क्र. एफ 5-3 ( 9-4 ) -2017-उन्तीस-2.- भारत के संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों को प्रयोग में लाते हुए, मध्यप्रदेश के राज्यपाल , एतद्वारा , खाद्य, नागरिक आपूर्ति एवं उपभोक्ता संरक्षण विभाग , मध्यप्रदेश राज्य उपभोक्ता विवाद प्रतितोषण आयोग में रजिस्ट्रार के पद पर भर्ती का तरीका विनियमित करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्ः-

नियमों का संक्षिप्त नाम मध्यप्रदेश राज्य उपभोक्ता विवाद प्रतितोषण आयोग रजिस्ट्रार, 1. संक्षिप्त नाम और प्रारंभ. ( 1 ) इन

(भर्ती तथा सेवा की शर्तें ) नियम, 2019 है.

(2) ये राजपत्र में इनके प्रकाशन की तारीख से प्रवृत्त होंगे.

2. लागू होना.- ये नियम अनुसूची- एक के कॉलम ( 1 ) में विनिर्दिष्ट पद पर लागू होंगे.

3. परिभाषाएं.-इन नियमों में, जब तक संदर्भ से अन्यथा अपेक्षित न हो,-

(क) सेवा के संबंध में, " नियुक्ति प्राधिकारी " से अभिप्रेत है , मध्यप्रदेश शासन;

(ख) " आयोग" से अभिप्रेत है, मध्यप्रदेश राज्य उपभोक्ता विवाद प्रतितोषण आयोग;

(ग) " शासन " से अभिप्रेत है, मध्यप्रदेश शासन ;

(घ) " राज्यपाल " से अभिप्रेत है , मध्यप्रदेश के राज्यपाल;

(ङ) " अनुसूची" से अभिप्रेत है, इन नियमों से संलग्न अनुसूची;

(च) " सेवा " से अभिप्रेत है, मध्यप्रदेश राज्य उपभोक्ता प्रतितोषण आयोग के रजिस्ट्रार पद की सेवा;

(छ) " राज्य" से अभिप्रेत है, मध्यप्रदेश राज्य;

4. पदों की संख्या, वर्गीकरण एवं वेतन.- उक्त पदों की संख्या, उनका वर्गीकरण और वेतन या उससे संलग्न वेतनमान जो इन नियमों से उपाबद्ध अनुसूची- एक यथा विनिर्दिष्ट होगा.

5. भर्ती का तरीका एवं अन्य अर्हतायें. - उक्त पदों पर भर्ती का तरीका, अर्हतायें और अन्य संबंधित विषय वही होंगे , जैसे कि अनुसूची- दो में विनिर्दिष्ट हैं.

6. सेवा में नियुक्ति.- इन नियमों के प्रारंभ होने के पश्चात् रजिस्ट्रार के पद पर नियुक्ति राज्य शासन द्वारा की जाएगी .

7. निर्हताएं. वह व्यक्ति-

(क) जिसने ऐसे व्यक्ति से, जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है, या

(ख) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी अन्य व्यक्ति से विवाह किया है , उक्त पदों पर नियुक्ति के पात्र नहीं होगाः

परन्तु यदि राज्य सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति के अन्य पक्षकार को लागू स्वीकार्य विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी.

(ग) जिसे महिलाओं के विरुद्ध अपराध के लिए दोषसिद्ध ठहराया गया हो , परंतु जहां ऐसे व्यक्ति के विरुद्ध न्यायालय में मामला लंबित है तो उसकी नियुक्ति आपराधिक मामले का अंतिम विनिश्चिय होने तक लंबित रखी जाएगी.

8. पात्रता विनिश्चिय करने की शक्ति.- प्रतिनियुक्ति के लिए किसी अधिकारी का पात्रता या अपात्रता के विनिश्चिय के संबंध में राज्य शासन का निर्णय अंतिम होगा.

9. प्रतिनियुक्ति हेतु चयन प्रक्रिया.- प्रतिनियुक्ति हेतु प्राप्त नामों पर विचारोपरांत राज्य शासन नियुक्ति- आदेश जारी करेगा .

10. शिथिल करने की शक्ति. जहां राज्य सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, तो वह लिखित में कारणों को अभिलिखित करते हुए आदेश द्वारा इन नियमों के किसी उपबंध को शिथिल कर सकेगी.

11. रजिस्ट्रार के कृत्य एवं कर्तव्य निम्नानुसार होंगे-

( 1 ) रजिस्ट्रार आयोग के आहरण एवं संवितरण अधिकारी का कार्य करेगा.

(2) रजिस्ट्रार आयोग एवं जिला उपभोक्ता फोरम के लिपिकवर्गीय स्थापना का प्रमुख होगा और ऐसी शक्तियों एवं कृत्यों का प्रयोग करेगा जो कि आयोग के अध्यक्ष द्वारा उसे दिए गये हैं.

(3 ) रजिस्ट्रार शासन स्तर पर होने वाली सभी बैठकों में शामिल होगा.

(4) रजिस्ट्रार आयोग के जनसम्पर्क अधिकारी का कार्य करेगा.

(5 ) रजिस्ट्रार उपभोक्ता संरक्षण अधिनियम, 1986 के उद्देश्यों का क्रियान्वयन सुनिश्चित करायेगा.

(6 ) प्रदेश के सभी जिला फोरम में दर्ज , लंबित एवं निराकृत प्रकरणों की सावधिक रिपोर्ट बुलाने एवं मॉनीटरिंग करने के लिए उन पर उसका प्रशासनिक नियंत्रण होगा.

12. सेवा शर्तें.- रजिस्ट्रार की सेवा शर्तें एवं पद से हटाने की प्रक्रिया वही होगी जो उनके मूल विभाग में लागू होती है , परंतु राज्य शासन बिना कोई कारण बताए उन अधिकारियों को उनके मूल विभाग में वापस भेज सकेगी.

