಲಿ ವಿವಿಧ ಕಾರಣಗಳಿಂದ ತೆರವಾಗಿರುವ ಗ್ರಾಮ ಪಂಚಾಯಿತಿಯ ವಿವಿಧ ಕ್ಷೇತ್ರಗಳ ಸದಸ್ಯ ಸ್ಥಾನಗಳನ್ನು ತುಂಬಲು

(3) ಕೋಲಾರ ಜಿಲ್ಲೆಯ ಮಾಲೂರು ಮತ್ತು ಬಂಗಾರಪೇಟೆ ತಾಲ್ಲೂಕುಗಳಲ್ಲಿನ ಇದರೊಂದಿಗೆ ಲಗತ್ತಿಸಿರುವ ತ:ಖ್ತೆಯಲ್ಲಿ ನಮೂದಿಸಿರುವ ಗ್ರಾಮ ಪಂಚಾಯ್ತಿಗಳಲ್ಲಿನ ಕೆಲವು ಸದಸ್ಯರ ಮರಣದಿಂದ ಮತ್ತು ಕೆಲವು ಸದಸ್ಯರ ರಾಜೀನಾಮೆಯಿಂದ ತೆರವಾಗಿರುವ ಸದಸ್ಯ ಸ್ಥಾನಗಳನ್ನು ತುಂಬಲು ಚುನಾವಣೆಗಳನ್ನು ನಡೆಸಬೇಕಾಗಿರುವುದರಿಂದ,

ಆದುದರಿಂದ, ಕರ್ನಾಟಕ ಪಂಚಾಯತ್ ರಾಜ್ (ಚುನಾವಣೆಗಳನ್ನು ನಡೆಸುವ) ನಿಯಮಗಳು 1993 ರ 12ನೇ ನಿಯಮಕ್ಕನುಸಾರವಾಗಿ ಕೋಲಾರ ಜಿಲ್ಲೆಯ ಡೆಪ್ಯುಟಿ ಕಮೀಷನರ್‌ರಾದ ಡಾ:ಡಿ.ಎಸ್.ವಿಶ್ವನಾಥ್, ಭಾ.ಆ.ಸೇ., ಎಂಬ ಹೆಸರಿನ ನಾನು, ಸದರಿ ಚುನಾವಣೆಗೆ ಸಂಬಂಧಿಸಿದ ಈ ಕೆಳಕಂಡ ಕಾರ್ಯಕ್ರಮ ವೇಳಾಪಟ್ಟಿಯನ್ನು ಈ ಮೂಲಕ ನಿಗಧಿಪಡಿಸುತ್ತೇನೆ.

1993ರ ಕರ್ನಾಟಕ ಪಂಚಾಯತ್ ರಾಜ್ ಅಧಿನಿಯಮ ಉಪಬಂಧಗಳ ಮೇರೆಗೆ ಚಿತ್ರದುರ್ಗ ಜಿಲ್ಲೆಯ ಅನುಬಂಧದಲ್ಲಿ ತೋರಿಸಿರುವಂತೆ ಗ್ರಾಮ ಪಂಚಾಯ್ತಿಗಳ ವಿವಿಧ ಕಾರಣಗಳಿಂದ ತೆರವಾದ ಸದಸ್ಯ ಸ್ಥಾನಗಳನ್ನು ತುಂಬಲು ಚುನಾವಣೆ ನಡೆಸಬೇಕಾಗಿರುತ್ತದೆ.

ತೆರವಾದ ಸ್ಥಾನಗಳಿಗೆ ಕರ್ನಾಟಕ ಪಂಚಾಯತ್ ರಾಜ್ (ಚುನಾವಣೆಗಳನ್ನು ನಡೆಸುವ) ನಿಯಮಗಳು 1993ರ 12ನೇ ನಿಯಮಕ್ಕೆ ಅನುಸಾರವಾಗಿ ಚಿತ್ರದುರ್ಗ ಜಿಲ್ಲೆಯ ಜಿಲ್ಲಾಧಿಕಾರಿಯಾದ ವಿಪುಲ್ ಬನ್ಸಲ್ ಎಂಬ ಹೆಸರಿನ ನಾನು ಸದರಿ ಚುನಾವಣೆಗೆ ಸಂಭಂಧಿಸಿದ ಈ ಕೆಳಕಂಡ ಕಾರ್ಯಕ್ರಮಗಳ ವೇಳಾಪಟ್ಟಿಯನ್ನು ಈ ಮೂಲಕ ನಿಗಧಿಪಡಿಸಿರುತ್ತೇನೆ.

