ವಿಷಯ ಃ ಕರ್ನಾಟಕ ವಿಧಾನಸಭೆ ಸಚಿವಾಲಯದಲ್ಲಿ ಶೀಘ್ರಲಿಪಿಗಾರರ ಹುದ್ದೆಗಳನ್ನು ನೇರ ನೇಮಕಾತಿಯ

ಮೂಲಕ ಭರ್ತಿ ಮಾಡುವ ಬಗ್ಗೆ.

ಕರ್ನಾಟಕ ವಿಧಾನ ಸಭೆ ಸಚಿವಾಲಯದ (ನೇಮಕಾತಿ ಮತ್ತು ಸೇವಾ ಷರತ್ತುಗಳು) ನಿಯಮಗಳು 2003 ಹಾಗೂ ತಿದ್ದುಪಡಿ ನಿಯಮಾವಳಿ 2009ರಡಿಯಲ್ಲಿ ಕರ್ನಾಟಕ ವಿಧಾನಸಭೆ ಸಚಿವಾಲಯದ ಶೀಘ್ರಲಿಪಿಗಾರರ ಹುದ್ದೆಗಳಿಗಾಗಿ ಅರ್ಹ ಅಭ್ಯರ್ಥಿಗಳಿಂದ ಅರ್ಜಿಗಳನ್ನು ಆಹ್ವಾನಿಸಲಾಗಿದೆ.

3. ಕರ್ನಾಟಕ ವಿಧಾನ ಸಭೆ ಸಚಿವಾಲಯದ (ನೇಮಕಾತಿ ಹಾಗೂ ಸೇವಾ ಷರತ್ತುಗಳು) ನಿಯಮಾವಳಿಗಳನುಸಾರ ಮೇಲ್ಕಂಡ ಹುದ್ದೆಗಳ ಭರ್ತಿಗಾಗಿ ಅರ್ಹತೆಯುಳ್ಳ ಅಭ್ಯರ್ಥಿಗಳು ಅರ್ಜಿ ನಮೂನೆ-1ರ ದ್ವಿಪ್ರತಿಯಲ್ಲಿ ಅರ್ಜಿಗಳನ್ನು ಸರ್ಕಾರಿ ಪುಸ್ತಕ ಮಳಿಗೆಯಿಂದ ಪಡೆದು ವಿಧಾನಸಭೆ ಸಚಿವಾಲಯಕ್ಕೆ ಅರ್ಜಿ ಸಲ್ಲಿಸಲು ನಿಗದಿಪಡಿಸಿರುವ ಕೊನೆಯ ದಿನಾಂಕದೊಳಗೆ ಸಲ್ಲಿಸಬೇಕು. (ಅರ್ಜಿ ನಮೂನೆಯು ಸರ್ಕಾರಿ ಮುದ್ರಣಾಲಯದಲ್ಲಿ ದೊರೆಯುವುದು).

(5953)5954 4. ವಿದ್ಯಾರ್ಹತೆ ಃ ಕರ್ನಾಟಕ ನಾಗರೀಕ ಸೇವಾ (ಸಾಮಾನ್ಯ ನೇಮಕಾತಿ) ನಿಯಮಾವಳಿ 1977ರ ಪ್ರಕಾರ ಅಭ್ಯರ್ಥಿಗಳು ನೇರ ನೇಮಕಾತಿಗೆ ಅರ್ಹತೆಯನ್ನು ಪಡೆದಿರಬೇಕು ಹಾಗೂ ಅವನು / ಅವಳು ಕೆಳಗೆ ತಿಳಿಸಿರುವ ವಿದ್ಯಾರ್ಹತೆಯನ್ನು ಹೊಂದಿರತಕ್ಕದ್ದು.

5. ವಯೋಮಿತಿಃ ಅರ್ಜಿಗಳನ್ನು ಸ್ವೀಕರಿಸಲು ನಿಗದಿಪಡಿಸಿದ ಕೊನೆಯ ದಿನಾಂಕದಂದು ಅಭ್ಯರ್ಥಿಗಳು ಕನಿಷ್ಟ 18 ವರ್ಷ ವಯಸ್ಸನ್ನು ಪೂರೈಸಿರತಕ್ಕದ್ದು.

6. ಸರ್ಕಾರಿ ಇಲಾಖೆಗಳಲ್ಲಿ ಈಗಾಗಲೇ ಸೇವೆ ಸಲ್ಲಿಸುತ್ತಿರುವ ಅಭ್ಯರ್ಥಿಗಳು ಅರ್ಜಿಗಳನ್ನು ತಮ್ಮ ನೇಮಕಾತಿ ಪ್ರಾಧಿಕಾರದ ಮೂಲಕವೇ ನಿಗದಿತ ದಿನಾಂಕದೊಳಗೆ ಸಲ್ಲಿಸಬೇಕು.

7. ಕರ್ನಾಟಕ ನಾಗರೀಕ ಸೇವಾ (ಸಾಮಾನ್ಯ ನೇಮಕಾತಿ) ನಿಯಮಾವಳಿ 1977ರ ಪ್ರಕಾರ, ರಾಜ್ಯ ಸಿವಿಲ್ ಸೇವೆಗಳಲ್ಲಿ ಹುದ್ದೆಗಳಿಗೆ ನೇಮಕಾತಿ ಹೊಂದಲು ಅರ್ಹತೆ ಹೊಂದಿರುವ ಅಭ್ಯರ್ಥಿಗಳು ಮಾತ್ರ ನೇಮಕಾತಿಗೆ ಅರ್ಹರಾಗಿರುತ್ತಾರೆ.

8. (1) ಆಯ್ಕೆಯಾದ ಯಾವುದೇ ಅಭ್ಯರ್ಥಿಯು, ನೇಮಕಾತಿ ಪ್ರಾದಿಕಾರಕ್ಕೆ ಅವನು / ಅವಳು ನೇಮಿಸಿರುವ ಕೆಲಸಕ್ಕೆ ದೈಹಿಕವಾಗಿ ಹಾಗೂ ಮಾನಸಿಕವಾಗಿ ಯೋಗ್ಯವೆನಿಸಿದ ಹೊರತು ಅವನನ್ನು / ಅವಳನ್ನು ಆ ಹುದ್ದೆಗೆ ನೇಮಿಸಲಾಗುವುದಿಲ್ಲ.

(2) ಸಕ್ಷಮ ನೇಮಕಾತಿ ಪ್ರಾದಿಕಾರದ ಪೂರ್ವಾನುಮತಿ ಪಡೆಯದೇ ಒಬ್ಬ ಜೀವಂತ ಪತ್ನಿಗಿಂತ ಹೆಚ್ಚು ಮಂದಿ ಪತ್ನಿಯರನ್ನು ಹೊಂದಿರುವ ಪುರುಷ ಅಭ್ಯರ್ಥಿ ಮತ್ತು ಈಗಾಗಲೇ ಇನ್ನೊಬ್ಬ ಹೆಂಡತಿ ಇರುವ ವ್ಯಕ್ತಿಯನ್ನು ಮದುವೆಯಾಗಿರುವ ಮಹಿಳಾ ಅಭ್ಯರ್ಥಿಯು ನೇಮಕಾತಿಗೆ ಅರ್ಹರಾಗಿರುವುದಿಲ್ಲ.

9. ಯಾವುದೇ ವ್ಯಕ್ತಿಯು ತನ್ನ ಉಮೇದುವಾರಿಕೆ ಬಗ್ಗೆ ಅದಿಕಾರಿಗಳು ಮತ್ತು ಅದಿಕಾರೇತರರುಗಳಿಂದ ಯಾವುದೇ ರೀತಿಯ ಒತ್ತಡ ತಂದಲ್ಲಿ ಸದರಿ ಹುದ್ದೆಯ ನೇಮಕಾತಿಗೆ ಅರ್ಹನಾಗುವುದಿಲ್ಲ.

10. ಶುಲ್ಕಃ ಪರಿಶಿಷ್ಟ ಜಾತಿ ಮತ್ತು ಪರಿಶಿಷ್ಟ ಪಂಗಡ ಹಾಗೂ ಪ್ರವರ್ಗ-I ಅಭ್ಯರ್ಥಿಗಳಿಗೆ ಅರ್ಜಿ ಶುಲ್ಕ ಇರುವುದಿಲ್ಲ. ಉಳಿದ, ಸಾಮಾನ್ಯ ವರ್ಗದ ಮತ್ತು ಇತರೆ ಹಿಂದುಳಿದ ವರ್ಗದ ಅಭ್ಯರ್ಥಿಗಳು ಕ್ರಾಸ್ ಮಾಡಿದ ರೂ.25.00ರ ಇಂಡಿಯನ್ ಪೋಸ್ಟಲ್ ಆರ್ಡರನ್ನು ಅರ್ಜಿ ಸಲ್ಲಿಸುವ ಕೊನೆಯ ದಿನಾಂಕಕ್ಕೆ 30 ದಿನಗಳೊಳಗಿರುವಂತೆ ಖರೀದಿಸಿ, ಕಾರ್ಯದರ್ಶಿ, ಕರ್ನಾಟಕ ವಿಧಾನ ಸಭೆ ಸಚಿವಾಲಯ, ಮೊದಲನೆ ಮಹಡಿ, ವಿಧಾನಸೌಧ, ಬೆಂಗಳೂರು-560 233 ಈ ವಿಳಾಸಕ್ಕೆ ಪಾವತಿ ಮಾಡಬೇಕು. ಅರ್ಜಿ ಶುಲ್ಕವನ್ನು ಒಮ್ಮೆ ಪಾವತಿಸಿದ ನಂತರ ಅದನ್ನು ಯಾವುದೇ ಸಂದರ್ಭದಲ್ಲಿಯೂ ಹಿಂದಿರುಗಿಸಲಾಗುವುದಿಲ್ಲ.

11. ಅಭ್ಯರ್ಥಿಗಳು ಅರ್ಜಿಯೊಂದಿಗೆ ಈ ಕೆಳಗೆ ತಿಳಿಸಲಾಗಿರುವ ದಾಖಲೆಗಳ ಜೆರಾಕ್ಸ್ ಪ್ರತಿಗಳನ್ನು ದ್ವಿಪ್ರತಿಗಳಲ್ಲಿ ತಪ್ಪದೇ ಲಗತ್ತಿಸಬೇಕು.

(ಅ) ಹುಟ್ಟಿದ ತಾರೀಖಿಗೆ ಆಧಾರದ ದಾಖಲೆ ಪ್ರತಿ. (ಎಸ್.ಎಸ್.ಎಲ್.ಸಿ. ಅಂಕಪಟ್ಟಿ ಅಥವಾ ಶಾಲಾ ವರ್ಗಾವಣೆ ಪತ್ರ (ಟಿ.ಸಿ.)) (ಆ) ವಿದ್ಯಾರ್ಹತೆಗೆ ಸಂಬಂದಿಸಿದಂತೆ ಎಲ್ಲಾ ವರ್ಷಗಳ ಪದವಿ ಪರೀಕ್ಷೆಯ ಅಂಕಪಟ್ಟಿಗಳ ನಕಲು ಪ್ರತಿಗಳೊಂದಿಗೆ.

(ಇ) ಹುದ್ದೆಗೆ ಸೂಚಿಸಲಾಗಿರುವ ವಿದ್ಯಾರ್ಹತೆಗಳಿಗೆ ಸಂಬಂದಿಸಿದ ಪದವಿ ಪ್ರಮಾಣ (Convocation Certificate) ಪತ್ರದ ನಕಲು ಪ್ರತಿ ಮತ್ತು ಇತರೆ

ವಿದ್ಯಾರ್ಹತೆಯ ಪ್ರಮಾಣ ಪತ್ರದ ನಕಲು ಪ್ರತಿ (ಅಂಕಪಟ್ಟಿಗಳ ನಕಲು ಪ್ರತಿಗಳ ಸಮೇತ).

(ಈ) ಮಾನ್ಯತೆ ಪಡೆದ ಸಂಸ್ಥೆಯಿಂದ ಗಣಕಯಂತ್ರದ ತರಬೇತಿಯ ಪ್ರಮಾಣ ಪತ್ರದ ನಕಲು ಪ್ರತಿ.

(ಉ) ಜಾತಿ ಪ್ರಮಾಣ ಪತ್ರದ ನಕಲು ಪ್ರತಿಯನ್ನು ಸರ್ಕಾರದಿಂದ ನಿಗದಿಪಡಿಸಿರುವ ನಮೂನೆಯಲ್ಲಿ ಸಲ್ಲಿಸತಕ್ಕದ್ದು.

ಸೂಚನೆಃ- ಅಭ್ಯರ್ಥಿಗಳು ಮೂಲ ಪ್ರಮಾಣ ಪತ್ರಗಳನ್ನು ಲಗತ್ತಿಸಬಾರದು.

12. ಅರ್ಜಿಗಳನ್ನು ನಮೂನೆ 1 ರ ದ್ವಿಪ್ರತಿಯಲ್ಲಿ ಅಗತ್ಯವುಳ್ಳ ದಾಖಲೆಗಳನ್ನು ಲಗತ್ತಿಸಿ, ಕೊನೆಯ ದಿನಾಂಕ ಃ 21.12.2012 ರಂದು ಸಂಜೆ 4-00 ಗಂಟೆಯ ಒಳಗಾಗಿ ಖುದ್ದಾಗಿ ಅಥವಾ ಅಂಚೆಯ ಮೂಲಕ ತಲುಪಿಸತಕ್ಕದ್ದು, ಸದರಿ ದಿನಾಂಕವು ಸಾರ್ವಜನಿಕ ರಜಾ ದಿನವಾದಲ್ಲಿ ಮುಂದಿನ ಕೆಲಸದ ದಿನದಂದು ಅರ್ಜಿಯನ್ನು ಸಲ್ಲಿಸತಕ್ಕದ್ದು.

13. ಕರ್ನಾಟಕ ವಿಧಾನಸಭೆ ಸಚಿವಾಲಯದ (ನೇಮಕಾತಿ ಮತ್ತು ಸೇವಾ ಷರತ್ತುಗಳು) ನಿಯಮಾವಳಿ 2003ರ ರೀತ್ಯಾ ಹುದ್ದೆಗಳ ಆಯ್ಕೆ ಪ್ರಕ್ರಿಯೆಯ ಕಾರ್ಯ ವಿಧಾನವನ್ನು ನಿಗದಿಪಡಿಸುವ ಅದಿಕಾರ ಮಾನ್ಯ ಸಭಾಧ್ಯಕ್ಷರವರಿಗೆ ಇರುತ್ತದೆ.

ವಿಶೇಷ ಸೂಚನೆಃ

1. ಅರ್ಜಿಗಳ ಮೇಲೆ ಹುದ್ದೆಯ ಹೆಸರನ್ನು ಹಾಗೂ ಅರ್ಜಿದಾರರ ಹೆಸರು, ತಂದೆಯ ಹೆಸರು ಮತ್ತು ಸರಿಯಾದ ವಿಳಾಸವನ್ನು ದಪ್ಪ ಅಕ್ಷರಗಳಲ್ಲಿ

ನಮೂದಿಸತಕ್ಕದ್ದು.

