e- Auction Notification

It is hereby notified that Teak timber IV & Teak Poles collected through thinning & final felling from 1987 TP Kodamala & 1957 TP Muthalathode in Achencovil Range will be sold through e-Auction as shown in the schedule, by M/S MSTC Ltd, Bangalore, subject to the conditions published by the M/S MSTC Ltd and in the Kerala Gazette No.49 Vol.IV dated. 15.12.2015 vide Notification No.Pro.(4)26243/13 dated:

21.11.2015 of the Additional Principal Chief Conservator of Forests (P) Thiruvananthapuram and other conditions prevalent in the Forest Department. Besides the quantity shown in the schedule, the quantity if any delivered to dumping depots before the date of e-Auction and that could be lotted immediately before the e-auction will also be placed in the proposed e-auction. Those who wish to participate in the e-auction have to remit EMD as shown in the schedule as e-payment before the e-auction through MSTC limited. Registration number of the bidder should be entered while remitting the EMD amount. Bidders those who are registered and have remitted the EMD before the e-auction will be permitted to take part in the e-auction. Successful bidders will have to remit 35% of the bid amount within 7 (seven) days after obtaining the confirmation of e-auction sale from MSTC. If any successful bidder fails to remit the 35% amount within the stipulated time, the EMD will be forfeited to Govt. and which is non-refundable under any circumstances. If any of the Banks demand a commission for converting the Demand Draft to cash, the bidder will have to suffer the commission charges. Successful bidders will also have to remit the balance value, Forest Development Tax, GST, Income Tax and such other taxes that are prevailing at the time of e-auction within the stipulated time limit.

www.mstcecommerce.com. The Earnest Money Deposit should be submitted on e-payment / e-treasury / demand draft / MSTC through the internet online banking of SBT or through NEFT for other banks. For submission of e-auction visit the website:

Online e-Auction/bids are to be accompanied with relevant documents. Divisional Forest Officer, Achencovil during the office hours. The details regarding e- Payment (Bidder's Bank Account No. where he/she is having core banking facility and email id) should be submitted along with the e-Auction documents. E-Auction documents with out these details will not be accepted. The Forest Department will not be responsible for any inconvenience or loss to the Bidder while uploading / downloading the documents.

The bidders who wish to participate in the e-auction should produce a certificate showing the permanent address and signature of the bidders duly attested by the concerned village officer, or any other approved identity documents along with the EMD through online. Those who do not produce any approved identity card or certificate will not be eligible to participate in the e-auction.

Intending persons may ensure the quantity and quality of materials put up for e- auction before the commencement of the same and no complaints will be entertained after the e-auction. In case any Govt. Department requires any of the materials put up for the e- auction, the quantity remaining after their selection only will be re-auctioned. The quantity that may become ready for sale after the publication of this notification will also be included in the e- auction. Any further notification to the sale conditions that may be issued by the Government after the issuance of this notification will also be applicable to this e- auction.

The unsold materials in the e-auction will be re-auctioned.

നിബന്ധനകൾ

6. ദർഘാസിൽ പങ്കെടുക്കുന്ന ആൾ ദർഘാസ് ഷെഡ്യൂളിൽ പറയുന്ന മതിപ്പ് കരാർ തുകയുടെ ഇത്ര ശതമാനം എന്ന് ദർഘാസ് ഫോറത്തിലെ പ്രസക്ത കോളത്തിൽ അക്കത്തിലും അക്ഷരത്തിലും രേഖപ്പെടുത്തേ−താണ്. അക്കത്തിലും, അക്ഷരത്തിലും വ്യത്യസ്ത നിരക്കുകളാണ് രേഖപ്പെടുത്തുന്ന തെങ്കിൽ അതിൽ കുറഞ്ഞ നിരക്ക് പ്രാബല്യത്തിലുള്ളതായി പരിഗണിക്കുന്ന തായിരിക്കും. ആയത് അംഗീകരിക്കാൻ ദർഘാസുകാരൻ ബാദ്ധ്യസ്ഥനാണ്. ദർഘാസ് ഫോറത്തിൽ രേഖപ്പെടുത്തിയിട്ടുള്ള നിരക്ക്, ജോലി പൂർത്തിയാ ക്കാൻ കഴിയുന്നതിലും വളരെ കുറവാണെന്ന് വനം വകുപ്പ് കാണുന്ന പക്ഷം ആയത് സംബന്ധിച്ച് ദർഘാസുകാരനിൽ നിന്നും തൃപ്തികരമായ വിശദീകരണം നൽകാൻ ആവശ്യപ്പെടുന്നതുമാണ്. ഇത്തരം സന്ദർഭത്തിൽ ദർഘാസ് അംഗീകരിക്കുന്നതിനു മുൻപായി രേഖപ്പെടുത്തിയിട്ടുള്ള നിരക്കിന്റെ ¹⁰% അധിക സെക്യൂരിറ്റിയായി ഒടുക്കുവാൻ ആവശ്യപ്പെടാവുന്നതാണ്. വിശദീകരണം തൃപ്തികരമല്ല എന്നു കാണുന്ന പക്ഷം അഥവാ വിശദീകരണം നൽകിയിട്ടില്ലായെങ്കിൽ ഏറ്റവും കുറഞ്ഞനിരക്ക് രേഖപ്പെടുത്തിയിട്ടു−െങ്കിലും ആയത് നിരസിക്കുന്നതിനുള്ള അധികാരം വനം വകുപ്പിൽ നിക്ഷ്പിതമാണ്.

7. നിശ്ചിത തീയതിക്കും സമയത്തും ലഭിക്കാത്ത അപേക്ഷകളും ആവശ്യമായ രേഖകൾ ഉൾപ്പെടുത്താത്തതോ നിശ്ചിത ഫോറത്തിലും നിശ്ചിത ക്രമത്തിലും എഴുതാത്തതോ ആയ ദർഘാസുകൾ പരിഗണിക്കുന്നതല്ല.

8. ദർഘാസിൽ എന്തെങ്കിലും തിരുത്തലുകൾ വരുത്തിയിട്ടു−െങ്കിൽ ആയത് ദർഘാസുകാരൻ തന്നെ ഇനിഷ്യൽ ചെയ്തിരിക്കേ−താണ്.