1993ರ ಕರ್ನಾಟಕ ಪಂಚಾಯತ್ ರಾಜ್ ಅಧಿನಿಯಮ ಉಪಬಂಧಗಳ ಮೇರೆಗೆ ವಿವಿಧ ಕಾರಣಗಳಿಂದ ತೆರವಾಗಿರುವ ಶಿವಮೊಗ್ಗ ಜಿಲ್ಲೆಗೆ ಸಂಬಂಧಿಸಿದಂತೆ ಸದರಿ ಅಧಿಸೂಚನೆಗೆ ಲಗತ್ತಿಸಿದ ಕೋಷ್ಟಕದಲ್ಲಿ ತೋರಿಸಿರುವಂತೆ ವಿವಿಧ ಗ್ರಾಮ ಪಂಚಾಯಿತಿಗಳ ವಿವಿಧ ಕ್ಷೇತ್ರಗಳಲ್ಲಿ ಖಾಲಿ ಇರುವ ಗ್ರಾಮ ಪಂಚಾಯಿತಿ ಸದಸ್ಯರ ಖಾಲಿ ಸ್ಥಾನಗಳನ್ನು ತುಂಬಲು ಚುನಾವಣೆಯನ್ನು ನಡೆಸಬೇಕಾಗಿರುತ್ತದೆ.

ಆದುದರಿಂದ ಕರ್ನಾಟಕ ಪಂಚಾಯತ್ ರಾಜ್ (ಚುನಾವಣೆಗಳನ್ನು ನಡೆಸುವ) ನಿಯಮಗಳು 1993ರ 12ನೇ ನಿಯಮಕ್ಕನುಸಾರವಾಗಿ, ಶಿವಮೊಗ್ಗ ಜಿಲ್ಲೆಯ ಜಿಲ್ಲಾಧಿಕಾರಿಯಾದ ಎಂ.ವಿ. ವೇದಮೂರ್ತಿ

ಎಂಬ ಹೆಸರಿನ ನಾನು ಸದರಿ ಚುನಾವಣೆಗೆ ಸಂಭಂಧಿಸಿದ ಈ ಕೆಳಕಂಡ ಕಾರ್ಯಕ್ರಮಗಳ ವೇಳಾಪಟ್ಟಿಯನ್ನು ಈ ಮೂಲಕ ನಿಗಧಿಪಡಿಸಿರುತ್ತೇನೆ.

NOTIFICATION

The draft of the Karnataka Prevention of Cow Slaughter and Cattle Preservation (Constitution of Goseva Ayog) Rules 2012, which the Government of Karnataka proposes to make in exercise of the powers conferred by section 18 of the Karnataka Prevention of Cow Slaughter and Cattle Preservation Act, 1964 (Karnataka Act 35 of 1964) is hereby published as required under sub-section (1) of section 19 of the said Act, for the information of all the persons likely to be affected thereby and notice is hereby given that the said draft will be taken into consideration after thirty days from the date of its publication in the official Gazette.

Any objection or suggestion which may be received by the State Government from any person with respect to the said draft before the expiry of the period specified above, will be considered by the State Government. Objections and suggestions may be addressed to the Principal Secretary to Government, Animal Husbandry and Fisheries Department, Vikasa Soudha, Bangalore-560 001.

DRAFT RULES

1. Title and commencement:- (1) These rules may be called the Karnataka Prevention of Cow Slaughter and Cattle Preservation (Constitution of Goseva Ayog) Rules, 2012.

(2) They shall come into force from the date of their publication in the official Gazette.

2. Definitions:– In this rules, unless the context otherwise requires;-

(a) "Act" means the Karnataka Prevention of Cow Slaughter and Cattle Preservation Act, 1964 (Karnataka Act 35 of 1964);

(b) "Ayog" means the Karnataka State Goseva Ayog established under these rules.