2. ಅರ್ಜಿಯನ್ನು ಸಲ್ಲಿಸಲು ನೀಡಿರುವ ಕಾಲಾವದಿಯು ಸರ್ಕಾರಿ ಇಲಾಖೆಗಳಲ್ಲಿ ಸೇವೆ ಸಲ್ಲಿಸುತ್ತಿರುವ ಅಭ್ಯರ್ಥಿಗಳು ಸೇರಿದಂತೆ ಎಲ್ಲಾ

ಅಭ್ಯರ್ಥಿಗಳಿಗೂ ಅನ್ವಯವಾಗುವುದು.

3. ಅಗತ್ಯ ಪ್ರಮಾಣ ಪತ್ರಗಳನ್ನು ಲಗತ್ತಿಸದೆ ಇರುವ, ಲೋಪ / ಅಪೂರ್ಣ ಅರ್ಜಿಗಳನ್ನು ಹಾಗೂ ನಿಗದಿತ ದಿನಾಂಕದ ನಂತರ ಬಂದ

ಅರ್ಜಿಗಳನ್ನು ತಿರಸ್ಕರಿಸಲಾಗುವುದು.

4. ಅಭ್ಯರ್ಥಿಗಳು ಅರ್ಜಿಯನ್ನು ಸಲ್ಲಿಸಿದ ನಂತರ ಆ ಸಂಬಂಧ ಯಾವುದೇ ಪತ್ರ ವ್ಯವಹಾರಕ್ಕೆ ಅವಕಾಶವಿರುವುದಿಲ್ಲ.

ಕರ್ನಾಟಕ ಕೃಷಿ ಉತ್ಪನ್ನ ಮಾರುಕಟ್ಟೆ ವ್ಯವಹಾರ (ನಿಯಂತ್ರಣ ಮತ್ತು ಅಭಿವೃದ್ಧಿ) 1966ರ ಕಲಂ 74(ಡಿ)ರಲ್ಲಿ ಪ್ರಧಾನ ಮಾಡಲ್ಪಟ್ಟ ಅಧಿಕಾರವನ್ನು ಪ್ರಯೋಗಿಸುತ್ತಾ ಎಸ್.ಕೆ. ಬೆಳ್ಳುಬ್ಬಿ, ಕೃಷಿ ಮಾರುಕಟ್ಟೆ ಮತ್ತು ಹಜ್ó ಹಾಗೂ ವಕ್ಫ್ ಸಚಿವರು, ಕರ್ನಾಟಕ ಸರ್ಕಾರ ಆದ ನಾನು ಕರ್ನಾಟಕ ಕೃಷಿ ಉತ್ಪನ್ನ ಮಾರುಕಟ್ಟೆ ವ್ಯವಹಾರ (ನಿಯಂತ್ರಣ ಮತ್ತು ಅಭಿವೃದ್ಧಿ) (ತಿದ್ದುಪಡಿ) ಅಧಿನಿಯಮ 2009 ರಡಿಯಲ್ಲಿ ಸರ್ಕಾರದ ಮುಂದೆ ಇತ್ಯರ್ಥಕ್ಕಾಗಿ ಬಾಕಿ ಇರುವ / ದಾಖಲಾಗುವ ಅಪೀಲು ಮತ್ತು ಪುನರೀಕ್ಷಣಾ ಅರ್ಜಿಗಳನ್ನು ಹಾಗೂ ದಾಖಲಾಗುವ ಅಪೀಲುಗಳನ್ನು ವಿಚಾರಣೆ ಮಾಡಿ ನಿರ್ಣಯಿಸಿ, ವಿಲೇ ಮಾಡಲು ಸಹಕಾರ ಇಲಾಖೆಯ ಪ್ರಧಾನ ಕಾರ್ಯದರ್ಶಿ / ಕಾರ್ಯದರ್ಶಿಯವರಿಗೆ ವಿಶೇಷವಾಗಿ ನಿರ್ದೇಶನ ನೀಡಿರುತ್ತೇನೆ. ಈ ಆದೇಶವು ಕೂಡಲೇ ಜಾರಿಗೆ ಬಂದಿದ್ದು ಮುಂದಿನ ಆದೇಶದವರೆಗೆ ಜಾರಿಯಲ್ಲಿರುತ್ತದೆ.

1. ಈ ರಜೆ ಪಟ್ಟಿಯು ಭಾನುವಾರಗಳಂದು ಬರುವ ಮಹಾ ಶಿವರಾತ್ರಿ (10-03-2013), ಡಾ|| ಬಿ.ಆರ್. ಅಂಬೇಡ್ಕರ್ ಜಯಂತಿ (14-04-2013), ಮಹಾ ನವಮಿ, ಆಯುಧ ಪೂಜೆ (13-10-2013), ರಜಾ ದಿನಗಳನ್ನೊಳಗೊಂಡಿರುವುದಿಲ್ಲ.

2. ಸಾರ್ವತ್ರಿಕ ರಜಾ ದಿನಗಳಲ್ಲಿ ರಾಜ್ಯಾದ್ಯಂತ ಸರ್ಕಾರಿ ಕಚೇರಿಗಳು ಮುಚ್ಚಲ್ಪಡುತ್ತವೆ. ಕಚೇರಿಯ ಜರೂರು ಕೆಲಸವನ್ನು ವಿಲೇವಾರಿ ಮಾಡುವ ಬಗ್ಗೆ ಇಲಾಖಾ ಮುಖ್ಯಸ್ಥರುಗಳು ಸೂಕ್ತ ವ್ಯವಸ್ಥೆ ಮಾಡತಕ್ಕದ್ದು.

3. ಈ ಪಟ್ಟಿಯಲ್ಲಿ ಸೇರಿಸಲಾಗಿರುವ ಮುಸಲ್ಮಾನರ ಹಬ್ಬಗಳು ನಿಗದಿತ ದಿನಾಂಕದಂದು ಬೀಳದಿದ್ದರೆ ಸರ್ಕಾರಿ ಸೇವೆಯಲ್ಲಿರುವ ಮುಸಲ್ಮಾನರಿಗೆ ನಿಗದಿತ ರಜೆಗೆ ಬದಲಾಗಿ ಹಬ್ಬದ ದಿವಸ ರಜಾ ಮಂಜೂರು ಮಾಡಬಹುದು.

4. ದಿನಾಂಕ 17-10-2013 (ಗುರುವಾರ) ತುಲಾ ಸಂಕ್ರಮಣ ಆಚರಿಸಲು ಹಾಗೂ ದಿನಾಂಕ: 16-12-2013 (ಸೋಮವಾರ) ಹುತ್ತರಿ ಹಬ್ಬವನ್ನು ಆಚರಿಸಲು ಕೊಡಗು ಜಿಲ್ಲೆಗೆ ಮಾತ್ರ ಅನ್ವಯವಾಗುವಂತೆ ಸ್ಥಳೀಯ ಸಾರ್ವತ್ರಿಕ ರಜೆಯನ್ನು ಘೋಷಿಸಿದೆ.

5. ಶಿಕ್ಷಣ ಇಲಾಖೆಗೆ ಸಂಬಂಧಿಸಿದಂತೆ ಪ್ರತ್ಯೇಕ ರಜಾ ದಿನಗಳ ಪಟ್ಟಿಯನ್ನು ಬೆಂಗಳೂರಿನ ಸಾರ್ವಜನಿಕ ಶಿಕ್ಷಣ ಇಲಾಖೆಯ ಆಯುಕ್ತರು ಪ್ರಕಟಿಸುವರು.

6. ಸಾರ್ವತ್ರಿಕ ರಜೆ ದಿನಗಳ ಜೊತೆಗೆ ರಾಜ್ಯ ಸರ್ಕಾರಿ ನೌಕರರು 2 ದಿವಸಗಳಿಗೆ ಮೀರದಂತೆ 2013ನೇ ವರ್ಷದಲ್ಲಿ ಅಧಿಸೂಚನೆ ಅನುಬಂಧದಲ್ಲಿ ತಿಳಿಸಿರುವ ಪರಿಮಿತ ರಜೆಯನ್ನು ಪೂರ್ವಾನುಮತಿ ಪಡೆದು ಉಪಯೋಗಿಸಿಕೊಳ್ಳಬಹುದು. ಸಾಂದರ್ಭಿಕ ರಜೆಯನ್ನು ಮಂಜೂರು ಮಾಡಲು ಅಧಿಕಾರವುಳ್ಳ ಅಧಿಕಾರಿಗಳು ಪ್ರಸ್ತುತ ಅನುಮತಿಗೆ ಮಂಜೂರಾತಿ ನೀಡತಕ್ಕದ್ದು.

ಸೂಚನೆ:-

1. ಈ ರಜಾ ಪಟ್ಟಿಯು ಭಾನುವಾರಗಳಂದು ಬರುವ 10-03-2013 ಮಹಾ ಶಿವರಾತ್ರಿ, 14-04-2013 ಡಾ|| ಬಿ.ಆರ್. ಅಂಬೇಡ್ಕರ್ ಜಯಂತಿ, 13-10-2013 ಮಹಾನವಮಿ ಆಯುಧಪೂಜೆ, ರಜಾ ದಿನಗಳನ್ನೊಳಗೊಂಡಿರುವುದಿಲ್ಲ.

Note :

1. This list does not include Maha Shivaratri (10-03-2013), Dr. B.R. Ambedkar Jayanthi (14.04.2013), Maha Navami Ayudapooja (13-10-2013), which fall on Sundays.

2. Government offices will be closed through out the State on General Holidays. However Heads of Department should make necessary arrangements for the discharge of urgent work.

3. If any of the Muslim Holidays notified above does not fall on the date notified, Muslims in Government Service may be granted Holiday on the date of observance in lieu of the holidays already notified.

4. Local holiday is declared for Kodagu District only on account of Tulasankramana on 17-10-2013 (Thursday) and Huthri Festival on 16-12-2013 (Monday)

5. Separate list of Holidays will be published by the Commissioner of Public Instructions, Bangalore for the Education Department.

6. In addition to the General holidays the State Government employees may utilize any of the Restricted Holidays not exceeding two days during the year 2013 with previous permission from the authority who is authorised to sanction casual leave.

ಮತ್ತು ಸದರಿ ನಿಗದಿತ ಅವಧಿಯಲ್ಲಿ ಯಾವುದೇ ಸಲಹೆ ಅಥವಾ ಆಕ್ಷೇಪಣೆಗಳು ಸ್ವೀಕರಿಸಿಲ್ಲದಿರುವುದರಿಂದ;

ಈಗ, ಕರ್ನಾಟಕ ಸರ್ಕಾರವು, ಕರ್ನಾಟಕ ರಾಜ್ಯ ಸಿವಿಲ್ ಸೇವೆಗಳ ಅಧಿನಿಯಮ, 1978ರ (1990ರ ಕರ್ನಾಟಕ ಅಧಿನಿಯಮ 14) 3ನೇ ಪ್ರಕರಣದ (1)ನೇ ಉಪ ಪ್ರಕರಣವನ್ನು 8ನೇ ಪ್ರಕರಣದೊಡನೆ ಓದಿಕೊಂಡಂತೆ ಇದರಲ್ಲಿ ಪ್ರದತ್ತವಾದ ಅಧಿಕಾರಗಳನ್ನು ಚಲಾಯಿಸಿ, ಈ ಮೂಲಕ ಈ ಕೆಳಗಿನಂತೆ ನಿಯಮಗಳನ್ನು ರಚಿಸುತ್ತದೆ, ಎಂದರೆ:-

ನಿಯಮಗಳು

1. ಹೆಸರು ಮತ್ತು ಪ್ರಾರಂಭ.- (1) ಈ ನಿಯಮಗಳನ್ನು ಕರ್ನಾಟಕ ಸರ್ಕಾರ ಸಚಿವಾಲಯ ಸೇವೆಗಳು (ನೇಮಕಾತಿ) (ಎರಡನೇ ತಿದ್ದುಪಡಿ) ನಿಯಮಗಳು, 2012 ಎಂದು ಕರೆಯತಕ್ಕದ್ದು.

(2) ಈ ನಿಯಮಗಳು ಅವು ಸರ್ಕಾರಿ ರಾಜ್ಯಪತ್ರದಲ್ಲಿ ಪ್ರಕಟಗೊಂಡ ದಿನಾಂಕದಿಂದ ಜಾರಿಗೆ ಬರತಕ್ಕದ್ದು.

2. ಅನುಸೂಚಿಯ ತಿದ್ದುಪಡಿ.- ಕರ್ನಾಟಕ ಸರ್ಕಾರದ ಸಚಿವಾಲಯ ಸೇವೆಗಳು (ನೇಮಕಾತಿ) ನಿಯಮಗಳು, 1992ರ ಅನುಸೂಚಿಯಲ್ಲಿ "III. ಯೋಜನೆ, ಸಾಂಸ್ಥಿಕ ಹಣಕಾಸು ಮತ್ತು ಸಾಂಖ್ಯಿಕ ಹಾಗೂ ವಿಜ್ಞಾನ ಮತ್ತು ತಂತ್ರಜ್ಞಾನ ಇಲಾಖೆಯ ಯೋಜನಾ ವಿಭಾಗದ ಕಾರ್ಯನಿರ್ವಹಣಾ ಶಾಖೆಗಳು" ಶೀರ್ಷಿಕೆಯಡಿಯಲ್ಲಿ, ಕ್ರಮ ಸಂಖ್ಯೆ: 1ರಲ್ಲಿಯ `ಹಿರಿಯ ನಿರ್ದೇಶಕ' ಎಂಬ ಹುದ್ದೆಯ ಪ್ರವರ್ಗಕ್ಕೆ ಸಂಬಂಧಿಸಿದ ನಮೂದುಗಳಲ್ಲಿ (4)ನೇ ಅಂಕಣದಲ್ಲಿನ ನಮೂದುಗಳ ತರುವಾಯ ಈ ಮುಂದಿನದನ್ನು ಕೊನೆಯಲ್ಲಿ ಸೇರಿಸತಕ್ಕದ್ದು, ಎಂದರೆ:-

Whereas, the draft of the Karnataka Government Secretariat Services (Recruitment) (Second Amendment) Rules, 2012, was published as required by clause (a) of sub-section (2) of section 3 of the Karnataka State Civil Services Act, 1978 (Karnataka Act 14 of 1990) in Notification No. DPAR 88 SRD 2012, dated 15th September 2012 in Part IV-A of the Karnataka Gazette (Extra ordinary) dated 15th September, 2012 inviting objections and suggestions from all persons likely to be affected thereby within fifteen days from the date of publication in the official Gazette.

And whereas, the said Gazette was made available to public on 15th September, 2012.

And whereas, no objections and suggestions have been received by the State Government.

