ಅಧಿಸೂಚನೆ

ಡಾ.ಬಿ.ಆರ್.ಅಂಬೇಡ್ಕರ್ ಅಭಿವೃದ್ಧಿ ನಿಗಮ ನಿಯಮಿತದ (ಇದರಲ್ಲಿ ಇನ್ನು ಮುಂದೆ ಡಾ.ಬಿ.ಆರ್.ಅಂ.ಅ.ನಿ. ಎಂದು ಕರೆಯಲಾಗಿದೆ) ಸಂಸ್ಥಾಪನಾ ಪತ್ರದ ಮೂಲಕ ತನಗೆ ಪ್ರದತ್ತವಾದ ಅಧಿಕಾರವನ್ನು ಚಲಾಯಿಸಿ, ಸದರಿ ನಿಗಮದ ನಿರ್ದೇಶಕರ ಮಂಡಳಿಯು ಕರ್ನಾಟಕ ಸರ್ಕಾರದ ಅನುಮೋದನೆ ಪಡೆದು ಈ ಮುಂದಿನ ವಿನಿಯಮಗಳನ್ನು ರಚಿಸುತ್ತದೆ, ಎಂದರೆ:

ನಿಯಮಗಳು

1. ಹೆಸರು ಮತ್ತು ಪ್ರಾರಂಭ: (1) ಈ ನಿಯಮಗಳನ್ನು ಡಾ.ಬಿ.ಆರ್.ಅಂ.ಅ.ನಿ.ದ (ವೃಂದ ಮತ್ತು ನೇಮಕಾತಿ) ನಿಯಮಗಳು 2013 ಎಂದು ಕರೆಯಬಹುದು

(2) ನಿಗಮದ ನಿರ್ದೇಶಕರ ಮಂಡಳಿಯು ಅಧಿಸೂಚಿಸಿದ ದಿನಾಂಕದಿಂದ ಅವುಗಳು ಜಾರಿಗೆ ಬರತಕ್ಕದ್ದು.

2. ಪರಿಭಾಷೆಗಳು: (1) ಈ ನಿಯಮಗಳಲ್ಲಿ, ಸಂದರ್ಭವು ಅನ್ಯಥಾ ಅಗತ್ಯಪಡಿಸಿದ ಹೊರತು:-

ಎ) "ನೇಮಕಾತಿ ಪ್ರಾಧಿಕಾರ" ಎಂದರೆ ಡಾ.ಬಿ.ಆರ್.ಅಂ.ಅ.ನಿ.ದ ವ್ಯವಸ್ಥಾಪಕ ನಿರ್ದೇಶಕರು;

ಬಿ) "ನೇರ ನೇಮಕಾತಿ": ಯಾವುದೇ ಪ್ರವರ್ಗದ ಸೇವೆ ಅಥವಾ ಹುದ್ದೆಗೆ ಸಂಬಂಧಿಸಿದಂತೆ ನೇರ ನೇಮಕಾತಿಯಲ್ಲಿ ಯಾವುದೇ ರಾಜ್ಯ ಸಿವಿಲ್ ಸೇವೆ ಅಥವಾ

ನಿಗಮ ಅಥವಾ ಸಂಸ್ಥೆಯಿಂದ ಬಡ್ತಿ ಅಥವಾ ಪ್ರತಿನಿಯೋಜನೆ ಮೂಲಕ ಮಾಡಿಕೊಳ್ಳುವ ನೇಮಕಾತಿಗಿಂತ ಬೇರೆಯದಾದ ನೇಮಕಾತಿಯು ಒಳಗೊಳ್ಳುತ್ತದೆ;

ಸಿ) "ನೌಕರ" ಎಂದರೆ ಈ ನಿಯಮಗಳ ಅನುಸಾರ ನೇಮಕಗೊಂಡ ನಿಗಮದ ನೌಕರ;

ಡಿ) "ನಿರ್ದೇಶಕರ ಮಂಡಳಿ" ಎಂದರೆ ನಿಗಮದ ಸಂಸ್ಥಾಪನಾ ಪತ್ರದಂತೆ ರಚಿತವಾದ ನಿಗಮದ ನಿರ್ದೇಶಕರ ಮಂಡಳಿ;

ಇ) "ಅಧಿಕಾರಿ" ಎಂದರೆ ನಿಗಮದ ಅಧಿಕಾರಿ;

ಎಫ್) "ಹಿಂದುಳಿದ ವರ್ಗಗಳು" ಎಂದರೆ ಕರ್ನಾಟಕ ಸರ್ಕಾರವು ಹಿಂದುಳಿದ ವರ್ಗಗಳೆಂದು ಹಾಗೆ ಅಧಿಸೂಚಿಸಿದ ವರ್ಗ ಮತ್ತು ಪ್ರವರ್ಗಗಳಿಗೆ ಸೇರಿದ ವ್ಯಕ್ತಿಗಳು;

ಜಿ) "ಬಡ್ತಿ" ಎಂದರೆ ನಿಗಮದ ಸೇವೆಯ ಕೆಳ ಹುದ್ದೆ ಅಥವಾ ಶ್ರೇಣಿಯಿಂದ ಸೇವೆಯ ಉನ್ನತ ಹುದ್ದೆ ಅಥವಾ ಶ್ರೇಣಿಗೆ ನೇಮಕ;

