ವಿಷಯ: ಕುವೆಂಪು ಕೋ-ಆಪರೇಟಿವ್ ಕ್ರೆಡಿಟ್ ಸೊಸೈಟಿ ನಿಯಮಿತ ರಾಜಾಜಿನಗರ 2ನೇ ಹಂತ, ಬೆಂಗಳೂರು-560 010 ಈ ಸೊಸೈಟಿಯ ಸಿ.ಇ.ಪಿ.ನಂ. ಎಆರ್‌ಬಿ-4/ಸಿಇಪಿ/37/2017-18, ಇದಕ್ಕೆ ಸಂಬಂಧಪಟ್ಟಂತೆ ಮಾರಾಟ ಮಾಡಲಾದ ತೀರ್ಪುಬಾಕಿದಾರರ ಸ್ಥಿರಾಸ್ತಿಯನ್ನು ಕರ್ನಾಟಕ ಸಹಕಾರ ಸಂಘಗಳ ನಿಯಮಗಳು 1960ರ ನಿಯಮ 38(6)(ಎ) ಅನ್ವಯ ಮಾರಾಟ ಸ್ಥಿರೀಕರಿಸುವ ಆದೇಶ ಹೊರಡಿಸುವ ಬಗ್ಗೆ.

ಪ್ರಸ್ತಾವನೆ:
ವಸೂಲಾಧಿಕಾರಿಗಳು ಹಾಗೂ ಸಹಕಾರ ಸಂಘಗಳ ಸಹಾಯಕ ನಿಬಂಧಕರು, 4ನೇ ವಲಯ, ಬೆಂಗಳೂರು ನಗರ ಜಿಲ್ಲೆ, ಬೆಂಗಳೂರು-560 003 ರವರ ಕಛೇರಿಯ ಮಾರಾಟಾಧಿಕಾರಿಯವರು ಉಲ್ಲೇಖ (3) ರಂತೆ ವರದಿ ಸಲ್ಲಿಸಿ, ಈ ಕೆಳಕಂಡಂತೆ ತಿಳಿಸಿರುತ್ತಾರೆ:-
ಶ್ರೀ ಬಿ.ಲಿಂಗಣ್ಣ ಮತ್ತು ಶ್ರೀಮತಿ ಲಕ್ಷ್ಮಮ್ಮ, ನಂ.145, 3ನೇ ಅಡ್ಡರಸ್ತೆ, ಜನತಾ ಕಾಲೋನಿ, ನಾಗರಬಾವಿ, ಬೆಂಗಳೂರು-560 072 ಇವರು ಕುವೆಂಪು ಕೋ-ಆಪರೇಟಿವ್ ಕ್ರೆಡಿಟ್ ಸೊಸೈಟಿ ನಿಯಮಿತ, ರಾಜಾಜಿನಗರ 2ನೇ ಹಂತ, ಬೆಂಗಳೂರು-560 010 ಇವರಿಂದ ಗೃಹ ಅಡಮಾನ ಸಾಲ ಪಡೆದಿದ್ದು, ಸದರಿ ಸಾಲವನ್ನು ಮರುಪಾವತಿ ಮಾಡದೇ ಸುಸ್ತಿದಾರರಾಗಿದ್ದರಿಂದ, ಇವರ ವಿರುದ್ಧ ಕರ್ನಾಟಕ ಸಹಕಾರ ಸಂಘಗಳ ಅಧಿನಿಯಮ 1959 ರ ಪ್ರಕರಣ 70 ರನ್ವಯ ಸಹಕಾರ ಸಂಘಗಳ ಜಂಟಿ ನಿಬಂಧಕರು, ಬೆಂಗಳೂರು ಪ್ರಾಂತ, ಬೆಂಗಳೂರು, ಇವರ ನ್ಯಾಯಾಲಯದಲ್ಲಿ ದಾವಾ ಪ್ರಕರಣ ಸಂಖ್ಯೆ:ಜೆಆರ್‌ಬಿ:ಡಿಐಎಸ್:82:2016-17, ದಾಖಲಿಸಿ, ದಿನಾಂಕ 14-02-2017 ರಂದು ದಾವಾದೇಶವನ್ನು ಪಡೆದಿರುತ್ತಾರೆಂದು ತಿಳಿಸಿರುತ್ತಾರೆ.
ಈ ಆದೇಶ ಜಾರಿಗಾಗಿ ಕರ್ನಾಟಕ ಸಹಕಾರ ಸಂಘಗಳ ನಿಯಮಗಳು 1960ರ ನಿಯಮ 34(3) ರನ್ವಯ ಅಮಲ್ಜಾರಿ ಅರ್ಜಿಯನ್ನು ವಸೂಲಾಧಿಕಾರಿ ಹಾಗೂ ಸಹಕಾರ ಸಂಘಗಳ ಸಹಾಯಕ ನಿಬಂಧಕರು, 4ನೇ ವಲಯ, ಬೆಂಗಳೂರುರವರ ನ್ಯಾಯಾಲಯದಲ್ಲಿ ದಾಖಲಿಸಿದ್ದು, ನ್ಯಾಯಾಲಯವು ದಿನಾಂಕ: 14-11-2017ರಂದು ನಿಯಮ 34(3)ರ ಅನ್ವಯ ತಗಾದೆ ನೋಟೀಸ್ (DISTRAINT WARRANT) ಅನ್ನು ಹೊರಡಿಸಿದ್ದು, ಸದರಿ ನೋಟೀಸನ್ನು ತೀರ್ಪು ಋುಣಿಗಳಾದ ಶ್ರೀ ಬಿ.ಲಿಂಗಣ್ಣ ಮತ್ತು ಶ್ರೀಮತಿ ಲಕ್ಷ್ಮಮ್ಮರವರಿಗೆ ದಿನಾಂಕ: 22-11-2017ರಂದು ಜಾರಿಗೊಳಿಸಲಾಗಿರುತ್ತದೆಂದು ತಿಳಿಸಿರುತ್ತಾರೆ. ಈ ತಗಾದೆ ನೋಟೀಸನ್ನು ತೀರ್ಪು ಋುಣಿಗಳಿಗೆ ತಲುಪಿಸಿದ್ದರೂ ಸಹ, ಅವರು ಸಂಘಕ್ಕೆ ಬಾಕಿ ಇರುವ ಸಾಲದ ಬಾಕಿಯನ್ನು ಮರುಪಾವತಿ ಮಾಡಲು ವಿಫಲರಾಗಿರುತ್ತಾರೆಂದು ಸಂಘದವರು ವರದಿ ಮಾಡಿರುತ್ತಾರೆ.