Now, therefore, in exercise of the powers conferred by sub-section (1) of section 3 read with section 8 of the Karnataka State Civil Services Act, 1978 (Karnataka Act 14 of 1990), the Government of Karnataka hereby makes the following rules namely:-

RULES

1. Title and Commencement.- (1) These rules may be called the Karnataka Government Secretariat Services (Recruitment) (Second Amendment) Rules, 2012.

(2) They shall come into force from the date of their publication in the official Gazette.

2. Amendment of Schedule.- In the Karnataka Government Secretariat Services (Recruitment) Rules, 1992, in Schedule under the heading "III. FUNCTIONAL DIVISIONS OF PLANNING WING OF PLANNING, INSTITUTIONAL FINANCE AND STATISTICS AND SCIENCE AND TECHNOLOGY DEPARTMENT", in the entries relating to the category of post of "Senior Director", at Serial No.1, after the entries in column (4), the following shall be inserted at the end, namely:-

"Provided that if persons who have put in a service of not less than six years are not available, persons who have put in a service of not less than four years may be considered for promotion.".

Whereas, the State Government considered that conditions have changed since the publication of the notification No. SARIE 188 SAEPA 2008 dated 03-11-2010 in respect of the maximum rates of fares and freights fixed for Stage Carriages in the State.

And whereas, it is considered necessary to supersede the direction issued to the State Transport Authority and Regional Transport Authority in the said notification in respect of the maximum rates of fares and freights fixed for Stage Carriages in the state.

Now, therefore in exercise of the powers conferred by sub-section (1) (i) of section 67 of Motor Vehicles Act 1988 (Act No 59 of 1988) and in supersession of the Notification No. SARIE 188 SAEPA 2008 dated 03-11-2010, the Government of Karnataka here by issue the following directions to the Karnataka State Transport Authority and the Regional Transport Authority namely:-

The Karnataka State Transport Authority and the Regional Transport Authority is directed to fix with effect from the date of this notification, the following maximum rates of fares and freights for Stage Carriages in the State,

Note: Wherever the operators pay road user fee, entry fee, bridge fee, toll fee etc., the same may be recovered from the passengers on pro rata basis. Any other fee collected for any other purpose and not spent for the same will be set off during next fare revision along with interest earned thereon.

Explanation:-

(i) An Express Stage Carriage is a Stage Carriage plying on a route covering a distance of not less than 25 Kms with specified and limited halts and not stopping at every bus stop or Stage to pick up or set down passengers,

(ii) Semi-Luxury/semi-deluxe coaches are carriages fitted with foam cushions and head rest,

(iii) Luxury/super deluxe coaches are carriages fitted with foam cushions and head rest and reclining seats (iv) Hi-tech buses/carriages are those providing comfortable sleeping while seating for the passenger.

IV). Luggage:- Where the weight of the luggage does not exceed 20Kgs., a luggage surcharge is payable by every passenger at 10 paise for every two stages or part thereof subject to a minimum of 50 paise and a maximum of Rs 3.50 together with the passenger fares and where the weight of the luggage exceeds 20 Kgs, the freight charges shall be as follows:-

Not exceeding 50 paise per unit of 15 Kgs weight per stage of 6.5 Kms or part thereof subject to a minimum of Rs 3.5 per percel.

V) Children: Between the age of 6 and 12 years may be charged at the adult rate of fares for journeys in luxury, super deluxe, Hi-tech and A/C services and at ½ the above rates for city/suburban and mofussil ordinary, express and semi- luxury coach services subject to a minimum of respective adult fares, rounding off the fare to the next higher multiple of 50 paise in case of suburban and mofussil ordinary services and to the next higher multiple of a rupee in case of remaining services.

VI) Surcharge:- (i) As and when the rate of the HSD, oil or lubricants or rubber products, steel and wages is increased either by levy of excise duty or sales tax or otherwise, a surcharge on passenger fares not exceeding four paise per passenger Km. Subject to a minimum of 25 paise is liveable.

(ii) For the use of Bus-station built at a cost of Rs 50 lakh or more, a surcharge not exceeding one rupee per head is liveable together with journey fare or separately.

ಸದರಿ ರಾಜ್ಯಪತ್ರವನ್ನು ದಿನಾಂಕ:1 ನೇ ಅಕ್ಟೋಬರ್ 2012 ರಂದು ಸಾರ್ವಜನಿಕರಿಗೆ ಲಭ್ಯವಾಗುವಂತೆ ಮಾಡಲಾಗಿತ್ತು.

ಸದರಿ ಪ್ರಕಟಣೆಗಳಿಗೆದುರಾಗಿ ಆಕ್ಷೇಪಣೆ ಮತ್ತು ಸೂಚನೆಗಳು ರಾಜ್ಯ ಸರ್ಕಾರದಿಂದ ಸ್ವಿಕರಿಸಲ್ಪಟ್ಟರುವುದಿಲ್ಲ

ಈಗ, ಕರ್ನಾಟಕ ಸರ್ಕಾರಿ ಸೇವೆಗಳ ಅಧಿನಿಯಮ, 1978 (1990 ರ ಕರ್ನಾಟಕ ಅಧಿನಿಯಮ 14) ರ 8ನೇ ಪ್ರಕರಣದೊಂದಿಗೆ ಓದಿಕೊಂಡ 3 ನೇ ಪ್ರಕರಣದ (1) ನೇ ಉಪ ಪ್ರಕರಣದ ಮೂಲಕ ಪ್ರದತ್ತವಾದ ಅಧಿಕಾರಗಳನ್ನು ಚಲಾಯಿಸಿ, ಕರ್ನಾಟಕ ಸರ್ಕಾರವು ಈ ಮುಂದಿನ ನಿಯಮಗಳನ್ನು ರಚಿಸಿದೆ. ಎಂದರೆ:-

ನಿಯಮಗಳು

1. ಶೀರ್ಷಿಕೆ ಮತ್ತು ಪ್ರಾರಂಭ:- (1) ಈ ನಿಯಮಗಳನ್ನು ಕರ್ನಾಟಕ ಪಶುಪಾಲನಾ ಮತ್ತು ಪಶುವೈದ್ಯಕೀಯ ಸೇವೆಗಳು (ಪಶುವೈದ್ಯರ ನೇಮಕಾತಿ) (ವಿಶೇಷ ನೇಮಕಾತಿ) ನಿಯಮಗಳು, 2012 ಎಂದು ಕರೆಯತಕ್ಕದ್ದು.

(2) ಈ ನಿಯಮಗಳು ಅಧಿಕೃತ ರಾಜ್ಯಪತ್ರದಲ್ಲಿ ಪ್ರಕಟಗೊಂಡ ದಿನಾಂಕದಿಂದ ಜಾರಿಗೆ ಬರತಕ್ಕದ್ದು.

(3) ಕರ್ನಾಟಕ ನಾಗರೀಕ ಸೇವಾ (ಸಾಮಾನ್ಯ ನೇಮಕಾತಿ) ನಿಯಮಗಳು, 1977 ಅಥವಾ ಕರ್ನಾಟಕ ನಾಗರೀಕ ಸೇವಾ (ಸ್ಪರ್ಧಾತ್ಮಕ ಪರೀಕ್ಷೆಗಳ ಮೂಲಕ ನೇರ ನೇಮಕಾತಿ ಮತ್ತು ಆಯ್ಕೆ) (ಸಾಮಾನ್ಯ) ನಿಯಮಗಳು, 2006 ಅಥವಾ ಕರ್ನಾಟಕ ಪಶುಪಾಲನಾ ಮತ್ತು ಪಶುವೈದ್ಯ ಸೇವೆಗಳು5970 (ನೇಮಕಾತಿ) ನಿಯಮಗಳು, 1965 ಅಥವಾ ಸರ್ಕಾರಿ ಸೇವಾ ಅಧಿನಿಯಮ 1978 ರ (1990 ರ ಕರ್ನಾಟಕ ಅಧಿನಿಯಮ 14) ಮೇರೆಗೆ ರಚಿಸಲಾದ ಅಥವಾ ರಚಿಸಲಾಗಿದೆ ಎಂದು ಭಾವಿಸಲಾದ ಯಾವುದೇ ಇತರ ನಿಯಮಗಳಲ್ಲಿ ಏನೇ ಒಳಗೊಂಡಿದ್ದಾಗ್ಯೂ ಪಶುವೈದ್ಯಾಧಿಕಾರಿಗಳ ನೇಮಕಾತಿ ಕುರಿತಂತೆ ಎನೇ ಇದ್ದರೂ, ಪಶುಪಾಲನಾ ಮತ್ತು ಪಶುವೈದ್ಯಕೀಯ ಸೇವೆಗಳಲ್ಲಿ, ಅನುಸೂಚಿಯಲ್ಲಿ ನಮೂದಿಸಿದ ನೇರನೇಮಕಾತಿ ಹುದ್ದೆಗಳಾದ 391 ಪಶು ವೈದ್ಯಾಧಿಕಾರಿಗಳ ಪ್ರವರ್ಗದ ನೇರ ನೇಮಕಾತಿ ರಿಕ್ತ ಸ್ಥಾನಗಳಿಗೆ ಈ ನಿಯಮಗಳ ನೇಮಕಾತಿ ವಿಧಾನ ಅನ್ವಯಿಸತಕ್ಕದ್ದು.

ಒದಗಿಸಿದ ಒಂದಕ್ಕಿಂತ ಹೆಚ್ಚಿನ ನೇಮಕಾತಿಗೆ ಈ ನಿಯಮಗಳು ಅನ್ವಯವಾಗತಕ್ಕದ್ದಲ್ಲ.

2. ಪರಿಭಾಷೆಗಳು:- (1) ನಿಯಮಗಳಲ್ಲಿ ಸಂದರ್ಭವು ಅನ್ಯಥಾ ಅಗತ್ಯಪಡಿಸಿದ ಹೊರತು:-

(ಅ) 'ಸಮಿತಿ' ಎಂದರೆ ನಿಯಮ 3 ರಡಿ ರಚಿಸಲಾದ ರಾಜ್ಯ ಮಟ್ಟದ ಆಯ್ಕೆ ಸಮಿತಿ.

(ಆ) 'ಅರ್ಹತಾ ಪರೀಕ್ಷೆ' ಎಂದರೆ ಅನುಸೂಚಿಯಲ್ಲಿರುವ ಹುದ್ದೆಗಳ ನೇಮಕಾತಿಗೆ ಪದವಿಯಾಗಿ ನಿಗದಿಪಡಿಸಿದ ಕನಿಷ್ಟ ವಿದ್ಯಾರ್ಹತೆ.

(ಇ) 'ಅನುಸೂಚಿ' ಎಂದರೆ ಈ ನಿಯಮಗಳಿಗೆ ಸೇರಿಸಲಾದ ಅನುಸೂಚಿ.

(ಈ) 'ಖಾಲಿ ಸ್ಥಾನ' ಎಂದರೆ ಈ ನಿಯಮಗಳಡಿಯಲ್ಲಿ ಭರ್ತಿ ಮಾಡಲಾಗುವ ಖಾಲಿ ಹುದ್ದೆಗಳು.

(ಉ) ಈ ನಿಯಮಗಳಲ್ಲಿ ಬಳಸಲಾಗಿರುವ ಆದರೆ ಪರಿಭಾಷಿಸಿಲ್ಲದ ಇತರೆ ಪದಗಳು ಮತ್ತು ವ್ಯಾಖ್ಯಾನಗಳು ಕರ್ನಾಟಕ ನಾಗರೀಕ ಸೇವಾ (ಸಾಮಾನ್ಯ ನೇಮಕಾತಿ) ನಿಯಮಗಳು, 1977ರಲ್ಲಿ ಅನುಕ್ರಮವಾಗಿ ಅವುಗಳಿಗೆ ನೀಡಲಾದ ಅರ್ಥಗಳನ್ನು ಹೊಂದಿರತಕ್ಕದ್ದು.

3. ರಾಜ್ಯ ಮಟ್ಟದ ಆಯ್ಕೆ ಸಮಿತಿ:- ಕರ್ನಾಟಕ ನಾಗರೀಕ ಸೇವಾ (ಸಾಮಾನ್ಯ ನೇಮಕಾತಿ) ನಿಯಮಗಳು, 1977 ರಲ್ಲಿರುವುದಕ್ಕೆ ತದ್ವಿರುದ್ಧವಾಗಿ ಏನೇ ಇದ್ದರೂ ಅಥವಾ ಪಶುವೈದ್ಯಾಧಿಕಾರಿಗಳ ವೃಂದದ ನೇಮಕಾತಿಗೆ ವಿಶೇಷವಾಗಿ ಮಾಡಿದ ನಿಯಮದಂತೆ ರಾಜ್ಯಮಟ್ಟದ ನೇಮಕಾತಿ ಸಮಿತಿ (ಇನ್ನು ಮುಂದೆ ಸಮಿತಿ ಎಂದು ಉಲ್ಲೇಖಿಸುವ) ಕೆಳಗಿನಂತೆ ಸದಸ್ಯರುಗಳನ್ನು ಒಳಗೊಂಡಿರತಕ್ಕದ್ದು. ಅಂದರೆ :-

1) ಆಯುಕ್ತರು

: ಅಧ್ಯಕ್ಷರು

4. ನೇಮಕಾತಿ ವಿಧಾನ:- (1) ಸಮಿತಿಯ ಈ ನಿಯಮದಡಿ ಭರ್ತಿ ಮಾಡಬೇಕಾದ ಖಾಲಿ ಹುದ್ದೆಗಳನ್ನು ಗಮನದಲ್ಲಿರಿಸಿಕೊಂಡು, ಅರ್ಹತಾ ಷರತ್ತು, ಆಯ್ಕೆ ವಿಧಾನ, ಭರ್ತಿ ಮಾಡಲಾಗುವ ಹುದ್ದೆಗಳ ಸಂಖ್ಯೆ ಮತ್ತು ಯಾವುದೇ ಕಾನೂನಿನಡಿ ಮತ್ತು ಯಾವುದೇ ಆದೇಶಗಳಡಿ ಒದಗಿಸಲಾದ ಮೀಸಲಾತಿಯಂತೆ ತತ್ಕಾಲಕ್ಕೆ ಜಾರಿಯಲ್ಲಿರುವ ವರ್ಗೀಕರಿಸಿದ ಹುದ್ದೆಗಳನ್ನಾಧರಿಸಿ ಅಧಿಕೃತ ರಾಜ್ಯಪತ್ರದಲ್ಲಿ ನಿರ್ಧಿಷ್ಟಪಡಿಸಿ, ಉದ್ದೇಶಿತ ಅಭ್ಯರ್ಥಿಗಳಿಂದ ಅರ್ಜಿಗಳನ್ನು ಆಹ್ವಾನಿಸತಕ್ಕದ್ದು. ಆ ಜಾಹಿರಾತಿನ ಸಾರಾಂಶವನ್ನು ರಾಜ್ಯದಲ್ಲಿ ಹೆಚ್ಚು ಪ್ರಸಾರವಾಗುವ ಎರಡು ದಿನಪತ್ರಿಕೆಗಳಲ್ಲಿ ಪ್ರಕಟಿಸತಕ್ಕದ್ದು. ಅದರಲ್ಲಿ ಒಂದು ಕನ್ನಡವಾಗಿರತಕ್ಕದ್ದು.