ಎಚ್) "ನೇಮಕಾತಿ ಸಮಿತಿ" ಎಂದರೆ ನೇರ ನೇಮಕಾತಿಯನ್ನು ಮಾಡುವ ಉದ್ದೇಶಕ್ಕಾಗಿ ಈ ನಿಯಮಗಳಲ್ಲಿ ನಿಯಮಿಸಲ್ಪಟ್ಟಂತೆ ನಿರ್ದೇಶಕರ ಮಂಡಳಿಯಿಂದ ನೇಮಕವಾದ ಪ್ರಾಧಿಕಾರ;

ಐ) "ಅನುಸೂಚಿತ ಜಾತಿಗಳು" ಮತ್ತು "ಅನುಸೂಚಿತ ಬುಡಕಟ್ಟುಗಳು" ಭಾರತ ಸಂವಿಧಾನದ 341 ಮತ್ತು 342ನೇ ಅನುಚ್ಛೇದಗಳ ಮೇರೆಗೆ ಮಾಡಿದ ಸಂವಿಧಾನದ (ಅನುಸೂಚಿತ ಜಾತಿಗಳ ಮತ್ತು ಅನುಸೂಚಿತ ಬುಡಕಟ್ಟುಗಳ) ಆದೇಶ 1950ರಲ್ಲಿ ಅನುಸೂಚಿತ ಜಾತಿಗಳು ಮತ್ತು ಅನುಸೂಚಿತ ಬುಡಕಟ್ಟುಗಳಿಗೆ ಸಂಬಂಧಿಸಿದ ಉಲ್ಲೇಖಕ್ಕೆ ಅನುರೂಪವಾಗಿರತಕ್ಕದ್ದು;

ಜೆ) "ಆಯ್ಕೆ" ಎಂದರೆ ನೇಮಕಾತಿ ಸಮಿತಿಯಿಂದ ಈ ನಿಯಮಗಳ ಉಪಬಂಧಗಳಿಗೆ ಅನುಸಾರವಾಗಿ ಮಾಡಲಾದ ಆಯ್ಕೆ;

ಕೆ) "ನಿಗಮ" ಎಂದರೆ ಕಂಪನಿಗಳ ಅಧಿನಿಯಮ 1956 ಮೇರೆಗೆ ನೊಂದಾಯಿತವಾದ ಡಾ.ಬಿ.ಆರ್.ಅಂಬೇಡ್ಕರ್ ಅಭಿವೃದ್ದಿ ನಿಗಮ;

(2) ಈ ನಿಯಮಗಳಲ್ಲಿ ಬಳಸಿದ ಆದರೆ ಪರಿಭಾಷಿಸಿರದ ಪದಗಳು, ಕಂಪನಿಗಳ ಅಧಿನಿಯಮ 1956ರಲ್ಲಿ ಅಥವಾ ಸಂದರ್ಭಾನುಸಾರ ಕರ್ನಾಟಕ ರಾಜ್ಯ ಸಿವಿಲ್ ಸೇವೆಗಳ ಅಧಿನಿಯಮ, 1978 (ಕರ್ನಾಟಕ ಅಧಿನಿಯಮ 1990ರ 14) ರ ಮೇರೆಗೆ ರಚಿಸಿದ ಅಥವಾ ರಚಿಸಲಾಗಿದೆಯೆಂದು ಭಾವಿಸಿದ ನಿಯಮಗಳಲ್ಲಿ ಅವುಗಳಿಗೆ ನೀಡಿರುವ ಅರ್ಥಗಳನ್ನೇ ಹೊಂದಿರತಕ್ಕದ್ದು. 3. ಡಾ.ಬಿ.ಆರ್.ಅಂ.ಅ. ನಿಗಮದ ನೌಕರರಿಗೆ ಅನ್ವಯವಾಗುವ ಇತರೆ ನಿಯಮಗಳು:- ಈ ನಿಯಮಗಳಲ್ಲಿ ಅನ್ಯಥಾ ಉಪಬಂಧಿಸಲಾದದ್ದನ್ನುಳಿದು, ಸರ್ಕಾರಿ ನೌಕರಿಗಾಗಿ ಕರ್ನಾಟಕ ಸರ್ಕಾರವು ನಿಯಮಿಸಿದಂಥ ಇತರ ನಿಯಮಗಳ ಉಪಬಂಧಗಳನ್ನು ಡಾ:ಬಿ.ಆರ್.ಅಂಅ.ಅ. ನಿಗಮದ ನೌಕರರಿಗೂ ಮಂಡಳಿಯ ಅನುಮತಿಯನ್ನು ಪಡೆದು ಅಗತ್ಯವಾದಂತೆ ಅಳವಡಿಸಿಕೊಳ್ಳಬಹುದು.