(c) "Chairperson" means the Chairperson of the Ayog;

(d) "Form" means Form appended to these rules.

(e) "Institution" means any charitable institution engaged in cattle welfare and established for the purpose of keeping, breeding, rearing and maintaining cattle or for the purpose of reception, protection, care, management and treatment of infirm, aged and diseased cattle and includes Gosadan, Goshala, Pinjrapole, Goraksha Sanstha and their Federation or Union registered under any enactment for the time being in force or otherwise;

(f) "Member" means a member of the Ayog and includes the Chairperson.

3. Constitution of Ayog :- (1) The State Government shall by notification constitute a body to be known as the Karnataka State Goseva Ayog to exercise the powers conferred on and to perform the functions assigned to it.

(2) The Ayog shall consist of the Chairperson and the following members, namely :-

(i) Ex-officio Members. -

(a) The Principal Secretary to Government of Karnataka, Animal Husbandry and Fisheries Department or his nominee not below the rank of Deputy Secretary;

(b) The Principal Secretary to Government of Karnataka, Home Department or his nominee not below the rank of Deputy Secretary;

(c) The Principal Secretary to Government of Karnataka, Revenue Department or his nominee not below the rank of Deputy Secretary;

(d) The Principal Secretary to Government of Karnataka, Rural Development and Panchayat Raj Department or his nominee not below the rank of Deputy Secretary;

(e) The Principal Secretary to Government of Karnataka, Urban Department or his nominee not below the rank of Deputy Secretary;

(f) The Commissioner, Animal Husbandry & Veterinary Services;

(g) The Commissioner, Agriculture Department;

(h) The Director, Agriculture Marketing Department;

(i) The Director, Animal Husbandry & Veterinary Services Dept. -- Member Secretary.

(ii) The State Government shall nominate six non-official members having interest in Cattle Welfare, and among them one shall be appointed as Chairperson of the Ayog by the State Government.

(3) Every appointment of non-official members under sub-section (2) shall take effect from the date of notification in the official Gazette.

4. Qualifications.- No person shall be eligible for appointment as a non-official member,-

(a) unless he is a citizen of India;

(b) unless he has attained the age of twenty one years;

(c) if he has been adjudged by a Competent Court to be of unsound mind ;

(d) if he has been sentenced by any court to imprisonment for an offence involving moral turpitude;

(e) if he has been dismissed from the service of the State Government for misconduct and has been declared to be disqualified for employment in public service; and

(f) if he is declared as insolvent.

5. Terms and conditions of appointment of members of the Ayog:- (1) Every non-official member of the Ayog shall hold office for a period of three years from the date on which the appointment is notified in the official Gazette under rule 3.

(2) There shall be paid to the non-official members such Traveling Allowances and other allowances as are admissible to non-official member as per Annexure-A to the Karnataka Civil Services Rules.

(3) A non-official member may resign his post in writing under his hand addressed to the State Government. (4) The State Government shall remove a person from the office of non-official member if he;-

(a) becomes an undischarged insolvent ;

(b) is convicted and sentenced to imprisonment for an offence, which in the opinion of the State Government, involves moral turpitude;

(c) becomes of unsound mind and stands so declared by a competent Court ;

(d) refuse to act or becomes incapable of acting ;

(e) is, without obtaining leave of absence from the Ayog, absent from three consecutive meetings of the Ayog; or

(f) has, in the opinion of the State Government so abused the position of Chairman or Member so as to be detrimental to the interests of livestock or public interest ;

Provided that no person shall be removed under this sub-section until that person has been given a reasonable opportunity of being heard in the matter.

6. Casual Vacancy:- Any vacancy arised in the event of death, resignation or disqualification of a non-official member or of his becoming incapable of acting before the expiry of his term of office, such vacancy shall be deemed to have occurred in such office and such vacancy shall be filled as early as possible by appointment of a person thereto as member who shall hold office for the unexpired term of his predecessor.

7. Headquarter and meetings of the Ayog:– (1) The headquarter of the Ayog shall be at Bangalore.

(2) The Ayog shall meet at least twice in a year, and shall keep record on its proceedings in a minute book.