(2) ಉಪ ನಿಯಮ (1) ರ ಪ್ರಕಟಣೆಗೆ ಅನುಗುಣವಾಗಿ ಅರ್ಜಿ ಸಲ್ಲಿಸಿದ ಅಭ್ಯರ್ಥಿಗಳಲ್ಲಿನ ಅರ್ಹತಾನುಸಾರ ನೇಮಕಾತಿಗೆ ಅರ್ಹತೆ ಪಡೆದ ಅಭ್ಯರ್ಥಿಗಳ ಪಟ್ಟಿಯನ್ನು ಅರ್ಹತಾ ಪರೀಕ್ಷೆಯಲ್ಲಿ ಪಡೆದ ಶೇಕಡಾವಾರು ಒಟ್ಟು ಅಂಕಗಳು ಮತ್ತು ತತ್ಕಾಲದಲ್ಲಿ ಜಾರಿಯಲ್ಲಿರುವ ಕಾನೂನಿನಡಿ ಮತ್ತು ಆದೇಶಗಳಡಿ ಹುದ್ದೆಗಳಿಗೆ ಒದಗಿಸಿದ ಮೀಸಲಾತಿಯಂತೆ ನೇಮಕಾತಿಗೆ ಅರ್ಹ ಅಭ್ಯರ್ಥಿಗಳ ಪಟ್ಟಿಯನ್ನು ಸಮಿತಿ ಸಿದ್ಧಪಡಿಸತಕ್ಕದ್ದು.

(3) ಉಪ ನಿಯಮ (2) ರಂತೆ ಆಯ್ಕೆ ಮಾಡಲಾಗುವ ಅಭ್ಯರ್ಥಿಗಳ ಸಂಖ್ಯೆಯು ಪ್ರಕಟಿಸಿದ ಖಾಲಿ ಹುದ್ದೆಗಳಿಗೆ ಅನುಗುಣವಾಗಿರತಕ್ಕದ್ದು.

(4) ಇಬ್ಬರು ಅಥವಾ ಹೆಚ್ಚಿನ ಅಭ್ಯರ್ಥಿಗಳು ಸಮಾನ ಅಂಕಗಳನ್ನು ಪಡೆದ ಪಕ್ಷದಲ್ಲಿ ಅಂತಹ ಅಭ್ಯರ್ಥಿಗಳ ಶ್ರೇಣಿಯನ್ನು ಅವರ ವಯಸ್ಸಿನ ಆಧಾರದ ಮೇಲೆ, ವಯಸ್ಸಿನಲ್ಲಿ ಹಿರಿಯನಾದವನನ್ನು ಕಿರಿಯವನಿಗಿಂತ ಮೇಲಿರಿಸಿ ನಿರ್ಧರಿಸತಕ್ಕದ್ದು. ಅರ್ಹ ಅಭ್ಯರ್ಥಿಗಳ ಸಂಖ್ಯೆಯ ಪಟ್ಟಿ ಅನುಸೂಚಿಯಲ್ಲಿ ನಿರ್ಧಿಷ್ಟಪಡಿಸಿದ ಹುದ್ದೆಗಳಿಗನುಗುಣವಾಗಿರತಕ್ಕದ್ದು.

(5) ಉಪ ನಿಯಮ (2) ರಂತೆ ತಯಾರಿಸಲಾದ ಪಟ್ಟಿಯಲ್ಲಿ ಸೇರ್ಪಡೆಯಾಗದಂತಹ ಅಭ್ಯರ್ಥಿಗಳ ಹೆಚ್ಚುವರಿ ಪಟ್ಟಿಯನ್ನು ಸಹ ಸಮಿತಿಯು ತಯಾರಿಸತಕ್ಕದ್ದು. ಹೆಚ್ಚುವರಿ ಪಟ್ಟಿಯಲ್ಲಿ ಸೇರಿಸಬೇಕಾದ ಅಭ್ಯರ್ಥಿಗಳ ಸಂಖ್ಯೆಯು ಸಾದ್ಯವಾದಷ್ಟು ಮಟ್ಟಿಗೆ ಉಪ ನಿಯಮ (2) ರಡಿಯಲ್ಲಿ ತಯಾರಿಸಲಾದ ಆಯ್ಕೆ ಪಟ್ಟಿಯ ಪ್ರತಿಯೊಂದು ಮೀಸಲಾತಿ ವೃಂದಗಳ (ಸಮತಲ ಮತ್ತು ನೇರ) ಶೇಕಡಾ. 10 ರಷ್ಟಿರತಕ್ಕದ್ದು. ಹೆಚ್ಚುವರಿ ಪಟ್ಟಿಯಲ್ಲಿ ಉಪ ನಿಯಮ (2) ರಂತೆ ಪ್ರತಿ ಮೀಸಲಾತಿ ವೃಂದದಲ್ಲಿ (ಸಮತಲ ಮತ್ತು ನೇರ) ಕನಿಷ್ಟ ಪಕ್ಷ ಒಬ್ಬ ಅಭ್ಯರ್ಥಿಯಾದರೂ ಇರಬೇಕು. ಉಪ ನಿಯಮ (2) ರಂತೆ ಆಯ್ಕೆ ಪಟ್ಟಿಯಲ್ಲಿ ಸೇರಿಸಲಾದ ಅಭ್ಯರ್ಥಿಯು ನಿರ್ಧಿಷ್ಟಪಡಿಸಿದ ಅವಧಿಯೊಳಗೆ ಕರ್ತವ್ಯಕ್ಕೆ ಹಾಜರಾಗಲು ವಿಫಲವಾದಲ್ಲಿ, ಕರ್ತವ್ಯಕ್ಕೆ (6) ಉಪನಿಯಮ (2) ಮತ್ತು (5) ರಂತೆ ಸಿದ್ಧಪಡಿಸಿದ ಪಟ್ಟಿಯನ್ನು ರಾಜ್ಯಪತ್ರದಲ್ಲಿ ಮತ್ತು ಸಮಿತಿಯ ಕಛೇರಿಯ ಸೂಚನಾ ಫಲಕದಲ್ಲಿ ಪ್ರಕಟಿಸತಕ್ಕದ್ದು.

(7) ಸಮಿತಿ ಆಯ್ಕೆ ಮಾಡಿದ ಅಭ್ಯರ್ಥಿಗಳ ಪಟ್ಟಿ ಮತ್ತು ನೇಮಕಾತಿ ಪ್ರಾಧಿಕಾರಕ್ಕೆ ನೀಡಿದ ಪಟ್ಟಿಯಲ್ಲಿನ ಪ್ರಕಟಿತ ಎಲ್ಲಾ ಹುದ್ದೆಗಳು ಭರ್ತಿಯಾಗುವವರೆಗೆ ಅಥವಾ ಆಯ್ಕೆ ಪಟ್ಟಿ ಪ್ರಕಟವಾದ ದಿನಾಂಕದಿಂದ 1 ವರ್ಷದವರೆಗೆ ಇದರಲ್ಲಿ ಯಾವುದು ಮೊದಲೋ ಅಲ್ಲಿಯವರೆಗೆ ಸಿಂಧುವಾಗಿರತಕ್ಕದ್ದು.

5. ಅಭ್ಯರ್ಥಿಗಳ ನೇಮಕಾತಿ:- (1) ನಿಯಮ 4 ರಡಿಯಲ್ಲಿ ತಯಾರಿಸಲಾದ ಆಯ್ಕೆ ಪಟ್ಟಿಯಲ್ಲಿ ಯಾವ ಅಭ್ಯರ್ಥಿಗಳ ಹೆಸರು ಸೇರ್ಪಡೆಯಾಗುತ್ತದೋ, ಅವರ ಹೆಸರು, ಖಾಲಿ ಹುದ್ದೆಗಳ ರಿಕ್ತ ಸ್ಥಾನದ ಯಾವ ಒಂದು ಕ್ರಮದಲ್ಲಿ ಬರುತ್ತದೋ ಆ ಪಟ್ಟಿಯನ್ನು ನೋಡಿಕೊಂಡು, ಅಗತ್ಯವೆನಿಸಿದ ವಿಚಾರಣೆಯ ನಂತರ ಪ್ರತಿ ಅಭ್ಯರ್ಥಿ ಎಲ್ಲಾ ವಿಧದಲ್ಲೂ ನೇಮಕಾತಿಗೆ ಅರ್ಹನಾಗಿದ್ದಾನೆ ಎಂಬುದನ್ನು ಮನದಟ್ಟು ಮಾಡಿಕೊಂಡ ನಂತರ ನೇಮಕಾತಿ ಪ್ರಾಧಿಕಾರ ಅವರನ್ನು ನೇಮಕಾತಿ ಮಾಡತಕ್ಕದ್ದು.

(2) ನಿಯಮ 4 ರ ಉಪ ನಿಯಮ (7) ರಂತೆ ಪ್ರಕಟಿಸಲಾದ ಪಟ್ಟಿಯಲ್ಲಿ ಅಭ್ಯರ್ಥಿಯ ಹೆಸರನ್ನು ಸೇರ್ಪಡೆ ಮಾಡಿ ಪ್ರಕಟಿಸಿದ ಮಾತ್ರಕ್ಕೆ ನೇಮಕಾತಿ ಪ್ರಧಾನ ಮಾಡಲು ಹಕ್ಕುಳ್ಳವನಾಗಿರತಕ್ಕದಲ್ಲ.

6. ಸಾಮಾನ್ಯ ನೇಮಕಾತಿ ನಿಯಮಗಳು ಅನ್ವಯ:- ಈ ನಿಯಮಗಳಲ್ಲಿ ಅವಕಾಶ ಮಾಡಲಾದ ವಿಷಯಗಳನ್ನು ಹೊರತುಪಡಿಸಿ, ಪ್ರಸ್ತುತ ಚಾಲ್ತಿಯಲ್ಲಿರುವ ಕರ್ನಾಟಕ ರಾಜ್ಯ ನಾಗರೀಕ ಸೇವಾ (ಸಾಮಾನ್ಯ ನೇಮಕಾತಿ) ನಿಯಮಗಳು, 1977 ರಲ್ಲಿ ಮಾಡಿರುವ ಸದ್ಯಕ್ಕೆ ಚಾಲ್ತಿಯಲ್ಲಿರುವ ಅವಕಾಶಗಳು ಈ ನಿಯಮದಡಿಯಲ್ಲಿ ಮಾಡುವ ನೇಮಕಾತಿಗಳಿಗೆ ಅನ್ವಯವಾಗತಕ್ಕದ್ದು.

Whereas, the draft of the Karnataka Animal Husbandry & Veterinary Services (Recruitment of Veterinary Officers) (Special Recruitment) Rules, 2012, was published as required by clause (a) of sub-section (2) of section 3 of the Karnataka State Civil Services Act, 1978 (Karnataka Act 14 of 1990) Notification No. AHF 94 VAH 2009, dated; 29th September 2012 in Part IV-A No. 691 of the Karnataka Extraordinary Gazette dated 1st October 2012. Inviting objections/suggestions from all persons likely to be affected thereby within fifteen days from the date of its publication in the Official Gazette.

And whereas, the said Gazette was made available to the public on 1st October 2012;

And whereas, no objections/suggestions have been received by the State Government;

Now, therefore, in exercise of the powers conferred by sub section (1) of section 3 read with section 8 of Karnataka State Civil Services Act, 1978 (Karnataka Act 14 of 1990), the Government of Karnataka hereby makes the following rules, namely;-

RULES

1. Title and commencement:- (1) These rules may be called the Karnataka Animal Husbandry and Veterinary Services (Recruitment of Veterinary Officers) (Special Recruitment) Rules, 2012.

(2) These Rules shall come into force from the date of their publication in the Official Gazette.

(3) Notwithstanding anything contained in the Karnataka Civil Services (General Recruitment) Rules, 1977 or the Karnataka Civil Services (Direct – Recruitment by Competitive Examination and Selection) (General) Rules, 2006 or in the Karnataka Animal Husbandry and Veterinary Services (Recruitment) Rules, 1965, or in any other rules made or deemed to have been made, under the Karnataka State Civil Services Act, 1978 (Karnataka Act 14 of 1990) pertaining to the method of recruitment to Veterinary Officers the provisions of these rules shall apply to recruitment of 391 direct recruitment vacancies in the categories of posts of Veterinary officers in the Animal Husbandry and Veterinary Services as specified in the Schedule.

Provided that nothing in these rules shall apply to more than one recruitment

2. Definitions:- (1) In these rules unless the context otherwise requires:-

(a) "Committee" means the State Level Selection Committee constituted under rule 3;

(b) "Qualifying Examination" means the examination leading to a degree specified as minimum qualification for recruitment to the posts in the schedule

(c) "Schedule" means a Schedule appended to these rules;

(d) "Vacancies" mean the number of vacant posts to be filled up under these rules.

(e) Other words and expressions used in these rules, but not defined shall have the same meaning assigned to them in the Karnataka Civil Services (General Recruitment) Rules, 1977.

3. State Level Selection Committee :- Notwithstanding anything to the contrary contained in the Karnataka Civil Services (General Recruitment) Rules, 1977 or rules of recruitments specially made for recruitment to the categories of posts of Veterinary Officers, recruitment shall be made under these rules by the State Level Selection Committee (hereinafter referred to as Committee) consisting of the following members, namely :-

(1) The Commissioner of Animal Husbandry and Veterinary

: Chairman Services Department, Bangalore.

(2) The Director of Animal Husbandry and Veterinary Services

: Member Department, Bangalore.

(3) The Commissioner of Social Welfare Department, Bangalore

: Member or his representatives not below the rank of Joint Commissioner.

(4) The Director of Tribal Welfare Department, Bangalore or

: Member his representative.

(5) The Director of Backward Classes or his representative

: Member (6) The Director of Minority Welfare Department, Bangalore

: Member or his representative.

(7) The Director of Women and Children Welfare Department

: Member Bangalore or his representative.

(8) The Joint Director (Administration )

: Member- Commissionerate of Animal Husbandry and

secretary Veterinary Services, Bangalore

4. Method of Recruitment :- (1) The Committee shall, after taking into consideration the vacancies to be filled up under these rules, advertise the vacancies in the Official Gazette specifying the conditions of eligibility, nature of selection, number of vacancies to be filled and classification in accordance with reservation of posts provided by or under any law or any order for the time being in force, invite applications from the intending candidates. Abstract of such advertisement shall also be published in two daily newspapers having wide circulation in the State of which one shall be in Kannada.

(2) The Committee shall from among the candidates who have applied in pursuance to the publication made under sub-rule (1), prepare in the order of merit, a selection list of candidates eligible for appointment under these rules on the basis of aggregate percentage of marks secured in the qualifying examination and the reservation of posts provided by or under any law or any order for the time being in force.

