ORDER

New Delhi, the 12th September 2016

S.O. 2923 (E).- Whereas, the Aadhaar (Targeted Delivery of Financial and Other Subsides, Benefits, and Services) Act, 2016 (the said act) received the assent of the President on 25th March 2016 and was published in the Gazette of India on 26th March 2016;

And whereas, sections 11 to 20, 22 to 23 and sections 48 to 59 have come into force and the Unique Identification Authority of India (the Authority) has been established under section 12 of the Act on 12th July 2016;

And whereas, the Unique Identification Authority of India (Terms and Conditions of Service of Chairperson and Members) Rules, 2016 have been notified on 12th July 2016 which require selection of the Chairperson and members through a Search-cum-Selection Committee headed by the Cabinet Secretary;

of the Act and various regulations which are required to give effect to the provisions of the Act can be framed by the Authority, which is likely to take some time;

And whereas, till such time that the Chairperson and Members are appointed and regulations framed, difficulties may arise in the Authority discharging its powers and functions under section 23 without having in place the regulations necessary for the same, which may result in residents being unable to receive subsides, benefits, and services by using the Aadhaar number;

Now, therefore, in exercise of the powers conferred by sub-section (1) of section 58(1) of the said Act, the Central Government hereby makes the following Order to remove the aforesaid difficulties, namely :-

1. Short title and commencement.- (1) This Order may be called the Aadhaar (Removal of Difficulties) Order, 2016.

(2) It shall be deemed to have come into force from the 12th of July, 2016, and shall be in force till such time all provisions of the Act come in force and regulations are made which are necessary to give effect to the said provisions, or till the expiry of three months from the date on which this order comes into force, whichever is earlier.

2. Continuance of procedures to be followed by the Authority.- (1) The procedures, processes, practices, guidelines, and circulars issued by the Unique Identification Authority of India established vide Resolution of the Government of India, Planning Commission bearing notification number A-43011/02/2009- Admin. I, dated the 28th January, 2009, or issued under the Cabinet Secretariat Notification bearing notification number S.O. 2492(E), dated the 12th September, 2015 shall continue to be followed by the Authority established under section 11 of the said Act till such time this Order is in force:

Provided that till such time this Order is in force, the processes of enrolment shall continue and consents shall be obtained as per the provisions contained in sub-section 2 of Section 3 of the said Act in revised sample forms, incorporating the new formats for consent as given in Schedule lA and 1 B.

(2) All actions that may be taken by the Central Government, the Authority, their officers, and staff in accordance with the said procedures, processes, policies, practices and systems shall be deemed to be actions authorised under this Act.

NOTIFICATION

G.S.R. 827 (E).- In exercise of the powers conferred by the proviso to article 309 of the Constitution, the President hereby makes the following rules further to amend the Ministry of Communications and Information Technology, Department of Information Technology (Group 'C' posts) Recruitment Rules, 2010, namely:-

1. Short title and commencement.- (1) These rules may be called the Ministry of Electronics and Information Technology (Group 'C' posts) Recruitment (Amendment) Rules, 2016.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. In the Schedule to the Ministry of Communications and Information Technology, Department of Information Technology (Group 'C' posts) Recruitment Rules, 2010,-

(a) in serial number 1, against the post of Upper Division Clerk, in column number (12), under the sub-heading 'Promotion', after Note 2 and the entries relating thereto, the following shall be inserted, namely:-

"Note 3: The approved service rendered in the grade, on the 1st day of the Recruitment Year, as the residency period will be counted for promotion. The expression "Approved Service "for the various modes of recruitment shall be as under,-

(i) in respect of an officer recruited directly to that grade, period or periods of regular service rendered in that grade, including period or periods of absence during which he would have held a post on regular basis in that grade but for his being on leave or otherwise not being available to hold such post, from the first day of the recruitment year, following the year in which the examination for direct recruitment was held;

(ii) in respect of an officer recruited to that grade through departmental examination, period or periods of regular service rendered in that grade, including period or periods of absence during which he would have held a post on regular basis in that grade but for his being on leave or otherwise not being available to hold such post, from the first day of the recruitment year for vacancies of which such examination was held;

(iii) in respect of an officer recruited to that grade on the basis of length of service in the lower grade, period or periods of regular service rendered in that grade, including period or periods of absence during which he would have held a post on regular basis in that grade but for his being on leave or otherwise not being available to hold such post, from the first day of the recruitment year for which the recruitment was made:

Provided that where there is delay of more than Ninety days in joining on appointment, in any of the cases mentioned in the sub-clauses (i), (ii) and (iii) above, such delay should not be due to any fault on the part of the officer.