The meetings of the Ayog shall be convened by the Chairperson who shall, when present preside at such meetings and in the absence of the chairperson, the members present shall elect one from amongst themselves to preside as Chairperson.

8. Vacancy not to invalidate proceedings:- No act or proceeding of the Ayog shall be deemed to be invalid by reason merely of any vacancy in, or any defect in the constitution of the Ayog.

9. Appointment of officers and other employees:- The State Government may, for the purpose of enabling the Ayog to efficiently discharge its functions under this Act provide such number of officers and other employees as may be considered necessary.

10. Registration of institutions and audit of their accounts.- (1)After the constitution of this Ayog, every Institution shall within 3 months thereof submit an application in Form-A for registration under these rules to the registering authority along with particulars;

(2) The application shall be accompanied by such fees as may be notified by the Ayog;

(3) The Ayog shall after such enquiry as it deems fit issue a certificate of registration in Form-B.

(4) The Ayog shall maintain a Register of Institution registered with it in Form C.

(5) Whenever any change occurs in any of the particulars relating to any institution recorded in the Register, the person entrusted to act on behalf of the Institution shall report the change to the Ayog which shall after such enquiry as it deems fit make the necessary changes in the Register.

(6) The accounts of every institution which has been registered under this Ayog, shall be balanced each year on the thirty first day of March and its accounts shall be audited by A Chartered Accountant within 2 months after closure of each financial year and the same shall be submitted to the Ayog every year alongwith the Utilization Certificate of formats received from the Ayog.

11. Functions of the Ayog - The Ayog shall discharge following functions for the betterment of the livestock in the State, namely.-

(a) to ensure protection provided to cattle under State Acts, Union Acts and laws for the time being in force;

(b) and to ensure proper and timely implementation of the laws and to propose remedial measures to concerned Departments of the State Government or any body or authority owned or controlled by the State Government as is responsible for such implementation to make them more effective ;

(c) proper and timely implementation of programs of the State Government under present and future Goshala Development Scheme ;

(d) to ensure care and management of cattle seized for violation of any enactment for the time being in force;

(e) to ensure proper management and care of infirm and aged cattle maintained by any Institution ;

(f) to supervise and inspect the institutions registered and proposed to be registered with the Ayog;

(g) to suggest such measures which may be helpful in strengthening of the Institutions which are economically weak ;

(h) to give financial assistance to the institutions subject to such terms and conditions specified by the State Government from time to time;

(i) to enquire into complaints in the functioning of any Institutions;

(j) to perform such other functions as may be assigned to it by the State Government ;

(k) to assist in implementation of the Actand such other laws to be enacted in respect of cattle welfare;

(l) to take custody of the agricultural cattle seized under the Act and to entrust them to the nearest Goshala, Gosadan or any Cattle Protection institution or to any person pending the disposal of the prosecution proceedings ;

(m) to promote educational activities in Primary and Higher studies on Safety laws, preservation, Goshala management and other related activities ;

(n) to participate in State, National and International level on animal welfare activities and to attract contributions and suggestions;

(o) to implement programmes entrusted by Government or Non- Government agencies.

(p) to appoint Honorary Animal Welfare Officers in with such regulations as may be issued by the Government from time and such honorary Animal Welfare Officers shall work for implementation of the Act and co- ordinate with concerned authorities and department;

12. Funds of the Ayog - (1) The Ayog shall have its own fund and all receipts of the Ayog shall be credited thereto and all payments by the Ayog shall be made there from.

(2) The Ayog may accept grants, donations and gifts from the State Government or a local authority, and private body, whether incorporated or not, or from any private individuals.

(3) All properties, funds and other assets of the Ayog shall be held and applied by it, subject to the provisions of these rules and for the purposes of the Act.

13. Banker of the Ayog - The funds of the Ayog shall be kept in a Nationalized Bank and shall be operated by the Member Secretary of the Ayog.

14. Power of the Ayog to call for records - The Ayog shall have the powers to perform functions and to call for any information or reports from any authority implementing the said enactments.