4. ಹುದ್ದೆಯ ಪ್ರವರ್ಗ, ನೇಮಕಾತಿ ವಿಧಾನ ಮತ್ತು ಕನಿಷ್ಠ ವಿದ್ಯಾರ್ಹತೆ:- ಡಾ.ಬಿ.ಆರ್.ಅಂ.ಅ. ನಿಗಮದ ಸಿಬ್ಬಂದಿ ವರ್ಗವು ಹುದ್ದೆಗಳ ಪ್ರವರ್ಗವನ್ನು ಒಳಗೊಂಡಿದ್ದು ವೇತನ ಶ್ರೇಣಿ, ನೇಮಕಾತಿ ವಿಧಾನ ಮತ್ತು ಕನಿಷ್ಠ ವಿದ್ಯಾರ್ಹತೆಯು ಅನುಸೂಚಿ-I ಮತ್ತು II ಹಾಗೂ VI ರಲ್ಲಿ ನಿರ್ಧಿಷ್ಟಪಡಿಸಿದಂತೆ ಇರತಕ್ಕದ್ದು.

5. ಡಾ.ಬಿ.ಆರ್.ಅಂ.ಅ. ನಿಗಮದ ನೌಕರರು ಕೆಲವು ಇಲಾಖಾ ಪರೀಕ್ಷೆಗಳನ್ನು ತೇರ್ಗಡೆ ಮಾಡಬೇಕಾಗಿರುತ್ತದೆ:- (1) ನೌಕರರು ಈ ನಿಯಮಗಳ ಮೇರೆಗೆ ಉಪಬಂಧಿಸಲಾದಂತೆ ಪ್ರೊಬೇಷನರಿ ಅವಧಿಯೊಳಗೆ ಕನ್ನಡ ಭಾಷಾ ಪರೀಕ್ಷೆಯಲ್ಲಿ ಮತ್ತು ಕೆಲವು ಇತರ ಇಲಾಖಾ ಪರೀಕ್ಷೆಗಳಲ್ಲಿ ತೇರ್ಗಡೆಯಾಗತಕ್ಕದ್ದು. (2) ನೌಕರನು ಇಲಾಖಾ ಪರೀಕ್ಷೆಗಳಲ್ಲಿ ತೇರ್ಗಡೆ ಹೊಂದಿದಾಗ ಮಾತ್ರವೇ ಅವನು ಹೊಂದಿದ ಹುದ್ದೆಯಲ್ಲಿ ಖಾಯಂಗೊಳ್ಳತಕ್ಕದ್ದು ಅಥವಾ ಕಾಲಿಕ ವೇತನ ಶ್ರೇಣಿಯ ವೇತನ ಬಡ್ತಿ ಪಡೆಯತಕ್ಕದ್ದು.

(3) ಯಾವುದೇ ಉನ್ನತ ಹುದ್ದೆಯ ಬಡ್ತಿಗಾಗಿ, ಅಭ್ಯರ್ಥಿಯು, ಈ ನಿಯಮಗಳ ಮೇರೆಗೆ ಉಪಬಂಧಿಸಲಾದಂತೆ ಅಂಥ ಉನ್ನತ ಹುದ್ದೆಗೆ ನಿಗದಿಪಡಿಸಿದ ಇಲಾಖಾ ಪರೀಕ್ಷೆಗಳಲ್ಲಿ ತೇರ್ಗಡೆಯಾಗಿರಬೇಕು. 6. ಶಿಸ್ತು ವ್ಯವಹರಣೆಗಳನ್ನು ಹೂಡುವ ಮತ್ತು ದಂಡನೆಗಳನ್ನು ವಿಧಿಸುವ ಪ್ರಾಧಿಕಾರ ಮತ್ತು ಅಫೀಲು ಉಪಬಂಧಗಳು:- ಡಾ.ಬಿ.ಆರ್.ಅಂಬೇಡ್ಕರ್ ಅಭಿವೃದ್ದಿ ನಿಗಮ ನಿಯಮಿತದ ಯಾರೇ ನೌಕರನ ವಿರುದ್ಧ ಶಿಸ್ತು ವ್ಯವಹರಣೆಗಳನ್ನು ನೇಮಕ ಪ್ರಾಧಿಕಾರವು ಕರ್ನಾಟಕ ಸಿವಿಲ್ ಸೇವೆಗಳ (ವರ್ಗೀಕರಣ, ನಿಯಂತ್ರಣ ಮತ್ತು ಅಪೀಲು) ನಿಯಮಗಳು, 1957ಕ್ಕೆ ಅನುಸಾರವಾಗಿ ಹೂಡಬಹುದು. ನೇಮಕಾತಿ ಪ್ರಾಧಿಕಾರ, ವಿವಿಧ ಬಗೆಯ ದಂಡನೆಗಳನ್ನು ವಿಧಿಸುವ ಶಿಸ್ತು ಪ್ರಾಧಿಕಾರ ಮತ್ತು ಅಪೀಲು ಪ್ರಾಧಿಕಾರಗಳು ಈ ನಿಯಮಗಳಿಗೆ ಸೇರ್ಪಡೆ ಮಾಡಲಾದ III ನೇ, IV ನೇ ಮತ್ತು Vನೇ ಅನುಸೂಚಿಯಲ್ಲಿ ನಿರ್ದಿಷ್ಟಪಡಿಸಲಾದಂತೆ ಇರತಕ್ಕದ್ದು.

7. ನಿವೃತ್ತಿ ಪ್ರಯೋಜನಗಳು:- ನಿಗಮದ ನೌಕರರು ನಿವೃತ್ತಿಯ ನಂತರ ಈ ಮುಂದಿನ ಪ್ರಯೋಜನಗಳನ್ನು ಪಡೆಯಲು ಅರ್ಹರಾಗಿರುತ್ತಾರೆ.