Note 4: Where juniors who have completed their qualifying or eligibility service are being considered for promotion, their seniors would also be considered, provided they are not short of the requisite qualifying or eligibility service by more than half of such qualifying or eligibility service or two years, whichever is less, and have successfully completed their probation period for promotion to the next higher grade. along with their juniors who have already completed such qualifying or eligibility service. ",

(b) in serial number 4, against the post of Senior Reprographer, in column number 12, under the sub-heading 'Promotion', after Note 2 and the entries relating thereto, the following shall be inserted, namely:-

"Note 3: The approved service rendered in the grade, on the 1st day of the Recruitment Year, as the residency period will be counted for promotion. The expression "Approved Service" for the various modes of recruitment shall be as under,-

(i) in respect of an officer recruited directly to that grade. period or periods of regular service rendered in that grade, including period or periods of absence during which he would have held a post on regular basis in that grade but for his being on leave or otherwise not being available to hold such post, from the first day of the recruitment year, following the year in which the examination for direct recruitment was held;

(ii) in respect of an officer recruited to that grade on the basis of length of service in the lower grade, period or periods of regular service rendered in that grade, including period or periods of absence during which he would have held a post on regular basis in that grade but for his being on leave or otherwise not being available to hold such post, from the first day of the recruitment year for which the recruitment was made:

"Note 3: The approved service rendered in the grade. on the 1st day of the Recruitment Year, as the residency period will be counted for promotion. The expression "Approved Service" for the various modes of recruitment shall be in respect of an officer recruited directly to that grade, period or periods of regular service rendered in that grade, including period or periods of absence during which he would have held a post on regular basis in that grade but for his being on leave or otherwise not being available to hold such post, from the first day of the recruitment year, following the year in which the examination for direct recruitment was held";

Provided that where there is delay of more than Ninety days in joining on appointment, in any of the cases mentioned in the sub-clause above, such delay should not be due to any fault on the part of the officer.

"Note 3: The approved service rendered in the grade. on the 1st day of the Recruitment Year, as the residency period will be counted for promotion. The expression "Approved Service" for the various modes of recruitment shall be as under,-

(i) in respect of an officer recruited directly to that grade. period or periods of regular service rendered in that grade.

including period or periods of absence during which he would have held a post on regular basis in that grade but for his being on leave or otherwise not being available to hold such post. from the first day of the recruitment year.

(e) in serial number 9, against the post of Staff Car Driver Grade-Il, in column number 12, under the heading 'Promotion', after Note 2 and the entries relating thereto, the following shall be inserted, namely:-

"Note 3: The approved service rendered in the grade. on the 1st day of the Recruitment Year, as the residency period will be counted for promotion. The expression "Approved Service" for the various modes of recruitment shall be in respect of an officer recruited directly to that grade, period or periods of regular service rendered in that grade, including period or periods of absence during which he would have held a post on regular basis in that grade but for his being on leave or otherwise not being available to hold such post, from the first day of the recruitment year, following the year in which the examination for direct recruitment was held;

sub-clause above, such delay should not be due to any fault on the part of the officer.