(೩೨೯೯)೩೩೦೦ ಕರ್ನಾಟಕ ರಾಜ್ಯಪತ್ರ, ಗುರುವಾರ, ಜೂನ್ ೭, ೨೦೧೮ ಭಾಗ ೩ ಅಮಲ್ಜಾರಿ ಅರ್ಜಿಯನ್ನು ಜಾರಿಗೊಳಿಸುವ ಮುಂದಿನ ಕ್ರಮದಂತೆ ಈ ನ್ಯಾಯಾಲಯವು ನಿಯಮ 38(2) (ಎ) (ಬಿ)ಯಂತೆ, ತೀರ್ಪು ಋುಣಿಯವರು ಈ ಪೂರ್ವದಲ್ಲಿ ಸಂಘಕ್ಕೆ ಅಡವು ಮಾಡಿದ ಸ್ಥಿರ ಸ್ವತ್ತುಗಳನ್ನು ಮಾರಾಟ ಮಾಡುವ ಮುಂಚಿತವಾಗಿ ಕೊಡುವ ತಗಾದೇ ಪತ್ರ (ಫಾರಂ ನಂಬರ್ 6)ನ್ನು ದಿನಾಂಕ: 14-12-2017ರಂದು ಹೊರಡಿಸಿರುತ್ತದೆ. ಸದರಿ ತಗಾದೆ ಪತ್ರವನ್ನು ತೀರ್ಪು ಋುಣಿಯವರಿಗೆ ದಿನಾಂಕ: 17-12-2017ರಂದು ಜಾರಿಗೊಳಿಸಲಾಗಿರುತ್ತದೆ. ಈ ನೋಟೀಸಿನಲ್ಲಿ ನೋಟೀಸು ತಲುಪಿದ 10ದಿನಗಳೊಳಗಾಗಿ ಸಂಘಕ್ಕೆ ಬಾಕಿ ಇರುವ ಮೊಬಲಗನ್ನು ಮರು ಪಾವತಿಸಲು ಸೂಚಿಸಿದ್ದು, ತಪ್ಪಿದಲ್ಲಿ ಅವರು ಸಾಲಕ್ಕೆ ಎದುರಾಗಿ ಅಡಮಾನ ಮಾಡಿರುವ ಸ್ಥಿರಾಸ್ತಿಯನ್ನು ಬಹಿರಂಗ ಹರಾಜು ಮೂಲಕ ಮಾರಾಟ ಮಾಡಲಾಗುವುದೆಂದು ತಿಳಿಸಲಾಗಿತ್ತು. ಈ ಕ್ರಮದ ನಂತರವೂ ಸಹ, ತೀರ್ಪು ಋುಣಿಯವರು ಸಂಘಕ್ಕೆ ಮರುಪಾವತಿಸಬೇಕಾದ ಸಾಲದ ಬಾಕಿ ಮೊಬಲಗನ್ನು ಮರುಪಾವತಿಸಲು ವಿಫಲರಾಗಿರುತ್ತಾರೆ.
ಮುಂದಿನ ಕ್ರಮಕ್ಕಾಗಿ ಕರ್ನಾಟಕ ಸಹಕಾರ ಸಂಘಗಳ ನಿಯಮಗಳು 1960 ನಿಯಮ 38 (2)(ಡಿ) ರನ್ವಯ ಬಹಿರಂಗ ಹರಾಜು ಪ್ರಕಟಣೆ (ಫಾರಂ ನಂಬರ್ 8)ಮತ್ತು ಮಾರಾಟದ ನೋಟೀಸ್ (ಫಾರಂ ನಂಬರ್ 9)ನ್ನು ದಿನಾಂಕ: 21-01-2018 ರಂದು ಈ ನ್ಯಾಯಾಲಯವು ಹೊರಡಿಸಿದ್ದು, ಸದರಿ ನೋಟೀಸನ್ನು ತೀರ್ಪು ಋುಣಿಗಳಾದ ಶ್ರೀ ಬಿ.ಲಿಂಗಣ್ಣ ಮತ್ತು ಶ್ರೀಮತಿ ಲಕ್ಷ್ಮಮ್ಮರವರಿಗೆ ದಿನಾಂಕ: 21-01-2018ರಂದು ಖುದ್ದಾಗಿ ಜಾರಿ ಮಾಡಲಾಗಿರುತ್ತದೆ. ಈ ನೋಟೀಸುಗಳ ಅನ್ವಯ ಸ್ಥಿರಾಸ್ತಿಯ ಬಹಿರಂಗ ಹರಾಜನ್ನು ದಿನಾಂಕ: 24-02-2018ರಂದು ಬೆಳಿಗ್ಗೆ 11-00ಗಂಟೆಗೆ ಸ್ಥಿರಾಸ್ತಿಯು ಇರುವ ಸ್ಥಳದಲ್ಲಿ ಬಹಿರಂಗ ಹರಾಜು ಮೂಲಕ ಮಾರಾಟ ಮಾಡಲಾಗುವುದೆಂದು ತಿಳಿಸಲಾಗಿತ್ತು. ಈ ನೋಟೀಸುಗಳಿಗೂ ಸಹ, ತೀರ್ಪು ಋುಣಿಗಳು ಯಾವುದೇ ಪ್ರತಿಕ್ರಿಯೆ ನೀಡದೇ ಸಂಘಕ್ಕೆ ಬಾಕಿ ಇರುವ ಮೊತ್ತವನ್ನು ಮರುಪಾವತಿಸಲು ವಿಫಲರಾಗಿರುತ್ತಾರೆ.
ಹರಾಜು ಪ್ರಕಟಣೆಯನ್ನು ನಿಯಮ 38 (1) (ಸಿ) ಅನ್ವಯ ಸ್ಥಳೀಯವಾಗಿ ಹೆಚ್ಚು ಪ್ರಸಾರದಲ್ಲಿರುವ "ಈ ಸಂಜೆ" ದಿನಪತ್ರಿಕೆಯಲ್ಲಿ ದಿನಾಂಕ: 21-02-2018ರಂದು ಪ್ರಕಟಿಸಲಾಗಿರುತ್ತದೆ. ಇದಲ್ಲದೇ ದಿನಾಂಕ: 21-02-2018 ಹಾಗೂ 23/02/2018ರಂದು ಕರಪತ್ರಗಳನ್ನು ಮುದ್ರಿಸಿ ಸ್ಥಳೀಯ ಹಾಗೂ ಸುತ್ತಮುತ್ತಲಿನ ವಿಧಾನ ಸಭಾ ಕ್ಷೇತ್ರಗಳಲ್ಲಿ ದಿನ ಪತ್ರಿಕೆ ಹಂಚುವ ಹುಡುಗರ ಮುಖಾಂತರ ಪ್ರಚಾರ ಪಡಿಸಲಾಗಿರುತ್ತದೆ. ಇದಲ್ಲದೇ ದಿನಾಂಕ: 21-02-2018, 23-02-2018ರಂದು ಡಂಗೂರ ಸಾರಿಸುವ ಮುಖಾಂತರ ಬಹಿರಂಗ ಹರಾಜು ವಿಚಾರವನ್ನು ಪ್ರಚಾರ ಮಾಡಲಾಗಿರುತ್ತದೆ.
ಈ ಕ್ರಮಗಳ ನಂತರವೂ ಸಂಘಕ್ಕೆ ತೀರ್ಪು ಋುಣಿಯವರಿಂದ ಬಾಕಿ ಹಣ ಮರು ಸಂದಾಯವಾಗಿರುವುದಿಲ್ಲ.