11. സാധാരണഗതിയിൽ കുറഞ്ഞ നിരക്ക് രേഖപ്പെടുത്തിയിട്ടുള്ള ദർഘാസ് സ്വീകരിക്കുന്നതായിരിക്കും. പക്ഷേ തീരുമാനമെടുക്കാൻ അധികാരമുള്ള ഉദ്യോഗസ്ഥന് ഒരു കാരണവും പറയാതെ തന്നെ ദർഘാസ് സ്വീകരിക്കുവാനോ നിരസിക്കുവാനോ അധികാരം ഉ−ായിരിക്കും.

The Divisional Forest Officer, Nemmara for and on behalf of the Governor of Kerala invites separate online e-tenders from registered eligible contractors/bidders having a valid and active registration with Kerala Forest Department in pursuance of G.O(MS) No. 26/2017/F&WLD dated 20.05.2017 & of G.O(RT) No. 141/2021/F&WLD dated 06.05.2021 for the execution of works noted in the schedule attached below.

The tenderer is bound to comply with the terms and conditions in force, besides the conditions that will be framed by the Government in future in connection with this tender.

Tender documents and tender schedules may be downloaded free of cost from the e-GP website www.etenders.kerala.gov.in. Bidders shall remit the tender document fee and the Earnest Money Deposit using online payment option of e-procurement system only and submitted through the internet online banking of State Bank of India or through NEFT for other banks. Bidders opting for NEFT facility of online payment are advised to exercise this option at least 72 hours before the closing date of bid to ensure that payment towards tender document fees and EMD are credited and a confirmation is reflected in the e- procurement system. The online NEFT remittance form provided by e-procurement system for making a NEFT transaction is not a payment confirmation. Kerala Forest Department /NIC/ SBI shall not be responsible for any kind of delay in payment status confirmation.

The successful tenderer should execute an agreement in the prescribed format in a white paper as per the existing rules within 14 days from the date of intimation of acceptance of the tender after furnishing security deposit equal to 05% of the tender amount. C O N D I T I O NS

1. All provisions in GO (MS) 26/2017 F&WLD dated 20.05.2017 & GO (Rt) No.141/2021/F &

WLD dtd 06.05.2021 regarding tender system in Kerala Forest Department, Kerala Forest

Act 1961 and Wildlife Protection Act 1972 will be applicable to the tenderer.

2. The tender/bids shall be opened online at the office of the Divisional Forest Office,

Nemmara in the presence of bidders / their representatives who wish to attend at the

above address. If the tender opening date happens to be a holiday or non working day

due to any other valid reason, the tender opening process will be done on the next

working day at same time and place.

3. The tender form shall be used only by the person in whose name it is issued and for the work

specified in the Schedule attached to the tender form.

4. Before submitting the tender, the tenderer is expected to study and scrutinize all the

conditions in the agreement to be executed, the draft of which can be had for perusal

at the Divisional Forest Office on any working day during office hours. They are also

requested to study the detailed tender conditions attached to the tender document. No

plea of ignorance of the agreement conditions or no complaint regarding the said

conditions received after putting in the tender will be entertained.

5. Before submitting the tender the tenderer shall visit the area of work to study all the

field conditions and nature of work and quote his rate accordingly. No enhancement

in rate due to any reason will be entertained thereafter.

6. The tenderer shall quote in the appropriate column in the tender a firm percentage of basic rates per Hecotr amount for raising the plantation and maintenance of plantation up to 3rd year or as in the Schedule both in figures as well as in words. In the case of the tenderer quoting different total rate in words and figures also, lower of the same only be considered valid and shall be binding on him/her. If the Kerala Forest Department feels that the total amount quoted or item wise rate of any of the items quoted is unworkable due to variance to the lower side to an abnormal level with the Kerala Forest Department's estimated rates, the tenderer may be required to furnish satisfactory explanation on the above respect. In such an event, the Kerala Forest Department has the option to collect a Additional Security Deposit to the tune of 10% of the quoted amount from the tenderer before issuance of confirmation orders. If the explanation furnished is not found satisfactory or no explanation is furnished, the Kerala Forest Department has the right to deny the offer of work to the tenderer even though he/she is the lowest tenderer.

7. Tender received after the specified date and time or received without the requisite

enclosures or tenders not written up in proper order or form will not be honoured.

8. All the corrections in the tender form shall be initialed by the tenderer himself.

9. Part I (Technical Bid) of the tenders received in due time will be opened by the

Divisional Forest Officer or his deputy at his office at 4 P.M on 25.01.2025 in the

presence of such of the tenderers present on that occasion.

10. Part-II tenders (Financial bid) of the tenderers whose Part-I tenders have been

accepted only will be opened subsequently. The time and place of opening of the Part

II tenders will be announced immediately on the acceptance of the Part I tender.

11.

The lowest tender will ordinarily be accepted, but the authority competent to accept

the tender reserves to himself the power of accepting or rejecting any tender without

assigning any reason therefore.

12. No tenderer will be permitted to withdraw his offer within three months from the date

of opening of the financial bid.

13. The tenderer whose tender is accepted will be informed regarding acceptance of his tender by a Confirmation Order issued by registered letter bearing the address mentioned in the tender. The successful tenderer, within 15 days of receipt of confirmation of his tender, shall have to execute an agreement in the prescribed form [Appendix 13] on a plain paper to be supplied by him at his cost. If the Contractor fails to execute the agreement during the period, the tender will be cancelled, and the Ernest Money Deposit submitted by the tenderer shall stand forfeited to the Kerala Forest Department. The work will be carried out at the risk and cost of the tenderer or through any other method (including through the next higher tenderer). The loss, if any, to the Government consequent to the default, if not paid by the defaulter within a reasonable time specified by the Divisional Forest Officer, shall be treated as arrears on public revenue to be recovered from the defaulter under the provisions of the Kerala Revenue recovery Act 1968 and in such other manner as the Government may deem fit. The defaulter however will not be entitled for gain, if any.

14. The successful tenderer while signing the agreement shall furnish a security deposit

for an amount equal to 05 per cent of the total Probable Amount of Contract.

The security deposit will be released only after the successful completion of the

contract work and after producing the Non Liability Certificate from the concerned

officers.

15. The successful tenderer shall give an undertaking at the time of execution of

agreement that he shall not sell, mortgage or otherwise alienate the properties covered

by the solvency certificate during the currency of the contract.

16. The post-offers and representations sent, after confirmation of the tender in respect of

work shall at no account be considered.

17. The Earnest Money Deposit of the unsuccessful tenderers will be returned as soon as

possible after the tenders are finalized.

18. The quantities of work shown in the Schedule are approximate and it may vary on

actual execution of work.

19. The area shown in the tender schedule is approximate. The actual extent of the

contract area may vary as per the final survey report, which will be binding on the

successful tenderer.