ಈ ವಿನಿಯಮಗಳಲ್ಲಿ ಒಳಗೊಂಡಿರುವುದು ಏನೇ ಇದ್ದರೂ, ಡಾ.ಬಿ.ಆರ್.ಅಂ.ಅ.ನಿ. ನಿಯಮಿತದ ಯಾರೇ ನೌಕರನು ನಿವೃತ್ತಿ ವೇತನಕ್ಕೆ ಅರ್ಹನಾಗಿರತಕ್ಕದ್ದಲ್ಲ.

ಒಂದು ವೇಳೆ, ಸಮಾಜ ಕಲ್ಯಾಣ ಇಲಾಖೆಯ ಆಯುಕ್ತರು, ಡಾ.ಬಿ.ಆರ್.ಅಂಬೇಡ್ಕರ್ ಅಭಿವೃದ್ಧಿ ನಿಗಮ ನಿಯಮಿತದ ವ್ಯವಸ್ಥಾಪಕ ನಿರ್ದೇಶಕರಿಗಿಂತ ಹಿರಿಯರಾಗಿದ್ದರೆ ಆಗ ಅವರೇ ಅಧ್ಯಕ್ಷರಾಗಿರತಕ್ಕದ್ದು.

2. ಬಡ್ತಿ ಸಮಿತಿ: ಇಲಾಖೆಯ ಬಡ್ತಿ ಸಮಿತಿಯು ಈ ಮುಂದಿನ ಅಧಿಕಾರಿಗಳನ್ನು ಒಳಗೊಂಡಿರತಕ್ಕದ್ದು.

ಬಡ್ತಿಗಾಗಿ ಅರ್ಹತೆ ಹೊಂದಲು ನಿಗದಿಪಡಿಸಿರುವ ಇಲಾಖಾ ಪರೀಕ್ಷೆಗಳಲ್ಲಿ ತೇರ್ಗಡೆ ಹೊಂದಬೇಕು ಮತ್ತು ಒಂದು ವರ್ಷ ಸ್ಥಾನಪನ್ನ ಅವಧಿಯನ್ನು ನಿಗದಿಪಡಿಸಲಾಗಿದೆ.

In exercise of the powers conferred under the Articles of Association of the Dr.B.R.AMBEDKAR DEVELOPMENT CORPORATION LIMITED (herein after called as Dr.BRADC) the Board of Directors of the said corporation with the approval of the Government of Karnataka makes the following regulation namely:

RULES

1. Title and commencement:- (1) These Rules may be called the Dr.BRADC (Cadre and Recruitment) Rules, 2013.

(2) They shall come into force on the date of notification by the Board of Directors of the Corporation.

2. Definitions:- (1) In these Rules, unless the context otherwise requires:-

a) "Appointing Authority" means the Managing Director of the Dr.BRADC.

b) "Direct Recruitment" in relation to any category of service or post includes appointment otherwise than by promotion or deputation from any state civil service or corporate or Body:

c) "Employee" means employee of the Corporation appointed in accordance with these regulations:

d) "Board of Directors" means the Board of Directors of the Corporation formed as per Articles of Association of the Corporation.

e) "Officer" means the Officer of the Corporation.

f) "Backward Classes" means the persons belonging to the classes or categories so notified by the Government of Karnataka as Backward Classes.

g) "Promotion" means the appointment from a lower post or grade of service to a higher post or grade of service in the corporation.

h) "Recruitment Committee" means the Committee as prescribed in these Rules Authority appointed by the Board of Directors for the purpose of making direct recruitment.

i) "Scheduled Castes" and "Scheduled Tribes" shall have reference to the Scheduled Castes and Scheduled Tribes in the Constitution (Scheduled Castes/Scheduled Tribes) Order 1950 made under Articles 341 and 342 of the Constitution of India:

j) "Selection" means selection in accordance with the provisions of these Rules by the Recruitment Committee.

k) "Corporation" means the Dr.BRADC., registered under the companies Act 1956.,

(2) Words used but not defined in these Rules shall have the meaning assigned to them in the Companies Act, 1956 or as the case may be, in the rules made or deemed to have been made under the Karnataka State Civil Services Act, 1978 (Karnataka Act 14 of 1990).

3. Application of other rules to the employees of the Dr.BRADC :- The provisions of the other Rules as prescribed by the Government of Karnataka for Government Employees save as otherwise provided in these Rules, may be adopted as required with the approval of the Board for the Employees of Dr.BRADC.

4. Category of posts, method of recruitment and minimum qualification:- The establishment of the Dr.BRADC., shall consist of the category of posts, scale of pay, the method of recruitment and minimum qualification shall be as specified in scheduled I and II and VI.

5. Employees of the Dr.BRADC., to pass certain Departmental Examinations:-

(1) The employee shall pass kannada language examination & certain other departmental examinations within the probationary period as provided under these Rules.

(2) Employee shall be confirmed in the post held by him or shall earn an increment in the time scale of the pay only when he passes the departmental examinations.

(3) For promotion to any higher post, candidate must have passed departmental examinations for such higher post, as provided under these rules.