ಹರಾಜು ಪ್ರಕಟಣೆ ಮತ್ತು ಮಾರಾಟದ ನೋಟೀಸಿನಂತೆ ದಿನಾಂಕ: 24-02-2018 ರಂದು ಹರಾಜು ಪ್ರಕ್ರಿಯೆಯನ್ನು ಮಾರಾಟಾಧಿಕಾರಿಗಳು ನಡೆಸಿರುತ್ತಾರೆ. ಹರಾಜಿನಲ್ಲಿ 6 ಜನ ಬಿಡ್ಡುದಾರರು ಭಾಗವಹಿಸಿದ್ದು, ಈ ಪೈಕಿ ಶ್ರೀ ಎನ್.ಸತೀಶ್. ಬಿನ್ ನಾಗರಾಜ್‌ರವರು ಅತಿ ಹೆಚ್ಚಿನ ಮೊತ್ತ `.35,00,000/- ಗಳಿಗೆ ಬಿಡ್ಡು ಮಾಡಿ 'ಯಶಸ್ವಿ ಬಿಡ್ಡುದಾರ'ರಾಗಿರುತ್ತಾರೆ. ಇವರ ಹೆಸರಿಗೆ ಬಿಡ್ಡನ್ನು ನಿಲ್ಲಿಸಿ, ಮಾರಾಟಾಧಿಕಾರಿಗಳು ಇವರಿಗೆ ಸ್ವತ್ತನ್ನು ಮಾರಾಟ ಮಾಡಿರುತ್ತಾರೆ. ಸದರಿ ದಿನಾಂಕದಂದೇ ನಿಯಮಾನುಸಾರ ಬಿಡ್ ಮೊತ್ತದ ಶೇಕಡ 15 ರ ಮೊತ್ತವಾದ `.5,25,000/- ಗಳನ್ನು ಚಲನ್ ಸಂಖ್ಯೆ 25ರ ಮೂಲಕ ಸಂಘಕ್ಕೆ ಯಶಸ್ವಿ ಬಿಡ್‌ದಾರರಾದ ಶ್ರೀಎನ್.ಸತೀಶ್‌ರವರು ಪಾವತಿಸಿರುತ್ತಾರೆ. ಈ ಸ್ಥಿರ ಸ್ವತ್ತನ್ನು ಬಹಿರಂಗ ಹರಾಜಿನಲ್ಲಿ ಮಾರಾಟ ಮಾಡಿರುವ ಬಗ್ಗೆ ತೀರ್ಪು-ಬಾಕಿದಾರರಿಗೆ ದಿನಾಂಕ: 24-02-2018ರಂದು ನೋಟೀಸಿನ ಮೂಲಕ ತಿಳಿಸಿ, 30 ದಿನಗಳ ಒಳಗಾಗಿ ಬಾಕಿ ಇರುವ ಮೊತ್ತವನ್ನು ಸಂಘಕ್ಕೆ ಮರುಪಾವತಿಸಿ, ಹರಾಜಾಗಿರುವ ಸ್ಥಿರ ಸ್ವತ್ತನ್ನು ಉಳಿಸಿಕೊಳ್ಳಲು ಸೂಚಿಸಲಾಗಿರುತ್ತದೆ. ಆದರೂ ಸಹ ಬಾಕಿ ಇರುವ ಸಾಲದ ಮೊಬಲಗನ್ನು ಅವರುಗಳು ಸಂಘಕ್ಕೆ ಮರುಪಾವತಿಸಿರುವುದಿಲ್ಲ. ಆದ್ದರಿಂದ ನಿಯಮಾನುಸಾರ ಯಶಸ್ವಿ ಬಿಡ್ಡುದಾರರು 45 ದಿನಗಳೊಳಗಾಗಿ ಬಿಡ್ಡಿನ ಉಳಿದ ಶೇಕಡ 85 ರ ಮೊತ್ತ `.29,75,000/- ಗಳನ್ನು ದಿನಾಂಕ 31-03-2018 ರಂತೆ ಚಲನ್ ಸಂಖ್ಯೆ 10 ಮುಖಾಂತರ ಸಂಘಕ್ಕೆ ಪಾವತಿಸಿರುತ್ತಾರೆ.
ಮಾರಾಟಾಧಿಕಾರಿಗಳು ಮೇಲ್ಕಂಡ ಎಲ್ಲಾ ಅಂಶಗಳನ್ನು ತಿಳಿಸಿ, ದಿನಾಂಕ: 24-02-2018 ರಂದು ನಡೆಸಿರುವ ಬಹಿರಂಗ ಹರಾಜಿನ ವಿವರಗಳನ್ನು ನಮೂದಿಸಿ, ದಾಖಲಿಸಿರುವ ನಡವಳಿಗಳನ್ನು ಸಲ್ಲಿಸಿರುತ್ತಾರೆ ಮತ್ತು ಮಾರಾಟವಾಗಿರುವ ಸ್ಥಿರ ಸ್ವತ್ತನ್ನು ಸ್ಥಿರೀಕರಿಸಿ ಪ್ರಮಾಣ ಪತ್ರ ನೀಡಲು ಕೋರಿರುತ್ತಾರೆ.
ಈ ನ್ಯಾಯಾಲಯದ ಬಹಿರಂಗ ಹರಾಜು ಪ್ರಕಟಣೆಯ ಷರತ್ತು, ಸೂಚನೆಗಳು ಮತ್ತು ಮಾರಾಟದ ನೋಟೀಸಿನನ್ವಯ ಕರ್ನಾಟಕ ಸಹಕಾರ ಸಂಘಗಳ ನಿಯಮಗಳು 1960ರ ಅವಕಾಶಗಳನ್ವಯ ಬಹಿರಂಗ ಹರಾಜು ಮಾಡಲಾಗಿದೆ. ಎಲ್ಲಾ ನೋಟೀಸು ಮತ್ತು ತಿಳುವಳಿಕೆಗಳನ್ನು ತೀರ್ಪುಬಾಕಿದಾರರಿಗೆ ಜಾರಿ ಮಾಡಲಾಗಿದೆ. ಈ ಪ್ರಕರಣದಲ್ಲಿ ದಿನಾಂಕ: 24-02-2018 ರ ಅಂತ್ಯಕ್ಕೆ ಒಟ್ಟು ಸಾಲ ಬಾಕಿ `. 15,51,245/-ಗಳು ಇರುತ್ತದೆ.
ಸ್ಥಿರಾಸ್ತಿಯ ಬಹಿರಂಗ ಹರಾಜಿನಲ್ಲಿ ಒಟ್ಟು 6 ಜನ ಬಿಡ್ಡುದಾರರು ಭಾಗವಹಿಸಿದ್ದು, ಈ ಪೈಕಿ ಅತ್ಯಧಿಕ ಬಿಡ್ಡುದಾರರಾದ ಶ್ರೀ ಎನ್.ಸತೀಶ್ ಬಿನ್ ನಾಗರಾಜು ಇವರಿಗೆ `.35,00,000-00 ಗಳಿಗೆ ಮಾರಾಟ ಮಾಡಿರುವುದು ದಾಖಲಾತಿಗಳಿಂದ ತಿಳಿದುಬಂದಿರುತ್ತದೆ. ಶೇಕಡ 15 ರಷ್ಟು ಬಿಡ್ ಮೊತ್ತವನ್ನು ಹರಾಜಿನ ದಿನವೇ ಮತ್ತು ಬಹಿರಂಗ ಹರಾಜು ನಡೆದ 45 ದಿನಗಳೊಳಗಾಗಿ ಬಿಡ್ಡು ಮಾಡಿದ ಬಾಕಿ ಹಣವನ್ನು ಪೂರ್ತಿಯಾಗಿ ಸಂಘಕ್ಕೆ ಸಂದಾಯ ಮಾಡಿರುತ್ತಾರೆ. ಮಾರಾಟಾಧಿಕಾರಿಯವರು ಕೈಗೊಂಡ ಕ್ರಮಗಳು ಕಾನೂನುಬದ್ಧವಾಗಿದೆ ಎಂದು ಅಭಿಪ್ರಾಯಪಟ್ಟು ಹರಾಜನ್ನು ಸ್ಥಿರೀಕರಿಸುವುದು ಸೂಕ್ತವೆಂದು ಈ ನ್ಯಾಯಾಲಯವು ಮನಗಂಡು ಈ ಕೆಳಕಂಡಂತೆ ಮಾರಾಟ ಸ್ಥಿರೀಕರಣ ಆದೇಶವನ್ನು ಹೊರಡಿಸಿದೆ.