20. The contractor has to keep the plantation free from weeds throughout the contract

period.

21.. Payment shall be made to the contractor at any stage as decided by the paying

authority and based on the works so far completed to the full satisfaction of the paying

authority and after proper inspection and recording of the works done/completed and

as per the existing provisions of the contract system.

22. It shall be open to the Divisional Forest Officer to cancel/reduce the quantity of work to be executed in the attached schedule based on site conditions in each year and the Divisional Forest Officer's decision will be binding on the successful tenderer. If any additional item/s of work which are not included in the schedule are required to be carried out inevitably for reasons to be recorded, in the contract area during the course of contract period, the successful tenderer is bound to execute that work for which payment shall be worked out based on the rate quoted above or below the estimate amount. If the cost quoted is above estimate amount, the payment shall be made based on the estimate amount/ schedule rate and if the cost of work is below the estimate amount, payment shall be made as per the quoted rate.

23. Kerala Forest Department reserves the right to execute the work through any other

mode of execution other than through contract system if the tender offered by the

contractors is not feasible according to the Department.

24. All the taxes prevailing at the time of tender is applicable to this tender.

Special Tender Conditions (Nursery Works)

1. Contractor should apply and obtains the license prescribed under the 'Contract Labour' (Regulation and abolition) contractor employees more than 20 workers on any day. Failure to do so will attract penalty and an amount equivalent to the fees for licence and security deposit as per Rule 24 of the Kerala Contract and labour (Regulation and abolition) Rules 1974 and the same will be recovered from the contractors bill without any notice.

2. Contractor should employ or engage his own workman and should strictly abide by all requirements under the Act 1948; Industrial Dispute Act 1947 ; Employees Provident Fund Act 1952, Workmens compensation Act 1923; the contract labour (Regulation and abolition ) Act 1970 etc

3. The Contractor shall give preference to tribals if any residing in the locality for the tendered work

4. Contractor should comply with the provision of Employees State Insurance Act 1948, Emplyoees Provident Fund Act 1952 and Miscellaneous Provision Act 1976. 5. In the case of nursery and plantation work the contractor should protect the nursery /seedlings from threat factors and also undertake necessary protective measures required by department.

6. Contractor must ensure that only good quality viable seeds prescribed by the department is used to produce seedlings

7. Potting mixture should be prepared using the ingredients mentioned in the estimate in ratio of 3:1:1 ie, Sieved soil: River Sand : Cow dung

8. Polythene bag must be with gauge prescription mentioned in the estimate and the potting mixture must be filled in such a manner that seedlings should stand upright and should not fall down.

9. Contractor must ensure the seedlings are wet and should water adequately or optimum as required by estimate.

10. Seedlings must be arranged in raw under green shade pandal. 11. Seedlings must be protected with fence or appropriate material till they are distributed.

12. LDPE Poly bags above 50 Microns of width 12 cm and length 18 cm (5 Inch x 7 Inch) is to be used.

13. Pricking out should be carried out when the cotyledyons have dropped off or two primary leaves have emerged in addition to cotyledons and seedlings stems have reasonable strength to stand transplanting . The period of attaining such a state of development varies from species to species, but it is generally more than three but less than four weeks. The seedlings should be held with thumb and forefinger by the leaves or just below the first pair of leaves and pulled up softly .

Carry out the operations on humid condition or in the evenings

14. Secondary bed nursery works shall be resumed soon after the primary bed nursery works are over. Half of the filling operations in secondary nursery shall be completed within two weeks and the balance work shall be completed within one month soon after the primary bed nursery works are over.

15. First part payment upto 40% of the agreed amount shall be sanctioned after proper germination is completed. Second part payment upto 80% of the agreed rate, when the seedlings become healthy and ready for planting. Balance 20% of the agreed amount will be released after the completion of distribution work. 16. VDA shall be calculated as per the prevailing VDA during the execution of work and the revised wage rate vide GO(Rt) No. 65/2019 LBR dated 18/07/2019.

17. Particulars of work are subjected to PCCF Circular No. Plg2–183-2004 dated 20/11/2004 on FSR job specifications.

ദർഘാസുകാരൻ വനംവകുപ്പിൽ നിലവിലുള്ളതും സർക്കാർ ഭാവിയിൽ പ്രാബല്യത്തിൽ കൊ−ുവരുന്നതുമായ എല്ലാ നിബന്ധനകളും പി.ഡബ്ലിയൂ.ഡി. വ്യവസഥകളും ഇതര വ്യവസ്ഥകളും പാലിക്കാൻ ബാദ്ധ്യസ്ഥനാണ്. ദർഘാസ് പ്രമാണങ്ങളും, ദർഘാസ് ഷെഡ്യൂളുകളും www.etenders.kerala.gov.in എന്ന വെബ്സൈറ്റിൽ ലഭ്യമാണ്. ദർഘാസിനോടൊപ്പം സമർപ്പിക്കുന്നതിനുള്ള നിരതദ്രവ്യം, ദർഘാസ് പ്രമാണവില എന്നിവ സ്റ്റേറ്റ് ബാങ്ക് ഓഫ് ഇൻഡ്യയുടെ ഇന്റർനെറ്റ് ഓൺലൈൻ ബാങ്കിംഗ് വഴിയോ മറ്റു ബാങ്കുകളുടെ കാര്യത്തിൽ NEFT വഴിയോ ഇ-ടെൻഡറിനൊപ്പം സമർപ്പിക്കേ−താണ്. NEFT വഴി ഇ-പെയ്മെന്റ് നടത്തുന്ന ദർഘാസുകാർ ദർഘാസ് സമർപ്പിക്കുന്നതിന് മുൻപ് കുറഞ്ഞത് ⁷² മണിക്കൂർ മുൻപെങ്കിലും ടെൻഡർ ഫോറത്തിന്റെ വിലയും ഇ.എം.ഡി-യും e- procurement system ൽ എത്തിച്ചേർന്നതായി ഉറപ്പുവരുത്തേ−താണ്.