6. Authority to institute disciplinary proceedings and impose penalties and appeal provisions:-

The disciplinary proceedings against an employee of the Dr.B.R.Ambedkar Development Corporation Limited may be instituted by the Appointing Authority in accordance with the Karnataka Civil Services (Classification, Control and Appeal) Rules 1957. The Appointing Authority, the Disciplinary Authority to impose different type of penalties and Appellate Authority shall be as specified in Schedule – III, IV and V appended to these Rules.

7. Retirement benefits:- Employees of Corporation are eligible for the following benefits after retirement.

a) Group gratuity

b) Group Insurance

c) Employees Provident Fund

d) Earned Leave Encashment

Notwithstanding anything contained in these regulations, an employee of the Dr. BRADCL shall not be eligible for pension.

In the application cited above of M/s. Best Associates, No.1/1, 2nd Cross, 1st Main, Maruthinagar, Madivala, Bangalore-560068 has sought clarification regarding the rate of tax applicable on 'half cooked chapathies'.

2. Section 59(4) of the Karnataka Value Added Tax Act , 2003 empowers the Commissioner of Commercial Taxes to clarify the rate of tax payable under the Act, if he considers it necessary or expedient so to do, for the purpose of maintaining uniformity in the work of assessments and collection of revenue. It is examined and found that the clarification requested by the petitioner is within the scope of the aforesaid provision and it is necessary that the clarification be issued for the purpose of maintaining uniformity in the work of assessments and collection of revenue.

3. Hence the following clarification is issued.

1. ವಾದಿಯು ಕರ್ನಾಟಕ ಸಹಕಾರ ಸಂಘಗಳ ಕಾಯ್ದೆ 1959ರ ಕಲಂ 70 ರಡಿ ದಾವಾ ಅರ್ಜಿಯನ್ನು ಸಲ್ಲಿಸಿ 1 ರಿಂದ 30ನೇ ಪ್ರತಿವಾದಿಗಳಿಂದ ರೂ.4,36,78,537/- (ರೂ. ನಾಲ್ಕು ಕೋಟಿ ಮೂವತ್ತಾರು ಲಕ್ಷದ ಎಪ್ಪತ್ತೆಂಟು ಸಾವಿರದ ಐದು ನೂರ ಮೂವತ್ತೇಳು ರೂಪಾಯಿಗಳು ಮಾತ್ರ) ಗಳು ಹಾಗೂ ಈ ಮೊತ್ತಕ್ಕೆ ದಿನಾಂಕ: 24-05-1996 ರಿಂದ ಸಾಲಿಯಾನ ಶೇ.22.5% ರಷ್ಟು ಬಡ್ಡಿ ದರದಂತೆ ಅಸಲು ಮತ್ತು ಬಡ್ಡಿ ವಸೂಲಾತಿಗಾಗಿ ದಾವೆಯನ್ನು ಹೂಡಿರುತ್ತಾರೆ. ಈ ದಾವೆಯನ್ನು ವಿಚಾರಣೆಗೆ ತೆಗೆದುಕೊಂಡು, ವಿಚಾರಣೆ ನಡೆಸಲಾಗುತ್ತಿದೆ. ಪ್ರಕರಣದ ವಿಚಾರಣಾ ಹಂತದಲ್ಲಿ ವಾದಿಯು ಪ್ರಮಾಣ ಪತ್ರದೊಂದಿಗೆ ಕಲಂ 103 ರಡಿ ಅರ್ಜಿಯನ್ನು ಸಲ್ಲಿಸಿ 24ನೇ ಪ್ರತಿವಾದಿಯ ಹೆಸರಿನಲ್ಲಿರುವ ಸ್ಥಿರಾಸ್ತಿಯನ್ನು ಆದೇಶ ಪೂರ್ವ ಜಪ್ತಿ ಆದೇಶ ಹೊರಡಿಸಬೇಕೆಂದು ಕೋರಿರುತ್ತಾರೆ.

2. ಅರ್ಜಿದಾರರು ಕಲಂ 103 ರ ಅರ್ಜಿ ಜೊತೆ ಸಲ್ಲಿಸಲಾಗಿರುವ ಪ್ರಮಾಣ ಪತ್ರದಲ್ಲಿ 1ನೇ ಪ್ರತಿವಾದಿ ಸಂಘದ ಆಡಳಿತ ಮಂಡಳಿಯನ್ನು ಸಹಕಾರ ಇಲಾಖೆಯು 1994ನೇ ಸಾಲಿನಲ್ಲಿ ರದ್ದು ಮಾಡಿರುತ್ತದೆ. ಈ ಆದೇಶವನ್ನು ಬಾದಿತ ವಾದಿ ಬ್ಯಾಂಕಿನ ಆಡಳಿತ ಮಂಡಳಿ ಸದಸ್ಯರು ಗೌರವ ಉಚ್ಚ ನ್ಯಾಯಾಲಯದಲ್ಲಿ ಪ್ರಶ್ನಿಸಿದ್ದು, ರಿಟ್ ಅಫೀಲು ಸಂ.2218 ಮತ್ತು 2219 CW/1991 ಹಾಗೂ 1992/1994 ಈ ರಿಟ್ ಅಪೀಲಿನನ್ವಯ ಗೌರವ ನ್ಯಾಯಾಲಯವು ಪ್ರತಿವಾದಿ 15 ರಿಂದ 19 ರವರುಗಳನ್ನು Government Nominees as Ad-Hoc Committee members to run the bank administration till holding of new election on 02-12-1994 ಅದರನ್ವಯ ಸದರಿ ಅಡಾಕ್ ಕಮಿಟಿಯು ದಿನಾಂಕ: 13-05-1995 ರವರೆಗೆ ಕಾರ್ಯನಿರ್ವಹಿಸಿರುತ್ತದೆ. ಈ ಅವಧಿಯಲ್ಲಿ 24ನೇ ಪ್ರತಿವಾದಿಯು ವಾದಿ ಬ್ಯಾಂಕಿನಲ್ಲಿ ಕಾರ್ಯನಿರ್ವಹಿಸಿ ಈ ಅವಧಿಯಲ್ಲಿ ಸಾಲ ಮಂಜೂರು ಆಗಿರುತ್ತದೆ.