ಸಂಘಕ್ಕೆ ತೀರ್ಪು ಋುಣಿಯವರಿಂದ ಸಾಲ ಬಾಕಿ ಒಟ್ಟು `.15,51,245/- ಇರುತ್ತದೆ. ಸ್ಥಿರಾಸ್ತಿ ಮಾರಾಟದಿಂದ ಸಂಘಕ್ಕೆ ಒಟ್ಟು `.35,00,000/-ಗಳು ಬಂದಿರುತ್ತದೆ. ಇವೆರಡೂ ಮೊತ್ತಗಳ ನಡುವಿನ ವ್ಯತ್ಯಾಸ `.19,48,755/-ಗಳನ್ನು ತೀರ್ಪು ಋುಣಿಯವರಾದ ಶ್ರೀ ಬಿ.ಲಿಂಗಣ್ಣ ಮತ್ತು ಶ್ರೀಮತಿ ಲಕ್ಷ್ಮಮ್ಮರವರಿಗೆ ಸಂಘವು ಪಾವತಿಸುವ ಜವಾಬ್ದಾರಿಯಿದ್ದು ಅದನ್ನು ಅವರಿಗೆ ಪಾವತಿಸಲು ಆದೇಶಿಸಿದೆ.

1966 ರ ಕರ್ನಾಟಕ ಕೈಗಾರಿಕಾ ಪ್ರದೇಶಾಭಿವೃಧ್ಧಿ ಕಾಯ್ದೆಯ (1966ರ ಕರ್ನಾಟಕದ ಕಾಯ್ದೆ ಸಂಖ್ಯೆ: 18) ವಿಧಿ 28(1) ಪ್ರಕಾರ ದತ್ತವಾದ ಅಧಿಕಾರದ ಮೇರೆಗೆ ಅಧಿಸೂಚನೆ ಸಂಖ್ಯೆ: ಸಿಐ 259 ಎಸ್‌ಪಿಕ್ಯೂ 2017, ದಿನಾಂಕ: 23.12.2017 ರ ಪ್ರಕಾರ ಸರ್ಕಾರವು ಸದರಿ ಅಧಿಸೂಚನೆಯಲ್ಲಿ ನಮೂದಿಸಲ್ಪಟ್ಟಿರುವ ಸ್ವತ್ತುಗಳ ಪ್ರದೇಶವನ್ನು "ಬೆಂಗಳೂರು ಮೆಟ್ರೋ ರೈಲು ಯೋಜನೆಯ" ಉದ್ದೇಶಕ್ಕಾಗಿ ಸ್ವಾಧೀನಪಡಿಸಿಕೊಳ್ಳಲು ಇಚ್ಛೆಪಟ್ಟಿದೆ.
ಮೇಲ್ಕಂಡ ಅಧಿಸೂಚನೆಯ ಷೆಡ್ಯೂಲ್‌ನಲ್ಲಿ ನಮೂದಿಸಲ್ಪಟ್ಟಿರುವ ಜಮೀನುಗಳನ್ನು ಅಧಿಸೂಚನೆಯಲ್ಲಿ ಪ್ರಕಟಿಸಲಾಗಿರುವ ಉದ್ದೇಶಕ್ಕೆ ಸ್ವಾಧೀನಪಡಿಸಿಕೊಳ್ಳಬೇಕಾಗಿರುವುದು ಕರ್ನಾಟಕ ಸರ್ಕಾರಕ್ಕೆ ಮನದಟ್ಟಾಗಿದೆ. ಈ ಬಗ್ಗೆ ಮೇಲ್ಕಂಡ ಕಾಯ್ದೆ ವಿಧಿ 28(3) ರ ಪ್ರಕಾರ ಆದೇಶ ಹೊರಡಿಸಲಾಗಿದೆ.
ಆದುದರಿಂದ 1966 ರ ಕರ್ನಾಟಕ ಕೈಗಾರಿಕಾ ಪ್ರದೇಶಾಭಿವೃದ್ಧಿ ಕಾಯ್ದೆಯ ವಿಧಿ 28(4) ರ (1966 ರ ಕರ್ನಾಟಕದ ಕಾಯ್ದೆ ಸಂಖ್ಯೆ: 18) ಮೇರೆಗೆ ದತ್ತವಾದ ಅಧಿಕಾರದ ಮೇರೆಗೆ ಕರ್ನಾಟಕ ಸರ್ಕಾರ ಈ ಕೆಳಗೆ ನಮೂದಿಸಿರುವ ಜಮೀನುಗಳನ್ನು ಅಧಿಸೂಚನೆಯಲ್ಲಿ ತಿಳಿಸಲಾಗಿರುವ ಉದ್ದೇಶಕ್ಕಾಗಿ ಸ್ವಾಧೀನಪಡಿಸಿಕೊಳ್ಳಲಾಗಿದೆಯೆಂದು ಈ ಮೂಲಕ ಘೋಷಿಸಲಾಗಿದೆ.

ಆದುದರಿಂದ 1966ರ ಕರ್ನಾಟಕ ಕೈಗಾರಿಕಾ ಪ್ರದೇಶಾಭಿವೃಧ್ಧಿ ಕಾಯ್ದೆ ವಿಧಿ 28(4)ರ (1966ರ ಕರ್ನಾಟಕ ಕಾಯ್ದೆ ಸಂಖ್ಯೆ: 18)ರ ಮೇರೆಗೆ ದತ್ತವಾದ ಅಧಿಕಾರದ ಮೇರೆಗೆ ಕರ್ನಾಟಕ ಸರ್ಕಾರ ಕೆಳಗೆ ನಮೂದಿಸಿರುವ ಜಮೀನುಗಳನ್ನು ಅಧಿಸೂಚನೆಯಲ್ಲಿ ತಿಳಿಸಿರುವ ಉದ್ದೇಶಕ್ಕಾಗಿ ಭೂಸ್ವಾಧೀನಪಡಿಸಿಕೊಳ್ಳಲಾಗಿದೆಯೆಂದು ಈ ಮೂಲಕ ಘೋಷಿಸಲಾಗಿದೆ.