എല്ലാ ടെ−ർ പ്രമാണങ്ങളും www.etenders.kerala.gov.in Fന്ന വെബ്സൈറ്റിൽ കാണിച്ചിരിക്കുന്ന ഓൺലൈൻ കവറുകളിൽ ഓൺലൈനായി മാത്രമേ സ്വീകരിക്കുകയുള്ളൂ. നേരിട്ടോ തപാൽ മാർഗ്ഗമോ ലഭിക്കുന്ന ദർഘാസുകൾ ഒരു കാരണവശാലും സ്വീകരിക്കുന്നതല്ല. നിശ്ചിത സമയപരിധിക്കുശേഷം ലഭിക്കുന്ന ടെ−റുകളും സ്വീകരിക്കുന്നതല്ല. ദർഘാസ് ഫോറത്തിന്റെ വില മാത്രമാണ് ഈടാ ക്കുന്നത്. ജി എസ് ടി ¹⁸% നിരക്കിൽ കരാറുകാരൻ ജി എസ് ടി വകുപ്പിലേക്ക് നേരിട്ട് അടയ്ക്കേ−താണ്.

നിബന്ധനകൾ

3. ഒരു വ്യക്തിയുടെ പേരിൽ നൽകിയിട്ടുള്ള ദർഘാസ് ഫോറം ആ വ്യക്തിക്കു മാത്രവും ടെ−ർ ഫോറത്തോടൊപ്പം ഉള്ളടക്കം ചെയ്തിട്ടുള്ള ജോലിക്കും മാത്രമേ ഉപയോഗിക്കാൻ പാടുളളൂ.

4. ടെ−ർ സമർപ്പിക്കുന്നതിനു മുൻപായി, ഒപ്പിടേ− എഗ്രിമെന്റിലെ വ്യവസ്ഥകൾ മനസ്സിലാക്കിയിരിക്കേ−താണ്. എഗ്രിമെന്റിന്റെ കരട് ഡിവിഷണൽ ഫോറസ്റ്റ് ഓഫീസിൽ നിന്നും ലഭ്യമാകുന്നതാണ്. ദർഘാസ് വ്യവസ്ഥകളും മനസ്സിലാക്കിയിരിക്കേ−താണ്. പൂരിപ്പിച്ച ദർഘാസ് സമർപ്പിച്ചശേഷം എഗ്രിമെന്റ് വ്യവസ്ഥകൾ മനസ്സിലാക്കിയിരുന്നില്ല എന്ന വാദമോ വ്യവസ്ഥകൾ സംബന്ധിച്ച് എന്തെങ്കിലും പരാതികളോ പരിഗണിക്കുന്നതല്ല.

5. ദർഘാസ് സമർപ്പിക്കുന്നതിനു മുൻപായി ജോലി നടത്തേ− സ്ഥലവും, ജോലിയുടെ സ്വഭാവവും പരിശോധിച്ച് മനസ്സിലാക്കുകയും ആയതിനനുസരിച്ച് നിരക്ക് രേഖപ്പെടുത്തേ−തുമാണ്. ആയതിനുശേഷം ഒരു കാരണവശാലും നിരക്ക് വർദ്ധിപ്പിക്കുന്നതല്ല.

6. ദർഘാസിൽ പങ്കെടുക്കുന്ന ആൾ ദർഘാസ് ഷെഡ്യൂളിൽ പറയുന്ന മതിപ്പ് കരാർ തുകയുടെ ഇത്ര ശതമാനം എന്ന് ദർഘാസ് ഫോറത്തിലെ പ്രസക്ത കോളത്തിൽ അക്കത്തിലും അക്ഷരത്തിലും രേഖപ്പെടുത്തേ−താണ്. അക്കത്തിലും, അക്ഷരത്തിലും വ്യത്യസ്ത നിരക്കുകളാണ് രേഖപ്പെടുത്തുന്ന തെങ്കിൽ അതിൽ കുറഞ്ഞ നിരക്ക് പ്രാബല്യത്തിലുള്ളതായി പരിഗണിക്കുന്ന തായിരിക്കും. ആയത് അംഗീകരിക്കാൻ ദർഘാസുകാരൻ ബാദ്ധ്യസ്ഥനാണ്. ദർഘാസ് ഫോറത്തിൽ രേഖപ്പെടുത്തിയിട്ടുള്ള നിരക്ക്, ജോലി പൂർത്തിയാ ക്കാൻ കഴിയുന്നതിലും വളരെ കുറവാണെന്ന് വനം വകുപ്പ് കാണുന്ന പക്ഷം ആയത് സംബന്ധിച്ച് ദർഘാസുകാരനിൽ നിന്നും തൃപ്തികരമായ വിശദീകരണം നൽകാൻ ആവശ്യപ്പെടുന്നതുമാണ്. ഇത്തരം സന്ദർഭത്തിൽ ദർഘാസ് അംഗീകരിക്കുന്നതിനു മുൻപായി രേഖപ്പെടുത്തിയിട്ടുള്ള നിരക്കിന്റെ ¹⁰% അധിക സെക്യൂരിറ്റിയായി ഒടുക്കുവാൻ ആവശ്യപ്പെടാവുന്നതാണ്. വിശദീകരണം തൃപ്തികരമല്ല എന്നു കാണുന്ന പക്ഷം അഥവാ വിശദീകരണം നൽകിയിട്ടില്ലായെങ്കിൽ ഏറ്റവും കുറഞ്ഞനിരക്ക് രേഖപ്പെടുത്തിയിട്ടു−െങ്കിലും ആയത് നിരസിക്കുന്നതിനുള്ള അധികാരം വനം വകുപ്പിൽ നിക്ഷ്പിതമാണ്.

7. നിശ്ചിത തീയതിക്കും സമയത്തും ലഭിക്കാത്ത അപേക്ഷകളും ആവശ്യമായ രേഖകൾ ഉൾപ്പെടുത്താത്തതോ നിശ്ചിത ഫോറത്തിലും നിശ്ചിത ക്രമത്തിലും എഴുതാത്തതോ ആയ ദർഘാസുകൾ പരിഗണിക്കുന്നതല്ല.

8. ദർഘാസിൽ എന്തെങ്കിലും തിരുത്തലുകൾ വരുത്തിയിട്ടു−െങ്കിൽ ആയത് ദർഘാസുകാരൻ തന്നെ ഇനിഷ്യൽ ചെയ്തിരിക്കേ−താണ്.

9. ലഭിച്ചിട്ടുള്ള ദർഘാസുകൾ ഒന്നാം ഭാഗം ഡിവിഷണൽ ഫോറസ്റ്റ് ഓഫീസറോ അദ്ദേഹം ചുമതലപ്പെടുത്തുന്ന ഉദ്യോഗസ്ഥനോ ²⁵.⁰¹.²⁰²⁵ ന് വൈകുന്നേരം ⁴ മണിക്ക് അദ്ദേഹത്തിന്റെ ഓഫീസിൽ വച്ച് ഹാജരായിട്ടുള്ള ദർഘാസുകാരുടെ സാന്നിദ്ധ്യത്തിൽ തുറക്കുന്നതാണ്.