ಆದರೆ ಅಡಾಕ್ ಕಮಿಟಿಯು ವಾದಿ ಸಂಘದಲ್ಲಿ ರೂ. 4,00,00,000/- ಕ್ಕೆ ದಿನಾಂಕ: 15-04-1995 ರಂದು ಅರ್ಜಿ ಸಲ್ಲಿಸಿ ಸಾಲವನ್ನು ಪಡೆದಿರುತ್ತಾರೆ.

ಆದರೆ ಈ ಸಾಲ ಮಂಜೂರಾತಿಯಲ್ಲಿ ಅಡಾಕ್ ಕಮಿಟಿಯು ಗೌರವ ಉಚ್ಚ ನ್ಯಾಯಾಲಯದ ಆದೇಶ, ಸಂಘದ ಬೈಲಾ ಮತ್ತು ಸಾಲಗಳ ನಿಯಮ ಮತ್ತು ನಿಬಂಧನೆಗಳನ್ನು ಉಲ್ಲಂಘನೆ ಮಾಡಿ, ಅರ್ಜಿದಾರ ಬ್ಯಾಂಕಿಗೆ ಸುಳ್ಳು ಮಾಹಿತಿ ನೀಡಿ ಮೋಸ ಮಾಡಿರುತ್ತಾರೆ. ಆದರೆ ಪ್ರಸ್ತುತ 1ನೇ ಪ್ರತಿವಾದಿ ಸಂಘವು ತನ್ನ ಕಾರ್ಯಚಟುವಟಿಕೆ ನಡೆಸದೇ ಇರುವಂತಹ ಸ್ಥಿತಿಯನ್ನು ತಲುಪಿದ್ದು, ಮುಂದೆಯು ಸಹ ಕಾರ್ಯಚಟುವಟಿಕೆಗಳನ್ನು ನಡೆಸುವ ಸಾಧ್ಯತೆ ಇಲ್ಲವೆಂದು ಮನಗಂಡು ಕಲಂ 70 ರಡಿಯಲ್ಲಿ ದಾವೆಯನ್ನು ಹೂಡಲಾಗಿದೆ. ಈ ಎಲ್ಲಾ ಅವ್ಯವಹಾರಕ್ಕೆ ಅಡಾಕ್ ಕಮಿಟಿಯ ಸದಸ್ಯರು, 1ನೇ ಪ್ರತಿವಾದಿ ಸಂಘದ ಆಡಳಿತ ಮಂಡಳಿ ಸದಸ್ಯರು ಮತ್ತು ಬ್ಯಾಂಕಿನ ನೌಕರರು ಒಳಗೂಡಿ ವೈಯಕ್ತಿಕವಾಗಿ ಮತ್ತು ಜಂಟಿಯಾಗಿ ಅವ್ಯವಹಾರ ನಡೆಸಿ ಅರ್ಜಿದಾರ ಬ್ಯಾಂಕಿನ ಸಾಲದ ಮೊತ್ತವನ್ನು ಉಪಯೋಗಿಸಿಕೊಂಡು ನಂತರ ಬ್ಯಾಂಕಿಗೆ ನಷ್ಟ ಉಂಟಾಗಲು ಕಾರಣ ಕರ್ತರಾಗಿರುತ್ತಾರೆ. ಈ ಹಿನ್ನಲೆಯಲ್ಲಿ ದಾವೆಗಳನ್ನು ಹೂಡಲಾಗಿದೆ. ಆದರೆ ಈ ದಾವೆಯು ಇತ್ಯರ್ಥವಾಗುವಲ್ಲಿ ಕಾನೂನು ರೀತ್ಯಾ ನಡವಳಿಕೆಗಳು ನಡೆಸಿ ಇತ್ಯರ್ಥಪಡಿಸುವಲ್ಲಿ ಸಮಯಾವಕಾಶ ತೆಗೆದುಕೊಳ್ಳುತ್ತಿದ್ದು, ಈ ಮಧ್ಯ ಪ್ರತಿವಾದಿಗಳು ತಮ್ಮ ಹೆಸರಿನಲ್ಲಿರುವ ಮತ್ತು ತಮ್ಮ ಕುಟುಂಬ ಸದಸ್ಯರ ಹೆಸರಿನಲ್ಲಿರುವ ಸ್ಥಿರಾಸ್ತಿಗಳನ್ನು ಮಾರಾಟ ಮಾಡುವ ಸಾಧ್ಯತೆಗಳಿರುತ್ತವೆ. ಒಂದು ವೇಳೆ ಈ ರೀತಿ ಪ್ರತಿವಾದಿಗಳು ತಮ್ಮ ಹೆಸರಿನಲ್ಲಿರುವ ಸ್ಥಿರಾಸ್ತಿಗಳನ್ನು ಮಾರಾಟ ಮಾಡಿದ ಪಕ್ಷದಲ್ಲಿ ಈ ದಾವೆಯ ಅಂತಿಮ ಆದೇಶ ಅರ್ಜಿದಾರ ಬ್ಯಾಂಕಿನ ಪರವಾಗಿ ಬಂದರೂ ಸಹ ಅವಾರ್ಡ್ ಮೊತ್ತವನ್ನು ವಸೂಲಿ ಮಾಡಿಕೊಳ್ಳಲು ಸಾಧ್ಯವಾಗದ ಪರಿಸ್ಥಿತಿ ಉಂಟಾಗುವ ಸಾಧ್ಯತೆ ಇರುವುದರಿಂದ ಕಲಂ 103 ರಡಿಯಲ್ಲಿ ಸಲ್ಲಿಸಲಾಗಿರುವ ಅರ್ಜಿ ಆಧಾರಿತ 24ನೇ ಪ್ರತಿವಾದಿಗೆ ಸೇರಿದ ಸ್ಥಿರಾಸ್ತಿಯನ್ನು ಆದೇಶಕ್ಕೆ ಪೂರ್ವ ಜಪ್ತಿ ಆದೇಶ ಹೂರಡಿಸಬೇಕೆಂದು ಕೋರಿದ್ದನ್ನು ಪುರಸ್ಕರಿಸಿ ದಿನಾಂಖ: 02-12-2013 ರಂದು ಷರತ್ತುಬದ್ದ ಆದೇಶವನ್ನು ಹೊರಡಿಸಲಾಗಿತ್ತು. 3. ಕಲಂ 103ರ ಅಡಿಯಲ್ಲಿ ಜಪ್ತಿ ಪೂರ್ವ ಷರತ್ತುಬದ್ದ ಆದೇಶ ನೋಟಿಸ್‌ನ್ನು ಸಂಬಂದಿದವರಿಗೆ ಜಾರಿ ಮಾಡಲಾಗಿತ್ತು. 24ನೇ ಪ್ರತಿವಾದಿ ತಮ್ಮ ವಕೀಲರ ಮೂಲಕ ತಮ್ಮ ಆಕ್ಷೇಪಣೆಗಳನ್ನು ಸಲ್ಲಿಸಿರುತ್ತಾರೆ. ತಮ್ಮ ಆಕ್ಷೇಪಣೆಗಳಲ್ಲಿ 15 ವರ್ಷದ ನಂತರ ಜಪ್ತಿ ಪೂರ್ವ ಆದೇಶವನ್ನು ಸಲ್ಲಿಸಿದ್ದು ಇಷ್ಟು ವರ್ಷ ಕಾಲ ವಿಳಂಬವಾಗಲು ವಾದಿ ಬ್ಯಾಂಕ್ ಕಾರಣವಾಗಿದ್ದು 24ನೇ ಪ್ರತಿವಾದಿ ನಿಷ್ಟವಂತ ಬ್ಯಾಂಕಿನ ಕೆಲಸಗಾರನಾಗಿದ್ದು ಷರತ್ತುಬದ್ದ ಆದೇಶದಲ್ಲಿ ವಿಧಿಸಿರುವ ಷರತ್ತುಗಳನ್ನು ಪೂರೈಸಲು ಸಾಧ್ಯವಿಲ್ಲವೆಂದು ತಿಳಿಸಿರುತ್ತಾರೆ.