(3) The number of candidates to be selected under sub-rule (2) shall be equal to the number of vacancies notified.

(4) If the marks secured by two or more candidates is equal, then the order of merit in respect of such candidates shall be fixed on the basis of their age, the older in age being placed above the younger. The number of candidates to be included in such list of eligible candidates shall be equal to number of vacancies specified in the schedule.

(5) The Committee shall also prepare an additional list of such of the candidates not included in the list prepared under sub-rule (2) The number of candidates to be included in the additional list shall be as far as possible 10% of the number of candidates in each of the reservation categories (horizontal and vertical) in the list under sub-rule (2). There shall be atleast one candidate in the additional list belonging to each of the reservation categories (horizontal and vertical) represented in the list under sub-rule (2). If a candidate whose name is included in the list under sub-rule (2) fails to report for duty within the prescribed period, to that extent a candidate belonging to the same reservation category as that of the candidate who failed to report for duty shall be appointed from the additional list.

(6) The lists so prepared under sub-rule (2) and (5) shall be published in the Official Gazette and also on the notice board of the office of the Commissioner.

(7) The list of candidates selected by the Committee and assigned to the appointing authority shall be valid till all the notified vacancies are filled or till the completion of 1 year from the date of publication of the selected list whichever is earlier.

5. Appointment of candidates:- (1) Candidates whose names are included in the selection list prepared under rule 4 may be appointed by the appointing authority in the vacancies in the order of which their names are found in the list after satisfying itself after such enquiry as it may consider necessary that each of the candidates is suitable in all respects for appointment.

(2) The inclusion of name of a candidate in the list published under sub-rule (7) of rule 4 shall not confer any right of appointment.

6. Application of general recruitment rules:- Except in respect of matters for which provision is made in these rules, the provisions of the Karnataka State Civil Services (General Recruitment) Rules, 1977 for the time being in force, shall be applicable for the purpose of recruitment under these rules.

ಕರ್ನಾಟಕ ರಾಜ್ಯ ಸಿವಿಲ್ ಸೇವೆಗಳ ಅಧಿನಿಯಮ, 1978 (1990ರ ಕರ್ನಾಟಕ ಅಧಿನಿಯಮ 14) 3ನೇ ಪ್ರಕರಣದ (2)ನೇ ಉಪಪ್ರಕರಣ (ಎ) ಖಂಡದ ಮೂಲಕ ಅಗತ್ಯ ಪಡಿಸಲಾದಂತೆ, ಅಧಿಸೂಚನೆ ಸಂಖ್ಯೆ: ಡಿಪಿಎಆರ್ 26 ಹೆಚ್ಇಟಿ 2003, ದಿನಾಂಕ: 03ನೇ ಅಕ್ಟೋಬರ್ 2012ರಲ್ಲಿ ಕರ್ನಾಟಕ ಸಾಮಾನ್ಯ ಸೇವೆಗಳ (ಸರ್ಕಾರಿ ಅತಿಥಿ ವ್ಯವಸ್ಥೆ ನೇಮಕಾತಿ) ತಿದ್ದುಪಡಿ ನಿಯಮಗಳು 2012ರ ಕರಡನ್ನು, ಕರ್ನಾಟಕ ರಾಜ್ಯಪತ್ರದ ವಿಶೇಷ ಸಂಚಿಕೆಯ ಭಾಗ-IVಎ ರಲ್ಲಿ, ಪ್ರಕಟಿಸಿ, ಕರ್ನಾಟಕ ರಾಜ್ಯ ಪತ್ರದಲ್ಲಿ ಪ್ರಕಟಣೆಯ ದಿನಾಂಕದಿಂದ ಹದಿನೈದು ದಿನಗಳೊಳಗೆ ಅದರಿಂದ ಬಾಧಿತರಾಗಬಹುದಾದ ಎಲ್ಲಾ ವ್ಯಕ್ತಿಗಳಿಂದ ಆಕ್ಷೇಪಣೆಗಳು ಮತ್ತು ಸಲಹೆಗಳನ್ನು ಆಹ್ವಾನಿಸಿ ಪ್ರಕಟಪಡಿಸಲಾಗಿದೆ.

ಮತ್ತು ಸದರಿ ರಾಜ್ಯಪತ್ರವು, ದಿನಾಂಕ: 05ನೇ ಅಕ್ಟೋಬರ್ 2012ರಂದು ಸಾರ್ವಜನಿಕರಿಗೆ ಲಭ್ಯವಾಗುವಂತೆ ಮಾಡಲಾಗಿದೆ.

ಮತ್ತು ಸದರಿ ನಿಗದಿತ ಅವಧಿಯಲ್ಲಿ ಯಾವುದೇ ಸಲಹೆಗಳು ಮತ್ತು ಆಕ್ಷೇಪಣೆಗಳನ್ನು ಬಾಧಿತರಿಂದ ಸ್ವೀಕರಿಸಿಲ್ಲದಿರುವುದರಿಂದ:

ಈಗ, ಕರ್ನಾಟಕ ಸರ್ಕಾರವು, ಕರ್ನಾಟಕ ರಾಜ್ಯ ಸಿವಿಲ್ ಸೇವೆಗಳ ಅಧಿನಿಯಮ 1978 (1990ರ ಕರ್ನಾಟಕ ಅಧಿನಿಯಮ 14)ರ 3ನೇ ಪ್ರಕರಣದ (1)ನೇ ಉಪ ಪ್ರಕರಣವನ್ನು 8ನೇ ಪ್ರಕರಣದೊಡನೆ ಓದಿಕೊಂಡಂತೆ ಇದರಲ್ಲಿ ಪ್ರದತ್ತವಾದ ಅಧಿಕಾರಗಳನ್ನು ಚಲಾಯಿಸಿ, ಈ ಮೂಲಕ ಈ ಕೆಳಗಿನಂತೆ ನಿಯಮಗಳನ್ನು ರಚಿಸುತ್ತದೆ, ಎಂದರೆ:-

ನಿಯಮಗಳು

1. ಹೆಸರು ಮತ್ತು ಪ್ರಾರಂಭ.- (1) ಈ ನಿಯಮಗಳನ್ನು ಕರ್ನಾಟಕ ಸಾಮಾನ್ಯ ಸೇವೆಗಳ (ಸರ್ಕಾರಿ ಅತಿಥಿ ಸಂಸ್ಥೆ ನೇಮಕಾತಿ) (ತಿದ್ದುಪಡಿ) ನಿಯಮಗಳು, 2012 ಎಂದು ಕರೆಯತಕ್ಕದು.

(2) ಇವು, ಅಧಿಕೃತ ರಾಜ್ಯಪತ್ರದಲ್ಲಿ ಪ್ರಕಟಗೊಂಡ ದಿನಾಂಕದಿಂದ ಜಾರಿಗೆ ಬರತಕ್ಕದ್ದು.

2. ಅನುಸೂಚಿಯ ತಿದ್ದುಪಡಿ.- ಕರ್ನಾಟಕ ಸಾಮಾನ್ಯ ಸೇವೆಗಳ (ಸರ್ಕಾರಿ ಅತಿಥಿ ವ್ಯವಸ್ಥೆ ನೇಮಕಾತಿ) ನಿಯಮಗಳು, 1986ರ ಅನುಸೂಚಿಯಲ್ಲಿ "ಬಿ ಕರ್ನಾಟಕ ಭವನ" ಶಿರ್ಷಿಕೆ ಅಡಿಯಲ್ಲಿ,-5976 (i) ಕ್ರ. ಸಂ. 28 ಅಂಕಣ (2)ರಲ್ಲಿ "ಸಹಾಯಕ ಇಂಜಿನಿಯರ್ ಹಾಗೂ ಸಹಾಯಕ ವ್ಯವಸ್ಥಾಪಕ, ಕರ್ನಾಟಕ ಭವನ, ನವದೆಹಲಿ" ಹುದ್ದೆಯ ಪ್ರವರ್ಗಕ್ಕೆ ಸಂಬಂಧಿಸಿದ ನಮೂದುಗಳಲ್ಲಿ "ಸಹಾಯಕ ಇಂಜಿನಿಯರ್ ಹಾಗೂ ಸಹಾಯಕ ವ್ಯವಸ್ಥಾಪಕ, ಕರ್ನಾಟಕ ಭವನ, ನವದೆಹಲಿ" ಪದಗಳಿಗೆ ಬದಲಾಗಿ "ಸಹಾಯಕ ಇಂಜಿನಿಯರ್" ಎಂಬ ಪದಗಳನ್ನು ಪ್ರತ್ಯಾಯೋಜಿಸತಕ್ಕದ್ದು.

(ii) ಕ್ರ. ಸಂ. 28 ಮತ್ತು ಇದಕ್ಕೆ ಸಂಬಂಧಿಸಿದ ನಮೂದುಗಳ ತರುವಾಯ ಈ ಮುಂದಿನದನ್ನು ಸೇರಿಸತಕ್ಕದ್ದು, ಎಂದರೆ:-

(iii) ಕ್ರ. ಸಂ. 29ರಲ್ಲಿ "ವ್ಯವಸ್ಥಾಪಕ, ಕರ್ನಾಟಕ ಭವನ" ದ ಹುದ್ದೆಯ ಪ್ರವರ್ಗ ಮತ್ತು ಇದಕ್ಕೆ ಸಂಬಂಧಿಸಿದ ನಮೂದುಗಳಿಗೆ ಬದಲಾಗಿ ಈ ಮುಂದಿನದನ್ನು ಪ್ರತ್ಯಾಯೋಜಿಸತಕ್ಕದ್ದು ಎಂದರೆ:-

(iv) ಕ್ರ. ಸಂ. 30ರಲ್ಲಿ "ಸ್ಟೀವಾರ್ಡ್, ಕರ್ನಾಟಕ ಭವನ" ಹುದ್ದೆ ಪ್ರವರ್ಗ ಮತ್ತು ಇದಕ್ಕೆ ಸಂಬಂಧಿಸಿದ ನಮೂದುಗಳಿಗೆ ಬದಲಾಗಿ ಮುಂದಿನದನ್ನು ಪ್ರತ್ಯಾಯೋಜಿಸತಕ್ಕದ್ದು, ಎಂದರೆ:-

(v) ಕ್ರಮ ಸಂಖ್ಯೆ 31ರಲ್ಲಿ `ಸ್ಟೋರ್ ಕೀಪರ್, ಕರ್ನಾಟಕ ಭವನ" ಹುದ್ದೆಯ ಪ್ರವರ್ಗ ಮತ್ತು ಇದಕ್ಕೆ ಸಂಬಂಧಿಸಿದ ನಮೂದುಗಳನ್ನು ಬಿಟ್ಟುಬಿಡತಕ್ಕದು.

(vi) ಕ್ರಮ ಸಂಖ್ಯೆ 32ರಲ್ಲಿ "ಸ್ವಾಗತಗಾರರು, ಕರ್ನಾಟಕ ಭವನ" ಹುದ್ದೆ ಪ್ರವರ್ಗ ಮತ್ತು ಇದಕ್ಕೆ ಸಂಬಂಧಿಸಿದ ನಮೂದುಗಳಿಗೆ ಬದಲಾಗಿ ಈ ಮುಂದಿನದನ್ನು ಪ್ರತ್ಯಾಯೋಜಿಸತಕ್ಕದ್ದು ಎಂದರೆ:-

(vii) ಕ್ರಮ ಸಂಖ್ಯೆ 33ರಲ್ಲಿ "ಟೆಲಿಪೋನ್ ಆಪರೇಟರುಗಳು, ಕರ್ನಾಟಕ ಭವನ" ಹುದ್ದೆಯ ಪ್ರವರ್ಗ ಮತ್ತು ಇದಕ್ಕೆ ಸಂಬಂಧಿಸಿದ ನಮೂದುಗಳನ್ನು ಬಿಟ್ಟುಬಿಡತಕ್ಕದ್ದು.

(viii) ಕ್ರಮ ಸಂಖ್ಯೆ 34ರಲ್ಲಿ "ಹಿರಿಯ ಚಾಲಕ, ಕರ್ನಾಟಕ ಭವನ" ಹುದ್ದೆಯ ಪ್ರವರ್ಗ ಮತ್ತು ಇದಕ್ಕೆ ಸಂಬಂಧಿಸಿದ ನಮೂದುಗಳಿಗೆ ಬದಲಾಗಿ ಈ ಮುಂದಿನದನ್ನು ಪ್ರತ್ಯಾಯೋಜಿಸತಕ್ಕದ್ದು, ಎಂದರೆ:-

(ix) ಕ್ರಮ ಸಂಖ್ಯೆ 35ರಲ್ಲಿ "ಬಟ್ಲರ್ ಗ್ರೇಡ್-II, ಕರ್ನಾಟಕ ಭವನ" ಹುದ್ದೆಯ ಪ್ರವರ್ಗ ಮತ್ತು ಇದಕ್ಕೆ ಸಂಬಂಧಿಸಿದ ನಮೂದುಗಳಿಗೆ ಬದಲಾಗಿ, ಈ ಮುಂದಿನದನ್ನು ಪ್ರತ್ಯಾಯೋಜಿಸತಕ್ಕದ್ದು, ಎಂದರೆ:-

(x) ಕ್ರಮ ಸಂಖ್ಯೆ 36ರಲ್ಲಿ "ಎಲೆಕ್ಟ್ರಿಷಿಯನ್- ಕಂ-ಪ್ಲಂಬರ್, ಕರ್ನಾಟಕ ಭವನ" ಹುದ್ದೆಯ ಪ್ರವರ್ಗ ಮತ್ತು ಇದಕ್ಕೆ ಸಂಬಂಧಿಸಿದ ನಮೂದುಗಳಿಗೆ ಬದಲಾಗಿ ಈ ಮುಂದಿನದನ್ನು ಪ್ರತ್ಯಾಯೋಜಿಸತಕ್ಕದ್ದು, ಎಂದರೆ:-

(xi) ಕ್ರ. ಸಂ. 37ರಲ್ಲಿ "ಅಟೆಂಡರ್, ಕರ್ನಾಟಕ ಭವನ" ಹುದ್ದೆಯ ಪ್ರವರ್ಗ ಮತ್ತು ಇದಕ್ಕೆ ಸಂಬಂಧಿಸಿದ ನಮೂದುಗಳಿಗೆ ಬದಲಾಗಿ ಈ ಮುಂದಿನದನ್ನು ಪ್ರತ್ಯಾಯೋಜಿಸತಕ್ಕದ್ದು ಎಂದರೆ:-