15. Accounts and Audit - The accounts of the Ayog shall be kept in the manner prescribed in Karnataka Financial Code. The annual balance sheet of the Ayog shall be audited by the State Accounts Department every year and Audit Report alongwith compliance shall be laid before each House of the Legislature through State Government. 16. Annual Report - The Ayog shall prepare for each financial year its annual report within three months from the closure of the financial year giving a full account of its activities during the previous financial year and forward a copy thereof to the State Government.

17. Action on Ayog Report – (1) On receipt of a report under section 16, the State Government may take such action thereon as it considers fit.

(2) A copy of the report made to the State Government together with a report of the action taken thereon by the State Government under sub- section (1) shall be laid on the table of each House of the State Legislature.

18. Power of the State Government to call for reports, returns etc., - The State Government may call for such reports, returns, statements from the Ayog from time to time as it considers necessary.

19. Directions of the State Government.- (1) In discharge of its function, the Ayog shall be guided by such policy which may be given to it, by the State Government.

(2) If any dispute arises between the State Government and the Ayog as to whether a question is or is not a question of policy, the decision of the State Government shall be final.

20. Members of the Ayog to be public servants.- All members and officers of the Ayog shall be deemed to be public servants within the meaning of section 21 of the Indian Penal Code, 1860 (No. 45 of 1860).

21. Default in performance of duty – (1) If the State Government is satisfied that the Ayoga has made default in performing any duty imposed on it, by or under these rules, it may fix a period for the performance of that duty.

(2) If in the opinion of the State Government, the Ayoga fails or neglects to perform such duty within the period so fixed for its performance, it shall be lawful for the State Government, notwithstanding anything contained in rule 3 to supersede and reconstitute the Ayoga.

(3) After the supersession of the Ayoga and until it is reconstituted, the powers, duties and functions of the Ayoga under these rule shall be carried on by the State Government or by such officer or officers, as the State Government may appoint for this purpose.

22. Dissolution of the Ayoga.- (1) The State Government may, by notification, declare that with effect from such date as may be specified in the notification, the Ayoga may be dissolved ;

Provided that no such declaration shall be made without giving a notice to the Ayoga to this effect.

(2) With effect from the date specified in the notification under sub- rule (1).-

(a) all properties, funds and dues which are vested in and realizable by the Ayoga shall vest in and he realizable by the State Government; and

(b) all liabilities endorsable against the Ayoga shall be endorsable against the State Government to the extent of the properties, funds and dues vested in and realized by the State Government.

23. Government to make regulations.- State Government may make separate regulations regarding the qualifications of Honorary Animal Welfare Officers, terms and conditions of appointment and other matters relating to it.

ಕರ್ನಾಟಕ ಪಂಚಾಯತ್‌ರಾಜ್ ಅಧಿನಿಯಮ 1993ರ ಉಪಬಂಧಗಳ ಮೇರೆಗೆ ಬೆಂಗಳೂರು ಗ್ರಾಮಾಂತರ ಜಿಲ್ಲೆಗೆ ಸಂಬಂಧಿಸಿದಂತೆ ಈ ಕೆಳಕಾಣಿಸಿದ ಗ್ರಾಮ ಪಂಚಾಯಿತಿ ಕ್ಷೇತ್ರಗಳಲ್ಲಿ ಚುನಾಯಿತ ಸದಸ್ಯರುಗಳ ರಾಜೀನಾಮೆ/ಮರಣ ಕಾರಣದಿಂದಾಗಿ ಇವರುಗಳ ಸ್ಥಾನಗಳು ಖಾಲಿ ಇರುವುದರಿಂದ ಆ ಖಾಲಿ ಸ್ಥಾನಗಳನ್ನು ತುಂಬಲು ಚುನಾವಣೆಯನ್ನು ನಡೆಸಬೇಕಾಗಿರುವುದರಿಂದ:-