4. 24ನೇ ಪ್ರತಿವಾದಿ ಬ್ಯಾಂಕಿನ ನೌಕರನಾಗಿದ್ದು ಈ ಪ್ರಕರಣಕ್ಕೆ ಸಂಬಂಧಿಸಿದಂತೆ ಈಗಾಗಲೇ ಮಾನ್ಯ ಸಿ.ಬಿ.ಐ. ನ್ಯಾಯಾಲಯದಲ್ಲಿ 24ನೇ ಪ್ರತಿವಾದಿ ವಿರುದ್ದ ಆರೋಪಗಳಿದ್ದು ಆರೋಪಪಟ್ಟಿಯನ್ನು ಸಲ್ಲಿಸಿರುವುದಾಗೀ ದಾವಾ ಅರ್ಜಿ ಕ್ಲೇಮ್‌ಗೆ 24ನೇ ಪ್ರತಿವಾದಿ ನೇರವಾಗಿ ಮತ್ತು ಪರೋಕ್ಷವಾಗಿ ಜವಬ್ದಾರರಾಗಿದ್ದು ಸದ್ಯಕ್ಕೆ ಪ್ರತಿವಾದಿ ಕೆಲಸದಿಂದ ನಿವೃತ್ತಿ ಹೊಂದಿರುವುದಾಗಿ ಪ್ರಮಾಣ ಪತ್ರದಲ್ಲಿ ತಿಳಿಸಿ ಜೊತೆಗೆ 24ನೇ ಪ್ರತಿವಾದಿ ಹೆಸರಿನಲ್ಲಿರುವ ಕ್ರಯ ಪತ್ರ, ಋುಣಭಾರ ರಾಹಿತ್ಯ ಪತ್ರವನ್ನು ಸಹ ಹಾಜರುಪಡಿಸಿರುತ್ತಾರೆ. ಅವುಗಳನ್ನು ಪರಿಶೀಲಿಸಿ ಷರತ್ತುಬದ್ದ ತಿಳುವಳಿಕೆ ನೋಟಿಸನ್ನು ನೀಡಲಾಗಿತ್ತು ಕಲಂ 103 ಅರ್ಜಿಯನ್ನು ಪರಿಗಣಿಸದೇ ಇದ್ದ ಪಕ್ಷದಲ್ಲಿ ಈ ಪ್ರಕರಣದಲ್ಲಿ ಅಂತಿಮ ಆದೇಶ ಹೊರಡಿಸಿದಾಗ್ಯೂ 24ನೇ ಪ್ರತಿವಾದಿ ವಿರುದ್ದ ಕ್ಲೇಂ ಮೊತ್ತ ಸಾಬೀತಾದಲ್ಲಿ ಆ ಮೊತ್ತವನ್ನು ವಸೂಲಿ ಮಾಡುವುದು ಕಷ್ಟ ಸಾಧ್ಯವಾಗುವುದೆಂಬುದನ್ನು ಮನಗಂಡು 24ನೇ ಪ್ರತಿವಾದಿ ಹೆಸರಿನಲ್ಲಿರುವ ಸ್ಥಿರಾಸ್ತಿಯನ್ನು ಆದೇಶಕ್ಕೆ ಪೂರ್ವ ಜಪ್ತಿ ಮಾಡುವುದು ಸೂಕ್ತ ಎಂಬ ಅಭಿಪ್ರಾಯಕ್ಕೆ ಬಂದು ಷರತ್ತುಬದ್ದ ಆದೇಶವನ್ನು ಹೊರಡಿಸಲಾಗಿತ್ತು ಆದರೆ 24ನೇ ಪ್ರತಿವಾದಿ ಷರತ್ತುಬದ್ದ ಆದೇಶದಲ್ಲಿ ತಿಳಿಸಿರುವ ಷರತ್ತುಗಳನ್ನು ಪೂರೈಸದ ಕಾರಣ ಹಾಗೂ ಪೂರೈಸಿದ ಬಗ್ಗೆ ದಾಖಲಾತಿಗಳನ್ನು ಈ ನ್ಯಾಯಾಲಯಕ್ಕೆ ಹಾಜರುಪಡಿಸಿರುವುದಿಲ್ಲ ಆದ ಕಾರಣ 24ನೇ ಪ್ರತಿವಾದಿಗೆ ಸೇರಿದ ಸ್ತಿರಾಸ್ಥಿಯನ್ನು ದಿನಾಂಕ 02-12-2013ರಂದು ಆದೇಶ ಪೂರ್ವ ಜಪ್ತಿ ಮಾಡಿ ಹೊರಡಿಸಲಾಗಿದ್ದ ಷರತ್ತುಬದ್ದ ಆದೇಶವನ್ನು ಸ್ಥಿರೀಕರಸುವುದು ಸೂಕ್ತ ಮತ್ತು ಅಗತ್ಯವೆಂದು ಮನಗಂಡು ಈ ಕೆಳಕಂಡ ಆದೇಶ ಹೊರಡಿಸಲಾಗಿದೆ.