In exercise of the power conferred by Sub-section (3) and (5) of Section 8 of the Karnataka Electricity Reforms Act, 1999 (Karnataka Act 25 of 1999), and in supersession of the Notification No.E/02/0/590, dated 24/05/2000, the Karnataka Electricity Regulatory Commission, with the approval of the State Government vide letter No.EN 251 EEB 2017, dated 27.03.2018 hereby make
| 1. Title, Commencement and Application : | (1) These Regulations shall be called the Karnataka Electricity Regulatory Commission (Recruitment and Conditions of Service) Regulations, 2018. (2) These Regulations shall come into force on the date of their publication in the Official Gazette. (3) These Regulations shall apply to all persons serving the Karnataka Electricity Regulatory Commission specified in Regulation 3 of these Regulations. |
| 2. Definitions: | In these Regulations, unless the context otherwise requires: a) "Act" means the Karnataka Electricity Reforms Act, 1999 (Karnataka Act 25 of 1999); b) "Appointing Authority" means the Karnataka Electricity Regulatory Commission; c) "Competent Authority" means the Chairman and such other Officer or Officers in the Commission, designated from time to time for the purpose, by the Commission; d) "Chairman" means the Chairman of the Commission; e) "Member" means a member of the Commission; f) "Secretary" means the Secretary of the Commission; g) "Function" means and includes all work and related activities of the Commission; h) "Service" means the service of the Commission; i) "Year" means the calendar year; and j) "Words" and expression used in these Regulations but not defined herein, shall have the same meaning as respectively assigned to them in the Act or in the Karnataka Civil Services Act, 1978 and Rules framed there under. |
| 3. Cadre Strength of the Commission: | The designation of the posts borne on the establishment of the Commission, the Cadre Strength and Scale of Pay shall be as specified in Columns (2), (3) and (4) of the First Schedule. |
| 4. Method of Recruitment: | 1) The following shall be the method of recruitment in the Commission, namely: (i) on deputation from the Government Departments (State and Centre) or other State or Central Government Organizations. In respect of deputation, the persons holding posts in a Scale of Pay lower or higher than that indicated against a post in the First Schedule may also be considered subject to fulfillment of the qualifications prescribed and suitability. Persons working on deputation in the Commission may be considered for absorption in the Commission on a regular basis. The period of deputation of Officers or Staff shall be for a period of three years and shall not exceed five years. (ii) on Contract basis and; (iii) by direct recruitment which may be either by competitive examination or by selection. 2) Nothing in of Regulation - 3 shall be construed as requiring the Commission to have at all times, the officers or Staff serving in all the categories or posts. |
| 5. Method of Recruitment and Minimum Qualification: | In respect of each category of posts specified in Column (2) of the Second Schedule appended to these Regulations, the method of recruitment and minimum qualification shall be as specified in the corresponding entries in Columns (3) and (4) respectively. |
| 6. Age limit: | The age limits for recruitment on a regular basis to the posts at Sl.Nos. 1 to 18 in Regulation 3 as well as the age of superannuation shall be as per the Rules of the Government of Karnataka as modified from time to time. Contract appointments shall normally be for a maximum period of three years, renewable annually. |
| 7. Reservation: | Appointment in the services of the Commission would be in conformity with the reservation policy of the Government of Karnataka as applicable to similar services in the Government Departments, Boards, Corporations and Autonomous Bodies. |
| 8. Procedure for appointment on Contract basis or by direct recruitment: | (1) The Commission may announce, in such manner as it thinks fit, the number of vacancies to be filled by Contract or direct recruitment and shall invite applications from candidates eligible for appointment to the posts. (2) Every candidate shall submit his Application in the prescribed form along with prescribed fees and documents to the Secretary or any other designated Officer of the Commission so as to reach him not later than such date as may be notified. (3) The Application shall be accompanied with a Demand Draft for the prescribed amount. (4) The following documents should be submitted along with the Application: a) Evidence that he holds the requisite educational qualification (s). b) Certificate of character and conduct from the head of college in which he has last studied. In case of candidates who have not served earlier in any capacity in the State/Central Government/ Public Sector Undertakings, etc. and those who are serving in the private sector, prior to employment in the Commission, should obtain such certificate from the previous employer (s). c) Evidence of age, which should be the High School Certificate, d) Caste certificate from the competent authority in the case of candidates belonging to S.C., S.T., and O.B.C. Verification of caste shall be in accordance with rules framed by the Government of Karnataka, for the purpose. (5) All the candidates shall produce the originals of the following certificates at the time of the interview and again immediately before the joining, if selected: i) SSC/SSLC or its equivalent examination certificate as proof of age. Documents in support of educational qualification and experience; Certificate of caste, if claiming any reserved post. (6) The Applications shall be scrutinized and qualified candidates will be called for interview by a Selection Committee constituted under Sub-Regulation (7) of this Regulation. (7) The Selection Committee shall consist of the following, namely: (a) Chairman of the Commission - Chairman (b) A person nominated by the Commission - Member (c) An expert in the concerned field – Member (8) The Selection Committee shall prepare a Select list on the basis of the marks secured by each candidate in the interview and in accordance with the guidelines issued by the State Government. (9) The appointing authority shall be the Commission for all posts. (10) Every candidate directly recruited shall be examined by a Medical Board and appointment shall be made only after obtaining a Fitness Certificate from the Medical Board. (11) All appointments shall be made after verification of character and antecedents of the candidate. |
| (12) Every Contract appointment shall be for a maximum period of three years, renewable annually except in respect of the post of Secretary to the Commission which would be governed by Section 8(1) of the Act. The Agreement for Contract appointment shall be as set out in Appendix-I. | |
