का.आ..89- -भारत के संविधान के अनुच्छे द 309 के प्रावधान द्वारा प्रदत्त शक्तयिों का प्रयोग करते हुए और इसी विषय पर पहले की सभी अधिसूचनाओं का अधिक्रमण करते हुए संघ राज्य लद्दाख के उपराज्यपाल (प्रशासक), यहां लद्दाख लीगल मेटर ोलॉजी विभाग में उपनियंत्रक के पद पर भती की विधि को विनियमित करने वाले निम्नलिक्तखत नियम बनाते हैं, अथाात्:
1, संप्तिि शीषषक और प्रारंभ.
(i) इन नियमों को लद्दाख कानूनी मेट्रोलॉजी विभाग में लद्दाख प्रशासन उप नियंत्रक "समूह ए राजपत्रित पद" भर्ती नियम, 2024 कहा जाएगाLADAKH GAZETTE : EXTRAORDINARY 2 (ii) ये नियम आधिकारिक राजपत्र में उनके प्रकाशन की तारीख से लागू होंगे। 2 पद संख्या, वगीकरण और वेतन मैटिि क्स में स्तर - उि पदों की संख्या, इसका वगीकरण और वेतन मैटिर क्स में इसके स्तर के बारे में अनुबंधित अनुसूची के पररशिष्ट 2, 3 और 4 में निदिाष्ट किया जाएगा। 3. भती की विधि, आयु सीमा, योग्यता: - उि पदों से संबंधित भती की विधि, आयु सीमा, योग्यता और अन्य मामले अनुसूची के पररशिष्ट 5 से 13 में निदिाष्ट किए जाएं गे।
4. सीधी भती द्वारा नियुक्ति के लिए निवासी मानदंड का प्रावधान: - नियुक्ति की पात्रता संघ राज्य लद्दाख में लागू अधिनियम, नियम, विनियम या आदेश में निदिाष्ट निवासी आवश्यकताओं के अधीन होगी l 5. अयोग्यता - कोई व्यक्ति नहीं
क. जिसने एक ऐसे व्यक्ति के साथ विवाह किया है जिसका पति जीवित है;
या
ख. जिसने एक ऐसे व्यक्ति(ओं) के साथ विवाह किया है जिसका पति जीवित है, वह उि पद के लिए योग्य होगा।
लेकिन लद्दाख के उपराज्यपाल (प्रशासक) को यदि इस बात से संतुष्ट हों कि ऐसा विवाह व्यक्ति(ओं) के व्यक्तगित कानून के तहत संविदानिक है और विवाह के दू सरे पक्ष के लिए या ऐसा करने के अन्य कारण हैं, तो उन्हें इन नियमों के प्रचालन से छू ट दी जा सकती है। 6. छू ट, की शक्ति - जहां उपराज्यपाल (प्रशासक) का यह मत है कि ऐसा करना आवश्यक या उचित है, वह अपने लिक्तखत आदेश में कारण दजा करके और यूपीएससी के परामशा से, किसी भी वगा या श्रेणी के व्यक्तयिों के संबंध में इन नियमों के किसी भी प्रावधान को छू ट, दे सकते हैं।
7. बचत - इन नियमों में कु छ भी ऐसा नहीं होगा जो संघ राज्य लद्दाख के प्रशासन द्वारा जारी नियमों, निदेशों या आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों और अन्य विशेष श्रेणियों के लिए प्रदान किए जाने वाले आरक्षण, आयु सीमा में छू ट और अन्य सुविधाएं प्रभावित करे ।

संयुक्त विधि (प्रतिनियुक्ति/पदोन्नति)
कें द्र/राज्य सरकारों/ संघ राज्यक्षेत्रों के अधिकारियों से:
(क) (i) मूल संवर्ग/विभाग में नियमित आधार पर अनुरूप पद धारण करना; या (iii) मूल संवर्ग/विभाग में वेतन मैट्रिक्स के वेतन स्तर-10 या समकक्ष पद पर 05 (पांच) वर्ष की नियमित सेवा के साथ; या
(iv) मूल संवर्ग/विभाग में वेतन मैट्रिक्स के वेतन स्तर-9 या समकक्ष पद पर 07 (सात) वर्षों की नियमित सेवा के साथ; या
(v) मूल संवर्ग/विभाग में वेतन मैट्रिक्स के वेतन स्तर-8 या समकक्ष पद पर 08 (आठ) वर्षों की नियमित सेवा के साथ;
या
ख) निम्नलिखित शैक्षणिक योग्यता और अनुभव रखने वाले:
(i) किसी मान्यता प्राप्त विश्वविद्यालय या संस्थान से भौतिकी विषय के साथ विज्ञान स्नातक या इंजीनियरिंग स्नातक;
(ii) लीगल मेट्रोलॉजी के क्षेत्र में तीन साल का अनुभव।
टिप्पणी 1: वेतन स्तर-8 (रु. 47600-151100) में विभागीय सहायक नियंत्रक, जो इस ग्रेड में 8 (आठ) वर्षों की नियमित सेवा और प्रतिनियुक्ति के आधार पर नियुक्ति के लिए निर्धारित शैक्षणिक योग्यता और अनुभव रखते हैं, उन्हें बाहरी उम्मीदवारों के साथ विचार किया जाएगा। यदि विभागीय उम्मीदवार को इस पद पर नियुक्ति के लिए चयनित किया जाता है, तो इसे पदोन्नति द्वारा भरा गया माना जाएगा।
मानक टिप्पणी:
फीडर श्रेणी में विभागीय अधिकारी जो पदोन्नति की सीधी पंक्ति में हैं, उन्हें प्रतिनियुक्ति के आधार पर नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे। इसी प्रकार, प्रतिनियुक्ति पर आए अधिकारी पदोन्नति द्वारा नियुक्ति के लिए पात्र नहीं होंगे।
प्रतिनियुक्ति की अवधि, जिसमें उसी या किसी अन्य संगठन में इस नियुक्ति से ठीक पहलेLADAKH GAZETTE : EXTRAORDINARY 5 धारण किए गए किसी अन्य बाह्य संवर्ग पद पर प्रतिनियुक्ति की अवधि भी शामिल है