ಮುಂದಿನದನ್ನು ಪ್ರತ್ಯಾಯೋಜಿಸತಕ್ಕದ್ದು ಎಂದರೆ:-

(xiii) ಕ್ರ. ಸಂ. 39ರಲ್ಲಿ "ಪ್ಲಂಬರ್, ಕರ್ನಾಟಕ ಭವನ" ಹುದ್ದೆಯ ಪ್ರವರ್ಗ ಮತ್ತು ಇದಕ್ಕೆ ಸಂಬಂಧಿಸಿದ ನಮೂದುಗಳಿಗೆ ಬದಲಾಗಿ ಈ ಮುಂದಿನದನ್ನು ಪ್ರತ್ಯಾಯೋಜಿಸತಕ್ಕದ್ದು, ಎಂದರೆ:-

(xiv) ಕ್ರ. ಸಂ. 40ರಲ್ಲಿ "ಎಲೆಕ್ಟ್ರಷಿಯನ್, ಕರ್ನಾಟಕ ಭವನ" ವೃಂದ ಮತ್ತು ಇದಕ್ಕೆ ಸಂಬಂಧಿಸಿದ ನಮೂದುಗಳಿಗೆ ಬದಲಾಗಿ ಈ ಮುಂದಿನದನ್ನು ಪ್ರತ್ಯಾಯೋಜಿಸತಕ್ಕದ್ದು, ಎಂದರೆ:-

(xv) ಕ್ರ. ಸಂ. 41ರಲ್ಲಿರುವ "ಕುಕ್ - ದರ್ಜೆ-IIರ, ಕರ್ನಾಟಕ ಭವನ" ಹುದ್ದೆಯ ಪ್ರವರ್ಗ ಮತ್ತು ಇದಕ್ಕೆ ಸಂಬಂಧಿಸಿದ ನಮೂದನೆಗಳಿಗೆ ಬದಲಾಗಿ ಈ ಮುಂದಿನವುಗಳನ್ನು ಪ್ರತ್ಯಾಯೋಜಿಸತಕ್ಕದ್ದು, ಎಂದರೆ:-

(xvi) ಕ್ರ. ಸಂ. 42ರಲ್ಲಿ "ಜವಾನ / ರಾತ್ರಿ ಕಾವಲುಗಾರ, ಕರ್ನಾಟಕ ಭವನ" ಹುದ್ದೆಯ ಪ್ರವರ್ಗಗಳು ಮತ್ತು ಇದಕ್ಕೆ ಸಂಬಂಧಿಸಿದ ನಮೂದನೆಗಳಿಗೆ ಬದಲಾಗಿ ಈ ಮುಂದಿನವುಗಳನ್ನು ಪ್ರತ್ಯಾಯೋಜಿಸತಕ್ಕದ್ದು, ಎಂದರೆ:-

(xvii) ಕ್ರಮ ಸಂಖ್ಯೆ 43 ರಲ್ಲಿ "ಮಾಲಿ / ಕಸಗುಡಿಸುವವನು, ಕರ್ನಾಟಕ ಭವನ'' ಹುದ್ದೆಯ ಪ್ರವರ್ಗ ಮತ್ತು ಇದಕ್ಕೆ ಸಂಬಂಧಿಸಿದ ನಮೂದನೆಗಳಿಗೆ ಬದಲಾಗಿ ಈ ಮುಂದಿನವುಗಳನ್ನು ಪ್ರತ್ಯಾಯೋಜಿಸತಕ್ಕದ್ದು ಎಂದರೆ:-

(xviii) ಕ್ರಮ ಸಂಖ್ಯೆ 44 ರಲ್ಲಿ "ಅಡುಗೆ ಸಹಾಯಕ, ಕರ್ನಾಟಕ ಭವನ" ಹುದ್ದೆಯ ಪ್ರವರ್ಗ ಮತ್ತು ಇದಕ್ಕೆ ಸಂಬಂಧಿಸಿದ ನಮೂದನೆಗಳಿಗೆ ಬದಲಾಗಿ ಈ ಮುಂದಿನವುಗಳನ್ನು ಪ್ರತ್ಯಾಯೋಜಿಸತಕ್ಕದ್ದು, ಎಂದರೆ:-

(xix) ಕ್ರ. ಸಂ. 45ರಲ್ಲಿ "ರೂಮ್‌ಬಾಯ್ / ಪರಿಚಾರಕರು, ಕರ್ನಾಟಕ ಭವನ" ಹುದ್ದೆಯ ಪ್ರವರ್ಗ ಮತ್ತು ಇದಕ್ಕೆ ಸಂಬಂಧಿಸಿದ ನಮೂದನೆಗಳಿಗೆ ಬದಲಾಗಿ ಈ ಮುಂದಿನವುಗಳನ್ನು ಪ್ರತ್ಯಾಯೋಜಿಸತಕ್ಕದ್ದು, ಎಂದರೆ:-

ಕರ್ನಾಟಕ ರಾಜ್ಯಪಾಲರ ಆಜ್ಞಾನುಸಾರ ಮತ್ತು ಅವರ ಹೆಸರಿನಲ್ಲಿ,

Whereas the draft of the Karnataka General Services (Government Hospitality Organisation Recruitment)(Amendment) Rules, 2012 was published as required by Clause(a) sub-section(2) of section(3) of The Karnataka State Civil Services Act, 1978(Karnataka Act No. 14 of 1990) in Notification No. DPAR 26 HET 2003, dated 3rd October, 2012, in Part - IVA of the Karnataka Gazette Extraordinary dated 5th October, 2012, inviting objections and suggestions from all persons likely to be affected thereby within fifteen days from the date of its publication in Official Gazette.

And whereas the said Gazette was made available to public on the 5th October, 2012.

And whereas no objections and suggestions have been received in this behalf by the State Government. Now, therefore in exercise of the powers conferred by sub-section(1) of section 3 read with section 8 of the Karnataka State Civil Services Act, 1978(Karnataka Act 14 of 1990) the Government of Karnataka hereby makes the following rules, namely:-

RULES

1. Title and commencement:- (1) These rules may be called the Karnataka General Services (Government Hospitality Organisation Recruitment) (Amendment ) Rules, 2012.

(2) They shall come into force from the date of their publication in the official Gazette.

2. Amendment of Schedule.- In the Karnataka General Services (Government Hospitality Organization Recruitment) Rules, 1986, in the schedule, under the heading "B. Karnataka Bhavan":-

(i) in the entries relating to the category of post of Assistant Engineer-cum Assistant Manager Karnataka Bhavan, New Delhi at Sl No. 28 in column(2), for the words "Assistant Engineer - cum Assistant Manager, Karnataka Bhavan, New Delhi" the words "Assistant Engineer" shall be substituted;

(ii) after the Sl. No.28,and entries relating thereto the following shall be inserted, namely:-

(iii) for the category of post of "Manager Karnataka Bhavan" at Sl.No.29 and entries relating thereto the following shall be substituted, namely:-

In exercise of powers conferred by the second proviso to sub-section (2) of Section 3 of the Karnataka State Civil Services Act, 1978 (Karnataka Act No. 14 of 1990) the Government of Karnataka, hereby makes following amendments to the Notification – I No. DPAR 55 HET 1982, dated: 22.5.1986,-

In the said notification for sub-heading "B- Karnataka Bhavan" and entries relating thereunder the following shall be substituted, namely:-

ಕರ್ನಾಟಕ ಸರ್ಕಾರವು, ಕರ್ನಾಟಕ ರಾಜ್ಯ ಸಿವಿಲ್ ಸೇವೆಗಳ ಅಧಿನಿಯಮ, 1978 (1990ರ ಕರ್ನಾಟಕ ಅಧಿನಿಯಮ 14)ರ 8ನೇ ಪ್ರಕರಣದೊಂದಿಗೆ ಓದಲಾದ 3ನೇ ಪ್ರಕರಣದ (1)ನೇ ಉಪ ಪ್ರಕರಣದಿಂದ ಪ್ರದತ್ತವಾದ ಅಧಿಕಾರಗಳನ್ನು ಚಲಾಯಿಸಿ, ಕರ್ನಾಟಕ ಸಿವಿಲ್ ಸೇವಾ ನಿಯಮಗಳಿಗೆ ಮತ್ತಷ್ಟು ತಿದ್ದುಪಡಿ ಮಾಡುವ ಸಲುವಾಗಿ ರಚಿಸಲು ಉದ್ದೇಶಿಸಿರುವ ಈ ಮುಂದಿನ ಕರಡು ನಿಯಮಗಳನ್ನು, ಸದರಿ ಅಧಿನಿಯಮದ 3ನೇ ಪ್ರಕರಣದ (2)ನೇ ಉಪ ಪ್ರಕರಣದ (ಎ) ಖಂಡದ ಮೂಲಕ ಅಗತ್ಯಪಡಿಸಲಾದಂತೆ, ಇದರಿಂದ ಬಾಧಿತರಾಗುವ ಎಲ್ಲಾ ವ್ಯಕ್ತಿಗಳ ಮಾಹಿತಿಗಾಗಿ ಈ ಮೂಲಕ ಪ್ರಕಟಿಸಲಾಗಿದೆ ಮತ್ತು ಸದರಿ ಕರಡು ನಿಯಮಗಳನ್ನು ಇವು ರಾಜ್ಯಪತ್ರದಲ್ಲಿ ಪ್ರಕಟಗೊಂಡ ದಿನಾಂಕದಿಂದ ಹದಿನೈದು ದಿನಗಳು ಮುಕ್ತಾಯಗೊಂಡ ತರುವಾಯ ಪರಿಗಣನೆಗೆ ತೆಗೆದುಕೊಳ್ಳಲಾಗುವುದೆಂದು ಈ ಮೂಲಕ ಸೂಚನೆ ನೀಡಲಾಗಿದೆ.

ಸದರಿ ಕರಡು ನಿಯಮಗಳ ಸಂಬಂಧದಲ್ಲಿ, ಯಾವುದೇ ವ್ಯಕ್ತಿಯಿಂದ ರಾಜ್ಯ ಸರ್ಕಾರವು ಸ್ವೀಕರಿಸಬಹುದಾದ ಯಾವುದೇ ಆಕ್ಷೇಪಣೆಯನ್ನು ಅಥವಾ ಸಲಹೆಯನ್ನು ಮೇಲೆ ನಿರ್ದಿಷ್ಟಪಡಿಸಿದ ಅವಧಿಯ ಮುಕ್ತಾಯಕ್ಕೆ ಮುಂಚೆ ರಾಜ್ಯ ಸರ್ಕಾರವು ಪರಿಗಣಿಸುವುದು. ಆಕ್ಷೇಪಣೆಗಳು ಮತ್ತು ಸಲಹೆಗಳನ್ನು ಸರ್ಕಾರದ ಅಪರ ಮುಖ್ಯ ಕಾರ್ಯದರ್ಶಿ, ಆರ್ಥಿಕ ಇಲಾಖೆ, ವಿಧಾನಸೌಧ, ಬೆಂಗಳೂರು-560 001 ಇವರಿಗೆ ಸಲ್ಲಿಸಬಹುದು.

ಕರಡು ನಿಯಮಗಳು

1. ಶೀರ್ಷಿಕೆ ಮತ್ತು ಪ್ರಾರಂಭ- (1) ಈ ನಿಯಮಗಳನ್ನು ಕರ್ನಾಟಕ ಸಿವಿಲ್ ಸೇವಾ (. . . . . .ತಿದ್ದುಪಡಿ) ನಿಯಮಗಳು 2012 ಎಂದು ಕರೆಯತಕ್ಕದ್ದು.

(2) ಇವು ಅಧಿಕೃತ ರಾಜ್ಯಪತ್ರದಲ್ಲಿ ಪ್ರಕಟಣೆಯಾದ ದಿನಾಂಕದಿಂದ ಜಾರಿಗೆ ಬರತಕ್ಕದ್ದು.

2. 41 ಸಿ ನಿಯಮದ ತಿದ್ದುಪಡಿ:- ಕರ್ನಾಟಕ ಸಿವಿಲ್ ಸೇವಾ ನಿಯಮಗಳಲ್ಲಿ (ಇಲ್ಲಿ ಇನ್ನು ಮುಂದೆ ಸದರಿ ನಿಯಮಗಳೆಂದು ಉಲ್ಲೇಖಿಸಲಾಗಿದೆ), 41 ಸಿ ನಿಯಮದ (v) ನೇ ಉಪಬಂಧದ ನಂತರ ಈ ಕೆಳಗಿನ ವಿವರಣೆಯನ್ನು ಸೇರಿಸತಕ್ಕದ್ದು ಎಂದರೆ.-

ವಿವರಣೆ: ಈ ಉಪಬಂಧದ ಸಲುವಾಗಿ ವೇತನದಲ್ಲಿ ಸರ್ಕಾರಿ ನೌಕರನು ಮಿಲಿಟರಿ ಸೇವೆಯಲ್ಲಿ ಅಂತಿಮವಾಗಿ ಪಡೆದ ಮೂಲವೇತನ, ಗ್ರೇಡ್ ಪೇ, ಎಕ್ಸ್ ಗ್ರೂಪ್ ಪೇ (ಎಲ್ಲೆಲ್ಲಿ ಅನ್ವಯಿಸುವುದೋ ಅಲ್ಲಿ) ಯನ್ನು ಒಳಗೊಳ್ಳುವುದು.

3. 112ನೇ ನಿಯಮದ ತಿದ್ದುಪಡಿ:- ಸದರಿ ನಿಯಮಗಳ 112ನೇ ನಿಯಮದ ಉಪ ನಿಯಮ (9)ರಲ್ಲಿನ "ಮತ್ತು 110ನೇಯ ನಿಯಮ" ಎಂಬ ಪದಗಳು ಮತ್ತು ಅಂಕಿಗಳನ್ನು ಬಿಟ್ಟುಬಿಡತಕ್ಕದ್ದು.

4. 118-ಎ ರ ನಿಯಮದ ತಿದ್ದುಪಡಿ:- ಸದರಿ ನಿಯಮಗಳ 118-ಎ ರ ಉಪ ನಿಯಮ (2)ರ ಉಪಬಂಧ (ಸಿ) ರ ನಂತರ ಈ ಕೆಳಗಿನ ವಿವರಣೆಯನ್ನು ಸೇರಿಸತಕ್ಕದ್ದು, ಎಂದರೆ.-

ವಿವರಣೆ: ಸೇವೆಯಲ್ಲಿದ್ದಾಗಲೇ ಮರಣ ಹೊಂದಿದ ನೌಕರರ ಪ್ರಕರಣದಲ್ಲಿ ನಿವೃತ್ತಿ ಸಮಯದಲ್ಲಿ ಗರಿಷ್ಟ ನಗಧೀಕರಣ ಸೌಲಭ್ಯವನ್ನು ಪಾವತಿಸುವಲ್ಲಿ "ಕುಟುಂಬ" ಎಂಬ ಪದವು, ನಿಯಮ 302(i)ರಲ್ಲಿ ವಿವರಿಸಿದ ಅರ್ಥವನ್ನೇ ಹೊಂದಿರತಕ್ಕದ್ದು.

5. 152-ಎ ನೇ ನಿಯಮದ ತಿದ್ದುಪಡಿ:- ಸದರಿ ನಿಯಮಗಳ ನಿಯಮ 152-ಎ ನ್ನು ಬಿಟ್ಟುಬಿಡತಕ್ಕದ್ದು.