| 9. Appointment: | (a) A person to be directly appointed should be of sound health. Every candidate directly recruited for appointment shall be examined by a Medical Board and appointment shall be made only on the basis of a Fitness Certificate of the Medical Board. This condition does not apply to those (i) taken on contract (ii) taken on deputation (iii) who are already working in a Government Organization prior to joining the Commission. (b) A candidate to be appointed has to possess the necessary qualifications and experience, as prescribed post-wise, given in the Second Schedule to these Regulations. However, when suitable candidates are not available, the Commission after recording reasons therefor, may relax the eligibility criteria for appointment in appropriate cases. All the candidates considered for appointment should have knowledge of Kannada. |
| 10. Pay fixation: | (a) The pay of the selected candidates shall normally be fixed at the minimum of the time scale as mentioned in the first Schedule of the Regulations. (b) The salary of a person appointed on Contract shall be appropriately fixed by the Commission having regard to the pay scale of the post to which he is appointed.This salary may be suitably revised by the Commission at the time of annual renewal of the Contract. (c) Persons appointed on deputation shall be entitled to Deputation Allowance, as per the rules of the State Government, amended from time to time.All other benefits which he was receiving in his parent Organization/Department shall be protected during the period of deputation. However, where any deputation allowance is payable as per the terms and conditions of deputation prescribed by the parent organization /department, this Special pay shall not be payable. |
| 11. Probation: | As regards probation of persons appointed on a regular basis, Rules of the Government of Karnataka shall apply. |
| 12. Training: | (a) Every Officer may be required to undergo such training or course conducted in- house/outside as may be prescribed by the Commission. (b) The Officer who is required to undergo any training or course may be required to execute a bond to serve the Commission for such period as may be prescribed which shall not exceed 12 months for every one month or part of the month of training or course subject to a maximum of two years after completing the training or course. Failure to serve the Commission for the stipulated period will render the candidate liable to refund the amount spent on him for training along with emoluments paid to him during the training period. (c) If an Officer is charged with misconduct during the period of training, then he/she would be called back from training and appropriate disciplinary proceedings would be initiated or contract terminated. He/she may be required to refund the amount spent on him/her for the training, if the Commission so decides. |
| 13. Subscription to the Provident Fund: | The Officers and the Staff of the Commission will be eligible to subscribe to the General Provident Fund, Karnataka with effect from the date of joining in the Commission as applicable to the Officers/Staff under the Government of Karnataka. |
| 14. Retirement Benefits: | (a) Staff recruited in the Commission on a regular basis shall be eligible to the pensionary benefits as applicable to the employees of the Government of Karnataka. (b) The pensionary services rendered by an Officer/Staff under the Government of India, the |
| Government of Karnataka and any Public Sector Undertakings prior to the date of joining in the Commission shall be taken into account for the purpose of grant of the pensionary and other retirement benefits together with the service rendered by them under the Commission after joining the Commission. The services rendered under the State or Central Government or Public Sector Undertakings of such Officer and staff shall be deemed to be service under the Commission for the purpose of pensionary and other retirement benefits. | |
| 15. Service Continuity: | (a) The period of service of the personnel under the Government of India, Government of Karnataka or Public Sector Undertakings, as the case may be, shall be treated as continuous for the purpose of all service benefits. (b) The personnel joining the service of the Commission on transfer or otherwise from the Government /Public Sector Undertakings shall be deemed to have entered into an Agreement with the Commission or the respective nominated authority, as the case may be, to repay the loans, advance and other sums due or otherwise perform the obligations undertaken by them to the Government / Public Sector Undertakings which remain outstanding against him / her on the date of joining as per the original terms and conditions. |
| 16. Applicability of CCA and Conduct Rules & other State Rules: | A. The provisions of the Karnataka Civil Services (Classification, Control and Appeal) Rules and Karnataka Civil Services (Conduct) Rules as applicable to the employees of the Government of Karnataka, as amended from time to time, shall mutatis mutandis apply to the employees of the Commission. In respect of any service matter not specifically mentioned in the above Regulations, the employees of the Commission are to be governed by the service Rules of the Karnataka State Government Employees. B. The provisions of Karnataka Civil Services (Time Bound Advancement) Rules, 1983 and Karnataka Civil Services Automatic grant of Special Promotion to senior scale of pay 1991, as applicable to the employees of the Government of Karnataka, as amended from time to time shall mutatis mutandis be applicable to the employees of the Commission. C. The provisions of Karnataka Civil Services (Computer Literacy Test) Rules, 2012 shall mutatis mutandis be applicable to the employees of the Commission. D. The Provisions of Karnataka Civil Services (Service and Kannada Language Examinations) Rules, 1974 shall mutatis mutandis be applicable to the employees of the Commission. |
| 17. Interpretation | The Commission may by order make such provisions or give such directions as it may deem fit and necessary for the removal of any difficulty that may arise in giving effect to the provisions of these Regulations. |
| 18. Power to remove Difficulties: | The Commission may be order make such provisions or give such directions as it may deem fit and necessary for the removal of any difficulty that may arise in giving effect to the provisions of the Regulations. |
| 19. Repeal and Savings: | (1) With the notification of these Regulations, The Karnataka Electricity Regulatory Commission (Recruitment and Conditions of Service) Regulations, 2000 is hereby repealed. (2) Not withstanding such Repeal, anything done or any action taken or purported to have been done or taken including any appointment or confirmation made shall be deemed to have been done or taken under the corresponding provisions of this regulations, to the extent applicable. |

ಮುಂದುವರೆದು, Bengaluru Water Supply and Sewerage Board (Absorption of Junior Assistants appointed on deputation basis in Bengaluru Water Supply and Sewerage Board) (Amendment) Regulations-2010 ರ ಅನುಸಾರ Bengaluru Water Supply and Sewerage Board (Absorption of Junior Assistants appointed on deputation basis in Bengaluru Water Supply and Sewerage Board) Regulations- 2008ರಲ್ಲಿನ ಈ ಕೆಳಗಿನ ಷರತ್ತು ಮತ್ತು ನಿಬಂಧನೆಗಳನ್ವಯ ಶ್ರೀ ಕೆ.ಬಿ. ಪದ್ಮನಾಭ, ಇವರನ್ನು ಬೆಂಗಳೂರು ಜಲಮಂಡಳಿಯಲ್ಲಿ ಕಿರಿಯ ಸಹಾಯಕ ಹುದ್ದೆಗೆ ವಿಲೀನಗೊಳಿಸಲು ತೀರ್ಮಾನಿಸಲಾಗಿರುತ್ತದೆ.
1. ನೌಕರರು ಮಾತೃ ಇಲಾಖೆಯಲ್ಲಿ ಹೊಂದಿರುವ ದ್ವಿತೀಯ ದರ್ಜೆ ಸಹಾಯಕ ಹುದ್ದೆಯ ಸಮಾನಾಂತರವಾಗಿ ಮಂಡಳಿಯಲ್ಲಿ ಕಿರಿಯ ಸಹಾಯಕ ಹುದ್ದೆಗೆ ವಿಲೀನಗೊಳಿಸಲಾಗುತ್ತದೆ.
2. ನೌಕರರು ಮಂಡಳಿಯ ಸೇವೆಗೆ ವಿಲೀನಗೊಂಡ ಹುದ್ದೆಯಲ್ಲಿ ಕರ್ತವ್ಯಕ್ಕೆ ವರದಿ ಮಾಡಿಕೊಂಡ ದಿನಾಂಕವನ್ನು ಪರಿಗಣಿಸಿ ವರಿಷ್ಠತೆಯನ್ನು ನಿಗಧಿಪಡಿಸಲಾಗುವುದು.

