Sub:—Labour and Skills Department—Industrial Dispute between the Management of Vasuprada Plantations Limited, Thrissur and Smt. Naseema, K. M., Tapping Worker—Referred for adjudication—Revised order—Compliance of judgement in WP(C) No. 34800/2025—

Orders issued.

Read:—(1) G. O. (Rt.) No. 911/2025/ LBR dated 31-7-2025.

(2) Judgment dated 27-10-2025 of the Hon'ble High Court of Kerala in WP(C) No. 34800/2025.

(3) Letter No. LCO/5063/2024- IR(4) dated 22-12-2025 from the Labour Commissioner, Thiruvananthapuram.

An industrial dispute relating to denial of employment to Smt. Naseema, K.M., who was working as a tapping worker in Vasuprada Plantations Limited, Thrissur, was earlier referred for adjudication before the Hon'ble Labour Court, Ernakulam, vide reference order cited as 1st paper above.

2. Aggrieved by the said reference order, the management of Vasuprada Plantations Limited filed WP(C) No. 34800/2025 before the Hon'ble High Court of Kerala. As per the judgement cited as 2nd paper above, the Hon'ble High Court directed to pass a fresh order referring the dispute between Smt. Naseema, K.M. and Shri Vasuprada Plantations Limited, Chimmini, Pudukkad Central House, Palapilly P.O., Thrissur, represented by its President, Mr. P. N. Ravunni, S/o Late. Sri K.M.C. Kurup, residing at Chimony Estate Bungalow, Palappilly P. O., Thrissur, Pin-680 304 for adjudication of the Labour Court, Ernakulam.

3. Whereas, the Government are of opinion that an industrial dispute exists between Sri P. N. Ravunni, S/o late Sri. K.M.C. Kuruppu, President, Vasuprada Plantations Limited, Chimmini Estate Bungalow, Palappilly P.O., Thrissur-680 304 and the work women of the above referred establishment Smt. Naseema, K. M., C/o Shamsudheen Kunjumoithu, House No. 5, Near Bank, Padoor P.O., Chavakkadu, Thrissur-680 524 represented by the Secretary, Kerala State Estate & Plantation Workers Union (TUCI), Second Floor, Aroma Building, Pudukkad - 680 301 in respect of matters mentioned in the annexure to this order;

4. And whereas, in the opinion of Government it is necessary to refer the said industrial dispute for adjudication;

5. Now, therefore, in exercise of the powers conferred by Section 10(1) (c) of the Industrial Disputes Act of 1947 (Central Act XIV of 1947) the Government hereby direct that the said industrial dispute be referred for adjudication to the Labour Court, Ernakulam. The Labour Court will pass the award within a period of three months.

6. This order is issued in full compliance with the judgement of the Hon'ble High Court of Kerala dated 27-10-2025 in WP(C) No. 34800/2025.

ANNEXURE

"Whether the dismissal of Smt. Naseema, K. M., Tapping Worker, by the Management of Shri Vasuprada Plantations Limited, Chemoni, Pudukkad Central Office, Palappilly P. O., Thrissur-680 304 is justifiable or not? If not, what relief she is entitled to get?''

O., Thrissur-680 304 and the workman of the above referred establishment Sri Sivaraman. C. K. S/o Karappan, Chinathu House, Palappilly P. O., Thrissur-680 304 in respect of matters mentioned in the annexure to this order;

And whereas, in the opinion of Government it is necessary to refer the said industrial dispute for adjudication;

Now, therefore, in exercise of the powers conferred by Section 10(1) (c) of the Industrial Disputes Act of 1947 (Central Act XIV of 1947) the Government hereby direct that the said industrial dispute be referred for adjudication to the Labour Court, Ernakulam. The Labour Court will pass the award within a period of three months.

P, W/o Abdul Razak, Jannathu, Sivaji Nagar, Adhi Kadalayi, Kannur-670 003 in respect of matters mentioned in the annexure to this order;

And whereas, in the opinion of Government it is necessary to refer the said industrial dispute for adjudication;

Now, therefore, in exercise of the powers conferred by Section 10(1) (c) of the Industrial Disputes Act of 1947 (Central Act XIV of 1947) the Government hereby direct that the said industrial dispute be referred for adjudication to the Labour Court, Kannur. The Labour Court will pass the award within a period of three months.

ANNEXURE

"Whether the denial of employement to worker Smt. Suneera. P. P., Billing Clerk of M/s S&S Marketting, K. P. Plaza, Parakandi, Kannur-670 001, by the Management is justifiable ?

If not what reliefs the workers are entitled to ?"