6. 166ನೇ ನಿಯಮದ ತಿದ್ದುಪಡಿ:- ಸದರಿ ನಿಯಮಗಳ ನಿಯಮ 166 ನ್ನು ಬಿಟ್ಟುಬಿಡತಕ್ಕದ್ದು.

7. 167ನೇ ನಿಯಮದ ತಿದ್ದುಪಡಿ:- ಸದರಿ ನಿಯಮಗಳ ನಿಯಮ 167 ನ್ನು ಬಿಟ್ಟುಬಿಡತಕ್ಕದ್ದು.

8. 169ನೇ ನಿಯಮದ ತಿದ್ದುಪಡಿ:- ಸದರಿ ನಿಯಮಗಳ ನಿಯಮ 169ರಡಿಯ ಟಿಪ್ಪಣಿ 3 ನ್ನು ಬಿಟ್ಟುಬಿಡತಕ್ಕದ್ದು.

9. 197ನೇ ನಿಯಮದ ತಿದ್ದುಪಡಿ:- ಸದರಿ ನಿಯಮಗಳ ನಿಯಮ 197ರಡಿಯ ವಿನಾಯತಿ 1 ಮತ್ತು ವಿನಾಯತಿ 2 ನ್ನು ಬಿಟ್ಟುಬಿಡತಕ್ಕದ್ದು.

10. 224-ಎ ರ ನಿಯಮದ ತಿದ್ದುಪಡಿ:- ಸದರಿ ನಿಯಮಗಳ ನಿಯಮ 224-ಎ ರ ನಂತರ ಈ ಕೆಳಗಿನ ವಿವರಣೆಯನ್ನು ಸೇರಿಸತಕ್ಕದ್ದು, ಎಂದರೆ.-5990 ವಿವರಣೆ: ಈ ನಿಯಮದಡಿ "ತಾತ್ಕಾಲಿಕ ಸೇವೆಯೆಂದರೆ" ತಾತ್ಕಾಲಿಕ ಹುದ್ದೆಯಲ್ಲಿ ಅಥವಾ ಸ್ಥಳೀಯ ಅಭ್ಯರ್ಥಿಯಾಗಿ ಅಥವಾ ಪರೀಕ್ಷಣಾ ಅವಧಿಯಲ್ಲಿ ಸಲ್ಲಿಸಿದ ಸೇವೆ ಎಂದು ಅರ್ಥ.

11. 226ನೇ ನಿಯಮ ಮತ್ತು 227ನೇ ನಿಯಮದ ತಿದ್ದುಪಡಿ:- ಸದರಿ ನಿಯಮಗಳ ನಿಯಮ 226 ಮತ್ತು ನಿಯಮ 227 ನ್ನು ಬಿಟ್ಟುಬಿಡತಕ್ಕದ್ದು.

12. 292 -ಸಿ ನೇ ನಿಯಮದ ತಿದ್ದುಪಡಿ:- ಸದರಿ ನಿಯಮಗಳ ನಿಯಮ 292-ಸಿ ಗೆ ಬದಲಾಗಿ ಈ ಕೆಳಗಿನದನ್ನು ಪ್ರತಿಸ್ಥಾಪಿಸತಕ್ಕದ್ದು, ಎಂದರೆ.-

ನಿಯಮ 292-ಸಿ. ವ್ಯಕ್ತಿಯು ಉಪದಾನ ಸ್ವೀಕರಿಸುವುದನ್ನು ನಿಷೇಧಿಸುವುದು.- (1) ಸರ್ಕಾರಿ ನೌಕರನು ಸೇವೆಯಲ್ಲಿರುವಾಗ ಅಥವಾ ನಿವೃತ್ತಿಯ ತರುವಾಯ ಮರಣ ಹೊಂದಿದ ಸಂದರ್ಭದಲ್ಲಿ ಈ ನಿಯಮಗಳ ರೀತ್ಯ ಉಪದಾನ ಪಡೆಯಲು ಅರ್ಹನಿರುವ ವ್ಯಕ್ತಿಯು, ಯಾವುದೇ ತೀವ್ರ ಅಪರಾಧದ ಆರೋಪಿಯಾದರೆ ಅಥವಾ ಅಂತಹ ಅಪರಾಧವನ್ನು ಮಾಡುವುದಕ್ಕೆ ದುಷ್ಪ್ರೇರಣೆ ನೀಡಿದ ಅಪರಾಧದ ಆರೋಪಿಯಾದರೆ, ಉಪದಾನವನ್ನು ಪಡೆಯಲು ಹಕ್ಕುಳ್ಳ ಕುಟುಂಬದ ಇತರ ಅರ್ಹ ಸದಸ್ಯ ಸೇರಿದಂತೆ ವ್ಯಕ್ತಿಯ ಕ್ಲೇಮ್‌ನ್ನು ಅವನ ವಿರುದ್ದ ಆರೋಪಿಸಲಾದ ಕ್ರಿಮಿನಲ್ ವ್ಯವಹರಣೆಗಳು ಮುಕ್ತಾಯವಾಗುವವರೆಗೆ ಅಮಾನತ್ತುಗೊಳಿಸತಕ್ಕದ್ದು.

(2) ಮೇಲಿನ ಉಪಖಂಡ (1)ರಲ್ಲಿ ಉಲ್ಲೇಖಿಸಲಾದ ಕ್ರಿಮಿನಲ್ ವ್ಯವಹರಣೆಯು ಮುಕ್ತ್ತಾಯವಾದ ನಂತರ ಸಂಬಂಧಪಟ್ಟ ವ್ಯಕ್ತಿಯು, (ಎ) ಯಾವುದೇ ತೀವ್ರ ಅಪರಾಧ ಮಾಡಿದ್ದು ಸಿದ್ಧವಾದರೆ ಅಥವಾ ಅಂತಹ ಅಪರಾಧವನ್ನು ಮಾಡುವುದಕ್ಕೆ ದುಷ್ಪ್ರೇರಣೆ ನೀಡಿರುವನೆಂದು ಅಪರಾಧ ಸಿದ್ಧವಾದರೆ, ಅಂತಹ ವ್ಯಕ್ತಿಯನ್ನು ಉಪದಾನ ಪಡೆಯುವುದರಿಂದ ಅನರ್ಹಗೊಳಿಸತಕ್ಕದ್ದು ಮತ್ತು ಅಂತಹ ಪಾಲನ್ನು ಕುಟುಂಬದ ಇತರ ಅರ್ಹ ಸದಸ್ಯ ಅಥವಾ ಸದಸ್ಯರಿಗೆ ಸಂದಾಯ ಮಾಡತಕ್ಕದ್ದು.

(ಬಿ) ಯಾವುದೇ ತೀವ್ರ ಅಪರಾಧದ ಆರೋಪದಿಂದ ಅಥವಾ ಅಪರಾಧವನ್ನು ಮಾಡುವುದಕ್ಕೆ ದುಷ್ಪ್ರೇರಣೆ ನೀಡಿದ ಆರೋಪದಿಂದ ಮುಕ್ತನಾದರೆ ಉಪದಾನವನ್ನು ಅಂತಹ ವ್ಯಕ್ತಿಗೆ ಸಂದಾಯ ಮಾಡತಕ್ಕದ್ದು.

13. 439ನೇ ನಿಯಮದ ತಿದ್ದುಪಡಿ:- ಸದರಿ ನಿಯಮಗಳ ನಿಯಮ 439ರಡಿಯ ಟಿಪ್ಪಣಿ 3 ರಲ್ಲಿ "ಅವನನ್ನು ಹಾಗೆ ಬಿಡುಗಡೆ ಮಾಡದಿದ್ದರೆ, 110ನೇ ನಿಯಮದ ಮೊದಲನೆಯ ಪರಂತುಕದ ಮೇರೆಗೆ ಅನುಮತಿಸಲ್ಪಡಬಹುದಾದಷ್ಟರ ಮಟ್ಟಿಗೆ ಸರ್ಕಾರಿ ಸೇವೆಯ ಹಿತದೃಷ್ಠಿಯಿಂದ ರಜೆಯನ್ನು ನಿರಾಕರಿಸಬೇಕು" ಎಂಬ ಪದಗಳನ್ನು ಬಿಟ್ಟುಬಿಡತಕ್ಕದ್ದು.

14. 446ನೇ ನಿಯಮದ ತಿದ್ದುಪಡಿ:- ಸದರಿ ನಿಯಮಗಳ ನಿಯಮ 446ರ ಟಿಪ್ಪಣಿ-9ರಡಿ ಉಪಬಂಧ(ಸಿ) ಪರಂತುಕದಲ್ಲಿ "ಇನ್ನೂ ಒಂದು ವರ್ಷದವರೆಗೆ" ಎಂಬ ಪದಗಳಿಗೆ ಬದಲಾಗಿ "ಇನ್ನೂ ಮೂರು ವರ್ಷದವರೆಗೆ" ಎಂಬ ಪದಗಳನ್ನು ಪ್ರತಿಸ್ಥಾಪಿಸತಕ್ಕದ್ದು.

15. 569ನೇ ನಿಯಮದ ತಿದ್ದುಪಡಿ:- ಸದರಿ ನಿಯಮಗಳ ನಿಯಮ 569ರ ಉಪಬಂಧ (ಸಿ)ಗೆ ಬದಲಾಗಿ ಈ ಕೆಳಕಂಡದನ್ನು ಪ್ರತಿಸ್ಥಾಪಿಸತಕ್ಕದ್ದು, ಎಂದರೆ.-

"(ಸಿ) ಸರ್ಕಾರಿ ಸೇವೆಯಲ್ಲಿಲ್ಲದ ವ್ಯಕ್ತಿಗಳ ಸಂದರ್ಭದಲ್ಲಿ ಹೋಗಿಬರುವ ಪ್ರತಿ ಪ್ರಯಾಣಕ್ಕೂ ರೈಲಿನಲ್ಲಿ ಎ.ಸಿ. ತ್ರಿ ಟೈಯರ್/ಎ.ಸಿ. ಚೇರ್ ಕಾರ್ ಮತ್ತು ಬಸ್ಸುಗಳ ದರವನ್ನು ರಾಜಹಂಸ/ಸೆಮಿ ಡಿಲಕ್ಸ್ ದರಗಳಿಗೆ ಮೀರದಂತೆ ಬಸ್ಸು ದರವನ್ನು ಹಾಗೂ ರಾಜ್ಯದ ಒಳಗಡೆ, ಇತರ ನಗರಗಳಲ್ಲಿ ತಂಗಿದ ಪ್ರತಿ ದಿನಕ್ಕೆ ರೂ.100/- ಗಳನ್ನು ಮೀರದಂತೆ ದಿನಭತ್ಯೆ".

16. ಪ್ರಪತ್ರ 11 ರ ತಿದ್ದುಪಡಿ:- (1) ಸದರಿ ನಿಯಮಗಳ ಪ್ರಪತ್ರ 11 ರ ಉಪಬಂಧ (iii) ನ್ನು ಬಿಟ್ಟುಬಿಡತಕ್ಕದ್ದು.

(2) ಸದರಿ ನಿಯಮಗಳ ಪ್ರಪತ್ರ 11 ರ ಅಡಕಗಳ ಪಟ್ಟಿಯ ಕ್ರಮಸಂಖ್ಯೆ 4 ಮತ್ತು 7 ನ್ನು ಬಿಟ್ಟುಬಿಡತಕ್ಕದ್ದು.

ಕರ್ನಾಟಕ ರಾಜ್ಯಪಾಲರ ಆದೇಶಾನುಸಾರ ಮತ್ತು ಅವರ ಹೆಸರಿನಲ್ಲಿ,

ಕರ್ನಾಟಕ ಸರ್ಕಾರವು, ಕರ್ನಾಟಕ ರಾಜ್ಯ ಸಿವಿಲ್ ಸೇವೆಗಳ ಅಧಿನಿಯಮ, 1978 (1990ರ ಕರ್ನಾಟಕ ಅಧಿನಿಯಮ 14)ರ 8ನೇ ಪ್ರಕರಣದೊಂದಿಗೆ ಓದಲಾದ 3ನೇ ಪ್ರಕರಣದ (1)ನೇ ಉಪ ಪ್ರಕರಣದಿಂದ ಪ್ರದತ್ತವಾದ ಅಧಿಕಾರಗಳನ್ನು ಚಲಾಯಿಸಿ, ಕರ್ನಾಟಕ ಸರ್ಕಾರಿ ನೌಕರರ (ಕುಟುಂಬ ನಿವೃತ್ತಿ ವೇತನ) ನಿಯಮಗಳು 2002ಕ್ಕೆ ಮತ್ತಷ್ಟು ತಿದ್ದುಪಡಿ ಮಾಡುವ ಸಲುವಾಗಿ ರಚಿಸಲು ಉದ್ದೇಶಿಸಿರುವ ಈ ಮುಂದಿನ ಕರಡು ನಿಯಮಗಳನ್ನು, ಸದರಿ ಅಧಿನಿಯಮದ 3ನೇ ಪ್ರಕರಣದ (2)ನೇ ಉಪ ಪ್ರಕರಣದ (ಎ) ಖಂಡದ ಮೂಲಕ ಅಗತ್ಯಪಡಿಸಲಾದಂತೆ, ಇದರಿಂದ ಬಾಧಿತರಾಗುವ ಎಲ್ಲಾ ವ್ಯಕ್ತಿಗಳ ಮಾಹಿತಿಗಾಗಿ ಈ ಮೂಲಕ ಪ್ರಕಟಿಸಲಾಗಿದೆ ಮತ್ತು ಸದರಿ ಕರಡು ನಿಯಮಗಳನ್ನು ಇವು ರಾಜ್ಯಪತ್ರದಲ್ಲಿ ಪ್ರಕಟಗೊಂಡ ದಿನಾಂಕದಿಂದ ಹದಿನೈದು ದಿನಗಳು ಮುಕ್ತಾಯಗೊಂಡ ತರುವಾಯ ಪರಿಗಣನೆಗೆ ತೆಗೆದುಕೊಳ್ಳಲಾಗುವುದೆಂದು ಈ ಮೂಲಕ ಸೂಚನೆ ನೀಡಲಾಗಿದೆ.