10. ദർഘാസിന്റെ ഒന്നാം ഭാഗം (Technical bid) അംഗീകരിച്ചിട്ടുള്ള കോൺട്രാക്ടർമാരുടെ മാത്രം ര−ാം ഭാഗം (Financial bid) തുറക്കുന്ന സമയം പിന്നീട് പ്രഖ്യാപിക്കുന്നതാണ്. ടെ−റിന്റെ ഒന്നാം ഭാഗംThis is a digitally signed Gazette. Authenticity may be verified through https://compose.kerala.gov.in/

തുറന്നാലുടൻതന്നെ ര−ാം ഭാഗം തുറക്കുന്ന സമയം അറിയിക്കുന്നതാണ്.

11. സാധാരണഗതിയിൽ കുറഞ്ഞ നിരക്ക് രേഖപ്പെടുത്തിയിട്ടുള്ള ദർഘാസ് സ്വീകരിക്കുന്നതായിരിക്കും. പക്ഷേ തീരുമാനമെടുക്കാൻ അധികാരമുള്ള ഉദ്യോഗസ്ഥന് ഒരു കാരണവും പറയാതെ തന്നെ ദർഘാസ് സ്വീകരിക്കുവാനോ നിരസിക്കുവാനോ അധികാരം ഉ−ായിരിക്കും.

12. ദർഘാസ് തുക രേഖപ്പെടുത്തിയിട്ടുള്ള ദർഘാസ് തുറന്ന് മൂന്ന് മാസത്തിനകം ഓഫർ പിൻവലിക്കുവാൻ ദർഘാസുകാരെ അനുവദിക്കുന്നതല്ല.

13. ആരുടെ ദർഘാസാണോ സ്വീകരിച്ചിട്ടുള്ളത്, ആ വിവരം വ്യക്തിയെ ദർഘാസിൽ കൊടുത്തിരിക്കുന്ന വിലാസത്തിൽ e-mail മുഖാന്തിരം അറിയിക്കുന്നതാണ്. വിജയിയായ ദർഘാസുകാരൻ 15 ദിവസത്തിനകം ടിയാന്റെ ചെലവിൽ വാങ്ങിയിട്ടുള്ള നിയമാനുസൃത തുകയ്ക്കുള്ള മുദ്രപത്രത്തിൽ ഒരു ഉടമ്പടി ഒപ്പു വയ്ക്കേ−താണ്. ദർഘാസുകാരൻ ഉടമ്പടി ഒപ്പു വയ്ക്കുന്നതിൽ പരാജയപ്പെട്ടാൽ ദർഘാസ് റദ്ദാക്കുന്നതും ടിയാൻ കെട്ടിവച്ചിട്ടുള്ള നിരതദ്രവ്യം വനംവകുപ്പിലേയ്ക്ക് ക−ുകെട്ടുന്നതുമാണ്. തുടർന്ന് ജോലികൾ ടിയാന്റെ നഷ്ടോത്തരവാദിത്വത്തിൽ തൊട്ടടുത്ത നിരക്ക് രേഖപ്പെടുത്തിയിട്ടുള്ള ആളിനെക്കൊ−് ചെയ്യിക്കുന്നതുൾപ്പെടെയുള്ള മറ്റ് മാർഗ്ഗങ്ങളിൽ കൂടി നടത്തുന്നതാണ്. ഇതിൽ വച്ച് സർക്കാരിന് എന്തെങ്കിലും നഷ്ടം ഉ−ാകുന്ന പക്ഷം ആയത് ആദ്യ ദർഘാസുകാരൻ ഡിവിഷണൽ ഫോറസ്റ്റ് ഓഫീസർ അനുവദിക്കുന്ന ന്യായമായ സമയത്തിനുള്ളിൽ ഒടുക്കിയി ല്ലായെങ്കിൽ ആയത് പൊതുമുതലിനുള്ള കുടിശ്ശികയായി കണക്കാക്കുന്നതും ആയത് 1968-ലെ കേരള റവന്യൂ റിക്കവറി ആക്ടിലെ വ്യവസ്ഥകൾ പ്രകാരമോ, സർക്കാരിന് യുക്തമെന്ന് തോന്നുന്ന മാർഗ്ഗങ്ങളിലൂടെയോ ഈടാക്കുന്നതാണ്. സർക്കാരിന് എന്തെങ്കിലും നേട്ടമു−ാകുന്ന പക്ഷം അതിൽ വീഴ്ചക്കാരന് യാതൊരു അവകാശവും ഉ−ായിരിക്കുന്നതല്ല.

14. വിജയിയാകുന്ന ദർഘാസുകാരൻ ഉടമ്പടി ഒപ്പു വയ്ക്കുന്ന സമയത്ത് കോൺട്രാക്ട് തുകയുടെ 5% സെക്യൂരിറ്റിയായി ഒടുക്കേ−താണ്. ജോലി പൂർത്തിയാക്കി, ബന്ധപ്പെട്ട ഓഫീസറിൽ നിന്നും ലഭ്യമാകുന്ന ബാദ്ധ്യതാ രഹിത സർട്ടിഫിക്കറ്റ് ഹാജരാക്കുന്ന മുറയ്ക്ക് മാത്രമേ സെക്യൂരിറ്റി വിടുതൽ ചെയ്യുകയുള്ളൂ.

15. വിജയിയാകുന്ന ദർഘാസുകാരൻ ഉടമ്പടി ഒപ്പു വയ്ക്കുന്ന സമയത്ത് സോൾവൻസി സർട്ടിഫിക്കറ്റിൽ ഉൾപ്പെട്ടിട്ടുള്ള വസ്തുവകകൾ വിൽക്കുകയോ, പണയം വയ്ക്കുകയോ കൈമാറ്റം ചെയ്യുകയോ ചെയ്യില്ലെന്ന് ഒരു സമ്മതപത്രം നൽകേ−താണ്.

16. ദർഘാസ് അംഗീകരിച്ചതിനുശേഷം ഒരു ജോലിയെ സംബന്ധിക്കുന്ന പോസ്റ്റ് ഓഫറുകളോ, പരാതികളോ ഒരു കാരണവശാലും പരിഗണിക്കുന്നതല്ല.

17. ദർഘാസിൽ പങ്കെടുത്തിട്ടുള്ള വിജയികളാകാത്ത ദർഘാസുകാരുടെ നിരതദ്രവ്യം ടെ−ർ നടപടികൾ അവസാനിക്കുന്ന മുറയ്ക്ക് തിരികെ നൽകുന്നതാണ്.