Authority by a registered dealer shall be kept by him in safe custody and he shall be personally responsible for the lost, destruction or theft of any such form or the loss of Government revenue if any result in directly or indirectly from such theft or loss.

The dealer has submitted a report to this office that the above form or forms issued by him to the selling dealer have been lost in transit at the hands of the seller. He therefore has submitted an indemnity bond as prescribed in Form-G to this office and requested to permit him to issue another Form. Further, he has also filed a letter stating that the selling dealer has also furnished indemnity bond to the notified authority of his State where the said form was lost in his custody. Further, the dealer to whom the forms were issued has made appropriate entries in remarks columns of the C-Forms usage register maintained by him.

The dealer has also reported that he has issued a Notification in the local newspaper of the loss of such forms and also filed complaint before the Jurisdictional Police. The selling dealer has also reported the loss in the newspapers of his area. In view of the above, the dealer is permitted to issue new Form in lieu of the lost form to his seller.

In exercise of the powers conferred by sub – section (1) of section 93 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act 2013 (Central Act N. 30 of 2013), the Government of Karnataka hereby withdraws from acquisition the lands specified below in respect of which the Preliminary Notification was published in the Karnataka Gazette dated:

06-04-1989 in Part-III at pages from 305 to 328 vide Notification No.BDA/SLAO/A1/324/88-89, dated:29-12-1988 and Final Notifications No. HUD 127 MNX 1994 dated 09.05.1994 and UDD 434 MNX 1997 dated: 16-09-1997 was published in the Karnataka Gazette dated:18.05.1994 and 17-09-1997 respectively under Sub-section(1) of Section-19 of BDA Act 1976 (Karnataka Act -12 of 1976) for formation of layout Called " BANASHANKARI VTH STAGE LAYOUT''.

TOTAL EXTENT WITHDRAWN 09 ACRES 21 Guntas (Nine Acres and Twenty One Guntas Only)