ಮೇಲ್ಕಂಡ ಅಧಿಸೂಚನೆಯ ಷೆಡ್ಯೂಲ್‌ನಲ್ಲಿ ನಮೂದಿಸಲ್ಪಟ್ಟಿರುವ ಜಮೀನುಗಳನ್ನು ಅಧಿಸೂಚನೆಯಲ್ಲಿ ಪ್ರಕಟಿಸಲಾಗಿರುವ ಉದ್ದೇಶಕ್ಕೆ ಸ್ವಾಧೀನಪಡಿಸಿಕೊಳ್ಳಬೇಕಾಗಿರುವುದು ಕರ್ನಾಟಕ ಸರ್ಕಾರಕ್ಕೆ ಮನದಟ್ಟಾಗಿದೆ. ಈ ಬಗ್ಗೆ ಮೇಲ್ಕಂಡ ಕಾಯ್ದೆ ವಿಧಿ 28(3) ರ ಪ್ರಕಾರ ಆದೇಶ ಹೊರಡಿಸಲಾಗಿದೆ.

ಆದುದರಿಂದ 1966 ರ ಕರ್ನಾಟಕ ಕೈಗಾರಿಕಾ ಪ್ರದೇಶಾಭಿವೃದ್ಧಿ ಕಾಯ್ದೆಯ ವಿಧಿ 28(4) ರ (1966 ರ ಕರ್ನಾಟಕದ ಕಾಯ್ದೆ ಸಂಖ್ಯೆ: 18) ಮೇರೆಗೆ ದತ್ತವಾದ ಅಧಿಕಾರದ ಮೇರೆಗೆ ಕರ್ನಾಟಕ ಸರ್ಕಾರ ಈ ಕೆಳಗೆ ನಮೂದಿಸಿರುವ ಜಮೀನುಗಳನ್ನು ಅಧಿಸೂಚನೆಯಲ್ಲಿ ತಿಳಿಸಲಾಗಿರುವ ಉದ್ದೇಶಕ್ಕಾಗಿ ಸ್ವಾಧೀನಪಡಿಸಿಕೊಳ್ಳಲಾಗಿದೆಯೆಂದು ಈ ಮೂಲಕ ಘೋಷಿಸಲಾಗಿದೆ.

1966ರ ಕರ್ನಾಟಕ ಕೈಗಾರಿಕಾ ಪ್ರದೇಶಾಭಿವೃದ್ಧಿ ಕಾಯ್ದೆಯ (1966ರ ಕರ್ನಾಟಕದ. ಕಾಯ್ದೆ ಸಂಖ್ಯೆ: 18 ವಿಧಿ 28(1) ಪ್ರಕಾರ ದತ್ತವಾದ ಅಧಿಕಾರದ ಮೇರೆಗೆ ದಿನಾಂಕ: 20.03.2012 ರಂದು ಕರ್ನಾಟಕದ ವಿಶೇಷ ರಾಜ್ಯ ಪತ್ರ ಭಾಗ-3 ವಿಶೇಷ ಪತ್ರಿಕೆಯಲ್ಲಿ ಪ್ರಕಟವಾಗಿರುವ ಅಧಿಸೂಚನೆ ಸಂಖ್ಯೆ: ಸಿ ಐ 482 ಎಸ್‌ಪಿಕ್ಯೂ 2011 ದಿನಾಂಕ: 20.03.2012 ರ ಪ್ರಕಾರ ಸರ್ಕಾರವು ಸದರಿ ಅಧಿಸೂಚನೆಯಲ್ಲಿ ನಮೂದಿಸಲ್ಪಟ್ಟಿರುವ ಸ್ವತ್ತುಗಳ ಪ್ರದೇಶವನ್ನು "ಬೆಂಗಳೂರು ಮೆಟ್ರೋ ರೈಲು ಯೋಜನೆಯ" ಉದ್ದೇಶಕ್ಕಾಗಿ ಸ್ವಾಧೀನಪಡಿಸಿಕೊಳ್ಳಲು ಇಚ್ಛೆಪಟ್ಟಿದೆ.