18. ദർഘാസിനോടൊപ്പമുള്ള ഷെഡ്യൂളിൽ പറയുന്ന അളവുകൾ ഏകദേശ മായിരിക്കും. ജോലികൾ ചെയ്തു വരുമ്പോൾ അളവുകളിൽ വ്യത്യാസം വരാവുന്നതാണ്.

19. ദർഘാസ് ഷെഡ്യൂളിൽ കാണിച്ചിട്ടുള്ള സ്ഥല വിസ്തൃതി ഏകദേശം മാത്രമാണ്. ദർഘാസ്കാരൻ സർവ്വേപ്രകാരമുളള യഥാർ° വിസ്തൃതിക്ക് ബാധ്യസ്ഥനാണ്.

20. ദർഘാസ് കാലയളവിൽ കോൺട്രാക്ടർ കളകൾ നീക്കം ചെയ്ത് തോട്ടങ്ങൾ സംരക്ഷിക്കേ−താണ്.

21. ജോലി പൂർത്തിയാക്കി നിശ്ചിത ഫോറത്തിലുള്ള ബില്ല് തയ്യാറാക്കി സമർപ്പിക്കുന്ന മുറയ്ക്ക് ജോലി നിർവ്വഹണം തൃപ്തികരമെങ്കിൽ നിലവിലെ കോൺട്രാക്ട് സിസ്റ്റത്തിലെ വ്യവസ്ഥകൾക്കനുസരിച്ച് ബില്ലുകൾ അനുവദിച്ചു നൽകുന്നതാണ്.

22. ദർഘാസ് ഷെഡ്യൂളിൽ കാണിച്ചിരിക്കുന്ന ജോലികളുടെ അളവിൽ സ്ഥലത്തിന്റെ പ്രത്യേകത അനുസരിച്ച് കുറവ് വരുത്താനോ ജോലി ക്യാൻസൽ ചെയ്യാനോ ഡിവിഷണൽ ഫോറസ്റ്റ് ഓഫീസർക്ക് അധികാരമു−ായിരിക്കും. ആയത് വിജയിയായ ദർഘാസുകാരന് ബാധകമായിരിക്കും. ദർഘാസ് ഷെഡ്യൂളിൽ ഉൾപ്പെട്ടിട്ടില്ലാത്ത ഏതെങ്കിലും ഐറ്റങ്ങൾ വ്യക്തമായ കാരണ ങ്ങളാൽ ഉൾപ്പെടുത്തേ−തു−െങ്കിൽ ആ ജോലി ചെയ്യുന്നതിന് വിജയിയായ ദർഘാസുകാരൻ ബാദ്ധ്യസ്ഥനായിരിക്കും. ഇപ്രകാരം അധികമായി ചെയ്യുന്ന പ്രവൃത്തിയ്ക്ക് ദർഘാസിൽ പറഞ്ഞിരിക്കുന്ന നിരക്ക് അടങ്കൽ നിരക്കിനേക്കാൾ കൂടുതലാണെങ്കിൽ ഫോറസ്റ്റ് ഷെഡ്യൂൾ നിരക്കിലും, കുറവാണെങ്കിൽ കുറഞ്ഞ നിരക്കിലും ആയിരിക്കും തുക മാറി നൽകുക.

23. കോൺട്രാക്ടർ വാഗ്ദാനം ചെയ്തിട്ടുള്ള ടെൻഡറുകൾ നടപ്പിലാക്കുന്നത് പ്രായോഗികമല്ലെന്ന് ബോധ്യപ്പെട്ടാൽ കോൺട്രാക്ട് സിസ്റ്റം അല്ലാത്ത മറ്റ് മാർഗ്ഗങ്ങളിലൂടെ നടപ്പിലാക്കുന്നതിനുള്ള അധികാരം കേരള വനം വകുപ്പിൽ നിക്ഷിപ്തമായിരിക്കും.

24. ദർഘാസ് നടത്തുന്ന സമയത്ത് നിലവിലുള്ള എല്ലാ നികുതികളും ഈ ദർഘാസിനും ബാധകമായിരിക്കും.

KFDDO/2332/2025-DFONMR/D Date : 15.01.2025 The Divisional Forest Officer, Nemmara for and on behalf of the Governor of Kerala invites separate online e-tenders from registered eligible contractors/bidders having a valid and active registration with Kerala Forest Department in pursuance of G.O(MS) No. 26/2017/F&WLD dated 20.05.2017 for the execution of works noted in the schedule attached below.

The tenderer is bound to comply with the terms and conditions in force, besides the conditions that will be framed by the Government in future in connection with this tender.

Tender documents and tender schedules may be downloaded free of cost from the e-GP website www.etenders.kerala.gov.in. Bidders shall remit the tender document fee and the Earnest Money Deposit using online payment option of e-procurement system only and submitted through the internet online banking of State Bank of India or through NEFT for other banks. Bidders opting for NEFT facility of online payment are advised to exercise this option at least 72 hours before the closing date of bid to ensure that payment towards tender document fees and EMD are credited and a confirmation is reflected in the e- procurement system. The successful tenderer should execute an agreement in the prescribed format in a white paper as per the existing rules within 15 days from the date of intimation of acceptance of the tender after furnishing security deposit equal to 05% of the tender amount or Rs. 5,00,000/- whichever is less. C O N D I T I O NS

1. All provisions in GO (MS) 26/2017 F&WLD dated 20.05.2017 & GO (Rt) No.141/2021/F &

WLD dtd 06.05.2021 regarding tender system in Kerala Forest Department, Kerala Forest

Act 1961 and Wildlife Protection Act 1972 will be applicable to the tenderer.

2. The tender/bids shall be opened online at the office of the Divisional Forest Office,

Nemmara in the presence of bidders / their representatives who wish to attend at the

above address. If the tender opening date happens to be a holiday or non working day

due to any other valid reason, the tender opening process will be done on the next

working day at same time and place.

3. The tender form shall be used only by the person in whose name it is issued and for the work

specified in the Schedule attached to the tender form.

4. Before submitting the tender, the tenderer is expected to study and scrutinize all the

conditions in the agreement to be executed, the draft of which can be had for perusal

at the Divisional Forest Office on any working day during office hours. They are also

requested to study the detailed tender conditions attached to the tender document. No

plea of ignorance of the agreement conditions or no complaint regarding the said

conditions received after putting in the tender will be entertained.