Note 4: Where juniors who have completed their qualifying or eligibility service are being considered for promotion, their seniors would also be considered, provided they are not short of the requisite qualifying or eligibility service by more than half of such qualifying or eligibility service or two years, whichever is less, and have successfully completed their probation period for promotion to the next higher grade, along with their juniors who have already completed such qualifying or eligibility service. ",

(f) in serial number 10, against the post of Staff Car Driver (Ordinary Grade), in column number 12, under the sub-heading 'Promotion', after Note 2 and the entries relating thereto, the following shall be inserted, narnely:-

"Note 3: The approved service rendered in the grade, on the 1st day of the Recruitment Year, as the residency period will be counted for promotion. The expression "Approved Service" for the various modes of recruitment shall be in respect of an officer recruited directly to that grade, period or periods of regular service rendered in that grade, including period or periods of absence during which he would have held a post on regular basis in that grade but for his being on leave or otherwise not being available to hold such post, from the first day of the recruitment year, following the year in which the examination for direct recruitment was held;

Provided that where there is delay of more than Ninety days in joining on appointment, in any of the cases mentioned in the sub-clause above, such delay should not be due to any fault on the part of the officer.

Note 4: Where juniors who have completed their qualifying or eligibility service are being considered for promotion, their seniors would also be considered, provided they are not short of the requisite qualifying or eligibility service by more than half of such qualifying or eligibility service or two years, whichever is less, and have successfully completed their probation period for promotion to the next higher grade, along with their juniors who have already completed such qualifying or eligibility service. (g) in serial number 12, against the post of Senior Roneo Operator, in column number 12, under the sub-heading 'Promotion', after Note 2 and the entries relating thereto, the following shall be inserted, namely:-

"Note 3: The approved service rendered in the grade, on the 1st day of the Recruitment Year, as the residency period will be counted for promotion. The expression "Approved Service" for the various modes of recruitment shall be in respect of an officer recruited directly to that grade, period or periods of regular service rendered in that grade, including period or periods of absence during which he would have held a post on regular basis in that grade but for his being on leave or otherwise not being available to hold such post, from the first day of the recruitment year, following the year in which the examination for direct recruitment was held;

S.O. 41 (E).- In exercise of the powers conferred by clause (a) of Section 3 of the National Highways Act, 1956 (48 of 1956), the Central Government hereby makes the following amendments in the notification of the Government of India in the Ministry of Road Transport and Highways number S.O. 2545 (E) dated 18th September, 2015, published in the Gazette of India. Extraordinary, Part II, Section 3, Sub section (ii), dated the 18-09-2015 namely :-

(1) In the Schedule to the aforesaid Notification :-

(i) In the taluk of Channapatna of district Ramanagara the word "Dabanugunada" at Sl. No. 50 in the name of village shall be substituted with "Dabanugunda". This shall be done only in the English version.

(ii) In Columns 1 to 4 the following entries shall be inserted respectively :-

NOTIFICATION

New Delhi, the 4th January 2017

G.S.R. 04 (E).- The following draft of certain rules further to amend the Central Motor Vehicles Rules, 1989, which the Central Government proposes to make in exercise of the powers conferred by section 110 of Motor Vehicles Act, 1988 (59 of 1988), is hereby published as required by sub-section (1) of section 212 of the said Act for information of all persons likely to be affected thereby; and notice is hereby given that the said draft rules will be taken into consideration after expiry of a period of thirty days from the date on which the copies of this notification as published in the Official Gazette, are made available to the public;

2. Any objections or suggestions which may be received from any person with respect to the said draft rules within the expiry of the period so specified will be considered by the Central Government.

3. Objections or suggestions, if any, may be sent to the Joint Secretary (Transport), Ministry of Road Transport and Highways, Transport Bhawan, Parliament Street, New Delhi-110001, within the period specified above.

DRAFT RULES

1. (1) These rules may be called the Central Motor Vehicles (…….Amendment) Rules, 2017.

(2) They shall come into force on the date of their final publication in the Official Gazette.

2. In the Central Motor Vehicle Rules (hereinafter referred as the said Rules), in sub-rule 125-C, after ub-rule (4), the following sub-rule shall be inserted, namely:-

"(5) On and after the expiry of six months from the date of commencement of the Central Motor Vehicles (-Amendment) Rules, 2017, the testing and approval for body building of double decked buses shall be in accordance with AIS- 139:2016, as amended from time to time, for vehicles mentioned therein, till the corresponding BIS specifications are notified under the Bureau of Indian Standards Act, 1986 (63 of 1986).".