ಮೇಲ್ಕಂಡ ಅಧಿಸೂಚನೆಯ ಷೆಡ್ಯೂಲ್‌ನಲ್ಲಿ ನಮೂದಿಸಲ್ಪಟ್ಟಿರುವ ಜಮೀನುಗಳನ್ನು ಅಧಿಸೂಚನೆಯಲ್ಲಿ ಪ್ರಕಟಿಸಲಾಗಿರುವ ಉದ್ದೇಶಕ್ಕೆ ಸ್ವಾಧೀನಪಡಿಸಿಕೊಳ್ಳಬೇಕಾಗಿರುವುದು ಕರ್ನಾಟಕ ಸರ್ಕಾರಕ್ಕೆ ಮನದಟ್ಟಾಗಿದೆ. ಈ ಬಗ್ಗೆ ಮೇಲ್ಕಂಡ ಕಾಯ್ದೆ ವಿಧಿ 28(3) ರ ಪ್ರಕಾರ ಆದೇಶ ಹೊರಡಿಸಲಾಗಿದೆ.

ಆದುದರಿಂದ 1966 ರ ಕರ್ನಾಟಕ ಕೈಗಾರಿಕಾ ಪ್ರದೇಶಾಭಿವೃದ್ಧಿ ಕಾಯ್ದೆಯ ವಿಧಿ 28(4) ರ (1966 ರ ಕರ್ನಾಟಕದ ಕಾಯ್ದೆ ಸಂಖ್ಯೆ: 18) ಮೇರೆಗೆ ದತ್ತವಾದ ಅಧಿಕಾರದ ಮೇರೆಗೆ ಕರ್ನಾಟಕ ಸರ್ಕಾರ ಈ ಕೆಳಗೆ ನಮೂದಿಸಿರುವ ಜಮೀನುಗಳನ್ನು ಅಧಿಸೂಚನೆಯಲ್ಲಿ ತಿಳಿಸಲಾಗಿರುವ ಉದ್ದೇಶಕ್ಕಾಗಿ ಸ್ವಾಧೀನಪಡಿಸಿಕೊಳ್ಳಲಾಗಿದೆಯೆಂದು ಈ ಮೂಲಕ ಘೋಷಿಸಲಾಗಿದೆ.

ಮೇಲ್ಕಂಡ ಅಧಿಸೂಚನೆಯ ಷೆಡ್ಯೂಲ್‌ನಲ್ಲಿ ನಮೂದಿಸಲ್ಪಟ್ಟಿರುವ ಜಮೀನುಗಳನ್ನು ಅಧಿಸೂಚನೆಯಲ್ಲಿ ಪ್ರಕಟಿಸಲಾಗಿರುವ ಉದ್ದೇಶಕ್ಕೆ ಸ್ವಾಧೀನಪಡಿಸಿಕೊಳ್ಳಬೇಕಾಗಿರುವುದು ಕರ್ನಾಟಕ ಸರ್ಕಾರಕ್ಕೆ ಮನದಟ್ಟಾಗಿದೆ. ಈ ಬಗ್ಗೆ ಮೇಲ್ಕಂಡ ಕಾಯ್ದೆ ವಿಧಿ 28(3) ರ ಪ್ರಕಾರ ಆದೇಶ ಹೊರಡಿಸಲಾಗಿದೆ.

ಆದುದರಿಂದ 1966 ರ ಕರ್ನಾಟಕ ಕೈಗಾರಿಕಾ ಪ್ರದೇಶಾಭಿವೃದ್ಧಿ ಕಾಯ್ದೆಯ ವಿಧಿ 28(4) ರ (1966 ರ ಕರ್ನಾಟಕದ ಕಾಯ್ದೆ ಸಂಖ್ಯೆ: 18 ಮೇರೆಗೆ ದತ್ತವಾದ ಅಧಿಕಾರದ ಮೇರೆಗೆ ಕರ್ನಾಟಕ ಸರ್ಕಾರ ಈ ಕೆಳಗೆ ನಮೂದಿಸಿರುವ ಜಮೀನುಗಳನ್ನು ಅಧಿಸೂಚನೆಯಲ್ಲಿ ತಿಳಿಸಲಾಗಿರುವ ಉದ್ದೇಶಕ್ಕಾಗಿ ಸ್ವಾಧೀನಪಡಿಸಿಕೊಳ್ಳಲಾಗಿದೆಯೆಂದು ಈ ಮೂಲಕ ಘೋಷಿಸಲಾಗಿದೆ.