5. Before submitting the tender the tenderer shall visit the area of work to study all the

field conditions and nature of work and quote his rate accordingly. No enhancement

in rate due to any reason will be entertained thereafter.

6. The tenderer shall quote in the appropriate column in the tender a firm percentage of basic rates per Hecotr amount for raising the plantation and maintenance of plantation up to 3rd year or as in the Schedule both in figures as well as in words. In the case of the tenderer quoting different total rate in words and figures also, lower of the same only be considered valid and shall be binding on him/her. If the Kerala Forest Department feels that the total amount quoted or item wise rate of any of the items quoted is unworkable due to variance to the lower side to an abnormal level with the Kerala Forest Department's estimated rates, the tenderer may be required to furnish satisfactory explanation on the above respect. In such an event, the Kerala Forest Department has the option to collect a Additional Security Deposit to the tune of 10% of the quoted amount from the tenderer before issuance of confirmation orders. If the explanation furnished is not found satisfactory or no explanation is furnished, the Kerala Forest Department has the right to deny the offer of work to the tenderer even though he/she is the lowest tenderer.

7. Tender received after the specified date and time or received without the requisite

enclosures or tenders not written up in proper order or form will not be honoured.

8. All the corrections in the tender form shall be initialed by the tenderer himself.

9. Part I (Technical Bid) of the tenders received in due time will be opened by the

Divisional Forest Officer or his deputy at his office at 4 P.M on 25.01.2025 in the

presence of such of the tenderers present on that occasion.

10. Part-II tenders (Financial bid) of the tenderers whose Part-I tenders have been

accepted only will be opened subsequently. The time and place of opening of the Part

II tenders will be announced immediately on the acceptance of the Part I tender.

11.

The lowest tender will ordinarily be accepted, but the authority competent to accept

the tender reserves to himself the power of accepting or rejecting any tender without

assigning any reason therefore.

12. No tenderer will be permitted to withdraw his offer within three months from the date

of opening of the financial bid.

13. The tenderer whose tender is accepted will be informed regarding acceptance of his tender by a Confirmation Order issued by registered letter bearing the address mentioned in the tender. The successful tenderer, within 15 days of receipt of confirmation of his tender, shall have to execute an agreement in the prescribed form [Appendix 13] on a plain paper to be supplied by him at his cost. If the Contractor fails to execute the agreement during the period, the tender will be cancelled, and the Ernest Money Deposit submitted by the tenderer shall stand forfeited to the Kerala Forest Department. The work will be carried out at the risk and cost of the tenderer or through any other method (including through the next higher tenderer). The loss, if any, to the Government consequent to the default, if not paid by the defaulter within a reasonable time specified by the Divisional Forest Officer, shall be treated as arrears

on public revenue to be recovered from the defaulter under the provisions of the

Kerala Revenue recovery Act 1968 and in such other manner as the Government may

deem fit. The defaulter however will not be entitled for gain, if any.

14. The successful tenderer while signing the agreement shall furnish a security deposit

for an amount equal to 05 per cent of the total Probable Amount of Contract.

The security deposit will be released only after the successful completion of the

contract work and after producing the Non Liability Certificate from the concerned

officers.

15. The successful tenderer shall give an undertaking at the time of execution of

agreement that he shall not sell, mortgage or otherwise alienate the properties covered

by the solvency certificate during the currency of the contract.

16. The post-offers and representations sent, after confirmation of the tender in respect of

work shall at no account be considered.

17. The Earnest Money Deposit of the unsuccessful tenderers will be returned as soon as

possible after the tenders are finalized.

18. The quantities of work shown in the Schedule are approximate and it may vary on

actual execution of work.

19. The area shown in the tender schedule is approximate. The actual extent of the

contract area may vary as per the final survey report, which will be binding on the

successful tenderer.

20. The contractor has to keep the plantation free from weeds throughout the contract

period.

21.. Payment shall be made to the contractor at any stage as decided by the paying

authority and based on the works so far completed to the full satisfaction of the paying

authority and after proper inspection and recording of the works done/completed and

as per the existing provisions of the contract system.

22. It shall be open to the Divisional Forest Officer to cancel/reduce the quantity of work to be executed in the attached schedule based on site conditions in each year and the Divisional Forest Officer's decision will be binding on the successful tenderer. If any additional item/s of work which are not included in the schedule are required to be carried out inevitably for reasons to be recorded, in the contract area during the course of contract period, the successful tenderer is bound to execute that work for which payment shall be worked out based on the rate quoted above or below the estimate amount. If the cost quoted is above estimate amount, the payment shall be made based on the estimate amount/ schedule rate and if the cost of work is below the estimate amount, payment shall be made as per the quoted rate.

23. Kerala Forest Department reserves the right to execute the work through any other

mode of execution other than through contract system if the tender offered by the

contractors is not feasible according to the Department.

24. All the taxes prevailing at the time of tender is applicable to this tender.

2. ദർഘാസ് / ലേലത്തിൽ പങ്കെടുക്കുന്നവർ ദർഘാസ് / ലേലത്തിന് മുൻപായി വിൽപ്പനയ്ക്ക് വെച്ചിരിക്കുന്ന വിഭവങ്ങളുടെ ഗുണനിലവാരവും മറ്റും നേരിൽ ക­് ബോധ്യപ്പെഠ­തൊണ്. ലേലത്തിനുശേഷം ഈ വക കാര്യത്തെക്കുറിച്ചുള്ള യാതൊരു പരാതിയും പരിഗണിക്കുന്നതല്ല.

³. വിജയിയായ ദർഘാസ് / ലേലക്കാരൻ ലേലം കഴിഞ്ഞയുടൻ മൊത്ത വില 20000/- രൂപയിൽ കുറവാണെങ്കിൽ മുഴുവൻ തുകയും അതിൽ കൂടുതലാണെങ്കിൽ മൊത്തം ലേലത്തുകയുടെ 35% വില, കുറഞ്ഞത് 20000 രൂപയും, കൂടിയത് 100000 രൂപയും എന്ന കണക്കിൽ മൊത്തം പണമായോ ഡി.ഡി ആയോ ലേല ദിവസം തന്നെ അടയ്ക്ക­േതാണ്. ലേല സംഖ്യയുടെ 35% തുക 1 ലക്ഷം രൂപയിൽ കൂടുതലാണെങ്കിൽ ലേല ദിവസം അടച്ച 100000 (ഒരു ലക്ഷം) രൂപ കിഴിച്ച് ബാക്കി തുക ലേലദിവസം കഴിഞ്ഞ് 7 പ്രവൃത്തി ദിവസത്തിനകം ട്രഷറിയിൽ അടച്ച് രസീതി ഹാജരാക്ക­േതാണ്. നിശ്ചിതതുക ഒടുക്കാതിരുന്നാൽ ലേലം റദ്ദ് ചെയ്തതായി കണക്കാക്കി നിരതദ്രവ്യം ഉൾപ്പെടെയുള്ള തുക സർക്കാരിലേയ്ക്ക് മുതൽക്കൂട്ടുന്നതാണ്. അഡ്വാൻസ് തുക അവസാനം നീക്കം ചെയ്യുന്ന വന വിഭവങ്ങളുടെ വിലയിലേയ്ക്ക് മാത്രമേ വകകൊള്ളിക്കുകയുള്ളൂ.