ಮಾತ್ರ) ತದನಂತರದ ಅವಧಿಗೆ + ಬಡ್ಡಿ + ಸುಸ್ತಿ ಬಡ್ಡಿ ಹಾಗೂ ಇತರೆ ಖರ್ಚು ವಸೂಲಾತಿಗಾಗಿ, ಸಾಲಗಾರರಿಗೆ ಸೇರಿದ ಈ ಕೆಳಗೆ ನಮೂದಿಸಿರುವ ಷೆಡ್ಯೂಲ್ ಸ್ಥಿರಾಸ್ತಿಯನ್ನು ಅಂತಿಮವಾಗಿ ಬಹಿರಂಗ ಹರಾಜು ಮೂಲಕ ಮಾರಾಟ ಮಾಡಲು ದಿನಾಂಕ: 27.10.2017ರಂದು ನಿಗದಿಪಡಿಸಲಾಗಿತ್ತು. ಈ ಆಸ್ತಿಯನ್ನು ಬಹಿರಂಗ ಹರಾಜಿನಲ್ಲಿ ಯಾರು ಖರೀದಿಸುವವರು ಇಲ್ಲದ ಪ್ರಯುಕ್ತ ಡಿಕ್ರಿದಾರ ಬ್ಯಾಂಕಿನ ಹೆಸರಿಗೆ ವರ್ಗಾವಣೆ ಮಾಡಬಹುದೆಂದು ಮಾರಾಟಾಧಿಕಾರಿಯವರು ಸೂಚಿಸಿದ ಪ್ರಕಾರ ಬ್ಯಾಂಕಿನ ಮುಖ್ಯ ಕಾರ್ಯನಿರ್ವಹಕರು ದಿನಾಂಕ: 02.11.2017ರ ಪತ್ರದ ಮೂಲಕ ಈ ಕಛೇರಿಗೆ ಪ್ರಸ್ತಾವನೆ ಸಲ್ಲಿಸಿ ತೀರ್ಪು ಬಾಕಿದಾರರ ಆಸ್ತಿಯನ್ನು ಬ್ಯಾಂಕಿಗೆ ವರ್ಗಾವಣೆ ಮಾಡಿಕೊಡಬೇಕೆಂದು ವಿನಂತಿಸಿರುತ್ತಾರೆ. ಬ್ಯಾಂಕಿನ ಮಾರಾಟಾಧಿಕಾರಿಯವರು ಮತ್ತು ಬ್ಯಾಂಕಿನ ಮುಖ್ಯ ಕಾರ್ಯನಿರ್ವಹಕರು ಸಲ್ಲಿಸಿದ ಮನವಿಯನ್ನು ಪುರಸ್ಕರಿಸಿ, ತೀರ್ಪು ಬಾಕಿದಾರರಿಗೆ ಈ ಕಛೇರಿಯ ಇದೇ ಆದೇಶದ ಕ್ರಮ ಸಂಖ್ಯೆಯಲ್ಲಿ ದಿನಾಂಕ: 03.11.2017ರಂದು ಕರ್ನಾಟಕ ಸಹಕಾರ ಸಂಘಗಳ ನಿಯಮಗಳು 1960ರ ನಿಯಮ 38 ಎ (3)ರನ್ವಯ ಈ ಕಛೇರಿಯಿಂದ ನೋಟಿಸ್ ನೀಡಿ ಡಿಕ್ರಿದಾರ ಬ್ಯಾಂಕಿಗೆ ಪಾವತಿಸಲು ಬಾಕಿಯಿರುವ ಸಾಲದ ಮೊತ್ತವನ್ನು ಈ ನೋಟಿಸ್ ಮುಟ್ಟಿದ ಒಂದು ತಿಂಗಳೊಳಗೆ ಸಂದಾಯ ಮಾಡತಕ್ಕದೆಂದು ಅಥವಾ ಸಾಲದ ಹಣವನ್ನು ವಸೂಲಾಧಿಕಾರಿಗಳವರ ಕಛೇರಿಯಲ್ಲಿ ಠೇವಣಿ ಮಾಡತಕ್ಕದ್ದೆಂದು ತಿಳಿಸಲಾಗಿದ್ದು, ತಪ್ಪಿದಲ್ಲಿ ಡಿಕ್ರಿ ಮತ್ತು ಅಮಲ್ಜಾರಿ ಹುಕುಂ ಹೊಂದಿರುವ ತುಮಕೂರು ಗ್ರೈನ್ ಮರ್ಚೆಂಟ್ಸ್ ಕೋ-ಆಪರೇಟಿವ್ ಬ್ಯಾಂಕ್ ಲಿ., ಬಿ.ಹೆಚ್.ರಸ್ತೆ, ತುಮಕೂರು- 572 103 ಇವರಿಗೆ ಕರ್ನಾಟಕ ಸಹಕಾರ ಸಂಘಗಳ ಕಾಯ್ದೆ ಕಲಂ 101 (ಬಿ) ಅನ್ವಯ ಮಾರಾಟವಾಗದ ಆಸ್ತಿಯನ್ನು ಬ್ಯಾಂಕಿಗೆ ವರ್ಗಾವಣೆ ಮಾಡಲಾಗುವುದೆಂದು ತಿಳಿಸಲಾಗಿತ್ತು. ತೀರ್ಪು ಬಾಕಿದಾರರು ದಿನಾಂಕ: 03.11.2017ರಂದು ಈ ಕಛೇರಿಯಿಂದ ನೀಡಲಾದ ನೋಟಿಸಿನಲ್ಲಿ ತಿಳಿಸಿದ ಸಾಲದ ಬಾಕಿಯನ್ನು ತಹಲ್‌ವರೆಗೂ ಪಾವತಿಸಿರುವುದಿಲ್ಲ. ನೋಟಿಸಿನ ಪ್ರಕಾರ ಸಾಲದ ಪೂರ್ಣ ಮೊತ್ತವನ್ನು ಡಿಕ್ರಿದಾರರ ಬ್ಯಾಂಕಿಗೆ ಸಂದಾಯ ಮಾಡಲು/ವಸೂಲಾಧಿಕಾರಿಗಳವರ ಕಛೇರಿಯಲ್ಲಿ ಠೇವಣಿ ಮಾಡಲು ವಿಫಲರಾದ ಪ್ರಯುಕ್ತ ಬ್ಯಾಂಕಿಗೆ ಆಧಾರವಾಗಿರುವ ಷೆಡ್ಯೂಲ್‌ನಲ್ಲಿ ಕಾಣಿಸಿರುವ ಬಾಕಿದಾರರ ಸ್ಥಿರಾಸ್ತಿಯನ್ನು ಡಿಕ್ರಿ ಹೋಲ್ಡರ್ ಮುಖ್ಯ ಕಾರ್ಯನಿರ್ವಹಕರು, ತುಮಕೂರು ಗ್ರೈನ್ ಮರ್ಚೆಂಟ್ಸ್ ಕೋ-ಆಪರೇಟಿವ್ ಬ್ಯಾಂಕ್ ಲಿ., ಬಿ.ಹೆಚ್.ರಸ್ತೆ, ತುಮಕೂರು- 572 103 ಬ್ಯಾಂಕಿನ ಹೆಸರಿಗೆ ಸಹಕಾರ ಸಂಘಗಳ ಕಾಯ್ದೆ ಕಲಂ 101 (ಬಿ) ಹಾಗೂ ಸಹಕಾರ ಸಂಘಗಳ ನಿಯಮ 38 (ಎ) (5)ರ ಪ್ರಕಾರ ವರ್ಗಾವಣೆ ಮಾಡಲು ಈ ಮೂಲಕ ಆದೇಶಿಸಲಾಗಿದೆ ಹಾಗೂ ನಿಯಮ 38 ಎ (5)ರ ಅಡಿಯಲ್ಲಿ ನಮೂನೆ 8ರಲ್ಲಿ ಕಲಂ 101 ಬಿ ಪ್ರಕರಣದ ಮೇರೆಗೆ ಖರೀದಿದಾರರು ಇಲ್ಲದೆ ಇರುವುದರಿಂದ ಮಾರಾಟ ಮಾಡಲಾಗದ ಆಸ್ತಿ ವರ್ಗಾವಣೆ ಪ್ರಮಾಣ ಪತ್ರವನ್ನು ನೀಡಲಾಗಿದೆ.