ಸದರಿ ಕರಡು ನಿಯಮಗಳ ಸಂಬಂಧದಲ್ಲಿ, ಯಾವುದೇ ವ್ಯಕ್ತಿಯಿಂದ ರಾಜ್ಯ ಸರ್ಕಾರವು ಸ್ವೀಕರಿಸಬಹುದಾದ ಯಾವುದೇ ಆಕ್ಷೇಪಣೆಯನ್ನು ಅಥವಾ ಸಲಹೆಯನ್ನು ಮೇಲೆ ನಿರ್ದಿಷ್ಟಪಡಿಸಿದ ಅವಧಿಯ ಮುಕ್ತಾಯಕ್ಕೆ ಮುಂಚೆ ರಾಜ್ಯ ಸರ್ಕಾರವು ಪರಿಗಣಿಸುವುದು. ಆಕ್ಷೇಪಣೆಗಳು ಮತ್ತು ಸಲಹೆಗಳನ್ನು ಸರ್ಕಾರದ ಅಪರ ಮುಖ್ಯ ಕಾರ್ಯದರ್ಶಿ, ಆರ್ಥಿಕ ಇಲಾಖೆ, ವಿಧಾನಸೌಧ, ಬೆಂಗಳೂರು-560 001 ಇವರಿಗೆ ಸಲ್ಲಿಸಬಹುದು.

ಕರಡು ನಿಯಮಗಳು

1. ಶೀರ್ಷಿಕೆ ಮತ್ತು ಪ್ರಾರಂಭ.- (1) ಈ ನಿಯಮಗಳನ್ನು, ಕರ್ನಾಟಕ ಸರ್ಕಾರಿ ನೌಕರರ (ಕುಟುಂಬ ನಿವೃತ್ತಿ ವೇತನ) (_ _ ತಿದ್ದುಪಡಿ) ನಿಯಮಗಳು, 2012 ಎಂದು ಕರೆಯತಕ್ಕದ್ದು.

(2) ಇವು ಅಧಿಕೃತ ರಾಜ್ಯಪತ್ರದಲ್ಲಿ ಪ್ರಕಟಣೆಯಾದ ದಿನಾಂಕದಿಂದ ಜಾರಿಗೆ ಬರತಕ್ಕದ್ದು.

2. ನಮೂನೆ-ಬಿ ಯ ಅನುಬಂಧಕ್ಕೆ ತಿದ್ದುಪಡಿ.- ಕರ್ನಾಟಕ ಸರ್ಕಾರಿ ನೌಕರರ (ಕುಟುಂಬ ನಿವೃತ್ತಿ ವೇತನ) ನಿಯಮಗಳು 2002ರ, ನಮೂನೆ-ಬಿ ಯ ಅನುಬಂಧದ ಕ್ರಮಸಂಖ್ಯೆ 9 (6) ಕ್ಕೆ ಬದಲಾಗಿ ಈ ಕೆಳಕಂಡದನ್ನು ಪ್ರತಿಸ್ಥಾಪಿಸತಕ್ಕದ್ದು, ಎಂದರೆ.-

"ಸಹಜ ಪೋಷಕರು ಜೀವಂತವಿರದಿದ್ದ ಸಂದರ್ಭದಲ್ಲಿ ಅಪ್ರಾಪ್ತ ವಯಸ್ಕ ಮಕ್ಕಳಿಗೆ ಕುಟುಂಬ ನಿವೃತ್ತಿ ವೇತನವು ಅಂಗೀಕಾರಾರ್ಹವಾಗಿರುವಲ್ಲಿ The National Trust for Welfare of persons with Autism, Cerebral Palsy, Mental Retardation and NOTIFICATION - I

The draft of the following rules further to amend the Karnataka Civil Services Rules, which the Government of Karnataka proposes to make in exercise of the powers conferred by sub-section (1) of Section 3 read with section 8 of the Karnataka State Civil Services Act 1978 (Karnataka Act 14 of 1990) is hereby published as required by clause (a) of sub-section(2) of section 3 of the said Act, for the information of all the persons likely to be affected thereby and notice is hereby given that the said draft will be taken into consideration after fifteen days from the date of its publication in the Official Gazette.

Any objection or suggestion which may be received by the State Government from any person with respect to the said draft, before the expiry of the period specified above will be considered by the State Government. Objections5992 and suggestions may be addressed to the Additional Chief Secretary to Government, Finance Department, Vidhana Soudha, Bangalore-560 001.

DRAFT RULES

1. Title and commencement.- (1) These rules may be called the Karnataka Civil Services (_ _ _ _ _ Amendment) Rules, 2012.

(2) They shall come into force from the date of their publication in the Official Gazette.

2. Amendment of Rule 41-C:- In the Karnataka Civil Services Rules (hereinafter referred to as the said rules) after Rule 41-C , after clause (v) the following explanation shall be inserted, namely:-

"Explanation:- For the purpose of this clause pay includes, basic pay Grade pay, Ex-Group pay (wherever applicable) last drawn by the Government Servant in the Military Service.

3. Amendment of Rule 112:- In Rule 112 of said rules, in sub rule (9), the words and figures 'and Rule 110' shall be omitted.

4. Amendment of Rule 118-A:- In Rule 118-A of the said rules, in sub-rule (2), after clause(c), the following explanation shall be inserted, namely:-

"Explanation:- For the purpose of payment of terminal leave benefit in case of death while in service, the word "family" shall have the same meaning as defined in Rule 302 (i)".

5. Amendment of Rule 152-A:- Rule 152-A of the said rules, shall be omitted.

6. Amendment of Rule 166:- Rule 166 of the said rules, shall be omitted.

7. Amendment of Rule 167:- Rule 167 of the said rules, shall be omitted.

8. Amendment of Rule 169:- In Rule 169 of the said rules, Note-3 shall be omitted,

9. Amendment of Rule 197:- In Rule 197 of the said rules, Exception-1 and Exception-2, shall be omitted.

10. Amendment of Rule 224-A:- In Rule 224-A of the said rules, the following Explanation shall be inserted, namely:-

"Explanation:- For the purpose of this rule "Temporary Service" means, the service rendered in any temporary post or as local candidate or service rendered on probation"

11. Omission of Rule 226 and 227:- Rule 226 and 227 of the said rules, shall be omitted.

12. Amendment of Rule 292-C:- For rule 292-C of the said rules, the following shall be substituted, namely:-

"Rule 292-C. Debarring a person from receiving gratuity:- (1). If a person, who in the event of death of the Government Servant, while in service or after retirement, is eligible to receive gratuity under these rules, is charged with the serious crime or for abetting in the commission of such a crime, the claim of such a person including other eligible member or members of the family to receive the gratuity, shall remain suspended till the conclusion of the criminal proceedings instituted against him.

(2) If, on conclusion of the criminal proceedings referred to in clause (1) above, the person concerned:-

(a) is convicted for the "serious crime" or abetting in the commission of such a crime, such a person shall be debarred from receiving gratuity, which shall be payable to the other eligible member or members of the family.

(b) is acquitted of the charge of the serious crime, the gratuity shall be payable to such a person".

13. Amendment of Rule 439:- In Rule 439 of the said rules, in Note-3, the words "If he is not so released, the leave should be refused in the interest of public service to the extent admissible under the first proviso to rule 110" shall be omitted.

14. Amendment of Rule 446:- In Rule 446 of the said rules, in clause (c) of Note 9, in proviso, for the words "not more than one year" the words "not more than three years" shall be substituted.

15. Amendment of Rule 569:- In Rule 569 of the said rules, for clause (c) the following shall be substituted, namely:-

"(c) In the case of persons not in Government Service, Railway fare of AC 3 tier/AC Chair Car and Bus fare not exceeding the rates fixed for Rajhamsa/Semi Delux types of buses for to and fro journeys and Daily Allowance not exceeding Rupees One Hundred per day, for the days of halts within the State".

16. Amendment to Form 11:- In form 11 of the said rules,-

(1) Clause (iii) shall be omitted.

(2) In the heading "List of ENCLOSURES", the entries relating to serial Number 4 and 7 shall be omitted.

"9(6) Guardianship Certificate issued by the Local Level Committee, in cases covered under the National Trust for Welfare of persons with Autism, Cerebral Palsy, Mental Retardation and Multiple Disabilities Act, 1999 (Central Act 44 of 1999) and by the Competent court in respect of other cases covered under Guardians and Wards Act 1890, where pension is admissible to the minor children in case natural guardians are not alive".

2. ಚುನಾವಣೆ ನಡೆಸಲು ಗೊತ್ತುಪಡಿಸಿರುವ ಅಧಿಕಾರಿಗಳು ಕರ್ನಾಟಕ ಪಂಚಾಯತ್ ರಾಜ್ ಅಧಿನಿಯಮ 1993 ಹಾಗೂ ಕರ್ನಾಟಕ ಪಂಚಾಯತ್ ರಾಜ್ [ಗ್ರಾಮ ಪಂಚಾಯಿತಿ ಅಧ್ಯಕ್ಷರ / ಉಪಾಧ್ಯಕ್ಷರ ಚುನಾವಣೆ] ನಿಯಮಗಳು 1995 ರಡಿಯಲ್ಲಿ ಸಭೆಯ ದಿನಾಂಕ ಮತ್ತು ಸ್ಥಳ ಗೊತ್ತುಪಡಿಸಿ ಆಯ್ಕೆಯಾದ ಎಲ್ಲಾ ಗ್ರಾಮ ಪಂಚಾಯಿತಿ ಸದಸ್ಯರುಗಳಿಗೆ ಚುನಾವಣೆ ಸಭೆ ನಡೆಸುವ ಬಗ್ಗೆ 7 [ಏಳು] ದಿನಗಳ ಮೊದಲೇ ನೋಟೀಸನ್ನು ಮುದ್ದಾಂ ಹಾಗೂ ನೋಂದಣಿ ಅಂಚೆ ಮೂಲಕ ರವಾನಿಸಿ, ಸ್ವೀಕೃತಿಯನ್ನು ಪಡೆದು ಸಭೆ ನಡೆಸಿ, ಆಯ್ಕೆಯಾದ ಅಧ್ಯಕ್ಷ / ಉಪಾಧ್ಯಕ್ಷರುಗಳ ಪಟ್ಟಿಯನ್ನು ನಡಾವಳಿ ಪ್ರತಿಯೊಂದಿಗೆ ಈ ಪ್ರಾಧಿಕಾರಕ್ಕೆ ಕೂಡಲೇ ಸಲ್ಲಿಸತಕ್ಕದ್ದು.

3. ಗೊತ್ತುಪಡಿಸಿದ ಅಧಿಕಾರಿಗಳು ಮೇಲ್ಕಂಡ ಈ ಚುನಾವಣೆ ನಡೆದ ನಂತರ ಕಾರಣಾಂತರಗಳಿಂದ ಮುಂದೆ ಖಾಲಿಯಾಗುವ ಅಧ್ಯಕ್ಷರ / ಉಪಾಧ್ಯಕ್ಷರ ಸ್ಥಾನಗಳು ಖಾಲಿಯಾಗಿದೆ ಎಂದು ಸಂಬಂಧಪಟ್ಟ ಪ್ರಾಧಿಕಾರ ಘೋಷಿಸಿ ಆದೇಶ ಹೊರಡಿಸಿದಲ್ಲಿ, ಸದರಿ ಪಂಚಾಯಿತಿಗಳಿಗೆ ಗೊತ್ತುಪಡಿಸಿದ ಅಧಿಕಾರಿಗಳು ಚುನಾವಣೆಯನ್ನು ನಡೆಸಲು ಕ್ರಮಕೈಗೊಳ್ಳಲು ಆದೇಶಿಸಿದೆ. ಇದು ನಿರಂತರವಾದ ಪ್ರಕ್ರಿಯೆಯಾಗಿರುವುದರಿಂದ ಈ ಆದೇಶವು ಮುಂದಿನ ಆದೇಶವಾಗುವವರೆಗೂ ಜಾರಿಯಲ್ಲಿರುತ್ತದೆ.

2. ಚುನಾವಣೆ ನಡೆಸಲು ಗೊತ್ತುಪಡಿಸಿರುವ ಅಧಿಕಾರಿಗಳು ಕರ್ನಾಟಕ ಪಂಚಾಯತ್ ರಾಜ್ ಅಧಿನಿಯಮ 1993 ಹಾಗೂ ಕರ್ನಾಟಕ ಪಂಚಾಯತ್ ರಾಜ್ [ಗ್ರಾಮ ಪಂಚಾಯಿತಿ ಅಧ್ಯಕ್ಷರ / ಉಪಾಧ್ಯಕ್ಷರ ಚುನಾವಣೆ] ನಿಯಮಗಳು 1995 ರಡಿಯಲ್ಲಿ ಸಭೆಯ ದಿನಾಂಕ ಮತ್ತು ಸ್ಥಳ ಗೊತ್ತುಪಡಿಸಿ ಆಯ್ಕೆಯಾದ ಎಲ್ಲಾ ಗ್ರಾಮ ಪಂಚಾಯಿತಿ ಸದಸ್ಯರುಗಳಿಗೆ ಚುನಾವಣೆ ಸಭೆ ನಡೆಸುವ ಬಗ್ಗೆ 7 [ಏಳು] ದಿನಗಳ ಮೊದಲೇ ನೋಟೀಸನ್ನು ಮುದ್ದಾಂ ಹಾಗೂ ನೋಂದಣಿ ಅಂಚೆ ಮೂಲಕ ರವಾನಿಸಿ, ಸ್ವೀಕೃತಿಯನ್ನು ಪಡೆದು ಸಭೆ ನಡೆಸಿ, ಆಯ್ಕೆಯಾದ ಅಧ್ಯಕ್ಷ / ಉಪಾಧ್ಯಕ್ಷರುಗಳ ಪಟ್ಟಿಯನ್ನು ನಡಾವಳಿ ಪ್ರತಿಯೊಂದಿಗೆ ಈ ಪ್ರಾಧಿಕಾರಕ್ಕೆ ಕೂಡಲೇ ಸಲ್ಲಿಸತಕ್ಕದ್ದು.

3. ಗೊತ್ತುಪಡಿಸಿದ ಅಧಿಕಾರಿಗಳು ಮೇಲ್ಕಂಡ ಈ ಚುನಾವಣೆ ನಡೆದ ನಂತರ ಕಾರಣಾಂತರಗಳಿಂದ ಮುಂದೆ ಖಾಲಿಯಾಗುವ ಅಧ್ಯಕ್ಷರ / ಉಪಾಧ್ಯಕ್ಷರ ಸ್ಥಾನಗಳು ಖಾಲಿಯಾಗಿದೆ ಎಂದು ಸಂಬಂಧಪಟ್ಟ ಪ್ರಾಧಿಕಾರ ಘೋಷಿಸಿ ಆದೇಶ ಹೊರಡಿಸಿದಲ್ಲಿ, ಸದರಿ ಪಂಚಾಯಿತಿಗಳಿಗೆ ಗೊತ್ತುಪಡಿಸಿದ ಅಧಿಕಾರಿಗಳು ಚುನಾವಣೆಯನ್ನು ನಡೆಸಲು ಕ್ರಮಕೈಗೊಳ್ಳಲು ಆದೇಶಿಸಿದೆ. ಇದು ನಿರಂತರವಾದ ಪ್ರಕ್ರಿಯೆಯಾಗಿರುವುದರಿಂದ ಈ ಆದೇಶವು ಮುಂದಿನ ಆದೇಶವಾಗುವವರೆಗೂ ಜಾರಿಯಲ್ಲಿರುತ್ತದೆ.