4. ദർഘാസ് ലേലം സ്ഥിരപ്പെടുത്തിയതായുള്ള അറിയിപ്പും ബാക്കി തുകയും അടച്ച് തീർക്കുവാനുള്ള ചലാൻ ഫോറവും അയച്ച തിയ്യതി മുതൽ 15 ദിവസത്തിനകം ചലാൻ ഫോറത്തിൽ കാണിച്ചിട്ടുള്ള തുക സർക്കാരിന്റെ നിർദ്ദിഷ്ട ഖജനാവിൽ അടച്ച് ചലാൻ രശീത് റെയിഞ്ച് ഓഫീസർക്ക് എത്തിച്ച് കൊടുക്ക­േതാണ്.

⁵. മേൽ സൂചിപ്പിച്ച 15 ദിവസത്തിനകം തുക അടയ്ക്കാത്തപക്ഷം പതിനെട്ട് ശതമാനം (18%) പലിശയോടു കൂടി ബാക്കി തുക അടക്കുന്നതിന് ഒരു മാസം (30 ദിവസം) വരെയും, ഇരുപത്തിനാല് ശതമാനം (24%) പലിശയും പിഴപലിശയിന്മേൽ ര­രശതമാനം (2.5%) ശതമാനം സർചാർÖും ഈടാക്കി കൊ­് അടുത്ത ഒരു മാസം വരെയും (30 ദിവസം) 36% പിഴപ്പലിശയും പിഴപലിശയിന്മേൽ 5% സർചാർÖും ഈടാക്കി കൊ­് വീ­ും ഒരു മാസം കൂടിയും (30 ദിവസം) ഇങ്ങനെ ആകെ 3 മാസം വരെ (90 ദിവസം) റെയിഞ്ച് ഓഫീസർക്ക് കാലാവധി ദീർഘിപ്പിച്ച് അനുവദിക്കാവുന്നതാണ്. അപ്രകാരം ദീർഘിപ്പിച്ച സമയപരിധിക്കകവും പണമടക്കാതെ വന്നാൽ, അടച്ച തുക സർക്കാരിലേക്ക് ക­ുകെട്ടുകയും ലേലം കൊ­ വഹകൾ വീഴ്ചക്കാരന്റെ നãോത്തരവാദിത്വത്തിൽ പുനർദർഘാസ് / ലേലം വഴി വിറ്റഴിക്കുന്നതുമാണ്.

⁶. ദർഘാസ്/ലേലം സ്ഥിരപ്പെടുത്തിയത് അറിയിക്കുന്ന തിയ്യതി മുതൽ 130 ദിവസത്തിനകം (നൂറ്റിമുപ്പത്ത് ദിവസം) എല്ലാ തുകയും അടച്ചുതീർക്കാത്തപക്ഷം ദർഘാസ്/ലേലം റദ്ദാക്കുന്നതും ആയത് ദർഘാസ്/ലേലക്കാരന് 10 ദിവസത്തെ അവധി വെച്ച് മുൻകൂടി നോട്ടീസ് കൊടുത്തതിനു ശേഷം അതെ റെയിഞ്ചിലെ ദർഘാസ്/ലേലത്തിൽ പ്രകാരം പുനർലേല വില്പന നടത്തുന്നതുമാണ്. തന്മൂലം ഡിപ്പാർട്ട്മെന്റിന് ഉ­ാകുന്ന എല്ല കãനãങ്ങൾക്കും ആദ്യ ലേലക്കാരൻ / ദർഘാസക്കാരൻ ഉത്തരവാദിയാകുന്നതുമാണ്.

7. ദർഘാസ്/ലേലം നടത്തുന്ന ഉദ്യോഗസ്ഥന്റെ താഴെപ്പറയുന്ന അധികാരങ്ങൾ ചോദ്യം ചെയ്യാൻ പാടുള്ളതല്ല.

അ. ഏതെങ്കിലും വ്യക്തിയുടെയോ സ്ഥാപനത്തിന്റേയോ നിരതദ്രവ്യം യാതൊരു കാരണവും പറയാതെ സ്വീകരിക്കുകയോ നിരാകരിക്കുകയോ ചെയ്യാവുന്നതാണ്.

ആ.ദർഘാസ്/ലേലത്തിനായി പരസ്യപ്പെടുത്തിയ ഏതെങ്കിലും ലോട്ടുകൾ വിൽക്കാതിരിക്കുകയോ പരസ്യപ്പെടുത്തിയിട്ടില്ലാത്ത ഏതെങ്കിലും ലോട്ട് വിൽക്കുകയോ ചെയ്യാവുന്നതാണ്.

ഇ. ലേലത്തിന് പ്രതികൂലമായി ബാധിക്കുന്ന ഏതെങ്കിലും നടപടികളിൽ ഏർപ്പെട്ടെന്ന് ബോദ്ധ്യപ്പെടുന്ന പക്ഷം ലേലക്കാരനെ ലേലത്തിൽ നിന്നോ ലേല സ്ഥലത്തു നിന്നോ പുറത്താക്കാവുന്നതാണ്.

ഉ. ലേലം വിളിക്കുന്നവർ പരോക്ഷമായി യോജിച്ച് സർക്കാരിനെ പ്രതികൂലമായി ബാധിക്കുന്ന നടപടികളിൽ ഏർപ്പെട്ട് പ്രതീക്ഷിച്ച വില ലഭിക്കുന്നില്ല എന്ന് ബോദ്ധ്യപ്പെട്ടാൽ ലേലം നിർത്തി വയ്ക്കാൻ ഡിവിഷണൽ ഫോറസ്റ്റ് ഓഫീസർക്ക് അധികാരമു­ായിരിക്കുന്നതാണ്.