Ladakh, the 20th of September, 2024
S.O.89, -In exercise of the powers conferred by the proviso to Article 309 of the Constitution of India and in supersession of all earlier notifications on the subject matter, the Lieutenant Governor (Administrator) of Union territory of Ladakh, hereby makes the following rules regulating the method of recruitment to the post of Deputy Controller in the Ladakh Legal Metrotogy Department, namely:
1. Short title and commencement:-
(i) These rules may be called the Ladakh Administration Deputy Controller in Ladakh Legal Metrology Department "Group A Gazetted Post" Recruitment Rules, 2024.
(ii) These rules shall come into force from the date of their publication in the Official Gazette.
2 Number of posts, classification and Level in the Pay Matrix: -
The number of said posts, its classification and Level in the Pay Matrix attached thereto shall be as specified in paras 2, 3 & 4 of the Schedule annexed hereto.
3. Method of recruitment, age limit, qualifications: -
The method of recruitment, age limit, qualifications and other matters relating to said posts shall be as specified in paras 5 to 13 of the Schedule annexed hereto.
4. Provision for Resident Criteria for appointment by direct recruitment: -
The eligibility for appointment will be subject to residency requirements prescribed in any Act, Rule, Regulation or Order in force in the Union territory of Ladakh.
5. Disqualification: -
No person,
a. who has entered into or contracted a marriage with a person having a spouse living;
OR
b. who, having a spouse living, has entered into or contracted a marriage with any person(s) shall be eligible for appointment to the said post.
Provided that the Lieutenant Governor (Administrator) of Ladakh may, if satisfied that such marriage is permissible under the personal law, applicable to such person(s) and the other party to the marriage or there are other grounds for so doing, exempt any person from the operation of these rulesLADAKH GAZETTE : EXTRAORDINARY 7 6. Power to relax: -
Where the Lieutenant Governor (Administrator) is of the opinion that it is necessary or expedient to do so, he may, by order for reasons to be recorded in writing and in consultation with UPSC, relax any of the provisions of these rules with respect to any class or category of persons.
7. Savings: -
Nothing in these rules shall affect reservations, relaxation in age limit, and other concessions required to be provided for the Scheduled Castes, Scheduled Tribes, and other special categories in accordance with the Rules, Instructions or Orders issued by the Administration of Union territory of Ladakh.

Composite method (Deputation/Promotion)
From officers under Central/State Governments/UTs:
(a) (i) Holding analogues post on regular basis in the parent cadre/department; or
(ii) With 05 (Five) years regular service in the Pay Level-l0 in the pay matrix or equivalent in the parent cadre/department; Or
(iii) With 07 (Seven) years regular service in the Pay Level-9 in the pay matrix or equivalent in the parent cadre/department; Or
(iv) With 08 (Eight) years regular service in the Pay Level-8 in the pay matrix or equivalent in the parent cadre/department;
And
(b) Possessing following educational qualifications and experience:
(i) Bachelor of Science with Physics as one of the subjects or Bachelor of Engineering from a recognized University or institute;
(ii) Three years' experience in the field of legal metrology.
Note 1: The departmental Assistant Controller in Pay level-8 (Rs. 47600-151100) with 8 (Eight) years of regular service in the grade and having educational qualifications and experience prescribed for considering appointment on deputation basis is considered along with outsiders. If the departmental candidate is selected for appointment the post, it shall be treated as having been filled by promotion
Standard Note:
The departmental officers in the feeder category who are in the direct line of promotion shall not be eligible for consideration for appointment on deputation similarly the deputationists shall not be eligible for consideration for appointment by promotion. The period of deputation including the period of deputation in another ex-cadre post held immediately preceding this appointment in the same or some other
| Organization/department of the Central Government shall ordinarily not exceed three years. The Maximum age limit for appointment by deputation shall be Not exceeding 56 years as on the last date of receipt of applications | |
