ORDERS
1. Whether the dismissal of Shri M. Masilamony Assistant Field Officer by the management of Nyamakad Estate isjustifiable or not ?

Whereas , the Government are of opinion that an industrial dispute exists between The Manager, Nyamakad Estate , Munnar P.O. , Idukki District , Pin-685 612 and the workmen of the above referred establishment represented by the Secretary , National Union of Plantation Staff (AITUC), Munnar P. O. , Idukki District -685 612 in respect of matters mentioned in the annexure to this order ;
Whereas, the Government are of opinion that an industrial dispute exists between The Trustee, St. Joseph Church , Kunnumbhagam , Kanjirappally and the workmen of the above referred establish- ment represented by the President , Kerala Plantation Labour Congress ( INTUC) ,(INTUC), Parathod, Pin-686 512 in respect of matters mentioned in the annexure to the order ;
And whereas , in the opinion of Government itis Lecessary to refer the said industrial dispute for adjudication ;
And whereas , in the opinion of Government it is necessary to refor the said industrial dispute for adjudication ;
Now, therefore , in exercise of the powers conferred by section 10 ( 1 ) ( d) of the Industrial Disputes Act of 1947 ( Gentral Act XIV of 1947) , the Now, therefore , in exercise of the powers conferred by section 10 ( 1 ) ( d) of the Industrial Disputes Act of 1947 (Central Act XIV of 1947) the Government hereby direct that the said Industrial dispute be referred for adjudication to the Industrial Tribunal, Idukki . The Industrial Tribunal will pass the award within a period of three months .

Whereas, the Government are of opinion that an industrial dispute exists between Smt . N. Rajamany Amma, Vasanth Vihar, Kochuplamoodu , Kollam and the workmen of the above referred establish- ment represented by Shri Murali Madanthakod , Secretary , KottarakkarKottarakkara Taluk Cashew Workers Union (CITU ) , ( HO ) Kottarakkara , Kollam District in respect of matters mentioned in the annexure to thisorder;
And whereas , in the opinion of Government it is necessary to refer the said industrial dispute for adjudication;
Now , therefore , in exercise of the powers conferred by section 10 ( 1 ) ( c ) of the Industrial Dispute. Act of 1947( Central Act XIV of 1947 ) the Government hereby direct that the said industrial dispute be referred for adjudication to the Labour Court, Kollam. The Labour Court will pass sud award within a period of three months .

Whether the denial of employment to the employees of Raj Gashew , Nallila , Kollamby the management is justifiable or not ? If not , what relief the employees are entitled to get ?

that Whereas, the Government are of opinion an industrial dispute exists between The Manager , M/ s T. R. & T Company Limited, Kuppakkayam Estate , Kuppakkayam Post , Mundakkayam and the workmen of the above referredd establishment represented by the General Secretary , Kerala Plantation Workers Union ( INTUC) , 35th Mile , Congress . House, Mundakkayam East Post in respect of matters mentioned in the annexure to this order ;
And whereas , in the opinion of Government it is necessary to refer, the said industrial dispute for adjudication:
Now, therefore, in exercise of the powers conferred by section 10 (1 ) ( 1) of the Industrial Disputes Act of 1917 (Central Act XIV of 1947) the Government hereby directdirect that the said industrial Industria dispate be referred for adjudication to the Industrial Tribunal , Idukki . The Industrial Tribunal will pass the award within a period of three months .