ಬ್ಯಾಂಕ್ ಲಿ., ಬಿ.ಹೆಚ್.ರಸ್ತೆ, ತುಮಕೂರು ಈ ಬ್ಯಾಂಕಿನಲ್ಲಿ ಸದಸ್ಯರಾಗಿ ದಿನಾಂಕ: 8.08.2014 ಮತ್ತು ದಿನಾಂಕ: 30.03.2015ರಂದು ರೂ. 10,00,000/- ಮತ್ತು ರೂ. 4,00,000/- ಒಟ್ಟು ರೂ. 14,00,000/-(ರೂಪಾಯಿ ಹದಿನಾಲ್ಕು ಲಕ್ಷಗಳು ಮಾತ್ರ) ಗಳನ್ನು ಸ್ಥಿರಾಸ್ತಿ ಆಧಾರ ಮಾಡಿ ಸಾಲವನ್ನು ಪಡೆದಿರುತ್ತಾರೆ. ಬ್ಯಾಂಕಿನ ಸಾಲ ಮಂಜೂರಾತಿಯ ಷರತ್ತು ಮತ್ತು ನಿಯಮಗಳ ಪ್ರಕಾರ ಸಾಲವನ್ನು ಮರುಪಾವತಿಸಲು ವಿಫಲರಾಗಿ ಸುಸ್ತಿದಾರರಾದ ಕಾರಣ ಬ್ಯಾಂಕಿನ ಮುಖ್ಯ ಕಾರ್ಯ ನಿರ್ವಹಣಾಧಿಕಾರಿಯವರು ಸಾಲದ ಬಾಕಿ ವಸೂಲಾತಿಗಾಗಿ ಕರ್ನಾಟಕ ಸಹಕಾರ ಸಂಘಗಳ ಕಾಯ್ದೆ 1959 ಕಲಂ 70 ರನ್ವಯ ಸಹಕಾರ ಸಂಘಗಳ ಜಂಟಿ ನಿಬಂಧಕರು (ನಿ. 441), ದಾವಾ ಪಂಚಾಯ್ತಿ ನ್ಯಾಯಾಲಯ, ಕರ್ನಾಟಕ ರಾಜ್ಯ ಸಹಕಾರ ಪಟ್ಟಣ ಬ್ಯಾಂಕುಗಳ ಮಹಾಮಂಡಳ ನಿ., ಬೆಂಗಳೂರು ಇವರ ನ್ಯಾಯಾಲಯದಲ್ಲಿ ದಾವಾ ಸಂಖ್ಯೆ: ಜೆಆರ್‌ಡಿ/ಯುಬಿಎಫ್/453 ಮತ್ತು 454/2017-18ರಂತೆ ದಾವಾ ಹೂಡಿ ಡಿಕ್ರಿ ಪಡೆದಿದ್ದರೂ ಸಾಲದ ಬಾಕಿ ವಸೂಲಾತಿಯಾಗಿರುವುದಿಲ್ಲ.
ಸಹಕಾರ ಸಂಘಗಳ ಜಂಟಿ ನಿಬಂಧಕರು (ನಿ. 441), ದಾವಾ ಪಂಚಾಯ್ತಿ ನ್ಯಾಯಾಲಯ, ಕರ್ನಾಟಕ ರಾಜ್ಯ ಸಹಕಾರ ಪಟ್ಟಣ ಬ್ಯಾಂಕುಗಳ ಮಹಾಮಂಡಳ ನಿ., ಬೆಂಗಳೂರು ಇವರ ನ್ಯಾಯಾಲಯದಿಂದ ಪಡೆದ ಡಿಕ್ರಿ ಆದೇಶಾನುಸಾರ ತುಮಕೂರು ಗ್ರೈನ್ ಮರ್ಚೆಂಟ್ಸ್ ಕೋ-ಆಪ್. ಬ್ಯಾಂಕ್ ಲಿ., ಬಿ.ಹೆಚ್.ರಸ್ತೆ, ತುಮಕೂರು ಈ ಬ್ಯಾಂಕಿನ ಮುಖ್ಯ ಕಾರ್ಯನಿರ್ವಹಣಾಧಿಕಾರಿ ಕರ್ನಾಟಕ ಸಹಕಾರ ಸಂಘಗಳ ನಿಯಮಗಳು 1960 ನಿಯಮ 34(1) ರನ್ವಯ ಸಹಕಾರ ಸಂಘಗಳ ಸಹಾಯಕ ನಿಬಂಧಕರು (ನಿ.441) ಮತ್ತು ವಸೂಲಾಧಿಕಾರಿಗಳು, ಕರ್ನಾಟಕ ರಾಜ್ಯ ಸಹಕಾರ ಪಟ್ಟಣ ಬ್ಯಾಂಕುಗಳ ಮಹಾಮಂಡಳ ನಿ., ಬೆಂಗಳೂರು ಇವರ ಕಛೇರಿಯಲ್ಲಿ ಅಮಲ್ಜಾರಿ ಅರ್ಜಿ ಸಂಖ್ಯೆ: ಸಿ.ಇ.ಪಿ/ಎ.ಆರ್.ಇ/ಯುಬಿಎಫ್/487 ಮತ್ತು 488/2017-18ರಂತೆ ದಾಖಲ್ಮಾಡಿ ಅಮಲಜಾರಿಯನ್ನು ಪಡೆದು, ಸದರಿ ಅಮಲ್ಜಾರಿ ಅರ್ಜಿಯನ್ನು ವಿಲೇವಾರಿ ಮಾಡಲು ಬ್ಯಾಂಕಿನ ಮಾರಾಟಾಧಿಕಾರಿಯವರಿಗೆ ವಹಿಸಲಾಗಿತ್ತು. ಬ್ಯಾಂಕಿನ ಮಾರಾಟಾಧಿಕಾರಿಯವರು ಅಮಲ್ಜಾರಿ ಅರ್ಜಿಯನ್ನು ವಿಲೇವಾರಿಗೊಳಿಸಲು ಬಾಕಿದಾರರು ಬ್ಯಾಂಕಿಗೆ ಆಧಾರ ಮಾಡಿದ್ದ ಸ್ಥಿರ ಸ್ವತ್ತನ್ನು ಮಾರಾಟ ಮಾಡಲು ದಿನಾಂಕ: 21.02.2018ರಂದು ಬಹಿರಂಗ ಹರಾಜಿಗೆ ತಂದಿರುತ್ತಾರೆ. ದಿನಾಂಕ: 21.02.2018ರಂದು ನಡೆದ ಸಾರ್ವಜನಿಕ ಹರಾಜಿನಲ್ಲಿ ಒಟ್ಟು 05 ಜನ ಬಿಡ್ಡುದಾರರು ಭಾಗವಹಿಸಿದ್ದು, ಈ ಪೈಕಿ 04ನೇ ಬಿಡ್ಡುದಾರರಾದ ಶ್ರೀ ಅತೀಖ್ ವುಲ್ಲಾ ಬಿನ್ ಫೀರಾನ್ ಸಾಬ್, ಮಸೀದಿ ರಸ್ತೆ, ಮಠದ ಕುರುಬರಹಟ್ಟಿ, ಚಿತ್ರದುರ್ಗ ಇವರು ರೂ. 33,05,000/- (ರೂಪಾಯಿ ಮೂವತ್ತಮೂರು ಲಕ್ಷದ ಐದು ಸಾವಿರಗಳು ಮಾತ್ರ) ಗಳಿಗೆ ಬಿಡ್ ಮಾಡಿ ಅತೀ ಹೆಚ್ಚಿನ ಬಿಡ್ಡುದಾರರಾಗಿರುತ್ತಾರೆ.
ಡಿಕ್ರಿ ಆದೇಶ ಮತ್ತು ಅಮಲ್ಜಾರಿ ಅರ್ಜಿಯನ್ವಯ ದಿನಾಂಕ: 6.12.2017ಕ್ಕೆ ಅಸಲು ರೂ. 10,22,000/- ಬಡ್ಡಿ, ಹಾಗೂ ಇತರೇ ವೆಚ್ಚಗಳು
ರೂ. 1,58,403/- ಸೇರಿ ಒಟ್ಟು ರೂ. 11,80,403/-ಗಳು ಬ್ಯಾಂಕಿಗೆ ಬರಬೇಕಾಗಿರುತ್ತದೆ.