भर्ती की पद्धतिः (1)

( 1 ) राज्य सरकार या मध्यप्रदेश न्यायिक सेवा अथवा अर्द्ध- न्यायिक प्राधिकरण के अधीन ऐसे अधिकारीः

प्रतिनियुक्ति द्वारा शत प्रतिशत

(क) जो मूल संवर्ग अथवा विभाग में नियमित आधार पर समकक्ष पद धारण किए हों; या

(ख) किसी न्यायालय में अतिरिक्त जिला न्यायाधीश के रूप में कार्य करने का अनुभव; या

(2 ) राज्य शासन की सेवाओं में राज्य प्रशासनिक सेवा के अपर कलेक्टर स्तर के अधिकारी , जिन्हें अनुविभागीय दण्डाधिकारी एवं अपर कलेक्टर के रूप में विभिन्न अधिनियमों के अंतर्गत अर्द्धन्यायिक कार्य का अनुभव; या

(3 ) राज्य शासन की सेवाओं में संयुक्त संचालक या उससे वरिष्ठ स्तर के अधिकारी .

टिप्पणी 1 : रुपये 7900 में नियमित सेवा वाले अधिकारी से अन्यून स्तर के मध्यप्रदेश शासन के अभ्यर्थियों पर विचार किया जाएगा.

टिप्पणी 2 : इस पद पर प्रतिनियुक्ति की अवधि एक बार में तीन वर्ष से अधिक नहीं होगी . परन्तु ऐसे अधिकारी की प्रतिनियुक्ति के लिए आयु सीमा 59 वर्ष से अधिक नहीं होगी.

S. No. F 5-3- (9-4) 2017 - ΧΧΙΧ- 2 . In exercise of the powers conferred by the proviso to Article 309 of the constitution of India , the Governor of Madhya Pradesh , hereby , makes the following rules regulating the method of recruitment to the post of Registrar in the Madhya Pradesh State Consumer Disputes Redressal Commission , Government ofMadhya Pradesh , Food and Civil Supplies department , namely:-

RULES

1. Short title and commencement.-( 1 ) These rules may be called the Madhya Pradesh State Consumer Disputes Redressal Commission Registrar (Recruitment and Service Conditions ) Rules , 2019 .

(2) They shall come into force from the date of their publication in the official Gazette .

2. Applicability.- these Rules shall apply to the post specified in column ( 1 ) of the Schedule- I .

3. Definitions . In these rules , unless the context otherwise requires ,-

(a) In relation to the service , " appointment authority " means the Government of Madhya Pradesh;

(b) "Commission " means , the Madhya Pradesh State Consumer Disputes Redressal Commission;

(d) "Governor " means the Governor of Madhya Pradesh;

(e) "Schedule " means the Schedules attached to these rules ;

(f) "Service " means the Service of the post of Registrar of Madhya Pradesh State Consumer Disputes Redressal Commission ;

(g) "State " means the State of Madhya Pradesh;

4. Number of posts , classification and pay. The number of the said post , their classification and their pay or the scale attached thereto shall be as specified in Schedule -I .

5. Method of recruitment and other qualifications . The method of recruitment , qualifications and other related matters shall be the same as specified in Schedule- II .

6. Appointment in Service. After the commencement of these rules , the appointment to the post of Registrar shall be made by the State Government .

7. Disqualification . No person-

(a) who has entered into or contracted a marriage with a person having a spouse living ; or (b) who having a spouse living , has entered into or shall contract a marriage with any person , be eligible for appointment to the said posts:

Provided that , if the State Government is satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for doing so , it may exempt any person from the operation of this rule .

Provided that where a case is pending in court against such person , the appointment shall be kept pending till the final decision of the case .

8. Power to decide eligibility. The decision of the State Government shall be final in regard to determine the eligibility or ineligibility of any applicant .

9. Selection Process for Deputation: After the consideration on the names received for the appointment on the post of Registrar, State Government shall issue the appointment order.

10. Power to Relax.- Where the State Government is of the opinion that it is necessary of expedient to do so, by order in writing with reasons may relax any provision of these rules .

11. Functions and Duties of the Registrar. The functions and duties of the Registrar shall be as under:-

(1) The registrar shall be drawing and disbursing officer of State Consumer disputes redressal commission .

(2) The Registrar shall be the head of the ministerial establishment of the Commission and District Con- sumer forum and shall exercise such powers and function as conferred upon him by the President of the Commission .

(3) The Registrar shall attend all the meeting at the government level .

(4) The Registrar shall act as Public Relations Officer of the Commission .

(5) The Registrar shall ensure inplementation of the consumer protection Act, 1986.

(6) The Registrar shall have administrative control over all the district foram in regard to ask for periodic report regarding the number of cases which have been registered , decided and pending .

12. Service Conditions . ( 1 ) The Service conditions of the officers appointed as Registrar and the procedure for their removal shall be same as applicable to the equivalent officers in their original department . However, the State Government may send back such officers to their perent departments without specifying any reason :-

(a) Who holds equivalent positions on regular basis in the original cadre or department ;

(b) Who has the experience of work as a Additional District Judge in any court ;

(2) Additional Collector level officers of the State Administrative Service in the service of the State Government, who has experi- ence of semi -judicial work under various Acts as Sub- Divisional Magistrate and Additional Collector ;

(3) The officers of the Joint Director level or above in the service of the State Government .

Note 1: Regular Officer not below the pay scale of Rs . 79900 of Madhya Pradesh Government shall be considered for the deputa- tion on this post.

Note 2: Deputation period will not be more than three years at one time but the maximum age limit would be 59 years for the deputation .
